Subject: Implementation of the recommendation of 7th CPC – Para 11.12.140 – Grant of Grade Pay of Rs. 5400 (PB 2) i.e. Level 9 of Pay Matrix in case of Assistant Accounts Officer of Defence Accounts Department of Ministry of Defence: Grant of Non-Functional Up-gradation (NFU).

The CGDA, Delhi Cantt office vide their letter no. AN/XIV/14162/7th CPC/ Vol-II dated 13.11.2020 has intimated that the revised pay scale of the post of Assistant Accounts Officer in Defence Accounts Department would be in Level-8 of Pay Matrix and Level-9 (7th CPC) on completion of 04 years in Grade Pay of Rs. 4800/-(PB-2) Level 8. This is a Non-Functional Up-gradation (NFU) which is subject to the following terms and conditions:-

  • (i) The grant of NFU will be admissible on completion of 4 years of regular service in the cadre from the date of joining as AAO. The aforesaid Non-Functional Up-gradation (NFU) to AAQs is effective from 01.01.2016.
  • (ii) The NFU will be subject to vigilance clearance.
  • (iii) Benefits of Pay Fixation as per Rule 13 of CCS (Revised Pay) Rules 2016 shall be available at the time of grant of Non-Functional Up-gradation to AAQs.
  • (iv) After the grant of NFU to AAOs in Pay Level-9 and their Pay Fixation under Rule 13 of CCS (RP) Rules 2016, there will be no further pay fixation on promotion.
  • (v) NFU will be reckoned for financial up-gradation under MACP Scheme. Subsequent financial up-gradation under MACPs, if any, is to be reckoned from the date of grant of NFU.

2. To consider the grant of NFU, it is requested to furnish the details of all eligible AAOs who are completing 04 years in the grade pay of Rs. 4800/- up to 30.06.2021 on the under-mentioned Performa. The requisite details should reach this office through mail ID pedawcan3 .dad@hub.nic.in latest by 01.03.2021. It may also be ensured that no elected official is left out from your office/section.

Pursuant to the issue of the Master Circular No. 7190 dated 22.10.1990, instructions have been amended and new orders issued on the policy regarding recruitment against Cultural/ Scouts and Guides Quota. Instructions issued from time to time on the above subject have now been consolidated below for the information and guidance of all concerned.

2. Recruitment against Scouts & Guides Quota in Level - 1 and Level - 2 of 7th CPC Pay Matrix.

(i) The annual quota for recruitment on Scouts and Guides has been fixed by this Ministry on the Zonal Railways and Production Units as below:

Note: Northern Railway will recruit additional 1 per year in Level -2 of 6th CPC Pay Matrix (6th CPC GP 1900) and 2 per year in Level-1 (6th CPC GP 1800) who will be posted in Research Designs & Standards Organisation (ROSO), not to be utilized elsewhere.

(ii) Recruitment should be done at the Zonal Administrative For this, each Zone should conduct the recruitment by clubbing the requirement/ quota fixed for all their respective divisions as well as Production Units (which are also districts under their respective zones), falling within their territorial jurisdiction. This should be done by way of open advertisement following the procedure laid down vide this Ministry’s letter No. E(NG)II/96/RR-1/62 dated 17.09.98.

(iii) The recruitment will be done only in Level -2 of 7th CPC Pay Matrix (6th CPC GP 1900/-) and Level -1 of 7th CPC of Pay Matrix (6th CPC GP 1800/-).

(iv) The educational qualification and age limit for consideration for appointment against the quota will be the same as applicable for direct recruitment to Level -2 & Level-1 Examination Fee may be charged @ Rs.500/- (Rupees Five Hundred) per candidate with the provision for refunding Rs.400/- to candidates actually appearing in the written examination. However, for candidates belonging to SC/ ST/ Ex-Serviceman/ Persons with Benchmark Disabilities (PwBDs), Women, Minorities and Economic Backward Classes Rs.250/- will be charged , with a provision for refunding the same to those who appear in the written examination.

(v) Power for Recruitment of Scouts and Guides quota shall lie with the General Application shall be called separately for Level-2 (6th CPC GP Rs.1900/-) and Level-1 (6th CPC GP 1800/-). The selection shall also be conducted separately . A candidate may apply both for Level-2 and Level-1.

(vi) The following qualification would apply for the recruitment of Scouts & Guides to posts in Level-2 and Level-1.
  • A President Scout/ Guide/ Rover/ Ranger Or Himalayan Wood Badge (HWB) holder in any section;
  • Should have been an active member of Scouts Organization for the last 5 years. The 'Certificate of Activeness' should be as per Annexure-1; and
  • Should have attended two events at National level OR All Indian Railways' level AND Two events at State
(vii) The candidate , who apply in response to the notification and are found eligible for consideration for appointment against Scout & Guides quota, should be assessed on the basis of following criteria :

The written test will consist of 40 objective quest ion (40 marks) & 1 essay type question (20 marks) relating to Scouts & Guides Organization and its activities and General knowledge for Level-2 and Level-1. The Syllabus for this will be as per Annexure-II.

(viii) For selection in Level-2, the recruitment committee shall consist of three Senior Administrative Grade (SAG) officers to b nominated by the General Manage For the selection in Level-1, the General Manager of Zonal Railways/ PUs may re-delegate the power for nomination of Junior Administrative Grade (JAG) Committee and acceptance of recommendation/ approval of panel for recruitment against Scouts & Guides Quota for the Post of Level-1 of 7th CPC Pay Matrix (erstwhile Group ‘D’ posts) to PCPO of Zonal Railways/ PUS. For selection in Level-1, the committee shall consist of three Junior Administrative Grade officers. One of them should be an officer holding honorary post of Commissioner in Scouting/ Guiding organization in the committee of a Zone/ Division/ unit other than the one conducting the recruitment. One of the three members should be necessarily be from the Personnel department.

(ix) A written declaration will be obtained from all the candidates who finally qualify for appointment as per Annexure-III. If the candidate violates any of the said declarations furnished by him/ her, he/ she should be taken up for D&AR by the concerned CPO/ Senior DPO on the recommendation of State Chief Commissioner/ District Chief Commissioner, as the case may

(x) Higher fixation of pay will not be admissible to a person appointed against Scouts & Guides Quota

(xi) The persons appointed against Scouts & Guides quota to the category of Clerks will be required to possess proficiency in typing within a period of two years from the date of their appointment, and their appointment will be provisional subject to the prescribed typing qualification within the stipulated In case of non­ acquisition of typing skills within the prescribed period, no additional time will be given and services of such candidate will be summarily terminated.

(xii) The Candidates selected for appointment under the Scout & Guide quota should be posted by the competent authority in consultation with the concerned State Chief Commissioner/ District Chief

(xiii) It may be noted that instead of notifying the posts against this quota as unreserved (UR), this should be mentioned as open to all candidates and candidates belonging to SC/ ST/ OBC Categories who apply against notification published for this quota be extended relaxation in age limit as admissible in a general open market recruitment. However, in case of being selected with any relaxation on account of being a candidate from the above categories, he/she will be taken against reserved roster point.

(xiv) The field units are directed that they should finalize and fill up the posts against this quota during the respective financial year without fail.

3. Recruitment against Cultural Quota posts in Level-2 and Level-1 of 7th CPC Pay Matrix.

(i) The annual quota for recruitment on Cultural quota has been fixed by this Ministry on the Zonal Railways

(ii) Recruitment should be done by the Railway Administration themselves

(iii) The recruitment against the quota should be done by open advertisement, following the procedure laid down in this Ministry's letter N E(NG)II 96/ RR-1/62 dated 17.09.98.

(iv) The educational qualifications for consideration for appointment against the quota will be the same as applicable for recruitment to 'Level 2' categories .

(v) The recruitment will be done only in the Level 2 of 7th CPC Pay Matrix.

(vi) Age limit as applicable for recruitment to other equivalent categories shall be follow

(vii) The following qualifications would apply for recruitment to level-2 posts against Cultural

Essentials:
  • Educational Qualification: The minimum qualification prescribed for Level 2
  • Possession of degree/ diploma/ certificate in Music/dance/drama etc. from Recognized institute
Desirable:
  • Experience in the field and performance given on AIR (Air India Radio) / Doordarshan
  • Prizes won at National
(viii) The candidates who apply in response to notification issued and are found eligible for consideration for appointment against Cultural Quota should be assessed on the following basis.


(A)Written Test50 Marks

Note: The Written test will consist of Objective Type Questions.
(B)Assessment of Talent in the relevant field on

(i) The basis of practical demonstration35 Marks

(ii) Testimonials/Prizes etc.15 Marks

(ix) The Recruitment Committee shall consist of three members to be nominated by the General Manger; which will include one SAG officer from personnel department , second SAG officer from any other department and an outside member of appropriate standing in the relevant field or a faculty member of any recognised University/Cultural Institution or a representative from Doordarshan/AIR (All India Radio) etc as the third

(x) Higher Fixation of pay will not be admissible to persons appointed against Cultural Quota.

(xi) The persons appointed against Cultural quota to all the categorises of Clerks will be required to possess proficiency in Typing within a period of two years from the date of appointment and their appointment will be provisional subject to acquiring the prescribed typing qualification within the stipulated (Board’s letter No. E(NG)II/98/RR -2/7 dated. 03.03 .1999).

4. This Ministry have no objection for the recruitment of more Scouts & Guides, if suitable person are available, within the overall ceiling limit for cultural-cum-Scouts and Guides Quota referred in para 2 above.

5. General :

(a) While referring to this Circular, the original letters referred to herein should be read for a proper This circular is only a consolidation of the instructions issued so far and should not be treated as a substitution to the originals. In case of doubt, the original circular should be relied upon as authority.

(b) The instructions contained in the original circulars referred to shall have only prospective effect from the date of issue unless specifically indicated otherwise in the concerned circular. For Dealing with old cases, the instructions in force at the relevant time should be referred to; and

(c) if any circular on the subject, which has not been superseded, has not been taken into consideration while preparing this consolidated letter, the said circular, which has been missed through oversight should be treated as valid and Such a missing circular, if any, may be brought to the notice of the Railway Board.

Clarification by Ministry of Railways regarding Recruitment of Divyangjans on Gr-D/Level-1 Vacancies

There is recent and continuing sit-in by Disabled persons (‘Divyangjan’) at Mandi House in Delhi regarding some issues for Level-1 jobs in the Railways for Divyangajans. At the outset, on this sensitive matter, it is categorically stated that insofar as Divyangjan candidates are concerned, Railways have ensured that notification of the required number of reserved vacancies, conduct of the entire recruitment exercise, and filled up of posts meant for Divyangjan have been not only transparent and fair, but also in accordance with statutory provisions and the law of the land in this regard. Nevertheless, necessary details with regard to the whole issue are brought out below.

Background

·        A centralized notification (CEN 02/18) for around 63000 Level-1 vacancies for all Railway zones across Indian Railways was issued in Feb’18 by Railway Recruitment Boards.

·        This notification had initially 729 vacancies for Disabled in 3 Categories- Orthopaedic, Visual, and Hearing Disabled. The major chunk of vacancies was notified for Orthopaedically Disabled, based on job & suitability requirements of the posts advertised. Candidates could apply to be considered for vacancies of one of the 16 Railway zones of their choice.

·        An organization of visually impaired persons filed a PIL in Hon’ble Delhi High Court in Feb’18. In the meantime, the revised Disabilities Act, 2016 had been enacted by then and notified by the Department of Personnel & Training of the Govt. of India in Jan 2018. In terms of this Act, the total vacancies to be reserved for Persons with Benchmark Disabilities (PwBD) was revised upwards to 4%, with prescribed bifurcation among Disability categories.

·         In compliance of Court hearings and directions in the case, the provisions of this revised Disabilities Act was made applicable to the CEN 02/2018 recruitment exercise as well. This meant that 4% vacancies had to be kept reserved for Disabled candidates. As specified in the Act, this was to be distributed equally as 1% each among 4 Disability Categories – Locomotor Disability (LD) that was earlier called Orthopaedic; Visually Impaired (VI), Hearing Impaired (HI), and an added Disability category of Multi-Disability (MD). MD would include candidates suffering from more than one Disability among the other three, as defined by medical benchmark standards.

·        Accordingly, total Vacancies reserved for Disabled candidates (Divyangjan) were revised upwards by Railways from 729 to over 2400 with around 600 for each of the 4 Disability categories of LD, VI, HI and MD.

·        In the meantime, a window of one month was provided on February 28, 2018 for candidates to apply because of the applicability of the revised Disability Act.

·        There were total about 1.87 crore applicants. Written Exams (Computer-based 100% objective in 15 languages) were conducted in the latter part of 2018. Around 1,55,000 (1.55 lakhs) Disabled candidates took the exam for the around 2400 posts notified as reserved for such candidates. All prescribed facilities such as scribes, extra time, careful seating arrangements etc. were arranged for Disabled candidates. Minimum qualifying/cut-off threshold scores that were 40 for General candidates and 30 for SC/ST/OBC candidates were relaxed by 2 marks to 38 and 28 respectively for Disabled candidates. Around 34000 Disabled candidates scored above this threshold qualifying limit. Based on number of vacancies and their merit position in the particular Disability category in that Railway, commensurate number of qualified candidates were called for Document Verification and medical examination, prior to being offered appointment. Against those who are either absent or have not cleared verification of Documents and meeting the medical standards as per their Disability, candidates next in line as per merit have been called. So far, around 1025 Disabled candidates have already been selected for appointment. As authenticity of certificates and determining of medical status is taking additional time in the case of some Disabled candidates, this number of 1025 will go up in the coming weeks.

Sequence of Events

·        Last month, some protesters under a banner “Toshiyas” did a sit-in in Delhi for 3 days from Oct 23-Oct 25, 2019. Apart from generic grievances regarding Government policy of reservation for Disabled categories and how this should be implemented in recruitments, they had also alleged irregularities in individual cases due to which they were aggrieved that meritorious Disabled candidates had not been selected.

·        A detailed three-way discussion with the protesters, senior Railway officers and senior officers of the Ministry of Social Justice was chaired by Secretary, M/o Social Justice on 24 Oct 2019.

·        On 25th October, the Court of Chief Commissioners of Persons with Disabilities (CCPD) heard the Petitioners and took their submissions on record. The Railways’ position and point-wise clarifications were also taken on record, following which the Court passed orders the same evening. These orders directed display of cut-offs for each Disability category not only on the respective Railway Recruitment cell websites of each Railway zone, but also on the Railway Board website. Directions to Railway zones to expedite the process, ensuring that no non-Divyangjan was appointed to a Divyangjan-reserved post, and careful consideration of any list of individual candidates’ grievances to be furnished by the Petitioner were also given.

·        The directions above were complied by Railways and compliance report also sent to the Court (CCPD), with a copy to the Petitioner.

·        After a specific request by Railway Board’s office, the Petitioner in the case at CCPD furnished a list of around 184 candidates across 10 Railway zones, who, it was claimed, had not been selected even though they had qualified as per merit.

·        The list was carefully examined by Railways Administration and it was found that around 21 of the 184 had not secured the relaxed threshold cut-off/ qualifying score of 38 (for UR) or 28 (for SC/ST/OBC). The around 163 others had crossed this minimum threshold but were far short in terms of merit score when compared to the last such candidate selected  in that Disability category by that Railway zone. This detailed position in respect of the entire list submitted by him was sent to the Petitioner.

·        On Ministry of Railways’ own initiative, a further detailed follow-up meeting with the main Petitioner and several of the original protesters was again held at Patna on 23rd November 2019 with senior officers of the Board to collect any residual grievances.

·        Again some protesters under a fresh banner have suddenly gone on a sit-in since 26th November. These protesters were part of the earlier group, but have now reportedly splintered/broken away and have sat on this dharna.

·        Two more attempts at resolving the matter through discussions with senior Railway officers have failed first at Rail Bhawan on 26th Nov evening, and the second at the protest site on 27th evening, as the protesters are sticking to their demand of being given jobs in Railways irrespective of their merit position, Disability category, and vacancies notified in the Railway zone they have chosen.

Railways’ position on issues raised by the Protesters

The demands pertaining to Level-1 recruitment cover 5 broad aspects as under:

5 Preference for appointment to those who have come to Delhi for the agitation Not permissible, as merit in the category alone can determine filling up of vacancies in any Railway zone

Any large competitive examination has to be conducted as per merit and as per statutory provisions. In a situation where around 2400 vacancies are reserved for Divyangjan and there are 1.55 lakh Divyangjan applicants, it is clear that the end of the recruitment exercise will unfortunately result in around 1.53 lakh Divyangjan not making the cut. As long as those selected are strictly as per merit for that Disability category and that Railway zone, the process should be accepted by all stakeholders. The point about whether the present 1% distribution of vacant posts across the 4 Disability categories is equitable considering the relative populations/number of applicants in each Disability is a larger policy issue involving other Ministries of the Government of India and other expert bodies. Railways cannot act unilaterally in the matter. As things stand, the Railways are bound to follow statutory provisions as notified. Any specific irregularities/grievances, if pointed out, will be promptly examined and corrective action, if necessitated, taken. This has been repeatedly emphasized to the protesters. The Railways continues to remain committed to the cause of Divyangjans.

It is also relevant to mention that another group of Disabled persons under a different NGO has already gone to Hon’ble Delhi High Court raising similar issues as these protesters. Matter is sub judice there. Indian Railways will respect the judicial verdict in the matter, as and when it is delivered.

As the Zonal Railways am aware, pay of medically unfit Railway servants while absorbing them in alternative post is presently fixed as per instructions contained in Board's letter No.E(NG)I-2008/RE-3/4 dated 30.04.2013. These provisions provides that while determining pay in Pay Band for the purpose of fixation of pay of medically unfit running staff in alternative (stationary) post, an amount equal to such percentage of basic pay (pay in Pay Band + Grade Pay) representing pay element of running allowance as may be in force from time to time may be added to the existing pay in Pay Band and the resultant figure (ignoring the fraction of rupee, if any) rounded off to the next multiple of 10, would be the pay in the Pay Band in the alternative post with no change in the Grade Pay of substantive post, in suitable alternative post.

2. The above issue of pay fixation of medically disabled / unfit running staff on such circumstances in pursuance of the 7th CPC regime has been under consideration of Board. It is pointed out that upto and including the 5th CPC pay regime, the pay scales had fixed stages and method of pay fixation of such running staff was governed in terms of para Nos. 1307 and 1308 of Board’s letter No.E(NG)I-96/RE-3/9(2) dated 29.04.1999. With the restoration of fixed and defined pay intervals in the form of distinct cells within each pay level in the 7th CPC pay matrix, it is clarified that the principles of pay fixation enunciated in Board’s letter ibid which will now hold good. This means that while fixing the pay of a medically decategorised running staff in an alternative stationary post if the resultant pay (after 30% addition) does not correspond to any cell, in the same pay level, then the pay will be fixed in the next - below cell of the same pay level and difference in pay will be protected as personal pay which will be adjusted in future increment (s).

3. It may also be noted that pay fixation as per para - 2 above will not apply for medical de-categorisation cases of 6th CPC regime, covered under Board’s letter dated 30.04.2013 referred to at para 01 above.

Subject: Grant of Dearness Allowance to Central Government employees- Revised Rates effective from 1.7.2019.

The undersigned is directed to refer to this Ministry's Office Memorandum No, 1.11/2019-E II (B) dated 27th February, 2019 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 12% to 17% of the basic pay with effect from 1st July, 2019.

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of ( Railways, respectively.

6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

The references have been received in this office seeking clarification whether the AAOs who have been granted NFU in the Pay Level 9 in terms of this office O.M. No, A-60015/1/2018/ MF, CGA(A)/ NGE/7th CPC/238 dated 4th July, 2018, are eligible for benefit of fixation of pay on promotion as Accounts Officer, The matter was taken up with the Department of Expenditure, Ministry of Finance accordingly.

The Department of Expenditure vide, I.D. No, 02-01/2018-E,IIIA dated 09.09.2019 has viewed that the benefit of fixation of pay under Rule 13 at CCS (Revised Pay) Rules 2016, if availed at the time of NFU, the same should be offset at the time of promotion in the same level in order to avoid double fixation benefits. As such the AAOs (CCAS) who have been granted NFU in Pay Level 9 and availed benefit of fixation of pay under Rule 13 of the CCS (RP) Rules 2016, are not eligible for grant of same benefit on promotion as Account Officer in the same Level i.e. Pay Level 9.

All respective accounting units of Ministries/ Departments concerned are advised to revival such cases in the light of clarification as mentioned in Para 2 above.

Federation feels disappointed that despite the above subject was listed in the PNM Agenda two years ago, there has been no decision from Railway Board till date.

Vide NFIR's letter of even no. dated 09/04/2019, merits of the case have been adequately explained besides extract of Item No. 31 of Railway Board's letter PC-V/99/1/1/1 dated 19/02/2002 has also been furnished. In terms of item No. 31 of Board's letter dated 19/02/2002, the Station Masters are entitled for 3rd financial upgradation under MACPS in GP 5400/ Level-9 (7th CPC). In this connection, Railway Board's letter No. PC- V/2019/ CC/7/WCR dated 05/04/2019 addressed to General Manager (P), W.C. Railway, Jabalpur allowing 3rd financial upgradation in terms of Board's letter dated 19th February,2002 (para 1.4) may be connected. It is however unfortunate that although the case of Station Master category gets covered by Railway Board's letter dated 19th February, 2002 for the purpose of entitlement of 3rd financial upgradation (GP 5400/Level-9) under MACPS, the Railway Board have not responded to Federation's PNM Item No. 15/2017 even after lapse of two years.

Attention is also invited to 7th CPC recommendation contained in para 11.40.55 of the report, relevant extract of which is placed below:-

"Keeping in mind the identical educational qualifications required for the posts of ASM and SM, with practically no difference in the functions performed by .them, and the historical importance of the post, it is recommended that the ASMs in GP 2800 should first be upgraded to GP 4200 and then fitted in the revised Pay Matrix. The cadre will then have 60 percent posts in Level 60 and 40 percent in Level 7. The designation of ASM may be abolished".

Federation once again urges upon the Railway Board to expedite action and decision, granting 3rd financial upgradation under MACPS to Station Master category in GP 5400/ Level-9.

Sub: Engagement of a consultant in the Department of Pension & Pensioners Welfare
The Department of Pension & Pensioners' Welfare intends to engage a consultant to assist the Department for undertaking comprehensive review/revision of CCS (Pension) Rules and orders issued by the Government on the subject of pensionary benefits and other important issues requiring immediate attention. The revision and review of the rules etc. is being undertaken by the Department in compliance with recommendation of the Hon'ble Supreme Court in the matter of UoI Vs. R. Sethumadhavan and Other. In addition, the Department may also assign the consultant any other work related to this Department.

Accordingly, applications are invited from retired Central Government Employees having been retired from the post of Deputy Secretary/ Director or equivalent i.e., to say from any-post carrying the following Pay Band / Pay Matrix:

i. Rs.15600 - 39100 + 7600 Grade Pay;. or
ii. Rs.37400 - 67000 + 8700 Grade Pay; or
iii. Pay Matrix 12 or 13 under 7th CPC


MANDATORY SERVICE EXPERIENCE
The applicant should have a minimum of 3 years experience in dealing with
pension cases and pension related court cases of Central Government Employees.

Age
Age should not be more than 65 years on the date of advertisement.

REMUNERATION
On selection, the consultant will be paid consolidated remuneration equivalent to his last pay drawn minus pension. He will also be paid Dearness Allowance on the 'remuneration amount' at the rates applicable for Central Government Employees on the date of engagement. No other allowance such as HRA / Transport Allowance etc. will be payable to the consultant.
The consultant may be required to undertake outstation visits also for which he will be paid Travelling Allowance/ hotel/ guest-house reimbursement as per rules applicable to equivalent scales.

DURATION OF ENGAGEMENT
The duration of engagement will be one year from the date of initial engagement which period may be curtailed or extended at the sole discretion of the Department and the same will be binding on the consultant.

The appointment of consultants would be on full-time basis and he will not be permitted to take up any other assignrnent during the period of Consultancy with the DoP&PW.

The appointment of consultant is of a temporary (non - official) nature and the appointment can be cancelled at any time by the Department without assigning any reason.

Kind attention of Railway Board is invited to Federation's PNM Agenda Item No. 15/2017, proposing grant of 3rd financial upgradation under MACP Scheme to the Station Masters entered in GP 2800 which got merged with GP 4200 / Level-6 w.e.f. 01/01/2016 vide Railway Board's instructions dated 02/08/2016 (RBE No. 93/2016), pursuant to acceptance of 7th CPC recommendation. Federation is however disappointed that the Railway Board has not yet considered for granting GP 5400 / Level-9 as financial upgradation to those Station Masters who have completed 30 years of service.

Federation has however learnt that the Railway Board vide letter No. PC-V/2009/ACP/5/CR dated 11/12/2017 has issued a clarification to the General Manager (P), Central Railway stating that the upgradation of ASM in GP 2800 to the post of SM in GP 4200 has to be counted as promotion for the
purpose of MACPS and therefore the GP 4200 (now Pay Level-6) cannot be treated as entry Grade. This clarification of the Railway Board is totally unjustified due to the fact that the said decision violates policy instructions as mentioned below:-
  • The Railway Board have cited Item No. 31 of Board's letter No. PC-V/99/I/1/1 dated,19/02/2002 to deny the benefit. The Federation on going through the contents of Item No. 31 of Board's letter dated, 19/02/2002 found following provision.
"Where all the posts are placed in a higher scale of pay, with or without a change in the designation; without requirement of any new qualification for holding the post in the higher grade, not specified in the Recruitment Rules for the existing post, and without involving any change in responsibilities and duties, then placement of all the incumbents against such upgraded posts is not be treated as promotion/upgradation".
Since the upgradation of ASMs GP 2800 to GP 4200 as SM has been done as a result of acceptance of 7th CPC recommendation by the Government with slight change in the designation but without change in the qualification and any change in responsibilities and duties, therefore, the placement of all such incumbents against the upgraded posts cannot be treated as promotion / upgradation.
  • Federation fur1her desires to clarify that the later part of the conditions mentioned against Item No.31 are not at all relevant to the case of Station Master category.
  • Further in Board's letter dated 02/08/2016 (93/2016), it has clearly been mentioned vide Item No. 2.1 of Annexure 'B' that in the case of ASMs GP 2800, their Grade Pay has to be revised to Gp 4200, therefore they are to be fitted in Pay Level-6 of 7th CPC. Note at Item No. 2 clearly states that ASMs in GP 2800 should be upgraded to 4200 and then fitted in the revised pay Matrix and the designation of ASM shall stand abolished and the post of ASMs shall stand merged with the post of Station Master (GP 4200) along with functions. However, the Note further states that the revised AVC, inter-se-seniority, recruitment rules, classification as decided by the Board, will be issued through separate letters. There are no instructions to treat such upgradation as promotion particularly for those ASMs who have been recruited in GP 2800/-.
  • Federation also brings to the notice of Railway Board the condition no. 5 mentioned in Annexure to Board's letter dated 10/06/2009 (RBE No. 101/2009) which stipulates as under:-
"Promotions earned/upgradations granted under the ACP Scheme in the past to those grades which now carry the same Grade Pay due to merger of pay scales/upgradations of posts by the 6th Pay Commission shall be ignored for the purpose of granting upgradation under MACPS".

Federation further states that based on the above positions, Railway Board have issued clarification vide letter dated 10/06/2009 (RBE No. 17/2009), that on the analogy of Para 5 of the Annexure to Board's letter dated 10/06/2009, that promotions earned or upgradations granted under ACP Scheme of 01/01/1999 in the past to the four pay scales mentioned above, which now carry the Grade Pay of Rs.1800 shall be ignored for the purpose of MACPS.
Federation requests the Railway Board to kindly review the case denovo, taking into account the points raised above as also the PNM Agenda Item No. 15/2017 and grant 3rd MACP to the Station Masters in GP 5400/ Pay Level-9 on completion of 30 years service. The subject will be discussed in the ensuing PNM meeting with the Railway Board on 25th/26th April. 2019.

I am directed to refer to the Government's decision regarding provisions regulating pension including the revision of pension/ family pension of Pre-01.01.2016 retired employees of the Indian Council of Philosophical Research (ICPR), New Delhi on the recommendations of 7th Central pay Commission issued vide Department of Pension and Pensioner's Welfare O.M. No. 38/37/2016-P&PW(A) dated 04.08.2016, 12.05.2017, 06.07.2017, 18.07.2017 and 13.09.2017.

2. The DoP&PW (as per aforesaid OMs) has provided for following manner of revision of pension/ family pension:

As per 2nd formulation (recommended by 7th CPC), vide' para - 4.1 of O.M. dated 04.08.2016, as follows:

For existing pensioners, who have retired before 01.01.2016 the revised pension/ family pension with effect from 01.01.2016 shall be determined by multiplying the exisiting pension/ family pension, as had been fixed at the time of implementation of 6th Central pay Commission (CPC)  recommendations, by 2.57. The amount of revised pension/ family pension so arrived at shall be rounded off to next higher rupee.

As per 1st formulation (recommended by 7th CPC), vide para - 4 of O.M. dated 12.05.2017, as follows:

The pension/ family pension w.e.f. 01.01.2016 may be revised by notionally fixing the pay of pensioners in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/ pay band and grade pay at which pensioners retired/ died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay. While fixing pay on notional basis, the pay fixation formulae approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. 50% of the notional pay as on 01.01.2016 shall be the revised pension and 30% of this notional pay shall be the revised family pension w.e.f. 01.01.2016 as per the first Formulation. In the case of family pensioners who were entitled to family pension at enhanced rate, the revised family pension shall be 50% of the notional pay as on 01.01.2016 and shall be payable till the period up to which family pension at enhanced rate is admissible as per rules. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

3. The DoP&PW's above mentioned OM dated 12.05.2017 vide para-5, further maintains that higher of the two Formulations i.e. the pension/family pension already revised in accordance with this Department's OM No.38/37/2016-P&PW(A) (ii) dated 04.08.2016 or the revised pension/family pension as worked out in accordance with para 4 of OM dated 12.05.2017, shall be granted to pre-01.01.2016 pensioners as revised pension/family pension w.e.f. 01.01.2016. In cases where pension/family pension being paid w.e.f. 01.01.2016 in accordance with this Department's OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016 happens to be more than pension/family pension as worked out in accordance with para 4 of OM dated 12.05.2017, the pension/family pension already being paid shall be treated as revised pension/family pension w.e.f. 01.01.2016.

4. Accordingly, the Indian Council of Philosophical Research (ICPR), New Delhi may workout the pension/ family pension of its pre-01.01.2016 pensioners/ family pensioners as per the formulations discussed above read with other principles enunciated in Department of Pension and Pensioner's Welfare's O.M. No. 38/37/2016-P&PW(A) dated 12.05.2017 and 06.07.2017 and subsequent OMs dated 18.07.2017 & 13.09.2017.

5. In the case of those employees who retired/died before 01.01.1986, the pension may be worked out on lines with these concordance tables given in Department of Pension and Pensioner's Welfare OM No. 38/37/2016-P&PW(A) dated 06.07.2017 based on their notional pay as on 01.01.1986, which was fixed in accordance with this Department's OM No. 45/86/97-P&PW(D)(iii) dated 10.02.1998.

6. The revision of pension and pensionary benefits such as gratuity etc. to those pensioners who retired on or after 01.01.2016 shall be done as per Department of Pension and Pensioner's Welfare O.M. No. 38/37/2016-P&PW(A) (i) dated 04.08.2016. The revision of pension and pensionary benefits such as gratuity etc. are to be made applicable to only those who are already covered with the schemes which are in accordance with the similar schemes for Central Government employees.

7. This order is applicable in only those cases where such pension schemes have already been adopted with prior approval of Government of India/ Ministry of Human Resource Development (MHRD) and the benefits was applicable as per Sixth CPC.

8. In case the Council has fixed the pension in a manner different from the above formulations, the same may have to be reworked by the Council and necessary adjustment be made.

9. Any excess payment made on account of incorrect fixation of pension or any other excess payment made shall be adjusted/ recovered against the future payments due or otherwise to the beneficiary.

10. The Indian Council of Philosophical Research (ICPR), New Delhi is hereby advised to review its user charges for increase in its internal revenue generation to take up a part of the pensionary burden.

11. This issues with the approval of the Integrated Finance Division vide its note Diary No. 1025 dated 26.03.2019.

The Railway Board has decided to revise the subscription rates of Railway Employees Liberalized Health Scheme (RELHS) as per the Pay Matrix Level recommended by the 7th Pay Commission.
Following the subscription calculation method of CGHS for Central Government Employees and Pensioners, the Railway Board has now decided and published the revised subscription rates for all the group of Railway employees through its official portal.

On 9th January, 2017 the Health Ministry published the new rates of monthly subscription for availing the CGHS facility. The Central Government Pensioners have an option to get their CGHS Pensioners Card by either making CGHS contribution on an annual basis (12 Months) or by making contribution for 10 years for life time validity.

The rate of contribution to join RELHS shall be last month’s basic pay drawn or the subscription rate indicated in the above table at different levels as per the 7th Pay Commission whichever is lower.

The revised rate of subscription as above shall be applicable to those railway employees who shall be retiring and joining RELHS on or after the date of issue of this letter (23.2.2017). Those who have already retired and are not member of RELHS shall be governed by the rules which were prevalent at the time of their retirement.

Subject: Pay fixation of SCS/Non-SCS officers promoted to IAS subsequent to the implementation of 7th CPC recommendations-reg.

Sir/Madam.
In supersession of this Department's letter of even number dated the 7th April, 2017 on the above mentioned subject, I am directed to say that the initial pay of a promoted officer or an officer appointed by selection as the case may be shall be fixed at the stage of the senior scale next above his actual pay. There is no provision of increment at the stage of initial fixation.

Rule 5(6) of lAS (Pay) Rules, 2016 provides for the fixation of pay of a Member of Service on promotion to Selection Grade (Level-13) of Pay Matrix by adding one increment in the Level- 12 of Pay Matrix and two additional increments in the Level 13 to which he is promoted. Rule 5(5) of lAS (Pay) Rules, 2016 provides that the pay of a member of the Service in the Senior Time Scale shall, on promotion to the Junior Administrative Grade he fixed in Level 12 of the Pay Matrix.

in respect of fixation of pay of officers who were promoted/Selected in lAS through SCS/Non-SCS respectively in Senior Time Scale/Junior Administrative Grade after 01.01.2016, the initial pay shall be fixed in the respective level of the Senior Scale i.e Level 11,12 01. 13 based on the year of allotment in the lAS. However, the pay drawn in the State Civil Services will be protected in the concerned Level. An illustration is as under:

Shri X who is drawing pay at Rs. 48920 (Rs.40220 [pay in the pay band + GP Rs.8700] is promoted/selected to lAS on 04.03.2016. lie is allotted 2010 batch. The pay on promotion/selection to lAS would be as under:

The pay of IAS officers who were promoted/selected in IAS through SCS/Non-SCS respectively prior to 01.01.2016 will be converted as per 7th CPC on 01.01.2016 and they shall notionally in the Level of Pay Matrix, in accordance with the length of service as per their allotment year, at the stage of the senior scale. On their actual promotion to JAG/Selection Grade, the pay of these officers will then be fixed as per IAS (Pay) Rules, 2016. That is, the officers will be eligible for two additional increments on their actual promotions to Level 12/ Level 13 after completion of 9/13 years of service in IAS respectively. Sir,
The undersigned Is directed to convey that instructions were Issued for revision of pension/family pension with effect from 1.1.2016 in respect of Armed Force pensioners/ family pensioners who retired/ died prior to 1.1.2016 vide this Ministry's letter No. 17(01)/2017(02)/ D(Pension/Policy) dated 5.9.2017. As per the same, revision of pension for pre-2016 Armed Force pensioners/ family pensioners under first formulation, was to be done by notionally fixing their pay in the pay
matrix recommended by the 7th Central Pay Commission in the level corresponding to the pay in the pay scale/ pay band and grade pay at which they retired/died. The notional pay fixation In 7th CPC pay matrix has to be arrived by fixing pay under each Intervening Pay Commission based on the formula for revision of pay. The revised rates of Military Service Pay, Non Practising Allowance, where applicable, and 'X' Group pay & Classification Allowance for JCO/ORs, If applicable, notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emolument as on 1.1.2016 for determining the revised pension/family pension in terms of para 5 of this Ministry's letter dated 5.9.2017.

2. Based on past Instructions on fixation of pay in various pay commissions, concordance tables for fixation of notional pay for Armed Force personnel who retired/died in various ranks during the 4th, 5th and 6th Pay Commission periods (including 3rd Pay Commission for Sailors only) have been prepared and the same are enclosed herewith. In the case of commissioned officers who retired/ died in harness before 1.1.1986, these concordance tables may be used based on their notional pay as on 1.1.1986, which was fixed in accordance with this Ministry's letter No 1(3)/98fD(Pen/Policy) dated 27.5.1998. Concordance tables for JCO/ORs who discharged/ died in service prior to 1,1.1986 (prior to 1.1.1973 for Sailors), are under preparation and shall be Issued separately.

3. These concordance tables have been prepared to facilitate fixation of notional pay of pre-2016 pensioners/ family pensioners by the concerned Record Offices and attached Pay Account Offices In case of JCO/ORs of the three Services and PCDA(O) Pune/ Naval Pay Office. Mumbai/ AFCAO New Delhi in case of commissioned officers of Army / Navy / Air Force respectively. Due care has been taken to prepare these concordance tables based on the fitment tables for fixation of pay from 3rd to 4th (only for Sailors), 4th to 5th, 5th to 6th and 6th to 7th Pay Commission. in case of any inconsistency in the concordance tables vis-a-vis the relevant rules / instructions, the notional pay and pension / family pension of pre-2016 pensioners / family pensioners may be fixed in accordance with the rules / instructions applicable for fixation of pay in the intervening Pay Commission periods.

4. The pension / family pension of pre-2016 Armed Forces pensioners / family pensioners may be revised using the appropriate concordance table in accordance with the Instructions contained in this Ministry's above quoted letter dated 5.9.2017.

5. This issues with concurrence of Ministry of Defence (Finance/Pension) vide their UO No. Part.file 1 to 30(0l)/2016/Fin/Pen dated 27.09.2018.

With reference to our earlier memorandum and our meeting with you on 04.07.2018, we submit this memorandum for the kind consideration of the Committee for revision of hourly rates of Incentive Bonus on estimated additional expenditure on account of revision of incentive rates based on minimum pay of respective Pay Level in 7th CPC Pay Matrix divided by 208 (standard working hours per month) - as per formula followed after 5th Pay Commissions.

Proposed revision of Incentive Rates is estimated to cost additionally only 1.28 percent in terms of cost of man power.

There are 2,38,546 workshop Group 'C' & 'D' staff (2,19,682 Group 'C' & 18,864 in Group 'D') of Mechanical, Electrical and S&T covered under incentive scheme as on 03.2017. (Strength of workshop artisan & helper as on 31.03.2017 is given in Table-1)
Average annual wage per employee for Group 'C' in Workshop staff including pay, all allowances, PLB, pension & gratuity (Senior Technician, Supervisor (Ministry), Technician Grade-I, II & Ill) is Rs. 7,09,494. (Ref. Statement 40 (II) (b) of Indian Railways Annual Statistical Statement 2016-17)
Average annual wage per employee for Group 'D' Workshop staff including pay, all allowances, PLB, pension & gratuity (semi-skilled & unskilled) is Rs. 5,66,147. (Ref. Statement 40 (II) (e) of Indian Railways Annual Statistical Statement 2016-17)
If incentive rates are revised based on minimum of respective Pay Level divided by 208, additional expenditure is estimated to be Rs.214.09 crore.
In terms of equivalent man power it will be 3,061 Group 'C' & 'D' workshop staff (2,847 men in Group 'C' and 213 in group 'D').
This will be only 1.28% of 2,19,682 strength of Group 'C'&'D' workshop staff available in Indian Railways as on 31.03.2017. Details of the calculation is attached in Table-2.

It is therefore requested that, no reduction in allowed time / man power may please be proposed for implementation of revised incentive rates, since the estimated additional cost equal to only 1.28% man power which will be compensated by additional work load due to the addition of rolling stocks & new trains.

Sub: Grant of two additional increments at revised rates to Nursing Personnel pursuant of revision of pay (7th CPC)-reg.

Ref: (i) NFIR's PNM Item No. 11/2008.
(ii) Railway Board's letter No. PC-VI/2010/I/7/5/1 dated 14/03/2012.

The Railway Board vide letter dated 14/03/2012 had issued instructions to the Zonal Railways etc to grant two additional increments to the Nursing Staff possessing B.Sc. Degree as additional qualification in terms of para 160(2) (iii) of IREM Vol-I,1989 Edition, on the basis of pay drawn in 6th CPC Pay Band. These instructions were issued as a result of demand raised by NFIR vide PNM Item No. 11/2008.

Federation has since received representations from the Nursing staff of some Zonal Railways that the payment of two additional increments, based on the revised rates of 7th CPC is not yet ensured w.e.f. 01/01/2016, (the date of implementation of 7th CPC pay matrix) and payment continued at the old rates of 6th CPC Pay Band. The non-revision of additional increments rate has been causing hardships to the staff and grievances continued from Nursing Personnel.

NFIR, therefore, requests the Railway Board to kindly issue suitable clarification to all Zonal Railways/Production Units to grant two additional increments (3% each on 7th CPC Pay) from 01-01-2016 to the Nursing Personnel. A copy of instructions issued may please be endorsed to Federation.
