Subject: Chargeability of Interest under Section 234A of the Income-tax Act, 1961 on self-assessment tax paid before the due date of filing of return of income- regarding

Interest under Section 234A of the Income-tax Act, l961 (hereinafler the Act) is charged in case of default in furnishing return of income by an assessee. The interest is charged at the specified rate on the amount of tax payable on the total income, as reduced by the amount of advance tax, TDS/TCS, any relief of tax allowed under section 90 and section 9oA, any deduction allowed under section 91 and any tax credit allowed in accordance with the provisions of section 115JAA and section 115JD of the Act. Since self-assessment tax is not mentioned as, a component of tax to be reduced from the amount on which interest under section 234A of the Act is chargeable, interest is being charged on the amount of self-assessment tax paid by the assessee even before the due date of filing of return.

2. It has been held by the Hon’ble Supreme Court in the case of CIT vs Prannoy Roy, 309 ITR 231 (2009) that the interest under section 234A of the Act on default in furnishing return of income shall be payable only on the amount of tax that has not been deposited before the due date of filing of the income-tax return for the relevant assessment year. Accordingly, the present practice of charging interest under section 234A of the Act on self-assessment tax paid before the due date of filing return was reviewed by CBDT.

3. The Board has decided that no interest under section 234A of the Act is chargeable on the amount of self-assessment tax paid by the assessee before the due date of filing of return of income.

4. This Circular may be brought to the notice of all officers for compliance.

Income Tax Department Initiates Investigation into Issuance of Cheques by Companies Which are Acting as Entry Operators to Convert Illegal Cash into Legitimate Money

Income Tax Department, Ministry of Finance, Government of India had initiated investigation into issuance of cheques by companies which are acting as entry operators to convert illegal cash into legitimate money. Recently in Kolkata, this investigation led to detection of substantial unaccounted income. In these cases, the unaccounted income was sought to be converted into legitimate money with the help of non-genuine companies which were acting as entry operators.

Similarly and based on media reports, enquiry was initiated in Delhi into issuance of cheques by companies which were alleged to be non-genuine and entry operators. The companies and their Directors could not be traced at the addresses given to Banks and Ministry of Corporate Affairs. Examination of the accounts of these companies revealed that they have issued accommodation entries to several persons and entities for substantial amounts. It was also found that sources for such entries were prima facie not genuine. To carry forward the investigation process, notices were issued to about 50 persons and entities including two political parties on 9th February, 2015. These notices seek information about the identity of the contributors and other relevant details which are necessary to complete the process of investigation.

Sir/Madam,

It is proposed to fill up the post of Registrar of Copyrights, Copyright office, under the Ministry of Human Resource Development on deputation basis The post is a non-CSS post to be filled through Civil Services Board procedure.

2 The Registrar of Copyrights is the head of the Copyright Office and all copyright registrations are issued under his superintendence and direction. He exercises the powers of a Civil Court for disposing copyright applications and act as competent authority to allow changes as per law. He gives effect to the orders of Copyright Board and register/monitor functioning of Copyright societies. He will have to coordinate with various Ministries/Departments, liaison with various higher education institutions and all the stakeholders from various fields and strata of the society. He is also required to participate in negotiations for drafting the legal text for various proposed treaties related to copyright matters in WIPO.

3 The Officers of the rank of Deputy Secretary/Director of the Government of India or equivalent level, eligible for appointment under the Central Staffing Scheme are eligible for the post. The period of deputation is 4/5 years for Dy. Secretary/Director respectively.

4 The post may be circulated amongst officers eligible to be appointed at Deputy Secretary/Director or equivalent level in the Government of India on priority basis. Names of willing and eligible officers who can be spared by the State  Governments/Ministries/Departments may be forwarded to the Department along with cadre clearance, vigilance clearance, detailed bio-data in the enclosed Perfonna and CR Dossier. For officers working in the cadre, it may also be ensured that the ‘Cooling off, after a previous stint on deputation, if any, is completed and the officer is eligible to be appointment on Central Deputation as per instructions.

Sports Ministry Revises Rashtriya Khel Protsahan Puruskar Scheme

The Ministry of Youth Affairs & Sports has revised the Scheme of Rashtriya Khel Protsahan Puruskar, which was introduced in 2009 to encourage and promote involvement of corporates, sports promotion boards etc., in the promotion and development of sports in the country. In the revised scheme, Rashtriya Khel Protsahan Puruskar will be given in following four categories:

    (i) Identification and nurturing of budding/young talent
    (ii) Encouragement of sports through Corporate Social Responsibility (CSR)
    (iii) Employment of sportspersons and sports welfare measures
    (iv) Sports for Development.

In the revised Scheme, eligibility criteria for all four categories have been prescribed. As ‘Training to promote rural sports, nationally recognized sports, Paralympic sports and Olympic sports’ have been included in the Schedule VII of the Companies Act 2013 and the companies can now spend on promotion and development of sports from the funds earmarked for Corporate Social Responsibility (CSR), a specific category for ‘Encouragement of sports through Corporate Social Responsibility’ has been provided for in the revised Scheme.

As non-governmental organizations are also doing a lot of work in promotion and development of sports, a separate category ‘Sports for Development’ has been provided for exclusively for NGOs to recognize their contributions.

43% salary increase for all categories of employees in Andhra Pradesh

Naidu matches KCR, hikes staff salary by 43%

Under pressure from his Telangana counterpart to match the salary hike for government staff, Andhra Pradesh chief minister N Chandrababu Naidu on Monday announced a 43% salary increase for all categories of employees. The Pay Revision Commission (PRC) had recommended a hike of 29%, but both AP and Telangana chose to peg the increase at 43%.

The hike will come into retrospective effect from June 2, 2014. The arrears will be credited in the general provident fund account of the staff and the revised salary paid from February onwards. More than six lakh employees and pensioners stand to benefit from the salary hike. “Though the state is going through a financial crisis, we have taken this decision keeping in mind the welfare of the employees. Now, I expect them to deliver the results in the form of better governance and better revenue collections,” Chandrababu Naidu told the media while announcing the salary hike.

The hike would cost the exchequer close to Rs 7,000 crore annually. At present, excluding the hike, the state generates annual revenue of Rs 47,000 crore but has a burden of Rs 53,000 crore in the form of salaries, pensions and interests on loans.

With this increase, the salaries of AP government employees have more than doubled in the last five years. The 63 per cent hike in dearness allowance effected during the last few months and the current 43 per cent hike will result in a 106 per cent hike in the salaries of all employees working in the state government. It would be near impossible for central government employees to get their salaries doubled even in 10 years whereas the AP and Telangana employees have achieved this rare feat in just five years.

Sub: Inter-action meeting with the Seventh Central Pay Commission on NFIR’s memorandum-reg.
Ref: NFIR’s letter No.IV/NFIR/7th CPC/CORRES/Pt. V dated 02/08/2014.
Federation vide its letter dated 02/08/2014, addressed to the Secretary, Seventh Central Pay Commission had made following suggestions with regard to holding interaction meetings:
a) Inter-action meetings may be fixed giving us reasonable advance intimation to enable us to reschedule our other programmes,
b) Meeting/hearing may be fixed department wise to facilitate us to meet the Pay Commission along with the representatives of the conccrned department/category.
c) In the Railways, there are eight major departments with hundreds of categories. Eight different dates for explaining our case may kindly be considered.
d) Inter-action meetings may also be convened for explaining the case of miscellaneous and isolated categories in Railways.
e) Separate date and time be provided to facilitate the NFIR to explain uniqueness of railways as well unique nature of duties of railway employee in general.
Federation is yet to receive response from the Seventh Central Pay Commission.
In this connection, NFIR desires to mention that the 6th CPC had allotted a total time of 28 hours to us in different spells/different dates to explain the case of Railway employees belonging to various categories in different departments. Federation trusts that similar time slots would be provided to us by the 7th CPC as well.
NFIR. therefore, once again requests the Hon’ble Chairman Seventh Central Pay Commission to arrange to allot adequate time slots and convey to the Federation.

The undersigned is directed to tefer to OM of even number dated 16.12.2014 on the subject noted above under which all Pr.CCsIT/DGsIT were requested to take necessary steps to install Aadhar Enabled Diametric Attendance System(AEBAS) in the offices under their administrative control within the time prescribed by the Government (by 31.12 2014 in Delhi and 26.1.2015 in rest of India) and to submit a compliance report by 15th February,2015.  Further, pursuant to a letter dated 29.12.2014, received from the D/o Electronics & Information Technology pointing to the low registration of employees. in Delhi by CBDT for the Aadhar Enabled Biometric Attendance System, all Fr.CCsIT/DCisIT were also requested vide OM of even number dated 7.1.2015 to ensure that necessary steps for expediting registration of all
officers/employees are taken on priority by the nodal officers for implementation of the AEBAS in their offices and a report submitted by 20.1.2015. A reminder in this regard recapitualating in brief the action to be taken and details of the officers in NIC who may be contacted by the nodal officers for seeking any clarification/guidance was also issued vide OM of even number dated 22.1.2015.
Based on the feed back received from different officers the position on the implementation of AEBAS has been reviewed by • the Chairperson, CBDT who has observed as under:-
"Very tardy Progress. It appears that field offices have assumed that their work ended
with appointment of nodal officers. Please send a self contained advance reminder w.r.t
compliance report due on 15.2.2015"
It is therefore requested that the matter may he looked into and nodal officers appointed for the implementation of the AEB.AS may be directed to take necessary action in this regard keeping in view the compliance report that is to be submitted to this office by 15.2.2015 as  directed by the Chairperson, CBDT

Kendriya Vidyalaya Sangathan to recruit 5,000 teachers


ALLAHABAD: Faced with the problem of adverse pupil-teacher ratio (PTR) in many Kendriya Vidyalayas of the country and strictly adhering to the guidelines of Right to Education Act (RTEA), KV Sangathan would soon be recruiting over 5,000 new teachers. Among these, over 400 new teachers would be recruited in Varanasi region.
Of 1,100 odd KVs spread across the country, there are many where the strength of students is over 50 per class and in some cases, it reaches around 65.
Deputy commissioner, KVS, regional office, Varanasi, PV Sai Ranga Rao said: "KVS had always been following RTE. From the coming academic session in April 2015, we would adhere to the set norms in every respect, including PTR." In accordance to RTE, the TTR would be brought down to the prescribed norm i.e. one teacher for every 40 students (for class I to 5) and one teacher for every 35 students (for class 6-8).

KVS has asked principals of all the schools to furnish information pertaining to how many more teacher they would require to follow the norms of PTR as per the RTE Act. "Now that the number of teachers to be recruited is known, the Sangathan would soon start recruitment process," Rao said.
Principal of KV, New Cantt, Shalini Dikshit said that the work load of teachers in a class of 65 students would be divided among two teachers. It will benefit pupils.
Rao said: "We would require more teachers for science which could be around 150. Likewise, the numbers could be anything around 90 for mathematics, English and other subjects."
