Incentive to Examiners of OFB
 In connection with the subject issue a High Power Committee has been constituted to formulate an incentive scheme for the employees of O.F Organisation who are not covered by the existing piece Work incentive scheme. To enable the committee to deliberate the issue in its justify perspective and render a report within the given time, the following information factory wise may please be furnished:
(i) Total number of examiners working in the Factory(Grade Wise)
(ii) Total number of Maintenance Workerd in the factory(Grade Wise)
(iii)Total Incentive paid to maintenance workers month wise during the period from 2012-2013-2014&2014-2015.
(iv)Total Piece work earnings(PWE) of the factory during the period 2012-2013,2013-2014&2014-2015.
(v) Piece Work Profit paid month wie(Value &percentage (%) both with and without ceiling)during the period 2012-2013,2013-2014&2014-2015.

ASSESSMENT OF INDWF OF THE RECOMMENDATION OF 7TH CPC

Minimum Pay : Though the Commission claims to have adopted Dr. Aykroyd formula in calculating minimum wages, the rates of commodities based on which the recommendations of the commission is made is significantly deviating from the rates mentioned in the National Council of JCM proposal. The JCM proposal in this regard should be reiterated. A comparison between existing and proposed VII CPC minimum pay is given below. The retrograde nature of the commission’s recommendations in this regard can by understood by this table.

From the above picture, it is clear that the VII CPC recommendations are not giving fair wages and the total pay increase is meager for next 10 years. Therefore, the minimum pay needs to be increased accepting the proposal of National Council JCM

NEW PAY STRUCTURE : The present system of pay bands and grade pay has been dispensed With and a matrix has been recommended. The New system is an extension of system Of Pay Scales, albeit, with a progressive Increment of 3% instead of fixed Increments. Unlike VI CPC, Minimum pay fixed on promotion is at par with the initial pay fixed direct recruits in the same grade. However, the fixation benefits on promotion, particularly from Level 2 to 3, 3 to 4 & Level 4 to 5 is significantly less compared to VI CPC Structure. National Council JCM demand of fixation benefit of two increments Should be reiterated or at least 5% should be ensured. A comparison of the promotion benefit for the after 10 years of service in their respective grades is given below.

PROPOSED NEW PAY SCALES MINIMUM (AFTER MERGER) SUBMITTED TO 7TH PAY COMMISSION – INDWF

Oral evidence submitted by National Council(JCM) Standing committee and the VII CPC on 23.03.2015, 24.03.2015 and on 31.03.2015 respectively.

The JCM(NC), JCM Constitutents including INDWF jointly prepared the memorandum on pay Structure, Pay determination, Allowances, leave, women issues, LTC, TA/DA and Retirement benefits etc., on 30.06.2014. Similarly, on behalf of INDWF, we have submitted matters relating to Defence Civilian Employees on service matters on 28.07.2014.

Defence Federations were invited from 30th to 31st march, 2015. INDWF met the VII CPC on 31.03.2015 in the VII CPC office, New Delhi from 1030 HRs to 1200 HRs.

Proposed new pay scales after removal of existing Grade Pay Rs.1900, Rs.2400, Rs.4600 and Rs.8700 in order to reduction of pay scales from 19 to 14.

Dear Colleagues,

In the recent meeting of the OFB JCM III Level council held on 25th and 26th August, 2014 at OFB HQrs, Kolkatta. During the meeting, the Staff side raised the issue regarding proper implementation of financial upgradation under ACP/MACP. Some Factories implemented properly and some factories denied implementing the same. Accounts authorities also did not agree the proposals of Factories.

In this regard, it was agreed by the official side to convene the Admin/Personnel officers of Ordnance Factories at NADP, Nagpur alongwith Accounts Officials for which the issues of
ACP/MACP is required to be forwarded for discussion to Ordnance Factory Board within 10 days.
Therefore all the Unions are requested to submit the details of ACP/MACP issues unsettled immediately with reference to the orders on the subject.

— Upto 31.08.2008 — ACP under Financial upgradations is to be granted on Promotional Hierarchy ignoring the promotion granted prior to 01.01.2006 for the erstwhile Group D employees and Labourer USK to Labourer SK.

— NIEs Group ‘D’ — Labourer SSK — then Tradesman SSK all should be ignored for ACP and their promotion to SK should also be ignored and 1st ACP should be Rs.2400 Grade Pay and 2nd ACP should be Rs.4200/- Grade Pay if they are eligible before 31.08.2008.

— NIEs Group ‘D’ categories like Peon, Duftry, Gestner Operator, Tracer etc., are eligible for promotions as per SRO of NIEs induding Durwans to supervisor and Chargeman. This has not been fully implemented, Whether this has been implemented If not what are the actions from the respective Factories.

— ACP till 31.08.2008 and MACP w.e.f. 01.09.2008 which is promotional hierarchy and Grade Pay hierarchy respectively whether this has been implemented/ Granted to the eligible employees.

Sub: Interaction meeting with 7th Central Pay Commission on INDWF memorandum – reg.

Indian National Defence Workers Federation is one of the constituents of National Council JCM representing the Central Government employees including Defence. On behalf of National Council JCM being one of the constituent organisatins have prepared a common memorandum consisting on the issues of Pay and Allowances and Terminal Benefits as well as retirement benefits etc., for which we are also party and unanimously accepted.

On the issues pertaining of Defence Civilian Employees to which this Federation is representing a separate memorandum has been prepared and submitted to the VII Central Pay Commission and was sent by e-mail as well as hard copy was handed over to the commission on 30.07.2014 at the office of VII CPC for consideration.

Defence Civilian employees consisting around 3.75 Lakhs next to the Indian Railways which is the second largest Central Government employees in India. These employees are mostly covered under the Factories Act and working in Industrial Establishments such as Ordnance Factories, DRDO, EME, AOC, MES, DGOA, DGAQA, Airforce, Navy, Army installations including Technical, Clerical, Storekeeping, Scientific, Paramedical, Teaching Staff, Security, Fire Staff and so on.

The Defence Civilian Staff are considered as fourth Arm of the Defence force in India and working side by side alongwith service personnels of the Armed Forces.

To consider the unique activities of the Defence Civilian employees we have proposed certain improvement and grant of benefit to Defence Civilian at par with service employees by the Pay Commission for a discussion alongwith the representatives fo the concerned Departmental category. The interaction meeting may also be convened for explaining the case of miscellaneous and isolate categories.

We request you to kindly consider to give dates for us in advance in a month’s time keeping in mind the holidays during the period to prepare ourselves to meet the Pay Commission. If the tentative dates are conveyed to us it will enable us to keep our other programmes accordingly so as to keep time spared for the meeting the commission.

Dear Affiliates,
The 7th CPC has circulated the questionnaire to all Federations/Unions and Associations and all stake holders and to the Ministries and Departments under Govt. of India; to response to the 7th CPC questionnaire by 9th May 2014. On receipt of this, the National Council JCM Staff Side met on 6th and 7th May 2014 at Delhi and discussed the issues. After due discussion, a consolidated report has been prepared on the questionnaire and has been forwarded to the 7th Pay commission on behalf of the JCM National Council constituents, in which the INDWF is also a constituent Organisation and submitted the same by Indian National Defence Workers Federation.
The National Council JCM has requested the 7th CPC to consider the proposal on behalf of entire Govt. Employees, irrespective of the proposals given by the unions/association. We have also on behalf of the Staff Side National Council JCM requested to extend the period for submission of the memorandum by the respective unions/Federations and Associations up to 30 June 2014.

However the Staff Side JCM National Council has decided to submit their proposal on pay and allowances as well as pensionary benefits etc. by 31.05.2014.

You are requested to forward the reply to 7th CPC questionnaire from your union directly addressed to the Secretary 7th CPC as submitted by National council and Federation. However you are free to include your view also. A copy of the same should be forwarded to the federation positively. (Copy of the Questionnaire is posted to your email and indwfblog spot.com).  Moreover, we have decided to hold Directorate wise meeting to prepare the proposals and after that a consolidated memorandum will be finalized. The final proposal will be submitted to the 7th CPC on or before 30th June 2014 by the Federation.

You are requested to prepare the proposals before the directorate wise meeting and forward it to Federation. Please carry a copy of proposal prepared by your union while coming to attend the directorate wise meeting.

The copy of reply to the questionnaire of 7th CPC will guide you to prepare the proposal. Read carefully and incorporate the views of National council in your proposal.

The respective Leader/Secretary and members of the Staff Side JCM’s should take the responsibility on collection of the proposals and prepare the document to be considered by the federation for submission to the 7th CPC.

Kindly prepare the documents and attend the meeting at, JCM House, New Delhi, on the date given above for each directorate.

Clarification on ACP / MACP to Ordnance Labourers

The issues involved on the above subject mentioned above had been examined in consultation with D(Civ), Defence(Finance) and DOP&T, DOP&T in the matter has advised in the following manner :
2. Consequent upon implementation of recommendations of 6th CPC, the posts of Unskilled (Labourers) and Semi Skilled Workers have been merged in PB-1 with GP Rs.1800/- (after imparting training) with designation as Tradesman Mate. In case of Tradesman Mate who had completed 30 years of service as on 01.09.2008, would be entitled for financial benefit under MACPS. Hence the following categories of employees are eligible for financial upgradation under ACP/MACPS :
(i) Employees completing 12 years of service upto 31.08.2008 - 1st ACP in GP Rs.1900/-
(ii) Employees completing 24 years of service upto 31.08.2008 - 2nd ACP in GP Rs.2400/-,
(iii) Employees completing 30 years of service as on 31.08.2008 - 3rd MACP in GP Rs.2800/-.
3. The posts of Unskilled (labourers) and Semi-skilled workers which are placed in the Grade Pay of Rs.1800/- have been merged to the post of Tradesman Mate. Para 5 of MACPS provides for ignoring of promotions earned/upgradations granted under ACP Scheme in the past to those grades which now carry the same grade pay due to merger of pay scales/upgradations of posts as a part of the 6th CPC recommendations, Guidelines with regard to grant of financial upgrdations under MACPS, Including that of para 5 of Annexure-1 of MACPS with regard to ignoring of past promotions ACPs granted in the pre-revised pay scales which are now merged in to the same GP, are effective from 01.09.2008 only. Accordingly, thre is no question of grant of 1st ACP to employees completing 12 years of service upto 31.08.2008 in the GP of Rs.1900/- and 2nd ACP on completion of 24 years of service upto 31.08.2008 in the GP Rs.2400/-.
4. So fare as the case of grant of 3rd MACPS benefits to the employees at category (iii) at para 2 above, it may be stated that ACP Scheme has been replaced by MACPS w.e.f.01.09.2008. Fulfillment of prescribed promotional norms including passing of Trade Test has been dispensed with for grant of financial upgradations under MACPS, In consultation with DOE, as MACPS upgradations are granted in the hierarchy of Grade Pay as prescribed in the CCS(RP) Rules, 2008, instead of promotional hierarchy. However, "Benchmark" as prescribed in para 17 of MACPs is mandatory.
5. Thus, para 4 above amply clarifies that for grant of MACPS upgradations which come into effect from 01.09.2008, passing of Trade Test is not mandatory.
6. OFB may take note that of the above clarification given by DOP&T in the matter to deal with all such cases relating to grant of ACP/MACP benefits to the eligible Labourers/Workers.

IMPORTANT ISSUES DISCUSSED AND ITS OUTCOME IN THE JCM III LEVEL MEETING OF OFB HELD ON 24.02.2014 AND 25.02.2014 AT KOLKATTA
 
DECISIONS
 
1. PIECE WORK CO-RELATION ON VI CPC PAY BAND & GRADE PAY 
After discussions held on 06.02.2014 at M of D, the proposal to grant Piece work Profit on Rs.5200 PB-I and Grade Pay Rs.1900 total Rs.7100/- as minimum of pay + Increment separately paid.  After approval by Defence Minister, it was sent to OF Board for getting Draft Government Letter (DGL) and the same was prepared and sent to Secretary, Department of Defence Production for issue of Government letter.  Orders will be issued in the first week of March 2014.  M of D said that the Co-relation will be effective from prospectively.  But it was demanded retrospectively which will be considered separately.

2. GRANTING OF DEPARTMENTAL OVERTIME FOR 3 ¼ Hours (Saturdays) for PIECE WORKERS. 
Departmental OTA for Piece workers for 3 ¼ Hrs working on Saturdays was stopped by OFB w.e.f 01.04.2006 whereas the same is being paid to Day workers, Maintenance Workers as well as Non-Industrial Employees.  This issue was discussed with M of D and at OFB.  The file was now submitted to OFB seeking justification.  The proposal from OFB with proper justification is about to be sent to M of D and Defence Finance for payment of OTA on Single Rate to Piece Workers for working on Saturday 3 ¼ Hrs.
 
3. MANPOWER 
For 2013-14 issue of sanction for Manpower was delayed but sanction was issued. For 2014-15, after collecting the data about the requirements from the factories, proposal will be taken up with Secretary, DP and necessary sanction will be issued. 
 
4.  INCENTIVE For EXAMINERS 
Indian National Defence Workers Federation raised this point granting of Incentive for Examiners which is pending for long.  Production employees are getting Piece work, Maintenance Employees are getting Incentive but whereas the Examiners are not getting any financial benefit.
 
Chairman said that the Council of Quality General of India in its meeting to consider the proposal for granting incentive.  Necessary policy is to be framed and will be taken up with Secretary, Department of Defence Production who is also in favour of considering.
 
5. CONSIDERING DIPLOMA OBTAINED THROUGH DISTANCE EDUCATION FOR LDCE TO CHARGEMAN 
Indian National Defence Workers Federation insisted that the Diploma obtained through Distance Education needs to be considered as the employees cannot acquire qualification through full time Diploma.  Also employees working in remote areas do not have any facility near to them.  Further acquiring Diploma/Degree is only eligibility, and not they will be automatically selected unless they pass the written examination and qualify for the same.  Therefore, the Diploma/Degree obtained through distance education should be considered eligible for appearing to Chargeman post through LDCE Quota both for Tech and Non-Tech.
 
Chairman while replying said that on this distance education we need to take a longer view and settle the matter at the earliest.
 
6. On IR matters when raised by INDWF about HE Factory violating safety norms etc harassing workers, extending probation periods etc.  Chairman, OFB said instructions will be issued to GM’s to avoid any gap between Unions and administration to maintain harmonious Industrial Relations.  On HE Factory issue a feed back was asked to submit on building No.37 where safety norms are totally violated.
 
7. HAPP – Work Load 
Within the powers of OF Board, Rs.50 Crores have been sanctioned for the RGB 6 & 12 project considering the huge requirements.  It is temporarily suspended but it will be restored soon.  FSAPB – Mark III, PMT etc huge requirements are there and HAPP will have more work load.
 
8. JWM Transfers 
Against 600 applications seeking transfers, in one sitting about 100 applications were cleared.  The remaining will be cleared on stages by Member/Per with the assistance of NG Section Officers very soon.  Further the pending transfer order which were cancelled will be restored.
 
9. ONE TIME RELAXATION TO UDC & OS AND CADRE REVIEW 
The issue was already taken up with DOP&T for obtaining One time relaxation.  Further, Cadre Review proposals for clerical Cadre has been referred to M of D with the following proposals vide OFB letter Dt 13.02.2014 to DPP

10. OF DAY GIFTS 
It was demanded to Chairman that during OF Day celebrations on 18th March of every Year the employees should be given gift and at the same time there should be uniformity in the Factories would be decided by OF Board.
 
11. CENTRAL RECRUITMENT BOARD FOR OFB 
OFB proposed long back to form a OFB Recruitment Board for recruitment of Group ‘C’ posts.  Still the appointment of the Board has not been approved by Secretary, DDP. Since more number of posts are lying unfilled by recruitment by many factories and GMs are reluctant to carry out the process of recruitment.  5 Factories have been identified and will be entrusted the responsibilities of Direct Recruitment for various Group ‘C’ posts.  The vacancies factory wise will be notified through advertisement and written test will be conducted on one day in various centres throughout the country and selected candidates list will be sent to the nearest factories of the candidates which will avoid migration from one place to another.
 
12. VIJAYANTA SR.SECONDARY SCHOOL OF HVF 
HVF Vijayanta Sr. Secondary School requires major repairs and renovation including providing better amenities.  Member/Per assured he will visit and sanction necessary funds. Provided the factory submit the proposal. Member A/V also agreed and supported the claim of INDWF. 
 
13. VII CPC CELL FORMATION AT OFB 
At OFB, Cell was formed to prepare a proposal to the 7th CPC.  A meeting was convened on 26.2.2014 at OFB with all the Federation and Association representatives a report has been asked to submit to the OFB.
 
14. CADRE REVIEW 
Cadre Review proposal for Para-Medical staff was forwarded by OFB to Ministry of Defence.
 
15. Revised Pay slip was issued.  We have demanded that the Bank Account number to be included.
 
16. One time relaxation from Labourers.  The issue was referred to DOP&T to grant MACP Rs.2800/-.
 
17. For granting ACP in promotional Hierarchy to Durwans, it was demanded to merge Durwans with Subedar Durwan.  This would be considered.
 
18. RELIEVING STAGNATION TO STOREKEEPING STAFF 
A proposal given by the Staff side JCM to Divert the Direct Recruitment, LDCE vacancies of Chargeman (T) and Chargeman (NT) one time to relieve the stagnation of Storekeeper and Supervisor stores is being considered about the feasibilities.  Now the DR and LDCE vacancies for this year have already been released but it would be considered in the next year.
 
19. Leather Machinist will be considered for promotion to Chargeman (Leather) based on the recommendation of the Sub-committee report.
 
20.  Due to court cases, Cadre Re-structuring was delayed and the promotions were granted at a later date.  It is demanded that all financial benefits should be granted retrospectively instead of notionally.

Subject : Indefinite Strike

Dear Colleagues,

Three Recognised Defence Federations (INDWF, AIDEF & BPMS) have jointly decided and issued a Joint Declaration on 19.09.2013 to call for a Joint Agitation by the Defence Civilian Employees including of a indefinite strike. Notice of the Joint Declaration was sent to Defence Secretary Dt. 19.09.2013 alongwith the charter demands. The Joint Declaration and the programme of action together with the charter of demands was sent to all our affiliated unions for conducting Strike Ballot. Accordingly strike ballot was conducted by our affiliated unions as per our programme on 19.12.2013 and reports were sent to the Federation HQrs. It has been observed as per reports that more than 98% of the Defence Civilian Employees all over the country have voted in favour of the indefinite strike as the demands are very much genuine and long pending.

After receiving the reports of the strike ballot, we have sent further intimation to the secretary, Ministry of Defence that the majority employees have supported the strike and the Ministry of Defence should settle the problems forth with failing which, the Defence Civilian Employees will go on indefinite strike and the date for strike will be intimated.

Three recognized Federation have met at New Delhi on 27.01.2014 and noted with serious concern that even after more than 4 month after forwarding the Joint Declaration alongwith charter of demands, there is no progress in settlement of the issues pertaining to Defence Civilian Employees and the Govt. has not taken any step forward for a negotiated settlement/Agreement on the charter of demands.

Considering the negative attitude of the Government and Ministry of Defence towards the demands of the Defence Civilian Employees and its negligence, three Federations have decided in the meeting held on 27.01.2014 at New Delhi to organize Defence Civilian Employees for an indefinite strike starting from 17.02.2014 from 0600 AM in support of the following charter of demands. The meeting also calls upon the affiliated unions of the three Federations to jointly mobilize the Defence Workers by various agitational programmes during the period of serving strike notice on 03.07.2014 and make the strike a grand success.

The meeting also appeals to the CDRA, its affiliates and all other trade unions and associations functioning in the Defence Establishments to join the indefinite strike in the interest of unity of the Defence Employees and also realize the out standing demands of the Defence Civilian Employees.

CHARTER OF DEMANDS

Demands on Service Matters
1) Grant of 2nd / 3rd MACP in Grade Pay Rs. 4600/- to the Artisan Staff of Defence Establishments who were granted 2nd ACP in the Chargeman Pay Scale of Rs. 5000-8000 upto 31.12.2005 (inspite of MoD’s recommendation matter is pending with Defence Finance)

2) Correlation of the hourly rate of Industrial Workers deployed on Piece Work system in Ordnance Factories in 6th CPC Pay Scale w.e.f. 01.01.2006 (inspite of MoD’s recommendation matter is pending with Defence Finance)

3) Grant of Departmental Overtime Wages to the Industrial Workers deployed on Piece Work system in the Ordnance Factories (inspite of MoD’s recommendation matter is pending with Defence Finance)

4) Grant of hourly rate to the Piece Workers of Ordnance Factories who were given MACP benefits, (inspite of MoD’s recommendation matter is pending with Defence Finance)

5) Grant of revised ACP benefits to the labourers who have completed 30 years of service by granting an one time exemption of Trade Test. (MoD’s recommendation in the matter is pending with DOP&T)

6) Grant of revised ACP benefits to the erstwhile Group “D” NIEs (MoD’s recommendation in the matter is pending with DOP&T)

7) Revision of Night Duty Allowance w.e.f. 01.01.1996 and from 01.01.2006 in the 5th and 6th CPC rates respectively by implementing the Court Judgments on the subject.

8) Doubling of the Risk Allowance for Defence Civilian Employees w.e.f, 01.09.2008 has agreed in the National Anomaly Committee Meeting.

9) Implementation of the following judgment to the similarly placed employees. As per the provisions of DOP&T OM No. A11019/2/98-AT dated 03rd September, 1998

i) Grant of MACP in promotional hierarchy (Government’s SLP dismissed in the case of CAT Chandigarh Bench Judgment on OA No. 1038/CH of 2010)-

ii) Placement from HS Grade to HS Grade-I should be ignored for . granting MACP (Judgment of CAT Principal Bench New Delhi in the case of Employees of 505 ABW, New Delhi referring various Supreme Court Judgments)

iii) Restoration of the opportunity of Chowkidars and Safaiwalas of MES for redesignation as Mate (SS) (Judgment of the Hon’ble CAT Ernakulam Bench in OA No.109/2012 dated 12.12.2012)

iv) Removal of discrimination and grant of skilled pay scale of Rs. 260-4000/950-1500 to non-petitioner Valvemen of MES (Judgment of Hon’ble CAT Jodhpur Bench in OA No. 51/2002 dated 21st July, 2003)

v) Inclusion of HRA and Transport Allowance etc. for computation of OT Wages under Factories Act 1948 based on the judgment of Madras High Court, vi) Implementation of higher Pay Scale and grade structure for the similarly placed Cooks of all Defence Establishments as granted to the Cooks of Air Force vide MoD Letter No. Air HQ./23064/Cooks/PC-4/444-CC/D (Air-!II) dated 12th November, 2013 based on the judgment of Hon’ble Principal Bench CAT, New Delhi.

10) Approval of all cadre review proposals of MTS, Durwan, Fireman, Drivers, Storekeeping Staff, Industrial Canteen Staff, Para Medical Staff, Stenographers, DEO, JJWM and Clerical Staff of OFB, DRDO, DGQA, Navy, EME, AOC, Air Force and other Directorates pending at different level.

11) Grant of PRIS to the DRDO Employees at par with Department of Atomic Energy and ISRO.

12) Revision of Fixed Medical Allowance to the Defence Employees posted at hard stations / isolated places and also grant of medical reimbursement for inpatient treatment for such employees by implementing the judgment of Punjab and Haryana High Court.

13) Grant of Four Grade Structure to the Ammunition Mechanic of NAD under Navy.

14) Grant of Four Grade Structure to the Meter Reader of MES at par with the Artisan Staff,

15) Extension of CSD Canteen facilities for retired defence civilian employees at par with Ex-Serviceman.

16) Revision of Bonus Payment ceiling and Gratuity Ceiling limit.

17) Opening of CGHS Dispensaries in all major cities and recognition of Hospitals under CGHS in Hill Stations.

DEMANDS ON POLICY ISSUES
1) Withdraw DPP-2013 which is against the interest of DRDO and Ordnance Factories.

2) No FDI in Defence Sector.

3) No disturbance in the functioning of DRDO by implementing Professor Rama Rao Committee recommendations.

4) No arbitrary reduction of manpower in the various Army Units in the name of ASEC Report in violation of the Cabinet Secretary’s directions.

5) No closure of any Defence Units including Military Farms,

6) Stop all types of outsourcing / contract and regularize all the existing contract/casual workers.

7) Fillup all the posts lying vacant in all the Defence Establishments.

8) Withdraw the New Pension Scheme.”

9) Grant of Compassionate Appointment 100% as being granted by the Railway Ministry.

10) No reduction of sanctioned strength of the Ordnance Factories based on Sourab Kumar Committee Report.

DEMANDS ON TRADE UNIONS RIGHTS AND FUNCTIONING OF JCM
1) Regular meeting with the recognized Federations by the MoD and other Directorates should be ensured.

2) Three meetings of the Departmental Council (JCM) and four meeting of the JCM-III Level Council as per the constitution of the JCM Scheme should be ensured.

3) Grant of Trade Unions rights to all the non gazetted employees working. in the Defence Establishments as being given in the case of Railway.

4) Grant of Trade Unions rights to the Employees of Hospitals and Training Establishments under MoD since these Establishments are already recognized as Industry by the Labour Ministry.

5. Grant of Trade Unions rights to the Defence Civilian Employees postedat area declared under SRO-17E.

DEMANDS ON 7th CPC ISSUES
1) Settle all the 6th CPC Anomalies and all Cadre review proposals before 7th CPC starts functioning.

2) Accept all the terms of reference of 7th CPC submitted by the staff side of National Council (JCM) to the DOP&T.

3) Implement the revised comprehensive pay packet for the Central Government Employees as on 01.01.2014.

4) To Consider the demand of merger of Dearness Allowance/Dearness Relief with Basic Pay and Basic Pension and also grant of interim relief.

The 4 lakhs Defence Civilian Employees who are the fourth force of the Defence of our country are committed and dedicated workforce and they work side by side with the uniformed personnel for the security of our great natioi. Their contribution to the Defence preparedness cannot be underestimated. Any disturbance in the industrial relations in the Defence Estatlishments will hamper the Defence preparedness. The Defence Civilian Employees and their Trade Unions with this responsibility in mind were patiently waiting for settlement of their demands. However, since there is no positive outcome inspite of our best efforts, the Defence Civilian Employees are forced to proceed with an indefinite Strike from 17.02.2014

Various queries have been raised by factories in regard to trade test for Industrial Employees. The same have been complied and a consolidated clarification is being issued for the same in the table underneath

Attention of all OFs / Units Is drawn to OFB circular dated 28/10/2013 cited at ref above vide which it was intimated that where sanction for recruitment has been issued by OFB but factory is yet to advertise, the mattermay be kept pending till complete clarity is obtained from DDP.
 
02. In this connection, it has now been decided to take action for direct recruitment for filling up the vacancies where sanction has been accorded by OFB. However, before proceeding ahead with the recruitment process, DGOF & Chairman desires that all Members should review afresh the sanctions already issued and only there after factories should proceed further in the matter.
 
03. As such all factories are requested to obtain clearance from the respective operating Member of the division for further recruitment action In respect of sanction accorded by OFBoard for direct recruitment for the years 2012-2013 & 2013-2014 for which advertisement have not yet been issued.

Sub: Posting of a Nurse to Factory Health Clinic- reg.

One Nurse will be posted to Factory Health Clinics (FHC) of Factories in day shift wef 01 Jaunary, 2014.

This is required for the following reasons :
a) Nurse is part of the staff requirement of FHC under Factory rules of various states.

b) Nurse will assist Medical Officer in conduct of Periodic Medical Examination of employees at FHC.

c) Nurse will help in investigation and treatment of routine and emergency cases at FHC and reduce referrals from FHC to main Hospital.

d) Nurse will supervise the work of subordinate paramedical staff.

02. The nurse will be posted to the FHC from overall strength of Nurses in hospital. Factories without hospitals but with independent Estate Health Clinics (EHC) will utilize the services of the Nurse of the EHC in FHC also on past time basis. In case of Factories without Hospital / FHC, Nurse will be posted to FHC from the Hospital concerned.

03. The above arrangement is feasible from current sanctioned strength of Nurses in hospitals with 30 beds are more. Some of the Hospitals with 25 beds or less, where sanctioned strength of nurses (Sr Nurse Gr I & II + Matron) is 06, may have difficulty in making the arrangement due to restricted availability of Nursing staff. They may post a Nurse to FHC on part-time basis.

Dear Colleagues,
Hon’ble Union Finance Minister made an announcement on 25th September, 2013 for constituting 7th Central Pay Commission; the Government has invited the leaders of the Federations (JCM National Council) for a meeting on 24.10.2013 to discuss the probable terms of reference of 7th Central Pay Commission.

In the meeting held on October, 24, 2013 at North Block, Room No.190, Chaired by Secretary, DOP&T the Federation leaders pointed out the following issues needs to be considered and settled.

Anomalies arisen consequent upon the implementations of VI CPC.

Anomalies relating to MACP Scheme vis-a-vis ACPs to be resolved as already discussed in Anomaly Committee

Merger of DA with Pay as was done during the year 2004.

All Cadre Review proposals should be cleared and should be de-linked with 7th CPC.

The Draft Terms of Reference – Finalised by the staff Side is given below:

(A) To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefit like Pension, gratuity, other terminal benefits etc., to the following categories of employees.

    Central Government employees – industrial and non-industrial.
    Personnel belonging to All India Services.
    Personnel belonging to the Defence forces.
    Personnel called as Grameen Dak Sevak belonging to the Postal department.
    Personnel of Union territories.
    Officers and employees of the Indian Audit and Accounts Department.
    Officers and employees of the Indian Audit and Accounts Department.
    Officers and employees of the Supreme Court.
    Members of Regulatory bodies (excluding RBI) set up under Act of Parliament.


(B)  To work out the comprehensive revised pay packet for the categories of Central Government employees mentioned in (A) above as on 01.01.2014.

(C)  The Commission will determine the pay structure, benefits facilities, retirement benefits etc., taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honourable Supreme Court thereon as on 01.01.2014.

(D) To determine the Interim relief needed to be sanctioned immediately to the Central Government employees and pensioners mentioned in (A) above.

(E)  To determine the percentage of Dearness Allowance/Dearness relief immediately to be merged with pay and pension.

(F) To settle the anomalies reached in various fora of JCM.

(G) To work out the improvement needed to the existing retirement benefits, like pension, death cum retirement gratuity, family pension and other terminal or recurring benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered in service on or after 01.01.2014.

(H) To recommend methods for providing cashless/hazzle free Medicare facilities to the employees and pensioners including postal pensioners.

PROGRESS ON ISSUES OF JCM III MEETING WITH DGOF

INDIAN NATIONAL DEFENCE WORKERS FEDERATIONS

JCM III LEVEL COUNCIL MEETING OF BOARD (14th MEETING OF 11th TERM) HELD ON
27th AND 28th NOVEMBER, 2013 AT KOLKATTA.

The following issue were discussed and some of the progresses on the issues are given below for the information of all our affiliated unions.

1. Ex-gratia payment of Rs.10 Iakhs to each family of the employees who lost lives while performing their bonafide duties has been cleared by M of D and sanction was issued by OFB for Rs. 3 crores in respect of 30 families.

2. Necessary clarification was issued by Department of Defence Production on the entitlement of 30 days of Earned leave for Piece workers opted leave under Factories Act but a doubt arised to PC of Fys about the date of effect for which necessary clarification will be obtained from M of D to give effect from July 2008.

3. Departmental Overtime for piece workers was abruptly stopped by OFB from the year 2006 which was not approved by M of D. orders are under issue.

4. For Clerical and Para Medical staff the cadre Review proposals now at OFB level, for Para Medical Staff, OFB finance has cleared and it would be processed further.

5. Cadre Review for Artisan Staff under M of D is to be done which is due. Now Indian Railways have revised the Cadre Review w.e.f. 01.11.2013. It was requested OFB should propose on this line for Ordnance Factory Artisan Staff on receipt of the letters from M of D.

6. The III MACP Rs.4600I- which was granted to MCM and Chargeman was now reviewed by DOP&T and M of D was directed to consider on its own, if the MCM is not the feeder grade to Chargeman. On this basis M of D convened a meeting on 21.11.2013 of Federations and Directors of all Directorates and confirmed that the MCM is not the Feeder grade to Chargeman and only HS Grade I, MCM to Chargeman is only by transfer. Now M of D has submitted the proposal to Defence (Finance) for approval. Therefore, the issue is likely to be settled Hence, it was demanded that PC of A Fys should not affect the reversion of Grade Pay from Rs.4600/- to Rs.4200/- for the serving employees till the orders are issued by M of D. It will be delayed till 31.12.2013.

7. Release of HRA for those who vacated the Quarters and not allotted the quarters has been raised to decide the matter at OFB level.

8. One time relaxation to clerical staff is a permanent demand which was forwarded to M Of D.

9. The following Cadre Review proposals have been submitted to Government through M of D.

MTS, Fire Staff, Canteen Staff, Storekeeping staff, Hindi Typist, Jr Hindi Translators, Teachers, Lab Asst, FED, Durwan, female Searcher etc.

10. Single instructions to all Factones in respect of granting ACP to Durwans will be issued on the basis of promotional hierarchy upto 30.08.2008.

11. All MCMs are now declared as Group B category employees as was demanded in last JCM meeting. They are now entitled to travel by Air on LTC 80 from the nearest Airport to North East Region and J & K. Also their contribution is increased to Rs.60/- towards Central Government Employees Insurance Scheme (CGIES).

12. Further it was demanded that for MCM Promotion, only Departmental Screening committee is held not DPC, therefore, they should be granted promotions twice in a year and not once.

13. Family pensions granted to widow daughters and unmarried daughters on the basis of DOP&T orders.

14. Piece work Co-relation is being processed.

15. It was agreed by PC of A Fys to sanction food bills while on duty to remote areas on self certification basis where registered hotels are not available necessary orders will be issued.

16. Electrical Supervisory Competency test for Chargeman, Theoretical training will be held at OFIL, Ambajhari.

17. Estate Co-ordination committee’s functioning’s will be strengthened to settle the HRA problem.

18. Chairman/OFB agreed to consider and dispose the pending requests of JWMs for transfers.

19. JWM/AWM 76 posts cleared 183 posts proposal sent for promotion 50% promotion to AWM. 50% DR Proposed.

20. Escort duty to which employees is detailed; they will be allowed to compensate the loss of Overtime by giving 75 Hours during the Quarter by which they can recover the loss. 54 Hours ceiling per week should be withdrawn. This has been agreed to consider and to issue necessary instructions to Factories.

21. In order to remove the prevailing stagnation for the Storekeepers and Supervisor NT Stores, a Joint proposal was submitted by the Staff side proposing to grand about 269 posts of Chargeman from Chargeman (T) which will relieve the stagnation. At the same time through Cadre Review, the proposed additional posts will be taken back. The proposal submitted would be agreed to consider by OFB.

20th Biennial Conference of INDWF

INDWF held its 20th All India Convention on 23rd and 24th August 2013 at Kanpur to which our beloved Leader G.Sanjeeva Reddy Ex-MP President All India INTUC was invited as Chief Guest and had appreciated the activities of INDWF and conveyed the actions proposed for the settlement of the demands placed to the Govt. of India by all the Central Trade Unions.

In the election held at the 20th All India Conference of INDWF. Shri Ashok Signh, Sr. Vice President of All India INTUC was re-elected unanimously and Shri R. Srinivasan was also re-elected with the following Office Bearers and Working Committee Members (List Enclosed) for the period 2013-2016.

The conference adopted resolution in respect of Govt. Employees in general and Defence Civilian Employees in particular, which are enclosed.

Further, the conference had unanimously resolved to form a  Co-Ordination Committee among the INTUC affiliated federations in Railways, Defence & Postal which constitutes major strength of Central Govt. Employees to demand appointment of 7th Central Pay Commission,

  •     replace new pension scheme,
  •     lift the ceiling of 5% on compassionate appointments,
  •     review productivity linked bonus policy etc,
  •     Merger of DA after crossing 50% basic pay.

14.  Revision of recruitment rules framed as DGQA organizations to provide promotional opportunities to industrial employees to become Chargeman.

15.  Include element of HRA for calculation of OT allowance as was given till 5th Central Pay Commission.

16. Create provisions in the Trade Apprentices ACT 1961 to provide employment to the Trade Apprentices under gone training in their respective factories.

17. Removal of 5% ceiling on compassionate appointment.

18.  Increase the existing limit of Central Govt. Employees Insurance Scheme (CGEIS) as recommended by VI Central Pay Commission.

INDWF General Secretary Shri.R.Srinivasan writes to DOPT Secretary regarding the matter of granting 4600 Grade Pay to MCM on 3rd financial upgradation on MACP Scheme in Defence Establishments. He explained about the status of MCM cadre in the 5th CPC and he also appealed to grant of 4600 Grade Pay to MCM on 3rd MACP as per the Dopt clarification of 2001... Brief about Master Craftsman granting MACP – III to Rs.4600/- Grade Pay in Defence
  • Master Craftsman in Defence were drawing the pay scale Rs.4500 – 7000 prior to 01.01.2006.
  • Through Fast Track committee on the recommendations of 6th CPC, Master craftsman (MCM) were upgraded to Rs.4200/- Grade Pay w.e.f. 01.01.2006 at par with Railways – vide M of D letter No.11 (5)/2009-D(Civ-I) dt 14.06.2010 and the re-structuring of Artisans were implemented by introducing 4 grade structure i.e., Skilled, HS Grade – II, HS Grade-I and MCM with a ratio of 45 : 20.625 : 20.625 : 13.75% respectively.
  • Principle Controller of Accounts Fys (PC of A(FYS), Kolkatta vide their letter No.Pay/Tech-II/04/2011/15 dated 26.10.2011 and 12.12.2011 clarified that the Industrial Employees who become MCM before 01.01.2006 is eligible for 3rd MACP in the Grade Pay of Rs.4600/-.

CLARIFICATION
Whether an Industrial Employee who was placed to MCM before 01.01.2006 and promoted to MCM on 01.01.2006 is eligible for 3rd MACP with Grade Pay of Rs.4600 after 30 years on the plea that he was granted only two up-gradations in his entire service i.e. Skilled to HS and HS to MCMYES, such MCM is eligible for 3rd MACP with Grade Pay Rs.4600/- after 30 years of service if found otherwise eligible, as they got two promotions prior to 01.01.2006 i.e. Skilled to HS and HS to MCM. But those Industrial Employees who were not placed to MCM before 01.01.2006 are not eligible for 3rd MACP because such persons have got or shall get promotion from Skilled to HS –II, from HS II to HS I and HS I to MCM, so there is no scope for 3rd MACP upgradation.

After issue of the above clarifications by the PC of A (FYS) Kolkatta, Master Craftsman (MCM) who became MCM before 01.01.2006 were granted 3rd MACP to Rs.4600/- Grade Pay on completion of 30 years of service.

Subsequently the DOP&T vide their letter DOP&T I.D.No.7680/12/CR dated 13.07.2012 and M of D I.D. No.11 (5)/2009-D (Civ-I) Dated 23.07.2012 clarified.

a) Para 8 of Annexure-1 of DOP&T OM No.35034/3/2008-Est(D) dt. 19.05.2009 of MACPs provides that promotion earned in the post carrying same grade pay in the promotional post carrying same grade pay in the promotional hierarchy as per recruitment rules shall be counted for the purpose of MACPs. Financial up-gradation under MACPs in respect of Master Craftsman will be in the same Grade Pay of Rs.4200/- as that of the Promotional post of Chargeman.

b) ACP/MACP schemes have been introduced by the Government in order to mitigate stagnation faced by employees due to lack of promotional avenues. Financial up-gradation under ACP/MACP scheme cannot be more than what can be allowed to an employee on his normal promotion. It may be classified that placement of Highly Skilled Grade as Master Craftsman prior to 01.01.2006 is to be treated as one Promotion for the purpose of MACP benefits.

After issue of the above clarifications, the IEs who became MCM prior to 01.01.2006 and who were granted Rs.4200/- Grade Pay were denied the 3rd MACP and the up-gradation of Pay was considered as promotion. Similarly, MCM who got Chargeman which is also having identical pay were also counted as promotion and the Grade Pay Rs.4600/- granted have been denied. Now, accounts authorities have fixed pay be revising to Rs.4200/- Grade Pay accordingly, MCM employees on their superannuation, pension and all other terminal benefits have been re-fixed and paid on the Grade Pay of Rs.4200/-.

Representation was sent by the Federations and by Ordnance Factory Board to M of D which was forwarded to DOP&T in which we have submitted that:

a) As per DOP&T OM of 2001 mentioned above, it is clear that all the posts of MCM as on 31.12.2005 were enbloc upgraded to higher pay scale, the higher pay scale granted to MCM w.e.f 01.01.2006 cannot be treated as promotion. Accordingly the MCM who are placed in the pre-revised pay scale of Rs.5000-8000 w.e.f 01.01.2006 are entitled for their next ACP/MACP in PB2 +Grade Pay Rs.4600/- by ignoring the higher pay scale granted to them w.e.f. 01.01.2006.

b) The post of MCM was not a post of hierarchy prior to 01.01.2006 and it was part of HS Grade. The ratio which was introduced for Industrial Employees in M of D w.e.f. 20.05.2003, the ratio was 45:55 between Skilled and HS Grade respectively 25% of 55% was placed as MCM which is a part of hierarchy till 31.12.2005. Therefore MCM placed from HS Grade was not treated as promotion only after 01.01.2006; it was treated as a separate grade.

c) The post of MCM, is part of hierarchy w.e.f.01.01.2006 but not a feeder post to Chargeman and as such any movement from MCM to Chargeman cannot be treated as promotion in the identical Grade Pay.

Thus, till 31.12.2005, MCM was part of HS Grade and it was treated as part of HS Grade and was treated as placement and not counted for ACP.

Further, ACP – II to the erstwhile pay of Rs.5000-8000 was granted prior to the promotion of MCM and subsequently they were promoted to Rs.4500 – 7000 but they continue to draw the ACP scale Rs.5000 – 8000 prior to 01.01.2006.

They were also denied the benefit of 3rd MACP after 01.09.2008 which is unfair.

MCM to Chargeman is not a feeder post only as per SRO HS I is the feeder post thus MCM to be treated as re-designation and not as promotion.

Therefore, denial of 3rd MACP is not as per the DOP&T clarification of 2001.They should be allowed to continue in Rs.4600/- Grade Pay as was granted.

Subject: - ASSURED CAREER PROGRESSION SCHEME FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES - CLARIFICATIONS REGARDING

The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum of even number dated August 9, 1999 regarding the Assured Career Progression Scheme (ACPS) and subsequent Office Memorandum dated February 10, 2000 clarifying the various points of doubt received from various quarters.

2. Some more situations in which a doubt persists in various organizations in regard to applicability/implementation of ACP Scheme have been brought to the notice of this Department. These have been duly examined and appropriate advice has been conveyed in individual cases. However, as it is observed that similar doubts are being received from various other Ministries/Departments/Organizations, it has been considered appropriate to issue a second set of clarificatory orders containing point-wise clarification to the additional points of doubt.

3. Cases where the ACP Scheme has already been implemented shall be reviewed/rectified if the same are not found to be in accordance with the scheme/clarifications. 3. All Ministries/Departments may give wide circulation to these clarificatory instructions for general guidance and appropriate action in the matter.

An employee was promoted from Grade ‘A’ to Grade ‘C’. Grade ‘B’ was introduced in the hierarchy in between Grade ‘A’ and Grade ‘C’ subsequent to such promotion. Will he be entitled to any more financial upgradation under the ACP Scheme (ACPS) considering that he is already placed in the third level of the hierarchy?
The reply is in the affirmative. The employee has got only one promotion in his career as per the hierarchy existing at the time of his promotion. The subsequent creation of the post in Grade ‘B’ will not, therefore, make any material difference in the situation in relation to the case of this employee for the purpose of grant of second financial upgradation under ACPS The newly created Grade ‘B’ would, as such, need to be ignored in his case. However, persons in Grade ‘A’, who become entitled to financial upgradation only after introduction of Grade ‘B’ in the hierarchy, will be entitled for grant of financial upgradation only in Grade ‘B’ subject to fulfillment of the other stipulations and conditions specified in the ACP Scheme introduced on 9.8.1999.

An employee has superannuated after 9.8.1999, i.e. the date from which ACPS was introduced. He had completed the required eligibility service as on 9.8.1999 for grant of financial upgradation but he retired on superannuation before the Screening Committee could meet to assess his suitability for grant of benefits under ACPS. Will he be entitled for financial upgradation under ACPS?
In terms of condition no. 3 of the ACP Scheme introduced vide O.M. dated 9.8.1999, the financial benefit under the ACPS shall be granted from the date of completion of the eligibility period prescribed under the ACPS or from the date of issue of the instructions whichever is later. Therefore, in respect of employees who had completed eligibility service as on 9.8.1999 but retired prior to meeting of the first Screening Committee meeting, if the assessment to decide grant of financial upgradation is based on ACRs and other service records, the employees who retired after 9.8.1999 may also be considered by the Screening Committee and, if recommended for grant of financial upgradation, such employees may be allowed the benefit of ACPS from the due date. If, however, the assessment also includes passing of a trade test/skill test/written examination (as prescribed for regular promotion) under ACPS and the employee had not qualified in such tests already, then it may not be possible to consider the retired persons, as assessment based on such tests is not possible after the date of superannuation.
35.
Whether placement/appointment in higher scales of pay based on the recommendations of the Pay Commissions or Committees set up to rationalise the cadres is to be reckoned as promotion/financial upgradation and offset against the two financial upgradations applicable under the ACP Scheme?
Where all the posts are placed in a higher scale of pay, with or without a change in the designation; without requirement of any new qualification for holding the post in the higher grade, not specified in the Recruitment Rules for the existing post, and without involving any change in responsibilities and duties, then placement of all the incumbents against such upgraded posts is not be treated as promotion/upgradation. Where, however, rationalisation/restructuring involves creation of a number of new hierarchical grades in the rationalised set up and some of the incumbents in the pre-rationalised set up are placed in the hierarchy of the restructured set up in a grade higher than the normal corresponding level taking into consideration their length of service in existing pre-structured/pre-rationalised grade, then this will be taken as promotion/upgradation.

If the rationalised/restructured grades require possession of a specific nature of qualification and experience, not specified for the existing posts in pre-rationlised set up, and existing incumbents in pre-rationalised scales/pre-structured grades, who are in possession of the required qualification/ experience are placed directly in the rationalised upgraded post, such placement will also not be viewed as promotion/upgradation. However, if existing incumbents in the pre-rationalised grades who do not possess the said qualification/ experience are considered for placement in the corresponding rationalised grade only after completion of specified length of service in the existing grade, then such a placement will be taken as promotion/upgradation.

Where placement in a higher grade involves assumption of higher responsibilities and duties, then such upgradation will be viewed as promotion/upgradation.

Where only a part of the posts are placed in a higher scale and rest are retained in the existing grade, thereby involving redistribution of posts, then it involves creation of another grade in the hierarchy requiring framing of separate recruitment rules for the upgraded posts. Placement of existing incumbents to the extent of upgradations involved, in the upgraded post will also be treated as promotion/upgradation and offset against entitlements under the ACPS.

For any doubts in this regard, matter should be referred to the Department of Personnel and Training (Establishment ‘D’ Section) giving all relevant details.
36.
An employee was initially appointed on deputation in a grade higher than the grade of the post held on regular basis and was subsequently absorbed against the ex-cadre post. Will such initial period of deputation in the higher grade prior to date of absorption be counted towards residency period/ ‘regular service’ for purposes of ACPS?
In reply to points of doubt No. 4 to 6 in DoP&T O.M. dated 10.2.2000, it has been stated that where a person is appointed on direct recruitment/transfer basis from another post in the same grade, then past regular service as well as past promotions, in the earlier post, will be counted for computing regular service for the purpose of ACPS in the new hierarchy. The reason being that so long as service is in the same scale during the period in question, it is immaterial whether he has been holding different posts in the same scale. However, if the appointment is made to a post in a higher grade, then such appointment , whether by direct recruitment or by transfer or initially on deputation followed by absorption, will be treated as direct recruitment and past service/promotion (which was in a different scale) will not be counted

In the case where a person is appointed to an ex-cadre post in higher scale initially on deputation followed by absorption, while the service rendered in the earlier post, which was in a lower scale can not be counted, there is no objection to the period spent initially on deputation in the ex-cadre post prior to absorption being counted towards regular service for the purposes of grant of financial upgradation under ACPS as it is in the same scale of pay and same post.
37.
Whether it is necessary to have SC/ST members in the Screening Committees set up for grant of ACPS?
As clarified vide condition no. 12 of ACP Scheme (vide DoP&T O.M. dated 9.8.1999), reservation orders/roster shall not apply to the ACP Scheme. Consequently, it is not necessary to have an officer from SC/ST communities on the Screening Committee constituted for deciding the suitability of the employee for upgradations under ACPS.
38.
A person has refused a vacancy-based promotion offered to him prior to his becoming eligible for financial upgradation under ACPS, on personal grounds. Will he be eligible for financial upgradation under ACPS? A person had refused a regular promotion for personal reasons. He has since completed 24 years’ of service. Will he be entitled for 2nd financial upgradation?
The ACP Scheme has been introduced to provide relief in cases of acute stagnation where the employees, despite being eligible for promotion in all respects, are deprived of regular promotion for long periods due to non-availability of vacancies in the higher grade. Cases of holders of isolated posts have also been covered under ACPS, as they do not have any promotional avenues. However, where a promotion has been offered before the employee could be considered for grant of benefit under ACPS but he refuses to accept such promotion, then he cannot be said to be stagnating as he has opted to remain in the existing grade on his own volition. As such, there is no case for grant of ACPS in such cases. The official can be considered for regular promotion again after the necessary debarment period.

In the second case also, since in terms of condition No. 10 of the ACPS, on grant of ACPS, the employee shall be deemed to have given his unqualified acceptance for regular promotion on occurrence of vacancy, the officer will have to give in writing his acceptance of the regular promotion when offered again after the debarment period before he can be considered for grant of second financial upgradation under ACPS.
39.
An employee is appointed to a lower grade as a result of unilateral transfer on personal request in terms of FR 15(2). Will the period of service rendered in the higher post count for the purposes of ACPS?
Condition no. 14 of the ACPS (DoP&T O.M. dated 9.8.1999), inter-alia, states that in case of transfer including unilateral transfer on request, regular service rendered in previous organisation shall be counted along with regular service in the new organisation for the purposes of getting financial upgradation under the Scheme. This condition covers cases where a unilateral transfer is to a lower post. However, financial upgradations under the ACPS shall be allowed in the hierarchy of the new post.
40.
An employee drawing pay in the scale of Rs.800-1150 (pre-revised) was declared surplus and was re-deployed as Peon in a Ministry through the Surplus Cell in the scale of Rs.750-940 (pre-revised). However, he was allowed to draw pay in the scale of Rs.800-1150 as personal to him even after redeployment in the lower grade. What shall be his entitlements under ACPS?
As the employee has remained in the scale of Rs.800-1150 all along and has not availed any promotion, he is entitled to two financial upgradations in a scale higher than Rs.800-1150 (pre-revised) irrespective of the post actually held after redeployment. Since in the Ministry, a Group ‘D’ employee is eligible for promotion to the grade of LDC provided he is a matriculate and as a post in the scale of Rs.825-1200 (S-4) is not in the normal hierarchy in the Secretariat, such an employee can be considered for two financial upgradations in the grades of LDC and UDC provided he is a matriculate Otherwise he will get only one financial upgradation in the revised scale of Rs.825-1200 (Rs.2750-4400 revised). Cases of other persons re-deployed to lower posts through the Surplus Cell may also be regulated accordingly.

A cadre consists of 4 Grades - ‘A’, ‘B’, ‘C’ and ‘D’ (in ascending order). Upon restructuring of a cadre, Grade ‘B’ is abolished from a date subsequent to 9.8.1999. Employees recruited in Grade ‘A’, who are eligible for financial upgradation on or after 9.8.1999 but before the date of effect of restructuring, get first/second financial upgradation in Grade ‘B’ and Grade ‘C’ respectively but those who become eligible for financial upgradation after the restructuring has been effected are entitled to first financial upgradation in Grade ‘C’ and second financial upgradation in Grade ‘D’. This is anomalous. The cases of earlier set of employees should be reviewed and they may be allowed financial upgradations as applicable to the latter category of employees.
The benefit of ACP Scheme is to be allowed as per the hierarchy existing, as on the date the employees become eligible for financial upgradation under ACPS. . Cadres/hierarchical structures are never static and are always subject to review based on recommendations of Pay Commissions/Expert Committees or otherwise and it is not possible to review the entitlements under ACPS already earned every time a cadre is reviewed. ACPS is only a temporary solution to provide relief to stagnating employees and the lasting solution for stagnation lies in review of cadre structures, as regular promotions will be earned in such restructured grades. All the employees will benefit from such cadre restructuring.
42.
An employee in Grade ‘A’ is eligible for promotion simultaneously to Grades ‘B’, ‘C’ and ‘D’ (in ascending order) with varying requirements of length of service in the present grade. In other words, he has multiple channels of promotion. What shall be his eligibility under the ACP?
Provisions in the existing Recruitment Rules in various organisations providing for multiple channels for promotion are not consistent with the guidelines on framing of the Recruitment Rules. All such Rules should be reviewed immediately so as to provide only a single channel of promotion. However, till such a review is undertaken, the first financial upgradation in such cases shall be allowed with reference to the lowest promotional Grade which is Grade ‘B’ If he does not earn any promotion in 24 years, his second financial upgradation will be as per the hierarchy of Grade ‘B’. However, if he has already earned one regular promotion, then his second financial upgradation shall be as per the hierarchy of the Grade to which he has been promoted.
43.
Whether service rendered in an autonomous body/statutory body/ State Government prior to appointment in Central Government as a direct recruit prior to appointment in the Central Government will be counted while computing regular service for the purpose of grant of financial upgradations under the ACP Scheme?
ACP Scheme is applicable to Central Government Civilian employees and for the purpose of financial upgradations under the ACP Scheme, only the regular service rendered after regular appointment in a Central Government civilian post is to be counted. Therefore, service rendered in an autonomous body/statutory body/State Government is not to be counted for the purpose. Correspondingly, promotions earned in these bodies prior to appointment in the Central Government are also to be ignored. The clarification in reply to point of doubt no. 4 to 6 in DoP&T O.M. dated 10.2.2000 providing for counting of past service in another organisation in the same grade is only in relation to past service in a civilian post held in the Central Government.
44.
On the basis of recommendations of the Fifth Central Pay Commission, a uniform pay structure has been introduced for Stenographers in the non-Secretariat organisations whereby the posts have been distributed in the ratio of 40:40:20 in the grades of Stenographer Grade-III (Rs.4000-6000), Stenographer Grade-II (Rs.5000-8000) and Stenographers Grade-I (Rs.5500-9000) However, in a particular non-Secretariat organisation, there is only an isolated post of Stenographer in the scale of Rs.4000-6000. Will he be entitled to financial upgradations in the scale of Rs.4500-7000 and Rs.5000-8000 as per Annexure II to O.M. dated 9.8.1999 or can he be allowed financial upgradations in the grades of Stenographer Grade-II and Stenographer Grade-I ?
In reply to point of doubt No. 10 in DoP&T O.M. dated 10.2.2000, it has been stated that the scales of pay for ACPS for isolated posts shall be same as those applicable for similar posts in the same Ministry/Department/Cadre except where the Pay Commission has recommended specific pay scales for mobility under ACPS. Such cases may be specifically examined by respective Ministries/Departments in consultation with the Department of Personnel and Training. In the case of remaining isolated posts, the pay scales contained in Annexure-II of O.M. dated August 9, 1999 shall apply. Thus, hierarchy in Annexure-II of O.M. dated August, 9, 1999 applies where Pay Commission has not made any specific recommendation regarding scales to be allowed under the ACPS and where it is not possible to identify similar posts in same organisation. In the case of stenographers in non-Secretariat organisations, which is a common category post, the Pay Commission has recommended a uniform grade structure for which has been accepted by the Government. Since the isolated post of Stenographer in scale of Rs.4000-6000 in a subordinate office is comparable to corresponding posts of Stenographer Grade-III in other non-Secretariat organisations under the same Ministry, the uniform pay (grade) structure for Stenographers may be adopted for the purpose of allowing financial upgradations to the said isolated post. In the instant case of an isolated post of Stenographer (Rs.4000-6000) in a non-Sect organisation, first and the second financial upgradations may be allowed in the scales of Rs.5000-8000 (Steno Grade-II) and Rs.5500-9000 (Stenographer Grade-I) respectively provided he is otherwise eligible. A similar approach can be adopted in respect of all other isolated posts belonging to common categories for which Pay Commission has similarly recommended a uniform grade structure which has been accepted and notified in part ‘B’ of the Ministry of Finance notification dated September 30, 1997 or agreed to by the Government subsequently. If such an isolated post is in a Central Ministry/Department, then the structure as recommended and accepted for similar common category posts in the Central Ministry/ Department may be adopted. If the isolated post is in a non-Secretariat organisation, then the uniform hierarchy as recommended for similar posts in the non-Secretariat organisations may be followed.
45.
In certain organisations, an employee after his selection on direct recruitment basis or even on promotion is required to undergo an induction training before he is given a functional post. Whether such induction training shall count towards the eligibility service for ACPS?
If under the relevant Recruitment/Service Rules, the induction training counts towards eligibility service for regular promotion, the same will also be counted towards the 12-years/24 years residency period/regular service required for financial upgradations under ACP Scheme.
46.
A person is working in the immediate promotional grade on ad-hoc basis. Is he eligible for financial upgradation under the ACP Scheme? Will his pay be refixed.?
An ad-hoc promotion is made only in an exigency of work where the post cannot be kept vacant and such appointment is to be discontinued as soon as a regular incumbent is appointed. In terms of existing guidelines, continuation of such arrangement beyond one year is also subject to prior concurrence of DoP&T. Thus such an employee can be reverted to the original regular post at any moment. Therefore, case of an employee holding the higher promotional grade/any other post on ad-hoc basis, for grant of financial upgradation under ACPS cannot be ignored.
