Paternity Leave, CCS (Leave) Rules, Rule 43-A

Rule-43 A: Paternity leave

(1)  A male Government staff (including an apprentice) with less than two surviving children, may be granted Paternity Leave  by an authority competent to  grant leave for a period of 15 days, during the confinement of his wife for childbirth, i.e., up to 15 days before, or up to six months from the date of delivery of the child.

(1) During such period of 15 days, he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.

(2) The paternity Leave may be combined with leave of any other kind.

(3)  The paternity leave shall not be debited against the leave account.

(4)  If Paternity Leave is not availed of within the period specified in sub-rule (1), such leave shall be treated as lapsed.



NOTE:- the Paternity Leave shall not normally be refused under any circumstances.

I have taken my Paternity Leave in the month of September, 2012 for 15 days along with prefixed the C L. Now the administrative staff of my office telling me that you not avail C L along with Paternity Leave. In this regards, I request you people to response to my query.

PATERNITY LEAVE CAN BE COMBINED WITH ANY OTHER LEAVE.
PATERNITY LEAVE GENERALLY NOT REFUSED.

No, I dont think u r eligible for leave then.

Because you joined after delivery you r not eligible for this.

Of course, you are eligible for paternity leave. In case, you do not use within six months from the date of baby's birth, it will be lapsed

i have joined in july 10 in my central govt service,before entering the service i have one child can i take the leave or not

Sir i have same situation(birth of baby before entry into service, applied for leave when baby was 3 month old) but Administration denied orally with out citing any written comment. please provide any rule so that post facto i can avial Paternity leave.

One more thing i asked administration that suppose in future i may blessed with 3rd child (for first child they denied paternity leave), is that possiblity for paternity leave for 3rd child. They are totally blank on this question (Since paternity leave applicable upto 2 Childs)
