Cabinet approves proposal to introduce the Financial Resolution and Deposit Insurance Bill 2017

Cabinet approves proposal to introduce the Financial Resolution and Deposit Insurance Bill 2017

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved the proposal to introduce a Financial Resolution and Deposit Insurance Bill, 2017. The Bill would provide for a comprehensive resolution framework for specified financial sector entities to deal with bankruptcy situation in banks, insurance companies and financial sector entities.

The Financial Resolution and Deposit Insurance, Bill 2017 when enacted, will pave the way for setting up of the Resolution Corporation. It would lead to repeal or amendment of resolution-related provisions in sectoral Acts as listed in Schedules of the Bill. It will also result in the repealing of the Deposit Insurance and Credit Guarantee Corporation Act, 1961 to transfer the deposit insurance powers and responsibilities to the Resolution Corporation.

The Resolution Corporation would protect the stability and resilience of the financial system; protecting the consumers of covered obligations up to a reasonable limit; and protecting public funds, to the extent possible.
The Government has recently enacted the Insolvency and Bankruptcy Code, 2016 ("Code") for the insolvency resolution of non- financial entities. The proposed Bill complements the Code by providing a resolution framework for the financial sector. Once implemented, this Bill together with the Code will provide a comprehensive resolution framework for the economy.

The Financial Resolution and Deposit Insurance Bill, 2017 seeks to give comfort to the consumers of financial service providers in financial distress. It also aims to inculcate discipline among financial service providers in the event of financial crises by limiting the use of public money to bail out distressed entities. It would help in maintaining financial stability in the economy by ensuring adequate preventive measures, while at the same time providing the necessary instruments for dealing with an event of crisis. The Bill aims to strengthen and streamline the current framework of deposit insurance for the benefit of a large number of retail depositors. Further, this Bill seeks to decrease the time and costs involved in resolving distressed financial entities.

Cabinet approves modifications in the 7th CPC recommendations on pay and pensionary benefits

Cabinet approves modifications in the 7th CPC recommendations on pay and pensionary benefits

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi approved important proposals relating to modifications in the 7th CPC (Central Pay Commission) recommendations on pay and pensionary benefits in the course of their implementation. Earlier, in June, 2016, the Cabinet had approved implementation of the recommendations with an additional financial outgo of Rs 84,933 crore for 2016-17 (including arrears for 2 months of 2015-16).

The benefit of the proposed modifications will be available with effect from 1st January, 2016, i.e., the date of implementation of 7th CPC recommendations. With the increase approved by the Cabinet, the annual pension bill alone of the Central Government is likely to be Rs.1,76,071 crore.  Some of the important decisions of the Cabinet are mentioned below:

1. Revision of pension of pre - 2016 pensioners and family pensioners
The Cabinet approved modifications in the recommendations of the 7th CPC relating to the method of revision of pension of pre-2016 pensioners and family pensioners based on suggestions made by the Committee chaired by Secretary (Pensions) constituted with the approval of the Cabinet.  The modified formulation of pension revision approved by the Cabinet will entail an additional benefit to the pensioners and an additional expenditure of approximately Rs.5031 crore for 2016-17 over and above the expenditure already incurred in revision of pension as per the second formulation based on fitment factor.  It will benefit over 55 lakh pre-2016 civil and defence pensioners and family pensioners.

While approving the implementation of the 7th CPC recommendations on 29th June, 2016, the Cabinet had approved the changed method of pension revision recommended by the 7th CPC for pre-2016 pensioners, comprising of two alternative formulations, subject to the feasibility of the first formulation which was to be examined by the Committee.
In terms of the Cabinet decision, pensions of pre-2016 pensioners were revised as per the second formulation multiplying existing pension by a fitment factor of 2.57, though the pensioners were to be given the option of choosing the more beneficial of the two formulations as per the 7th CPC recommendations.

In order to provide the more beneficial option to the pensioners, Cabinet has accepted the recommendations of the Committee, which has suggested revision of pension based on information contained in the Pension Payment Order (PPO) issued to every pensioner.  The revised procedure of fixation of notional pay is more scientific, rational and implementable in all the cases.  The Committee reached its findings based on an analysis of hundreds of live pension cases.  The modified formulation will be beneficial to more pensioners than the first formulation recommended by the 7th CPC, which was not found to be feasible to implement on account of non-availability of records in a large number of cases and was also found to be prone to several anomalies.
2. Disability Pension for Defence Pensioners
The Cabinet also approved the retention of percentage-based regime of disability pension implemented post 6th CPC, which the 7th CPC had recommended to be replaced by a slab-based system.

The issue of disability pension was referred to the National Anomaly Committee by the Ministry of Defence on account of the representation received from the Defence Forces to retain the slab-based system, as it would have resulted in reduction in the amount of disability pension for existing pensioners and a reduction in the amount of disability pension for future retirees when compared to percentage-based disability pension.

The decision which will benefit existing and future Defence pensioners would entail an additional expenditure of approximately Rs. 130 crore per annum.

Central government to change the ceiling for tax free gratuity

Cabinet nod likely to double gratuity cap to Rs 20 lakh

Besides, the bill seeks to enable the central government to change the ceiling for tax free gratuity after factoring in rise in income levels by an executive order bypassing Parliament route to amend the law.
The Union Cabinet is likely to consider tomorrow a draft amendment bill which seeks to double the ceiling of tax-free gratuity to Rs 20 lakh under the Payment of Gratuity Act.

Besides, the bill seeks to enable the central government to change the ceiling for tax free gratuity after factoring in rise in income levels by an executive order bypassing Parliament route to amend the law.
"The bill to amend the Payment of Gratuity Act is likely to be considered and approved by the Union Cabinet in its meeting scheduled tomorrow," a source said.

After the amendment in the Act, formal sector workers would be eligible for up to Rs 20 lakh tax-free gratuity. Last month, the central trade unions had agreed on the proposal in a tripartite consultation with the Labour Ministry.

However, the unions had demanded the removal of conditions asking to have at least 10 employees in an establishment and minimum five years of service for payment of gratuity.

At present, as per the Payment of Gratuity Act, an employee is required to do minimum service of five years to become eligible for gratuity amount. Moreover, the Act applies to those establishments where the number of employees is not less than 10.

Trade unions had demanded that the amended provision regarding maximum amount should be made effective from January 1, 2016, as done in the case of central government employees.

Besides that rate of 15 days wages for each completed year of service be raised to 30 days wages, the unions had said during the tripartite meeting.

The proposed amendment to the Payment of Gratuity Act as circulated by the government only deals with enhancing the ceiling of maximum amount under Section 4(3) of the Act from Rs 10 lakh to Rs 20 lakh.
The proposed amendment is being brought to bring the maximum ceiling amount to Rs 20 lakh in line with the 7th Central Pay Commission's recommendations as accepted by the government.

The relevant amendment for central government employees was notified on July 25, 2016 and the enhanced amount ceiling was made effective from January 1, 2016.

The unions were of the view that the delay of eight months for employees covered under the Payment of Gratuity Act should not result in adversely affecting the interest of the concerned employees.
The employers as well as state representatives had also agreed to the proposal of raising the amount of gratuity to Rs 20 lakh in the tripartite meeting held last month.

Bonanza for babus! 23.55% Salary hike likely for central government employees

Bonanza for babus! 23.55% Salary hike likely for central government employees

cabinet-to-take-up-pay-panel-proposal-on-29th
The total outgo if this award is implemented from January 1, 2016, is pegged at Rs 1.02 lakh crore, providing a bid demand boost to the economy.
NEW DELHI: The much-anticipated Seventh Pay Commission bonanza for the government employees is likely soon with the Union Cabinet set to consider the panel’s recommendations on Wednesday.

The committee of secretaries tasked with reviewing the recommendations has given its report that would be considered by the government before deciding on the final award.

The Seventh Pay Commission has announced 23.55% increase in pay and allowances of serving central government employees and 24% increase in pension of retired officers.

A government official confirmed that the proposal is on the cabinet agenda for Wednesday.

The total outgo if this award is implemented from January 1, 2016, is pegged at Rs 1.02 lakh crore, providing a bid demand boost to the economy.

However, in view of fiscal constraints, the government is likely to go for a lower increase and also delay the implementation of the increase in allowances.

In the budget for FY17, the government has budgeted 32% increase in salary of its employees but only a meagre 1.9% rise in allowances.

Finance ministry officials have said that the budget has adequate provision for pay commission and the fiscal deficit target of 3.5% of GDP will not be under stress from implementation of the award.
In a report after the budget, Moody’s had said “Pay Commission recommendations of a 24% hike in public sector salary, allowances and pensions, is not fully accounted for in the budget” and will be a source of spending pressure.

The government can delay the implementation of increase in allowances to a later date but the salary increases will have to be given from January 1, 2016, which means employees will get arrears for these month, a potential boost to economy.

Car and property sales tend to rise after pay commission awards.

Incentives announced for textiles will help create jobs

Incentives announced for textiles will help create jobs

The “extra push” given to the textiles industry through an incentive package will help create more jobs and push exports, Commerce and Industry Minister Nirmala Sitharaman said today.

“It is a sector where India has gained a lot of advantage … It has a great potential for job creation,” the minister told reporters here.

This “extra push” was given to the sector due to various global developments, she said.

The Union Cabinet yesterday approved a Rs 6,000 crore package for textiles and apparel sector with an aim to create one crore new jobs in three years and attract investments of USD 11 billion while eyeing USD 30 billion in exports.

Textiles exports contribute significantly to the country’s total exports at about USD 17 billion in 2014-15. The sector is witnessing huge competition from small countries like Bangladesh and Vietnam, which have access to developed markets at lower tariffs.

When asked about the impact of Brexit (possible exit of Britain from European Union) on India, Sitharaman said that the government is “watching the situation”.

“We will be observing the developments. It is too early for me to comment (on its impact),” she added.
Talking about the stalled India-EU free trade agreement, the minister said India is waiting for the dates to resume the talks.

“We are waiting for the dates. It is my doubt that if because they are waiting for the outcome of Brexit, they have not yet given the dates as yet. The moment they give the dates, we will be keenly wanting to continue the talks to reach the conclusion at the earliest,” she added.

Launched in June 2007, the negotiations for the proposed agreement have witnessed many hurdles with both sides having major differences on crucial issues like intellectual property rights, duty cut in automobile and spirits, and liberal visa regime.

The pact is aimed at reducing or significantly eliminating tariffs on goods, facilitating trade in services and boosting investments between the two sides.

When asked about Apple Inc’s proposal to open single brand retail stores in the country after announcement of the tweaked FDI policy in the sector, Sitharaman said: “We have announced the policy. We will wait to hear from them”.

The ministry has stated that it will give exemption to foreign firms such as Apple Inc coming with state-of-the-art technology from the mandatory local sourcing norms in the single-brand retail sector for up to three years.

Cabinet clears bill to check benami transactions

Cabinet clears bill to check benami transactions

New Delhi: The Cabinet today approved the new Benami Transaction (Prohibition) Bill which aims at curbing the generation of domestic black money.

“The Union Cabinet has approved the new Benami Transaction (Prohibition) Bill to curb generation of black money,” said a source after the Cabinet meeting here.

Apart from confiscation, the Bill provides for prosecution and aims to act as a major avenue for blocking generation and holding of black money in the form of benami property, especially in real estate.

The government had in Budget 2015-16, presented at the end of February, announced that it would come out with a new and more comprehensive Benami Transactions (Prohibition) Bill.

The Benami Transactions (Prohibition) Act was earlier enacted in 1988, but the rules under that Act could not be formulated due to inherent infirmities in it.

Following this, in 2011 the government introduced in Parliament a Benami Transactions (Prohibition) Bill, which proposed replacing the 1988 Act.

The Bill was referred to the Standing Committee on Finance for examination, which submitted its report in June 2012.

However, the Bill lapsed with the dissolution of 15th Lok Sabha.

Cabinet hikes DA to 100%, salary may increase by 30%

Cabinet hikes DA to 100%, salary may increase by 30%

NEW DELHI: The Union Cabinet on Friday raised dearness allowance to 100% from 90%, benefiting 50 lakh employees and 30 lakh pensioners.

The government has also cleared the way for merger of 50% DA with basic pay by approving it among the terms of reference of the 7th Pay Commission. An official said now the commission can suggest the merger in its interim report.

He added that 50% DA merger with basic pay will roughly increase the gross salaries of central government employees by around 30%.

The Cabinet approved the proposal to release an additional installment of DA and dearness relief (DR) to pensioners with effect from January 1, 2014, in cash, but not before the disbursement of the salary for the month of March 2014 at the rate of 10% increase over the existing rate of 90%, said an official statement.
Central government employees as well as pensioners are entitled for DA/DR at the rate of 100 per cent of the basic with effect from January 1, 2014, it said.

The government has estimated that the combined impact on exchequer on account of both DA and DR would be Rs 11,074.80 crore every year.

Media report hints Central D.A. hike today

The Union Cabinet is likely to approve a proposal to increase dearness allowance (DA) of central government employees by 8% on Thursday.

The move to increase D.A. from 72% to 80% will benefit around 50 lakh employees and 30 lakh pensioners of the central government.

"The Union Cabinet may consider the finance ministry proposal to increase DA in its meeting scheduled for Thursday," a source said, adding the hike would be effective from January 1, 2013 and employees and pensioners would be entitled to arrears.

The government had raised DA to 72% in September last year, which had come into effect from July 1, 2012.

As per usual practice, DA is merged with basic pay when it breaches the 50% cap. This helps employees get higher allowances as those are paid as proportion of the basic pay.

Latest DA News : Decision on hiking dearness allowance deferred
Decision on hiking dearness allowance deferred
NEW DELHI: The government on Tuesday deferred a decision on hiking dearness allowance (DA) of central government employees to 80 per cent, from 72 per cent at present.
An increase in DA would have benefitted about 50 lakh employees and 30 lakh pensioners.

"The proposal on DA has been deferred as the Finance Minister was not present," Information and Broadcasting Minister Manish Tewari told reporters after the Cabinet meeting chaired by Prime Minister Manmohan Singh here.
Finance Minister P Chidambaram is on an official visit to Japan.
A hike in DA has been proposed with effect from January 1, 2013, according to sources.
The government had hiked DA to 72 per cent in September last year. The increase was with effect from July 1, 2012.
The Confederation of Central Government Employees has demanded merger of up to 50 per cent DA with the basic pay and setting up the seventh pay commission at the earliest.
As per the practice, the DA is merged with basic pay when it breaches the 50 per cent cap. This helps employees get higher allowances as those are paid as proportion to the basic pay.
