Sub: VII Central Pay Commission recommendations- Submission to the empowered Committee Secretaries- reg.

1. Bharat Pensioners Samaj (BPS) Federation of pensioners’ associations, a conglomerate of over 628 pensioners’ organizations as an accredited Federation under the Government of India, had appealed to the Secretary, Ministry of personnel, Public Grievances and Pensions, on 16.2.2016 during the meeting on Aadhar seeding to hold a meeting of Pensioners Associations to discuss 7th CPS pension related recommendations, though he had agreed to hold such a meeting but it did not materialize.

2. Now BPS has come to know through NJCA News letter dated 27.5.2016 issued after their meeting with you on 26.5.2016that the Department of Pension is opposed to the first option recommended by the 7th CPC to bring about the parity with the past pensioners, as they consider it to be infeasible and impracticable (due to the non-availability of the requisite records)

3. It is hard to believe, how a department meant for the welfare of pensioners which helped pensioners to get better deal in earlier pay commissions could arrive at such a damaging and misleading decision without even consulting the stake holders.

4. Sir, Service record is a permanent one and if it to be destroyed, proper permission from the Competent Authority is to be obtained. In any case, service record of pensioners can always be reconstructed taking the details from various sources available with the department and the material collected from the Pensioner. This has been done in the past while implementing parity enunciated by fifth CPC and even while implementing modified parity of 6th CPC. It is also being done now implementing OROP. In this regard Your kind attention is also drawn to recent Bombay High court Nagpur judgement dated 09.03.2015 in case of Smt. Saija v. General Manager, Central Railway O.A.No. 2131 of 2011 (Bombay Bench at Nagpur)
Undersigned in the capacity of Secy. Genl ‘Bharat Pensioners Samaj’ request you to takean independent decision in view of submission in Para 4 above to save pensioners/family pensioners from unprecedented permanent damage by a department meant for their welfare.

7th Pay Commission: Central government employees to get salary hike from next month

New Delhi: The long wait for implementation of 7th Pay Commission recommendation will soon come to an end.

As per media reports, the new increased pay scale for all central government employees will be given from next month.

Meanwhile, the group of secretaries headed by Cabinet Secretary PK Sinha is all set to meet on June 11 to give final shape to the changes on 7th Pay Commission recommendation.

Government in January set up a high-powered panel headed by Cabinet Secretary P K Sinha to process the recommendations of the 7th Pay Commission which will have bearing on the remuneration of 47 lakh central government employees and 52 lakh pensioners.

The Empowered Committee of Secretaries will function as a Screening Committee to process the recommendations with regard to all relevant factors of the Commission in an expeditious detailed and holistic fashion.

The government had earlier stated that implementation of new pay scales recommended by the 7th Pay Commission is estimated to put an additional burden of Rs 1.02 lakh crore, or 0.7 percent of GDP, on the exchequer in 2016-17.

The undersigned is directed to say that a need for providing for an appeal to the complainant in allegation of sexual harassment in accordance with the Section 18(1) of the Sexual Harassment of Women at Workplace [Prevention, Prohibition and Redressal] Rules, 2013 has been examined. The draft instructions are attached. Subject: Central Civil Services (Conduct) Rules 1964 — Guidelines regarding prevention of sexual harassment of women at the workplace— regarding 

Undersigned is directed to say that following enactment of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [SHWW(PPR) Act] and notification of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 [SHWW(PPR) Rules] on 09.12.2013, the Government notified the amendments to Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965. The amendments and other salient features of the Act/ Rules was brought to the notice of all concerned vide Office Memorandum No. 11013/02/2014- Estt.A-III dated 27.11.2014.

2. Section 18 (1) of the SHWW(PPR) Act, 2013 provides that any person aggrieved with the recommendations made under sub-section (2) of section 13 or under clause (i) or clause (ii) of sub-section (3) of section 13 or sub-section (1) or sub-section (2) of section 14 or section 17 or non-implementation of such recommendations may prefer an appeal to the court or tribunal in accordance with provisions of the service rules applicable to said person or where no such service rules exist then, without prejudice to the provisions contained in any other law for the time being in force, the person aggrieved may prefer an appeal in such manner as may be prescribed.

3. In accordance with Section 18(1) of the SHWW (PPR) Act, 2013, it has been decided that in all cases of allegations of sexual harassment, the following procedure may be adopted:

Where a Complaint Committee has not recommended any action against the Charged Officer in a case involving allegations of sexual harassment, the Disciplinary Authority shall supply a copy of the Report of the Complaints Committee to the complainant and shall consider her representation, if any submitted, before coming to a final conclusion. The representation shall be deemed to be an appeal under section 18(1) of the Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

4. All Ministries/ Departments/Offices are requested to bring the above guidelines to the notice of all Disciplinary Authorities under their control. All cases, where final orders have not been issued may be processed as per these guidelines.

Special Aadhaar Seeding Camps being held from May 30-June 10, 2016

The Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS (IC) for Youth Affairs and Sports, MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh has directed that priority should be given to pensioners visiting the bank branches for seeding Aadhaar number in their bank account. Dr. Jitendra Singh said Pensioners can approach their paying branches with the PPO, Aadhaar card and bank pass book for trouble-free seeding.
Special AADHAAR Seeding Camps are being held from May 30, 2016 to June 10, 2016. These camps are being organised all over the country in Pension disbursing banks and their branches. Dr. Jitendra Singh said that it is hoped that a large number of Pensioners will be able to benefit from these camps. So as to reach the pensioners and family pensioners located in the remotest corners of the country, this event will be publicised through radio jingles, hand bills, local cable TV network etc., he added

Various steps are being taken by the Government and Pension Disbursing Banks to sensitize Pensioners and Bank Branches and to link up Aadhaar number, PPO number and Bank Account Number so that all Pensioners can avail of the “Jeevan Pramaan” facility.

Dr. Jitendra Singh said, in case the Pensioners do not have an Aadhaar number they can avail of the special facilities set up for this purpose in the bank premises.

“Jeevan Pramaan” is an initiative launched by the Department of Pension & Pensioners’ Welfare, especially for the benefit of the aged and infirm Pensioners/Family Pensioners. Under the scheme Digital Life Certificates can be submitted by Pensioners from personal computers and laptops at home or by visiting a conveniently located Common Service Centre or the nearest branch of any Pension Disbursing Bank. Submission of Digital Life Certificate also ensures authenticity of Pension Payments. So far, more than 15 lakh Digital Life Certificates have been attempted.

The Employees Provident Funds & Misc Provision (EPF&MP) Act gives the framework for operating three important social security schemes for the workers of the country. These Schemes are (i) The Employees Provident Funds (EPF) Scheme 1952; (ii) The Employees Pension Scheme (EPS) 1995; and (iii) The Employees Deposit Linked Insurance (EDLI) Scheme, 1976. Under the provisions of the Employees pension scheme, 1995, pension security is provided for the employees who joined on or after 16.11.1995. In order to provide a bare minimum amount as pension which may help towards social security of EPS Pensioners, the Govt had started providing a minimum pension of Rs.1000/- p.m. to the pensioners under the scheme initially form 1.9.2014 for the year 2014-15.
