Sub: Payment of difference on arrears of TA/DA arising out of Railway Board’s letter No.F(E)I/2011/AL-28/18 dt.29.4.14.

One of the Railways has sought clarification regarding a supplementary claim for difference of TA/DA arising out of enhancement of Dearness allowance upto 100% w.e.f. 1.1.14 after issue of Board’s letter No.F(E)/2011/AL/28/18 dt. 29.04.14.

2. The matter has been examined in Board’s office and it is clarified that where TA/DA has been paid at old rates supplementary claims for difference of TA/DA would be admissible in respect of official tours made on or after 01.01.14 consequent to increase in the rates of TA/DA by 25%, w.e.f. 01.01.2014.

3. This disposes of South Eastern Railway’s letter No.ENG/Bills/TA&DA/604 dated 25.08.2015.

In the Fast Track Committee Meeting held in the Railway Board on 08/05/2015, the above subject was discussed without finality. However, NFIR places below detailed justification warranting restoration of payment of TA/DA to the Staff Car Drivers:-

1. The Committee constituted by the Railway Board appears to have not recommended payment of Daily Allowance to the Staff Car Drivers for performing official journeys during the prescribed duty hours even if they move out beyond a distance of 8 kms. from the Head Quarters without consulting extant codal provision.

2. The Sub Rule (1) of Rule 1614 o.f lndian Railway Establishment Code (Second Reprint Edition) permits drawal of daily allowance by a Railway employee who is not receiving a permanent allowance on any day on which he proceeds on tour beyond a radius of 8 krns.

The position mentioned above shows that the decision taken by the Railway Board is contrary to the instructions/codal provisions, the same requires to be reviewed. It needs to te appreciated that the staff car drivers carry the officials to accident sites, flood affected areas, and different locations in view of administrative requirement. Their working is not comparable with other departments of central Government. Denial of TA/DA is therefore unjustified.

NFIR, therefore, urges the Railway Board to withdraw Board’s letter dated 12/03/2008 and issue instructions to the General Managers of Zones/PUs for restoration of payment of TA/DA to Staff Car Drivers undertaking journeys a beyond a distance of 8 kms. A copy of the instructions issued may be endorsed to the Federation.

However, outstation members arriving from a station more than 1000 kms are entitled to get reimbursement for travel as per this Department’s letter no F.No 42/11/2014-P&PW(G) dated 19th May, 2014

Subject: Travelling Allowance (TA) Rules – Submission of Boarding Pass along with TA bills- reg.

References have been received in this Department seeking review of the existing guidelines relating to submission of Boarding Passes alongwith TA bills for air journeys performed on Government account.

2. O/o Controller General of Accounts have clarified that as per provisions of Civil Accounts Manual Pay and Account Offices are mandated to ask the DDOs to produce records to ensure that the journey for which TA is being claimed, was actually performed and DDOs may accordingly be asked to enclose the Boarding Passes with the TA bills.

3. Since submission of Boarding Passes as proof of having undertaken the journey is a requirement under the rules and procedures for passing TA claims, all concerned are required to follow these instructions. Ministries/Departments etc. are accordingly advised that these instructions may be brought to the notice of all concerned for strict compliance.

Subject : Non submission of Boarding Pass for settlement of T.A. Claims

Difficulties have been expressed by various quarters in production of original boarding passes along with T.A. Claims from time to time. The matter has been considered and it has been decided with the approval of the competent authority that in order to simplify the procedure of settlement of T.A. Claims, the condition of submission of Boarding Pass alongwith settlement of T.A. claim is dispensed with.

2. However, the officer concerned, preferring Travelling Allowance, will have to attach an undertaking along with T.A. claims that the journey, as mentioned therein, has actually been performed by him/her. Other requirements, as per the established procedures will continue to be followed.

3. Notwithstanding above, in case of extreme doubt, the controlling officer may be asked to verify the genuineness of the claim.

4. Air tickets should be purchased only from the authorized travel agent of this Deptt. i.e. M/s Balmer Lawrie & Co. Ltd and at the cheapest rates after comparing the available fare from the websites of travel agents of repute. If cheaper rates are available directly from Air India, the same can also be bought.

5. The frequent flyer reward points from Air India may only be redeemed for the official tours of the Deptt.

6. This issues with the approval of Secretary (P).

ORDER

Ministry of Railways (Railway Board) have decided to constitute a Committee of officers representing each stream under the Chairmanship of Member Staff with Secretary to Board as co-Chairman to formulate a Comprehensive transfer policy starting from the lowest level up to various posts in Board. The Committee will consist of the following Members:-

i) Director General (RHS), Railway Board
ii) Director General (RPF), Railway Board
ill) Addl. Member (Traffic), Railway Board
iv) Addl. Member (PU), Railway Board
v) Addl. Member (L), Railway Board
vi) Addl. Member (CE), Railway Board

2. The Terms of reference of the Committee will be as under:-

i) Comprehensive transfer policy to be formulated;
ii) Minimum tenure and maximum period for each level be defined;
iii) Maximum number of years an officer can stay in one location/city;
iv) Rotation of officer to various Zones in Railways to have Pan-India exposure;
v) Compulsory shifting after maximum period of stay;
vi) Prescribing minimum number of experience in divisions for posting as DRM and minimum experience in number of Zones for GM posts as well as posts in Railway Board;
vii) Examining the possibility of not posting the officer to the native divisions, if desired not to be posted to native zones;
viii) Streamlining the feeder cadre for each level of promotion and cadre management;
ix) Any other references to be made by Chairman and Members of the Board; and
x) Any references to be made by Minister of State for Railways and Minister for Railways.

3. The Headquarter of the Committee will be at New Delhi.

4. The Chairman, Co-Chairman and Members of the Committee will be eligible to draw TA/DA, as per extant rules.

Subject: Engagement of Consultant under the Plan Scheme ‘Pensioners Portal’.

This Department has been implementing a Plan Scheme namely ‘Pensioners’ Portal’ – A Mission Mode Project under NeGP, Government of India.

It is proposed to engage one Consultant at Under Secretary level to assist the Department in undertaking various activities under the Pensioners Portal. The consultancy fee payable to the Consultant so selected is likely to be lump-sum monthly remuneration to be fixed based on pay last drawn under the Government minus pension plus DA (fixed). The present approved tenure of the Consultant may be up to 25th February, 2015. The Consultant so appointed may also be required to undertake tours for outstation activities for which he/she will be paid TA/DA as per Rules.

Retired Under Secretaries/equivalent having worked in social welfare schemes of Ministries/ Departments would be desirable. Sub: Payment of Travelling Allowance & Daily Allowance to the Non-official Members of Railway Users’ Consultative Committees and National Railway Users’ Consultative Council (NRUCC).

Please refer to this offiec letter No.2001/TG-I/24/TA/DA dated 08.01.2002 on the subject quoted above wherein the rates of Travelling Allowance / Daily Allowance payable to Members of Railway Users’ Consultative Committees and National Railway Users’ Consultative Council were, inter alia, advised.

2. The rates of TA/DA payable to Non-official Members have been reviewed and it has been decided to revise the rates of TA/DA as under:

An important letter has been sent to Railway Board by the General Secretary of AIRF regarding the issue of arrears to be paid in difference of TA due to implementation of MACP to Railway employees.

Dear Sir,

Sub: Payment of difference in TA to the employees due to implementation of MACP Scheme

Consequent upon implementation of the orders, modifying ACP Scheme as MACP Scheme on the basis of recommendations of VI CPC, many employees were granted financial upgradation under MACP Scheme w.e.f 01.09.2008. T.A. amount was claimed by the employees as per their old grade pay prior to their financial upgradation, and they are due for the arrears of TA with retrospective effect due to implementation of MACP orders.

The matter was taken up by our affiliate, S.C. Railway Mazdoor Union, with South Central Railway Administration, requesting payment of supplementary claims relating to difference of TA on enhanced pay of the employees who have been granted benefit of financial upgradation under MACP Scheme with retrospective effect.

It is unfortunate, that the above request of our affiliate was not considered favourably by the Railway Administration, saying that the payment of different of TA consequent upon financial upgradation with retrospective effect is not in consonance with Board’s instructions/codal provisions.

There is a provision exists in the Note under para 1602(2) of the IREC, that, in the case of late authorization/ drawl of increments with retrospective effect, other than those where increments were withheld or where increments take an officer above the stage of efficiency bar, there is no objection to supplementary claims relating to Travelling Allowance, if any, being admitted, on the basis of enhanced pay, including increments.
In this connection, photocopy of letter No.P(R) 75/VII dated 25.01.2012 of the CPO/SCR is enclosed herewith.

In view of the above, the Board are requested to issue necessary orders to South Central Railway Administration for the payment of arrears of TA to the employees who were granted financial upgradation under MACP Scheme w.e.f. 01.09.2008.
