Budget session from Feb 23, General Budget on Feb 29

The Budget Session of Parliament will commence on February 23 that will focus largely on the financial business of the government, which will present the general budget on Feb 29.

But there will be no curtailment of the session or the recess period on account of Assembly elections in five states due shortly.

This was decided at a meeting of the Cabinet Committee on Parliamentary Affairs, chaired by Home Minister Rajnath Singh.

“The budget session of parliament will commence on February 23. The Rail Budget will be presented on February 25, the pre-budget economic survey on February 26 and the General budget on February 29.

“The first part of Budget session will end on March 16 and the second part will be convened from April 25 to May 13,” Parliamentary Affairs Minister M Venkaiah Naidu told reporters after the meeting of CCPA.

He said there were suggestions for curtailing the recess period due to assembly elections in five states but the government as well as political parties wanted a full session.

“In 2011, the then government had decided not to refer bills to Standing Committees in the budget session when states were going to polls and there were demands to curtail the session.

“But the government today decided that bills will be referred to standing committees for examination during recess period,” Naidu said.

On the basis of the results of the Combined Defence Services Examination (I)-2015 held by the Union Public Service Commission on February15, 2015, 8488 candidates with the following Roll Numbers have qualified for being interviewed by the Service Selection Board of the Ministry of Defence, for admission to (i) Indian Military Academy, Dehradun, 140th Course commencing in January, 2016 (ii) Indian Naval Academy, Ezhimala, Course commencing in January, 2016 (iii) Air Force Academy, Hyderabad (Pre-Flying) Training Course commencing in January, 2016 i.e. No. 199/16F/PC (iv) Officers’ Training Academy, Chennai, 103rd SSC Course (for Men) commencing in April, 2016 and (v) Officers’ Training Academy, Chennai, 17th SSC Women (Non-Technical) Course commencing in April, 2016.
The ratio of candidates shortlisted for the examination per vacancy is 1:18.29
The candidature of all the candidates, whose Roll Numbers are shown in the lists below, is provisional. In accordance with the conditions of the admission to the examination, they are required to submit the original certificates in support of age (date of birth), educational qualifications, NCC (C) (Army Wing/Senior Division Air Wing/Naval Wing) etc. claimed by them, alongwith attested copies of thereof, to Army Headquarters, A.G.’s Branch/Rtg./CDSE Entry, West Block 3, Ground Floor, Wing No.I, R.K. Puram, New Delhi-110066. In case of IMA/SSC first choice candidates and IHQ of MoD NAV ( OI & R Section), Room No. 204, C-Wing, Sena Bhawan, New Delhi-110011 in case of Naval first choice candidates and PO3 (A) Air Headquarters, ‘J’ Block, Room No. 17, Opp. Vayu Bhawan, Moti Lal Nehru Marg, New Delhi-110011 in case of Air Force as their first choice. The original Certificates are to be submitted within two weeks of completion of the SSB Interview and not later than November 13, 2015 (February 01, 2016 in case of SSC only). The candidates must not send the original certificates to the Union Public Service Commission.

In case, there is any change of address, the candidates are advised to promptly intimate directly to the Army Headquarters/Naval Headquarters/Air Headquarters as the case may be.

The Union Public Service Commission have a Facilitation Counter near Examination Hall Building in its Campus. Candidates may obtain any information/clarification regarding this examination on working days between 10.00 AM to 5.00 PM, in person or over telephone Nos. 011-23385271, 011-23381125 and 011-23098543 from this Facilitation Counter. Candidates can also obtain information regarding their result by accessing UPSC website http.//www.upsc.gov.in

The marks-sheet of candidates who have not qualified, will be put on the Commission’s website within 15 days from the date of publication of the final result of OTA (after conducting SSB interview) and will remain available on the website for a period of 60 days.

Sports Ministry Revises Rashtriya Khel Protsahan Puruskar Scheme

The Ministry of Youth Affairs & Sports has revised the Scheme of Rashtriya Khel Protsahan Puruskar, which was introduced in 2009 to encourage and promote involvement of corporates, sports promotion boards etc., in the promotion and development of sports in the country. In the revised scheme, Rashtriya Khel Protsahan Puruskar will be given in following four categories:

    (i) Identification and nurturing of budding/young talent
    (ii) Encouragement of sports through Corporate Social Responsibility (CSR)
    (iii) Employment of sportspersons and sports welfare measures
    (iv) Sports for Development.

In the revised Scheme, eligibility criteria for all four categories have been prescribed. As ‘Training to promote rural sports, nationally recognized sports, Paralympic sports and Olympic sports’ have been included in the Schedule VII of the Companies Act 2013 and the companies can now spend on promotion and development of sports from the funds earmarked for Corporate Social Responsibility (CSR), a specific category for ‘Encouragement of sports through Corporate Social Responsibility’ has been provided for in the revised Scheme.

As non-governmental organizations are also doing a lot of work in promotion and development of sports, a separate category ‘Sports for Development’ has been provided for exclusively for NGOs to recognize their contributions.

Expected DA for January 2015 – DA Hike Almost Decided..!

Until the 6th CPC, the Dearness Allowance didn’t increase by more than 1 or 2%. It was only after the 6th Pay Commission that it began to increase substantially. With the skyrocketing prices of essential commodities, Dearness Allowance too began to rise. Twice, it touched double digits. In July 2013 and Jan 2014, within 12 months the DA has leapt on to the 100%. We cannot forget that the each instalment gave 10%. Then, it slumped.
Dearness Allowance, which is given once every six months, is likely to be 6% hike from January 2015. This is 1% less than the previous hike of additional DA from July 2014. The total DA from Jan 2015 will become 113%.
As soon as the first instalment is confirmed, expectations will start growing about the second instalment, i.e., ‘Expected Da from July 2015‘. The second instalment of the year will cover the months between July and December 2015. This will be the last time that the DA hike will be calculated based on the method recommended by the 6th Pay Commission. DA of 2016 will be calculated based on the recommendations made by the 7th Pay Commission.

How DA is calculated..?
Month Year /  CPI(IW) BY 2001=100 / Total / Average / App. DA / DA%
First is the month and year. Then the CPI (IW) Base Year 2001=100 and the relevant data. In the next column, you have the sum total of all the 12 months, i.e., the total of the declared AIPCIN numbers for the past 12 months. Next comes the division of the sum total by 12.

The next step is the most crucial one. You will have to find out by how much it exceeds 115.76. You will have to calculate the excess as percentage of 115.76.

  • NFPE & AIPEU-GDS (NFPE) says GDS are part of Central Govt. Employees and they should be included in 7th CPC itself.
  • Confederation of Central Govt. Employees & Workers says that GDS are part of Central Govt. Employees and they should be incuded in 7th CPC itself.
  • JCM National Council (staff side) orgisastions including Railway & Defence Federations says GDS are part of Central Govt. Employees and they should be included in 7th CPC itself.
  • BUT RECOGNISED GDS UNION OF SHRI. MAHADEVAIAH ACCEPTED THE GOVT. STAND THAT GDS ARE NOT PART OF CENTRAL GOVT. EMPLOYEES AND HENCE HE IS DEMANDING SEPERATE COMMITTEE FOR GDS.  HE DON’T WANT GDS TO BE INCLUDED IN 7TH CPC.  HIS MAIN DEMAND IN THE CHARTER OF DEMANDS IS SEPERATE COMMITTEE FOR GDS .
  • NFPE & AIPEU-GDS (NFPE) declared joint indefinite strike under the banner of JCA from 2015 May 6th for inclusion of GDS in 7th CPC.
  • FNPO & NUGDS also declared joint indefinite strike under the banner of JCA from 2015 May 6th for inclusion of GDS in 7th CPC.
&     Confederation, Railways & Defence Federations organised joint National Convention of entire JCM staff side orgnisations and decided to organise massive Parliament March in April 2015 to declare indefinite strike of entire Central Govt. Employees.  Inclusion of GDS in 7th CPC is included in the charter of demands as number one demand.

RECOGNISED GDS UNION OF SHRI MAHADEVAIAH DON’T WANT JOINT STRIKE OF GDS & REGULAR EMPLOYEES.  HE ALWAYS DECLARES FRAGMENTED STRIKE TO TORPEDO THE UNITY OF GDS AND REGULR EMPLOYEES.  HE IS DESPERATELY TRYING TO RETAIN HIS CONTROL OVER GDS.  HE HAS WRITTEN TO THE GOVT. NOT TO ALLOW NFPE & FNPO TO DISCUSS GDS ISSUES.  GOVT. LET US ORGANISE JOINT INDEFINITE STRIKE OF FIVE LAKHS GDS & REGULAR EMPLOYEES FROM 2015 MAY 6TH UNDER THE BANNER OF POSTAL JOINT COUNCIL OF ACTION (NFPE, FNPO, AIPEU-GDS (NFPE) & NUGDS) DEMANDING INCLUSION OF GDS IN 7TH CPC & GRANT OF ALL BENEFITS OF REGULAR EMPLOYEES TO GDS ALSO.
RECOGNISED GDS UNION OF MAHADEVAIAH IS AGAINST FILING CASE IN SUPREME COURT  for grant of Civil Servant status and all benefits of regular employees to GDS.  NFPE & AIPEU-GDS (NFPE) has filed a Writ Petition in Supreme Court and after the preliminary hearing Supreme Court transferred the case to Delhi High Court.  The next hearing of the case in Delhi High Court is on 4th February, 2015.

But Shri. Mahadevaiah had filed a case in the Karnataka High Court for his own benefit requesting to grant Foreign Service benefits to him.  (Writ Petition No.24106/2005 (S.CAT).

When he has filed Writ Petition in High Court for his own benefit it is perfectly alright, but when NFPE & AIPEU-GDS (NFPE) filed case in Supreme Court for the benefit of 2.76 lakhs GDS he is ridiculing it and opposing it.

A Committee for the cadre restructuring of the Central Secretariat Stenographers’ Service with the following composition and terms of reference is constituted:

Composition: -

(iii) Joint Secretary (Pers.), Department of Expenditure : Member

Terms of Reference:-

(i) To review the structure of CSSS cadre so as to harmonise the functional requirements with the career expectations of its members.

(ii) To assess the magnitude of stagnation in various grades of CSSS and suggest remedial measures – both short term and long term – to reduce promotional blocks and at the same time prevent gaps from building up.

(iii) To suggest measures to enhance the effectiveness of service and capacity building of its members.
(iv) To take into view the suggestions of the stakeholders, viz. participating Ministries, Associations and members of the service for cadre review.

(v) To review the entitlement of stenographic assistance to various category of officers of Government of India.

(vi) To examine any issue as referred to it by the cadre controlling authority of CSSS,

Subramanian Swamy raises one-rank one-pension issue with Manohar Parrikar

NEW DELHI: Seeking justice for ex-servicemen, BJP leader Subramanian Swamy today met Defence Minister Manohar Parrikar and raised the issue of one-rank one-pension.

He reminded Parrikar that the implementation of same-rank same-pension scheme was BJP’s 2014 election promise made by Prime Minister Narendra Modi during the campaigning at Bhiwani.

In his speech at Bhiwani, Modi had stated that if BJP came to power after the Lok Sabha elections, the BJP government would do justice to the ex-servicemen of the armed forces on the same rank-same pension issue.

One-rank, one-pension means soldiers of the same rank and the same length of service get the same pension, irrespective of their retirement date. For an example, a sepoy who retired in 1995 would get the same amount of pension as the one who retired in 1996.

According to Swamy, Parrikar told him that he is seized of the matter and is closely studying the issue with a view to finding a solution to the satisfaction of ex-servicemen.

The Defence Minister assured Swamy that an announcement on the issue of one-rank one-pension is expected to be made by the time of the Budget presentation in February next year.

The decision to implement the scheme was first announced by former Finance Minister P Chidambaram in the UPA government’s interim Budget in February this year. Chidambaram had allocated Rs 500 crore for it.
The NDA government had allocated Rs 1000 crore for the scheme in its July Budget this year.

Besides one-rank one-pension scheme, Swamy also brought to Parrikar’s notice some strategic issues regarding China’s defence capacity.

The meeting with CHAIRMAN AND MEMBERS of 7th Central Pay Commission was held at Bangalore 0n 24th August 2014 for about 50 minutes. Overall the meeting was on positive note.
The following members of COC Karnataka participated in the meeting.

  • Com P.S.Prasad General Secretary of COC Karnataka (Representing department Central Ground Water Board.)

  • Com M,Ramakrishna Joint Secretary of COC Karnataka (Representing department RMS).
  • Com Dominic Vijaya Anand Finance Secretary COC Karnataka (Representing department Postal Accounts).

The President Com Radhakrishna welcomed the Chairman and Members of the 7th CPC for the meeting.
The General Secretary Com P.S.Prasad presented the power point presentation.

The interactions were held for about 50 minutes with the Pay Commission officials,Com Radhakrishna, Com P.S.Prasad, Com Muthukumar , Com Vinod, & Com Ramakrishna spoke effectively on various subjects.
The following items and points were presented:

Bangalore Prices:

It was brought to the notice of the commission that the cost of living is high in Bangalore compared to other metro cities in the country and the prices of all essential commodities are comparatively high in the State of Karnataka. House rent is in the range of Rs 7000/- per month to Rs 35,000/- per month. The private school fees is from Rs 25,000/- to Rs 50,000/- per year. Donation is also too high, the cost of local transportation is from Rs 2000/- to Rs 10,000/- per month.
(This was only informative portion on prices)

Minimum Wage:


It was brought to the notice of the commission that:
a) Since Government is a model employer, they should provide minimum wages as per the 15 ILO conference and other wages as per the educational qualification & skill requirement of the job
b) Higher skill requirement due to computer usage and modernisation of equipment’s. The skill requirement is higher compared to earlier days due to technology advancement.
c) The higher inflation which is existing from the last eight years which is effecting the Government Employees, the money value has gone down to a large extent & there is erosion in wages calculation, whereas in private sector allowances are not taxed
(The commission Agreed to consider this on the lines of JCM memorandum)
It was brought to the notice of the commission that to attract higher talent to Central Government higher pay scales should be given.

(The commission was of the view that people choose their career on various aspects including wages. Wages of Government employees cannot be compared with private sector. It was pointed out by us that though the wages cannot be compared with private sector there is a need to keep the wages in central government that people will continue in government after joining. Chairman assured to examine this aspect)

EQUAL PAY FOR EQUAL WORK

It was brought to the notice of the commission that on Increment rate of 5% and Promotion policy.
a) As the Government employee put more and more service, he will be more trained to perform his duties in a better befitting manner. Thus the Government is more beneficial as good quality of work can be expected from an experienced official.
b) His family responsibility will increase with age.
c) They has to educate the children in professional courses, marriage of his children has to be performed, his medical expenses will also increase.
d) There should be adequate financial protection for him, the better rate of increment should motivate him to work more.
e) The person joining a Central Government Service is not just for the employment is for a whole career.
f) On promotion one shall get two additional increments subject to an minimum salary increase of Rs 3000/- per month as he will perform higher duties and responsibility’s.
g) He shall get not less than five financial up gradations in promotional hierarchy during his service to motivate him to work more.
h) Similarly the scientist are provided to FCS and get promotions every 4 years.
(The commission positively agreed to consider this suggestion.)

Consumer Price Index & Dearness Allowance Formula.

It was brought to the notice of the commission that on Consumer Price Index & Dearness Allowance Formula.
a) CPI as on 1/1/2006 was 115.76 points.
b) CPI as on 1/1/2014 was 237 points.
c) The CPI has increased by 121 points .
d) But the DA increased by just 100% as on 1/1/2014 from 1/1/2006.
e) The actual DA should have been 121 % not just 100% as on Jan 2014.
f) Actual increase in price rise is more than 200 % and DA should have been more than 200%.
g) 6 months average DA computation of Consumer Price Index should be provided to Central Government employees rather than 12 months average.
h) Rounding off DA be done whenever it crosses fraction more than 0.50
(The commission positively agreed to consider this suggestion.)

Allowances:

It was brought to the notice of the commission that on Allowances
a) All allowances such as HRA, Tour DA, CEA (tuition fees) , Cashier Allowances, etc. should be increased by four times.
b) OTA & Night Duty to be paid on par with Railways .
c) When ever there is an increase in Dearness Allowance, the above allowances be also increase as in the case of Transport allowance.
(The commission positively agreed to consider this suggestion.)

Transport allowance:

It was brought to the notice of the commission that on Transport allowance
a) The field oriented organizations like CGWB, Survey Of India, GSI, IBM, IMD, etc. most of the categories remain in fields, even Postal Employees and AG’s Employees are effected.
b) Now the field going staff are deprived of earlier CCA and present Transport Allowance as they cannot fulfill the condition of at least one day stay in a month in head quarters.
c) This condition of being present at Hqrs. Office at least a day in a calendar month becoming eligible for transport Allowances should be removed.
(The commission positively agreed to consider this suggestion.)

Taxes:

It was brought to the notice of the commission that on taxes:
a) The Fifth Central Pay commission in its report vide para no105.12 has said that Dearness allowance be paid free of net taxes as the DA is paid for compensation against price rise. All other allowances should also be paid net of taxes which has been examined by 5th CPC in para no 167.
(The commission agreed to examine this suggestion.)

Health Care system:

It was brought to the notice of the commission that on Health Care system
a) More CGHS hospitals should be made available or alternatively the person should have the option to choose any of the hospitals of his choice and the bill to be passed with AIMS rates.
b) Existing CGHS system needs improvement.
c) Proper ward entitlement should be made as per grades.
d) Cash less facility for hospitalization.
e) Autonomous bodies shall also be included in CGHS
(The commission to examine this suggestion, but not satisfied with demand of Cash less facility for hospitalization.)

It was brought to the notice of the commission that on following issues.


Other points:

a) Central Government Strength.
b) Non-filling up of vacant posts has resulted in increased work load on the existing employees.
c) Lower Spending by Central Government on its Employees.
d) Leave / Holidays.
e) 12 days Casual Leave.
f) Restrictions EL of 300 days to be removed.
g) The PSU are providing reward medals after 15 years, 25 years and end of service, similarly such reward should be provided to Central Government Employees.
h) In case of death of Government Servant during while on duties, his family members should get compassionate appointment not considering restrictions of 5%.
i) Education Loan should be provided.

2. The Committee had earlier met on 27th Nov 2013, 04th & 05th Feb 2014 and had detailed discussions.

3. The representatives of the Staff side informed that Postal Assistant cadre officials are getting promotions in promotional hierarchy to Grade Pay of Rs. 2800/- [PB-1] in Lower Selection Grade at a time when they are already placed in the Grade Pays’ of Rs. 4200/- [PB-2] or Rs. 4600/-[PB-2] on award of financial upgradation(s) under MACPS. Taking note of this factual position and detailed discussions, the following recommendations in respect to the cadre restructuring of Group ‘C’ employees were agreed to:-
(a) The post of SPMs in Single Handed Post Offices and Double Handed Post Offices will be placed in the Grade Pay of Rs.2800/- in the Pay Band PB-I.
(b) The post of Sub Postmasters in Triple Handed Post Offices and all other existing norm based HSG Posts in Post Offices will be placed in the Grade Pay of Rs. 4200/- in the Pay Band PB-II.
(c) All existing posts in HSG-II will be placed in the Grade Pay of Rs.4600/- in the Pay Band PB-II along with the existing HSG 1 Posts.
(d) After the implementation of the above restructuring/the officials in the Grade Pay of Rs. 4600/-, who have completed 2 years of regular service, will be granted the Grade Pay of Rs. 4800/- in the Pay Band -II on non-functional basis after following the usual procedure of non-functional upgradation(s).
(e) Cadre ratio as per the agreed position mentioned at (a) to (d) above, will be worked out and the ratio so worked out will be replicated to the SA cadre of RMS, PA cadre of Circle & Administrative Offices as also to the PA cadre of SBCO.
(f) In respect of Postmaster Grade I, Grade II and Grade III Posts, once the recommendations of this Committee are implemented; the matter will be examined in the light of the same.
(g) In the light of peculiar situation of Postman/Mail Guard cadre where the work for bulk of the cadre continues to remain the same; as a special case the Committee recommends the ratios as worked out in pursuance of (e) above may be considered for implementation for these cadres as well and that the cadre so restructured may concurrently get the benefit of MACP also.
(h) MTS being a common cadre in all Central Government Ministries/Departments’ will be extended the same benefits as commonly decided for them.

* CADRE RESTRUCTURING AGREEMENT SIGNED *

At last after several round of protracted negotiations with the administration, JCM Staff side, Departmental council ( NFPE & FNPO) has signed the cadre restructuring proposal. The staff side has tried to the best of its ability to make maximum improvement in the proposal. In spite of our hard bargaining we could not achieve 100 percent success. Our demand for separate higher pay scale for PO& RMS Accountants, Creation of separate cadre for System Administrators or grant of special pay/allowance, bringing MTS also under cadre restructuring etc is not accepted by the administration. Regarding Postmaster Cadre after much bargaining, it is agreed to examine our claim for higher pay scale after the present proposal is approved by the government.
As Govt has already appointed 7th CPC and the Pay Commission has already published the questionnaire, any further delay in completing the cadre restructuring will adversely affect the interest of Postal employees. We will take up the remaining issues, which are not agreed by the administration in the cadre restructuring committee with the 7thCPC in our memorandum and make one more effort to get a favourable recommendation.

Taking into consideration all the above aspects and also keeping in mind the larger interest of the employees, we have decided to sign the agreement

The Salient features of the agreement are as follows :
1. Number of LSG posts will increase from 8 % to 22 %
2. Number of HSG II posts will increase from 2 % to 12 %
3. Number of HSG I posts will increase from 1.5 % to 4 %
4. After completion of 2 years in HSG I the official will be promoted to 4800 GP (Non-functional Basis)
5. The above proposal will be applicable to RMS, Circle Office and SBCO in the same ratio
6. Postman/Mail guard will get the same ratio of promotion.
The present proposal is to be approved by Postal Board, DoPT & Finance Ministry. We will make all out effort to get the proposal implemented at an early date.

Bharat Pensioners Samaj’. One of the identified Pensioners’ Federation by GOI  M/O Personnel,  PG & Pensions-DOP& PW and a stake holder. In its capacity as one of the oldest & largest Pensioners Organization with over 500 Affiliated Associations, submits hereunder its reply to the questionnaire issued vide your D.O. No 7cpc/15/questionnaire   dated 9th April 2014.
As Pension is not independent of Salary. Salary structure also, is a matter of concern to pensioners. However, Bharat Pensioners Samaj limits its answers to Question Nos 1.1,1.2 , 10.1 &  10.1.2 under the heads ‘Salary’ & ‘Pension’ .
Q.1.1  The consideration on which the minimum and maximum salary in case of the lowest group c’ functionary and the maximum salary in case of a secretary level officer may be determined and what should be the ratio between the two.
Ans. Socialistic structure of the country , constitutional provisions for equality & reduction of vast  inequality in income & wealth between highest and lowest paid should be the main  considerationfor fixing maximum & minimum Salary.
The Ratio between maximum & minimum of Salary be brought down to  1: 9. Ensuring uniformly equal % rise in Salary of all employees by adopting a common multiplication factor.
4th CPC had determined the ratio between minimum & maximum of salary to be 10.7(Chapter 41 & 43). In accordance with  the basic fiber of a socialistic State this ratio should have gone reducing Pay Commission after Pay Commission. Even in capitalist countries like America & Britain this ratio is 1: 3.3 &1:5 respectively?  In  countries with weaker economy like Philippines this is 1: 9.5. VI CPC adopted conversion factor of  1.86 to arrive at the minimum of lowest pay Band, where as it adopted a factor of  3.37 for arriving at the highest scale. This shredded the very basic fiber of the Constitution of Indian Socialistic State by raising  the  ratio  between minimum & maximum of Salary to 1: 12.85. This negative and socially regressive effect of the 6th Central Pay Commission has had the effect of worsening wealth and income inequality not only between pre-and post-2006 retirees, but even within pre-2006 retirees wherein higher-ups got full parity in Pension(Through modified parity) .Adoption of  a ratio of 1:9 between minimum & maximum paid will therefore rectify to some extent the injustice done so far .
Defence Employee:
As far as Armed forces are concerned they do the supreme sacrifice for the country & must be the highest paid .For them the ratio between lowest & highest paid must not be more than 1:5.
Q.1.2  What should be the consideration for determining salary for various levels of functions between the highest level and the lowest level functionaries?
Ans. Equal  % rise in Salary of all employees should be the main consideration .Revise the highest existing Salary first. Divide the revised maximum Salary by 9 to arrive at the revised minimum Salary. Divide the revised minimum salary by existing salary. The factor so arrived may be adopted as common multiplication factor.
Q. No 10.1 New pension Scheme i.e The retirement benefits of all Central Government employees appointed on or after 1.1.2004 are covered by the New Pension Scheme (NPS). 
What has been the experience of the NPS in the last decade?

Ans. Withdraw New Pension Scheme: for following reasons:
(i) Pension of Govt. employees is a deferred wage. Since wage paid out to them
during the course of work tenure is kept low by design, to cater for pension.
(ii) He/She forgoes with interest 8.33% of govt. matching contribution to PF.
(iii) Pension is a social security measure & cannot be subjected in any way to Market risks
(iv) It does not guarantee minimum return & thus lacks the basic fiber of Social Security Scheme (iv). It is in no way better than the existing Pension  Scheme .
(v)It does not provide guaranteed Family Pension to dependents & disabled siblings which exist in present scheme, even in case of spouse & dependent parents where death of the employee occur in early years of service there is no adequate social security.
Q. 10.1.2  i.e.  As for as pre 2004 appointees are concerned, what should be the principles that govern the structure of pension and retirement benefits?
Ans.  1.Keeping in view the Socialistic structure of the country , constitutional provisions & to reduce vast inequality between have & have lots, it is proposed:  The Ratio between maximum & minimum of Pension be brought down to  9:1. Ensuring uniformly equal rise in Pension of all pensioners, irrespective of pre- retiral status. By adopting common multiplication factor for revision of Pension, raising the ratio between minimum & maximum pension to 1:12.85 by 6thCPC  , instead of reducing it,  was  unconstitutional.
7th pay commission is requested to  first workout the top most revised pension, divide it by 9 to arrive at the minimum revised pension & then derive a uniform multiplication factor  by dividing minimum  revised Pension by minimum pre-revised Pension, with the condition that Pension shall not in any case be less than 65% & family Pension 45% of the last Pay  in Pay Band i.e. Pay in Pay Band+ GP  /Pay scale or of average of last 10 months emoluments (Whichever is more beneficial) as was worked out & recommended by TECS (Tata Economic Consultancy Services)  consultant to Vth CPC (Para 127.9 Vol III 5th CPC report)
2.One Rank one pension i.e full parity: ‘Justice must be equal for all’.
Otherwise, it breeds contempt, discontentment, inefficiency, corruption & finally the insurgency. We have seen it happening in Tribal areas of N.E, Chhatishgarh, Jharkand, Orisa, MP etc.
Vast inequality of income and wealth between lowest & the highest paid, violation of Article 14 has already induced contempt, discontent, inefficiency & corruption, in Civil services.
Govt. granted One Rank One Pension (OROP) to Armed forces, Judges granted it to themselves. Even a period of private practice of lawyer judges, to be counted towards qualifying service. Higher Bureaucracy got it through modified parity.   All other Central Govt. employees & Pensioners are definitely not the 2nd grade citizens!  One Rank one Pension to all retirees is now a constitutional requirement to ensure equality.
3.Defence Pensioners: 
As far as defence pensioners are concerned they do the supreme sacrifice for the country .For them the ratio between highest & lowest paid must not be more than 1:5 and instead of being thrown out at an early age they must be transferred to paramilitary/police force after active tenure in armed forces. Otherwise, if these retired army personnel trained in all sort of weaponry are left uncared, they may fall prey to undesirable anti National outfits. In their case it is also essential that retirees from uniformed cadre & civilian defence Pensioners are treated at Par for all purpose.
4.Dearness relief : 
100% neutralization with automatic merger with Pension whenever it goes to 50%  :The Pension of Central Government Pensioners undergo revision only once in 10 years during which period the pension structure gets seriously dis-aligned; 50% increase in price takes place even in less than 5 years. This results in considerable erosion of the financial position of the pensioner. DR does not adequately take care of inflation at this level. Working employees are getting automatic relief by way of 25% increase in their allowances with every 50% rise in Dearness Allowance. As pensioners do not get any allowances, they feel discriminated against. In order to strike a balance, DR may be automatically merged with Pension whenever it goes to 50% .
5.Additional old age Pension : 
5% upward enhancement in pension be granted every five years’  after the age of 60 years & upto 80 years & thereafter as per existing dispensation.       As in the present scenario of climatic changes, incidence of pesticides and rising pollution, old age disabilities/diseases set in by the time an employee retires and go on manifesting very fast, needing additional finances to take care of these disabilities and diseases, especially as the cost of health care has gone very high.
6.Pension to be net of Income Tax :
The purchase value of pension gets reduced day by day due to continuously high inflation and steep rise in cost of food items and medical facilities. Retired persons/Senior citizens do not enjoy fully public goods and services provided by Government for citizens due to lack of mobility and many other factors. Their ability to pay tax gets reduced from year to year after retirement due to ever-increasing expenditure on food, medicines and other incidentals. Their net worth at year end gets reduced considerably as compared to the beginning of the year. Inflation, for a pensioner is much more than any tax. It erodes the major part of the already inadequate pension. To enable pensioners, at the far end of their lives, to live in minimum comfort and to cater for ever rising cost of living, they may be spared from paying Income Tax.
7. Restoration of commuted value of Pension in 12 years: 
Commutation value in respect of employee superannuating at the age of 60 years between 1.1.1996 and 31.12.2005 and commuting a portion of pension within a period of one year would be equal to 9.81 years Purchase. After adding thereto a further period of two years for recovery of interest, in terms of observation of Supreme Court in their judgment in writ petitions No 395-61 of 1983 decided in December 1986, it would be reasonable to restore commuted portion of pension in 12 years instead of present 15 years. In case of persons superannuating at the age of 60 years after 31.12.2005 and seeking commutation within a year, numbers of purchase years have been further reduced to 8.194. Also, the mortality rate of 60 plus Indians has considerably reduced ever since Supreme Court judgment in 1986; the life expectancy stands at 76 years now. Therefore, restoration of commuted value of Pension after 12 years is fully justified.
8. The 6th Central Pay Commission’s improved/new benefits, like full pension for 20 years of service/10yrs service etc  have been limited only to post-1.1.2006 retirees.  This is in violation of the letter and spirit of Hon’ble Apex Court judgment in Nakara Case.
We appeal to the 7th CPC to extend the above benefits to all pre-1.1.2006 retirees with monetary benefit from 1.1.2006 to do them equal justice. And that new/improved benefits which 7th CPC may recommend, too be made equally applicable to present & past pensioners
9.Medical facilities: 
“Health is not a luxury” and “not be the sole possession of a privileged few”. It is a Fundamental Right of all present & past Employees!
To ensure hassle free health care facility to Pensioners/family pensioners, Smart Cards be issued irrespective of departments to all Pensioners and their Dependents for cashless medical facilities across the country.
These smart cards should be valid in
  • all Govt. hospitals
  • all NABH accredited Multi Super Specialty hospitals across the country which have been         allotted land at concessional rate or given any aid or concession by the Central or the State govt.
  • all CGHS, RELHS & ECHS empanelled hospitals across the country.
  • Medical attendants. For reimbursement of bills for treatment & for hospitalization . No referral should be insisted in case of medical emergencies. For the purpose of reference for hospitalization & reimbursement of expenditure thereon in other than emergency cases Doctors/Medical officers working in different Central/State Govt. department dispensaries/health units should be recognized as Authorized medical attendant.

The enjoyment of the highest attainable standard of health is recognized as a fundamental right of all workers in terms of Article 21 read with Article 39(c), 41, 43, 48A and all related Articles as pronounced by the Supreme Court in Consumer Education and Research Centre & Others vs Union of India (AIR 1995 Supreme Court 922) The Supreme court has held that the right to health to a worker is an integral facet of meaningful right to life to have not only a meaningful existence but also robust health and vigour. Therefore, the right to health, medical aid to protect the health and vigour of a worker while in service or post retirement is a fundamental right-to make life of a worker meaningful and purposeful with dignity of person. Thus health care is not only a welfare measure but is a Fundamental Right.

We suggest that, all the pensioners, irrespective of pre-retiral class and status, be treated as same category of citizens and the same homogenous group. There should be no class or category based discrimination and all must be provided Health care services at par .
10. Hospital Regulatory Authority:
To ensure that the hospitals do not avoid providing reasonable care to smart card holders and other poor citizens, a Hospital Regulatory Authority should be created to bring all NABH-accredited hospitals and NABL-accredited diagnostic Labs under its constant monitoring of quality, rates for different procedures & timely bill payments by Govt. agencies and Insurance companies. CGHS rates may be revised keeping in mind the workability as per market conditions.
11.Fixed Medical allowance (FMA): 
As is recorded in Para 5 of the minutes of Committee of Secretaries (COS) held on 15.04.2010 (Reference Cabinet Secretariat, Rashtrapati Bhavan No 502/2/3/2010-C.A.V Doc No. CD (C.A.V) 42/2010 Minutes of COS meeting dated 15.4.2010) which discussed enhancement of FMA. “CGHS card estimates for serving Personnel: Since estimates are not available separately for pensioners M/O Health & Family Welfare had assessed the total cost per card p.a. in 2007-2008 = Rs 16435 i.e. Rs.1369 per month for OPD”. Adding to it inflation, the figure today is well over Rs 2000/- PM. Ministry of Labour & Employment, Govt. of India vide its letter no. G-25012/2/2011-SSI dated 07.06.2013 has already enhanced FMA to Rs 2000/- PM for EPFO beneficiaries. Thus, to help elderly pensioners to look after their health, Adequate raise in FMA will encourage a good number of pensioners to opt out of OPD facility which will reduce overcrowding in hospitals. OPD through Insurance will cost much more to the Govt. As such the proposal for raising Fixed Medical allowance to Pensioners is fully justified and is financially viable.
We suggest that FMA for all C.G. Pensioners be raised to at least Rs 2000/- PM without any distance restriction linking it to Dearness Relief for automatic further increase. We further suggest that FMA be exempted from INCOME TAX.
Fixed Medical Allowance (FMA) is a compensatory allowance to reimburse the medical expenses. As Medical Reimbursement is not taxable, FMA should also be exempted from Income Tax.
12.Grievance redressal Mechanism:
Pensioners/Family Pensioners are exploited, harassed and humiliated by their own counterparts in chair, who at the sight of an old person adopt a wooden face and indifferent attitude. Pensioners do not have representation even in Forums & Committees wherein pension policies and connected matters are discussed. The forum of Pension Adalat too is not of much avail as it meets only once a year which is too long a period for an elderly nearer to his end. Moreover, these Adalats deal with settlement claims only. SCOVA too meets only twice a year for about 3 hours at each occasion. Moreover, the scope of SCOVA is limited to feedback on Government policies. DOP&PW is perceived as a toothless authority which lacks direct Service Delivery Capability. It has been striving over the years to redress the Pensioners’ grievances through the ‘Sevottam’ model of the Department of Administrative Reforms & Public grievances; in the absence of strict timeline with punitive clause it is, however, proving to be a failure. Grievances are either not resolved for years or closed arbitrarily without resolving correctly.
We therefore, appeal that for resolving Pensioners complaints ,
(i) A strict time line with punitive clause be introduced in “Sevottam model”
(ii) Grievances are not allowed to be closed without resolving.
(iii) SCOVA be upgraded to JCM level covering all Pensioners by introducing suitable legislative amendment if required.
13. Representations in various committees : As recommended vide Vth CPC report Vol III para 141.30 Pensioners’ representatives should be included in various committees & other Fora of Govt where issues relating to the welfare of pensioners are likely to be discussed &debated :
Discussing, debating and deciding the matters / Policies relating to Pensioners, with representatives other than those of pensioners, is unfair & against the Rules of ‘Natural Justice’. At present various Committees like National Anomaly Committee (NAC) and JCM (on Pensioner matters), are there, wherein matters / policies relating to pensioners’ welfare are discussed and decided, but they do not have pensioners’ representatives with the result their viewpoints, hardships & anomalies are not properly represented. As pensioners are a homogenous class, there is an urgent need to constitute separate Committees for pensioners wherein matters / policies / anomalies relating to pensioners of all Groups, categories &departments may be discussed.
14. Govt. should not indirectly pressurize courts by appealing again & again to get judgments reversed in its  favor & must implement all court  judgments  in  case of all similarly placed persons.
V CPC recommended in para 126.5 that any Court Judgment involving  a common policy matter of pay/pension to a group of employees/pensioners, should be extended automatically to similarly placed employees/pensioners without driving every affected individual to the Courts of law. This recommendation is never followed by GOI, with the result Pensioners in the evening of their life, are forced to approach the legal forums, seeking  the same relief. This in turn, bulges court dockets. VII CPC to look into this matter once again and to issue suitable guidelines as deem fit and necessary.

Death of Government Employee does not entitle family for job: Supreme Court

The Supreme Court has held that death of a government employee in harness does not entitle the family to claim compassionate employment and the person seeking appointment must possess the eligibility for the post.

A bench of justices B S Chauhan and S A Bobde also said that the competent authority should examine the financial condition of family of the deceased and job should be offered to the eligible family member only if it is satisfied that they would not be able to cope up with the crisis.

"Mere death of a government employee in harness does not entitle the family to claim compassionate employment. "The competent authority has to examine the financial condition of the family of the deceased employee and it is only if it is satisfied that without providing employment, the family will not be able to meet the crisis, that a job is to be offered to the eligible member of the family. More so, the person claiming such appointment must possess required eligibility for the post," it said.

The bench allowed an appeal filed by MGB Gramin Bank which had challenged a 2010 judgement of the Rajasthan High Court by which one Chakrawarti Singh, son of a deceased Bank employee, was directed to be appointed under a scheme of compassionate employment.

Singh's father, who was working as a Class III employee with the Bank, had died on April 19, 2006 while in harness. Singh had applied for compassionate appointment on May 12, 2006.

The bench set aside the judgements of the High Court, saying, "The reasoning given by the single judge as well as by the division bench is not sustainable in the eyes of law." It also said that "an ameliorating relief should not be taken as opening an alternative mode of recruitment to public employment".

Following is the text of the President of India, Shri Pranab Mukherjee’s address to the Nation on the eve of the 67th Independence Day:

“Fellow citizens:

1. On the eve of the 66th anniversary of our Independence, I extend warm greetings to you and to all Indians around the world.

2. My thoughts turn first towards the Father of our Nation, Mahatma Gandhi, who shaped our liberation struggle and the martyrs who made supreme sacrifice for the freedom of our country and great patriots whose relentless struggle liberated our motherland from the colonial rule of nearly two hundred years. Gandhiji sought freedom from both foreign rule as well as the indigenous social chains that had imprisoned our society for long. He launched every Indian on a path of self-belief and hope for a better future. Gandhiji promised Swaraj- self-rule based on tolerance and self-restraint. He promised freedom from want and deprivation. For nearly seven decades now we have been masters of our destiny. This is then the moment to ask: are we heading in the right direction? Gandhiji`s vision cannot be turned into reality if we spurn the very values that were compulsory to his cause: sincerity of effort, honesty of purpose and sacrifice for the larger good.

3. Our founding fathers created the first oasis in the desert of a colonized world nourished by democracy. Democracy is much more than the right to vote every five years; its essence is the aspirations of the masses; its spirit must influence the responsibilities of the leaders and duties of the citizens every day. Democracy breathes through a vibrant Parliament, an independent judiciary, a responsible media, a vigilant civil society, and a bureaucracy committed to integrity and hard work. It survives through accountability, not profligacy. And yet we have allowed unbridled personal enrichment, self-indulgence, intolerance, discourtesy in behavior and disrespect for authority to erode our work culture. The biggest impact of the decay in the moral fiber of our society is on the hopes and aspirations of the young and the poor. Mahatma Gandhi had advised us to avoid, and I quote, “politics without principles, wealth without work, pleasure without conscience, knowledge without character, commerce without morality, science without humanity, and worship without sacrifice”, (unquote). We have to pay heed to his advice as we work towards building a modern democracy. The ideals of patriotism, compassion, tolerance, self-restraint, honesty, discipline and respect for women have to be converted into a living force.

4. Institutions are a mirror of national character. Today we see widespread cynicism and disillusionment with the governance and functioning of institutions in our country. Our legislatures look more like combat arenas, rather than fora that legislate. Corruption has become a major challenge. The precious resources of the nation are being wasted through indolence and indifference. It is sapping the dynamism of our society. We need to correct this regression.

5. Our Constitution provides a delicate balance of power between various institutions of the State. This balance has to be maintained. We need a Parliament that debates, discusses and decides. We need a judiciary that gives justice without delays. We need leadership that is committed to the nation and those values that made us a great civilization. We need a state that inspires confidence among people in its ability to surmount challenges before us. We need a media and citizens who, even as they claim their rights, are equally committed to their responsibilities.

Fellow citizens:

6. A re-ordering of the society can be brought about through the educational system. We cannot aspire to be a world class power without a single world class university. History records that we were the cynosure of the world once. Takshashila, Nalanda, Vikramashila, Valabhi, Somapura and Odantapuri comprised the ancient university system that dominated the world for eighteen hundred years beginning Sixth Century BC. They were a magnet for the finest minds and scholars in the world. We must seek to regain that space. A university is the banyan tree whose roots lie in basic education, in a vast network of schools that build the intellectual prowess of our communities; we have to invest in every part of this knowledge tree, from seed, root and branch to the highest leaf.

Fellow Citizens:

7. There is a direct relationship between a successful democracy and a successful economy, for we are a people-driven nation. People serve their interests best when they participate in decision- making at the level of panchayat and other forms of local government. We have to rapidly empower the local bodies with functions, functionaries and finances to improve their performance. Faster growth has given us the resources, but larger outlays have not translated into better outcomes. Without inclusive governance, we cannot achieve inclusive growth.

8. For a developing country of more than 1.2 billion people, the debate between growth and redistribution is vital. While growth builds the scope for redistribution, redistribution sustains growth over time. Both are equally important. A disproportionate emphasis on any one, at the expense of the other, can have adverse consequences for the nation.

9. The last decade has seen India emerge as one of the fastest growing nations in the world. During this period, our economy grew annually at an average rate of 7.9 per cent. We are today self-sufficient in food grains production. We are the largest exporter of rice and second largest exporter of wheat in the world. The record production of 18.45 million tonne of pulses this year augurs well for our march towards self-sufficiency in pulses. This was unthinkable just a few years ago. This momentum has to be sustained. In a globalized world, with increasing economic complexities, we have to learn to cope better with adversities, both external and domestic.

Fellow citizens:

10. At the dawn of our Independence, we lit the glowing lamp of modernity and equitable economic growth. To keep this lamp aflame, our highest priority has to be the elimination of poverty. Though a declining trend in the poverty rate is clearly visible, our fight against this scourge is far from over. India has the talent, ability and the resources to overcome this challenge.

11. Reforms that have enabled us to come this far have to be pursued at all levels of governance. Favorable demographic changes over the next two decades can pay us handsome dividends. It requires industrial transformation and rapid creation of employment opportunities. It also requires an orderly urbanization process. Several initiatives taken by the Government in the recent past including the New Manufacturing Policy, the renewal of urban infrastructure and the ambitious skill training programme will need close monitoring in the coming years.

12. We have given our citizens entitlements backed by legal guarantees in terms of right to employment, education, food and information. We now have to ensure that these entitlements lead to real empowerment for the people. We need robust delivery mechanisms to make these legislations work. New benchmarks of efficient public service delivery and accountability have to be established. The Direct Benefits Transfer Scheme, launched earlier this year, will bring in greater transparency, enhance efficiency and eliminate wastage of precious resources.

Fellow citizens:

13. In our race for development, we must be careful not to disturb the balance between man and nature. The consequences of such imbalance can be disastrous. My heartfelt condolences to the many who lost their lives, and the innumerable who suffered in Uttarakhand; and my salutations to those brave personnel of our security and armed forces, government and NGOs who did so much to alleviate suffering. This tragedy owes as much to the avarice of human nature as to the rage of Mother Nature. This was nature’s wake-up call. And it is time to wake up.

Fellow citizens:

14. We have seen in the recent past grave challenges to our security, internal as well as external. The barbaric face of Maoist violence in Chhattisgarh led to a loss of many innocent lives. Despite India`s consistent efforts to build friendly relations with neighbours, there have been tensions on the border and repeated violations of the Ceasefire on the Line of Control, leading to tragic loss of lives. Our commitment to peace is unfailing but even our patience has limits. All steps necessary to ensure internal security and protect the territorial integrity of the nation will be taken. I applaud the courage and heroism of our security and armed forces who maintain eternal vigilance and pay homage to those who have made the supreme sacrifice of the most precious gift of life in the service of the motherland.

15. There will be a general election in our country before I have the privilege of addressing you again on the eve of our next independence day. This great festival of democracy, is an opportunity for us to elect a stable government which will ensure security and economic development. Every election must become a crucial milestone in our nation’s journey towards greater social harmony, peace and prosperity.

16. Democracy has given us an opportunity to re-create another golden age. Let us not squander this extraordinary opportunity. The journey ahead calls for wisdom, courage and determination. We must work on across-the-board revival of our values and institutions. We must realize that rights go with responsibilities. We must re-discover the virtue of self-scrutiny and self-restraint.

17. Let me conclude by quoting from the great classic Bhagvad Gita where the Teacher propounds his views and then says, and I quote, “ÿatha icchasi tatha kuru” “even as you choose, so you do. I do not wish to impose my views on you. I have presented to you what I think is right. Now it is for your conscience, for your judgment, for your mind to decide what is right.” (unquote)

On your decisions rests the future of our democracy.

Department of Posts has proposed to set up a Post Bank of India. This will be an independent entity, separate from the current operations of Small savings Schemes being carried out by the Department on behalf of Ministry of Finance. The Department of Posts has accordingly submitted an application to the RBI on 28.06.2013 seeking a banking license subject to necessary Cabinet approvals.

The Government has approved the following modifications in the Civil Services Examination, 2013 notified on 5.3.2013:


1.    A candidate is allowed to use any one regional language from the 8th Schedule of the Constitution of India or English as the medium of writing the examination.

2.    Conditionality of a minimum of 25 candidates in that medium and the requirement to have that language as the medium of examination at graduation level has been dropped.

3.    Furthermore, a candidate is allowed to take up literature as his/her optional subject (to be chosen from a list of 23 literature subjects – 22 of the 8th Schedule languages and English) without the conditionality of having to do his/her graduation in that language’s literature.

4.    The English component (of 100 marks) from the Essay Paper has been dropped and 2 qualifying papers of 300 marks each in any Modern Indian Language(MIL) and in English have been restored. The Essay Paper is now of 250 marks to be written in the medium/language of candidate’s choice.

Now, the Civil Services Main Examination 2013 will be as under:

a.    The candidates may write the examination in any one medium/language chosen from the languages listed in the 8th Schedule of the Constitution of India or English;

b.    Paper I and II will be of qualifying nature only– one in any MIL and another in English – of 300 marks each;

c.    Paper III will be the compulsory Essay Paper, with no English Comprehension test, to be written in the medium of candidate’s choice. The English component shall be dropped. Now this paper shall be of 250 marks.

d.    There will be 4 compulsory papers of General Studies of 250 marks each, namely, Paper-IV (Indian Heritage & Culture, History and Geography of the World and Society), Paper-V (Governance, Constitution, Polity, Social Justice and International relations), Paper-VI (Technology, Economic Development, Bio Diversity, Environment, Security and Disaster Management) and Paper-VII (Ethics, Integrity and Aptitude).

e.    Paper VIII and IX: Candidates will have to take one optional subject with 2 papers of 250 marks each. This optional subject can be selected from a list of 25 core subjects and 23 literatures (literature of 22 languages in 8th Schedule of The Constitution of India and English).

f.    The personality test/interview will be of 275 marks.

ORDER

Sub: Providing immediate medical treatment to victims of crimes or road accidents.

In continuation with guidelines on the subject issued by this Department vide letters dated 30/10/1998, 31/03/2002, 27/11/2008 and 07/02/2011 all hospitals including private hospitals and nursing homes, functioning in the National Capital Territory of Delhi, are hereby directed to attend to victims of crimes and trauma in dire need of immediate medical treatment, including victims of rape and road accident, and provide them immediate treatment.

The above said hospitals/nursing homes shall not refuse to provide medical treatment for any reason including that the case involved is of medico-legal nature. In such cases the hospital / nursing home concerned shall also call / inform the nearest Police Station or the Police Control Room concerning the medico legal case.

Attention of all the above hospitals/nursing homes is drawn to clause 14.2 of the schedule appended with Rule 14 of Delhi Nursing Homes Registration (Amendment) Rules, 2011 which provides as under:

“14.2 The nursing home shall not refuse treatment to the injured / serious patients brought to them due to any reason, whatsoever.”

Any such victim brought to the hospital/nursing home either by the Police or the public or on their own, shall not be refused immediate medical treatment that may be required to stabilize the emergency medical condition of the victim.

Non-compliance of the aforementioned directions by defaulting hospitals / nursing homes shall attract appropriate disciplinary / punitive action including cancellation of registration.
