OFFICE MEMORANDUM

Subject: Promotion of UDCs of Central Secretariat Clerical Services (CSCS) to the Assistants’ Grade of Central Secretariat (CSS) on ad-hoc basis.

The undersigned is directed to refer to this Department’s O.Ms. of even number dated 1ih February, 2015 and 2ih March, 2015 on the subject mentioned above vide which ad-hoc promotion was granted to UDCs of SL-2003 (Extended).

2. This Department, vide O.M. No. 12/5/2015-CS. 11(8) dated 2nd November, 2015 had finalized CSL-2003(Extended) in the UDC grade. Thereafter, it has been observed that finalization of CSL-2003 (extended) has resulted in change in seniority position of many officials. A number of representations have been received in this Department indicating the anomaly as per which many officials who are senior as per the Final CSL-2003(extended) have been working as UDCs, whereas many of their juniorsare working as ad-hoc Assistants. In order to overcome this anomaly, it has been decided with the approval of the competent authority to promote the remaining UDCs of SL-2003(extended) ( who are yet to be promoted till date) as Assistants on ad-hoc basis till further orders. All the concerned Departments/ Ministries are, therefore, requested to promote the remaining UDCs of SL-2003(extended) as Assistants on ad-hoc basis.

3. The officials may be promoted/ appointed as Assistants on ad-hoc basis, after assessing their suitability for promotion by screening the records (APARs) of the officials after ensuring that these officials are clear from the vigilance angle. The ad-hoc promotion/apPointment is subject to the following conditions:-
i) The ad-hoc appointment shall not confer on the appointees any right to continue in the grade indefinitely or inclusion in the Select List or to claim seniority in the Assistant grade of CSS;
ii) Ad-hoc appointments may be terminated at any point of time without giving any reason therefore;
iii) The appointment on ad-hoc basis will take effect from the date of taking over charge to the post of Assistant of CSS.
iv) The ad-hoc appointees would attend and qualify the mandatory training as and when nominated by CS.I (training) section to this Department,(if not already done), failing which they shall have no claim for inclusion in the regular Select List of Assistant.
4. The willingness of the Officials on deputation as to whether they are willing to revert to the Cadre with a view to avail of the promotion will be obtained by the Ministry/ Department from where the Official(s) have proceeded on deputation.

5. Procedure regarding deployment of surplus officials:-

A cadre unit consists of sub-cadre units as well. Choices of the UDCs of the sub-cadre who are to be promoted as Assistant may be obtained and deployed in the cadre unit/sub-cadre units. For example, if 10 UDCs are covered in the list who are to be promoted to Assistant grade and only 6 posts are available in the cadre unit and sub-cadre units put together, the 6 ad-hoc Assistant (senior most) shall be allotted as per their choices and the details of the remaining 4 officials Uunior most) along with their preferences shall be sent to CS.II Division for their onward deployment in those cadre units where there are surplus vacancies. The ope proceedings and the promotion of the officials as ad-hoc Assistants in the manner as indicated above shall be completed as quickly as possible and in no case later than 15-12-2015. The details of the surplus officials who could not be accommodated in the cadre/sub-cadre unit shall be sent to CS.II Division before by 15-12-2015positively.

6. All the cadre units are requested to take necessary action and the whole process may be completed on top priority basis within 15-12-2015. A copy of the appointment order may be endorsed to this Department. A report indicating the names and details of the UDCs who have been appointed/promoted to the post of Assistant on ad-hoc basis as well as those who have not been found fit, with reasons therefore, may be, furnished to this Department by 15th December, 2015, in the prescribed proforma enclosed.

Provision of PMR in One Rank One Pension: Minister Replied in Parliament on 1.12.2015

Minister of State for Defence Shri.Rao Inderjit Singh replied in written form in Rajya Sabha on 1st December 2015 regarding the provision of PMR in One Rank One Pension.

He said that the “certain ex-servicemen associations have been demanding for changes in methodology for fixation of pension, periodicity of its revision, coverage of future PMR cases etc.
Personnel who opt to get discharged henceforth on their own request under Rule 13(3) 1(i)(b), 13(3)1(iv) or Rule 16B of the Army Rule 1954 or equivalent Navy or Air Force Rules will not be entitled to the benefits of OROP. It will be effective prospectively.

The Government has decided to appoint a Judicial Committee to look into anomalies, if any, arising out of implementation of OROP.”

Public health being a State subject, the primary responsibility of providing health care services to the population including women and children in rural areas is that of respect State/UT Government. Under National Health Mission (NHM) support is being provided to States/ UTs to supplement the efforts of the States/UTs to strengthen their health care system for provision of accessible and affordable health care to all those who access public health facilities.

Some of the special measures taken under NHM for the expansion of health services after May, 2014 are given below:-

New initiatives for expansion of health services

1) Launch of India Newborn Action Plan (INAP): INAP was launched in September 2014, for accelerating the reduction of preventable newborn deaths and stillbirths in the country – with the goal of attaining ‘Single Digit Neo-natal Mortality Rate (NMR) by 2030’ and ‘Single Digit Still Birth Rate (SBR) by 2030’. Currently, there are estimated 7.47 lakh neonatal deaths annually.The neo-natal deaths are expected to reduce to below 2.28 lakh annually by 2030, once the goal is achieved.

2) Intensified Diarrhoea Control Fortnight was observed in July- August 2014 and 2015 focusing on ORS and Zinc distribution for management of diarrhoea and improved feeding practices.

3) Integrated Action Plan for Pneumonia and Diarrhoea (IAPPD) launched in four states with highest infant mortality (UP, MP, Bihar and Rajasthan).

4) National Deworming day was observed in eleven States/UTs, namely- Assam, Bihar, Chhattisgarh, Dadra & Nagar Haveli, Haryana, Karnataka, Maharashtra, Madhya Pradesh, Rajasthan, Tamil Nadu and Tripura.

5) Launch of Mission Indradhanush: Mission Indradhanush was launched in December 2014 to reach 90 Lakh unimmunized/partially immunized children by 2020. It has been implemented in 201 districts in 1st Phase, 297 additional Districts are to be covered in 2nd Phase. About 20 lakh children received full immunization during the Phase-1 of Mission Indradhanush.

6) New vaccines: launch of new vaccines has been announced of which Inactivated Polio Vaccine (IPV) has already been launched on 30th November, 2015 and Rotavirus vaccine is planned to be launched on first quarter of 2016. In addition, NVBDCP has recently identified 21 adult JE vaccination districts in Assam, Uttar Pradesh and West Bengal. Adult JE vaccination campaign has been completed in three districts of Assam, selected blocks of three districts of West Bengal and ongoing in selected blocks of six districts of Uttar Pradesh.

7) Launch of Nationwide Anti-TB drug resistance survey: Drug resistant survey for 13 TB drugs was launched to provide a better estimate on the burden of Multi-Drug Resistant Tuberculosis in the community. This is the biggest ever survey in the world with a sample size of 5214 patients. Results are expected by 2016.

8) Kala Azar Elimination Plan : Kala-Azar elimination Plan was rolled out to reduce the annual incidence of Kala-Azar to less than one per 10,000 population at block PHC level by the end of 2015, which inter-alia includes,
  • New thrust areas launched for UP, Bihar, West Bengal and Jharkhand.
  • New Action Plan to include active search, new drug regimen, coordinated Indoor Residual Spray (IRS) etc.
  • New non-invasive Diagnostic kit launched.
9) Kayakalp –Award to Public Health facilities has been launched on 15th May 2015, as a national initiative to promote cleanliness, hygiene and infection control practices in public health facilities. Under this initiative public healthcare facilities shall be appraised and such public healthcare facilities that show exemplary performance meeting standards of protocols of cleanliness, hygiene and infection control will receive awards and commendation.

10) Operational Guidelines have been issued under NHM on :
(i) NHM Free Drugs Service Initiative
(ii) NHM Free Diagnostic Services Initiative
(iii) Mobile Medical Units
(iv) Swachhta Guidelines for public Health Facilities

11) New Guidelines: The following new guidelines to strengthen capacities of States to effectively treat women in rural and urban areas of the country have been prepared:
(i) National Guidelines for deworming in pregnancy
(ii) Engaging General Surgeons for performing C-Sections and Managing Obstetric complications
(iii) Maternal Near Miss Review Operational Guidelines
(iv) National Guidelines for Diagnosis and Management of Gestational Diabetes
(v) National Guidelines for calcium supplementation during pregnancy and lactation
(vi) National Guidelines for screening of hypothyroidism during pregnancy
(vii) Screening for Syphilis during pregnancy
(viii) DAKSHATA – A strategic initiative to strengthen quality of intra and immediate postpartum care empowering providers for improved MNH care during institutional deliveries
(ix) Daksh Skills Lab for RMNCH+A services (training manual for facilitators)
(x) Daksh Skills Lab for RMNCH+A services (training manual for participants)

Changes under Bonus Act

Shri Bandaru Dattatreya, the Minister of State (IC) for Ministry Labour and Employment in reply to a question in Lok Sabha today stated that there is a proposal to increase the eligibility limit and calculation ceiling under the Payment of Bonus Act, 1965.

The minimum wage in the country may not be comparable to those of developed countries owing to differences in exchange rates, purchasing power parity of local currencies, etc. Also under the provisions of the Minimum Wages Act, 1948, both Central and State Governments are appropriate Governments to fix, review and revise the minimum wages of the workers employed in the scheduled employment under their respective jurisdictions. As regards minimum wages in States, there is disparity due to variations in socio-economic and agro-climatic conditions, income, prices of essential commodities, paying capacity, productivity and local conditions. However, as per the available information, a statement showing the range of rates of minimum wages in all the States/Union Territories is enlisted here.

The minimum wages shown for unskilled category for the state of Assam and West Bengal do not include the rates for Tea plantation. However, the rate of Tea Plantation in Tamil Nadu and Kerala are higher than the minimum for unskilled category.

7th CPC has recommended X-Pay of Rs. 6200 to existing defence personnel who are in receipt of X-Pay and possessing qualification equivalent to Diploma approved by AICTE

Group ‘X’ pay for JCOs/ORs and equivalent has been sought to be enhanced by four times from the existing rate of Rs.1,400 per month. In the context of change in nature of warfare the requirement of a higher technological threshold has been emphasized by the Services.

The Commission has taken due note of the emphasis being placed on skilled manpower with higher educational and technological thresholds.

While determining X pay for X group of JCOs/ORs the VI CPC considered the relativity of some of the grades of JCOs/ORs in Group X with diploma holders in engineering on the civil side. In case of civilians, posts requiring minimum qualification of diploma in engineering are placed in GP 4200 and in defence forces, some of the posts in X group whose minimum qualification held equivalent to diploma in engineering are placed in GP 2800.

The element of X group pay was therefore fixed at Rs.1,400. The Commission has examined the existing educational and training requirements of X pay personnel and has already noted the wide variation that exists in the three Services in this regard. It has therefore recommended that all X trades should mandatorily involve obtaining a qualification which is equivalent of a diploma in engineering (recognised by AICTE).

The approach adopted by the VI CPC in determining X pay is agreed with. At the same time the incentive structure needs to have a bearing with the qualifications.

Accordingly, this 7th Pay Commission has recommended the following

i.      X pay for JCOs/ORs in Group X at Rs.6,200 per month for all X trades which involve obtaining a qualification which is equivalent of a diploma recognised by AICTE. This amount is the difference in the minimum of the Pay level 6 (corresponding to Grade Pay of Rs.4200 in VI CPC), and Pay level 5 (corresponding to Grade Pay of Rs.2800 in VI CPC).

ii.      X pay for JCOs/ORs in Group X at Rs.3,600 per month (standard fitment of 2.57 on the existing X pay of Rs.1,400), for those currently in X pay, but not having a technical qualification recognised by AICTE.
