Sub: Implementation of BSNL Voluntary Retirement Scheme, 2019 - Augmentation of staff strength in Pension Cells in Circles and other administrative units for smooth and timely settlement of pension cases.

Sir,
I am directed to invite your kind attention to this office letter no. 1-15/2009-PAT (BSNL) dated 04.11.2019 regarding introduction and implementation of BSNL Voluntary Retirement Scheme, 2019.

As per the said scheme, employees aged 50 years or above are eligible to opt for voluntary retirement w.e.f. 31.01.2020 and it is expected that a sizable number of eligible employees would be opting for voluntary retirement under the scheme. Consequently, the workload of the pension settlement units in circles and other administrative units are expected to increase manifold. Moreover, some of the eligible employees who are presently posted in pension settlement units may also opt for voluntary retirement under the scheme. It would, therefore, be necessary to arrange for suitable substitutes for such employees for maintaining continuity

In view of above, you are requested to ensure posting of suitable and sufficient number of Executives/ Non-Executives in sections handling pension settlement in Circle/ SSA at the earliest, so that the newly posted employees could be accustomed with the nature of work and pension cases can be processed and settled in timely manner.

1. Eligibility Criteria :-
All regular employees, both absorbed and directly recruited, of BSNL who attains 50 years or above as on effective date of VRS, ie 31/01/2020, are eligible.

2. Important Dates :-
  • Start of option : 04/11/2019
  • Closing of option : 03/12/2019 up to 1730 hrs.
3. Benefits :-
  • Ex-gratia- 35 days salary for each completed year of service+25 days salary for each year of service left, until superannuation, provided further ex-gratia shall not exceed the salary he/she would have drawn at the existing level for the service period left.
  • For employees absorbed in BSNL under Rule 37A, ex-gratia shall be restricted to the amount which taken together with the pension that the employee would be drawing for the balance period left till superannuation. Provided further that the ex-gratia shall not exceed 125% of the salary of the employee would have drawn at the existing level for service period left.
4. Employees opting VRS are entitled for the terminal & other benefits under existing rules as below:-

i. For Absorbed employees :-
» Pension /Family Pension from the next day of effective date of VRS
» Retirement Gratuity :-
  • For employees above 59 years- within one month from the date of attaining 60 years
  • For employees 55 and below - in February 2025.
» Incase of death of the retired employee before due date of payment of gratuity , the amount shall be released immediately to family along with interest.
» Simple interest @GPF rates (currently 7.9%) will be paid till the date of release of gratuity

ii. For BSNL Recruited employees and those appointed under Rule 37, gratuity shall be paid without deferment.

iii. Commutation of Pension :-
Full pension will be paid till the employee opt for commutation as below:-
» For employees above 50 years- on attaining 60 years
» For employees 59 and below- on 01/02/2025.

iv. Encashment of EL /HPL, TA/DA to place of settlement after VRS, Retention of staff quarters, RTC, Post-retirement medical facilities allowed as per existing rules and procedures, amended from time to time.

5. The eligible employees are required to login to the ERP / ESS portal for exercising his option for seeking voluntary retirement under the BSNL Voluntary Retirement Scheme -2019. Physical copies in triplicate signed in blue ink by the employee concerned shall be submitted to the administrative office concerned, within three days of giving option in ESS.

The option once exercised under this Scheme shall be final and decision of the competent authority shall be binding on the employee(s). Provided that the employee(s) will be allowed to withdraw the option only once at any time till the closing time and date of option.

Will the Minister of FINANCE be pleased to state:
(a) whether voluntary retirement is allowed to employees of Central Government covered under NPS after completion of 20 years of service on the lines of old pension scheme;
(b) if so, the details thereof;
(c) the details of pensionary benefits and other retirement benefits available/ allowed under NPS to employees who voluntarily retire;
(d) whether Government would increase its contribution to 20 per cent from 14 per cent under NPS in view of dismal returns on NPS fund to make it more attractive;
(e) if so, the details thereof; and
(f) if not, the reasons therefor?

ANSWER

(a) and (b) The features and benefits under National Pension System (NPS) and the old pension scheme are independent. Under NPS, there is a provision for voluntary retirement/exit prior to the age of superannuation, without linking it with the minimum number of 20 years of service.
(c) As per Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) Regulations, 2015, and amendments there under, the provisions for voluntary retirement/exit and the benefits available/ allowed under NPS to employees of Central Government who voluntary retires are as follows:

"3(b) where the subscriber who, before attaining the age of superannuation prescribed by the service rules applicable to him or her, voluntarily retires or exits, then at least eighty per cent out of the accumulated pension wealth of the subscriber shall mandatorily be utilized for purchase of annuity and the balance of the accumulated pension wealth, after such utilization, shall be paid to the subscriber in lump sum or he shall have a choice to collect such remaining pension wealth in accordance with the other options specified by the Authority from time to time, in the interest of the subscribers”

Further, as informed by the Department of Pension and Pensioners’ Welfare, the benefit of retirement gratuity and death gratuity has been extended to Government employees covered under NPS on the same terms and conditions as are applicable under CCS (Pension) Rules, 1972.

(d) to (f) Recently, vide Gazette Notification dated 31.01.2019, the mandatory contribution by the Central Government for its employees covered under NPS Tier-I has been enhanced from the existing 10% of basic pay +DA to 14% of basic pay + DA. The employees’ contribution rate would remain at the existing 10% of basic pay + DA. There is no proposal to increase the contribution to 20 per cent from 14 per cent under NPS.

Minister of State for Home Affairs replied in Parliament(Rajya Sabha) on 27.12.2017 regarding Voluntary Retirement in Paramilitary Forces.

“As per information provided by Central Armed Police Forces and Assam Rifles (CAPFs & AR), 19239 personnel have taken voluntary retirement from service since January, 2016.

Improvement in service conditions/ amenities and welfare of the force personnel is a continuous endeavour. A study was got conducted through Bureau of Police Research & Development (BPR&D) into the factors causing stress and suggest remedial measures and another similar study was got conducted though Indian Institute of Management, Ahmedabad (IIMA) for BSF & CRPF”. Based on the above study report, the measures, which have been taken to boost the morale and improve the working conditions and reduce stress among the force personnel, are at Annexure-‘A’.

Measures taken to improve the working conditions and reduce stress among the force personnel

(i) Transparent policies pertaining to transfer and leave of CAPFs and AR personnel. The hospitalization period due to injuries while on duty is treated as on duty. Choice posting is considered to the extent possible after the personnel served in hard area.

(ii) Regular interaction of officers with troops to find out and redress their grievances.

(iii) Ensuring adequate rest and relief by regulating the duty hours.

(iv) Improving living conditions for troops, providing adequate recreational/ entertainment, sports, communication facilities etc. Crèche facility is also provided at various establishments (where feasible) to facilitate the female employees.

(v) Facility of retention of government accommodation at the place of last posting (for keeping the family) while posted in NE State, J&K and LWE affected areas (except State Capitals).

(vi) Providing better medical facilities, also organizing talks with specialists to address their personal and psychological concerns and organizing Meditation & Yoga routinely for better stress management.

(vii) Adequately compensating the troops deployed in difficult areas.

(viii) Other welfare measures like facility of Central Police Canteen (CPC), scholarship for wards etc. Also air courier service has been provided to CAPF personnel deployed in NE States, J&K and LWE affected areas as welfare measure.

(ix) Designating retired CAPF personnel as ex-CAPF personnel for better identity and community recognition.

(x) Promotions are released regularly to eligible personnel as & when the vacancies arise. Financial benefits under Modified Assured Career Progression (MACP) are given in case promotion does not take place for want of vacancies at 10, 20 & 30 years of service.

Besides above, implementation of suitable model for improvement of working conditions of CAPFs & AR is a continuous process and instructions in this regard are issued from time to time by this Ministry.

Will the Minister of TEXTILES be pleased to state:-

(a) whether the Government has revised the pay, wages and other service benefits available to the employees working in the mills under the National Textile Corporation (NTC) time to time and if so, the details thereof;

(b) whether the Government has implemented VRS and MVRS scheme for the employees working in the mills under the NTC and if so, the details thereof;

(c) whether the Government proposes to extend the benefit of MVRS scheme implemented for the employees of Minarva Mills for the similarly placed other mills and if so, the details thereof;

(d) whether the Government proposes to implement the MVRS scheme implemented in Minarva Mills to the employees of Parvathi Mills, Kollam and if so,the details thereof; and

(e) the details regarding the proposals pending with the Government for the welfare of employees in Parvathi Mills, Kollam?

(a): Pay, wages and other benefits has been revised by NTC Ltd. of the on roll employees of the working mills from time to time i.e. during the year 1992, 1997 and 2007 to the employees governed by Industrial Dearness Allowance pay pattern and during the year 1986, 1996 and 2006 to the employees governed by Central Dearness Allowance pay pattern.

(b): VRS and MVRS has been implemented by NTC to the employees in the units identified for closure and surplus employees of working units, Head Office, Regional Offices and Retailed Marketing Division of NTC. So far NTC has given MVRS to 63297 employees at a total cost of Rs.2373.86 crores, details as given in Annexure – I.

(c): Modified Voluntary Retirement Scheme (MVRS) has been uniformly applied for similarly placed mills. A copy of the scheme is at Annexure – II.

(d): Modified Voluntary Retirement Scheme (MVRS) has been uniformly applied to the employees of Parvathi Mills, Kollam and so far 644 employees has availed the benefit at a total cost of Rs.16.81 crores.

(e): No such proposal is pending.

Government mulls giving Rs 10 lakh extra to employees for taking VRS

New Delhi: Government is considering giving financial incentives Rs 10 lakh to those central government employees willing to go to voluntary retirement.

The Transport Minister Nitin Gadkari said on Thursday that he has asked his Ministry to come out with a proposal to give Rs 10 lakh extra to such employees for taking VRS.

Gadkari asked bureaucrats and engineers to take voluntary retirement, who often raise needless objections or delay work.

“There is a tendency to stop or delay work, which goes against everyone and hampers development. It’s better that government personnel take VRS…Let them go rather than troubling us,” Gadkari said while addressing a conference on highway construction equipment.

Large number of engineers and other officials from Transport Ministry, NHAI and other affiliated agencies were present in the meeting.

This is not the first time when Gadkari has cracked the whip on a public platform. Soon after taking charge of the Ministry, he had asked officials and engineers to stop the practice of making contractors visit them again and again.

He had said he would prefer such officials go out of the system. Gadkari had also warned that strict action would be taken against all those who keep files with them for several days.

New Delhi: Central government has decided not to accept (VRS) notice of its disabled employees in reference to Supreme Court order in the case Bhagwan Dass & Anr Vs Punjab State Electricity Board.

The Persons with Disabilities (PWD) Act, 1995, states that no establishment shall dispense with the services of a disabled employee.

“It has been decided that whenever a government servant seeks voluntary retirement citing medical grounds or due to disability, administrative authorities shall advise him or her about the option of continuing in service with the same pay scale and service benefits,” said Office Memorandum F.No.25012/1/2015-Estt (A-IV) dated May 19 issued by Department of Personnel and Training (DoPT).

“If however, despite being so advised, such government servant still wishes to take voluntary retirement, the request may be processed,” it added.

The DoPT said in this order that no establishment shall dispense with or reduce in rank an employee who acquires a disability during service.

“No promotion shall be denied to a person merely on the grounds of disability,” Office Memorandum says.

“It has been noticed that in many instances, persons suffering from physical or mental disability seek voluntary retirement owing to inability to attend to duty and not being aware of the protection afforded to them by the PWD Act” the Office Memorandum added.

According to the Office Memorandum, all the ministries, departments, subordinate offices, central public sector undertakings and autonomous bodies are requested to inform disabled employees about the protection available to them under the PWD Act and must be encouraged them to continue work instead of taking VRS.

Subject: Request for Voluntary retirement from persons suffering from disability — Supreme Court Order in Bhagwan Dass & Anr Vs Punjab State Electricity Board, (2008) 1 SCC 579.

The undersigned is directed say that vide Department of Personnel and Training’s OM No.18017/1/2014-Estt(L) dated the 25 th February, 2015, certain clarifications regarding treatment of leave and absence of disabled Government servants have been issued.

2. Instances have come to notice where Government servants apply for voluntary retirement under various provisions like Rules 38, Rule 48 and 48A of CCS (Pension) Rules, 1972 or Rule 56 of the Fundamental Rule on account of hardships faced by them due to a disability, as they are unaware of the protection provided by the Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of justifys and Full Participation) Act, 1995 (PWD Act). Section 47 of the PwD Act, 1995 is reproduced below for reference:

“Non-discrimination in Government Employment — (1) No establishment shall dispense with, or reduce in rank, an employee who acquires a disability during his service.

Provided that, if an employee, after acquiring disability is not suitable for the post he was holding, could be shifted to some other post with the same pay scale and service benefits;

Provided further that if it is not possible to adjust the employee against any post, he may be kept on a supernumerary post until a suitable post is available or he attains the age of superannuation, whichever is earlier. No promotion shall be denied to a person merely on the ground of his disability;

Provided that the appropriate Government may, having regard to the type of work carried on in any establishment, by notification and subject to such conditions, if any, as may be specified in such notification, exempt any establishment from the provisions of this section”.

3. The issue had come up in Bhagwan Dass & Anr Vs Punjab State Electricity Board (2008) 1 SCC 579, decided by the Hon’ble Supreme Court where the employee who had during his service suffered from blindness, had applied for voluntary retirement. The Hon’ble Supreme court has observed that the Petitioner was not aware of any protection that the law afforded him and apparently believed that the blindness would cause him to lose his job, which was the source of livelihood of his family. In those circumstances, it was the duty of the superior officers to explain to him the correct legal position and to tell him about his legal justifys.

4. Keeping in view the provisions of the Section 47 of the PwD Act, 1995 and the above mentioned judgement, it has been decided that whenever a Government servant seeks voluntary retirement citing medical grounds, or when the said notice has been submitted due to a disability, the administrative authorities shall examine as to whether the case is covered under Section 47 of PWD Act, 1995. In case the provisions are applicable, the Government servant shall be advised that he/she has the option of continuing in service with the same pay scale and service benefits.

5. In case a disabled Government servant reconsiders his decision and withdraws the notice for voluntary retirement, his case shall be dealt with under the provisions of the Section 47 read with the Department of Personnel and Training OM dated 25th February, 2015, mentioned above. If however, in spite of being so advised, such Government servant still wishes to take voluntary retirement, the request may be processed as per the applicable rule.

6. All the Ministries and Departments are requested to keep the above in view while processing cases of requests for Voluntary retirement from disabled Government servants.

The undersigned is directed to say that many Government servants seek voluntary retirement on medical grounds. Sec 47 of the Persons with Disabilities (Equal Opportunities, Protection of justifys and Full Participation) Act, 1995 (PWD Act) lays down that no establishment shall dispense with the services of an employee who acquires a disability during the course of service. It is proposed that any Government servant seeking voluntary retirement on medical grounds may be apprised of the above provisions of PWD ACT, in order that he can take a considered decision.

The undersigned is directed to refer to Rule 48A and Rule 48 of CCS (Pension) Rules, 1972 and Rule 56 of Fundamental Rules and say that a Government servant can seek voluntary retirement after completion of prescribed period of qualifying service under the said Rules.

2. It has been noticed that on many occasions persons suffering from physical/mental disability seek voluntary retirement owing to their inability to attend duty, not being aware of the protection afforded by the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (PWD Act):

NOTIFICATION
New Delhi, the 17th January, 2014

G.S.R. 27(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in consultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rule further to amend the Fundamental Rules, 1922, namely :—

1. (1) These rules may be called the Fundamental (First Amendment) Rules, 2014. (2) They shall came into force on the date of their publication in the Official Gazette.

2. In the Fundamental Rule, 1922, in rule 56, —

(a) in clause (k), in sub-clause (1), for item (c), the following shall be substituted namely :

“(c) it shall be open to the Appropriate Authority to withhold permission to a Government servant, who seeks to retire under this clause, if,—

(i) the Government servant is under suspension: or

(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or

(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending
Explanation :– For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceedings.”;


(b) for clause (m), the following shall be substituted, namely :—

“(m) A Government servant in Group ‘C’ post who is not governed by any pension rules, may, by giving notice of not less than three months in writing to the Appropriate Authority, retire from service after he has completed thirty year’s service :

Provided that it shall be open to the Appropriate Authority to withhold permission to a Government servant, who seeks to retire proceedings.”;
(i) the Government servant is under suspension; or

(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or

(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending.

Explanation :- For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceedings.”;

OFFICE ORDER

It has come to the notice of the CBDT that the officers, even after giving notice for VRS, continue to take decisions of sensitive nature. The Centeral Vigilance Commission(CVC) has taken a serios view of this practice. It is, therefore, decided by the Board that an officer who has submitted, his/her application for voluntary retirement from service (VRS) should take decisions of sensitive nature, if any, with the approval of next higher authority.


2. This issues with the approval of Chairperson, CBDT.

Subject: The Special Voluntary Retirement Scheme - 2013 to the redeployed erstwhile employees of Delhi & Mumbai Airports - Extension of date up to 30 June 2013.

Reference is made to Corporate HRM Circular of even number dated 14.03.2013 and letter dated 30.04.2013 on the subject cited above, wherein the last date for excising the option for VRS was mentioned as 30.04 2013 and subsequently, the date of exercising the option for VRS was extended from 30.04.2013 to 31.05.2013.

2. Now, it has been decided to further extend the said Scheme upto 30.06.2013 based on the request received from RED, Western Region, Mumbai,.

3. In this context. it is requested to ensure timely relieving of the executives and non-executives opting for VRS-2013. The relieving date shall be the date requested by the VRS opted employees in their application or 30.06.2013, whichever is earlier.

4, Further, no overstay is allowed in this regard and no VRS opted employee is allowed to report for duty after the closing date of the VRS-2013 Scheme i.e., 30.06.2013. As such the VRS forms for executives must be faxed immediately to CHQ for acceptance and the approval of the same should be communicated by return FAX without any delay. As far as Non-executives are concerned their cases should be approved and communicated to the concerned on or before the date of opting for VRS but not later than 30 06.2013.

5. The other terms and condition remain same.

6. This issues with the approval of the Competent Authority.

Office Memorandum

Subject : Furnishing of information regarding transfer, retirement, voluntary retirement, resignation, missing,m long leave (with medical certificate and without medical certificate) and death of Government officials, who have been allottees of General Pool Residential Accommodation (GPRA) and disciplinary action taken against the delinquent allottees of GPRA to the Directorate of Estates.

I am directed to refer to this Directorate O.M. of even number dated 25.1.2002 on the subject mentioned above requesting all Ministries/Departments of the Government of India to furnish a monthly information in respect of transfer of allottees of General Pool Residential Accommodation to ineligible office/outstation posting/voluntary retirement / resignation / death to this Directorate immediately on occurrence of such events along with details of general pool residential accommodation occupied by such allottees in order to take timely follow up action. In the said OM it was also requested that a copy of orders of transfer, voluntary retirement and resignation may be endorsed to this Directorate as this would not only avoid unauthorized occupation of government accommodation but it would improve availability of government accommodation for allotment to other government servants who are in the waiting list.

2. It is further informed that this Directorate always forwards a copy of orders in cases of proven subletting to the concerned Ministry/Department/office to initiate disciplinary proceedings against the delinquent Government servant in terms of Department of Personnel and Training O.M. No 11013/14/85-Estt.(A) dated 6.3.1986 and O.M.No.F.11012/2/97.Estt(A) dated 31.12.1997.

3. It has been past experience in this Directorate that a very few Ministries/Departments/offices have intimated the outcome of the Disciplinary proceedings, under CCS(CCA) Rules. 1964, to Directorate of Estates on proven subletting cases. Moreover, no Ministry/Department/Office endorses a copy of orders of transfer, voluntary retirement, resignation and death to this Directorate resulting in unauthorised occupation of government accommodation.

4. In order to obviate unauthorized occupation of government accommodation and to streamline allotment of government accommodation, all Ministries/Departments/Offices are once again requested to furnish final outcome of the Disciplinary proceedings, under CCS(CCA) Rules, 1964, to Directorate of Estates and to endorse a copy of orders in respect of transfer of officials to an ineligible office, eligible office and outstation and voluntary retirement, resignation, death and missing government employees and employees on long leave (with medical certificate and without medical certificate) to this Directorate immediately on occurrence of such events along with details of general pool residential accommodation occupied by such allottees.

5. All Ministries and Departments of the Government of India are also requested to circulate this information to all offices (including statutory bodies etc) under their control with the direction to adhere to the request of this Directorate without fail.

Subject: Requests for cadre clearance - procedure to be adopted reg.

As Ministries/Departments are aware, CS.I Division, DoPT is the cadre controlling authority for CSS Officers. This Division grants cadre clearance to CSS officers of US and above level for applying lo deputation posts, foreign training and private foreign visits. This Department is also the competent authority to accept requests for voluntary retirement and resignation of US and above level officers.

2. This Department has devised formats for seeking cadre clearance and approvals for voluntary retirement / resignation. It has been observed that many times the requests for cadre clearance / approvals are received without furnishing information in the prescribed format. On several occasions it has been noticed that requests are not sent in original and only fax / photocopies are received, Further, Administrative Vigilance Division (AVD), DoPT is the Disciplinary Authority for US and above level officers of CSS. In view of this, vigilance clearance from AVD is necessary before considering requests of officers for cadre clearance for various purposes.

3. Hence forth, while seeking cadre clearance from CS.I Division in respect of US and above level officers of CSS, the following should be adhered to scrupulously:

(i) Requisite information complete in all respects should be furnished in the prescribed format - the formats are available on the website of this Department at http://persmin.nic.in /-> DoPT -> Central Secretariat -> CSS -> Forms;

(ii) Copy of the vacancy circular / advertisement / training circular should be forwarded, vigilance clearance form AVD.I Division of DoPT and a copy of the vigilance clearance should be enclosed with the request.

(iv) If the organization in which deputation is applied for is a Central Autonomous Organisation it should be clearly indicated whether the post applied for is exempt from the rule of immediate absorption in terms of D/o, P&PWs O.M. No.4/78/2006-P&PW(D) dated 31.10.2007;

(v) It should also be ensured that the officer concerned fulfils the eligibility conditions for the post applied for on deputation and completed the requisite 'cooling off' period on reversion from earlier deputation;

(vi) In case of voluntary retirement / resignation, approval of Secretary of the Department should be obtained and a copy of the note sheet containing the approval should be enclosed with the request for seeking approval.

2. CS.I Division will consider only such requests which are complete in all respects for grant of cadre clearance.
