Expected DA: Expected announcement of DA of 10% in September 2013
Generally, Central Government announces DA for the employees twice in a year, effecting on January and July. But the last announcement for DA, came only in April and it was 8% and the total DA was 80% of the basic pay. As per the AICPIN calculations for the last six months, (from January to June 2013) DA is to be fixed at 10%. Employees are eagerly awaiting for the announcement of the same in September itself without any delay from the government. This is the second time that the DA will be 10% after the 6th CPC came into effect. This clearly shows the price rise for essential commodities in India. The state government employees also awaits for the announcement. Let us hope that the government announces the DA in second week of September after their cabinet meeting and discussions.

MEMORANDUM

Subject : Grant of ex-gratia payment to the State Government Pensioners.

The undersigned is directed by order of the Governor to say that in order to provide some relief to the State Government Pensioners during the ensuring festivals, the Governor has been pleased to decide that all State Government Pensioners including the holders of provisional pension who retired prior to 30.9.2012 and also the pensioners who retired or died after 30.9.2012 but prior to 01.09.2013 and whose basic pension plus relief on pension as on March 31, 2013 did not exceed Rs.22000/-(Rupees twenty two thousand) only and are not eligible for ad-hoc bonus shall be paid an ex-gratia grant of Rs. 1000/- (Rupees One thousand) only in lump per head.

2. The charge is debitable to the head “2071-Pensions and other retirement Benefits-01 Civil-800-other Expenditure-NP-001-fund required for meeting other expenditure-V-04-Pension / Gratuities” during the current financial year.

3. The ex-gratia sanctioned herein will also be admissible to :-
i) The holders of family pension, ex-gratia family pension and adhoc family pension;
ii) Pensioners (including widow pension holders) who draw their pension sanctioned under French Pension Rules;
iii) Holders of extra-ordinary pension; and
iv) Holders of ex-gratia pension.

The benefit will also be admissible to the pensioners of the undivided Government of Bengal and the pensioners of the erstwhile East Pakistan (now Bangladesh) Government who migrated to West Bengal and are receiving pension under “Provisional Payment of Pension Scheme”.

4. The ex-gratia grant sanctioned herein will not be admissible to the special categories of pensioners, such as :-

i) Pensioners who have migrated from Pakistan ;
ii) Political Pensioners ;
iii) Special Pensioners ;
iv) War Risk Pensioners ;
v) Pensioners governed by the All India Services Rules.

5. The benefit will also not be admissible to those who are entitled to ad-hoc bonus sanctioned by the State Government and those who are employed/re-employed under any Public Undertakings/Statutory Bodies under the Government and are in receipt of bonus or ex-gratia payment in lieu there of during the current financial year.

6. State Government pensioners who draw their pension through Public Sector Banks will get this ex-gratia grant through their respective Bank Accounts. The Principal accountant General (A&E), West Bengal will issue an authority for this purpose to all such Banks under the Kolkata Payment Scheme immediately on receipt of this order so that the pensioners may draw the ex-gratia grant immediately to make their commitments for their festival. The Treasury/Sub-Treasury Office will take appropriate steps for issue of cheque to the respective paying branches of the Banks and Post Offices, so that the pensioners receiving pension through Banks and Money Order get the payment of ex-gratia immediately to meet their commitments for their festival. No authority of the Principal Accountant General (A&E), West Bengal will be required for this purpose.

7. Subject to para 6 above, this order will also be applicable to those who are eligible for this ex-gratia grant but whose pension/family pension has not yet been sanctioned. In their cases and in the case of persons who are drawing provisional pension, this amount of ex-gratia will be drawn by the authority competent to draw provisional pension in the same manner as the amount of provisional pension is drawn by him. In their cases, the facts of payment of ex-gratia grant should be intimated to the Principal Accountant General (A&E), West Bengal at the time of forwarding their pension papers for final sanction of pension.

This benefit of ex-gratia grant of Rs. 1000/- per head as has been sanctioned in this memorandum for the State Government Pensioners will also be allowed to the teaching and non-teaching Pensioners of State aided Non-Government Educational Institutions and Pensioners of Panchayats, the Pensioners of Municipal Corporations/Municipalities/Local Bodies and other Organisations for whom pension is authorized either by the Accountant General, West Bengal or the DPPG, West Bengal. In such cases the respective Administrative Department may sanction the benefit of ex-gratia payment @ Rs. 1000/- per head this year to the pensioners concerned under their control without making any further reference to Pension Branch of this Department.

The payment of ex-gratia as sanctioned herein above should be made by 6th August, 2013 for the Muslim Pensioners / Family Pensioners and other than Muslim Pensioners / Family Pensioners the benefits should be disbursed in between 23rd September,2013 to 30th September,2013.

According to the official order, the State government of West Bengal has decided to issue Rs.1000 as ex-gratia to pensioners and family pensioners.

Ahead of festival seasons the pensioners of WB state will get an ex-gratia of Rs.1000 in lump per head. The payment will be made to the pensioners and family pensioners between 23.9.2013 to 30.9.2013.

The following categories are eligible to get ex-gratia…

The holders of family pension, ex-gratia family pension and adhoc family pension;
Pensioners (including widow pension holders) who draw their pension sanctioned under French Pension Rules;

The undersigned is directed to say that on the basis of the vacancy position intimated by CS.I Division, it has been decided by the competent authority to prescribe the range of seniority for the Select List of Assistant of CSS for the Years 2009 (Seniority Quota).

3. In order to avoid any disparity which may arise if the promotions are made on the basis of Cadre Seniority, the competent authority has also approved the range of seniority for promotion UDCs CSCS to Assistant Grade of CSS for the Select List Years 2009, on the basis of CSL of UDCs of CSCS finalized as per the information received from the Cadre Units and circulated by this Department vide OM No.20/53/2008-CS.II(B) Vol.II dated 16.12.2011.

4. The range of seniority for the Select List of Assistant of CSS for the year 2009 is as follows:

5. Cadre Units are also informed that the vacancies in SL 2009 may undergo a change. As no UDCs of ST category having 10 years of approved service are available for the Select List Year 2009, these unfilled vacancies are to be carried forward to the next Select List Years.

6. A list of UDCs (as in the Annexure-I) presently working as ad-hoc Assistants tobe considered for regularization is enclosed. Cadre Units are requested to take immediate action for their regularization by appointing them as Assistants against the Select List Year 2009 by conducting DPC within a period of one month. The Cadre Units must ensure that no official without vigilance clearance/unfit is appointed to Assistant Grade. It is also stated that the UDCs who are not in CSCS, due to retirement, technical resignation (and holding no lien on the post), VRS etc., may not be considered for promotion to Assistant Grade as they are not available for actual promotion.

7. All the eligible officials, in the said attached Annexure-I, may be appointed ‘as is where is basis’ i.e., in the Cadre Units where they are presently working within the sanctioned strength in that Cadre Unit. A copy of the appointment order may be endorsed to this Department for records. The seniority of these officials in Assistant Grade would be as per the CSL of UDCs prepared, circulated and finalized by this Department. Cases of refusal of promotion may be dealt with as per instructions contained in Department’s OM No.22011/5/86-Estt.(D) dated 10.04.1989. Relevant extract of the said OM was circulated vide this Department’s OM No. 5/1/2008-CSI(S) dated 08.04.2011.

8. A consolidated report indicating the name and details of the officials who have been appointed/promoted to Assistant Grade against the Select List year 2009 and a list of those UDCs who have not been promoted to Assistant Grade, with reasons, may also be furnished to this Department in the prescribed proforma (Annexure-II) by 10th September, 2013.

9. Further, it shall be specified in the orders to be issued by the Cadre Units that the appointment of these officials would be subject to the Outcome of W.P. No.209/2013 filed by Shri Ravinder Kumar Jha and others before the Hon'ble High Court of Delhi and order by Competent Court in any of the connected matters.

In reference to MOHFW OM No. S.11011/23/2009-CGHS D II / Hospital Cell (part-IX) dated 14-02-2013 and this Directorate letter No. S11045/23/2013/CGHS D-II (HEC)/CGHS (P)/(Pt) dated 15-07-2013 for continuous fresh empanelment of Private Hospitals & Diagnostic Centers under CGHS Meerut, a committee was formed with two senior most CMOs headed by undersigned including Consultant as Special Invitee. Inspection for authentication of documents submitted was carried out by Transparency officer, CGHS Meerut, Office Superintendent CGHS Meerut & Sr. Consultant CGHS Meerut as Special Invitee. The qualified list of Hospitals & Diagnostic Centers is according to category and purpose attached as Annexure "A" with this OM (on the recommendation of Hospital Committee) for One Year or Fresh Empanelment whichever is earlier.

1. The Hospitals & Diagnostic Centers who have qualified to be empanelment under CGHS, Meerut have submitted the Draft MOA with CGHS along with performance Bank Guarantee are approved for empanelment of Private Hospitals & Diagnostic Centers under CGHS, Meerut with effect from date of notification of the OM. As fresh empanelment mentioned at Sr. No 10, 11, 17 & 18 and from Sr.No 1 to 4 have added additional facilities after giving an undertaking on Rs.100.00 rupees Non Judicial Stamp paper and remaining are old empanelled Hospitals & Diagnostic Centers.

2. The empanelment shall be for a period of one year from the date of notification or fill new empanelment process whichever is earlier.

Sub: Payment of Travelling Allowance & Daily Allowance to the Non-official Members of Railway Users’ Consultative Committees and National Railway Users’ Consultative Council (NRUCC).

Please refer to this offiec letter No.2001/TG-I/24/TA/DA dated 08.01.2002 on the subject quoted above wherein the rates of Travelling Allowance / Daily Allowance payable to Members of Railway Users’ Consultative Committees and National Railway Users’ Consultative Council were, inter alia, advised.

2. The rates of TA/DA payable to Non-official Members have been reviewed and it has been decided to revise the rates of TA/DA as under:

Dearness allowance as Dearness Pay

While answering to a question raised by our Hon’ble Member of Rajya Sabha Shri. Sardar Balwinder Singh Bhundar, the Minister of State in the Ministry of Finance (E and FS) Shri.NamoNarain Meena replied in a written form on 7th May, 2013 that the ‘5th Pay Commission had recommended that Dearness Allowance should be converted into Dearness Pay each time the Consumer Price Index increases by 50% over the base index used by the last pay Commission. Accordingly the Government issued orders on 27.02.2004 for merging of 50% of the DA with the basic pay w.e.f.01.04.2004.

The 6th Central Pay Commission had recommended not to merge Dearness Allowance with basic pay at any stage. Government has accepted this recommendation vide Resolution dated 29.08.2008. Hence the question to merge DA with basic pay does not arise. However, the rate of DA is being revised at periodic intervals’.

GOVERNMENT TO GO FOR REVIEW ON HIERACHIAL GRADE PAY?

When all Government Servants are anxiously waiting to hear a decision from the Government in regard to grant of grade pay in promotional hierarchy at the time of 1st/2nd Financial upgradation as per the CAT, Principal Bench Judgement, it is given to understand that the government is opting to go for judicial review.  The government instead of implementing the judgement gracefully, which will benefit the employees in general and particularly the employees at lowest rung.

It is a fact that grant of Hierarchical grade pay is detrimental to the interest of employees.  The Hon’ble CAT has rightly observed and opined that any new scheme brought in place of old one should be beneficial than that that of the existing one.  It is quite unfortunate that that the government, instead of sticking to  its guns, should have implemented the judgement as it benefits the employees at lowest rung.

It is high time that the Confederation of Central Government Employees to take up the issue at appropriate level for implementation.  It is pathetic to note that the confederation is not raising its voice even today on any issue pertaining to LDCs.

No one can deny the fact that injustice took place while framing the Grade Pay structure at lowest rung.  Better late than never.  It is appealed to all  leaders to put their minimum effort in implementing the CAT Judgement which will benefit maximum number of employees.
