UPLOADING OF COURT VERDICT REGARDING PAYMENT OF HRA TO CIVILIAN EMPLOYEES OF DGQA

1. Payment of HRA to DGQA Civ employees is governed SRO 1 E as amended bySRO-31. Recently, some DGQA employees obtained order from Hon'ble CAT, Kolkata Bench in their favour for payment of HRA without requirement of NAC. However Hon'ble High Court of Karnataka and Hon'ble Madhya Pradesh High Court have given judgments on the similar issue in favour of the department.

2. In view of the above, it is felt that uploading of following High Court judgments on DGQAweb site would enable wider dissemination and necessary action, if required by all establishments of DGQA and avoid replying to individual enquiries of units:-

Reservation to Disabled

As per Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, every appropriate Government shall appoint in every establishment such percentage of vacancies not less than three per cent for persons or class of persons with disability of which one per cent each shall be reserved for persons suffering from-

(i) blindness or low vision;
(ii) hearing impairment;
(iii) loco motor disability or cerebral palsy, in the posts identified for each disability.

The Supreme Court in its judgment dated 18.10.2013 in the matter of SLP (7541 of 2009) titled Union of India & Anr. Vs. National Federation of the Blind & Ors has, inter alia, held that the computation of reservation for persons with disabilities has to be computed in case of Group A, B, C and D posts in an identical manner viz., computing 3% reservation on total number of vacancies in the cadre strength.

The Supreme Court has also directed to modify the O.M. 29.12.2005 issued by Department of Personnel and Training consistent with its order.

In pursuance with order of the Supreme Court, Department of Personnel and Training has issued an O.M. dated 3.12.2013 requesting all concerned to take necessary action for implementing the order. The State Government/Union Territories have also been appraised by Department of Personnel and training in this regard.

This information was given by the Minister of State for Social Justice and Empowerment, Shri P. Balram Naik in a written reply to a question in Lok Sabha today.

OFFICE MEMORANDUM

Sub: Implementation of suo motu disclosure under Section 4 of RTI Act, 2005 - Compliance of Section 4 of the RTI Act, 2005.

Attention is invited to this Department's O.M. of even no. dated 15.4.2013 on the subject mentioned above.

2. In that O.M., it was mentioned that each Ministry/Public Authority shall ensure that the guidelines for suo motu disclosure under RTI are fully operationalised within a period of 6 months from the date of their issuance i.e. 15.04.2013. It was also requested that the Action Taken Report on the compliance of guidelines should be sent, alongwith the URL link, to the DoPT and the Central Information Commission soon after the expiry of the initial period of the 6 months. It has been noticed that most of the Ministries/Departments/Public Authorities have not sent the compliance report/Action Taken Report to this Department and Central Information Commission.

3. It is once again requested that the guidelines mentioned in O.M. dated 15.4.2013 be complied with at the earliest and compliance report sent to this Department and Central Information Commission, immediately.

CIRCULAR

It is intimated that Directorate of Estates has commenced the process of filling-up the application Forms for Clearance Certificate/No Demand Certificate etc. through online. No Demand Certificate/Clearance Certificate Is issued to the Allottees’ on Surrender of superannuation required for clearance of 10% Gratuity With-held by Concerned office.

All concerned (allottees) are requested to filling the NDC application form online on vacation of quarter, after retirement or so, duly forwarded by their office.

It is stated that all the staff/employees of Rent/Allotment Section of Directorate of Estates should accept the Online application Form, of the allottees, duly forwarded by their concerned office.

The guidelines may be strictly adhered to.

Subject :Inter cadre transfer of All India Service Officers on grounds of marriage - reg.

The undersigned is directed to refer to the subject mentioned above and to say that EO Division vide OM No. 37/22/2013-EO(SM-1)(i) dated 06-11-2013 has informed as under :-

"While considenng the proposal for inter cadre transfer of Shri Govind Jaiswal, IAS(NL:2007), the Appointments Committee of Cabinet has approved that the cases where the couple officers belong to two different services, out of which one is IAS, would be processed in the Department of Personnel & Training in the first instance. Similarly the cases where the couple officers belong to IPS and IFS, would be considered in the Ministry of Home Affairs in the first instance".

2. It is requested that while processing the cases for Inter cadre transfer of All India Service Officers on grounds of marriage, the same may be processed in accordance with the direction of ACC, as above.
