  10. The Post Master………….. Sub: Payment of Additional Quantum of Pension to old pensioner. Representations are being received from various Pension Disbursing Agencies(PDAs) seeking clarification as to from which date payment of additional quantum of pension to the armed forces service pensioners on attaining age of 80 years and above will be paid in cases where age shown in the PPO varies with the exact date of birth mentioned in the office records (i.e original discharge certificate).
The issue has been examined and it is noticed that in all old cases, there was a practice of mentioning the age of armed forces personnel instead of date of birth (though the date of birth was mentioned in LPC cum data sheet provided by the records offices). It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.

Accordingly, it has been decided that in all such cases where pensioner is not satisfied or PDA is not sure regarding date of commencement of additional pension, the cases may be referred to this office through ROs/HOOs' concerned for issuing Corr. PPO for making necessary amendment.

Sub: Grant of additional pension to the pensioners of U.T. Chandigarh - reg.

I am directed to refer to your UO No. CPAO/IT & Tech/U.T. Chandigarh/50/2016-17/167 dated 14th December 2017 on the above subject and to say the in accordance with Rule-2 of CCS (Pension) Rules, these rules are applicable to Government servants appointed substantively to civil services and posts in connection with the affairs of the Union. As mentioned in your note dated 24.4.2017, the employees and pensioners of U.T. Chandigarh are governed by the rules and orders as applicable to the employees of Punjab Civil Services. However, the employees of other U.T. Administrations are governed by the rules regulating the service conditions of Central Government employees.

2. MHA, in their OM dated 24.3.1984 has also clarified that the employees of Union Territory Administration other than Chandigarh are governed by CCS (Pension) Rules, 1972 and that the pay scales and conditions of service of employees of Chandigarh Administration are not covered by the rules governing Central Government employees. Thus, there is no inconsistency in the note dated 24th March, 1984 of MHA. Therefore, there is no need for any amendment to the note of MHA.

A copy of Department of pension & pensioners welfare (DOP&PW)’s O.M. No.38/8/15-P&PW(A) dated 16.04.2015 on the above subject is enclosed for information and compliance. These instructions shall apply mutatis-mutandis on the Railways also’ DoP&PW’s O.M. No.38/37/08-P&PW(A) dated 02.09.2008 mentioned in the O.M. has been adopted on Railways vide Board’s letter No.F(E)III/2008/PN1/13 dated 15.09.2008.

The undersigned is directed to say that vide this Department’s OM No.38/37/08 -P&PW (A) dated 1.9.2008 and ON No.38/37/08-PPW(A) dated 2.9.2008. Instructions were issued for grant of additional pension/family pension @ 20% to 100% to old pensioners/family pensioners of the age of 80 years and above.

2. A question has been raised as to how the amount of additional pension is to be regulated in case the additional pension results in fraction of a rupee. The matter has been examined in consultation with ministry of Finance (Department of Expenditure) and it has been decided that the amount of additional pension as finally calculated may be rounded off to the next higher rupee. In cases where the pension/Family pension of old pensioners has been fixed.revised without rounding off the additional pension, in those cases also, the additional pension may be rounded off to the next higher rupee hereinafter. However, no arrears for the period from 1.1.2006 on account of such rounding off would be paid in those cases.

3. This issues with the approval of Ministry Of Finance (Department of Expenditure)ID No.157/EV/2015 dated 30.3.2015.

Subject: Eligibility of Unmarried Daughters of Armed Forces personnel for grant of Family Pension beyond 25 years of Age.
 
Sir,
 
The undersigned is directed to refer to this Ministry’s ID No.878/A/D(Pen/Sers)/04 dated 21.9.2004 extending the provisions of Department of P&PW OM No. 1/19/03-P&PW (E) dated 25.08.2004 and this Ministry’s letter No.I (3)/2007-D(Pen/Policy) dated 25.10.07 which makes unmarried / widowed / divorced daughter eligible for family pension beyond 25 years of age subject to fulfilment of other prescribed conditions, Attention is also invited to this Ministry’s ID No.9(6)/2007-D(Pen/Policy) dated 21.2.2008 under which it was clarified in consultation with Department of P&PW that liberalised family pension/special family pension (dependent pension) was not covered under the provisions of this Ministry’s above said letter dated 25.10.2007. A lot of references are being received in this Ministry for making unmarried/widowed/divorced daughter eligible for grant of liberalised family pension/special family pension beyond 25 years of age, if otherwise in order.
 
References are also being received in this Ministry for dissolving the provisions contained in Regulation 230(c) of Pension Regulations for the Army Part — 1(1961) and similar provision in Pension Regulations for Navy and Air Force, which debars unmarried daughters for continuance of Special Family pension if they were in receipt of children allowance even after disqualification of all other eligible heir(s).
 
2. The above matter is considered by the Government and it has been decided in consultation with Department of P&PW that unmarried/widowed/divorced daughter also be eligible for grant of liberalised / special family pension beyond 25 years subject to fulfilment of other prescribed conditions as hitherto fore. It has also decided that all unmarried/widowed/divorced daughters, who were earlier or otherwise eligible for children allowance, shall also be sanctioned I liberalised family pension subject to other conditions being fulfilled. The allowance, if being paid, shall be discontinued from the date special/liberalised family pension is sanctioned under these orders. 
 
The provisions contained in Regulations 230(c), 239 & 240 of Pension Regulation for the Army Part - 1(1961) and similar provisions in Pension Regulations for the Navy and Air Force shall stand modified to that extent.
 
3. The family pension to unmarried/widowed/divorced daughters above the age of 25 years shall be payable if all other eligible children below the age of 25 years have ceased to receive family pension and there is no disabled child to receive the family pension. Family pension shall be payable to unmarried/widowed/divorced daughter in order of their date of birth and younger of them shall not be eligible unless the next above has become ineligible for grant of family pension.
 
4. This order will take effect from 6.9.2007 i.e., the date from which Ordinary Family Pension was allowed to unmarried daughters by DoP&PW.
 
5. This issues with the concurrence of Finance Division of this Ministry vide their UO No. 10(8)/2012/Fin/Pen dated 21.11.12.
