Respected Madam,
 
With due regards, your attention is invited to meeting held with your good self and BPMS reps on 12.12.2013 wherein one of the issues was raised regarding grant of incentive bonus to Examiners of Quality Control in Ordnance & Ordnance Equipment Factories and you had assured to do the needful.
This letter is to bring to your kind notice that vide OFB letter No. 108/POLICY/TS/QCS, Dated 12.09.2012 addressed to Sr GM /GM of all Ord Fys, the then DGOF & Chairman OFB had reflected his concerns over the ‘Quality Management System in Ordnance Factories’ which needs improvement to enhance User’s confidence in our products.
 
In this regard, this federation vide letter no. BPMS / OFB / 72(7/3/R), dated 19.09.2012 urged the then DGOF & Chairman, OFB to give some incentive to Examiners at least on par with Maintenance workers to motivate the Examiners, to contribute their knowledge, experience cent percent to the organization.
This federation has been grateful to the OFB on considering the above in correct perspective and for inviting the comments from Sr GMs/GMs of all Ordnance Factories whether Examiners may be provided some incentives. It is learnt that almost all Sr GMs/GMs have recognized the role of Examiners and recommended to grant incentive to Examiners at least on par with Maintenance workers. Since then the matter is pending in OFB.
 
Therefore, you are requested to take necessary action on priority to give Incentive Bonus to Examiners of QC at least on par with Maintenance Workers to boost the morale of Examiners and remove their apathetic attitude.

It is for your kind information that our delegates S/Sri V L Nawade , Sadhu Singh, Mukesh Singh & Virendar Sharma today had a meeting with Hon’ble Finance & Defence Minister, Shri Arun Jaitley at 1300 hrs. It was scheduled as a courtesy meeting but we invited his attention to the news articles on 100% FDI in defence sector because it was a great concern for all the stake holders. We reflected our concern vide a memorandum submitted by Shri Sadhu Singh (copy of the same is enclosed for ready reference).
Hon’ble Minister narrated how the Secretary, DIPP came to his office with the concerned minister on the same day of assuming the charge of ministry and shown the discussion paper prepared during the previous Government on 100% FDI in defence sector which he rejected at once. He has assured us that he is not in favour of 100% FDI in defence sector as neither it is required nor it is in the interest of the Nation. Not only that, he would take all the necessary steps to strengthen the existing Ordnance Factories & DPSUs but on the same time these defence installations require introspection.

Apart from above, some of the following issues were also brought to his notice which were considered by him very sympathetically and assured that appropriate action would be taken by concerned authorities:-

1. Defence installations should be exempted from 5% limit of Compassionate ground appointment and one time relaxation for all pending cases,

2. Re-draft the role of Defence (Finance) so that service matters like Recruitment Rules, Cadre Review, revival of sanctioned posts, payment of arrears, revision of allowances etc. may be settled at the earliest,

3. Judicial pronouncements may be extended to similarly placed non-petitioner employees,
4. The meeting of Departmental Council (JCM), MOD is not being convened regularly,

5. None of the Administrative Joint Secretaries of Departments of MOD has implemented the instruction {MOD I.D. No. 1(1)/2013/D(JCM), dated 22.10.2013} on the Mechanism to provide additional meeting opportunities to Staff Side to sort out their grievances,

6. The minimum benefit under Central Government Employees Groups Insurance Scheme should be enhanced to Rs. 10 lakh,

7. Dearness Allowance should be merged with Basic Pay,

8. Scrap the New Pension Scheme and restore old Pension Scheme,

9. CSD Canteen facilities may be provided to the retired Defence Civilian Employees,

10. A separate meeting to discuss the issues related to Department of Defence Production (OFB, DGQA, DGAQA etc.).


After that we met Shri Navin Kumar Chaudhari, Joint Secretary (Establishment), Min of Defence and discussed following issues besides all the above issues;

1. Probable date of completion (PDC) on the pattern of citizen charters should be fixed for resolving the issues, for movement of file/paper from desk to desk/section in respect of issues raised by JCM/Federations and latest position should be updated in website,

2. A permanent cell of empowered officers from Min of Defence, Finance, Law, Labour, DoPT etc. should be constituted in MoD so that the Cadre Review & Recruitment Rules of Group ‘B’, ‘C’ & ‘D’ may be revised expeditely.

3. Remove the artificial restriction of 40 days PLB for AOC, Navy, Air Force, EME & Ordnance Factories. The PLB should not be less than the Adhoc Bonus of 30 days, and all ceilings on payment and eligibility of Bonus should be removed, JS (E) immediately called the DS (E) & DS (CP) and instructed to convene regular meetings of JCM and next meeting of Departmental Council (JCM), MOD may be convened on 24.06.2014 in Sena Bhawan.

After implementation of VIth CPC report by Government, there is a growing demand from Staff Side to review the cadre structure of clerical staff in the light of recommendations of VIth CPC and accordingly OFB has constituted a committee.

02. The recommendations of the Committee has been accepted by OFB and are summarised below…
(i) The number of posts of LDC and UDC is proposed to be 1700 each, which is the bare minimum at the lower level of the Clerical Cadre for smooth running of offices in the various Ordnance Factories. 
(ii) The number of posts of Office Superintendent is proposed to be fixed at 1600 for efficient running of the higher hierarchy of the Clerical Cadre.
(iii) The number of posts of Junior Works Manager (NT/OTS) is proposed to be 30% of the strength of Office Superintendent for further strengthening of the top hierarchy of the Clerical Cadre and taking care of the genuine aspirations of the cadre.
(iv) The following rationalised structure is proposed

Dear Sir,
I have come to know that a meeting of the Standing Committee of the National Council JCM is scheduled to be held on 07.05.2014 under the Chairmanship of Secretary (P). Being a constituent of National Council (JCM) but not of Standing Committee, I would like to submit one of the issues regarding grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay.
 
An affected employee had challenged the Government’s decision on the subject vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP. In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.
 
Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.
 
 Further, your attention is invited to Para 126.5 of 5th Central Pay Commission which reads as under:
Extending judicial decisions in matters of a general nature to all similarly placed employees. – We have observed that frequently, in cases of service litigation involving many similarly placed employees, the benefit of judgement is only extended to those employees who had agitated the matter before the Tribunal/Court. This generates a lot of needless litigation. It also runs contrary to the judgment given by the Full Bench of Central Administrative Tribunal, Bangalore in the case of C.S. Elias Ahmed and others v. UOI & others (O.A. Nos. 451 and 541 of 1991), wherein it was held that the entire class of employees who are similarly situated are required to be given the benefit of the decision whether or not they were parties to the original writ. Incidentally, this principle has been upheld by the Supreme Court in this case as well as in numerous other judgments like G.C. Ghosh v. UOI, [ (1992) 19 ATC 94 (SC) ], dated 20-7-1998; K.I. Shepherd etc. Accordingly, we recommend that decisions taken in one specific case either by the judiciary or the Govt. should be applied to all other identical cases without forcing the other employees to approach the court of law for an identical remedy or relief. We clarify that this decision will apply only in cases where a principle or common issue of general nature applicable to a group or category of Government employees is concerned and not to matters relating to a specific grievance or anomaly of an individual employee.
 
Contrary to above, DoP&T has replied (letter No. No. P-26012/5/2011-AT, 19.08.2013 & No. P-13025/11/2014-AT, dated 04.04.2014) under RTI Act that the SLP was dismissed on technical grounds and not on merit, hence, the Department had decided to implement the order dated 31.05.2011 of CAT Chandigarh Bench for grant of financial upgradation in the promotional hierarchy under MACP to Shri Rajpal on personal basis not to be treated as a precedent
 
The stand taken by DoP&T is a matter of great concern for the trade unions as whether Govt of India wants to add 35 Lakh more court cases filed by each and every Central Government Civilian employees where the courts are already overloaded and several lakhs of litigants are waiting for judgment for decades.
 
You may be agree that the JCM Forum has been evolved for promoting harmonious relations and securing the greatest measure of cooperation between the Government, in its capacity as employer, and the general body of its employees in matters of common concern and increasing the efficiency of the public service. Hence, it is our moral and legal responsibility to protect the rights of our fellow members through JCM forum also.
 
Therefore, you are requested to add the above agenda point in the meeting and try your level best to prove the worthy of existence of this National Council (JCM) by resolving the issue without further delay and litigations in the interest of employees.

Sub: Non-implementation of decisions taken in the National 6th CPC Anomaly committee.
Ref: Minutes of the National Anomaly Committee meeting held on 17/07/2012.
 
We wish to draw your kind attention to the above mentioned subject. After the implementation of 6th CPC recommendations w.e.f.1/1/2006, Govt. of India constituted a National Anomaly Committee with representatives of staff side to settle the various anomalies arosed as a result of 6th CPC. The following two major issues which affects the major section of the Central Govt. employees was raised in the meeting and discussed in the subsequent meetings and an understanding was reached between the official side and the staffside. However it is unfortunate that the Govt. has not taken any decision on these two issues which has now forced the employees to approach Court of Law. Therefore to avoid multiplicity of litigations in the service matters of the Central Govt. employees, we request you to kindly intervene in the matter and arrange to issue necessary instructions for implementing the following two major issues.
 
1) Anomaly in the entry pay between Direct Recruite and promotee
There arosed an anomaly in Rule-8 of the CCS(RP) Rules - 2008, basically due to the fact that it is for the first time that the pay commission has recommended specific entry level pay for Direct Recruits (DRs). This has resulted in employees who were appointed in service prior to the Direct Recruits and got promoted earlier getting less pay as compared to their counterparts recruited directly and who joined after 1/1/2006. The official She stated that in such cases stepping up of pay is permissible subject to certain conditions. However the staffside hoisted that on promotion , the pay of all the promotees should be fixed at the entry level of pay of that post as in the case of the Direct Recruits wherever there is a provision of Direct Recruitment in the Recruitment Rules. The staffside requested that wherever there is a provision in the recruitment rule for direct recruitment in a post then in such cases the entry pay given to a direct recruitee should be automatically given to the promotee irrespective of the fact, whether a junior direct recruite is available or not. This proposal of the staffside was agreed by the official side and the DOP&T has proposed for implementation of this decision to the Department of Expenditure for issuing necessary Govt. orders. However till date no Govt. orders is issued on the subject.
 
2) Grant of MACP benefits in the promotional hierarchy of the Post instead of the next Grade pay in the Pay Band.
In the ACP scheme implemented by the Govt. w.e.f. 9/8/1999, based on the recommendation of the 5th CPC, the benefit was given in the promotional hierarchy of the respective posts. However the scheme was modified as MACP by 6th CPC and while implementing the same from 1/9/2008, it was changed from promotional hierarchy to next Grade pay in the Pay band. Due to this the employees are subjected to huge financial loss. To quote an eg. in the ACP scheme an employee in the GP of Rs.1900 was given ACP benefits in the next promotional post in the GP of Rs.2400, whereas in the case of MACP the benefit was given only in the next GP of Rs.2000/-. This major anomaly was pointed out by the staffside in the National Anomaly Committee and the staffside has given various suggestions for the consideration of the official side, it was agreed in the meeting that the suggestions given by the staffside would be considered. However, since no positive decision was coming from the Govt., the aggrieved employees have started approaching various courts. The matter went up to the Hon'ble Supreme Court and the Supreme Court was kind enough to rule that MACP benefits should be given in the promotional hierarchy and not in the next GP. After this Judgement various Federations of the Central Govt. employees have represented to implement the decision of the Hon'ble Supreme Court to all similarly placed employees. However it is regretted to inform you that the Govt. has implemented the benefit only for the petitioner .
 
Sir, we once again request your kind intervention in the matter and necessary directions may please be given to the DOP&T and Department of Expenditure to settle the above major two anomalies, seas to avoid any further litigation on the matter.

Clarification on ACP / MACP to Ordnance Labourers

The issues involved on the above subject mentioned above had been examined in consultation with D(Civ), Defence(Finance) and DOP&T, DOP&T in the matter has advised in the following manner :
2. Consequent upon implementation of recommendations of 6th CPC, the posts of Unskilled (Labourers) and Semi Skilled Workers have been merged in PB-1 with GP Rs.1800/- (after imparting training) with designation as Tradesman Mate. In case of Tradesman Mate who had completed 30 years of service as on 01.09.2008, would be entitled for financial benefit under MACPS. Hence the following categories of employees are eligible for financial upgradation under ACP/MACPS :
(i) Employees completing 12 years of service upto 31.08.2008 - 1st ACP in GP Rs.1900/-
(ii) Employees completing 24 years of service upto 31.08.2008 - 2nd ACP in GP Rs.2400/-,
(iii) Employees completing 30 years of service as on 31.08.2008 - 3rd MACP in GP Rs.2800/-.
3. The posts of Unskilled (labourers) and Semi-skilled workers which are placed in the Grade Pay of Rs.1800/- have been merged to the post of Tradesman Mate. Para 5 of MACPS provides for ignoring of promotions earned/upgradations granted under ACP Scheme in the past to those grades which now carry the same grade pay due to merger of pay scales/upgradations of posts as a part of the 6th CPC recommendations, Guidelines with regard to grant of financial upgrdations under MACPS, Including that of para 5 of Annexure-1 of MACPS with regard to ignoring of past promotions ACPs granted in the pre-revised pay scales which are now merged in to the same GP, are effective from 01.09.2008 only. Accordingly, thre is no question of grant of 1st ACP to employees completing 12 years of service upto 31.08.2008 in the GP of Rs.1900/- and 2nd ACP on completion of 24 years of service upto 31.08.2008 in the GP Rs.2400/-.
4. So fare as the case of grant of 3rd MACPS benefits to the employees at category (iii) at para 2 above, it may be stated that ACP Scheme has been replaced by MACPS w.e.f.01.09.2008. Fulfillment of prescribed promotional norms including passing of Trade Test has been dispensed with for grant of financial upgradations under MACPS, In consultation with DOE, as MACPS upgradations are granted in the hierarchy of Grade Pay as prescribed in the CCS(RP) Rules, 2008, instead of promotional hierarchy. However, "Benchmark" as prescribed in para 17 of MACPs is mandatory.
5. Thus, para 4 above amply clarifies that for grant of MACPS upgradations which come into effect from 01.09.2008, passing of Trade Test is not mandatory.
6. OFB may take note that of the above clarification given by DOP&T in the matter to deal with all such cases relating to grant of ACP/MACP benefits to the eligible Labourers/Workers.

IMPORTANT ISSUES DISCUSSED AND ITS OUTCOME IN THE JCM III LEVEL MEETING OF OFB HELD ON 24.02.2014 AND 25.02.2014 AT KOLKATTA
 
DECISIONS
 
1. PIECE WORK CO-RELATION ON VI CPC PAY BAND & GRADE PAY 
After discussions held on 06.02.2014 at M of D, the proposal to grant Piece work Profit on Rs.5200 PB-I and Grade Pay Rs.1900 total Rs.7100/- as minimum of pay + Increment separately paid.  After approval by Defence Minister, it was sent to OF Board for getting Draft Government Letter (DGL) and the same was prepared and sent to Secretary, Department of Defence Production for issue of Government letter.  Orders will be issued in the first week of March 2014.  M of D said that the Co-relation will be effective from prospectively.  But it was demanded retrospectively which will be considered separately.

2. GRANTING OF DEPARTMENTAL OVERTIME FOR 3 ¼ Hours (Saturdays) for PIECE WORKERS. 
Departmental OTA for Piece workers for 3 ¼ Hrs working on Saturdays was stopped by OFB w.e.f 01.04.2006 whereas the same is being paid to Day workers, Maintenance Workers as well as Non-Industrial Employees.  This issue was discussed with M of D and at OFB.  The file was now submitted to OFB seeking justification.  The proposal from OFB with proper justification is about to be sent to M of D and Defence Finance for payment of OTA on Single Rate to Piece Workers for working on Saturday 3 ¼ Hrs.
 
3. MANPOWER 
For 2013-14 issue of sanction for Manpower was delayed but sanction was issued. For 2014-15, after collecting the data about the requirements from the factories, proposal will be taken up with Secretary, DP and necessary sanction will be issued. 
 
4.  INCENTIVE For EXAMINERS 
Indian National Defence Workers Federation raised this point granting of Incentive for Examiners which is pending for long.  Production employees are getting Piece work, Maintenance Employees are getting Incentive but whereas the Examiners are not getting any financial benefit.
 
Chairman said that the Council of Quality General of India in its meeting to consider the proposal for granting incentive.  Necessary policy is to be framed and will be taken up with Secretary, Department of Defence Production who is also in favour of considering.
 
5. CONSIDERING DIPLOMA OBTAINED THROUGH DISTANCE EDUCATION FOR LDCE TO CHARGEMAN 
Indian National Defence Workers Federation insisted that the Diploma obtained through Distance Education needs to be considered as the employees cannot acquire qualification through full time Diploma.  Also employees working in remote areas do not have any facility near to them.  Further acquiring Diploma/Degree is only eligibility, and not they will be automatically selected unless they pass the written examination and qualify for the same.  Therefore, the Diploma/Degree obtained through distance education should be considered eligible for appearing to Chargeman post through LDCE Quota both for Tech and Non-Tech.
 
Chairman while replying said that on this distance education we need to take a longer view and settle the matter at the earliest.
 
6. On IR matters when raised by INDWF about HE Factory violating safety norms etc harassing workers, extending probation periods etc.  Chairman, OFB said instructions will be issued to GM’s to avoid any gap between Unions and administration to maintain harmonious Industrial Relations.  On HE Factory issue a feed back was asked to submit on building No.37 where safety norms are totally violated.
 
7. HAPP – Work Load 
Within the powers of OF Board, Rs.50 Crores have been sanctioned for the RGB 6 & 12 project considering the huge requirements.  It is temporarily suspended but it will be restored soon.  FSAPB – Mark III, PMT etc huge requirements are there and HAPP will have more work load.
 
8. JWM Transfers 
Against 600 applications seeking transfers, in one sitting about 100 applications were cleared.  The remaining will be cleared on stages by Member/Per with the assistance of NG Section Officers very soon.  Further the pending transfer order which were cancelled will be restored.
 
9. ONE TIME RELAXATION TO UDC & OS AND CADRE REVIEW 
The issue was already taken up with DOP&T for obtaining One time relaxation.  Further, Cadre Review proposals for clerical Cadre has been referred to M of D with the following proposals vide OFB letter Dt 13.02.2014 to DPP

10. OF DAY GIFTS 
It was demanded to Chairman that during OF Day celebrations on 18th March of every Year the employees should be given gift and at the same time there should be uniformity in the Factories would be decided by OF Board.
 
11. CENTRAL RECRUITMENT BOARD FOR OFB 
OFB proposed long back to form a OFB Recruitment Board for recruitment of Group ‘C’ posts.  Still the appointment of the Board has not been approved by Secretary, DDP. Since more number of posts are lying unfilled by recruitment by many factories and GMs are reluctant to carry out the process of recruitment.  5 Factories have been identified and will be entrusted the responsibilities of Direct Recruitment for various Group ‘C’ posts.  The vacancies factory wise will be notified through advertisement and written test will be conducted on one day in various centres throughout the country and selected candidates list will be sent to the nearest factories of the candidates which will avoid migration from one place to another.
 
12. VIJAYANTA SR.SECONDARY SCHOOL OF HVF 
HVF Vijayanta Sr. Secondary School requires major repairs and renovation including providing better amenities.  Member/Per assured he will visit and sanction necessary funds. Provided the factory submit the proposal. Member A/V also agreed and supported the claim of INDWF. 
 
13. VII CPC CELL FORMATION AT OFB 
At OFB, Cell was formed to prepare a proposal to the 7th CPC.  A meeting was convened on 26.2.2014 at OFB with all the Federation and Association representatives a report has been asked to submit to the OFB.
 
14. CADRE REVIEW 
Cadre Review proposal for Para-Medical staff was forwarded by OFB to Ministry of Defence.
 
15. Revised Pay slip was issued.  We have demanded that the Bank Account number to be included.
 
16. One time relaxation from Labourers.  The issue was referred to DOP&T to grant MACP Rs.2800/-.
 
17. For granting ACP in promotional Hierarchy to Durwans, it was demanded to merge Durwans with Subedar Durwan.  This would be considered.
 
18. RELIEVING STAGNATION TO STOREKEEPING STAFF 
A proposal given by the Staff side JCM to Divert the Direct Recruitment, LDCE vacancies of Chargeman (T) and Chargeman (NT) one time to relieve the stagnation of Storekeeper and Supervisor stores is being considered about the feasibilities.  Now the DR and LDCE vacancies for this year have already been released but it would be considered in the next year.
 
19. Leather Machinist will be considered for promotion to Chargeman (Leather) based on the recommendation of the Sub-committee report.
 
20.  Due to court cases, Cadre Re-structuring was delayed and the promotions were granted at a later date.  It is demanded that all financial benefits should be granted retrospectively instead of notionally.

‘Minutes’ of the Meeting held on 06.02.2014 under the Chairmanship of AS(A) with the representatives of Recognized Federations of MoD i.e. AIDEF, INDWF & BPMS in connection with the notice of “Indefinite Strike” from 17.02.2014 by Defence Civilian Employees:

The Declaration made by the Federations.

I. List of participants is at Annexure.

II. At the outset, AS(A) welcomed the representatives of the Federations and Official Side Members. He stated that the efforts will be made to sort out the problems expeditiously in the best interest of employees. The representatives of the Federations expressed their unhappiness at the accumulation of pending demands which compelled them to come at this juncture to go on ‘Indefinite Strike’ but hoped to get good discussion and solutions to their problems today. Then, AS(A) invited the representatives of all the three Recognized Federations to discuss the issues indicated in their Charter of Demands.

III. Discussions on Agenda Points raised :

Agenda Point-1 Grant of 2nd / 3rd MACP in Grade Pay Rs 4600/- to the Artisan Staff of Defence Establishments who were granted 2‘ ACP in the Char to 31.12.2005 in spite of MoD’s recommendation matter is pending with Defence Finance)
Decision : Addl FA & JS(RS) agreed to the issuance of clarification on this issue. Staff Side demanded discussions on the framing of RRs for MCM and Chargeman before referring the same to DOP&T and Was also agreed to.

Agenda Point-2 Correlation of the hourly rate of Industrial Workers deployed on Piece Work system in Ordnance Factories in 6th CPC Pay Scale w.e.f. 01.01.2006 (in spite of MoD’s recommendation matter is pending with Defence Finance)
Decision: Demand was agreed to. However, the issue of giving retrospective effect to the same will be examined separately.

Agenda Point-3 Grant of Departmental Overtime Wages to the Industrial Workers deployed on Piece Work ; system in the Ordnance Factories(in spite of MoD’s recommendation matter is pending with Defence Finance).
Decision: The demand will be re-examined by DDP and a justified action will be taken as per policy.

Agenda Point No-4 Grant of hourly rate to the Piece Workers of Ordnance Factories who were given MACP benefits. (inspite of MoD’s recommendation matter is pending with Defence Finance).
Decision: Depending upon the decision on agenda point No.1, a decision on this issue will be taken by,DDP.

Agenda Point No-5 Grant of revised ACP benefits to the labourers who have completed 30 years of service by granting an one time exem tion of Trade Test. MoD’s; recommendation in the matter is pending with DoP&T).
Decision: To get the matter expedited, a meeting with DOP&T is to be held

Agenda Point No-6 Grant of revised ACP benefits to the erstwhile Group “D” NIEs (MoD’s recommendation in the matter is pending with DoP&T).
Decision: As detailed in reply to Item No. 5.

Agenda Point No-7 Revision of Night Duty Allowance w.e.f. 01.01.1996 and from 01.01.2006 in the 5th and 6th CPC rates respectively by implementing the Court Judgments on the subject
Decision: Defence Finance will look into the matter expeditiously

Agenda Point No-8 Doubling of the Risk Allowance for Defence Civilian Employees w.e.f. 01.09.2008 has agreed in the National Anomaly Committee Meeting.
Decision: DOP&T may be reminded and matter to be pursued

Agenda Point No-9 Implementation of the following judgment to the similarly placed employees as per provisions of DOP&T OM No. A11019/2/98-AT dated 03 September, 1998.

i) Grant of MACP in promotional hierarchy (Government’s SLP dismissed in the case of CAT Chandigarh Bench Judgment on OA No.1038/CH of 2010.
Decision: Comments noted.

ii) Placement from HS Grade to HS Grade-I should be ignored for granting MACP (Judgment of CAT Principal Bench New Delhi in the case of Employees of 505 ABW, New Delhi referring various Supreme Court Judgments)
Decision: Comments noted.

iii) Restoration of the opportunity of Chowkidars and Safaiwalas of MES for re-designation as Mate (SS) (Judgment of the Hon’ble CAT Ernakulam Bench in OA No.109/2012 dated 12.12.2012)
Decision: Matter already resolved.

iv) Removal of discrimination and grant of skilled pay scale of Rs.260-4000/ 950- 1500 to non-petitioner Valvemen of MES (Judgment of Hon’ble CAT Jodhpur Bench in OA NO.51/2002 dated 21st July, 2003)
Decision: D(Works-II) to consider the matter and expedite the same.

v) Inclusion of HRA and Transport Allowance etc. for computation of OT Wages under Factories Act 1948 based on the judgment of Madras High Court.
Decision: Comments noted.

vi) Implementation of higher Pay Scale and grade structure for the similarly placed Cooks of all Defence Establishments as granted to the Cooks of Air Force vide MoD Letter No. Air HO/23064/Cooks/PC-4/444-CC/D(Air-III) dated 12th November 2013 based on the judgment of Hon’ble Principal Bench CAT, New Delhi.
Decision: Directions may be issued to cadre controlling authorities to carryout the cadre review of Cooks cadre in line with Cooks of the Air HQr.

Agenda Point No-10 Approval of all cadre review proposals of MTs, Durwanl Fireman, Drivers, Storekeeping Staff, Industrial Canteen Staffs Para Medical Staff, Stenographers, DEO, JWM and Clerical Staff of OFB, DRDO, DGOA, Navy, EME, AOC, Air Force and other Directorates pending at different level.
Decision: (i) Cadre reviews pending with Defence Finance be finalized.

(ii) Cadre review proposal not submitted shall be submitted within in one month and settled.

(iii) DRDO shall consult Staff Side Federations before finalization of DRTC cadre review.
Agenda Point No-11 Grant of PR1S to the DRDO Employees at par with Department of Atomic Energy and ISRO.
Decision: DRDO shall expedite a decision at RM level.

Agenda Point No-12 Revision of Fixed Medical Allowance to the Defence Employees posted at hard stations/isolated places and also grant of medical reimbursement for impatient treatment for such employees by implementing the judgment of Punjab and Haryana High Court.
Decision: Matter may be pursued with Ministry of Health & Family Welfare to expedite a decision.

Agenda Point No-13 Grant of Four Grade Structure to the Ammunition Mechanic or NAD under navy.
Decision: Matter may be pursued with Ministry of Finance to expedite a decision.

Agenda Point No-14 Grant of Four Grade Structure to the Meter Reader of MES at Par with the Artisan Staff
Decision: Matter may be pursued with DOP&T to expedite a decision. Agenda Point No-15 Extension of CSD Canteen facilities for retired defence civilian employees at par with Ex-Serviceman.

Addl. Secy (A) appealed the Federations that considering the discussion and decisions taken in the meeting, the Federations may please consider to withdraw their proposed ‘Indefinite Strike’ action.

The representatives of the Federations expressed the hope to get the ‘Minutes’ of the meeting by 11th February, 2014 so as to enable them to take a final decision on the proposed strike. The meeting ended with a vote of thanks to the Chair.

Defence civilian staffers agree to put off strike
Three federations representing around 4 lakh Defence Civilian Employees today decided to postpone their proposed indefinite strike from February 17 after receiving assurances from Defence Minister AK Antony regarding their demands.


"Defence Ministry has agreed to settle some of the demands related to cadre restructuring, promotional issues, piece rate and incentive revisions for production workers along with revision in the night duty allowance, etc.," said an office bearer of the All-India Defence Employees Federation.

A Joint meeting of the 3 Federations to review the decision taken for an indefinite strike to be observed from 17/2/2014 by the 4 lakhs Defence Civilian Employees, on the wake of the negotiations held with the Addl. Secretary(A) MoD and the subsequent meeting held with the Hon'ble Defence Minister Shri.A.K.Antony on 06/2/2014. The following representatives participated in the meeting.

Resolution

The Joint meeting of the representatives of AIDEF, INDWF & BPMS held at New Delhi on 12/2/2014 has taken note of the spirit of discussion which has taken place in the negotiation held under the Chairmanship of Addl. Secretary(A) MoD and subsequently with the Hon'ble Defence Minister on 06/02/2014. The meeting expressed its satisfaction over the proactive steps taken by the Hon'ble Defence Minister Shri.A.K.Antony, Defence Secretary, Secretary(DP) and all senior officials of the MoD and Defence Finance in settling the genuine demands of the employees. The meeting has also noted about the assurance given by the MoD that regular meetings with the Federations and JCM would take place in future.
 
The meeting considered about the good will of the MoD and also the appeal made by the Addl. Secretary(A) to the Federations to withdraw the proposed indefinite strike and has unanimously resolved that to reciprocate the positiveness and goodwill shown by the Defence Ministry, it would be prudent to defer/postpone the indefinite strike proposed from 17/2/2014 till a joint review of the progress on the settlement of the charter of demands, as assured by the MoD by the Federations. Accordingly it was unanimously decided to inform the MoD about the decision of the postponement/deferment of the strike. 
 
The meeting thanked and congratulated the 4 lakhs Defence Civilian employees and all the affiliated unions of AIDEF, INDWF & BPMS and other unions who served the strike notice on the Govt. and started serious preparation and mobilisation for the success of the proposed indefinite Strike. The meeting also appealed to the Defence Civilian employees to remain united to achieve the demands which are agreed by the Ministry of Defence.

Hon’ble Union Finance Minister made an announcement on 25th September, 2013 for constituting 7th Central Pay Commission; the Government has invited the leaders of the Federations (JCM National Council) for a meeting on 24.10.2013 to discuss the probable terms of reference of 7th Central Pay Commission.

In the meeting held on October, 24, 2013 at North Block, Room No.190, Chaired by Secretary, DOP&T the Federation leaders pointed out the following issues needs to be considered and settled.

Anomalies arisen consequent upon the implementations of VI CPC.

Anomalies relating to MACP Scheme vis-a-vis ACPs to be resolved as already discussed in Anomaly Committee

Merger of DA with Pay as was done during the year 2004.

All Cadre Review proposals should be cleared and should be de-linked with 7th CPC.

The Draft Terms of Reference – Finalised by the staff Side is given below:

(A) To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefit like Pension, gratuity, other terminal benefits etc., to the following categories of employees.

    Central Government employees – industrial and non-industrial.
    Personnel belonging to All India Services.
    Personnel belonging to the Defence forces.
    Personnel called as Grameen Dak Sevak belonging to the Postal department.
    Personnel of Union territories.
    Officers and employees of the Indian Audit and Accounts Department.
    Officers and employees of the Indian Audit and Accounts Department.
    Officers and employees of the Supreme Court.
    Members of Regulatory bodies (excluding RBI) set up under Act of Parliament.


(B)  To work out the comprehensive revised pay packet for the categories of Central Government employees mentioned in (A) above as on 01.01.2014.

(C)  The Commission will determine the pay structure, benefits facilities, retirement benefits etc., taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honourable Supreme Court thereon as on 01.01.2014.

(D) To determine the Interim relief needed to be sanctioned immediately to the Central Government employees and pensioners mentioned in (A) above.

(E)  To determine the percentage of Dearness Allowance/Dearness relief immediately to be merged with pay and pension.

(F) To settle the anomalies reached in various fora of JCM.

(G) To work out the improvement needed to the existing retirement benefits, like pension, death cum retirement gratuity, family pension and other terminal or recurring benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered in service on or after 01.01.2014.

(H) To recommend methods for providing cashless/hazzle free Medicare facilities to the employees and pensioners including postal pensioners.
