1. Refer further to this office letter No.CC-3/85610/47/MACP/D’ Man/6th/CSCC dated 21 April 2017.

2. The undersigned is directed to inform that the approval of grant of 2nd Financial Upgradation after completing 24 yrs of service under ACP scheme of DoPT in respect of Draughtsman & Tech Officers in the pay scale of Rs.15600 – 39100 plus Grade pay of Rs. 6600/- in MES for the intervening period between 01 Jan 2006 to 30 Aug 2008 was granted by MoD after thorough scrutiny of the proposal.

3. Some complaints & grievances were filed against this grant of 2nd Financial Upgradation under ACP scheme by few individuals. In this connection the matter was again sent to MoD for further scrutiny and examinations. The decision of MoD in this regard is reproduced below :-

 “It is stated that the case for grant based on the analogy of Draughtsman Cadre of MES and Assistant (Arch Department) of CPWD provided by E-in-C’s Branch and as per Financial Upgradation to the TOs of Draughtsman Cadre of MES was granted as per the extant rules and guidelines of DoP&T.”

4. In view of the above, it is advised to take further necessary action as per the clarification of the MoD

Leave granted.

2. The instant batch of appeals have been filed assailing the orders of various High Courts dismissing petitions filed by the appellants, thereby upholding decisions rendered by different Benches of Central Administrative Tribunal granting financial upgradation of grade pay in the next promotional hierarchy by placing reliance upon Union of India and others v. Raj Pal and another CWP No.19387 of 2011 dated 19.10.2011. In these batch matters, we are concerned with the question whether MACP Scheme entitles financial upgradation to the next grade pay or to the grade pay of the next promotional hierarchy.

3. In all these appeals, almost all the High Courts have followed the Raj Pal and Ved Prakash’s case and granted relief as prayed for by the Being aggrieved, the appellant- UOI has filed these appeals.

4. The main questions falling for consideration in these appeals are:-
  •     Whether MACP scheme entitles financial upgradation of pay to the next grade pay or to the grade pay of the next promotional post as envisaged under the ACP scheme? Whether MACP Scheme envisages grant of financial upgradation in Grade Pay Hierarchy and not in promotional hierarchy?
  •     As contended by the respondents, whether MACP scheme is disadvantageous to the employees in comparison to ACP scheme as long as the financial upgradation is granted in hierarchy of grade pay under MACP scheme?
  •     Whether respondents are entitled to stepping up of their grade pay to be at par with grade pay of their juniors who were getting the higher grade pay on account of implementation of MACP Scheme?

Appeals relating to Issue No.III were ordered to be de-tagged and listed separately.

At the outset, it is to be pointed out that almost all the Tribunals/High Courts have only relied upon Raj Pal’s case for grant of financial upgradation on promotional hierarchy and rejected the stand of the appellant-UOI that under MACP scheme, the employees are entitled to financial upgradation of the next grade pay only. Since the matter was considered on merits and since the issue involves impact on the public ex- chequer and also interest of the staff of various establishments, we requested learned Senior counsel, Mr. Jaideep Gupta to assist the Court as amicus curiae which the learned Senior counsel has readily Mr. Kunal Chatterji, learned counsel has agreed to assist the learned Senior counsel-amicus.

Assured Career Progression (ACP) Scheme :-

6. The Government of India with a view to “deal with the problem of genuine stagnation and hardship faced by the employees due to lack of adequate promotional avenues”, introduced the Assured Career Progression (ACP) Scheme with effect from 09.08.1999 vide its Office Memorandum dated 09.08.1999. To mitigate the hardship in cases of acute stagnation in a cadre or in an isolated post, it has been decided to grant two financial upgradations under the ACP Scheme to Group ‘B’, ‘C’ and ‘D’ employees on completion of 12 and 24 years of regular service. As per ACP Scheme, isolated post in Group ‘A’, ‘B’, ‘C’ and ‘D’ cadres which have no promotional avenues also qualify for similar benefits. The financial upgradations under the ACP Scheme is placement in the higher Pay Scale and financial benefits in the higher Pay Scale without regular promotion. Under the financial upgradation, grant of financial benefits under the ACP Scheme to the government servants concerned is on personal basis. Such financial upgradation neither amounts to regular promotion nor require creation of new post. Some of the salient features of the ACP Scheme are as follows:-
  •     The ACP Scheme envisages merely placement in the higher pay- scale/grant of financial benefits (through financial upgradation) only to the Government servant concerned on personal basis and shall, therefore, neither amount to functional/regular promotion nor would require creation of new posts for the purpose;
  •     Under the ACP Scheme, two financial upgradations shall be allowed to Group ‘B’, ‘C’ and ‘D’ employees on completion of 12 years and 24 years of his/her regular service. As per para 1 of Annexure-1 – conditions for grant of benefits under the ACP Scheme, it is stipulated that two financial upgradations would be available only if no regular promotion during the prescribed period (12 and 24 years) was granted to an employee. If an employee has already received one regular promotion, he/she would qualify for second ACP only on completion of 24 years of regular service. However, in case if two regular promotions have been received by an employee, no further benefit under the ACP Scheme would accrue in favour of the employee.
  •     As per para 1 of the Office Memorandum dated 09.08.1999, the grant of financial upgradations under the ACP Scheme shall be subject to the conditions mentioned in the Annexure-I annexed thereon to the Office Memorandum dated 09.08.1999.
7. Para 8 of the Annexure provides that the financial upgradations shall be purely personal to the employee and would have no relevance to his/her seniority position. In other words, there would be no additional financial upgradations for the senior employee on the ground that the junior employee has got the higher pay scale under the ACP Scheme. Para No.12 of Annexure-I provides that the ACP Scheme contemplates merely placement on personal basis in the higher pay scale/grant of financial benefits only and shall not amount to actual functional promotion of the employees concerned. We may usefully refer to the relevant features of the ACP Scheme as stipulated in Annexure-I to the Office Memorandum dated 09.08.1999-Conditions for Grant of Benefits under the ACP Scheme, which reads as under:-

Conditions for grant of benefits under the ACP Scheme :-

1. The ACP Scheme envisages merely placement in the higher pay-scale/grant of financial benefits (through financial upgradation) only to the Government servant concerned on personal basis and shall, therefore, neither amount to functional/regular promotion nor would require creation of new posts for the purpose;

4. The first financial upgradation under the ACP Scheme shall be allowed after 12 years of regular service and the second upgradation after 12 years of regular service from the date of the first financial upgradation subject to fulfilment of prescribed conditions. In other words, if the first upgradation gets postponed on account of the employee not found fit or due to departmental proceedings, etc. this would have consequential effect on the second upgradation which would also get deferred accordingly;

8. The financial upgradation under the ACP Scheme shall be purely personal to the employee and shall have no relevance to his seniority position. As such, there shall be no additional financial upgradation for the senior employee on the ground that the junior employee in the grade has got higher pay-scale under the ACP Scheme;

12. The proposed ACP Scheme contemplates merely placement on personal basis in the higher pay-scale/grant of financial benefits only and shall not amount to actual/functional promotion of the employees concerned. Since orders regarding reservation in promotion are applicable only in the case of regular promotion, reservation orders/roster shall not apply to the ACP Scheme which shall extend its benefits uniformly to all eligible SC/ST employees also. However, at the time of regular/functional (actual) promotion, the Cadre Controlling Authorities shall ensure that all reservation orders are applied strictly;

8. ACP Scheme was replaced by Modified Assured Career Progression (MACP) Scheme which became operational with effect from 09.2008. The Sixth Central Pay Commission has recommended the adoption of MACP Scheme primarily to rectify the problems arising from inter-departmental disparities:-

  •     ACP Scheme led to creation of certain disparities within the employees in different organisations/departments who were directly recruited in the same pay scale who received different financial upgradations under the ACP Scheme because of existence of different promotional hierarchical structure and different promotional pay scales in different organisations/ departments;
  •     Another adverse consequence in the implementation of the ACP Scheme was that the benefit of a higher pay scale was not available if the next post in the hierarchy also existed in the identical pay scale. 
9. In order to bring systematic changes in the existing scheme of ACP so that all employees irrespective of existing hierarchical structure in their organisations/cadre get the same benefit, MACP was recommended by the Sixth Central Pay Commission which was accepted by the Government with certain modifications vide its Office Memorandum dated 05.2009. Under the Sixth Central Pay Commission, revised pay structure has been implemented with effect from 01.01.2006; whereas benefits of ACP Scheme have been allowed till 31.08.2008. Vide Office Memorandum dated 19.05.2009, the Government of India introduced the MACP Scheme, in supersession of the ACP Scheme w.e.f. 01.09.2008. There shall be no change in distinction, classification or higher status on grant of financial upgradation under MACP as the upgradation is purely personal and merely placement in the next higher Grade Pay.

Modified Assured Career Progression (MACP) Scheme:-

10. Under the MACP Scheme, three financial upgradations are made available in the next grade pay to an employee who has completed 10, 20 and 30 years of regular service in the same post without getting any The benefit would be available at the next higher grade pay. Some of the salient features of the MACP Scheme are as follows:-

  •     Para 2 of the MACP Scheme provides that the “MACP Scheme envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay”.
  •     As per para 10 of the MACP Scheme – Office Memorandum dated 19.05.2009, no stepping up of pay in the pay band or grade pay would be admissible with regard to junior getting more pay than the senior on account of pay fixation under the MACP Scheme.
  •     As per para No.11 of the said memorandum dated 19.05.2009, the differences in pay scales on account of financial upgradations under the ACP Scheme and MACP Scheme would not be construed as anomaly.

11. Para (19) of MACP Scheme contemplates merely placement on personal basis in the immediate higher grade pay / grant of financial benefits only and shall not amount to actual/functional promotion of the employees concerned. As per para (20) of the MACP Scheme, financial upgradations shall be purely personal to the employee and shall have no relevance to the seniority position. As such, there shall be no additional financial upgradation for the senior employees on the ground that the junior employees in the grade have received higher grade pay under MACP Scheme. We may usefully extract the relevant portion of Annexure-I of the Office Memorandum dated 19.05.2009, which reads as under:-

ANNEXURE-I

MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS)

    There shall be three financial upgradation s under the MACPS, counted from the direct entry grade on completion of 10, 20 and 30 years service Financial upgradation under the Scheme will be admissible whenever a person has spent 10 years continuously in the same grade-pay.
    The MACPS envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay as given in Section 1, Part-A of the first schedule of the CCS (Revised Pay) Rules, Thus, the grade pay at the time of financial upgradation under the MACPS can, in certain cases where regular promotion is not between two successive grades, be different than what is available at the time of regular promotion. ln such cases, the higher grade pay attached to the next promotion post in the hierarchy of the concerned cadre/organisation will be given only at the time of regular promotion.

17. The financial upgradation would be on non-functional basis subject to fitness, in the hierarchy of grade pay within the PB-1.Thereafter for upgradation under the MACPS the benchmark of ‘good’ would be applicable till the grade pay of Rs. 6600/- in PB-3. The benchmark will be ‘Very Good’ for financial upgradation to the grade pay of Rs. 7600 and above.

19. The MACPS contemplates merely placement on personal basis in the immediate higher Grade pay /grant of financial benefits only and shall not amount to actual functional promotion of the employees Therefore, no reservation orders/roster shall apply to the MACPS, which shall extend its benefits uniformly to all eligible SC/ST employees also. However, the rules of reservation in promotion shall be ensured at the time of regular promotion. For this reason, it shall not be mandatory to associate members of SC/ST in the Screening Committee meant to consider cases for grant of financial upgradation under the Scheme.

25. If a regular promotion has been offered but was refused by the employee before becoming entitled to a financial upgradation, no financial upgradation shall be allowed as such an employee has not been stagnated due to lack of opportunities. If, however, financial upgradation has been allowed due to stagnation and the employees subsequently refuse the promotion, it shall not be a ground to withdraw the financial upgradation. He shall, however, not be eligible to be considered for further financial upgradation till he agrees to be considered for promotion again and the second the next financial upgradation shall also be deferred to the extent of period of debarment due to the refusal.

12. Clause 28 contains illustrations as to grant of financial upgradation under MACP. The illustrations in Clause 28 of the Scheme can easily be understood by referring to the First Schedule, Part-A of Section 1 of Central Civil Services (Revised Pay) Rules, 2008 which gives a comparison of the scale of pay under the 5th Pay Commission and the 6th Pay Commission as under:-

Subject: Grant of financial upgradation under ACP/MACP Scheme and Non Functional Grade to Pharmacists.

The issue of grant of ACP/MACP to Pharmacists on acceptance of Fast Track Committee Report, the Government of India, vide Min of Fin, Deptt of Expenditure F. No. 1/1/2008-IC dated 18.11.2009 was referred to our HQrs office for clarifications on the following points.

(i) Whether the pharmacists (GP Rs2800/-) who have already been granted higher scale/GP (GP 4200/-) by virtue of ACP or otherwise prior to effective date of OM dated 18.11.2009 are again to be allowed Non Functional Upgradation (GP 4200/-) under the above provisions.

(ii) Further, doubt has been raised regarding mode of fixation of pay while on granting ACP after NFU, as in the case of Pharmacists, the scale/GP granted on account of NFU and the standard/common pay scales applicable for ACP in terms of Annexure-II are same and identical i.e. GP of Rs.4200/- in the PB-2.

In this regard a copy of CGDA No-AT/Il/2458-XXIII, dated 01/03/2018 received in this office clarifying the above points is forwarded herewith for information and necessary guidelines.

Subject: Grant of financial upgradation under ACP/ MACP Scheme and Non Functional Grade to Pharmacists.

Reference: Your office letter No Pay/Tech-I/01 (6th CPC) Pharmacist dated 12-01-2017, 20-02-2017 and 14-09-2017.

The issue of grant of ACP/MACP to Pharmacists referred to HQrs Office vide your office letter dated 12-01-2017 has been examined in consultation with other PCsDA/CSDA. As regard to the first point of doubt referred by your office, it is viewed that grant of NFU (in the grade pay of Rs 4200/-) to the pharmacists who have already been granted GP of Rs 4200/- by virtue of ACP or otherwise as on 01-
01-2006 does not appear to be in tune with or supported by the orders regulating the grant of NFU.

2. Further, regarding second doubt raised by your office it is stated that the clarification given at S] No 2 of DOPT OM No 35()34/1/97-Estt (D) (Vol-IV) dated 10-02-2000 clearly stipulates that in cases where pay scale given as selection grade/in-situ promotion is not a part of hierarchy, the pay scale granted by virtue of selection grade/in-situ promotion may be treated to have withdrawn on grant of ACP. In View of the provisions ibid it is viewed that the pay scale/ grade pay of Rs 4200/- granted by virtue of NFU in the cases of pharmacists which is not a part of hierarchy may be treated to have withdrawn on grant of ACP.

Sub: Regarding grant of MACP/ACP benefit to SAS qualified officers appointed to the post of Section Officer/Assistant Accounts Officer on the basis of CAG Circular No. 23 staff wing/2016 No. 39 staff(Ent-1) 184-2014 dated 20/06/2016

Various reference has been received from different Controllers regarding grant of benefit of ACP/MACP after passing of SAS-ll examination on the basis of CAG Circular No. 23 staff Wing/2016 No. 39 staff(Ent-1) 184-2014 dated 20/06/2016.

In this connection, attention is invited to' Para 1 and 9 of Annexure of DOP&T OM No.3534/3/2008-Estt.(D) dated 19th May 2009, which stipulates that
".....
1) There shall be three financial upgradations under the MACPS, counted from the direct entry grade on completion off 10, 20 and 30 years service respectively. Financial upgradation under this scheme will be admissible Whenever a person has spent 10 years continuously in the same grade pay.

9) Regular service for the purpose of the MACPS shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption/re-employment basis. Service rendered on adhoc/contract basis before regular appointment on pre-appointment training shall not be taken into reckoning. However, past continuous regular service in another Government Department in a post carrying same grade pay prior to regular appointment in a new Department, without a break shall also be counted towards qualifying regular service for the purpose of MACPs only( and not for the regular promotions). However, benefits under the MACPS in such cases shall be considered till the satisfactory completion of the probation period.

Further, it is also intimated that the matter was referred to DoPT, for treating AAO as fresh recruits after passing of SAS Part II Exams and it has been clarified by DOP&T that Departmental Examination is one of the fast track mode of promotion and the appointment on the base of Limited Departmental Examination cannot be treated as direct recruitment and the orders of C & AG dated 20.06.2016 is not consistent with the instructions of the Government. Further, DoPT has opined that treating AAO as a fresh recruits for the purpose of benefit of MACP will be violative of the provisions of RR.

The Modified Assured Career Progression Scheme for the Central Government civilian employees has been introduced vide Department of Personnel & Training O.M. No. 35034/3/2008-Estt.(D) dated 19th May, 2009 as amended from time to time. The extension of Modified Assured Career Progression (MACP) to the employees is subject to the conditions that:
i) The earlier ACP Scheme was also implemented / adopted by the said Autonomous / Statutory Body.

ii) The proposal to adopt MACP Scheme has been approved by the Governing Body/Board of Directors.

iii) The Administrative Ministry/Financial Adviser of the Ministry has concurred with the proposal.

iv) The financial implications of adoption of MACP Scheme has been taken into account by the Organisation / Body and the additional financial implication can be met by it within the existing Budget Grants.

As the teaching staff of KVS, including Principals had not accepted the earlier ACP Scheme introduced in the year 1999, they would not be entitled for the benefits of MACP scheme.

Note: * The above comparison clearly establishes the fact that under ACP Scheme the staff got financial up-gradation in Pay Scale Rs.5000-8000/GP 4200/- on completion of 24 years of service whereas under MACP Scheme, the staff gets GP 2800/- (replacement Grade Pay) on completion of three decades and they cannot dream of reaching GP 4200 (PB-2) under MACPS.
 
NFIR, therefore, requests the Railway Board to include the above category of staff in the reference agreed to be made to the DoP&T for seeking guidelines.

You have already clarified that erstwhile ACP Scheme was applicable upto 31.08.2008 and the promotions / upgradations granted prior to 01.01.2006 in the merged grade pay had been ignored for grant of ACP in the promotional hierarchy upto 31.08.2008 and this clarification had already been implemented in favour of supervisory cadre (Chargeman & JWM) of Ord Fys.

On the above analogy, Blue Printer & Record Supplier being a feeder grade for Tracer (upto 20.04.2006) which is a feeder grade for Draughtsman / Chargeman may be granted the 02 financial upgradations under the ACP Scheme by ignoring his movement upto Blue Printer & Record Supplier.

Further, your attention is invited to the order of CAT (Principal Bench) in OA No. 634/2013 (Smt Madhu Malti Tyagi & ors Versus Union of India & others) decided on  22.10.2013 wherein similar case had been dealt with and the relief was granted in favour of petitioners. Respondent No. 3 (General Manager, Ordnance Factory Muradnagar) had published the necessary Factory Order for pay fixation (copy enclosed) in this regard.

In such circumstances, you are requested to take necessary action so that similarly placed all the non-petitioner Record Supplier / Blue Printers may be granted 01st ACP in GP 2400/- and 02nd ACP in GP 4200/- on completion of 12 yrs & 24 yrs regular service between 01.01.2006 to 31.08.2008 & 03rd MACP in GP 4600/- on or after 01.09.2008 on completion of 30 yrs regular service.

Kindly resolve the issue without further delay.

Further to NFIR’s   letter of even number dated 05/01/2016, Federation invites attention of the Railway Board   to the DoP&T’s    O.M.   Dated   10/06/2015   wherein   clarifications   on financial   up-gradation   under ACPSIMACPS   for the category   of Pharmacist   have been conveyed.   Gists of the clarifications   are given hereunder:-

(i)          Every financial up-gradation including non-functional grades granted, have to be treated as offset against one financial up-gradation under the scheme

(ii)     The Pharmacists recruited in GP 2800/- are to be placed in GP 4200/- after completion of 2 years service. They will be eligible  for 2nd  financial  up-gradation  in GP 4600/–, on completion  of next 10 years  of service  i.e. total  12 years  of service  and further  3rd  MACP  on completion  of 22 years of continuous  service.

(iii)       The  Pharmacists   who  have  received  benefit  of  financial  up-gradation   under  ACP  Scheme  shall however  be  eligible  for  3rd   financial  up-gradation   under  MACPS  (which  came  into  effect  from 01/09/2008).   
                           .
(iv)        The  Pharmacists,   on  their  placement   from  GP  2800/-  (PB-l)   to  GP  4200/–  in  PB-2  have  been allowed  the  pay  fixation  benefit   equal  to  3%  of  existing  Basic  Pay  and  the  difference  in  GP consequent  upon such placement  which changes not only the Grade Pay but the Pay Band as well.
  1. In this connection,   Federation   cites  below  the  cases  of  the  following  Pharmacists   working  in  the Railway  Hospitals  of Northern Railway,  which are required to be reviewed  for extending benefit on the basis of above clarifications  of DoP&T.

Note:     Both  the   above   named   persons   completed   24  years  of  service  on   18/05/2000   and   18/02/2004, consequently  they were eligible  for 2nd  ACP in GP 4800/- from the respective  dates. Further on completion  of 30  years  of  service   they   are  also  eligible   for  MACP   in  GP  5400/-  w.e.f.   01109/2008  and   18/02/2010 respectively.  However,  this benefit was not granted to them. In this connection  it is to be noted that the DoP&T in its reply dated  10/06/2015  to the JCM (Staff Side), copy endorsed to the Railway Ministry, has clarified that the Pharmacists  at the time of their placement  from GP 2800/- (PB-l)  to GP 4200/- (PB-2) may be allowed pay fixation  benefit.  This  shows that the category  of Pharmacists  were granted placement  in GP 4200/-  subject to fulfillment  of 2 years service  in 4500-7000/GP  2800/-  (PB-l)  as the GP 4200/- for this category is required  to be treated  as  “placement   Grade  Pay”  in place  of GP  2800/-.  The  above  named  are therefore  eligible  for 3rd financial up-gradation  in GP 5400/- under MACPS w.e.f. 01109/2008 and 18/02/2010 respectively.

Federation   also  conveys  that  in the  above  cases  the entitled  benefit  under  ACP/MACP   Scheme  has unfortunately  not been granted  with effect from the dates they were due as explained  in the above paras. There may be similar situations in the case of Pharmacist category on Zonal Railways.

NFIR, therefore,  requests  the Railway  Board to issue clarification  instructions  to the General Managers of Zonal Railways  and Productions  Units in general and Northern Railway in particular  to review the cases and extend  benefits  under  ACP/MACP   Scheme  correctly  and also allow consequential  benefits  to the Pharmacists. Federation may be replied of-action being taken in the matter.

Three Recognised Federations in Defence have served Strike notice to go for Strike from 17.02.2014 to the Secretary, Ministry of Defence o settle some of the outstanding and long pending demands of Defence Civilian Employees.

On the basis of the Strike notice, a meeting was convened by ministry of Defence to discuss the demands under the Chairmanship of Addl. Secretary, Ministry of Defence on 06.02.2014. During the discussion some of the issues were agreed and accordingly necessary orders were issued on the settled demands.
In this particular demands i.e. granting of Rs.4600/- Grade Pay w.e.f.01.09.2008 for those Industrial Employees who have completed 30 years of regular and continuous service and got Rs.5000-8000 on or before 31.12.2005 irrespective of their grade on completing 24 years service under ACP Scheme has been agreed to consider.

Accordingly after the meeting M of D,(Civ-I) has issued necessary order vide I.D.No.11(5)/2009-D (Civ-I) Dt 06.02.2015. to grant Rs.4600/- on completion of 30 years of regular service either w.e.f 01.09.2009 or after the date of completion of 30 years through MACP-III. In this letter, M of D mentioned that the benefit of MACP-III will be granted for HS/MCM employees only whereas, there are many number of skilled employees who got Rs. 5000-8000 due to stagnation on or before 31.12.2005 and are also eligible along with HS/MCM employees since they did not get promotions in their hierarchy. This draft and final order is merely an error, that it was not viewed skilled employees are also available in the Directorates due to heavy stagnation and continue to remain in the Skilled grade for 30 years.

This error is purely due to unnoticed and not brought to the knowledge of M o D but this has created a serious anomaly and denied the benefit of granting MACP Rs.4600/- Grade Pay to skilled employees. This M of D letter was issued with the acceptance and approval of Defence Finance authorities.

When the issue was raised by the Staff side several times in the steering committees and in the main meetings of Departmental Council JCM, M of D, necessary action has been initiated by M of D to consider/include skilled category employees who got ACP-2 Rs.5000-8000 on or before 31.12.2005. Unfortunately, it seems Def (FM) refused to consider and also DOP&T has also not agreed.

In this respect, we would like to submit that this issue is very much genuine and the skilled grade employees are also equally eligible for MACP-3 for Rs.4600/- either from 01.09.2009 or on completion of 30 years along with HS/MCM. It is also pertinent to mention that grade is not the criteria for ACP/MACP, only the present Pay/Grade pay and total number of regular and continuous service is the only criteria for granting financial upgradation.

It is therefore, requested the M of D may issue suitable amendment to the M of D letter Dated 06.02.2014 to grant the financial upgradation to skilled employees to avoid an ligation on the subject.

Newspapers continuously update us with news about the recommendation of the 7th Pay Commission which holds the highest expectation levels at present. From such sources, we come to know that the recommendations of the 7th Pay Commission are going to be submitted on 31st of October and they may come to force from 1/4/2016.

Pay structure is very important and equally important is the promotion policy.

Assured Career Progression (ACP) which was introduced in the 5th Pay Commission, provided some comfort for the employees who suffered from lack of promotions for long years. Before this, promotion was just an illusion. Labour Unions and Federations of the Central government employees got these benefits for us after much struggle.

In the recommendations of the 6th Pay Commission, which came after this, ACP was changed to MACP (Modified Assured Career Progression) and it provided an opportunity for employees who were not promoted for the last ten years to enter the next Grade Pay.

In this, the benefit was very small as 1800, 1900, 2000, 2400, 2800, 4200, 4600, 4800 (excluding 2800-4200). Many issues in this method of Grade Pay still lie unresolved before the National Anomaly Committee.

Hence, lakhs of Central Government employees expect a favourable change in MACP at least through 7th Pay Commission. During his or her service period, an employee must have at least five promotions. This has been an important plea of the Central Trade Unions.

The benefit of the first MACP has to be given after 8 years of continuous service and the benefit of the successive MACP has to be given after 7,6,5 and 4 years of continuous service.

If the benefits of MACP were such, certainly all the central government employees will be highly encouraged and will work hard to make all the Central Government plans and activities a great success.

This will definitely increase the productivity of the Central Government and the associated industries. Due to this, the relationship between the government and the employees will become more harmonious and there will be a peaceful working environment.

IN PURSUANCE TO PER 6TH PAY COMMISSION RECOMMENDATION, GOVERNMENT OF INDIA HAS IMPLEMENTED MACP SCHEME W.E.F. 1/9/2008. AND, THE PREVIOUS ACP SCHEME WAS MADE AVAILABLE TO THE CENTRAL GOVERNMENT EMPLOYEES, INCLUDING THE EMPLOYEES OF KV, TILL 31/08/2008.

THUS AS PER ACP/MACP RULE AN LDC COMPLETED 12 YEARS SERVICE AS ON 31/08/2008 WOULD GET 1ST ACP WORTH RS 2400 GRADE PAY AND AN LDC COMPLETED 24 YEARS SERVICE ON THE STIPULATED DATE WILL GET RS. 4200 GRADE PAY. AND VARIOUS MINISTRIES/OFFICES OF GOVERNMENT OF INDIA HAS ALREADY IMPLEMENTED THIS ORDER TO THE EMPLOYEES SERVING THERE.

BUT IT SURPRISED TO NOTE THAT IN ORDER TO GET THE GOVERNMENT OF INDIA’S AFORESAID ORDER IMPLEMENTED IN KV, KV STAFF HAS TO KNOCK THE DOOR OF COURTS. IN THIS RESPECT, A COPY OF THE LETTER SENT TO THE COMMISSIONER, KENDRIYA VIDHYALAYA BY THE KENDRIYA VIDHYALAYA NON-TEACHING STAFF ASSOCIATION, IS PLACED BELOW.

Sir,
I have been directed to refer to the above and draw your kind attention to the following few lines in the matter of grant of IInd financial upgradation under ACPs to those who were appointed as Junior Accountants on the basis of the results of Departmental Competitive Examination conducted by the SSC during the years 1981 & 1982-

1. The candidates who had qualified the Departmental Competitive Examination for the posts of Junior Accountants conducted by the Staff Selection Commission during the year 1981 & 1982 against direct recruitment quota of different departments of Civil Accounts Organization are required to be equated with the Junior Accountants who were directly recruited through the examination conducted by the Staff Selection Commission for recruitment to the post of Junior Accountant as the standard and method of both the examinations were similar at that point of time.

2. Clarification No. 8 of the DOPT O.M. No. 35034/1/97/Estt. (D) Vol-IV dated 10th February 2000 states that, if relevant Recruitment Rules provide for filling up of vacancies by direct recruitment, induction of a person from lower grade in the next grade through Limited Departmental Competitive examination may be treated as direct recruitment for the purpose of ACPs. In such cases, service rendered in a lower pay scale shall not be counted for the purpose of benefit under ACPs. Not only this, the said order nowhere states that the benefit under ACPs shall be limited to those incumbents only where there is a change of their cadre/service.

3. The CCAs (Group – C) Recruitment Rules provides for filling up of vacancies in the grade of Accountant through direct recruitment and it fulfills the requirements stated in the clarification No. 8 of the DOPT O.M. No. 35034/1/97/Estt. (D) Vol – IV dated 10th February 2000.

4. The scheme of granting ACP was introduced in the year 1998-1999, whereas the officials who have qualified the departmental competitive examination prior to the issuance of the DOPT orders should in no way be deprived of this benefit. In fact, the clarification was specifically meant for such officials only.

5. The benefit of the scheme has already been implemented in CGA’s organizations itself. Examples are as below:-
i) CBEC: – Pr. CCA, CBEC, New Delhi vide order No. Admn.1 (17) 9/ACP Scheme/770 office order No. 164 dated 14.08.2007 granted IInd financial upgradation with effect from 01.04.2007 to Shri A.J. Kulkarni (PAO, CEX, Pune). He had qualified the departmental competitive examination conducted by the SSC in the year 1981.
ii) CBDT: – Pr. CBDT, New Delhi office order No. Admn.ii/5-23/ACP/Sr.Acctt/2005-06/486 dated 16/23.03.2007 granted IInd financial upgradation with effect from 06/08.07.2007 to Shri S.N. Kaulgud, ZAO, CBDT, Pune. He had qualified the departmental competitive examination conducted by the SSC in the year 1982. Incidentally, it may be placed for your information and record that Shri S.N. Kaulgud of PAO, CBDT (Roll No – 018 rank No.-11) was granted 2nd ACP but Shri Subhash Chander Bamrara (Roll No. 010 rank No.-6) at present working under CCA, Ministry of External Affairs, New Delhi has been deprived of the same benefit while both of them had qualified the same examination in the year 1982.
iii) Min. Home Affairs: – Though there is no specific example readily available with us, but many employees of Ministry of Home Affairs were also extended the said benefit by the then Heads of The Departments.
Decisions by all the heads of the Departments had been taken with the concurrence of the Controller General of Account. There may be many others who might have been accorded the benefit of 2nd ACP and as on record only a handful of employees have been kept out of the benefit at present.

\Therefore, on behalf of this Association, I seek your personal intervention into the matter and requests you to kindly take a favorable decision of extending the benefit to the left out and deprived section of employees as a onetime measure so that they could be able to get rid of the feelings of discrimination they have been suffering from due to non-receipt of their legitimately due benefit on par with their batch mates.

Attention is invited to Board’s letter of even number dt. 07.07.2014 (RBE No.68/2014) on the above subject whereby it was clarified that those officers who are upgraded to Grade Pay of Rs.10000/PB-4 scale on the basis of Dynamic ACP or due to non-functional in-situ upgradation shall not be eligible for grant of Transport Allowance @7000 p.m+DA thereon. On receipt of representations from IRMS Association this matter was further reviewed by the Board in the light of earlier instructions contained in Boards letter No.PC-V/2008/ACP/2, dt. 07.07.2010 and Board have decided that the IRMS Officers having Grade Pay of Rs.10000/- on promotion through DACP Scheme are toga treated at par with SAG Officers for payment of Transport Allowance @7000 p.fn plus DA thereon. However, officers of other organized services who get similar grade on non-functional upgradatlon basis shall not be eligible for the same.

2. Necessary action as per above decision may please be taken.

3. This issues with the concurrence of Finance Dte. of Railway Board.

Sub: – Clarification on reckoning of period of “Dies non” while & granting ACP / MACP to officials.

The issue of counting the period of “Dies non” for the purpose of ACP / MACP was raised in JCM (DC). The issue was examined in consultation with DoPT. The Nodal Department has clarified the issue vide DOFF ID NO. 78961/13/CR dated 14.11.13 as below:-

“Regular service for the purpose of grant of financial upgradations under MACPS includes all period spent, on deputation/foreign service, study leave and all other kind of leave, duly sanctioned by the competent authority. In terms of Government of India decisions relating to ” Treatment of willful absence from duty given under Rule 25 (leave) of CCS (Leave) Wes, 1973, the period of absence not covered by grant of leave shall have to be treated as “dies non” for all purpose, viz increment, leave and pension. Though the.period of dies non does not constitute break in service, but only the day (s) treated as dies non are not counted as duty for any purpose. Dies non is only a concession for permitting the beneficiary thereof to have subsequent service in continuation of the period of service before the beneficiary proceeded on unauthorized. absence.

“Accordingly, it is clarified that dies non period will not be counted as regular service for the purpose of grant of financial upgradation under ACP/MACP Schemes”.

Maximum age limit for recruitment of Ex-servicemen in the Public Sector Banks/Financial Institutions
Guidelines on reemployment of Ex-servicemen in Public Sector Banks/Financial services have been issued vide the Ministry of Finance, Department of Economic Affairs (Banking Division) (Now Department of Financial Services) OM No.261/16/89-SCT(B) dated the 30th May, 1990.

The OM prescribes the following maximum age limit for recruitment of Ex-servicemen in the Public Sector Banks/Financial Institutions:

1.Security Guard/Armed Guard45 Years
2.Clerical cadre50 Years
3.Sub-staff cadre other than Security Guard/Armed Guard50 Years
4.Chief Security Officer55 Years
5.Security Officers40 Years

The Public Sector Banks do not have any Assured Career Progression Scheme (ACP) similar to Government.

MACP-An Unsettled Issue Of (6CPC) Sixth Pay Commission Recommendation

MACP is said to be the abbreviation of Modified Assured Career Progression Scheme, but many central government employees feel that it is Meaningless Assured Career Progression Scheme. The main objective of introducing ACP scheme was to grant financial benefits for the govt servants, those who are not getting promotions due to lack of promotional avenues. Before the introduction of ACP scheme in 1999, many central government employees retired from service without getting even single promotion in some departments. The worst part of this story is, apart from not getting promotion, they were not even been granted annual increment for many years until their retirement, as they reached the maximum of their Pay Scale. Working without any promotion and increment until the retirement is pathetic. It was the prevailing situation till the date of introducing ACP scheme.

Financial up gradation under ACP Scheme

Upon introduction of ACP scheme, central government employees were granted two financial up gradation on the completion of 12 years and 24 years of regular service respectively in the same post. According to the ACP Scheme, the central government employees were to be granted next higher pay scale of their Promotional Hierarchy as financial up gradation under ACP Scheme. So the pay equalant to the promotional post had been ensured under ACP scheme for the government servants after completion of 12 and 24 years of regular service if they were not granted regular promotion. Many central government employees were benefited by this scheme where there were no promotional avenues available for them.


Modified Assured Career Progression Scheme (MACPS)

The Sixth CPC recommendation on ACP scheme and government’s decision gave all the central government employees surprise and shock both. The Sixth Central Pay Commission in Para 6.1.15of its report, has recommended Modified Assured Career Progression Scheme (MACPS). As per the recommendations, financial up gradation would be available in the next higher grade pay whenever an employee has completed 12 years continuous service in the same grade. However, not more than two financial upgradations shall be given in the entire career, as was provided in the previous ACP Scheme. The Scheme will also be available to all posts belonging to Group “A” whether isolated or not. However, organised Group “A” services will not be covered under the Scheme

The Government has considered the recommendations of the Sixth Central Pay Commission for introduction of a MACPS and has accepted the same with further modification to grant three financial upgradations under the MACPS at intervals of 10, 20 and 30 years of continuous regular service. The surprise was that, government’s consideration for modifying the ACP scheme to grant three financial up gradation for central government employees on completion of 10,20 and 30 years of regular service. But its decision to grant immediate next higher Grade Pay in the hierarchy of Grade Pay instead of Promotional Hierarchy is the shock for everyone.

The MACP Scheme envisages merely placement in the immediate next higher Grade Pay in the hierarchy of the recommended revised Pay Bands and Grade Pay. For example, if a govt servant appointed as LDC in the grade pay of Rs.1900/-, he will be granted Rs.2000/- Grade Pay as first MACP after completing 10 years of regular service though this Grade Pay is not in the promotional hierarchy of the individual concerned. Whereas the first financial up gradation to be granted under ACP Scheme will be Rs. 2400/- Grade Pay on completion of 12 years of regular service as ACP was granted on the basis of promotional hierarchy. As a result of this the Modified ACP Scheme has not served the purpose that it was supposed to. So the Modified Assured Career progression Scheme needs to be modified again. The financial up gradation has to be granted on the basis of Promotional Hierarchy of posts instead of hierarchy of Grade Pay.

The decision of Joint Committee of MACP Scheme

The Staff Side of National Anomaly committee also reiterated their demand in the last meeting of the Joint Committee of MACP Scheme held on 15.03.2011 under the Chairpersonship of the Joint Secretary (Estt), DOPT that the financial up-gradations under the MACP Scheme should be granted in the promotional hierarchy of posts instead of the Grade Pay hierarchy. The Staff Side stated that the erstwhile ACP Scheme was implemented on the recommendations of the 5th CPC and, as such, has become a part of the service conditions of the employees. The Staff Side, therefore, contended that the Government cannot impose the MACP Scheme thereby altering the service conditions to the detriment of the employees.

In this regard the Judgment of Hon’ble Central Administrative Tribunal, Chandigarh has been upheld by the Honble High Court of Punjab and Haryana at Chandigarh. In a separate case filed in CAT, Principle Bench, New Delhi, to grant next promotional Grade Pay under MACP Scheme, the Honble CAT gave its Judgment in favour of applicants based on the judgments of above cases. The appeal against the judgment of Honble High Court of Punjab and Haryana has been dismissed by the Hon’ble Supreme Court.

Almost all the Federations have demanded the Central Government to issue necessary instructions for granting financial up gradation under MACP scheme on Promotional hierarchy as per the Court Order. So it is high time for the government to come forward to issue the necessary order to grant financial up gradation under MACP scheme in Promotional hierarchy to make this scheme serve its purpose and avoid confusion.

38 POINT CHARTER OF DEMANDS FOR STRIKE BALLOT
The 88th Annual Conference of the All India Railwaymen’s Federation, held at Visakhapatnam on 18-20 December, 2012, decided that, if the following burning grievances of the Railwaymen are not resolved in a time-bound programme, AIRF would be compelled to conduct strike ballot as a first step for a decisive struggle:-

1. Filling-up all vacant posts.
2. Sanction additional posts in commensurate with increase in the number of trains and workload.
3. Stop outsourcing of perennial nature jobs, violating the provision of Contract Labour (Regulation & Abolition) Act, 1970.
4. Scrap New Pension Scheme and cover all the staff with pension and family pension scheme as available to staff appointed prior to 01.01.2004.
5. Implement recommendations of Cade Restructuring Committee.
6. Remove all the anomalies of the 6th CPC as agreed upon in the meeting of Departmental Anomaly Committee and resolve all the anomalies pending before National Anomaly Committee.
7. Recommendations of the Joint Committee constituted to study the Career Progression and Package for Trackmen has been diluted arbitrarily. The recommendation should be implemented in to to.
8. Merger of grades of Technician Gr. II and Gr. I duly grant GP of Rs.2800.
9. Provision of GP of Rs.4800 in place of Rs.4600 to all Senior Supervisors.
10. Upgradation of 15% apex level Group `C’ posts to Group `B’.
11. Grievances of the Running Staff, such as granting of Running Allowance w.e.f. 01.01.2006 duly improving ALK, reduction in Duty Hours, Provision of Additional Allowance to Running Staff working in Goods Trains and also to Traffic Running Staff working as Goods Guards and Passenger Guards, improvements in the condition of Running Rooms etc.
12. Upgrade all categories of staff in Grade Pay of Rs.2400 to Rs.2800.13. Parity of grade pay to Stenographers between the field staff and the staff working in Secretariat.
14. Reckoning of 100% Casual Labour Service rendered as Qualifying Service for seniority and pensionary benefits is still pending in spite of Hon’ble Supreme Court judgment.
15. Stepping up of pay of seniors who are drawing less pay than the juniors consequent on fixation of pay due to implementation of VI CPC recommendations between the direct recruits and promotees.
16. Stepping up of pay of senior employee on par with junior employee consequent on modification of ACP Scheme as MACP is pending with the Railway Board.
17. Safety Related Voluntary Retirement Scheme has been modified as LARSGESS permitting the Railway employees in Safety Categories to give Voluntary Retirement so as to enable their wards getting appointed. Lot of conditions were imposed diluting the intention of this scheme by introducing Written Examination.
Large number of wards of the employees who have applied for appointment under LARSGESS in 2010 cycle have failed in the PET. Later, PET was abolished for the wards appearing under LARSGESS 2012.
AIRF has demanded waival of PET for failed candidates of LARSGESS 2010 and requested the Board to issue necessary orders to Zonal Railways for absorbing them in the Railways. The matter is yet to be resolved at Board’s level.
18. Granting of one increment for the employees in the categories like MCMs, Loco Running Staff, SMs, P. Way Supervisors etc. when they get horizontal promotions without reckoning the same as “Promotion” for the purpose of granting financial upgradation under MACP.
19. The demand of recruitment of wards of Railwaymen as Substitutes has not been implemented by the GMs of the Zonal Railways due to several restrictions imposed in the orders of the Railway oard.
20. Welfare Schemes announced in the Railway Budget, such as opening of Nursing Colleges, Medical and Engineering Colleges, Polytechnics, Kendriya Vidyalas for the children of the Railwaymen, extension of medical facilities and pass to both dependant father and mother of Railway employees etc. are yet to be implemented by the Board. The announcement of the scheme – “House to All” has also not seen the light of the day.
21. Entitlement of Privilege Passes to travel by “Duronto Express” trains is yet to be finalized.
22. As per decision taken in the DC/JCM Meeting, 5% of the sanctioned strength of the Section Officers in the pre-revised scale of Rs.6500-10500 was earmarked to non-qualifying Appendix III Accounts Assistants. Consequent upon implementation of VI CPC recommendations, the same was revised to 1% of the combined strength of SOs & SO(A)s , reducing the percentage. The demand of increasing the same to 5% on the combined strength of SOs and SSO(A)s is still pending with the Railway Board.
23. Grievances of AC Mechanics and AC Attendants deputed to work on trains is yet to be resolved by the Board.
24. Running Allowance should be paid to medically de-categorized Running Staff kept on supernumerary posts.
25. Even though technical categories working in Electrical, Mechanical, Civil Engineering(Works), erstwhile Mistries and supervisors have been merged in the cadre of JE, in the Civil Engineering the Senior P. Way Supervisors are rotting in their category without merger with JE category. This issue is pending with the Railway Board.
26. Even though several times the issue of absorption of quasi-administrative offices staff was discussed, no orders have been issued so far for the absorption of quasi-administrative offices staff in the Railways.
27. Improvement in the conditions of Railway Hospitals and filling up of all the vacancies of Doctors, Nurses and Paramedical Staff. Provide medical facilities to the staff posted at roadside stations and ganghuts.
28. Increase the amount of Fixed Medical Allowance and issue Smart Card to all RELHS beneficiaries.
29. Grant parity in pension and family pension to the staff/family retired prior to 01.01.2006.
30. Revise the rates of Patient Care Allowance and Risk Allowance and grant Patient Care Allowance to the staff of Medical Department working in Kitchen, Store, Watching duties etc.
31. Exempt Transport Allowance and Special Duty Allowance for the purview of Income Tax deduction.32. Raise the ceiling limit of Rs.3500 for the purpose of payment of PLB.
33. Raise the ceiling of Income Tax deduction from Rs.2.00 lakh to Rs.3.00 lakh, as recommended by the Standing Committee on Finance.
34. Repair quarters, roads, drains and do not compel staff to stay in inhabitable quarters and pay House Rent Allowance to such staff.
35. Limit duty hours of the staff to a maximum of 7 hours a day.
36. Scrap classification of duty hours as “Essential Intermittent” and “Excluded”.
37. Pay T.A., O.T., N.D.A., National Holiday Pay etc. regularly.
38. Increase the rate of Special Duty Allowance by 25% with retrospective effect from 01.01.2011.
