Subject: Implementation of the Government decision on the recommendation of the Seventh Central Pay Commission – in respect of Service Pension to the Havildar granted Honorary Rank of Naib Subedar retiring on or after 01.01.2016.

Reference: Circular No. 584 dated 07.09.2017.

Reference is invited towards this office Circular No. 584 dated 07.09.2017. In this circular orders and procedure of pensionary award of 7th CPC were circulated with LPCs & its filling instructions. But the Circular is silent in respect of service pension of Havildar granted Hony Rank of Naib Subedar. A clarification was sought for regarding applicability of MoD letter dated 12.06.2009 for post 2016 retirees. It has now been clarified by the competent authority that ibid MoD letter is also applicable to post-2016 retirees Havildar granted Honorary rank of Naib Subedar.

2. Now, it has been decided that in all such cases the field SI No. 93 (Field name-Average Pay) of LPC-Cum Data Sheet of Circular No. 584 dt 07.09.2017 is invariably to be filled with Notional Pay of Havildar granted Hony. Naib Subedar fixed in Level-6 for Pension purpose only.

3. All other terms and condition shall be applied as per various paras of this govt. order as well as the existing provisions on the issue.

4 This circular is applicable in respect of service pension to the Havildar granted Honorary Rank of Naib Subedar retiring on or after 01.01.2016.

Sub:- Revision of pension wef 01.01.2006 of Pre-2006 pensioners who retired from the 5th CPC scale of Rs. 6500- 10500/- or equivalent pay scale in the earlier Pay Commission periods.

Ref: -This office Important Circular No.195, dated 04.02.2019.

Attention is invited to this office circular No. C-195 dt. 04.02.2019 under which instruction has been issued to PDA for revision of pension/family pension wef 01.01.2006, consequent on the decision issued by GOI DP&PW vide OM No.38/33/12- P&PW (A) dated 04.01.2019 to consider the Grade Pay Rs. 4600 as the corresponding Grade pay in the case of Pre-2006 pensioners who retired/died in the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.

2. For revision of pension/family pension w.e.f. 01.01.2016 of pre-2016 pensioners by notional fixation of pay in the 7th CPC Department of P&PW has issued concordance tables vide OM F. No. 38/37/2016-P&PW (A) dated 06.07.2017. Tables No. 24 & 25 in these concordance tables indicated the revised pension/family pension based on the corresponding 6th CPC grade pay of Rs. 4200/- in respect of pre-2006 pensioners/family pensioners who retired/died in the 5th CPC scale of Rs 6500-10500/-or equivalent pay scale in the earlier Pay Commission periods. Consequent on the decision to consider the Grade Pay of Rs. 4600/- in above cases, revised tables No. 24 & 25 have been issued vide DP&PW OM No. 38/33/12-P&PW (A) dt.09.07.2019 (copy enclosed).

3. For implementation of above OM dt.09.07.2019, you are requested to issue instructions to sub offices under your administrative control to submit the revised LPC-cum-data sheet in affected cases, as procedure prescribed in this office circular No. C-164 dated 30.05.2018, so that corrigendum PPOs for the same may be issued at the earliest.

Representations are being received from various Pension Disbursing Agencies(PDAs) seeking clarification as to from which date payment of additional quantum of pension to the armed forces service pensioners on attaining age of 80 years and above will be paid in cases where age shown in the PPO varies with the exact date of birth mentioned in the office records (i.e original discharge certificate).
The issue has been examined and it is noticed that in all old cases, there was a practice of mentioning the age of armed forces personnel instead of date of birth (though the date of birth was mentioned in LPC cum data sheet provided by the records offices). It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.

Accordingly, it has been decided that in all such cases where pensioner is not satisfied or PDA is not sure regarding date of commencement of additional pension, the cases may be referred to this office through ROs/HOOs' concerned for issuing Corr. PPO for making necessary amendment.

Subject:- Implementation of ‘One Rank One Pension’ to all Pre-01.06.1953 Defence pensioners and their families.

Reference:- Gol, MoD letter No. 12(1)/2014/D(Pen/Policy)-Part-ll dated 3rd Feb 2016 (Circular No. 555 dated 04.02.2016), Circular 557 dated 17.03.2016, Circular 580 dated 05.07.2017, Circular 581 dated 02.08.2017 and Circular 591 dated 13.11.2017.

Pension Disbursing Agencies (PDAs) are aware that as per this office Circular No. 555 dated 04.02.2016, pension of Armed Forces Personnel is to be revised w.e.f. 01.07.2014 by the PDAs as per tables attached with the circular.

In continuation of the same, the rates of ordinary family pension, Special Family Pension, 2nd life award of SFP, Liberalized Family Pension, 2nd life award of LFP, Disability/ Liberalized disability element for 100% Disability, War Injury Element for 100% disability (Invalid out cases) meant for post -53 retirees JCOs/ ORs of Regular Army of Group “Y” may be allowed to the families of pre-53 retirees under OROP scheme.

Further, cases where data is not available with PDAs, the same may be referred to PCDA(P) Allahabad for issue of Corr. PPOs.

In view of the above, this office Circular No. 591 dated 13.11.2017 stands cancelled in toto.

Please refer item 36 of Appendix I under ORDER of RESOLUTION - Ministry of Finance (Department of Expenditure) published in the Gazette of India - EXTRAORDINARY Part-1 Section 1 Notification no. 169 dated 6th July 2017 and Government of India, Ministry of Finance, Department of Expenditure F No. 29/1/12017-E.II(B) dated 11/07/2017 regarding payment on account of discontinued allowances.

The Condiment allowance stands abolished w.e.f. 01/07/2017 vide MOF OM 11/07/2017 and circulated vide CGDA letter No. AN/XIV/14164NII CPC/CircularNo-I dated 21/08/2017.

Reference: This office Circular No. 78 dated 08.07.2010.

Attention is invited to this office circulars no. 78 dated 08.07.2010,

under which a copy of Govt. of India, Ministry of Personnel, Public Grievances & Pensions, Department of Pension & Pensioners’ Welfare, OM No. 4/25/2008-P & PW (D), dated 26.05.2010 regarding grant of Fixed Medical Allowance @ Rs. 3ooI- PM to Central Government Pensioners/Family Pensioners residing in area not covered under CGHS was circulated to all Pension Disbursing Authorities (PDAs).

2. As per Govt. of India, Min. of PPG & P, Deptt. of P & PW OM No.4/25/2008-P & PW (D), dated 19.11.2014, Govt. has decided to enhance the amount of Fixed Medical Allowance from Rs.300/- to Rs. 500/- per month. The other conditions for grant of Fixed Medical Allowance shall continue to be in force. These orders will take effect from 19.11.2014.

3. A copy of Govt. of India, Min. of PPG & P, Deptt. of P & PW OM No.4/25/2008-P & PW (D), dated 19.11.2014 is enclosed for immediate implementation and the payment of Fixed Medical Allowance (FMA) to be regulated accordingly wef 19.11.2014. Other conditions for grant of Fixed Medical Allowance circulated in previous circulars will remain unchanged.

4. It is requested that suitable instructions alongwith a copy of this Circular may please be issued to all sub offices under your administrative control for implementation of the above Government order.

PCDA circular: Grant of Family Pension and gratuity

Subject: - Grant of Family Pension and gratuity to the eligible member of the family of an employee/pensioner/family pensioner reported missing-consolidated instructions regarding.
Reference: - This office Circular No. 498 dated 08.08.2013.

A copy of Govt. of India, Ministry of Defence letter No 1(1)/2010-D(Pension/Policy) dated 23.12.2014 is reproduced wherein it has now been decided to issue consolidated instructions in supersession of previous instructions by various Govt. letters as mentioned in Para-1 of ibid Govt. letter regarding grant of family pension to the eligible members of family of the Armed Forces Personnel/Pensioner/Family pensioner reported missing and whose whereabouts are not known.  It includes those kidnapped by insurgents /terrorists but does not include those who disappear after committing frauds Icrime/desertion etc.

2. In the case of a missing Armed Forces Personnel/ Pensioner/Family pensioner, the family can apply for the grant of family pension, amount of salary due, leave encashment due and the amount of DSOP/AFPP fund and gratuity (whatever has not already been received) to the IHQ / Record Office concerned, where the officers and JCOs/ORs in Army and equivalent in Navy and Air Force, had last served, six month after lodging of police report. The family pension and/or retirement gratuity may be sanctioned by the respective Pension Sanctioning Authorities (PSAs) after observing the following formalities:-

(i) The family must lodge a report with the concerned Police station and obtain a report from the police that the Armed Forces Personnel/ Pensioner/ Family pensioner has not been traced despite all efforts made by them. The report may be a First Information Report or any other report such as a Daily Diary/General Diary Entry, filed by the Police authorities concerned, as per the practice prevalent in the state/ UT.

(ii) An Indemnity Bond should be taken from the nominee/dependents of the Armed Forces Personnel/ Pensioner /Family pensioner that all the payments will be adjusted against the payments due to the Armed Forces Personnel/Pensioner /Family pensioner in case she/he appears on the scene and makes any claim.

3. In the case of a missing Armed Forces Personnel, the family pension, at the ordinary or enhanced rate, as applicable, will accrue from the expiry of leave or the date upto which pay and allowances have been paid or the date of the police report, whichever is later. In the case of a missing pensioner/family pensioner, it will accrue from the date of the police report or from the date immediately succeeding the date till which pension/family pension had been paid, whichever is later.

4. The retirement gratuity will be paid to the family within three months of the date of application. In case of any delay, the interest shall be paid at the applicable rates and responsibility for delay shall be fixed. The difference between the death gratuity and retirement gratuity shall be payable after the death of the employee is conclusively established or on the expiry of the period of seven years from the date of the police report.

5- Before sanctioning the payment of gratuity, Service HQrs/ Record Office will assess all Government dues outstanding against the employee/pensioner and affect their recovery in accordance with instruction in force.

6. The amount of salary due, leave encashment due and the amount of DSOP/AFPP fund will be paid to the family in the first instance as per the nominations made by the Armed Forces Personnel/ Pensioner on filing of a Police report and submission of an indemnity bond as indicated above.

7- The benefits to be sanctioned to the family/nominee of the missing Armed Forces Personnel/ Pensioner will be based on and regulated by the emoluments drawn by him/her as on the last date he/she was on duty including authorised periods of leave.

8. Formats of separate Indemnity Bonds to be used in the case of missing Armed Forces Personnel, missing pensioners and missing family pensioners are available at the official website of PCDA (Pensions) Allahabad i.e. www.pcdapensionnic.in.

Subject: Forwarding of revised LPC-cum-Data Sheets for Retiring and disability Pension Module (Commissioned Officers) of the Pension Sanction Software by incorporating Aadhaar Number, Mobile No. and E-mail ID.

Please refer to this office above cited Section orders under which PHP based LPC-cum-Data Sheet along with instruction for filling of additional columns of Data Sheets for sanction of pensionary awards in r/o Commissioned officers retired/ invalided out from service have been circulated.

2. As you may be aware, Aadhaar-Card Number-based biometric verification system for pensioners as an additional option has been introduced by Govt. of India from Nov 2014. Accordingly, this office issued circular No. 176, 177 dated 17.11.2014 & 19.11.2014 (copies enclosed for information) to all PDAs for accepting Life Certificate issued online by a Govt. agency as result of Aadhaar biometric authentication. It may be mentioned that <www.Jeevanpramaan.gov.in> is an official portal of Govt. of India for all activities relating to issue of this Aadhaar -based biometric authenticated Life Certificate.

3. In the backdrops of introduction of Aadhaar based -life certificate, a need has been felt to capture details of Aadhaar No., Mobile No., residential address and email ID in PPOs to facilitate improved sen/ices to pensioners. Accordingly, LPC-cum-Data Sheet in respect of Retiring Pension circulated earlier and LPC-cum Data Sheet for issue of Corrigendum of it have been replaced with new LPC-cum-Data Sheets under which new columns have been added to incorporate details of Aadhaar Card Number, Mobile No., residential address and E-mail-ID of the pensioners and Aadhaar No. of family members. The information of Aadhaar card is required to be received along with the pension claim from Nodal Agency(PCDA (O) Pune). Therefore, it is requested that the Aadhaar card information with photocopy of same in respect of pensioner, family pensioner and dependants may be obtained from Service H. Qrs or the Units/ offices where the individual has last served and provided to this office in LPC cum data sheet duly filled in with a photocopy of same in support for audit purpose. The Service H. Qrs. are requested to provide the details of Aadhaar Card of officer and family in family detail issued by them at the time of retirement or death for the purpose of notification of pensionary benefits. Revised LPC-cum-Data Sheets for sanction of Retiring Pension (original corrigendum) mentioned below are forwarded herewith for necessary action at your end.

4. The field-wise instructions to fill the LPC-cum-data sheet are enclosed herewith as Annexure for information and necessary action by all concerned. It is requested that all Retiring pension claims may be initiated on revised LPC-cum-Data Sheet so that PPOs/ Corrigendum PPOs may be issued duly incorporating above information in PPOs/Corrigendum PPOs. This additional information will be helpful for Aadhar-based biometric verification system for pensioners.

2. Consequent upon issue of letter No.1 (2)/97/D (Pen-C) dated 31.01.2001 the benefit of Broad Banding i.e. Rounding of Disability, 50% (for disability less than 50%) and 75% (for disability from 50% to 75%) and 100% (for disability from 76% to 100%) provision has been made for those pensioners who have been invalided out from the service on medical ground attributable to or aggravated by military service on or after 01.01.1996. The demand of this benefit for Pre-96 Defence pensioners was pending with the Govt. which had been considered by Cabinet Secretary Committee and recommended for extension of this benefit to Armed Forces Officers and PBORS who were invalided out of service prior to 01.01.1996 and were in receipt of disability/ war injury pension as on 01.07.2009. The Govt. had accepted the above said recommendations and issued order vide MOD letter No. 10(01)/D(Pen/Policy)/2009/Vol-ll dated 19.01.2010.


NEW PROVISION IN BROAD BANDING

3. Now in partial modification of above said GOI, MOD letter dated 19.01.2010, the Government vide MOD letter No. 12(16)/2009/D(Pen/Policy) dated 15.09.2014 has allowed the benefit of broad banding of percentage of disability/ war injury w.e.f. 01.01.1996 to Armed Forces Officers and PBOR pensioners who were invalided out of service prior to 1.1.1996 and were in receipt of disability element/ war injury element as on 1.1.1996. In such cases, where the pensioner was not in receipt of disability element as on 1.1.1996 but became entitled at a later stage due to reassessment of disability more than 20%, this benefit shall also be allowed from the same date i.e. from the date of reassessment.


AFFECTED CASES

4. With effect from 01.01.1996, the concept of broad banding of percentage of disability/ war injury, as provided in Para 7.2 of MOD letter dated 31.01.2001 quoted above, shall be extended to Armed Forces Officers and PBOR who were invalided out of service prior to 01.01.1996 and are in receipt of disability/ war injury pensions as on 01.01.1996. In such cases where the pensioner was not in receipt of disability element as on 01.01.1996, but became entitled at later stage due to re-assessment of disability more than 20%, this benefit shall be allowed from the same date i.e. from the date of reassessment.

5. Further, as per above GOI MOD letter, those cases where the pensioners were in receipt of disability element/ war injury element as on 1.1.1996 but the same was discontinued at a later stage due to reassessment of disability as less than 20%, the disability element/ war injury element shall be discontinued from the later date as hithertofore. However, in those Pre 1.1.1996 cases where the disability element/ war injury element was not allowed for disability being accepted as less than 20% at initial stage or subsequent stage on reassessment of disability, the same will continue to be disallowed and such cases will not be re-opened.


APPLICATION TO BE SUBMITTED

6. For this purpose, each affected Armed Forces pensioner who were invalided out of service prior to 1.1.1996 and were in receipt of disability element/ war injury element on 1.1.1996 or thereafter, shall submit an application in the format enclosed as Annexure to this letter to the PSAs concerned through their Pension Disbursing Agencies and Record Offices thereof in the case of PBOR and through Pension Disbursing Agencies in the case of Commissioned Officers to PSAs concerned for revision of disability element/ war injury element.

7. For the grant of LTA of deceased invalided out of service prior to 01.01.1996 and who were in receipt of disability element/ war injury element as on 01.01.1996 or thereafter, a certificate is to be submitted by the Family Pensioner/ his heir in the format enclosed as CERTIFICATE FOR THE PAYMENT OF LTA to this circular. However, the Part-II & Part-III of ANNEXURE will also be filled up with CERTIFICATE FOR THE PAYMENT OF LTA.


ACTION ON THE PART OF THE PDA

8. Pension Disbursing Authorities are requested that the affected cases of disability/war injury element where Armed Forces Officers and PBOR who were invalided out from service prior 01.01.1996 and were in receipt of disability element/ war injury element as on 1.1.1996 may be reviewed and application obtained in triplicate from them may be endorsed and submitted to the concerned Record Office in the cases of PBOR and directly to the PSA in the cases of Commissioned Officer so that the necessary Corr. PPO for Broad Banding may be issued by the PSA concerned.

9. If a pensioner, to whom benefit accrues under the provisions of this letter, had already died on or after 01.01.1996 but before date of issue of this letter (i.e. 15.09.2014), the application for revision shall be submitted by the family pensioners or by his/ her heir, as the case may be. Payment of LTA shall, however, be regulated as per the extant Government orders on the subject matter.

10. PDA to ensure that format enclosed in cases for ‘CERTIFICATE FOR THE PAYMENT OF LTA’ is properly filled along with Part-ll of Annexure and the same is verified by them.


ACTION ON THE PART OF THE RECORD OFFICE

11. ROs are requested that on receipt of the ANNEXURE for Broad Banding from the individual or CERTIFICATE FOR THE PAYMENT OF LTA from the family pensioner/ his/her heir duly filled by the PDAs the same may please be forwarded to concerned PSAs duly verified along with completed

LPC-Cum-Data Sheet, photo copy of original and latest D/ DE PPOs for issue of necessary Corr PPO. The following documents may invariably be forwarded along with the claim-

(i) CTC of Sheet Rolls’ page indicating clause of discharge.
(ii) Discharge Part-ll order showing the clause of discharge and where Part-II order is not available, a certificate, certifying that the individual had been invalided out/ deemed to be invalided out duly showing the clause of discharge.
(iii) A certificate to the effect may also be enclosed that “no claim on this account has earlier been initiated” to avoid recurrence of double PPO for the same claim.

 12. ROs are also requested to review all such cases where Broad Banding benefit has already been notified by concerned Pension Sanctioning Authorities wef 01.07.2009 and where disability was assessed as for life before 01.01.1996.

A list of such cases indicating individual’s details i.e. Name, Regt. Number, Original PPO Number, Corrigendum (Broad Banding) PPO No. and Current PDA details may be forwarded to concerned PSA for further necessary action.

13. This may please be given wide publicity.

Policy for posting on sensitive Assignments: Principal Controller of Defence Account (Central Command) - PCDA (CC) Order

 1. The station-wise seniority will be considered as and when vacancy arises at particular station.

2. At least one year's stay is essential at the station.

3. The date of occurrence of vacancy will be the date when the existing incumbent completes three years of his sensitive posting on that assignment. In case of retirement, the date of retirement will be reckoned as the date of occurrence of vacancy.. In case of permanent transfer, which happen before date of completion of three years tenure, the date of being relieved from the assignment will become the date of vacancy.

4. Seniority in respect of those who have previously served on sensitive assignments will be reckoned with effect from the date of completion of sensitive tenure served by them on previous occasion provided they have completed minimum cooling off period of three years.

5. APAR grading of minimum three 'Very Good and above for the immediately preceding three years of relevant quarter. In case there is missing AFAR among these three years, the inidivudual 's name will be dropped for consideration in that quarter and considered in next one provided the missing AFAR has been received.

6. For third sensitive assignments minimum of two outstandings-Fone very good AFAR grading is essential.

7. Persons who have served thrice or more on sensitive assignment will not be considered for further sensitive assignment.

8. Posting to the sensitive assignment will be decided on quarterly basis one month in advance through the Placement Board.

9. The crucial date for deciding seniority I cooling off period /station seniority of one year will be first day of the quarter.

10. If a person forgoes the sensitive assignment, he/she would be debarred for the sensitive posting for five years from the date of acceptage,

11. The sensitive assignment will be given to only those persons who have at least one year (12 months) service in hand.

12. The period spent by individuas in AO (Projects) Border Road/Unit Accountant Formations are treated as sensitive assignment and period spent in Imprest Section of Pay Accounts Office will not be considered as sensitive assignment.

13. If the eligible persons are not available at the same station, then volunteers may be called for from the whole Command.

14. In case of any eventuality not covered above arising the posting and selection will be done at the discretion of PCDA (CC).

15. The period spent in DPDO office is also not considered as sensitive assignment.
