Subject: Implementation of the recommendation of 7th CPC – Para 11.12.140 – Grant of Grade Pay of Rs. 5400 (PB 2) i.e. Level 9 of Pay Matrix in case of Assistant Accounts Officer of Defence Accounts Department of Ministry of Defence: Grant of Non-Functional Up-gradation (NFU).

The CGDA, Delhi Cantt office vide their letter no. AN/XIV/14162/7th CPC/ Vol-II dated 13.11.2020 has intimated that the revised pay scale of the post of Assistant Accounts Officer in Defence Accounts Department would be in Level-8 of Pay Matrix and Level-9 (7th CPC) on completion of 04 years in Grade Pay of Rs. 4800/-(PB-2) Level 8. This is a Non-Functional Up-gradation (NFU) which is subject to the following terms and conditions:-

  • (i) The grant of NFU will be admissible on completion of 4 years of regular service in the cadre from the date of joining as AAO. The aforesaid Non-Functional Up-gradation (NFU) to AAQs is effective from 01.01.2016.
  • (ii) The NFU will be subject to vigilance clearance.
  • (iii) Benefits of Pay Fixation as per Rule 13 of CCS (Revised Pay) Rules 2016 shall be available at the time of grant of Non-Functional Up-gradation to AAQs.
  • (iv) After the grant of NFU to AAOs in Pay Level-9 and their Pay Fixation under Rule 13 of CCS (RP) Rules 2016, there will be no further pay fixation on promotion.
  • (v) NFU will be reckoned for financial up-gradation under MACP Scheme. Subsequent financial up-gradation under MACPs, if any, is to be reckoned from the date of grant of NFU.

2. To consider the grant of NFU, it is requested to furnish the details of all eligible AAOs who are completing 04 years in the grade pay of Rs. 4800/- up to 30.06.2021 on the under-mentioned Performa. The requisite details should reach this office through mail ID pedawcan3 .dad@hub.nic.in latest by 01.03.2021. It may also be ensured that no elected official is left out from your office/section.

Subject: Promotion and Posting Orders in the grade of Assistant Accounts Officers (AAO) of IP&TAFS Group 'B' consequent to declaration of Merit List of AAO LDCE 2018.

The approval of competent authority is hereby conveyed for regular promotion of the 949 (NINE HUNDRED FORTY NINE) officials whose names are mentioned in the Annexure A of this OM to the cadre of Assistant Accounts Officer of IP&TAFS Group B (Level 8 of 7th CPC -Rs 47,600-1,51000) subject to conditions mentioned herein and to post them to the offices mentioned in the table in Annexure A. The postings within the Postal/Telecom Circle will be made by the Head of the Postal Account Office/ Pr. CCA office respectively.

2. The promoted officials are hereby directed to join their office of posting as indicated against their names in Annexure A of this OM not later than 30 days of issue of this OM.

3. The officials who have been allocated to DoT HQ/IT Cell DoT HQ are to report to SEA Section of DoT HQ. The officials who have been allocated to DoP HQ are to report to PA Wing of DoP HQ.

4. In the event of an official not joining the place of posting within 30 days of issue of this OM, it shall be deemed as Refusal of Promotion and dealt with as per rules on the subject.

5. No representation for change of place of posting will be entertained and no representation(s) needs to be forwarded. The officers may be relieved immediately by the authorities concerned to report for duty on promotion at the place of their posting.

6. The promotion of officials against whoSe names 'Provisional - Graduation Not Confirmed' is mentioned in the Remarks column of the table in Annexure A to this OM is further subject to fulfilment of eligibility condition of having a Graduation degree from a recognised University as per Recruitment Rules of AAO dated 02.04.2018. In case any official fails to submit valid proof of having acquired Graduation Degree from a recognised University prior to the cut-off date i.e. 30.05.2018, within 30 days of issue of this OM; these promotion orders shall be considered null & void in respect of such officials. if the proof of Graduation qualification submitted by a promoted official is found to be invalid at a later date, then these promotion orders shall be considered null & void in respect of such officials and further departmental action shall be initiated against such officials as per rules.

7. These promotion orders are further subject to re-verification of eligibility of officials with respect to conditions mentioned in Recruitment Rules of AAOs as notified on 21111 April 2018. The Heads of Offices, where the promoted officials report for duty, are to re-verify the eligibility of officials within one month of their joining. In case any official is found to be ineligible, the case may be immediately reported to this office for further necessary action. Departmental action may be initiated against such officials as they have submitted a signed Declaration in the Application Form of AAO LDCE 2018, that they are eligible as per Recruitment Rules of AAOs as notified on 2nd April 2018.

8. In respect of Reserved Category candidates i.e. SC/ST candidates “Promotion of the candidates is provisional subject to verification of their caste status. Head of the Office will take an undertaking from the officers to this effect at the time of their relieving and ensure verification of caste status within one month. After verification necessary entries may invariably be made in the Service Books of the officers concerned in terms of instructions contained in DO P&T O.M. NO. 36011/16.80-Estt. (SCT) dated 27.02.81, No.42012/8/87- (SCT dated 14.10.87 and O.M. No 36012/36(22)/89-Estt. (SCT] dated 16.6.89.”

9. The promotion of the officer(s) as in para (1) above is subject to the condition that no disciplinary/vigilance case of the types referred to in the Department of Personnel and Training OM No. 22011/4/91-Estt. (A) dated 14.09.1992 is pending against them and such case, if any, be referred to the Directorate, and no promotion be made. Further, if in respect of any officer some punishment like stoppage of increment/reduction of pay etc. is current, he/she should not be promoted/relieved and his/her case should be reported to this office immediately.

10. No leave of any kind should be granted to the officials who are to be relieved under these

12. All promoted officials, except those promoted from Group B (i.e. Senior Accountants), will be on probation for a period of 2 years from date of their joining as Assistant Accounts

13. The pay of the promoted officers may be fixed as per provision of FR22 (I) (a) (1) and are eligible to exercise option for fixation of pay within the period prescribed therein.

14. The official(s) who are already officiating in AAO cadre on local officiating basis may be reverted to their substantive grade before promotion to the grade of AAO on regular basis.

15. These Promotion Orders are further subject to outcome of the Court cases as per Annexure B and also as per any other orders by any competent court in any other matter/matters connected with the subject.

16. These orders are subject to and without prejudice to any order of Court of Law.

 Restoration of pay fixation benefit of 3% on promotion from the post of SO(A) to AAO during the period 01.01.2006 to 29.08.2008 in view of Hon'ble CAT, Bangalore Judgement in OA No. 489/2011: CGDA Order to implement CAT order to all similarly placed persons:-

Sub: Restoration of pay fixation benefit on promotion from the post of SO(A) to AAO during the period 01.01.2006 to 29.08.2008.

Ref: This HQrs office circular bearing No. AN/XIV/14162NI CPC/Circular/Vol-IV, dated 04.09.2009.

Reference is invited to contents of circular cited under reference, wherein instruction was issued to discontinue the practice of allowing the benefits of pay fixation/allowances under RPR 2008 at the time of promotion from SO(A) to AAO in anticipation of clarification to be issued by Ministry of Finance (Department of Expenditure).

2. An OA No. 489/2011 was filed by Sh. S. Vijaya Kumar Naidu and 12 others before the Hon'ble CAT Bangalore Bench praying for restoration of pay fixation benefit of 3% allowed to the applicants on their promotion grade after 01.01.2006 and consequential benefits upon restoration of pay fixation benefit. The OA was allowed by the Hon'ble CAT and the order implemented by the Competent Authority in respect of the applicants only.

3. The issue was referred to DoP&T, Ministry of Law & Justice and Ministry of Finance for general implementation to all similarly placed persons. Having been approved by Ministries/DoP&T, the competent authority has decided to extend the benefit of Hon'ble CAT Bangalore Bench order dated 10.10.2012 in OA No. 489/2011 to all similarly placed persons, who were promoted to the post of Assistant Accounts Officer during the period from 01.01.2006 to 29.08.2008.

4. Hence, it is requested to restore the pay fixation benefit of 3% granted at the time of promotion to AAO grade from SO(A), which was withdrawn earlier. Necessary fixation may be carried out with all consequential benefits.

Action taken in this regard may be intimated to HQrs office.

Sub: Promotion of Asstt. Accounts Officers to Accounts Officer’s grade.

102 (One Hundred Two) AAOs as per enclosed Annexure-I, have been approved for promotion to the grade of Accounts Officer carrying Pay Band-2 Rs. 9300-34800 plus Grade Pay of Rs. 5400/- with immediate effect or from the assumption of charge whichever is later.

2. Before promoting the AAOs, it may please be ensured that none of the circumstances enumerated in para 2 of the DOP&T 0M No. 22011/4/91-Estt. (A) dated 14.09.1992 have arisen before promotion. If such circumstances have arisen the promotion shall not be released and instead considered as if, the case of the officer concerned has been placed in Sealed Cover by the Departmental Promotion Committee, in terms of para 7 of the said OM.

3. TA and joining time, is permissible under rules, as applicable in the case.

4. These AAOs may be relieved immediately but not later than 01-08-2013. The relief of the officer shall also not be deferred on the ground that a representation has been submitted for change of place of posting or on the ground that reliever has not reported/ been posted. It may be brought to the notice of the officer that no representation for change of posting etc will be entertained in any case as all efforts have been made to accommodate individuals at choice stations keeping in view the grounds mentioned in their respective representations to the extent possible. Controllers may also ensure that representations are not unduly forwarded.

5. After promoting the officer. Immovable Property Return (IPR) of the officer, as on date of promotion to the Accounts Officer’s grade, duly verified, may also be forwarded within 1 5 days from the date of reporting.

6. Par-11 Office Orders regarding relief / promotion of the officer may please be notified in the under mentioned format and copy endorsed to Admin-II Section of Hqrs office.
