NOTIFICATION

New Delhi, the 5th June, 2020


G.S.R. 350(E).- In exercise of the powers conferred by sub-section (2) of section 13 read with clause (b) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules to amend the Central Administrative Tribunal (Salaries, allowances and conditions of service of the officers and employees) Rules, 2017, namely:-

1. Short title and commencement.- (1) These rules may be called the Central Administrative Tribunal (Salaries, allowances and conditions of service of the officers and employees) Amendment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Administrative Tribunal (Salaries, allowances and conditions of service of the officers and employees) Rules, 2017, in the Schedule, -
  • in column (2), against serial number 15, for the words “Assistant”, the words “Assistant Section Officer” Shall be substituted;
  • in column (2), against serial number 26, for the words “Upper Division Clerk”, the words “Senior Assistant” shall be substituted;
  • in column (2), against serial number 29, for the words “Lower Division Clerk”, the words “Junior Assistant” shall be substituted.

Subject: Revision of pension/family pension of pre-2006 pensioners of All India Services.

Sir,
I am directed to refer to the above mention subject and to say that in compliance to the judicial pronouncement, the Department of Pension & Pensioners vide its O.M. No. 38/37/08-P&PW(A) dated 30/07/2015 has decided that the pension/family pension of all pre-2006 pensioners/family pensioners may be revised in accordance with their Department’s O.M. NO. 38/37/08/-P&PW(A) dated 28/1/2013 w.e.f. 01.01.2006 instead of 24.9.2012.

The applicability of the provisions of the aforesaid O.M. dated 30/07/2015 to All India Services pensioners of pre-2006 has been considered by this Department and it is decided that provisions of the aforesaid O.M. of Department of Pension & Pensioners Welfare shall be applicable miutatis-mutandis to All India Service pensioners of pre- 2006.

OFFICE MEMORANDUM

Subject : Promotion to the grade of Deputy Secretary on ad-hoc basis – Extension of period for one year beyond 03.06.2014.

The undersigned is directed to refer to this Departments O.M. of even number dated 23rd July, 2013 and subsequent orders bearing No. 4/14/2011-CS.I(D) dated4.6.2013. No. 4/3/2013-CS.I(D) dated 18.6.2013 & 7.8.2013, No.4/2/2013-CS.l(D) dated 12.8.2013 and No.3/1/2013-CS.l(D) (Pt.1) dated 30.9.2013, for extension of period of ad-hoc promotions / promotions of Under Secretaries of the CSS to the grade of Deputy Secretary on ad-hoc basis. The tenure of ad-hoc appointment of some of the officers covered under the above orders is for different periods.

2. The Competent Authority has approved the extension of the period of ad-hoc appointment of all the Deputy Secretaries upto 30.6.2015 or till the posts are filled up on regular basis or till the further orders, whichever is earlier.

3. The above stated approval for extension upto 30.06.2015 will be applicable to all such officers who are holding the post of Deputy Secretary on ad-hoc basis as per aforementioned orders and also to those officers who have retired between 03.06.2014 to the date of issue of this Office Memorandum. This approval will, however, not be applicable to those officers whose promotions were cancelled subsequently. The continuation of the ad-hoc promotion is subject to the conditions mentioned in this Department’s aforementioned orders.

OFFICE MEMORANDUM

Subject: Recruitment to Group 'C' posts in Pay Band-I, with Grade Pay of Rs.1800/- (pre-revised Group `D' posts).

This Department vide OM of even number dated 12.5.2010 requested all the Ministries/ Departments to intimate their requirements for Non-Technical Group 'C' posts in PB-1 Grade Pay Rs.1800/- to the SSC immediately in order that the Commission could initiate action for recruitment. The Ministries/Departments were also advised to take action simultaneously for framing Recruitment Rules for these posts in accordance with the Model RRs already circulated vide OM dated 30.4.2010.

2. It has, however, come to the notice that Cadre Controlling Authorities are not sending their requisitions for the vacancies of MTS to SSC. The erstwhile Group 'D' posts which now belong to Group 'C' are required to be filled up through SSC as per instructions of this Department instead of through Employment Exchange or any other mode. All Ministries/ Departments are, therefore, once again requested for sending their requirements in respect of Ministries/Departments themselves as well as their attached/ subordinate officers also, for Non-Technical Group 'C' posts in PB-1 Grade Pay Rs.1800/- to the SSC immediately in order that the Commission could initiate action for recruitment.

3. Action pending if any, may simultaneously be taken for framing Recruitment Rules for these posts in accordance with the Model RRs already circulated.

Subject :  Select List of Section Officers’ Grade for the year 2010 against Examination Quota on the basis of Combined Limited Departmental Competitive Examination -2009, 2010 & 2011 held by the UPSC.

The undersigned is directed to say that the Department of Personnel & Training had reported 268 (UR - 229, SC - 24 & ST - 15) vacancies for the year 2010 to be filled up in the Section Officers grade of Central Secretariat Service(CSS) on the basis of the results of the Combined SOs/Stenographers (Gr. 'B’/Gr 'I') Limited Departmental Competitive Examination 2009, 2010 & 2011conducted by UPSC. UPSC has since declared the final result of LDCE 2009, 2010 & 2011 on 24 July, 2013. The details of qualified candidates for the year 2010 are as under:

Out of 257 (UR - 229, SC - 24, SI - 04) candidates recommended by UPSC, only 255 (UR- 227, SC -24, ST- 04) candidates are effectively available for consideration for appointment as Section Officers in the Select List of the year 2010. Allocation of candidates has been made having regard to the vacancies in the various cadre units and Rotational Transfer Policy for CSS personnel. The list of candidates is annexed. Dossiers of the candidates included in the Select List will be sent in due course.

2. The cadre unit authorities are requested to initiate the process of appointment/relieving of the candidates immediately subject to being clear from vigilance angle as per available relevant instructions on the subject.

3. It may also be brought to the notice of all the officers who figure in the annexure that their appointments shall be subject to the outcome of the following Court cases and also as per any other order by any competent court in any of the connected matters :

(i) OA No. 4135/2012, MA No. 3477/2012 filed by Shri Rajeev R & Ors Vs UOI in CAT, New Delhi

(ii) OA No 4082/2012 & MA No. 3448/2012 filed by Shri M.R.Meena & Ors Vs UOI in CAT New Delhi

(iii) OA No. 4141/2012 filed by Shri Shanti LaI Bourasi & Ors Vs. UOI in CAT New Delhi.

4. A copy of the appointment order may be endorsed to this Department for record.

5. The receipt of the OM along with enclosures may please be acknowledged.

6. With the issue of this OM all requests from individuals Ministries/Departments on the subject are disposed off.

Subject : LDCE 2009, 2010, 2011 - Allocation regarding.

The undersigned is directed to refer to DOPTs OM of even number dated 26th July, 2013 vide which preferences of postings were sought from cadre units in respect of successful candidates of LDCE 2009, 2010 and 2011.

2. Out of 874 qualified candidates for LDCE 2009, 2010 and 2011, 111 are Personal Assistants of CSSS Cadre. It has come to the notice of this Department that many of these officers have already been included in the Select List of Private Secretary for the year 2010 against Seniority Quota and many are likely to be included in the Select List of Private Secretary for the year 2011 against Seniority Quota. There is a likelihood that many of these officers may refuse promotion in the grade of Section Officer.

3. All the Personal Assistants (as per list enclosed as Annexure-I) are therefore requested to furnish their acceptance or otherwise ( as per Anneure-II) to join the post of Section Officer on the basis of LDCE 2009, 2010 and 2011 to Department of Personnel and Training directly on fax numbers 24629413 and 24629414 by 5.30 PM today.

4. In case option is not received in respect of an officer, it may be treated as refusal to join the post of Section Officer on the basis of LDCE 2009, 2010 and 2011.

OFFICE MEMORANDUM

Subject : Nomination of Area Welfare Officers - Additional charge.


The undersigned is directed to refer to this Department’s O.M. No.32/1/2012-Welfare dated 31.1.2013 on subject noted above. In view of the several complaints being received from altottee residents of Panchkuian Road regarding non-enrollment of his/her names as Members of RWA. directions were issued to Shri Roop Lal in the meetings held by JS&CWO to resolve the matter. However, he has failed to comply with the instructions of this Department and has not offered convincing explanation for denial of membership to some of the complainants who are said to have approached Shri Roop Lal for granting Membership in the RWA. The dissatisfied allottee residents have approached senior officers to obtain redressal.

2. In view of the position explained above, it has been decided by the competent authority to terminate the services of Shri Roop LaI as Area Welfare Officer for Panchkuian Road and to assign the area of Panchkuian Road to Shri Tushar Kanti Pal, Area Welfare Officer in addition to the area already assigned to him, till nomination of a regular Area Welfare Officer.
