OFFICE MEMORANDUM

Subject: Zone of Consideration for inclusion in Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota-Regarding.

The undersigned is directed to refer to Department of Personnel and Training’s 0M of even number dated 25th September, 2013 vide which Zone of Consideration for inclusion in Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota was issued. All the care units were requested to conduct the DPC in respect of all the officers covered in the zone and intimate their fitness or otherwise to Department of Personnel and Training by 15th October, 2013. A reminder was also issued on th January, 2014 to all the cadre units to expedite DPCs. However, till date information has been received from few cadre units only.

2. Some Doubts have been raised by cadre units on some of the issues pertaining to Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota. Also, some discrepancies have been found in the information furnished by some of the cadre units. The clarification on these issues is as under:

Issue 1 : Whether DPC is to be conducted in respect of officers not clear front Vigilance angle.
Clarification: As per DOPTs 0M No 22011/5/86-Estt(D) dated 10th April, 1989 (Consolidated Guidelines on DPC), DPC in all such cases should be held and sealed cover procedure should be adopted as laid down in the O.M.

Issue 2 : Whether DPC is to be conducted in respect of officers who are in the zone of promotion but have retired/taken VRS/expired/resigned from service as on date before conduct of DPC
Clarification : As per DOPTs 0M No 22011/4/98-Estt(D) dated 12th October, 1998, DPC in respect of such officers should be held but as they have retired/left the service before the conduct of DPC, their order/notification for promotion need not be issued. Many Ministries/Departments have issued notification/orders in respect of such officers, which is not as per the 0M mentioned above.  Such Ministries/Departments are requested to issue necessary corrigendum in this regard. Only the fitness of these employees is to be informed to CS.I Division for finalization of Select List.

Issue 3 : What should be the date of effect of promotion in respect of persons included in the zone of promotion for inclusion in the Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota
Clarification: Promotion orders/notification should be issued from prospective effect only not prior to the date of DPC. Many Ministries/Departments have issued promotion order w.e.f. 1.7.2009, 1.7.2010 and 1.7.2010 for the respective Select Lists, which is not as per DPC guidelines. Such Ministries/Departments are requested to issue necessary corrigendum in this regard.


Issue 4: If a person whose name appeared in the zone of promotion for inclusion in the Select List of Section Officers’ Grade of CSS for the years 2009/2010/2011 against Seniority Quota had retired from a deputation post. Who will conduct the DPC in such cases- borrowing department or Parent department?
Clarification: DPC in such cases is to be conducted by the parent department.

Issue 5: What is the action on the part of Ministries/Departments if they found an officer in the zone who has already left the service prior to the crucial date i.e. 1.7.2009. 1.7.2010 and 1.7.2010 for the respective Select Lists?
Clarification: The concerned Ministry/Department will forward the name of such officers to CS.I Division, DOPT so that necessary corrections may be carried Out in the Select List. One such instance has come to the notice of this department that notification has been issued in respect of person for the Select List Year 2011 who had taken VRS w. e. f. 1.4.2011 i.e. prior to the crucial date of promotion. The mistake may be rectified by issuing of a corrigendum.

Issue 6: Many Ministries/Departments have not conducted DPCs in respect of many persons on the pretext that ACRs for these officers are incomplete
Clarification: Ministry/Departments may refer to para 6.2.1 of DOPTs 0M No 22011/5/86-Estt(D) dated 10th April, 1989 (Consolidated Guidelines on DPC).

Subject :  Select List of Section Officers’ Grade for the year 2010 against Examination Quota on the basis of Combined Limited Departmental Competitive Examination -2009, 2010 & 2011 held by the UPSC.

The undersigned is directed to say that the Department of Personnel & Training had reported 268 (UR - 229, SC - 24 & ST - 15) vacancies for the year 2010 to be filled up in the Section Officers grade of Central Secretariat Service(CSS) on the basis of the results of the Combined SOs/Stenographers (Gr. 'B’/Gr 'I') Limited Departmental Competitive Examination 2009, 2010 & 2011conducted by UPSC. UPSC has since declared the final result of LDCE 2009, 2010 & 2011 on 24 July, 2013. The details of qualified candidates for the year 2010 are as under:

Out of 257 (UR - 229, SC - 24, SI - 04) candidates recommended by UPSC, only 255 (UR- 227, SC -24, ST- 04) candidates are effectively available for consideration for appointment as Section Officers in the Select List of the year 2010. Allocation of candidates has been made having regard to the vacancies in the various cadre units and Rotational Transfer Policy for CSS personnel. The list of candidates is annexed. Dossiers of the candidates included in the Select List will be sent in due course.

2. The cadre unit authorities are requested to initiate the process of appointment/relieving of the candidates immediately subject to being clear from vigilance angle as per available relevant instructions on the subject.

3. It may also be brought to the notice of all the officers who figure in the annexure that their appointments shall be subject to the outcome of the following Court cases and also as per any other order by any competent court in any of the connected matters :

(i) OA No. 4135/2012, MA No. 3477/2012 filed by Shri Rajeev R & Ors Vs UOI in CAT, New Delhi

(ii) OA No 4082/2012 & MA No. 3448/2012 filed by Shri M.R.Meena & Ors Vs UOI in CAT New Delhi

(iii) OA No. 4141/2012 filed by Shri Shanti LaI Bourasi & Ors Vs. UOI in CAT New Delhi.

4. A copy of the appointment order may be endorsed to this Department for record.

5. The receipt of the OM along with enclosures may please be acknowledged.

6. With the issue of this OM all requests from individuals Ministries/Departments on the subject are disposed off.

Subject: Extension of Select List 2003 of UDCs of CSCS- reg.

The undersigned is directed to refer to this Department’s O.M. of even number dated 03.05.2012 on the subject mentioned above. Vide the above mentioned O.M., the cadre units were requested to verify the names of the UDCs included in the list and also to circulate the list amongst the UDCs to enable them to point out the discrepancies, if any. Some of the cadre units had pointed out the discrepancies which were examined by this Department and the necessary corrections have been carried out

2. As mentioned in para 1(iii) of this Department's O.M. of even number dated 03.05.2012, against the LDCE slots the names of the 132 candidates who had qualified the LDCE 2003 earlier and their ACR Dossiers were called for by SSC but could not be recommended for appointment due to non-availability of sufficient number of vacancies in the Select List year 2003 under LDCE mode have now been included. The cadre units are requested to verify the names of UDCs of their cadres in the lists which consist of 484 UDCs, and are requested to further take the following actions:

i) Verify the list attached to this O.M. and point out discrepancy if any to this Department immediately. Further the Cadre units are also requested to Convene DPC to promote 484 UDCs of their cadre units against extended Select List year 2003 of UDC grade.

ii) Since a case is pending in the Hon’ble High Court of Delhi, the above inclusion of personnel in the extended Select List 2003 of UDC (asper Annexure) would be subject to any further order that may be passed by the Hon’ble High Court of Delhi in W.P. No. 209/2013 filed by Shri Ravinder Kumar Jha and Ors and any other similar petitions before the Hon’ble High Court of Delhi. This fact may be emphatically stated in the order to be issued.

3. All the cadre units may intimate this Department the action taken in this regard within 15 days in the enclosed proforma.

Subject: Concessions to Scheduled Castes and Scheduled Tribes in posts filled by Promotion by selection-posts within Group A (Class I).

The undersigned is directed to invite reference to this Department OM No.36028/21/2003-Estt. (Res.) dated 29th January 2004 which provides that in promotion by selection to posts within Group A (Class I) which carry an ultimate salary of Rs.18,300/- per month or less, the Scheduled Caste/Scheduled Tribe officers, who are senior enough in the zone of consideration for promotion so as to be within the number of vacancies for which the select list has to be drawn up, would be included in that list provided they are not considered unfit for promotion. The scales of pay of Group A post have been revised on the basis of the recommendations of the 6th Central Pay Commission. Keeping that in view, it has been decided that orders contained in the aforesaid OM would apply to promotions by selection to posts within Group A carrying Grade Pay of Rs. 8,700/- or less.

2. All Ministries/Departments are requested to bring the above decision to the notice of all concerned.

OFFICE MEMORANDUM

Subject : Fixation of Range of Seniority for promotion from PA to PS Grade of CSSS Select list Year-2011-reg.

Reference is invited to this Departments’ O.M. of even number dated 28.03.2013 & subsequent reminder dated 07/05/2013 on the above mentioned subject. The requisite information regarding recommendation of DPC for promotion of eligible PA to PS Grade of CSSS for the Select List Year-2011 was required to be furnished in the prescribed proforma by 30/04/2013 by the Cadre Units of CSSS.

2. The requisite information from the Cadre Units addressed below has not so for been received despite a reminder. Thy non-receipt of this information is delaying the process of finalizing the panel of eligible officers for appointment to PS Grade of CSSS for the Select List Year-2011. The defaulting Cadre Units are requested to furnish the requisite information without further delay.

The requisite information viz, recommendations of the DPC alongwith vigilance clearance of all the eligible officers who are working in their Cadre Units, including those who had been transferred to their Cadre Units from other Cadre Units on their ad-hoc promotion to PA grade of CSSS and duty filled -in option form (Annexure-VI) from the concerned officers have not yet been received from the Cadre Units addressed below, even after a lapse of considerable time.
 
3. The concerned Cadre Units are requested to expedite the requisite information to this Department without any further delay.
