PENDING DEMANDS AND NEW GOVERNMENT 
 
New Central Government under the leadership of Hon’ble Prime Minister Shri. Narendra Modi has taken charge with a clear majority in the Lok Sabha election.  People of the country and the Central Government employees who suffered a lot under the UPA Government, have voted for a change.  Now it is the turn of NDA Government.  Coming days will prove whether the selection made by the voters is correct or not.
 
Central Government employees have to take a cautious approach towards the new Government.  As the new Government has just taken over charge and expectations are very high, jumping into any sudden conclusion may not be correct on our part.  We have to give reasonable time to the new government to make its stand clear on the issues agitating the minds of the Central Government employees.  Let us hope that our past experience in the 2000 December 14 days Postal strike when the NDA Government was in power, the support extended by the party leading NDA to the UPA Government for introducing and passing the PFRDA Bill in Parliament, the infamous downsizing order of 2001 issued by the NDA Government which paved way for abolition of thousands of vacant posts in Central Government Departments and refusal to concede any of the main demands of Gramin Dak Sevaks will not be repeated by the new Government.
The maiden budget of the new Government to be presented in Parliament in July 2014 may give us an idea on the thinking of the Government and also the attitude of the Government towards the problems faced by the common people and the Central Government employees.  Confederation of Central Government Employees and Workers has placed our demands before the new Government.  JCM National Council staff side has also written to the Finance Minister and Cabinet Secretary.  Our demands are not new.  Demands raised before the UPA Government are again placed before the NDA Government.
               
While constituting 7th Central Pay Commission the UPA Government has refused to include the main demands of the Central Government employees in the terms of reference viz:
(1) Grant of merger of DA 
(2) Grant of interim relief and 
(3) inclusion of Gramin Dak Sevaks under the purview of 7th CPC.  

Confederation has conducted 48 hours strike in February 2014, just before the General Election is declared, demanding settlement of the 15 points charter of demands which includes the above three main demands also.  As General Election was declared we could not move further.  Central Government employees expect that the new Government will consider positively, the demands raised in the 48 hours strike.
               
If the new Government also take the same stand as that of previous UPA Government and refuse to concede our genuine demands, the Central Government employees will be forced to tread the path of struggle again. Before embarking upon such a struggle, our prime duty is to build up largest unity among all sections of the Central Government employees.  Confederation is making all out effort in this direction especially to build up total unity among JCM staff side organisations.  We are even ready to make certain compromises for the sake of unity.
               
We have to give enough time to the new Government and we are ready to wait.  But we cannot wait indefinitely. 7th CPC has already commenced its work and has fixed target dates for submission of memorandums by Federations and Unions/Associations.  Chairman, 7th CPC, has also made it clear that unless the Government refer the issues of DA merger, Interim relief and GDS issues to the Commission, it will not consider these issues.  Hence the ball is now in the Government’s court.  Let us see how the things move.  Let us also be ready to face any situation.

RESOLUTION  adopted at the  National Convention of Central Government employees on 4th April, 2014 at Nagpur.
1. The National Secretariat of the Confederation places on record its appreciation over the massive and magnificent participation of the largest number of our members in the 48 hour strike on 12th and 13th Feb. 2014.  It was a great manifestation of the confidence the members had reposed in the organization and their determination to win the demands through struggles.  The reports, the Confederation CHQ received both from the affiliates and the State Committee indicate the massive participation of the employees in the strike action throughout the county.  In some of the affiliates, the participation had been cent percent.  This must embolden the Confederation to pursue the issue with determination and organize further action programmes to ensure that the demands are got settled.

2. The Secretariat has noted that the Government had pretended to ignore the massive action of the employees.  There had been no response from them so far.  In the wake of the strike action, it announced the composition of the 7th CPC disregarding the united demand raised by the Staff side of the JCM National Council for the inclusion of a labour representative.  The Government also chose not to convene the meeting the staff side to discuss the draft terms of reference submitted.  It did not make any announcement on the question of merger of DA, Interim Relief, and inclusion of GDA within the ambit of the Commission and rejected the demand for making the recommendation of the Commission effective from 1.1.2014. 

3. On every issue, which is included in the 15 point Charter of demands, the Govt. continued with its nugatory attitude.   In the last session of the Parliament, they ensured that the PFRDA bill becomes an Act despite the strongest objection and resistance of the employees by eliciting and receiving the support and patronage of the dominant opposition party, the BJP.  Even on an issue like compassionate appointments, no positive response emerged.   The period witnessed increased outsourcing of governmental functions.  Almost a third of the workforce is presently casual and contract workers with abysmally poor wages taking advantage of the acute unemployment situation in the country.  There had been no settlement of any issue raised by the Staff Side in the National Council JCM.  The JCM scheme has been made ineffective as not a single meeting of the Council was held in the last three years and even the decision taken at the National Anomaly Committee was thwarted through political intervention.

4. The plight of the three lakh Gramin Dak Sevaks of the Postal Department is highly deplorable.  They constitute almost half of the Postal work force. But for them, the functioning of the Postal system will come to a grinding halt.  Their service conditions are presently worse off than even a causal/daily rated worker. Despite the Supreme Court’s decisions that they are holders of Civil Post and consequently are entitled to the benefits and privileges of a civil servant, there had been no improvement in their service conditions worth mentioning.  In spite of repeated presentation of their case both inside and outside the Parliament by people from all walks of life irrespective of party affiliation, the Government had been silent to the pleading for bringing them within the ambit of the Pay Commissions.  Confederation is duty bound and determined to change the situation and to bring them within the purview of the 7th CPC.
5. During its five year tenure the UPA II was in power, it intensified the neo-liberal reforms;  phased out all welfare measures; accentuated the unemployment situation; divested the PSUs; allowed unbridled entry of Foreign capital to subjugate the Indian people; ruined the indigenous industry; destroyed the livelihood of the farmers and agricultural labourers; allowed the prices of all essential food items to soar; privatised education and health care services; ensured that each of its decision was to favour the rich; granted huge tax concessions to the corporate; indulged in large scale corruption; squandered away the national wealth; siphoned off the poor man’s earning into the hands of a few rich in the country; sided with the entrepreneurs in all labour disputes;  took each and every political decision to sub-serve the interest of the imperialist powers especially the USA.  The pursuance of the neo liberal policies at the behest of the advanced capitalist countries drove the majority of Indian population to be below the poverty levels. In the comity of nations, India became the poorest and the last ranking in all fields. Indian youth were driven to be beggars at the doors of transnational corporations and developed countries.

6. Those who were responsible in driving our country men to unprecedented deprivation have to now seek mandate, for their tenure is to end shortly.  No different is the approach of the major opposition party, BJP. There is nothing to choose from these two political dispensations.  They were hand in glove together to demolish the sovereignty of the country; pauperisation of the people and supported every legislation to intensify the neo liberal exploitation of the common man.  They supported to the hilt the corporate houses.  But for the support extended by the BJP, the PFRDA bill would never have been made into a law.  The Act now provides for the extension of the new contributory pension scheme to those who were recruited prior to 1.1.2004 and the existing pensioners.  Despite the refusal of the Government to accept their suggestion to guarantee minimum pension, the BJP unashamedly supported the Bill, for they were the proponents of the neo liberal economic policies.  They supported this Government to increase the FDI and FII in all sectors of economy and announced that they would intensify the reform process if elected to power.  The conglomeration of Corporates in the country has now appointed the leader of that party to be the next CEO to run the country.  They have no use for the discredited UPA howsoever subservient it could be.  They know in a democratic system demagogy can play a vital role.  They are certain that BJP and its allies if elected to power will be much more pliant and compliant.

7. The Corporate controlled media has created an illusion to the effect that there exists a consensus across the political spectrum in the country that the neo liberal policies will spur economic growth and the only point to be clinched in the forthcoming election is as to which political combination, whether the UPA led by Rahul Gandhi or the NDA of Narendra Modi is more efficient in pursuing the IMF dictated economic policies vigorously.  Economic growth is not akin to development. In the initial years of the introduction of the LPG, no doubt, the economy grew phenomenally, but the large majority of Indian people suffered. It permanently halted the bringing up of an egalitarian society.  It only enlarged the scope for maximisation of profit of the corporate giants; opened up larger and bigger avenues for corruption at the top of administration, whereby the ruling party and its leaders could amass wealth.  The scams unearthed by the Comptroller and Auditor General of India during the last five years of UPA II Rule speak volumes of the cancerous growth of corruption in our country.  The 2G spectrum involving Rs. 1.76 lakh crores,  the Coalgate of the dimension of Rs. 1.86 lakh crores, the corruption involved in the commonwealth games, the Rs. 40,000 cr deal in the Delhi Airport Privatisation scheme, The KG Basin related Gas price deal with Reliance, topping with Rs 48 lakh crores are a few that surfaced during this period.

8. As part of the economic policy, concerted and continuous efforts were made to the job killing process in all sectors, through contractorisation, casualisation, outsourcing, privatisation etc. Contract workers now constitute 80% of the total work force in the private sector.  After the implementation of the 6th CPC recommendations about 35% of the workforce in the Governmental sector is either contract or casual workers.  They are paid quarter of or even less the wages of the regular workers. 

9. This election is not only to decide who should govern this country but more so to determine for whom the governance is. UPA having been totally discredited in the eyes of the common man has no chance whatsoever.  NDA must not have a chance once again for it is bound to pursue the neo liberal policies more vigorously than even the UPA. That is the one and only reason why the Indian corporate houses and the corporate controlled media solidly back the BJP and the BJP led NDA. The Political combination outside the NDA and UPA has a predominant presence in the 15th Lok Sabha. They are capable of being the largest segment in the 16th Lok Sabha too.

10.   It is in this background that the workers must assess the political situation.  In the forthcoming electoral battle, every worker must discharge his salutary responsibility.  Since the present state of affairs is the product of the neo- liberal policies and since both the UPA and the NDA are the proponents of those policies, one must have clear vision and exercise the franchise effectively to ensure that a pro-worker, pro-people combination of parties is in governance.  In the forthcoming election to the 16th Lok Sabha, the Central Government employees must become a vehicle for change in the interest of the common people; rise above the divisive ideologies and misleading propaganda; identify their friends especially in the Left parties; and ensure the success of those who stood with them and fought for the cause of the workers and common people. 

11. The Secretariat came to the inescapable conclusion that the settlement of the demands in the charter will only be possible through intensification of the struggles.  It recognised the need for larger unity. It will strive for bringing about such a united platform for joint action.  The inevitability of an indefinite strike action has to be emphasised.  The Confederation and its affiliates must prepare its members for such an eventual and unavoidable action, if the proposed 7th CPC is to really revise the wages.  It is needed to ensure the withdrawal of the pernicious contributory pension scheme.  It only will ensure that there are no casual or contract system of employment in Government service.   The Government employees must be bestowed with democratic rights and above all must enjoy the facility for collective bargaining and right to strike.  The Gramin Dak Sevak system is a colonial legacy and no civilised country must endure such brutal exploitation.  All is possible through united and sustained action.  The Confederation has proved beyond any iota of doubt that it has built up an organisation capable of carrying out such an action.

12. To ensure that the Indian people have food security, the farmers are not driven to commit suicide, the workers do have decent job environment and emoluments, the prices of essential commodities do not soar, there is universal public distribution of essential food articles; India has an independent foreign policy, this great Nation is not enslaved by western imperial powers once again, all communities and people of different faiths are allowed to live in peace and harmony; no communal violence erupts; all able bodied people have jobs and livelihood, there must be a Government which exist for the sake of the poor inhabitants of this country.  Central Government employees must take an active role in the ensuing General election and strive with their best to bring about such a Government.

13. This convention calls upon every worker of the Confederation to fan out and reach out to the rank and file of its membership, explain the stupendous task ahead; to work in consonance with the understanding depicted in this resolution and ensure that they become instruments for a great political change in our country. 

14. The Convention authorises the National Secretariat to review the political situation emerging after the election and take appropriate decision to mobilise the rank and file of the workers for an eventual industrial action to seek settlement of the 15 point charter of demands.

Defense employees proposed indefinite strike from 17.02.2014 withdrawn

Only sectional demands discussed by defence ministry. No discussion or ensurance about DA merger, Interim Relief, Date of effect of 7th CPC and New Pension Scheme. On the other hand, despite of 96 percent Railway employees voted in favour of indefinite strike on the issues of Pay Commission, DA Merger, Interim Relief, New Pension Scheme etc, Railway unions have not taken it seriously.

CONFEDERATION IS THE ONLY ORGANISATION WHICH IS CONDUCTING UNCOMPROMISING FIGHT AGAINST THE POLICIES OF THE CENTRAL GOVT. AND ALSO FOR THE JUSTIFIED DEMANDS OF THE CENTRAL GOVT. EMPLOYEES. AND WE CONDUCTED THE TWO DAY STRIKE SUCCESSFULLY.

LET US KEEP UP THIS FIGHTING SPIRIT AND CONTINUE OUR STRUGGLE IN THE COMING DAYS.

Dear Sir,
The Confederation of Central Government employees and workers is the apex level organisation of all Federations/Associations/Unions of CGEs other than in the Railways and Defence establishments.  In our last National Executive meeting, we were constrained to decide to call upon our members to organise TWO DAYSs strike on 12th and 13th February, 2014 in pursuance of our charter of demands.

It was in the wake of a strike action in 1960s by the Central Govt. Employees, the Govt. of India set up the permanent negotiating machinery called JCM so that the employees will be able to raise their demands and grievances and seek settlement thereof through dialogue.  This machinery has now come to a standstill as the Govt. does not convene the meetings of the councils at the Departmental levels on one pretext or the other.

A new set of rules were promulgated in 1993 to grant recognition to Service Associations.  Many Ministries, despite the employees organizations abiding by the stipulated conditions, have not afforded recognition to the Associations/Federations, thereby closing all channels of communication.  The JCM had the facility of referring the issues on which the Government could not agree upon to the Board of Arbitration.

The decision/award of the Board was binding on all parties.  However, of late the Government had been rejecting the awards in favour of the employees on the specious plea of adverse impact on national economy by presenting resolutions in the Parliament.  We need not emphasise the unethical character of this approach which undermines the confidence of the employees in the fairness of the system.

The new contributory pension scheme was introduced by the Government on the plea that the pension liability has become unbearable and is a drag on the exchequer.  In our Memorandum to the Prime Minister, we had raised several issues and had pointed out that the financial outflow on account of the new scheme will be much more than the existing defined benefit scheme. We had indicated in our memorandum quite a number of aspects which would be detrimental to the interest of workers. In the debate on PFRDA Bill in the last session of Parliament. We could notice that quite number of MPs had demanded for the withdrawal of the bill itself as it only benefits the Stock market operators and entrepreneurs. Even the Standing Committee’s suggestion for incorporation of a minimum return to the employees was turned down by the Government. We are certain that the new contributory pension scheme shall be a drag on the exchequer and the scheme will turn out to be a conduct for the flow of the poor employees’ savings to the corporate houses. We appeal to you to raise your voice in the Parliament against the new contributory Pension Scheme for its anti employee and anti national characteristic.  The real purport of the bill is reflected in the decision to allow FDI to the extent of 40% in this sector. The said decision has facilities outflow of Indian savings for investment outside the country.

The 6th CPC recommendations and its implementation had given rise to various anomalies.  The employees genuinely felt that the said anomalies would be removed through discussions for which the Government had set up a committee.  The Committee despite meeting on four occasions had not been able to settle the issues; nor could it be referred to the Arbitrator. The 6th CPC recommendations were implemented with effect from 1.1.2006.  The revision of wages was due on 1.1.2011. The Government has not so far come forward to set up the 7th CPC.

It had been the age- old   practice to revise the wages of Central Government employees as and when substantial erosion takes place in the real value of wages. The 5th CPC opined that as and when the DA Component in wages crosses over 50% such revision must take place and the said Component of DA must be merged with pay. Accordingly the 6th CPC was set up and wages revised in 2006. On 1st January 2011 the Dearness allowance component in the emoluments of the employees had   reached 51%   The Government had been dilly dallying the wage revision and merger of DA with Pay which would have helped the employees to combat the soaring price rise. On 12th December 2012, the employees went on a day’s strike which received magnificent response from the rank and fill of the workers. The unbridled inflation and the consequent Price rise has made the existing Pay and allowances   incapable of making both ends meet. The Government announced its intention of setting up 7th CPC thereafter but no follow-up action ensued, leaving the employees with no alternative but to declare a 48 hours strike on 12th and 13th February 2014. As on 1.1.2014 the DA component has crossed   over 100%. The Government attitude has become untenable. On the request of the Government, the Staff side had submitted the draft terms of reference for 7th CPC.   They had also raised     the grant of interim Relief, which normally precedes the notification of any CPC. The Staff Side of the National Council had demanded the inclusion of Gramin Dak Sevaks within the ambit of the 7th CPOC, an issue which was at the core of discussion earlier in 2006. The Government has not indicated its approach on this vital issue so far as a result of which about three lakh GDS employees are in anxiety and desperation.

The Neo-liberal policies brought in its wake the unethical practice of contract labour system and  employing casual workers for perennial and permanent jobs, which is strictly prohibited by the law of the land. Government departments witnessed an overdose of this policy in the period between 2004-2014. More than one third of the work force in Govt. Sector is now composed   of such a informal workers. They are provided with pittance of wages and the huge gap in wages of the regular and the informal employees has been the root cause of inter-personnel tension and many fraudulent ventures.  Government functions are supported supposed to have an element of security and accountability. The removal of this ill- advised system had been a cry often falling on deaf ears. Besides there are quite a number of casual workers employed to carry out perennial and permanent jobs. They are to be regularised. In the postal department alone they number about 3 lakhs called as GDS. Enclosed is a brief note on Charter of demands, the non-settlement of which has resulted in the loss of confidence in the system itself and consequent compulsion to tread the path of straggle. Many of these issues are incorporated   in the agenda of National Council for not less than ten years back, begging settlement.  . The Government has made procrastination an art in itself and allow the issues longer on for years.

We seek your solidarity and support and request you to kindly raise these issues in the Parliament and ask the Government to settle the demands of the Government employees.

OFFICE MEMORANDUM

Subject: Disbursement of salary/wages/pension to the Central Government Employees in the State of Kerala for the month of September, 2013 on account of ONAM festival.

In view of the 'ONAM festival, the Government have decided that the salary of all Central Government employees in the State of Kerala for the month of September, 2013 may be drawn and disbursed by the Central Government offices (including Defence, Posts & Telecommunications) on 13th September, 2013.

2. The wages for September, 2013 of the industrial employees of Central Government serving in the State of Kerala may also be disbursed in advance on 13th September, 2013.

3. The pension for September, 2013 of all Central Government Pensioners in the State of Kerala may also be disbursed by Bank/PAOs on 13th September, 2013.

4. The salary/wages/pension so disbursed is to be treated as advance payments and will be subject to adjustment after the full months salary/wages/pension of each employee/pensioner is determined. The adjustment, if any, will be made without exception from the salary/wages/pension as the case may be from the month of September, 2013.

5. The concerned Ministries/Departments are requested to bring these instructions to the notice of their offices located in the State of Kerala for necessary action immediately.

6. Reserve Bank of India is requested to bring these instructions to the notice of all paying branches of all Banks located in the State of Kerala for necessary action immediately.

Will the Minister of RAILWAYS be pleased to state:-


(a) whether the All India Railwaymen’s Federation and National Federation of Indian Railwaymen have threatened to go on an indefinite strike in case their demands are not met;

(b) if so, the details thereof; and

(c) the reaction of the Railways thereto and the manner in which the Railways propose to address the situation so as to prevent such strike?

ANSWER

MINISTER OF STATE IN THE MINISTRY OF RAILWAYS (SHRI ADHIR RANJAN CHOWDHURY)

(a) and (b): All India Railwaymen’s Federation (A.I.R.F.) and National Federation of Indian Railwaymen (N.F.I.R.) have made numerous demands. Some of the demands are setting up of VIIth Central Pay Commission, abolition of New Pension Scheme, merger of Dearness Allowance with Pay, filling up of all vacant posts, implementation of the report of Joint Committee for career growth of Track Maintainer, reduction in duty hours of staff. While A.I.R.F. have indicated that if their grievances are not resolved in a time bound programme, the Federation would be compelled to conduct strike ballot as a first step. N.F.I.R. have decided to give a time of four months to the Government for satisfactorily settling their demands failing which the Federation will be compelled to give call for ‘Indefinite Strike’ on Railways.

(c): Some of the demands like setting up of VIIth Central Pay Commission (7CPC), abolition of New Pension Scheme, Merger of Dearness Allowance with Pay which are not within the purview of Ministry of Railways are being considered for referring to concerned Ministries/ Departments. In accordance with Government’s policy, other demands of the Federations are given due consideration within the framework of existing rules and financial constraints, and action as considered necessary is taken.

CENTRAL TRADE UNIONS HELD NATIONAL WORKERS CONVENTION AT NEW DELHI ON 06TH AUGUST 2013

A massive National convention of all Central Trade Unions, Central and State Government Employees &; Teachers Federations and Public Sector employees Unions etc was held at Mavlankar Hall New Delhi on 6th August 2013. The convention was addressed by the leaders of BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF. Presidium consisted of the leaders of all the above Central Trade Unions. The resolution adopted by the National convention called upon the workers to organize following.

1. Demonstration/Rallies/Satyagraha at all state capitals with respective statewide mobilization on 25th September 2013

2. Massive Demonstration before Parliament with main mobilization from neighbouring states on 12th December, 2013

3. On the same day of Demonstration before Parliament (12th December 2013), District-level Demonstrations at all District Headquarters all over the country.

4.  Sectoral programme of joint actions for effectively opposing Restructuring, Outsourcing etc. and on sector-specific issues/demands and against Divestment of shares in Pubic Sector Enterprises.

5.  Exclusive Joint Action Programmes on the demand of Minimum Wage and Contract Workers related other demands.

CONFEDERATION CALLS UPON THE CENTRAL GOVERNMENT EMPLOYEES TO ORGANIZE TWO HOURS WALK-OUT PROGRAMME ON THE DAY WHEN THE BILL IS TAKEN UP FOR DISCUSSION IN PARLIAMENT

As you are aware, Central Government is going ahead with their agenda on pension privatization. The controversial PFRDA Bill (Pension Fund Regulatory and Development Authority Bill) is listed as an agenda item for the current Parliament session. The bill may be taken up for discussion in Parliament on any day. Confederation of Central Government Employees & Workers has opposed the Contributory Pension Scheme and also the PFRDA Bill from the very beginning.

We have conducted so many agitational programmes including strike. The left parties in the parliament have also strongly opposed the Bill. Inspite of the opposition from employees (both Central Government and State Government Employees & Teachers) and also from left political parties, the Central Government is not ready to withdraw the contributory Pension scheme or to scrap the PFRDA Bill.

The National Secretariat of the Confederation has viewed the move of the Government with grave concern and decided to call upon the entirety of the Central Government Employees & Workers to organize mass protest demonstration in front of all offices throughout the country after walking out from offices for two hours, on the day when the bill is taken up for discussion in Parliament or on the next day if information is received late.

All India office bearers, State level COCs and other COCs are requested to make the two hours walk out programme a grand success.

GoM on Workers' Demands

Government has set up a Group of four Ministers led by Shri A.K. Antony to discuss the workers' demands with the United front of trade unions.

Two meetings of the Group of Ministers (GoM) were held on 18.02.2013 and 22.05.2013 in which the ten point Charter of Demand of the trade unions were discussed. The discussions remained inconclusive and it was decided that the issues/demands will be considered by the Group of Ministers themselves before further discussions with the Central Trade Unions representatives. As such, no final recommendation has been given by the GoM.

This information was given by Minister of State for Labour & Employment Shri Kodikunnil Suresh in the Lok Sabha today in reply to a written question.

53RD ANNIVERSARY OF 1960 STRIKE

Today, is the 53rd anniversary of the Glorious Strike of the Central Government Employees which started on 11th July 1960 and continued for 5 days on the basic demands of the workers. That was their biggest strike in independent India till then, which shook the edifice of the Government.

It was suppressed by all repressive measures putting thousands in jail, dismissal, termination etc. But the workers never surrendered. The mighty one day Token Strike on 19th September 1968 reminded the Government that the workers can never be suppressed all the times.

On this day our Revolutionary salutes to all those comrades who sacrificed their lives at the altar of struggle and also who faced inhuman suppression and also the lakhs of workers who participated. Red Salute to all those who showed through their action that the united struggle is the right path.

Confederation General Secretary Shri.M.Krishnan uploaded a brief outcome of the meeting of Central Trade Unions held on 8.7.2013 on his official blog yesterday.

"The Joint meeting of Central Trade Unions held on 8th July 2013 at BMS office, New Delhi has decided the following course of joint mobilization/agitations and activities


   1.   National Convention of Trade Unions on 6th August 2013 at Mavalankar Hall, New Delhi

    2.  State level and district level rallies/agitations/demonstrations / jail bharo etc during last week of September 2013

    3.  March/demonstration before Parliament in the month of December during Parliament session.

    4.  In various sectors like Coal, Telecom, Banks & Insurance, Transport, Power, Port & Dock etc, joint struggles/strikes are being planned/undertaken by the respective federations. All support should be extended to those struggles. Central Trade Unions should also jointly endeavour to develop sectoral struggles in various sectors.


Dates and details of programmes in September and December will be finalized through joint consultation of Central Trade Unions and announced from the National Convention".

A meeting of the representatives of Staff Side National Council with Secretary, Pension AR & PG on pensionary matters was held on 28.5.2013. Staff Side was represented by S/ Shri S.G. Mishra and Rakhal Das Gupta (AIRF), Guman Singh (NFIR) and K.K.N.kutty and S.K.Vyas (Confederation)

Old Items

The following issues have been discussed

1. Ex-gratia Payment to SRPF / CPF beneficiaries who had voluntarily retired or medically invalidated. It has been decided to implement the Kerala High Court judgment in general and extend the benefit of exgratia payment to the meagre number of pre 1986 optees who retired voluntarily or on medical invalidation after rendering 20 years of service. The enabling orders are to be issued shortly.

2. Raising quantum of ex-gratia to CPF retirees on lines of SRPF.

In respect of SRPF retirees of the Railways, the rate of ex-gratia was raised from Rs. 600/- pm to Rs. 750/- pm to Rs. 3000pm with effect from 1.11.2006. The Govt. have now decided to revise the rate of exgratia in respect of CPF retirees at the above rates I. e. Rs. 750/- to Rs. 3000/- pm w.e.f. 1.11.2006.

3. Issue of Revised PPOs in favour of Pre 2006 retirees and others.

 In the case Civilian departments about 4 lakhs of cases reported pending on 1.8.2012, now only 1.30 lakhs are pending and these would also be cleared by 30.6.2013. In the case of Railways total pendency in August 2012 was 10.8 lakhs which has been brought down to 5.54 lakhs. Now when it has been decided that revised PPOs may be issued suo mottu by the Railway authorities, the entire pending is targeted to be cleared by 30th September 2013.In the case of Defence civilians, action is being taken to issue all pending PPOs by 30.9.2013.

4. Fixation of revised pension by multiplying pre-revised 1/3rd pension (in  respect of PSU absorbees) by a factor of 2.26.In the case the speaking order issued by the Govt. on 26.11.2012 that no further increase in pension of absorbee pensioners would be allowed has been challenged in CAT Hyderabad and the Tribunal has passed orders on 24.4. 2013. This order is under examination.

5. Commutation of Pension.
The Govt. have not agreed to reduce the period of 15 years to 11 years for restoration even in the cases where commutation has been paid at the rates prescribed in the New Table. The Govt. wanted that the matter may be raised before 7th pay commission.

6. Family pension to divorced / widowed / unmarried daughters –nomination for life time arrears by the family pension in respect of his / her daughter. This has not been agreed to.

7. Non payment of arrears of pension on account of Revision of pension w.e.f. 1.1.2006 in case of pensioner of Chandrapur. Now these arrears have been disbursed by all Banks.

New Items.

I. Equitable Gratuity  under Rule 50 of Pension Rules, 1972.

As recommended by IV CPC the following rates of Death Gratuity had been provided for :-

3.5 Years or more but less than 20 years 12 times emoluments
4.20 years or more half of emoluments for every completed

subject to maximum of 33 times of emoluments


Staff Side suggested the following amendment in Sl. No. 3 above which may be split as under :-
a) Five years or more12 times the emoluments but less than 11 years.
b) 11 years or more but less than 20 years20 times of emoluments

The Govt. has not agreed and have suggested that the matter may be raised before the next Pay Commission.

II.Extension of CS (MA) Rules, 1944 to Central Government Pensioners.

The Health Ministry has agreed to extend CS (MA) Rules, 1944 to Pensioners. In many cases which had gone to Court, it has been ruled that pensioners are entitled to full reimbursement of medical expenses incurred by them as per CS (MA) Rules 1944 which are applicable in the case of serving employees. The Department of Expenditure has not agreed to implement the above decision. The pensioners have to wait till the Medical Insurance Scheme is introduced.

III. Grant of modified parity with reference to the Revised Pay Scale corresponding to pre revised Pay Scale of the post from which an employee had retired. The Govt. cited the decision of Supreme Court in K.S. Krishna Swamy Vs UOI (C.A. no.3173-3174/2006 and 3188-3190/2006). According to this the benefit of up-gradation of post subsequent to their retirement would not be admissible to pre 1996 / pre 2006 retirees.

The Staff Side pointed out that the result of this clarification is that a retiree is now being compared with the pay scale of an employee two stages lower and subordinate to the post from which an employee has retired. If V IV CPCs have consciously upgraded certain posts it is established that pay scales granted for these posts were in adequate and only therefore the up-gradation has been recommended by them. On what ground the benefit of up-gradation even in determining the modified parity be denied to them when it is established that they retired from a pay scale which were inadequate.

However Govt. did not agree to reconsider this matter.

S.K. Vyas, our President had been writing and following it up with telephonic conversations to bring about such a platform for action. We are happy to inform you that the AIRF and AIDEF has now agreed to bring about a joint platform of action to project two important demands of the CGEs. Viz. the setting up of the 7th CPC and the withdrawal of the PFRDA Bill. 
  
                We send herewith the joint Circular letter issued by the three organizations on 23.3.2013 calling upon its units to organize a joint demonstration on 29th April, 2013 in front of all offices throughout the country.  The affiliates and State Committees are requested to take initiative in organizing the programme with maximum participation of members of the three organizations at a mutually agreed Central place in all Cities/towns and other places.  All Units should be requested to send the telegram to the Prime Minister and a report of the extent of participation sent to the Confederation CHQ by 3rd May, 2013.  We shall review the participation in the programme at our National Conference at Kolkata.

As  you are aware, the Government in reply to a question raised in the Parliament has stated that setting up of the 7th Central Pay Commission  for effecting wage revision of central Government employees is not presently under its consideration.  You will recall, that  a similar statement was made by the then Finance Minister, when the demand for setting up the 6th CPC was raised by the employees.  The Joint movement of the Central Government employees, for which we created the platform of the Steering Committee of the organizations participating in the JCM under the leadership of Late Com. J.P. Chaubey, the then General Secretary of All India Railway men Federation could ensure that the Government rescind its stand then and set up the 6th CPC.  The real value of wages determined by the 6th CPC has now been eroded to the extent of above 100% due to the unprecedented inflation in the economy and spiraling rise in the prices of essential commodities.  While the Government permits wage negotiation and revision in the fully owned Public Sector Undertakings every five years, the denial to revise the wages of Central Government employees despite such large scale erosion in the real value of wages is absolutely unjustified. 
  
The Government had been persisting with the enactment of the PRFDA Bill in the Parliament in almost all sessions ever since the UPA II Government took over.  Ironically they could elicit support from the main Opposition Party in the country for this ill advised enactment.  Lakhs of new workers who have joined in various organizations of the Government since2004 are worried of their future, which is forlorn and bleak, in the wake of the denial of an age old social security scheme of Pension.  We have been together opposing this move right from the day, the NDA Government introduced the bill in the Parliament in 2003.  However, our efforts, actions and objections have all been ignored with disdain by the Government. Though they could not muster enough support required to pass the bill in the Parliament, the Union Cabinet has recently taken the decision to allow 49% FDI in the pension fund. 
  
We are to channelize our efforts through a wider platform of Unity. Efforts are on anvil to bring about such a platform.  In the meantime, we have decided to call upon all Units and Branches of AiRF, Confederation and AIDEF to organize Demonstration on 29th April, 2013. in front of all offices and send the following telegram to the Prime Minister.
