Cabinet approves revision of pay and allowances of Lieutenant Governors of Union Territories

  The Union Cabinet chaired by Prime Minister Shri Narendra Modi has given its approval for revision of pay and allowances of Lieutenant Governors of Union Territories. It will bring the pay and allowances of LGs at par with that of the Secretary to the Government of India.

Details:
The Cabinet has approved the proposal for increasing the pay and allowances of Lieutenant Governors of Union Territories with effect from 1st January, 2016 from Rs.80,000/- per month plus dearness allowance, sumptuary allowance at the rate of Rs.4,000/- per month and local allowances to Rs. 2,25,000/- plus dearness allowance, sumptuary allowance at the rate of Rs.4,000/- per month and local allowances at the same rate as applicable to the officers of the rank of Secretary to the Govt. of India It will be subject to the condition that the total emoluments (excluding sumptuary allowance and local allowances) shall not exceed the total emoluments drawn by the Governor of a State.

Background:
The pay and allowances of Lieutenant Governors of Union Territories remain at par with those of officers of the rank of Secretary to the Government of India. The pay and allowances of Lieutenant Governors of Union Territories was last revised with the approval of the Cabinet with effect from 1st January, 2006 from Rs. 26,000/- (fixed) per month to Rs.80,000/- (fixed) per month plus dearness allowance, sumptuary allowance at the rate of Rs.4,000/- per month and local allowances.

The pay of officers of the rank of Secretary to the Government of India has been revised from Rs. 80,000/- to Rs. 2,25,000/- per month with effect from 01.01.2016 as per CCS (Revised) Pay Rules, 2016.

Sub: Pending issues of Central Government Employees

Dear Sir,
As you are aware that the Central Government Employees issues particularly review of New Pension Scheme, Minimum Wage and Fitment Formula are pending since long. Its unfortunate that inspite of assurance given by Cabinet Ministers and our pursuation with you time to time has not yielded any result so far. We had deffered the strike on a clear cut assurance but the committees formulated to resolve the issues have not done any thing, with the result creating lot of anguish amongst Central Government Employees.

It is also unfortunate that inspite of continues persuation the meeting of National Council has also not been fixed gives an impression than no body is serious for resolution of long pending demands of Central Government Employees. The National Council JCM (Staff Side) had tried its level best for a negotiated settlement but unfortunately could not succeed due to willingly attitude of Government.
In view of all round dissatisfaction among Central Government Employees it is requested that the above demands could be resolve without further loss of time and meeting of National Council (JCM) should also be convend at an earliest to resolve the other issues submitted as agenda.

Release of Berths Under Emergency Quota in Railways

In order to meet the urgent travel requirements of High Official Requisition (HOR) holders, which includes Central Government Ministers, Judges of Hon'ble Supreme Court/High Courts of various States, Members of Parliament and other emergent demands, who are on the waiting list, a limited number of berths have been earmarked as Emergency Quota in different trains and in different classes.

The quota is released by the Railways in accordance with the priority as per warrant of precedence and well established practice being followed since long. At the time of allotment of berths/seats, emergency quota is first allotted for self travel of HOR holders/Members of Parliament, etc., strictly as per their inter-seniority in warrant of precedence.

Thereafter, other requisitions received from various quarters are considered and the remaining quota is released taking into account various factors like status of passengers travelling, nature of urgency like travelling on government duty, bereavement in the family, sickness, job interview, etc.

Emergency Quota Cells are located at Zonal/Divisional Headquarters and at some of the important non-Headquarter stations. These Cells normally function under the control of a gazetted officer supported by requisite number of staff posted by Zonal Railways.

Sub: Brief of the meetings held between the Staff Side (JCM) and Official Side

Met yesterday, i.e. on 9th April, 2018, with the Secretary (DoP&T), Government of India, Dr. C. Chandramauli, who joined recently, and requested him for holding meetings of the Standing Committee of the NC/JCM and National Anomalies Committee at an earliest. He has promised for the same.

Today, i.e. on 10th April, 2018, met the Cabinet Secretary, Government of India, and handed him over a copy of the enclosed letter.

He said that, the issue of the NPS is under finalization and Secretary(Pension), Government of India, had very recently given presentation. He further said that, there would be some visible changes in the NPS.

On the issue of Minimum Wage and Fitment Formula he once again mentioned that it depends totally on the political call.

So far the issue of non-holding of meetings of the National Council (JCM) is concerned, he said that he would try to hold this meeting very shortly.

SCHEME FOR PROMOTION OF ADVENTURE SPORTS & SIMILAR ACTIVITIES AMONGST CENTRAL GOVERNMENT EMPLOYEES

1. Background: The Department of Personnel and Training recognizes that welfare of employees is one of the prime tasks of personnel management and sports activities play an important role in improving their efficiency and morale. Participation by Central Government Employees in adventure sports and similar activities will give them a platform where they would learn lessons from nature and use the knowledge acquired for welfare of the society.

2. Vision: To foster spirit of risk-taking, cooperative team work, capacity of readiness, vital response to challenging situations, endurance and environmental awareness.

3. Mission: The Mission of the Scheme for promotion of adventure sports and similar activities is to encourage Central Government Employees working in the Ministries/Department of the Government of India to take pa,'! in these activities by giving financial assistance and other incentives. The Central Civil Services Cultural & Sports Board, a Society registered under the Society Registration Act, 1860, which is under the aegis and control of the Department of Personnel & Training will be the nodal agency for the Scheme.

4. Objectives:
(i) The Scheme would tackle the alarming situation of stress and impact of sedentary life on Government servants as highlighted in several studies conducted so far;
(ii) It would provide a creative outlet to Central Government Employees;
(iii) It would create and foster spirit of risk - taking, cooperative team work, capacity of readiness and vital response to challenging situations and of endurance;
(iv) Central Government Employees would be prepared for better Disaster Management; and
(v) Environmental awareness would be inculcated amongst the Central Government Employees.

5. Scope of the Scheme: The scope of the Scheme is limited to Central Government Employees working in the Ministries/Departments of Government of India. It will also be limited to the programme run by Institutes/Organizations approved by the Department of Personnel & Training.

6. Activities to be sponsored and Institutes: The Department of Personnel & Training will sponsor programmes of 5-7 days duration to be organized by the Institutes/Organizations listed at Annex-I. The programme wi ll have components of environmental awareness, disaster management, team spirit, capacity building, and Swachchh Bharat Campaign. The activities under the programme will be Trekking, Mountaineering, Rock-Climbing, Cycling in a difficult terrain, Skiing, Surfing, Boat Sailing, Snorkeling, Rafting, Para Sailing Ballooni ng, Para Gliding, Jung le Safari/Trekking, Desert Safari/Trekking, Beach Trekking and Environmental Awareness Camps etc. A Calendar of the programmes admissible under the Scheme will be circulated by the Department of Personnel & Training from time to time .

7. Financial Assistance and other incentives:
7.1 The Department of Personnel & Training will provide financial assistance to the eligible Central Government Employees for the programme of approved activities and conducted by the Institutes listed in Annex I.

7.2 Financial assistance will be in the form of reimbursement of Travel Expenses, programme fee and Hiring Charges of the equipments as per the terms and conditions specified in paragraph 7.3 and with a maximum ceiling of Rs.20,000/- (Rs. Twenty thousand only) per person per camp. The assistance will be limited to one activity in a block period of two year. Financial Assistance of 100% of programme fee would be provided in a calendar year to two officials of each Ministries/Departments who have been awarded by the Ministry/Department for excellence In service and nominated for the programme.

7.3 The fo llowing Heads are admissible for fi nancial assistance under the Scheme:

i) To and fro travel expenses as per the entitlements under Leave Travel Concessions Rules with a maximum ceiling of Rs. 4,000/-;
ii) Re-imbursement of Programme fee :

(a) 90% for Group' C' Central Government Employee;
(b) 80% for Group' B' Central Government Employee; and
(c) 75% for Group' A' Central Government Employee.

iii) Actual hiring charges if the necessary equipment are hired from any Government agency with adequate proof subject to maximum of Rs. 2000/-.
7.4 Special Casual Leave will be granted to eligible participants in accordance with Department of Personnel & Training Office Memorandum No. 6/1/1985-Estt.(Pay-I) dated 16th July, 1985 and No. 6/ l/85- Estt(Pay-I) dated 7th November, 1988.

8. Procedure for availing benefits of the Scheme:
8.1 The Central Government Employee will register himself with the Institute/Organization for the approved programme and make payment for it. He/she will simultaneously also submit his/her application to Central Civil Services Cultural & Sports Board duly forwarded by the Welfare Officer of their respective Ministry / Department.

8.2 The Ministry/Department will forward nominations of officials who have been awarded by the Ministry/Department for excellence In service and eligible for Financial Assistance of 100% of programme fee.

8.3 The Welfare Officer of the Ministry/Department in each case will certify that the recommended official is a Central Government employee working in the main Ministry/Department and medical ly fit for the adventure activities opted by him.

8.4 The financial assistance will be given on successful completion of the programme and submission of participation certi ficate to the Central Civil Services Cultu ra l and Sports Board.

9. Flexibility to expand the scope :The Department of Personnel & Training wil l reserve the rights to modify the scheme, addition or deletion of activities, Institutes/Organization, change in pattern of financial assistance and other conditions of the Scheme without any prior notice .

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) the number of homeopathic doctors working in the CGHS Homeopathy Dispensaries in the country, State/UT-wise particularly in Delhi;

(b) whether there is a acute shortage of homoeopathic doctors in the CGHS dispensaries, if so, the details thereof and the reasons therefor;

(c) whether the CGHS Homeopathic dispensaries disburse only generic/ substandard medicines available in the store and not indented good quality of medicines through medical store;

(d) if so, the details thereof and the reasons therefor; and

(e) the corrective steps taken by the Government to address the shortage of homeopathy doctors in CGHS dispensaries and also make available quality homeopathic medicines?

(e): Following steps have been taken to address the shortage of homeopathy doctors in CGHS dispensaries and also make available quality homoeopathic medicines:-

Homoeopathic Doctors are recruited through UPSC against vacant posts on regular basis.
There is a clause in the e-tender document for procurement of medicines regarding quality assurance.
The medicines are accepted in the CGHS Homeopathic dispensaries only if:-
(i) The lab analytical report of each batch of medicines from the NABL accredited laboratory is enclosed.
(ii) The medicines conform to the Homeopathic Pharmacopoeia of India (HPI) quality standard.

If any parameter of the batch supplied is found not matching with the HPI quality standard, the sample of the same is further tested from the Govt. Homeopathic Pharmacopoeia Laboratory (HPL) and accepted only if passed in the drug test. No substandard medicine is accepted by the CGHS Homeopathic Medical Store Depot (HMSD).

Subject:- Clarification regarding demarcation of CGHS covered areas under CGHS Wellness Centre

With reference to the above subject the undersigned is directed to state that in some of the CGHS Cities the areas covered under CGHS were not specified resulting in inconvenience to the beneficiaries. The matter has been reviewed and it is now decided that hereinafter the coverage of CGHS shall be limited to the areas within 5 km (approx.) radius of the CGHS Wellness Centres , in all CGHS covered Cities , where such demarcations were not specified. The Additional Director, CGHS concerned City shall notify such areas covered under CGHS Wellness Centres.

The serving Central government employees residing outside the CGHS covered areas shall be covered under CS(MA) Rules. However, in all CGHS covered cities the serving Central government employees residing within the Municipal limits of the city, shall be given a onetime choice to opt for CGHS (instead of CS(MA) Rules) from the nearest CGHS Wellness Centre.

Subject : Reiteration of instructions relating to application of own merit in Direct Recruitment for appointment of Other Backward Classes (OBCs)-regarding

The undersigned is directed to say that the Hon’ble Supreme Court in its judgment in the case of R. K. Sabharwal vs. State of Punjab, had, inter-alia, observed that “the reserve category candidates can compete for the non-reserve posts and in the event of their appointment to the said posts their number cannot be added and taken into consideration for working out the percentage of reservation.”

2. As per instructions issued vide this Department’s OM No. 36012/2/96-Estt.(Res) dated 02.07.1997, in direct recruitments to Central Government jobs and services, the reserve category candidates who are selected on the same standard as applied to general candidates will not be adjusted against reserved vacancies. As per instructions issued vide DOP&T OM No. 36011/1/98-Estt.(Res) dated 01.07.1998, only when a relaxed standard is applied in selecting a reserved candidate, for example in the age limit, experience, qualification, permitted number of chances in written examination, etc., such candidates will be counted against reserved vacancies.

3. It has been brought to the notice of this Department by the Hon’ble Parliamentary Committee on Welfare of OBCs that these instructions are not being followed in some cases in direct recruitments to Central Government jobs and services. It is, therefore, reiterated that while making Direct Recruitments, guidelines issued vide this Department’s OM No. 36012/2/96-Estt.(Res) dated 02.07.1997 and OM No.36011/1/98-Estt.(Res) dated 01.07.1998 may be kept in view by all concerned.

(b) the reasons for converting existing percentage based system of disability pension into slab based system;

(c) the steps taken by the Government to rectify the discrepancies that have emerged in disability pension system after Seventh Central Pay Commission;

(d) whether the Government is considering to bring disability pension of defence services equivalent to disability pension in civil sector in Seventh Central Pay Commission and make a review thereof; and

(e) if so, the details thereof and if not, the reasons therefor?

(a) to (e): The 7th Central Pay Commission (CPC) recommended the following on disability pension:-

The Commission is of the considered view that the regime implemented post 6th CPC needs to be discontinued, and recommended a return to the slab based system. The slab rates for disability element for 100 percent disability would be as follows:-

 

The above recommendation was accepted and Resolution dated 30.09.2016 issued accordingly.


The 6th CPC dispensation of the calculation of disability element on percentage basis, however, continued for civil side which resulted in an anomalous situation. The issue was accordingly referred to the Anomaly Committee. The Anomaly Committee recommended that parity with civilians for grant of disability element which was granted to the Defence Forces Personnel under 6th CPC may be maintained which was approved by the Cabinet. Government order in this regard has been issued on 4th September, 2017.

(a) whether the Seventh Central Pay Commission (CPC) has recommended option-I for ensuring equal basic pension to pre – 2016 and post – 2015 pensioners retiring from similar/equal posts and stages and if so, the details thereof;

(b) whether the Government has finally not accepted that recommendation and if so, the details thereof; and
(c) the steps taken/being taken by the Government to ensure that such similarly placed pensioners get equal basic pension from 01.01.2016?

(a) to (c) The 7th Central Pay Commission had recommended two formulations for revision of pension of employees who retired before 01.01.2016 and the employees were given option to choose whichever formulation was beneficial. As per the first formulation, the Commission recommended for revision of pension based on notional pay arrived at by adding the number of increments an employee had earned in the appropriate level while in service. This formulation was later on examined by a Committee under the Chairmanship of Secretary, Department of Pension and Pensioners’ Welfare.

The Committee recommended that instead of counting of increments earned in the retiring scale and applying directly to the 7th Pay Commission Pay Matrix, a more scientific and rational method would be to refix pay in each successive Pay Commission as per the formula for revision of pay right up to the 7th Pay Commission. This method of fixing notional pay and pension would benefit a larger number of pensioners as compared to the increment method which benefits only a select segment of pensioners who served for a longer period in the retiring scale without being promoted to a higher grade.

This has been accepted by the Government and appropriate orders have been issued.

(a) whether the reports of successive Pay Commissions have been increasing the burden on Government finances/ exchequer in partially accepting their recommendations for increase in wages and if so, the details thereof;

(b) whether the last Pay Commission has suggested productivity linked pay hike to the deserving employees to eliminate below average or mediocre performance and if so, the details thereof;

(c) whether such periodic hikes in wages resulting from Pay Commission recommendations trigger similar demands from the State Government/public utility employees, imposing burden on already strained State finances and if so, the details thereof; and

(d) whether the Government is considering an alternative for increasing the salaries and allowances of Central Government employees and pensioners in future instead of forming Pay Commission and if so, the details thereof?

(a) The financial impact of the recommendations of the Central Pay Commission, as accepted by the Government, is normally more pronounced in the initial year and gradually it tapers off as the growth in the economy picks up and fiscal space is widened. While implementing the recommendations of the last Central Pay Commission, i.e., the Seventh Central Pay Commission, the Government staggered its implementation in two financial years. While the recommendations on pay and pension were implemented with effect from 01.01.2016, the recommendations in respect of allowances have been implemented with effect from 01.07.2017 after an examination by a Committee. This has moderated the financial impact of the recommendations. Moreover, unlike the previous 6th Pay Commission, which entailed substantial impact on account of arrears, the impact in the year 2016-17 on account of element of arrears of revised pay and pension on the present occasion of the 7th Central Pay Commission pertained to only 2 months of the previous financial year of 2015-16.

(b) The Seventh Central Pay Commission in Para 5.1.46 of its Report proposed withholding of annual increment in the case of those employees who are not able to meet the benchmark either for Modified Assured Career Progression (MACP) or regular promotion within the first 20 years of their service.

(c) The service conditions of employees of State Governments fall within the exclusive domain of the respective State Governments who are federally independent of the Central Government. Therefore, the concerned State Governments have to independently take a view in the matter.

(d) No such proposal is under consideration of the Government.

Procedure for Admission in KV Schools through MP recommendations

As per the decision taken in the 103rd Board of Governors meeting held on 30.10.2015, the existing quota of 06 (six) children for admission in Kendriya Vidyalayas on the recommendation of Hon’ble Members of Parliament during each academic session under the Special Dispensation Scheme is enhanced from 06 to 10 (ten) with effect from the academic session, i.e. 2016-17.

The Revised Scheme of Special Dispensation Admission for Members of Parliament comes into vogue with effect from the academic session 2016-17 with the following features:

1. Each Hon'ble Member of Parliament can refer 10 (ten) cases for admission under the scheme in an academic year but such recommendations shall be confined to children whose parents belong to his constituency either by domicile or on account of having been soon-before posted there or else on account of exigencies of service, migrate to his constituency. Such recommendations would be for admissions in Kendriya Vidyalaya(s) located in his constituency only. In case there is no Kendriya Vidyalaya in the constituency of the Hon'ble MP(Lok Sabha), she/he can recommend these admissions in the Kendriya Vidyalaya(s) located in any neighbouring contiguous constituency. For Members of Rajya Sabha, the State from which the member has been elected would be deemed to be his constituency for this purpose. Nominated members of Rajya Sabha and Lok Sabha can recommend 10 cases for admission in any one or more Kendriya Vidyalaya(s) of the country.

2. These admissions shall be over and above the class strength.

3. These recommendations would be made for classes I and IX.

4. These admission would be made at the beginning of the academic year and no admission would be allowed after the prescribed cutoff date of the year.

5. The recommendations to be made shall be valid only if these are made in the prescribed format provided to each Members of Parliament by KVS(HQ). Recommendations sent in any other format/manner shall not be considered.

6. The children recommended by Hon'ble Members of Parliament must be otherwise eligible for admission as per the extant KVS Admission Guidelines.
