OFB, Kolkata vide letter No.01/CR/A/I/Vol.IV/658 dated 28/01/2013 intimated that your office has returned the pay fixation proposal of the IEs who have got promotions on 01.01.2006 (Sunday), due to implementation of MoD letter No.11(5)/2009-D (Civ-I) dtd 14-06-2010 issued on cadre restructuring of Artisan Staff in Defence Establishment, with audit remarks that granting of promotion on Sunday/holiday is not in order.

The matter has been examined at this end it is pointed that ibid MoD order dated 14.06.2010 extended financial benefit w.e.f.01.01.2006 i.e. the cut-off date from which the financial benefit for promotion, due to cadre restructuring, on a non-functional manner should be admitted. Hence, in the instant case the financial benefit needs to be given from 01.01.2006 if the individual is on duty on 02.01.2006 and his next increment is to be provided w.e.f.1.7.2006. However, if the incumbent is on regular leave on 02.01.2006, the benefit of promotion cannot be given w.e.f. 1.1.2006 but benefit of promotion may be allowed from the date of actual resumption of duty on or after 3.1.2006. In such cases, next increment cannot be provided to them w.e.f.1.7.2006, if not opted for final fixation from the date of drawl of increment in the lower pay.

Subject: Non-relieving of Section Officers covered under RTP – regarding.

The undersigned is directed to refer to this Department’s OMs of even number dated 06th February, 2013 and 15th March, 2013 vide which all the Cadre Units were requested to relieve the officers concerned within 45 days of the issue of RTP orders dated 21.12.2012 and 09.01.2013. As per the records available in this office, a number of Section Officers included in the said order have not been relieved by the Cadre Units concerned as yet.

2.    Non-compliance of RTP orders by various Cadre Units has led to various administrative difficulties for DOP&T in smooth cadre management. DOP&T is well aware of the fact that large number of vacancies exist across the 42 Cadre Units and necessary action has already been taken up by DOP&T by intimating 992 vacancies to UPSC for Limited Departmental Competitive Examinations(LDCEs) 2009, 2010 & 2011. Once result is declared, which is expected shortly, almost all the vacancies in all the Cadre Units would be filled up.

3.    This is a transitional phase and Cadre Units are requested to co¬operate with DOP&T during this phase. It is, therefore, once again requested that all the officers mentioned in the annexure may be relieved immediately.

Computer Fund (Fee) is not for Class 1 & 2 Students: KVS clarification

G.S.R. --- In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Company Law Board (Group IV posts) Recruitment Rules, 1999, in so far as they relate to the post of Section Officer, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group 'B' post — Section Officer in the Company Law Board, Ministry of Corporate Affairs, namely:-

2. Short title and commencement.-- (1) These Rules may be called the Company Law Board (Group 'B' Post — Section Officer) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and Pay Band and Grade Pay .-- The number of posts, their classification and Pay Band and Grade Pay attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications .-- The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in column (5) to (13) of the aforesaid Schedule.

4. Disqualification - No person —
(a) who, has entered into or contracted a marriage with a person having spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax -- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving .-- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Ex- servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

Note- 1. The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same, or some other organization/ department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.

Note 2: For the purpose of appointment on deputation, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended), shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scales of pay into one grade with a common Grade Pay or Pay Scale and where this benefit will extend only for the post (s) for which that Grade Pay or Pay Scale is the normal replacement grade without any up- gradation.

Subject: Recruitment on all India basis by open competition and otherwise than by open competition — Clarification regarding.

The undersigned is directed to say that the Ex-servicemen (Re-employment in Central Civil Services and Posts) Amendment Rules, 2012, inter-alia provides as follows:-

    “5 (b) For appointment to any vacancy in Group A and Group B services or posts filled by direct recruitment otherwise than on the results of an Open All India Competitive Examination, the upper age limit shall be relaxed by the length of military service increased by three years in the case of ex-servicemen and commissioned officers including Emergency Commissioned Officers or Short Service Commissioned Officers.

    (c) For appointment to any vacancy in Group A and Group B service or posts filled by direct recruitment on the results of an All India Competitive Examination, the ex-servicemen and Commissioned Officers who have rendered at least five years military services and have been released:-

    (i)    on completion of assignment (including those whose assignment is due to be completed within one year) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency; or

    (ii)    on account of physically disability attributable to military service or on invalidment, shall be allowed maximum relaxation of five years in the upper age limit.”

This Department has been receiving representations and RTI applications to

clarify the meaning of the phrases “recruitment otherwise than on the results of an Open All India Competitive Examination” and “posts filled by direct recruitment on the results of an All India Competitive Examination” mentioned in the above paragraph.

3.    It is hereby clarified that instructions on the subject already exist that the expression ‘direct recruitment on the results of an All India Competitive Examination’ means (i) all recruitment by UPSC whether through written examination or by interview or both and; (ii) recruitment made by other authorities including Staff Selection Commission or any other appointment authority through written competitive examination or tests (but not by interview only). The expression ‘direct recruitment otherwise than by open competition means’ (i) any recruitment not made by the UPSC or (ii) recruitment not made through written competitive tests held by any other authority.

4.    All the Ministries/Departments are requested to bring it to the notice of all establishments under their control.
