Subject: Holidays to be observed in BSNL Offices during the year 2021- reg.

In accordance with Ministry of Personnel, Public Grievances & Pensions (Deptt. of Personnel & Training O.M. No. 12/9/2020-JCA-2 dated 10th June 2020, it has been decided by the Competent Authority that the holidays as specified in the Annexure I to this O.M. will be observed in all the BSNL Offices located at Delhi / New Delhi during the year 2021. In addition, each employee will also be allowed to avail himself/ herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure II.

BSNL Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3.1 below:

3.1 In addition to the above 14 Comnpulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Circle Heads of Territorial Circles in consultation with the Circle Staff Welfare Board and the representative Union and keeping in view the recommendation of the Central Government Employees Coordination Committee in the State Capitals. The final list applicable uniformly to all BSNL offices within the territorial jurisdiction of the concerned State shall be notified accordingly and a copy endorsed to the Corporate Office within a period of 4 weeks of issue of this letter and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicated.

3.2 No substitute holiday should be allowed if any of the festival holidays, initially declared, subsequently happens to fall on a weekly off or any other non-working day or in the event of more than one festival falling on the same day.

4. The list of Restricted Holidays appended to this O.M. is meant for BSNL Offices located in Delhi/ New Delhi. The Heads of Territorial Circle in consultation with the Circle Staff Welfare Board and the representative Union and keeping in view the recommendations of the Central Government Employees Co-ordination Committee in the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.

 

5.1 For offices in Delhi New Delhi, any change in the date of holidays in respect of Idu’l Fitr, Idu’l Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after aScertaining the position trom the Govt. of NCT of Delhi (DCP, Special Branch, Delhi Police).

5.2 For offices outside Delhi / New Delhi, the Heads of Territorial Circles are authorized to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in Muharram respect of ldu’l Fitr, Idu’l Zuha, and Id-e-Milad.

5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through P.I.B/ T.V. /A.l.R. / Newspapers and the Heads of Territorial Circles may take action according to such an announcement without waiting for a formal order, about the change of date.

6. During 2021, Diwali (Deepavali) falls on Thursday, November 4, 2021 (kartika 13). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on “Naraka Chaturdasi Day”. In view of this, there is no objection if holiday on account of Deepavali is observed on- “Naraka Chaturdasi Day (in place of Deepavali Day) compulsory for the holiday BSNL Offices for Diwali in a State if in that State that day alone is declared as a for the offices of the State Government.

7. BSNL Offices which include industrial, commercial and would observe upto 16 trading establishments holidays in a Republic Day, year including three national holidays viz. Independence Day and Mahatma Gandhi’s birthday, as holidays. The compulsory of Circle remaining holidays / occasions may be determined by respective Heads themselves for the year 2021, subject to para 3.2 above.

Sub: Instructions regarding Payment of VRS dues - Validation & Compliance

In continuation of even numbered letters issued on the cited subject, following instructions are issued for strict compliance:
  • Notwithstanding the position that the amount of ex-gratia and leave encashment payable to the retirees of BSNL VRS - 2019 scheme, has been verified by the circles, it is requested to do the checking of the master data of the employees towards eligible service, eligible number of leaves, their vigilance clearance status etc once again duly keeping in view the PPOs issued by CCA and underlying information thereto.
  • It is required to prepare (and keep in records) a proper statement of the amount recoverable, and recovery made on account of dues (towards Loans, advances, Pay and allowances recoveries, other recoveries etc) from the BSNL VRS-2019 retirees against the Ex-gratia, and Leave Encashment payout. The amount recoverable and recovered should be duly validated for any errors and omissions.
  • Establishment section has already communicated the SOP for BSNL VRS 2019, with the format of report to be submitted to DoT on Ex-Gratia. Kindly ensure that the reports / compliances in the Format given in Annexure A, B & C of the DOT letter No. 1/VRS/BSNL/2019/Accounts/TA-I/170-198, dated 16.01.2020 are duly submitted to the respective CCA.
  • The second / subsequent instalment of the Ex-Gratia shall be paid as and when further funds and instructions are received from DoT. Therefore, you may please do the necessary preparations, well in advance so that the payout can happen without delay, as and when the funds are received in this regard.
  • May kindly note that the activity needs to be completed by 14.04.2020.

1. The Department of Telecommunications (DOT), Government of India, (Petitioner No.1), the Bharat Sanchar Nigam Limited (BSNL) through its Chairman-cum-Managing Director (Petitioner No.2) and the Department of Pension & Pensioners Welfare ("DPPW"), Ministry of Personnel Public Grievances & Pensions (Petitioner No.3) have jointly filed this petition challenging an order dated 16th December, 2016 of the Central Administrative Tribunal, Principal Bench, New Delhi ("CAT") disposing of OA No. 2173/2014 filed by the Respondent No.1 and Respondents No. 4 to 14 thereby quashing an order dated 15th January, 2003 issued by the DOT in regard to payment of pension to employees who retired from the DOT between 1st October, 2000 and 31st July, 2001 and were subsequently absorbed in the BSNL. OA No. 2173/2014 was filed before the CAT by the All India BSNL Pensioners Welfare Association (hereafter Association) (Respondent No.1 herein) on behalf of 4230 affected pensioners in a representative capacity.

2. By the impugned order, the CAT has held that there was no justification for the DOT to deny the benefit to the Respondents 2 to 14 the benefit of formula adopted in Office Memorandum (OM) dated 18th October, 1999. The CAT has issued a direction to the Petitioners to re-fix the pension of the said Respondents; give them notional benefit of the IDA pay scale and thereafter grant all consequential benefits from the date of their respective dates of retirement in accordance with law.

3. It must be noted at the outset that on 23rd January, 2018 an interim order was passed that no coercive steps will be taken against the Petitioners for implementing the impugned order of the CAT.

4. The facts in brief are that on creation of the BSNL with effect from 1st October, 2000 all serving Group "A" officers were transferred to it on deputation basis. An OM dated 27th October, 1997 was issued by the DPPW on the issue of implementation of the recommendations of the 5th Central Pay Commission ("CPC") regarding revision of the provisions regulating pension/commutation of pension. This provided that pension shall continue to be calculated at 50% of average emoluments in all cases subject to a minimum of Rs.1275/- and maximum upto 50% of the highest pay in the Government.

5. The OM dated 27th October, 1997 further provided that those Government servants who opted for revised scales of pay and retired within ten months from coming into force of the revised scales of pay, basic pay for ten months preceding retirement shall be calculated as under:
  • For the period during which pay is drawn in the pre-revised scale
    Basic pay plus DA and Interim Relief I and II appropriate to the basic pay at the rates in force on 01.01.1996 drawn during the relevant period and
  • For the period during which pay is drawn in revised scale-Basic pay in the revised scale.
6. The above OM was further revised by an OM dated 17th December, 1998 specifying that pension shall not be less than 50% of the minimum pay in the revised pay scale.

7. Another OM dated 18th October, 1999 was issued by the DPPW modifying the earlier OM dated 27th October, 1997. This stated that the average emoluments for those retiring within ten months of coming over to the revised pay scales would be calculated thus:
“The average emoluments based on the basic pay of the preceding ten months of those Government Servants who had opted to come over to the revised scales of pay and had retired within a period of 10 months reckoned from January 1, 1996 shall be calculated as follows for the purpose of determining their pension entitlement.
(A) For the period during which pay was drawn in the pre- revised pay scales.

The total emoluments for the number of months for which pay was drawn in the pre-revised pay scales shall be calculated after taking into account the following:

i. Basic Pay (including increments if any drawn during the intervening period).
ii. Dearness allowance upto CPI 1510 i.e. @ 148%, III% and 96% of the basic pay as the case may be.
iii. The first and second installments of Interim Relief appropriate to the Basic pay drawn during the relevant period.
iv. Notional increase of the Basic Pay by applying the Fitment Benefit of 40 percent on the Basic pay in the pre-revised pay scale.

(B) For the period during which pay was drawn in the revised pay scales :
The aggregate of the Basic pay for the number of months for which pay was drawn in the revised pay scales.

The average emoluments of the preceding ten months will thereafter be calculated by adding (A) and (B) and dividing the result by 10. Pension admissible will consequently be 50% of the average emoluments so calculated.”

8. According to the Petitioners, the object behind this modification was to eliminate the anomaly in pension drawn by those retiring within ten months of coming over to the revised pay scale during the period from 1st January to 31st October, 1996 and those who retired after completion of ten months period with effect from 1st January,1996.

9. Prior to en masse transfer of DOT employees to the BSNL on deemed deputation basis with effect from 1st October 2000, several rounds of discussions were held with the unions. It was agreed to extend the retirement benefits in the BSNL in accordance with the CCS (Pension) Rules, 1972. This led to insertion of Rule 37A in the CCS (Pension) Rules which came to be published on 30th September, 2000. It provided for the conditions for payment of pension and absorption upon conversion of a Government Department into a Central Autonomous Body („CAB‟) or a Public Sector Undertaking (PSU).

10. The relevant portion of the newly inserted Rule 37A of the CCS (Pension) Rules read as under:
“(4) The permanent absorption of the Government servants as employees of the Public Sector Undertaking or Autonomous Body shall take effect from the date on which their options are accepted by the Government and on and from the date of such acceptance, such employees shall cease to be Government servants and they shall be deemed to have retired from Government service.
(7) The employees including quasi-permanent and temporary employees but excluding causal labourers, who opt for permanent absorption in the Public Sector Undertaking or Autonomous Body, shall on and from date of Absorption, be governed by the rules and regulations or bye-laws of the Public Sector Undertaking or Autonomous Body, as the case may be.
(8) A permanent Government servant who has been absorbed as an employee of a Public Sector Undertaking or Autonomous Body shall be eligible for pensionary benefits on the basis of combined service rendered by him in the Government and in the Public Sector Undertaking or Autonomous Body in accordance with the formula for calculation of pension/family pension under these rules as may be in force at the time of his retirement from the Public Sector Undertaking or Autonomous Body, as the case may be.
(9) The pension of an employee under sub-rule (8) shall be calculated on the basis of his last ten months average pay.
(10) In addition to pension or family pension, as the case may be the employees shall also be eligible to Dearness relief as per Industrial Dearness Allowance pattern.
(21) Nothing contained in sub-rule (12) to (20) shall apply in the case of conversion of the Departments of Telecom Services and Telecom Operations into Bharat Sanchar Nigam Limited in which case the pensioner benefits including family pension shall be paid by the government.
(22) For the purpose of payment of pensionary benefits including family pension referred to in sub-rule (21), the Government shall specify the arrangements and manner including the rate of pensionary contributions to be made by Bharat Sanchar Nigam Limited to the government and the manner in which financial liabilities on this account shall be met.”
11. In other words, Rule 37A provided that those Government servants permanently absorbed in PSU or the CAB would be entitled to pension in the same manner as Central Government employees.

12. A further round of discussions was held with the unions by the management of BSNL on 2ndJanuary, 2001. It was agreed that options for absorption in the BSNL would be called in January, 2001. It was further mutually agreed that pending fitment in the IDA pay scales Group (C) & (D) optees will continue in the Central Government (CDA) pay scales. They were also to be paid an adhoc amount of Rs. 1,000/- per month with effect from1st October, 2000 which was to be adjusted from IDA emoluments, perks and benefits upon fitment in the IDA scale.

Sub: Implementation of BSNL Voluntary Retirement Scheme, 2019 - Augmentation of staff strength in Pension Cells in Circles and other administrative units for smooth and timely settlement of pension cases.

Sir,
I am directed to invite your kind attention to this office letter no. 1-15/2009-PAT (BSNL) dated 04.11.2019 regarding introduction and implementation of BSNL Voluntary Retirement Scheme, 2019.

As per the said scheme, employees aged 50 years or above are eligible to opt for voluntary retirement w.e.f. 31.01.2020 and it is expected that a sizable number of eligible employees would be opting for voluntary retirement under the scheme. Consequently, the workload of the pension settlement units in circles and other administrative units are expected to increase manifold. Moreover, some of the eligible employees who are presently posted in pension settlement units may also opt for voluntary retirement under the scheme. It would, therefore, be necessary to arrange for suitable substitutes for such employees for maintaining continuity

In view of above, you are requested to ensure posting of suitable and sufficient number of Executives/ Non-Executives in sections handling pension settlement in Circle/ SSA at the earliest, so that the newly posted employees could be accustomed with the nature of work and pension cases can be processed and settled in timely manner.

1. Eligibility Criteria :-
All regular employees, both absorbed and directly recruited, of BSNL who attains 50 years or above as on effective date of VRS, ie 31/01/2020, are eligible.

2. Important Dates :-
  • Start of option : 04/11/2019
  • Closing of option : 03/12/2019 up to 1730 hrs.
3. Benefits :-
  • Ex-gratia- 35 days salary for each completed year of service+25 days salary for each year of service left, until superannuation, provided further ex-gratia shall not exceed the salary he/she would have drawn at the existing level for the service period left.
  • For employees absorbed in BSNL under Rule 37A, ex-gratia shall be restricted to the amount which taken together with the pension that the employee would be drawing for the balance period left till superannuation. Provided further that the ex-gratia shall not exceed 125% of the salary of the employee would have drawn at the existing level for service period left.
4. Employees opting VRS are entitled for the terminal & other benefits under existing rules as below:-

i. For Absorbed employees :-
» Pension /Family Pension from the next day of effective date of VRS
» Retirement Gratuity :-
  • For employees above 59 years- within one month from the date of attaining 60 years
  • For employees 55 and below - in February 2025.
» Incase of death of the retired employee before due date of payment of gratuity , the amount shall be released immediately to family along with interest.
» Simple interest @GPF rates (currently 7.9%) will be paid till the date of release of gratuity

ii. For BSNL Recruited employees and those appointed under Rule 37, gratuity shall be paid without deferment.

iii. Commutation of Pension :-
Full pension will be paid till the employee opt for commutation as below:-
» For employees above 50 years- on attaining 60 years
» For employees 59 and below- on 01/02/2025.

iv. Encashment of EL /HPL, TA/DA to place of settlement after VRS, Retention of staff quarters, RTC, Post-retirement medical facilities allowed as per existing rules and procedures, amended from time to time.

5. The eligible employees are required to login to the ERP / ESS portal for exercising his option for seeking voluntary retirement under the BSNL Voluntary Retirement Scheme -2019. Physical copies in triplicate signed in blue ink by the employee concerned shall be submitted to the administrative office concerned, within three days of giving option in ESS.

The option once exercised under this Scheme shall be final and decision of the competent authority shall be binding on the employee(s). Provided that the employee(s) will be allowed to withdraw the option only once at any time till the closing time and date of option.

The Union Cabinet today approved the proposal for revival of BSNL and MTNL by administrative allotment of spectrum for 4G services, debt restructuring by raising of bonds with sovereign guarantee, reducing employee costs, monetisation of assets and in-principle approval of merger of BSNL & MTNL.

The following was approved by the cabinet:-
  1. Administrative allotment of spectrum for 4G services to BSNL and MTNL so as to enable these PSUs to provide broadband and other data services. The said Spectrum will be funded by the Government of India by capital infusion in these PSUs at a value of Rs 20,140 Cr in addition; the GST amount of Rs 3,674 Cr to this spectrum value will also be borne by the Government of India through Budgetary resources. By using this spectrum allotment, BSNL and MTNL will be able to deliver 4G services, compete in the market and provide high speed data using their vast network including in rural areas.
  2. BSNL and MTNL will also raise long-term bonds of Rs 15,000 Cr for which sovereign guarantee will be provided by the Government of India (GoI). With the said resources, BSNL and MTNL will restructure their existing debt and also partly meet CAPEX, OPEX and other requirements.
  3. BSNL and MTNL will also offer Voluntary Retirement to their employees, aged 50 years and above through attractive Voluntary Retirement Scheme (VRS), the cost of which will be borne by the Government of India through budgetary support. The ex-gratia component of VRS will require Rs. 17,169 Cr in addition, GoI will be meeting the cost towards Pension, Gratuity and Commutation. Details of the scheme will be finalised by BSNL/MTNL.
  4. BSNL and MTNL will monetise their assets so as to raise resources for retiring debt, servicing of bonds, network upgradation, expansion and meeting the operational fund requirements.
  5. In-principle merger of BSNL and MTNL
It is expected that with the implementation of said revival plan, BSNL and MTNL will be able to provide reliable and quality services through its robust telecommunication network throughout the country including rural and remote areas.

OFFICE MEMORANDUM

Subject: CGHS facilities to the retired BSNL / MTNL employees who are in receipt of pension from Central Civil Estimates – Revised mapping for determining CGHS subscription and Ward entitlement.

The undersigned is directed to refer to this Office Memorandum No. 4-12(11)/2012- PAT(Part) dated 31.08.2016 vide which CGHS facilities were extended to retired BSNL / MTNL employees who receive pension from Central Civil Estimates.

The rates of monthly CGHS subscription and entitlement of Wards in Private hospitals empanelled under CGHS have been revised with effect from 01-01-2017 by Ministry of Health and Family Welfare vide OM No. S.11011/11/2016-CGHS(P)/EHS dated 09.01.2017. This has necessitated corresponding revision in mapping of Pay & scales from IDA to CDA as circulated vide O.M. dated 31.08.2016.

At the outset, BSNLEU, the main recognised representative union In BSNL, heartily welcomes you, on your assuming change as the Hon'ble Minister of Telecommunications and IT. On this occasion, BSNLEU welcomes and also highly appreciates your statement that, BSNL and MTNL should remain healthy in the nation's interest. BSNLEU also approves your view that BSNL and MTNL need to become professional and adopt the competitive, attitude. In this connection, we also recollect the statement made by you, in your earlier tenure as the Honb'le Minister of Communications and IT, that BSNL was not allowed to grow for 10 years from 2004. BSNLEU assures to strengthen your hands, in all your endeavours to strengthen BSNL.

It is not out of context to point out here that, the entire telecom sector is stressed due to the predatory pricing being adopted by Reliance Jio. Due to this, all the telecom service providers. including Airtel and Vodafone Idea, have gone into loss. However, even under such a stressed situation, it is only BSNL, apart from Reliance Jio, which is consistently expanding its Mobile Customer bass every month. Under these circumstances, we wish to reiterate that, an early allotment of 4G spectrum to BSNL, by the government, will go a long way In speedily restoring the financial health of BSNL.
At this juncture, it is our duty to bring to your kind notice that, two Important decisions of the Union cabinet, taken in September, 2000, i.e. on the eve of the formation of BSNL, are yet to be implemented. Both these decisions are very crucial for the financial revival of BSNL The first decision is that, the government would do everything possible to keep BSNL financially viable. It is needless to state that this decision needs to be implemented in letter and spirit. The second decision is that. alt the asset and liabilities of the department would be transferred to BSNL While the liabilities stand transferred to BSNL, the assets are not transferred to BSNL. We request you to kindly look into these and to do the needful.

At this juncture, we also like to draw your kind attention to the moves presently being, made by the DoT and BSNL Management, to implement VRS, is well as the rolling back of the retirement at from 60 to 58 years, in the name of reviving BSNL's financial health. When 79,295 employees, from the present strength of 1,65,657, are going to retire In the next 4 years, ie., by April,2024, we do not understand the logic behind the urgency to implement VRS in BSNL. Similarly, as per the assurance given by the government in 2000, to the erstwhile recognised federations, only the government rules with regards to retirement age, are applicable to BSNL employees. We request you to kindly look into these aspects.

Another important aspect, connected with the revival of BSNL is that the Company is having vacant lands throughout the country, whose value is pegged at more than Rs.1 lakh crore. BSNL Management has estimated to earn Rs. 5000 crore to Rs. 10,000 crore per annum, by renting / leasing out those vacant lands. However, the DoT is yet to accord necessary approval to BSNL, for the monetization of the vacant lands. Similarly, the government of India Rule, in respect of payment of Pension Contribution, is yet to be implemented in the case of BSNL, as a result of which a huge amount is being collected in excess every year from BSNL, in the name of Pension Contribution. An early decision by the DoT in these issues, will go a long way to ensure the financial revival of BSNL.
Finally, the issues of implementation of 3rd Pay Revision to the BSNL employees, and also the issue of Revision of Pension to the BSNL retirees are, agitating the minds of the employees and the pensioners, An early, as well as positive decisions on these two issues, will greatly motivate the Executives and Non-Executives of BSNL, to contribute their mite for the Revival of BSNL.

We request you to kindly look into these issues and to ensure a positive settlement of the same.

BSNL CO vide letter No. 500-163/2017-18/CA-III/BSNL dated 27.02.2019 raised a claim of Rs. 1749948154.00 on account of reimbursement of employee cost of BSNL's employees deputed on loan basis in DoT and its field units as well as Leave Salary contribution.

2. Approval of the Competent Authority is hereby conveyed for payment of RS'I 72,91,77,486.00 ( Rupees Seventy Two Crore Ninety One Lakh Seventy Seven Thousand Four Hundred and Eighty Six Only) only to BSNL based on provisional certificates given by Pr.CsCA/CsCA/TERM Cell on working of such BSNL employees against their sanctioned posts on loan basis (Annexure - A). The above payment is subject to final settlement/ adjustment after reconciliation.

3. All Pr.CsCA/CsCA are requested to make payment of total verified amount shown in column '10' of enclosed Annexure - 'A' to the concerned CGMT of BSNL subject to availability of budget. The payment in respect of BSNL employees worked/working on loan basis in DoT Headquarter and other Delhi based offices, if any, may be made by the Pr.CCA, Delhi Region.

4. Further it has been decided that no employee of BSNL/MTNL or any other PSUs will be engaged in DoT and its field units on loan basis w.e.f. 01.04.2019 except on deputation against sanctioned and vacant posts as per DoP&T OM No. 6/8/2009-Estt. (Pay II) dated 17.06.2010 (amended from time to time). It may be ensured that no employee of BSNL/MTNL is retained in DoT (Hqrs) and its field units on loan basis after 31.03.2019. No claim of pay and allowances of BSNL/MTNL employee working after 31.03.2019 on loan basis shall be entertained for reimbursement by DoT in future.

BSNL, a state - owned telecoms company, said that its 1,76 lakh employees were cleared of their pending february salaries.
The company also announced the launch of various schemes to increase its market share and revenue.
“We have disbursed salary of all employees that was pending for the month of February. BSNL employees have ensured that customers services run uninterrupted despite issues that they were facing. Now we will aggressively focus on increasing our market share and revenue with attractive schemes,” BSNL Chairman and Managing Director Anupam Shrivastava told PTI.

The BSNL CMD Thursday had said that the telco was using internal accruals of Rs 850 crore to clear the February salary.

He had stressed that with the telecom department’s support, there would be no delay in salary disbursement in coming months.

BSNL Friday announced free voice call on its ‘Wings’ mobile app and free broadband services for a period of 30 days to attract new customers.

Under the scheme, BSNL landline and mobile customers can make unlimited calls across India for free for a period of 30 days through its Wing mobile application and make calls to any landline or mobile number in India for Rs 1.2 per minute when they are travelling abroad.

“The Wings app annual activation charge is Rs 1,100 but we are giving it to all students at 20 per cent discount, all central and state government at 50 per cent discount and BSNL employees for 75 per cent discount,” BSNL Wings (OSD) AK Jain said.

Post the free offer, Wings users can make calls using any wifi network and will need to pay as per their landline or mobile subscription plan.

BSNL customers can divert incoming calls on their landline or mobile phone to the Wings app.
“We are not charging money for diverting calls to the app,” Jain said.

Besides voice calls, the state-run firm announced free broadband service for its landline and new customers for 30 days. Under the offer, customers availing broadband connection will get 5Gb per day data.

Though the scheme is not applicable for existing broadband customers, the company has announced “25 per cent cash back and Amazon prime subscription for a year on zero cost” for them.

Amid tariff war fuelled by Mukesh Ambani-led Reliance Jio, BSNL is the only company, apart from Jio, that gained new customers in mobile segment, according to the Trai data.

The company, however, had been losing landline customers and expects new schemes to check the decline.

It is very unfortunate that payment of salaries of the Executives and Non-Executives of BSNL for the month of February, 2019 is not made today.

All of us are aware that BSNL is not getting permission of the DoT for taking Bank loans. The AUAB has already demanded that the DoT should immediately permit BSNL for taking Bank loans to tide over the crises.

However, so far, the DoT has not given the necessary approval.

The AUAB has called on the employees to organize demonstrations tomorrow the 01-03-2019, protesting the non-payment of salary and demanding the DoT to immediately grant sanction to BSNL for taking Bank loans.

All Circle and District unions of BSNLEU are requested to coordinate with the other constituents of AUAB and to organize the demonstrations successfully.

A meeting between the AUAB and the BSNL Management was held today at 17.30 hrs. Shri Anupam Srivastava, CMD, BSNL, Ms.Sujatha.T Ray, Director (HR & Finance) and Shri A.M.Gupta GM (SR) were present. From AUAB, Com.P.Abhimanyu, Convener, Com.Chandeswar Singh, Chairman, Com.K.Sebastin, GS, SNEA., Com. Prahlad Rai, GS, AIBSBNLEA, Com.Pathak, AGS, AIGETOA., Com.Suresh Kumar, GS, BSNL MS, Com.H.P.Singh, Dy. GS,BSNLOA and Com.S. Sivakumar, President, AIBSNLEA participated.. The CMD, BSNL explained the serious financial crisis being faced by the BSNL and appealed for the cooperation of the AUAB, for deferring payment of the salary for the month of February 2019. The AUAB representatives firmly rejected the request of the CMD, BSNL. They told in one voice that payment that the payment of salary of employees should not be deferred. Thereafter, the CMD, BSNL said that the 3 days strike called on by the AUAB from 18-02-2019 will be self-defeating and appealed to call off the strike. The representatives of the AUAB rejected the appeal of the CMD, BSNL and reaffirmed that the strike will take place at any cost. They told the Management that the repeated assurances given by the Hon'ble Minister of State for Communications are not implemented by DoT and that the strike will now take place successfully.. The AUAB told the HB Management in categorical term that there is no question of going back from the decision to go on strike.

The undersigned is directed to say that several instances have been reported in this office from different Telecom Circles wherein it has been requested for reply of the following queries:

1. If at the time of death of BSNL employee, son/daughter of deceased employee is minor & he/she applies for CGA after attaining the age of 18 year then the period of belated request to be counted from date of death or date of attaining the age of 18 years for awarding the negative points in weightage point system.

2. If the family of deceased employee does not have own house & living in relative’s house & not paying any rent for this house then the 10 points of accommodation can be awarded or not in weightage point system.

In this connection, the point wise reply of the above said queries has been given below as:

1. If at the time of death of BSNL employee spouse is alive and she is waiting for his/her son/daughter to become 18 years of age then belated points may be deducted. However, if spouse of ex-official had already expired or expires within 5 years from his/her death then belated points may not be deducted for son/daughter when he/she applies for his/her own CGA after attaining the age of 18 years.

2. Weightage points for Accommodation can only be given if the applicant submits rent receipt.

Facility of extension of without voucher facility which was withdrawn vide EF Branch letter No. 7-8/2010/EF/Part/l dated 5.9.2011 was revived vide this office OM of even no. dated 11th April 2017 to retired employees and it was decided that the decision will be reviewed after six months.

The issue was reviewed, there has been an increase in expenditure on this account. Whether to continue the scheme for the year 2018-19 and if it is continued the quantum of allowance to be paid is under active consideration. It is learnt that the last two quarterly instalments payable to the optees (retired employees) for the year 2017-18 have not been released. To avoid inconvenience to retired employees, it is therefore requested that two instalments due may be released. Decision on continuation of the scheme and other related issues will be conveyed immediately after its approval.

The undersigned has been directed to convey the Approval of the Competent Authority towards revision of remunerations being paid to, the retired Government servants engaged in Department of Telecommunications(Head Quarters) with effect from 1st January, 2016 as under:

(a) In the case of Government servants retired after 01.01.2016 engaged as consultant:

The consolidated fee/ remunerations for the consultants shall be restricted to an amount equal to the difference between the last basic pay (as per 7th CPC) drawn by the retired officer and basic pension (as per 7th CPC), plus dearness allowance on the difference as applicable to the Central Government Servants from time to time.

(b) In the case of Government servants retired prior to 01.01.2016:

In case of those engaged as consultants in DOT H Qrs. who retired prior to 01.01.2016 i.e. before implementation of 7th CPC, their last pay drawn shall be fixed notionally in accordance with para 4 of DOP&PW OM No.38/37/2016-P&PW(A) dated 12.05.2017 i.e., their last pay may be fixed notionally in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay band A and grade pay at which they retired. The consolidated fee/ remunerations for the consultants shall be restricted to an amount equal to the difference between the last basic pay arrived as above and basic pension (as per 7th CPC), plus dearness allowance on the difference as applicable to the Central Government Servants from time to time.

(c) In the case of retired officers from PSUs viz. BSNL, MTNL etc.
The remunerations of such PSU employees engaged as consultants may be fixed by multiplying both the notional basic pay as per 6th CPC and basic pension of PSU retirees by factor 2.57 and their difference plus Dearness Allowance on the difference as per 7 CPC at the rate applicable to Central Government Servants from time to time or the existing remunerations, whichever is higher.

2. Para 4 of OM No. 3-2/2009-SEA-I dated nil February, 2010 and para 1 (iv) of the approved policy for “Engagement of Consultants” issued vide OM No. 03-10/2014-SEA-I/Fin. Dated 28.02.2015 stands modified to the extent stated in para 1 of this OM w. e. f. 01.01.2016.

3. The nodal sections/wings of DOT HQ will revise the consolidated fee/remunerations in respect of the consultants Working in their wings on the basis of copy of the letter from the Department/Ministry from which they retired (giving details of revision of pension) addressed to CPAO with copy given to pensioners. The remuneration so revised should be got vetted for the first time from IFD before making payment.

4. The above revision of the consolidated fee/ remunerations as per 7th CPC and its implementation will be applicable in respect of consultants engaged in various wings of DOT HQs was well as in CCA Offices.

I am directed to forward herewith a copy of letter No. 40-27/2017-Pen(T) dated- 04/12/2017 received from Under Secretary, DoT alongwith a copy of notification dated 21/ 12/2012 issued by DOP&PW.

2. DoT in their above referred letter has clarified that Rule 5 (2) of CCS (Pension) Rules, 1972 previously included a proviso as per which the date of retirement in case of a Government Servant who is retired prematurely or who retires voluntarily, shall be treated as a non-working day has been amended by DoP&PW and omitted the proviso with effect from 01/01/1996 by a notification dated 21/ 12/2012 issued by DOP&PW. Consequently, for all cases of retirement, the last day shall be treated as a working day.

3. Accordingly, the modifications issued by DOP&PW notified on 21/ 12/2012 may be considered while issuing orders of voluntary retirements.

Hon'ble Sir,
At the outset, we are thankful for your reported inclination towards implementing revised pay scales with 25% fitment benefit in respect of BSNL executives, even though BSNL does not fully meet the affordability condition stipulated by the 3rd PRC but BSNL is already on revival path and reporting operational profit for last few years. In this regard, we would like to draw your kind attention to the fact that MTNL employees were allowed pay revision as recommended by 2nd PRC w.e.f. 1.1.2007 with the highest 30% fitment benefit although the affordability clause existed then and MTNL was incurring loss for consecutive years.

2. We now learn that BSNL Board has approved a proposal for pay revision and has submitted to the administrative department i.e., the Department of Telecommunication.

3. It is needless to say that BSNL was formed when Hon’ble Shri Atal Bihari Vajpayee ji, was the Prime Minister of India, with a Mission to provide world class, State-of-art technology based telecom services on demand at affordable prices and to provide world class telecom infrastructure to develop country’s economy. At the time of Corporatisation, while approving HRD and financial issues arising out of the corporatisation, the Union Cabinet had assured that “Government will consider and provide a package of measures so that the viability of BSNL is not impaired because of implementation of any socially desirable uneconomic activity, such as rural telephony, undetaken by BSNL at the behest of Government”.

4. Since then, BSNL has been discharging the social obligations of the Government of India by providing services in remote and rural areas inspite of incurring loss because of these services and its presence in the Telecom industry as a fully Government owned PSU, aiming at providing world class services at affordable tariff, has been accepted by every stake holder as a ‘moderating factor’ in controlling the tariff in favour of the customers.

5. When all private networks failed to provide dependable service during natural calamities, whether it was Hudhud cyclone in Andhra Pradesh, Vardha cyclone in Tamilnadu, Floods in Tamilnadu and Uttarakhand, Earthquake in Jammu & Kashmir, BSNL was the only operator which proved its robustness.

6.1 In the prestigious Digital India programme of Hon’ble Prime Minister of India too, BSNL is contributing in two three areas, like National Optic Fibre Network (NOFN), providing Wi-fi hotspots at commercial places, Mobile Wallet service under the Prime Minister Jan Dhan Yojana and delivering m-governance services like digital mandi, kisan seva, Digital high quality educational content among others. BSNL’s contribution towards BharatNet is also worth mentioning.

6.2 BSNL's role in ensuring GST compliance also cannot be under estimated. BSNL introduced GSP/ASP service on PAN India basis to assist Small and Medium Enterprises as well as large business houses in transitioning to GST by launching an application software which will record invoices on a PC / hand held device or a smart phone along with all GST compliances like preparation of GST Returns, Assistance in generation of GST challans for payment, filing of GST Returns, sending back mismatch invoices etc. BSNL also played an effective role during demonetisation in last November by providing seamless network connectivity among banks and financial institutions.

7. Recently BSNL has signed (MoU) with Fiber Home to jointly start manufacturing telecom equipment and optical fiber cable in BSNL factories, underscoring another initiative by Hon’ble Prime Minister of India – ‘Make in India’.

8. BSNL revenue over the past three years is increasing. The year 2013-14 saw an increase in revenue of 3.2%. The year 2014-15 saw an increase of 2.32%. In the year 2015-16, the increase in income is 14.92% whereas in the same year the expenses decreased marginally by 1.47%. The loss is declining and BSNL is likely to make profit in 2018.

9. While these are sufficient ground justifying revision of pay scales of BSNL employees with 15% fitment benefit, we would like to draw your kind attention towards another major fact which cannot be ignored or overlooked.

10. All the senior officers of Department of Telecommunication who are on ‘deployment’ in BSNL, holding major managerial positions in BSNL have already got their pay fixed in revised scales as per the recommendations of VII Central Pay Commission with 14.2% fitment benefit w.e.f. 1.1.2016. All of them draw their higher pay and perks from BSNL and BSNL’s affordability to pay was not at all an issue for them. If BSNL employees are denied the revised pay with 15% fitment benefit, it will result in an unprecedented discrimination against its own employees vis-à-vis those who are under ‘deployment’. The fall out of such a situation will be unparalleled in the history of indian Public Sector.

11. It will be therefore unfair if BSNL executives are denied their due pay revision in the name of non-affordability, since such a proposition will have a negative impact on their morale which in turn will affect the revival plans of BSNL.

12. We therefore earnestly request you to kindly get the issue examined thoroughly and to ensure that pay revision as per 3rd PRC recommendations are implemented in BSNL with 15% fitment benefit in view of its strategic national importance.

Soldiers and officers of various army and para-military units like CRPF, BSF, BRO, ITBP, etc. are deployed in remote and far flung areas to protect Borders of India. The soldiers and officers are working day and night without bothering about difficult weather conditions and as they are posted away from their homes and headquarters, there is a constant requirement for them to speak to their family and also to their Headquarters. They use only DSPT service provided by BSNL because there is no other means of communications available in those areas.

Briefing the media here, the Minister of Communications Shri Manoj Sinha said that in order to use the facility of DSPT, the soldiers & officers at present are required to pay monthly fee of Rs.500/- and call charges of Rs.5/- per minute. But, looking at the requirement of Soldiers & Officers and also the heavy cost they have to incur for talking to their family members, government has taken an important decision on the auspicious occasion of Diwali. Shri Sinha said, from Diwali day (19th October, 2017), no monthly fee will be taken for using DSPT service, that is, the current monthly fee of Rs.500/- will be ‘Zero’ from tomorrow. And also, the present telephone charges of Rs.5/- per minute is being reduced to Re.1/- per minute.

With this special Diwali Gift from Government of India, Defence personnel can now talk without worrying for more expenses to their home and their Headquarter. The Minister also wished the jawans and officers and their family members A Very Happy Diwali.

Sub: Implementation of Superannuation Pension Scheme as per BSNL Employees Superannuation Pension Trust Rules.

As a measure of extension to social security to the BSNL recruited employees (as defined in BSNL Employees Superannuation Pension Trust Rules), BSNL has approved the implementation of Superannuation Pension Scheme w.e.f. 05.05.2016. Accordingly, BSNL has framed BSNL Employees Superannuation Pension Fund Trust Rules (copy of the Trust Rules is enclosed ). As per the Trust Rules, BSNL will contribute at the rate of 3% of Basic Pay plus IDA per month for all BSNL recruited employees, as defined in the Trust Rules. The employees may also contribute to the scheme on a voluntary basis. The quantum of employees' contribution to the scheme is governed by the Trust Rules.

In this connection, the basic procedural as well as accounting aspects of the scheme are given below:

1 There are two GL codes in respect of superannuation pension scheme.
  • Claims Payable to Superannuation Pension Fund Trust - 1310203
  • Superannuation Pension Expenses - 5010310
2 Initially, on the basis of the process run in SAP, the total amount booked under Liability GL Code-1310203 upto September 2017, will be paid to the fund manager Corporate Office.

3 With effect from October 2017, on a monthly basis, at the time of preparation of salary:
  • GL Code 5010310 will be debited for the Employer Share.
  • GL Code 1310203 will be credited by the amount of Employer share and Employee Share of superannuation pension scheme.
4 After completion of the salary process, total of the monthly credit under GL Code 1310203 duly tallied with the schedules, shall -be transferred to the Superannuation Trust on 5th of the following month followed by transfer of the equal amount to the fund manager by the Trust at Corporate Office level. Circles should reconcile the amount booked in GL code 1310203 with the HCM schedules by 4th of the following month.

5 At the time of maturity of the scheme on account of superannuation / retirement / resignation / death of the employee, the employees / nominee of the employees will be required to opt for the pension option offered by LIC as also annexed With this circular. To opt for the pension options, employees / nominee of the employees shall submit the requisite forms duly filled to the DDO/AO(Cash).

6 Circles should ensure to " revise the terms and conditions of deputation services to this effect and arrange to communicate with such other organizations.

7 The SAP related operational guidelines have already been issued by ERP HCM team.

8 General Instructions
  • In the beginning, the DDOs will ensure to get the amount of monthly voluntary contribution and duly filled Nomination Form (copy enclosed) from the employees.
  • At the time of maturity of the scheme on account of superannuation/ retirement/ resignation / death of the employee, the DDOs/AO(Cash) will ensure to send the claim form to GM(CA), CO, BSNL in original. Separate set of forms to be sent to this office for death and other than death cases are enclosed as Annexure 'A' and 'B' respectively. Each page of the claim form should be authenticated by the DDO/AO(Cash).
  • LIC, the fund manager, of the BSNL Employees Superannuation Pension Scheme will provide the facility of online Web portal for each Employee through which the employees will be able to have updated. information on his superannuation pension contribution fund. The procedure to check the portal will be intimated in due course.

Where is the Bonus for BSNL employees?

Bonus is the deferred wage. There was no Bonus for government employees till 1977. Sustained struggles were fought by the Railways and Central government employees for Bonus, including the historic Railway Strike of 1974. It was only after the Janata Government came in to power that Bonus was granted.
The government has announced Bonus for Railway, Postal and other central establishments for 2017, though it is below the demand of the employees. But BSNL employees, who were central government employees earlier, have not been granted the same so far, despite demand from the unions. The Festival season has started and the delay in announcing the same is unjustified.

We demand the BSNL management to announce the Bonus for employees at the earliest.
