Sub:  Revision of Special Pay granted to  Trolleyman  working  in  Engineering and S&T  Departments - reg.

Ref:  (i) NFIR's PNM Item No. 34/2012.
          (ii) Railway Board's letter No. E (P&A) I-2012/FE-4/5 dated 10/07/2013.

While going through the observations/recommendations of the Committee pursuant to the instructions of  DoP&T  (based on Vth  CPC), the Federation notes that absolutely harsh criteria has been proposed by the committee of Executive Directors, Railway Board in listing out categories for grant of Risk Allowance.

2.  In this connection, NFIR  wishes to bring to the notice of the Railway Board that the nominated Committee was required to bifurcate the categories of staff into two types of risks involved in the course of performing duties as defined by the Vth CPC. These are:

  • Continuous risks: Where the employee is prone to risk fully or partially in the course of performing Railway duties and
  • Contingent  risks:  In this category of risk the Railway employees have to face risk like one - time event and also when the event is uncertain.

3.  Federation further desires to highlight that the Committee has incorrectly denotified following  categories of  staff who face continuous risk  in the course of  performing railway duties by virtue of their job contents:-

  • Gate Keepers
  • Track Maintainers
  • Staff handling 440 Volts & above equipments,
  • Shuntman
  • Shunting Master
  • Shunting Jamadar
  • Shunting Porter
  • Trolley man
  • TRD Lineman
  • Welder

The contention of NFIR could be established  by the fact that every year in the Train accidents, derailments etc some of the staff of above categories get injured and more than often killed due to their nature ofjob involving continuous risk.

List of denotified categories of staff, therefore needs to revised to include at least above categories for payment of Risk Allowance.

NFIR, therefore, requests the Railway Board to  review the decision and issue suitable instructions on the above lines to settle the demand raised in the pNM meeting. Copy of the instructions issued may be endorsed  to the Federation.

Arrears & Rank Pay Revision : Example & Table by PCDA

Implementation of Hon'ble SC Judgment dated 04/09/2012

How pay has been revised on 1/1/86


A. Existing emoluments as on 1/1/86 ie Basic Pay, DA, ADA, Adhoc DA, Interim Relief I and II are added
B. 20 % of Basic pay is added to it
C. Pay is now fixed at next stage above total emoluments so arrived
Earlier the rank pay was deducted from sum of A and B above before fixing the pay in next above stage. This time Rank Pay has not been deducted.

Example 1
Pay of Capt A in the integrated pay scale (2300 —100 —3900-150-5100) on 1/1/86

Basic Pay 1450

Earlier pay was fixed at Rs 3300, which is next stage above 3205 (3405 minus 200)
Now Pay fixed at Rs 3500, which is next stage above 3405.

Example 2
Pay of Capt B in the integrated pay scale (2300 -100 -3900-150-5100) on 1/1/86

Earlier pay was fixed at Rs 3200, which is next stage above 3140 (3340 minus 200).
Now Pay fixed at Rs 3400, which is next stage above 3340.

Earlier pay was fixed at Rs 3400 (minimum prescribed for a Major), despite the fact that the next stage above 2955 ( 3555 minus 600) was 3000.

Now Pay fixed at Rs 3600, which is next stage above 3555.

* Minimum Pay prescribed for the ranks of Maj and Lt Col was Rs 3400/- and Rs 3900/- respectively. Officer already in receipt of same or more pay on the date of promotion, therefore Basic Pay didn't change on these dates.

5th CPC Orders - At the time of promotion, Basic Pay is fixed in the pay scale of higher rank and Rank Pay of higher rank is admitted.

Pay scale of Lt Col 13500 - 400 - 17100
Pay scale of Col 15100 - 450 - 17350

As the starting pay in the scale for Col was 15100, no change in Pay on the date of promotion.
In this case arrears will accrue from 01/01/86 till 01/05/98 only, as the pay drawn and pay due is same after 01/05/98.

Grant of DR to pensioners who are in receipt pension in the pre-revised scale of 5th CPC w.e.f. 1.1.2010

OFFICE MEMORANDUM

Subject : Grant of Dearness Relief to Central Government pensioners who are in receipt of provisional pension or pension in the pre-revised scale of 5th CPC w.e.f. 1.1.2010.

      In continuation to this Department’s OM No. 42/12/2009-P&PW(G) dated 17th November, 2009 sanctioning the Dearness Relief to those Central Government pensioners who are in receipt of provisional pension or pension in the pre-revised scales of 5th CPC, the President is pleased to grant the Dearness Relief to these Central Government pensioners as under :

    (i)     Those who are in receipt of provisional pension or pension in the pre revised scales of 5th CPC are entitled to Dearness Relief @ 87% w.e.f 1.1.2010.

    (ii)     The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12,1985 and are in receipt of ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to Dearness Relief @ 87% w.e.f. 1.1.2010.

2.     The following categories of CPF beneficiaries who are in receipt of ex¬gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR @ 79% w.e.f. 1.1.2010.

    (i)     The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m.

    (ii)     Central Government employees who had retired on CPF benefits before 8.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs. 659/-, Rs. 703/- and Rs. 965/-.

3.     In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue in consultation with the C&AG.

4.    This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their UO No. 377/EV/2010 dated 28.6.2010.
