 Restoration of pay fixation benefit of 3% on promotion from the post of SO(A) to AAO during the period 01.01.2006 to 29.08.2008 in view of Hon'ble CAT, Bangalore Judgement in OA No. 489/2011: CGDA Order to implement CAT order to all similarly placed persons:-

Sub: Restoration of pay fixation benefit on promotion from the post of SO(A) to AAO during the period 01.01.2006 to 29.08.2008.

Ref: This HQrs office circular bearing No. AN/XIV/14162NI CPC/Circular/Vol-IV, dated 04.09.2009.

Reference is invited to contents of circular cited under reference, wherein instruction was issued to discontinue the practice of allowing the benefits of pay fixation/allowances under RPR 2008 at the time of promotion from SO(A) to AAO in anticipation of clarification to be issued by Ministry of Finance (Department of Expenditure).

2. An OA No. 489/2011 was filed by Sh. S. Vijaya Kumar Naidu and 12 others before the Hon'ble CAT Bangalore Bench praying for restoration of pay fixation benefit of 3% allowed to the applicants on their promotion grade after 01.01.2006 and consequential benefits upon restoration of pay fixation benefit. The OA was allowed by the Hon'ble CAT and the order implemented by the Competent Authority in respect of the applicants only.

3. The issue was referred to DoP&T, Ministry of Law & Justice and Ministry of Finance for general implementation to all similarly placed persons. Having been approved by Ministries/DoP&T, the competent authority has decided to extend the benefit of Hon'ble CAT Bangalore Bench order dated 10.10.2012 in OA No. 489/2011 to all similarly placed persons, who were promoted to the post of Assistant Accounts Officer during the period from 01.01.2006 to 29.08.2008.

4. Hence, it is requested to restore the pay fixation benefit of 3% granted at the time of promotion to AAO grade from SO(A), which was withdrawn earlier. Necessary fixation may be carried out with all consequential benefits.

Action taken in this regard may be intimated to HQrs office.

Subject : Provision of Brief Case/Hand Bag for official use-regarding – to Staff drawing Grade Pay of Rs.4600/- and above.

HQrs vide Letter of even no dated 9/12/2013 had called for the information regarding number of individuals coming under the category of “Non Gazetted” drawing Grade Pay of Rs.4600 and above for consideration of extension of benefit of brief cases/hand bags to Non Gazetted staff also drawing Grade Pay of Rs 4600 and above. The matter is one of the Agenda points to be discussed in JCM Meeting.

2. However, even after subsequent reminders on 15/01/2014 and 10/02/2014, requisite information has not been furnished by some Controllers which has been viewed very seriously. A copy of all previous references are again being forwarded for necessary action.

3. It is requested to expedite the same by return fax Latest by 4.04.2014 for consolidational HQrs. alongwith the reasons for the delay.

Subject: - Enhancement of amount of Ex-Gratia payable to Reservists and families of Reservists.
Reference: -This office circular No. 278 dated 29.03.2001.

Consequent on issue of Govt. of India, Ministry of Defence letter No 1(06)/2010-D (Pen/Policy) dated 22.11.2013 (copy enclosed), the existing amount of ex-gratia of Rs. 600/- per month being paid to Reservists and the amount of ex¬gratia of Rs. 605/- p.m. being paid to dependents members of families i.e. widows and dependents children of deceased beneficiaries has been revised w.e.f. 4th June 2013 at the following rates.

2. Widows and dependent children of the deceased Reservists Rs. 645/-

2. Dearness ex-gratia equal to 50% of the enhanced amount of ex-gratia and Dearness Relief, as notified from time to time, on the sums of enhanced amounts of ex-gratia and dearness ex-gratia shall also be admissible to them.

3. The other terms and conditions for grant of ex-gratia and dearness relief prescribed in this Ministry's letter No. 10(7)192/D(Pension/Services) dated 30.03.1992 (for families of deceased Reservists) and No. B/39042/AG/PS-4 (a&c)/1331/C/D/(Pen/Sers) dated 29.12.2000 (for Reservists) as modified from time to time, shall continue to be followed.

4. In view of above all Pension Disbursing Agencies are hereby authorized to step up the ex-gratia amount to Reservists and families of Reservists of the affected Reservists who were discharged prior to 01.04.1968 who having rendered minimum qualifying service required for grant of pension, had opted/ accepted for lump sum amount of gratuity at the time of release from service and have not availed benefits of rehabilitation assistance granted by the Government and were not in receipt of any other pension. This enhance amount is payable with effect from 4th June 2013.

5. It is also intimated that in case of recipient of ex-gratia to whom benefits accrues under the provisions of this letter has died/dies before receiving the payments of arrears, the life time arrears of ex-gratia will be paid as per extant Government orders in this regard.

6. It is requested that copy of this circular may please be circulated to all the PDAs under your jurisdiction in order to ensure prompt action for the revision of ex¬gratia payment. It is also requested that an intimation regarding disbursement of enhanced ex-gratia will be sent to this office in the enclosed Proforma with copy to recipient concerned for their information.

7. This circular has been uploaded on PCDA (P) website www.pcdapension.nic.in to disseminate among the Defence pensioners and PDAs.

A list of ‘Hard’ & ‘Tenure’ stations is already in circulation along with the Draft Transfer Policy on 28/6/ 14 for seeking comments. All concerned have given their views on the subject matter. After examination and due deliberation, the competent authority in the HQrs office has decided, once again, to solicit views/suggestions of all concerned, if any.

2. Hence, a combined list of proposed Hard/Tenure stations, taking into account recommendations of the Controllers and administrative feasibility/requirement is annexed with the request to offer your considered views wIthin 15 days from the date of issue of this letter. Nil report is also required.

CIRCULAR

Subject: Issue of Uniforms/Liveries to MTS directly recruited through Staff Selection Commission post 6th CPC.

The matter regarding issue of Uniforms and liveries to MTS recruited posts 6th CPC through Staff Selection Commission was referred to Ministry for clarification.

2. DoP&T has since confirmed that Uniforms/Liveries and washing allowance to newly recruited MTS , post 6th CPC may be allowed as is being admitted to erstwhile Group ‘D’ posts of peon, daftary, jamadar, Junior Gestetner Operator, Farash, Chowkidar, Safaiwala, Mali etc. which have been designated as MTS in Group ‘C’ post 6th CPC.

Further , it should be ensured that the Uniforms/Liveries are being admitted to those expected to wear respective uniforms while on duty.
