Sir/ Madam,

The Central Government has conveyed its approval to the existing Productivity Linked Bonus Scheme for the year 2019-2020 for the employees of EPFO vide letter No A- 26022/1/94 -SS-1 (Pt) dated 22nd October, 2020.

2. Accordingly, the competent authority is pleased to convey the approval for payment of the Productivity Linked Bonus for the year 2019-2020 for 60 (Sixty) days in all the offices of EPFO. The bonus of 60 days has been assessed on the basis of data/ information submitted by the Zonal Offices in compliance to Head Office letter dated 07.10.2020. The payment of bonus is to be released to all Group ‘C’ and Group ‘B’ (Non-Gazetted) employees of EPFO.

3. The quantum of bonus may be assessed as per the following formula:-

4. The expenditure incurred for payment of bonus may be debited from the budget head “Productivity Linked Bonus.” It may be ensured that Bonus is disbursed as per eligibility.

FAQ regarding regulation of Ad-hoc/ Non-PLB Bonus

  1. Employees appointed on purely temporary ad-hoc basis?
    Yes, if there is no break in service
  2. Employees who resigned, retired from service or expired before 31st March, 2020?
    As a special case only those persons who superannuated or retired on invalidation on medical grounds or died before 31st March, 2020 but after completing at least six months regular service during the year will be eligible for the ad-hoc bonus on pro rata basis in terms of nearest number of months of service.
  3. Employees on deputation/ foreign service terms to state governments, U.T. Governments, Public Sector Undertakings, etc., on 31st March, 2020?
    Such employees are not eligible for the ad-hoc bonus to be paid by the lending departments. In such cases the liability to pay ad-hoc bonus lies with the borrowing organization depending upon the ad-hoc bonus/ PLB/ ex-gratia/ incentive payment scheme, if any, in force in the borrowing organization.
  4. Employees who reverted during accounting year from deputation on foreign service with the organizations indicated in ‘C’ above?
    The total amount of bonus/ex-gratia received for the accounting year from foreign employer and the ad-hoc bonus, if any, due from a central government office for the period after reversion will be restricted to the amount due under ad-hoc bonus as per these orders.
  5. Employees from state Government/U.T. Admn./ Public Sector Undertakings on reverse deputation with the Central Government?
    Yes, they are eligible for ad-hoc bonus to be paid by the borrowing departments in terms of these orders provided no additional incentive as part of terms of deputation, other than Deputation Allowance, is paid and the lending authorities have no objection.
  6. Superannuated employees who were re-employed?
    Re-employment being fresh employment, eligibility period is to be worked out separately for re-employment period; the total amount admissible, if any, for prior to superannuation and that for re¬employment period being restricted to the maximum admissible under ad-hoc bonus under these orders.
  7. Employees on half-Pay leave/ E.O.L./ Leave not due/study leave at any time during the accounting year?
    Except in the case of leave without pay the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of E.O.L./ dies non will be excluded from eligibility period but will not count as break in service for the purpose of ad-hoc bonus.
  8. Contract employees?
    Yes, if the employees are eligible for benefits like dearness allowance and interim relief. Categories not eligible for these benefits would be considered at par with casual labor in terms of ad-hoc bonus orders.
  9. Employees under suspension at any time during the accounting year?
    Subsistence allowance given to an employee under suspension for a period in the accounting year cannot be treated as emoluments. Such an employee becomes eligible for the benefit of ad-hoc bonus if and when reinstated with benefit of emoluments for the period of suspension, and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay.
  10. Employees transferred from one Ministry/ Department/ Office covered by ad-hoc bonus orders to another within the Government of India or a Union Territory Government covered by ad-hoc bonus orders and vice versa?
    Employees who are transferred from any of the Ministry/ Department/ Office covered by ad-hoc bonus orders to another such office without break in service will be eligible on the basis of combined period of service in the different organizations. Those who are nominated on the basis of a limited departmental or open competitive exam from one organization to a different organization will also be eligible for the ad-hoc bonus. The payment will be made only by the organization where he was employed as on 31st March, 2020 and no adjustments with the previous employer will be necessary.
  11. Employees who are transferred from a Government Department /Organization covered by ad-hoc bonus orders to a Government Department/ Organisation covered by productivity – Linked Bonus scheme or vice versa?
    They may be paid what would have been paid on the basis of emoluments in ad-hoc bonus covered department for the entire year less the amount due as productivity-linked bonus. The amount so calculated may be paid by Department where he was working on 31st March, 2020 and/or at the time of payment.
  12. Part-time employees engaged on nominal fixed payment?
    Not eligible.
  13. Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year?
    The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus, ex-gratia or incentive payment has not been earned and received.
  14. Casual labour who were not in work on 31st March, 2020?
    The condition of being in employment on 31st March, 2020 as laid down in these orders is applicable to regular Government Employees and not to casual labour.
  15. Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year?
    If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2020 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.

Subject: Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2019-20

The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2019-20 to the Central Government employees in Group ‘C’ and all non-gazetted employees in Group ‘B’, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc Bonus under these orders shall be monthly emoluments of Rs.7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.

2. The benefit will be admissible subject to the following terms and conditions:-

78 days Bonus for non-gazetted Railway employees – Payment of Productivity Linked Bonus 2019-20

  • Only those employees who were in service as on 31.3.2020 and have rendered at least six months of continuous service during the year 2019-20 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months);
  • The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will, thereafter, be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 7000 (where actual average emoluments exceed. Rs.7000), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000×30/30.4=Rs.6907.89 (rounded off to Rs.6908/-).
  • The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below Rs.1200/- p.m., the amount will be calculated on actual monthly emoluments.
  • All payments under these orders will be rounded off to the nearest rupee.
  • Various points regarding regulation of Ad-hoc/Non-PLB Bonus are given in the Annexure.

3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances of these employees are debited.

4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/ Departments for the current year.

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi, has given its approval to pay Productivity Linked Bonus (PLB)for the year 2019-2020 to 16.97 lakh non-gazetted employees of commercial establishments like Railways, Posts, Defence, EPFO, ESIC, etc. will be benefitted and the financial implication would be Rs.2,791 crore.

Non-PLB or ad-hoc Bonus is given to Non-Gazetted Central Government employees. 13.70 lakh employees would be benefited and Rs.946 crore will be the financial implication for the same.

A total of 30.67 lakh employees would be benefited by the Bonus announcement and total financial implication will be Rs 3,737 crore.

Payment of Bonus to non-gazetted employees for their performance in the preceding year is usually made before Durga Puja/ Dussehra season. The Government is announcing the Productivity Linked Bonus (PLB) and ad hoc bonus for its non-gazetted employees to be disbursed immediately.

Bonus
This year’s Bonus to Central Government Employees is not yet declared by the Central Government. Normally, every year Bonus is declared before the second week of October. We suspect some hidden agenda behind the deliberate delay on the part of the Government. From 1978 onwards Central Government Employees are paid Bonus without any interruption. Bonus is a product of historic strike of Railway employees under the banner of Railway Federations and other Central Government Employees under the banner of Confederation of Central Government Employees and Workers. Any attempt to deny Bonus under any pretext cannot be tolerated.

Confederation of Central Govt. Employees and Workers calls upon the entirety of Central Government Employees including Gramin Dak Sevaks GDS to hold protest demonstrations all over India at all centres and also in front of all offices (observing Covid protocol) on 20th October 2020, Tuesday. Railway Federations have also given a similar call for protest demonstrations on 20.10.2020. Let us be ready for strike with short notice if circumstances demand.

Every year Bonus is declared to the Central Government Employees before Durga Puja. Now Durga Puja celebrations will start from 17 October 2020 and Dussehra will be celebrated on 25th October 2020, but the bonus has not been declared yet.

It is therefore requested to kindly cause orders for payment of Bonus to Central Government Employees before Durga Puja so that they may celebrate the Festival happily.

Diwali Bonus for Tamil Nadu State Government (PSU) Public Sector Undertakings Employees 2019

By a press release dated 15 October 2019 the State Government of Tamil Nadu has confirmed the 2018-19 Diwali Bonus.

The bonus pay limit is Rs. 21000, according to the press release. The monthly incentive estimate salary limit is Rs. 7000. The maximum amount of Rs 16800 and Rs 8400 is the minimum salaries for workers in the public sector.

All qualifying PSU employees receive a 20 percent bonus and other PSU employees also receive a bonus of 10 percent. TNEB and TNSTC worker and Staff will receive a bonus of 8.33% with an ex gratia of 11.67%, a maximum bonus of 20% for 2018-19.

7th Pay Commission Latest News 2019 - In the lead of great festival season the Centre has declared ad hoc bonus to Central Para Military Forces and Armed Forces as per the recommendations of 7th Pay Commission.

In the lead of great festival season the Centre has declared Non Productivity Linked Bonus (ad hoc bonus) to all eligible Central Para Military Forces and Armed Forces and Non Gazetted Central Government Employees as per the recommendations of 7th Pay Commission.

The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. According to the notification, Non Productivity Linked Bonus (ad hoc bonus) equivalent to 30 days emoluments for the accounting year 2018-19 to all eligible Central Government employees in Group 'C' and all Group 'B' Non Gazetted Central Government Employees who are not covered by any Productivity Linked Bonus monthly emoluments of Rs. 7000 as revised with effect from 1st April 2014.

Point: Whether ad-hoc bonus is payable to casual labour for an accounting year in the following cases:-

(a) Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year.

Clarification: The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus. ex-gratia or incentive payment has not been earned and received.

(b) Casual labour who were not in work on 31st March, 2019.

Clarification: The condition of being in on 31st March, 2019 employment as laid down in these orders is applicable to regular Government Employees and not to casual labour.

(c) Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year.

Clarification: If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2018 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.

7th Pay Commission latest news today: Around 1.1 crore central government employees are eagerly waiting for the announcement of an increase in their Dearness Allowance (DA). The festive season has virtually started and Dussehra, Diwali and other big holy days are just around the corner. This is the time when everyone celebrates these festivals with pomp and splendour and that includes central government employees too. For this money is required and so far the extra amount from DA has not reached them. They have been waiting for the good news announcing the granting of DA. However, this has not happened so far and today Modi Cabinet meeting is scheduled today will start at evening 06.30 PM of 03rd Oct, 2019.

They were hopeful that it will be announced in last month September 2019, but due to PM’s foreign visit the announcement get delayed. The announcement of the DA hike is made by government usually by mid-September. It is October now and the same has not happened. Now the the same should have happened today in Cabinet meeting scheduled today evening around 6.30 pm as per news sources. and the chances of the 7th pay commission (7th CPC) linked DA hike and Ad-hoc Bonus are to be considered.

Expectations are that the government may announce it by Dussehra in October. The government is expected to announce DA hike of 5% and this translates from between Rs 900 to Rs 12,500 per month increase in salary, depending on the pay levels. The 5% increase in DA of central government employees, if it happens, will be the highest in 3 years. The reason for this is the rise in inflation in AICPIN during January to June 2019. Inflation in the AICPI figures for January to June has risen by more than 5%.

Ad-hoc Bonus for Central Government Employees is also on the cards as PL Bonus to Railways and Defence Employees have already approved. Now, it will also be announced on today and will be great festival gift from the Modi Cabinet to all non-gazetted central government employees.

The above demand was discussed as Item No.14 of the Standing Committee meeting of the National Council (JCM) held on 7-3-2019. The extract from the minutes of the above meeting is given below for your kind ready reference.

  ‘Staff Side stated that inspite of the Govt, orders issued on the basis of Cabinet approval, the employees of Department of Defence Production, are eligible for 41 days Productivity Linked Bonus (PLB). However despite the recommendations by the Hon’ble Defence Minister the Department of Expenditure is reducing one day PLB for the past 11 years, and is approving only 40 days PLB. Similarly in case of EME also such reduction is taking place every year.

JS (Pers), Dept. of Expenditure stated that the issue is under consideration and in consultation with Dept. of Defence Production/MoD. The staff side requested for an early decision in the matter.

  Inspite of a period of more than 5 months after the meeting of the Standing committee of National council (JCM) Department of Expenditure have not yet issued any instructions to Department of Defence Production. Since this is an outstanding demand it is requested that necessary instructions may be issued the DDP for payment of the one day PLB amount reduced from the actual PLB due to the Defence civilian employees of OFB, DGQA and DGAQA at the earliest. A copy of your instruction may please be endorsed to this office.

Sir,
I am directed to refer to the Productivity Linked Bonus Scheme already circulated vide this Ministry’s letter No.F.24(6)/80/d (JCM) dated 28th September, 1983. as amended from time to time, and to convey the sanction of president to the payment of 40 days (Forty days) wages in cash as PLB for the year 2018-19 to the eligible civilian employees of the AOC.

2. The entitlement has been worked out on the basis of the working results for the year 2018-19 in accordance with the agreed formula

3. The PLB will be paid to all eligible Gp. ‘B’ (Non-Gazetted) Gp ‘C’ and GP ‘D’ civilian employees of AOC who are covered under PLB scheme for the accounting year 2018-19. The calculation ceiling of Rs.7000/- (7000X40/30.4) and other terms and conditions of the PLB Scheme will remain unchanged.

4. Productivity Linked Bonus to the casual labourer will be paid at the assumed wages of Rs.1200/- p.m. (1200x40/30.4) for the accounting year 2018-19. However, in cases where the actual wages fall below Rs.1200/- p.m., the amount will be calculated on the actual monthly wages. The other conditions remain unchanged.

5. The expenditure on this account will be debitable to defence Service Estimates under respective Heads to which the pay and allowances of these employees are debited. It is for your kind information that Government Employees National Confederation has decided to conduct one day Hunger Strike on 14.10.2019 from 10:30 hrs to 15:30 hrs at Atal Samadhi (Sadaiv Atal), Near Rajghat, Delhi for various burning issues/ pending demands of Government employees like-
  • Eradication of unemployment and filling of vacant posts through permanent employees in various offices/ establishments of Central/ States/ Autonomous Bodies
  • Corruption free Government Departments
  • No efforts should be made regarding corporatization of establishments of Defence/ Railway/ Postal or any other Government Department
  • Restoration of Old Pension Scheme/ Removal of New Pension Scheme Extension of slab for Nil income tax liability upto 8 lakh
  • Calculation limit of Bonus should be extended upto 18000 based on recommendation of 7th CPC on Minimum Pay
  • Total abolition of Contract Worker System/ Outsourcing System for job of permanent nature in all Govt Departments
  • All Allowance should be paid as per 7th CPC recommendations from 01.01.2016
  • All employees of State Govt/ Autonomous Bodies should be granted Pay Structure of Central Government, wherever it is less beneficial to the Pay Structure of Central Government etc.
All the unions are requested to mark its presence by at least 5 members so that the hunger strike may be made successful.

New Delhi, the 29th January, 2019

G.S.R. 58(E). - Whereas a draft of certain rules further to amend the Payment of Bonus Rules, 1975, among other rules, were published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i) vide notification of the Government of India in the Ministry of Labour and Employment number G.S.R. 413(E), dated the 23rd April, 2018, inviting objections and suggestions from all persons likely to be affected thereby, within a period of three months, from the date on which copies of Official Gazette containing the said notification were made available to the public;

And whereas copies of the said Official Gazette were made available to the general public on the 23rd April, 2018;

And whereas the objections and suggestions received on the said draft rules from the public have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 38 of the Payment of Bonus Act, 1965 (31 of 1965), the Central Government hereby makes the following rules further to amend the Payment of Bonus Rules, 1975, namely:-
  1. (1) These rules may be called the Payment of Bonus (Amendment) Rules, 2019.
    (2) They shall come into force on the date of their publication in the Official Gazette.
  2. In the Payment of Bonus Rules, 1975, for rule 5, the following rule shall be substituted, namely:-
‘5. Annual return.- Every employer shall, on or before the 1st day of February in each year, upload unified annual return in Form D on the web portal of the Central Government in the Ministry of Labour and Employment giving information as to the particulars specified in respect of the preceding year:

Provided that during inspection, the inspector may require the production of accounts, books, registers and other documents maintained in electronic form or otherwise.

Explanation.- For the purposes of this rule, the expression “electronic form” shall have the same meaning as assigned to it in clause (r) of section 2 of the Information Technology Act, 2000 (21 of 2000).’.

Sub: Brief of the meeting held today with the Member Staff, Railway Board, to discuss the important issues raised by AIRF with the Railway Board

A meeting was held today with the Member Staff, Railway Board, to discuss the vital issues raised by AIRF with the Railway Board, wherein the following deliberations took place:-

Implementation of four grade structure, in the ratio of 10:20:20:50, in the case of Trackmen/ Track Maintainers - Member Staff informed that, four grade structure, in the ratio of 10:20:20:50, is approved by the Full Board, and the file was put-up to Hon'ble MR for his approval. Hon'ble MR wanted certain clarifications from the Engineering Directorate, and the same was submitted by the said Directorate. This will be finalized after arrival of Hon'ble MR who is busy in the state elections.
Revision of the rates of Running Allowance and other Allowances related to Running Staff - After lengthy discussions; the Member Staff informed that, the file is put-up to Hon'ble MR for his approval, and after his approval, the file would be sent to the MoF. The Member Staff further informed that, the matter is vigorously pursued by him with the MoF.

Continuance of the LARSGESS - The Official Side informed that, after consultation with the Solicitor General, original scheme would be implemented after submitting it to the court. The court has given time for submitting the final result.

Advancement of prospects of the staff working in erstwhile GP Rs.1800 and GP Rs.4600 - After prolonged discussion, the Member Staff agreed that, there is stagnation of the staff working in erstwhile GP Rs.1800. Federation (AIRF) pointed out that, due to various surrenders in Grade III Technicians as well as other cadres, the present incumbents working in erstwhile GP Rs.1800 are not getting promotions. Due to direct recruitment in GP Rs.4600, people are not having any promotional prospects as there are no grades in GP Rs.4800 and GP Rs.5400. Federation(AIRF) wanted that, as was done on previous occasion, 50% of Direct Recruitment vacancies should be thrown open for promotion for the staff working in erstwhile GP Rs.1800, and also GP Rs.4800 and GP Rs.5400 SSEs and Sr. Supervisors should be made Gazetted.

Non-revision of rates of Incentive Bonus/Bonus Factor and PCO Allowance paid to Technical Staff and Supervisors of the PUs and Maintenance Workshops - The Committee appointed by the Railway Board is expected to submit its report within a month's time, and then only; the item will be finalized.
Upgradation of the Apex level of Group 'C' to Group 'B' - AIRF insisted that, powers are vested with the Railway Board to grant upgradation for the apex grade Supervisors to Group 'B'. This was also confirmed by the Finance Secretary(Exp.) on the previous occasion, and the minutes of the said meeting given to the Railway Board. In spite of that, the matter is dragged by the Railway Board by sending proposal to the MoF. The Federation(AIRF) insisted that, decision should be taken at the Railway Board level itself. Member Staff directed the AM(S) to put-up all the particulars, including minutes of the Cabinet Secretary, for taking a decision. The Federation(AIRF) insisted that, as per the Act and Codal Provisions as well as Business Rules, the powers are vested in the Railway Ministry and they should not run to the DoP&T and MoF.

Regularization of the Act Apprentices in Railways - AIRF demanded that, all the Act Apprentices imparted training in the Railways should be absorbed in the Railways. It was explained to the Member Staff that the orders were available previously, but unfortunately, Board have issued orders and implemented the orders with back date, depriving the Act Apprentices from the absorption in the Railways. The Federation demanded that, new Apprentices Act, passed by the Parliament, has given full powers to decide procedure for absorption of these Act Apprentices. Federation demanded that, Screening Type system should be adopted for absorption of the Act Apprentices. Member Staff agreed to study the problem after finalization of the present RRC examination.

It is worth-mentioning here that, there will also be another round of discussions with the Member Staff, Railway Board, tomorrow, i.e. on 5th December, 2018, and the outcome of the said meeting shall also be communicated to all of you.

Madam/Sir,

The Central Government has conveyed its approval to the existing Productivity Linked Bonus Scheme for the year 2017-2018 for the employees of EPFO vide MoL&E letter No A-26022/1/94-SS.1 (Pt) dated 12th October, 2018.

2. Accordingly, the competent authority is pleased to convey the approval for payment of the Productivity Linked Bonus for the year 2917-2018 for 60 (Sixty) days in all the offices of EPFO. The bonus of 60 days has been assessed on the basis of data/information submitted by the Zonal Offices in compliance to Head Office letter dated 25.09.2018. The payment of bonus is to be released to all Group 'C' and Group 'B' (Non-Gazetted) employees of EPFO.

3. The terms and conditions governing payment of P.L.B. will be as per the instructions issued by the Ministry of Finance O.M. No. 7/24/2007/E.III(A) dated 08.10.2018 for payment of the bonus to the employees in Central Government departments from time to time. However, the quantum of bonus may be assessed as per the following formula, as given in above letter:-
