Sub: Leave encashment - process regarding.

 Sir,
The year 2013 is going to end and new year will start from 01st of January. As per normal HR procedure, each employee will be credited with 15 days EL and 10 days HPL in their leave accounts. In some cases this may lead to the employee leave account get swelled beyond permissible 300 days credit.

Since the leave account is being maintained in SAP ERP system w.e.f. 01/04/2013, those who wish to avail encashment of their EL prior to year end, may apply for encashment before of December 2013 in order to enable to run their encashment requests in the last off cycle payment which may fall before 23 of December 2013. After this date, the off cycle payments cannot be run for the month / year as payroll process for the month Dec, 2013 will start and thereafter the year will get changed to 2014 and new credit of EL will also be get triggered. Once this triggering action is completed, there is no provision to effect EL encashment action retrospectively in the ERP system.

All HR heads are requested to widely publicise this issue among the employees in order to avoid any late receipt of application and grievances.

1. Whether earned leave encashment allowed by the State Governments, PSUs, Autonomous Bodies to Govt. servant prior to his joining the Central Govt. is to be taken into account while calculating ceiling of leave encashment on his superannuation and retirement from Central Govt.?
Encashment of EL allowed by the State Governments, Public Sector Undertakings/Autonomous Bodies for services rendered therein need not be taken into account for calculating the ceiling of 300 days of Earned leave to be encashed as per CCS (Leave) Rules.

2. Whether Leave encashment allowed by Govt. under CCS (Leave) Rules, 1972 on absorption in a Central autonomous body/PSU is to be taken into account?
Encashment of EL allowed by the Govt. under the CCS(Leave) Rules, 1972 for service rendered in the Central Govt. prior to absorption in Central autonomous body shall not be taken into account while calculating the number of days of E.L. encashable in an autonomous body/PSU for the post absorption period.

3. Whether cash equivalent of leave salary in case of permanent absorption in PSU/Autonomous Body is permissible?
A Government servant who has been permitted to be absorbed in a Corporation/Company wholly or substantially owned or controlled by Central/State Government shall be suo motu granted cash equivalent of leave salary of earned leave at his credit on the date of absorption subject to a maximum of 300 days (being calculated as per provisions of rule 39) {Rule 39-D) Permanent absorption under the rule shall mean such appointment for which the Government servant applied through proper channel and resigned from Government service for taking up of such appointment — {Note below rule 39-D — Notification No. 13026/3/2011-Estt.(L) dated 28-03-2012}

Subject :- Payment of Leave Encashment amount along with LTC advance.

The undersigned is directed to refer to the Ministry of Defence’s OM No.11(2)/2011/D(Civ-II) dated 24.1.2012 and reminder 21st March 2012 on the above mentioned subject and to say that the benefit of leave encashment may be allowed 60 days before the proposed date of outward journey. Ministry of Defence may also please ensure that in future reference seeking a clarification are sent to this department with the approved of an officer of the level of Joint Secretary or above.

OFFICE MEMORANDUM
 
Subject: Extension of the revised orders on encashment of Earned Leave and Half Pay Leave to industrial employees.
 
The undersigned is directed to state that the matter regarding extension of revised orders on encashment of Earned Leave and Half Pay Leave lo industrial employees at par with the non industrial Central Government employees covered by the CCS (Leave) Rules. 1972 has been under consideration of this Department. It has been decided in consultation with the Ministry of Finance (Department of Expenditure) to extend the provision of this Department’s OM No.14028/3/2008-Estt (L) dated 25th September 2008, mutatis mutandis to industrial employees of Ministries/Department other than Railways. 
 

Accordingly, industrial employees shall be entitled to encash both Earned Leave and Half Pay leave, subject to overall limit of 300. Cash equivalent payable for Learned Leave shall continue unchanged. However, cash equivalent payable for half Pay Leave shall be equal to leave salary admissible for Half Pay Leave plus Dearness Allowance admissible on the leave salary without any reduction being made on account of pension and pension equivalent of other retirement benefit payable. To make up for the short fall in Earned Leave, no commutation of Half Leave shall be allowed. This Department’s OM No. 14028/25/94-Estt.(L) dated 7th October, 1996, stands amended to this extent.
 
2.These order shall take effect from the date of 07.11.2006, the date from which accumulation and encashment of 300 days EL were allowed to them and subject to the following conditions :-
 
(i) The benefit will be admissible in respect of past cases i.e. relating to period w.e.f. 07.11.2006 to till date, on receipt of applications to that effect from the pensioner concerned by the Administrative Ministry concerned.
 
(ii) In respect of retirees (retired after 07.11.2006), who have already received encashment of earned leave of maximum limit of 300 days together with encashment of HPL, standing at their credit on the date of retirement, such cases need not he reopened. However, such cases of Government servant considered as industrial employees retiring after 07.11.2006, in which there was a shortfall in reaching the maximum limit of 300 days can he reopened.
