ADVERTISEMENT

a. Army officer's who were in receipt of Rank Pay in 01/01/1986 are entitled for arrears of Pay as per Hon'ble Supreme Court Judgement.

b. PCDA(O) Pune has not yet received bank details from some of the officer's. In some cases officer's promotion details are not available with PCDA(O).

c. Officer's can download from website the formats on which bank details have to be forwarded to Pay Revision Cell, O/o Pr. CDA(O), Golibar Maidan, Pune —411001.

Controller General of Accounts (CGA) has instructed vide his No. 1(7)(2)/2000/TA/Pt.file/325 dated 12.06.2013 to all the Central Government Offices that they should continue to remit funds to the designated NPS Trust accounts being maintained with the current trustee bank i.e. Bank of India till 30th June, 2013.  Axis Bank as a new Trustee Bank in place of Bankd of India for National Pension System with effect from 1st July, 2013.  Text of CGA's letter is reproduced below:-

Sub: Appointment of new TB (Trustee Bank) under NPS (National Pension System)

Reference is invited to Pension Fund Regulatory and Development Authority Circulars issued under Letter Nos. PFRDA/2013/10/CRTB /1 dt. 30.04.2013 86 31.05.2013 (copies enclosed) regarding appointment of Axis Bank as a new Trustee Bank in place of Bank of India (the current Trustee Bank) for National Pension System (NPS) with effect from 1st July 2013.

2. All the Offices shall continue to remit funds to the designated NPS Trust accounts being maintained with the Current Trustee Bank i.e. Bank of India till 30th June 2013.

3. Pr.CCAs/CCAs/CAs are requested to circulate the contents of the Circulars to the offices under their control immediately so that funds could be remitted to the Trustee Bank in time.

4. 1.his issues with the approval of the competent authority.

Rank Pay Matter: Antony expect Attorney General’s opinion on issue of rank pay fixation

Faced with differing interpretations of a Supreme Court order on correct fixation of “rank pay” of armed forces officers, Defence Minister AK Antony today decided to seek opinion of the Attorney General (AG).

The “rank pay” issue is popularly known as the Major AK Dhanapalan case. The Supreme Court, in a verdict last September, ordered fixation of “rank pay” since January 1, 1986, for the Fourth Pay Commission.

Antony, at a high-level meeting today, made it clear that the apex court verdict had to be implemented. The forces and the MoD are in disagreement over interpretation of the SC order. The MoD interpretation is that the order may be implemented for personnel impacted by the Fourth Pay Commission “as on January 1, 1986”. The interpretation of the forces is that it means “with effect from January 1, 1986”.

This would mean that the anomaly in the subsequent pay commissions (the fifth and the sixth) should also be corrected. Rank pay, when calculated with the basic, will enhance pension of thousands of retired officers.

Going by the MoD interpretation, officers affected by the Fourth Pay Commission would benefit, while there would be no hike for those covered under the later pay commissions.

Antony said the Services would give their interpretation and submit to the Attorney General directly while the MoD would take up the matter with the Ministry of Finance that fixed the pays and salaries of all government employees.

According to official sources, Antony wants the matter to be sorted out soon. The MoD will also give its interpretation to the AG.

The Supreme Court had directed the government to re-fix the pay scale of Army officers affected by the Fourth Pay Commission and this would entail an additional burden of Rs 1,600 crore on the exchequer.

The orders benefited officers in the rank of Captain to Brigadier in the Army and equivalent ranks in the Air Force and the Navy, between January 1, 1986, and January 1, 2006.

The apex court also directed the Centre to pay 6 per cent interest from January 1, 2006, to all officers, whether or not they have filed any petition before any of the high courts or the Benches of Armed Forces Tribunal, within 12 weeks from today.

Major AK Dhanapalan was the first officer to challenge the fixation before the Kerala High Court which, in October 1998, directed the government to re-fix the pay without deducting the rank pay.

OFFICE MEMORANDUM

Subject: Amendment in the policy relating to reversion of officers belonging to All India Service as well as Central Services on pre-mature cessation of their tenure as Private Secretary/Officer-on-Special Duty to Ministers.

A review of the policy on the above subject has been under consideration of the Government for some time. The Appointments Committee of the Cabinet (ACC) has now approved certain amendments to the existing policy as mentioned below:-

(i) Officers of all the three All India Services (including IPS) as well as Central Services who are appointed as PS/OSD without completing their "cooling off" should be reverted to their cadre once their term as PS/OSD ends for whatever reason. While appointing such officers as PS/OSD an informed consent should be obtained from them that they are willing to be appointed as PS/OSD in waiver of the "cooling off" requirement, fully aware of the condition that they would be reverted back to their cadre once their term as PS/OSD ends for whatever reason and that they would be further required to complete the "cooling off" afresh;

(ii) Officers of all the three All India Services as well as Central Services who are appointed as PS/OSD from the "Offer List" may be allowed to complete their normal period of central deputation if their term, as PS/OSD ends for whatever reason before the completion of such term.

(iii) Officers of all the three All India Services as well as Central Serviced who are not on the Offer List but are appointed as PS/OSD after completing their "cooling off requirement" should also normally be allowed to complete their full term of Central deputation, subject to their willingness and suitability, in case their term as PS/OSD ends for whatever reason before the completion of such term.

(iv) The revised policy would have a prospective effect and cover all those who:, are appointed as PS/OSD after the date of revision of the policy. Those who are already working as PS/OSD in the Central Government at present as well as those who have already been appointed to posts under the CSS and non-CSS following cessation of their appointment as PS/OSD shall continue to be governed by the pre-revised policy till the completion of their present tenure.

2. All the Ministries/Departments of Government of India, Cadre Controlling Authorities of all participating units under the Central Staffing Scheme and the State Governments are requested to take note of the above revised instructions for information and compliance.
