Subject: Revision of Pension of Pre-2016 pensioners - Stagnation Increment regarding

The undersigned is directed to say that in pursuance of the decision taken by the Government on the recommendations of the 7th CPC, orders were issued vide this Deptt's OM of even number dated 12.5.2017 for revision of pension/family pension in respect of pre-2016 pensioners/family pensioners by notionally fixing pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which the Government servant / pensioner retired/died. Concordance tables for fixation of notional pay / pension of pre-2016 pensioners were issued vide this Department's OM of even number dated 6.7.2017.

2. References/representations have been received in this Department seeking clarification on the applicability of the OM dated 7.9.2016 for the purpose of notional pay fixation and revision of pension of pre-2016 pensioners and family pensioners w.e.f. 1.1.2016. The matter has been examined in consultation with the Ministry of Finance (Department of Expenditure). It is clarified that the benefit of additional increment has been granted to those officers who were serving as on 1.1.2016. Those who retired/died before 1.1.2016 are, therefore, not eligible for increment after retirement for the purpose of pension.

3. This issues with the approval of Department of Expenditure vide their I.D. No.1(3)/V-V/2018 dated 4.9.2018 and 1.D. No.1(3)/V-V/2018 dated 28.11.2018

As you are aware that 7th CPC pension revision for Pre-2016 pensioners/family pensioners is going on in compliance to the DP&PW 0M dated 12th May, 2017. As on date, more than 5 Lakhs pension revision cases of central civil pensioners/family pensioners have been received in Central pension Accounting Office (CPAO). CPAO is receiving many queries from the pensioners/family pensioners regarding status of their pension revision. CPAO is providing the status of pension revision to the pensioners. The pension revision status can also be checked by the pensioners/family pensioners through CPAO website www.cpao.nic.in by entering their 12 digit PPO numbers. For the wider publicity of this facility among Central Civil Pensioners/family pensioners, it is felt necessary that a link of this facility available on CPAO website may be provided in the official websites of your Ministry/Department and its attached/subordinate offices for the benefits of pensioners.

4) NOTIONAL PAY SHOWN UNDER COLUMN 3 (e) MAY BE CHECKED.

5) PAY/NOTIONAL PAY SHOWN IN COLUMN 3 (e), DOES NOT MATCH WITH PAY FIXED UNDER 7TH CPC AS SHOWN IN COLUMN 4 (a).

6) LEVEL AND INDEX UNDER COLUMN 4 (a) MAY BE CHECKED.

7) BASIC PENSION IS NOT MATCHING WITH THE LAST PAY DRAWN AS PER 7TH CPC.

Sub: Revision of Pension of pre-2016 Pensioners/Family Pensioners pursuant to Government’s decision on the recommendations of 7th CPC - Concordance Tables for pension revision to the former Running Staff-reg.

Ref: Railway Board’s letter No. 2016/F(E)III/1(1)/7 dated 11/07/2017.

Railway Board’s attention is invited to the instructions issued vide Board's letter dated 11/07/2017 (RBE No. 66/2017) vide which DoP&PW’s orders together with Concordance tables for revision of Pension of pre-2016 Pensioners/Family Pensioners have been circulated. The Concordance Tables circulated by the Board, unfortunately do not cover the pension revision of former Running Staff as no separate tables in favour of them staff have been circulated so far. Reports received by the Federation (NFIR) reveal that the Pension/Family Pension of pre-2016 Running Staff is not being revised by the Zonal Railways due to non-provision of separate Concordance Tables by the Railway Board.

In this connection, NFIR desires to clarify that in case of former Running Staff Pension/Family Pension is required to be calculated taking into account the Basic Pay + 55% add on pay element. A sample calculation sheet of the Pension in the case of pre-2016 Running Staff is enclosed as Annexure to this letter for appreciation and quick action.

NFIR, therefore, requests the Railway Board to communicate the Concordance Tables to the Zonal Railways for revision of Pension/Family Pension of former Running Staff. It is also urged that the Concordance Tables be finalized on the basis of specimen (vide Annexure to this letter) and instructions issued to the GMs of Zonal Railways.

Subject:  Implementation of Government's decision on the recommendations of 7th Central Pay Commission - Revision of pension of pre- 2016 Pensioners/ Family Pensioners, etc.-reg.

DP&PW vide OM No. 38/37/2016-P&PW (A) dated-12.05.2017 on the above subject had issued detailed instructions to all concerned to revise the pensions of pre-2016 pensioners/ family pensioners. But while issuing instructions to PAOs vide CPAOs OM No. CPAO /IT& Tech/ Revision (7th CPC)/ 19 Vol-III/2016-17/37 dated-25.05.2017 inadvertently an important point "that these orders would not be applicable for the purpose of revision of pension of those pensioners who were drawing compulsory retirement pension under Rule 40 of the CCS (Pension) Rules or compassionate allowance under Rule 41 of the CCS (Pension) Rules. The pensioners in these categories would continue to be entitled to get revised pension in accordance with the instructions contained in DP&PW O.M. No. 38/37/2016-P&PW(A)(ii) dated 04.08.2016" was missed.

Consequently, it has been noticed that some Ministries/Departments have revised the pensions of pensioners who were drawing compulsory retirement pension under Rule 40 of CCS (Pension) Rules, 1972 or Compassionate allowance under 41 of the CCS (Pension) Rules also and sent to CPAO. These cases are to be returned to the concerned PAOs by CPAO.

In view of the above, to avoid any further problems arising out of it, all Pr. CCAs/CCAs/ CAs/ AGs/ Administrators of UPS are requested to instruct their PAOs not to revise such cases.

Instructions have been issued regarding revision of pre-2016 pensioners/family pensioners in line with 7th CPC recommendations vide Railway Board’s letter under reference above. These instructions envisage 'suo moto' revision in pension for all pre-2016 retirees. Till date 151982 pensioners PPO have been revised.

It may be appreciated that against the 14 lakh pensioners cases on Indian Railways, the pace of pension revision is slow. In the recently held review meeting, additional secretary (Expenditure) has also emphasized that adequate priority may be given to this area of work. Finance Secretary also expressed that exercise of pension revision may be completed in a time-bound manner. In this connection, Financial Commissioner, vide his DO letter No.2016/AC-II/21/8/PT-III dated 5.9.2017 has also advised that the exercise of revision may be carried out on a parallel track alongwith ARPAN to expedite the process.

As a welfare measure, it should be ensured to step up with pace for revision of pension. The work flow of pension revision envisages close coordination between the personnel and the accounts Department and hence, it is advised that PCPO and PFA to monitor the progress of revision of pension cases at their level to ensure that pension revision exercise is completed at the earliest.

Sub : Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission Revision of pension of pre-2016 retired medical officers.

The undersigned is directed to say that in implementation of the decision taken on the recommendations of the 7th CPC, orders were issued vide this Departments OM No.38/37/2016-P&PW(A)(ii) dated 04.08.2016 for revision of pension of pre-2016 pensioners/family pensioners w.e.f. 01.01.2006 by multiplying the pre-revised pension/family pension by a factor of 2.57. Subsequently, vide OM No. 38/37/2016-P&PW(A) dated 12.05.2017, it has been decided that the pension/family pension w.e.f. 01.01.2016 in respect of all Central civil pensioners/family pensioners, who retired/died prior to 01.01.2016, may be revised w.e.f. 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay hand and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay

2. In the case of medical officers, the emoluments reckoned for calculation of pension include Non-practicing Allowance (NPA). The pay of the medical officers is revised in accordance with the specific provision made in the Revised Pay Rules. The manner in which the pay of the medical officers is to be revised w.e.f. 1.1.2016 is prescribed in Rule 7 of the CCS (Revised Pay) Rules, 2016. Accordingly, for the purpose of revision of pension of pre-2016 retired medical officers in accordance with this Department’s O.M. dated 12.05.2017, their pay will be notionally revised w.e.f. 1.1.2016 based on the formula for revision of pay as applicable to the medical officers in the 7th CPC as well as in the intervening Pay Commissions. NPA at the rate as applicable as on 01.01.2016 shall be added to such notional pay as on 1.1.2016 to arrive at pension/family pension of retired medical officers w.e.f. 1.1.2016.

3. NPA to serving medical officers has been revised @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the pension/family pension of retired medical officers shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the notional pay as on 1.1.2016, instead of the NPA admissible as on 1.1.2016.

4. The revision of pension/family pension of retired medical officers in the above manner will be further subject to the condition that the notional pay as on 1.1.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.

5. This issues with the approval of Ministry Of Finance, Department of Expenditure vide their I.D.No.136/EV/2017 dated 25.08.2017.

Subject: Implementation of Government's decision on the recommendation of the Seventh Central Pay Commission - Revision of pension of pre-2016 pensioners / family pensioners etc - reg.

The undersigned is directed to refer to this Department's letter of even number dated 19th May 2017 vide which the instructions dated 12th May 2017 relating to revision of pension of pre-2016 pensioners issued by Department of Pension and Pensioner's Welfare in the context of implementation of VII CPC recommendations, were extended to All India Service (AIS) Pensioners. The said letter dated 19th May 2017 was also sent to all Ministries / Departments of Government of India (copy enclosed).

2.Many retired AIS Officers who are drawing pension from the Central Government, have since voiced grievances at various levels, stating that pension revision in pursuance of the order dated 19th May 2017 has not taken place so far.

3.It is observed in this regard that CPAO, with the approval of the Controller General of Accounts, have issued instructions on 25th May 2017 to Pr. Chief Controller of Accounts / Chief Controller of Accounts etc. about the modalities to be followed for expeditious implementation of the instructions dated 12th May 2017 of the D/o Pension & PW. Joint Secretary (Admn) / Admin in charge of Ministries / Departments have also been requested by CPAO to instruct their Head of Offices (HOOs) to start immediately sending the revised pension cases to the PAOs on the basis of records available with them and monitor the progress in this regard. Further follow up instructions have also been issued by CPAO on 7 th July 2017.

Reference: i) DOP&PW OM No.38/37/2016-P&PW(A) dated 12th May, 2017 & 6th July, 2017 ii) Para 10.1.67 of 7th CPC Report for grant of Parity of Pension of Pre & Post Seventh CPC Pensioners

1. We draw your kind attention to the sad plight of large majority of Central Government Pensioners – especially the Pre-2006 Pensioners and more so the Pre-1996 Pensioners, who will suffer a major financial loss in fixation of their Revised Pension on account of an unjust decision on implementation of 7th CPC Report vide DOP&PW OM dated 12-5-2017 cited above.

2. The Seventh Central Pay Commission (CPC) in Para 10.1.67 & 10.1.68 of its Report had for the first time conceded the long pending demand of the Central Government Pensioners for Parity of Pension between the Pre and Post CPC Pensioners and had recommended the following pension formulation for civil employees including CAPF personnel who had retired before 01.01.2016:
i) All the Civilian personnel including CAPF who retired prior to 01.01.2016 (expected date of implementation of the Seventh CPC recommendations) shall first be fixed in the Pay Matrix being recommended by this Commission, on the basis of the Pay Band and Grade Pay at which they retired, at the minimum of the corresponding level in the matrix. This amount shall be raised, to arrive at the notional pay of the retiree, by adding the number of increments he/she had earned in that level while in service, at the rate of three percent. Fifty percent of the total amount so arrived at shall be the revised pension.

ii) The second calculation to be carried out is as follows. The pension, as had been fixed at the time of implementation of the VI CPC recommendations, shall be multiplied by 2.57 to arrive at an alternate value for the revised pension.

iii) Pensioners be given option of choosing whichever formulation is beneficial to them.
3. Option 1, cited above, was very much feasible to implement as recommended by 7th CPC for revision of Pension of old Pension since according to the survey conducted by the DOP&PW, it was accepted that the Service Records of over 80% of old Pensioners were available, while those of the others could be re-built as per procedure prescribed in the Rules and as was done after 5th & 6th CPC and as per orders of the Courts in numerous cases.

4. Regrettably, the Committee formed by the Government, to consider the feasibility of implementation of Option 1 recommended by the Seventh CPC, while finding it non-feasible, did not care for the interest of the more than 80% of the Pensioners merely to save the Administration from the botheration of Re-building the Service Records of the rest less than 20% Pensioners. This was a great injustice since the 80% of the Pensioners who’s Records are available, shall suffer a loss of Pension just because of missing records of the rest 20%.

5. Instead, the Government accepted the following formula vide OM Dated 12-5-2017, as recommended by the Committee on Feasibility of Option 1:

"the revised pension/family pension w.e.f. 01.01.2016 in respect of all Central civil pensioners/family pensioners, including CAPF's, who retired/died prior to 01.01.2016, may be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay. While fixing pay on notional basis the pay fixation formulae approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. 50% of the notional pay as on 01.01.2016 shall be the revised pension and 30% of this notional pay shall be the revised family pension w.e.f. 1.1.2016 as per the first Permutation."

6. The above said formula will very seriously and adversely affect the Revised pension of a large majority of the Pre-2016 Pensioners on account of following reasons:
a) "Parity of Pension" between Pre and Post-2016 Pensioners - recommended by the Seventh CPC - would be denied to the Pre-2016 Pensioners.

b) In the process of notional pay fixation in successive Pay Commissions, there is a lot of dilution particularly for pensioners who retired in 4th CPC period resulting in big financial loss.

c) Irrespective of the date of retirement, Option 1 would have given the same pension to pre-2016 pensioners depending upon the number of increments earned in the last Level. By denying option 1 there will be sub-groups even within the homogenous group of pre-2016 pensioners.

d) None of the above losses would occur to the Pre-2016 Pensioners if the Option 1 recommended by the 7th CPC is implemented and if the new formula is allowed as a 3rd Option in addition to Option 1 & 2 Recommended by the 7th CPC in the interest of natural justice to all Pre-2016 Pensioners.
2. It is, therefore, requested that the Pension of Pre-2016 Pensioners be fixed at the highest of the 3 Options - including first two Options as recommended by 7th CPC and 3rd Option as accepted by the Government and Notified vide DOP&PW OM Dated 12-5-2017.

Sir/Madam,

Kindly refer to this office letter of even number dated 23.5.2017 circulating DoP&PW O.M. No. 38/37/2016-P&PW(A) dated 6.7.2017 regarding implementation of Government decision for revision of pension of pre-2016 pensioners/family pensioners.

2. Department of Pension & Pensioners Welfare has circulated O.M. No. 38/37/2016-P&PW (A) dated 6.7.2017 concordance tables for fixation of notional pay and pension/family pension of employees who retired/died in various grades during the 4th , 5th and 6th Pay Commission periods. A copy of the OM is forwarded herewith for information and compliance. The concordance table is available on the website of Department of Pension & PW at http://www.doppw.gov.in and appropriate table may be utilized in terms of instructions of DoP&PW O.M. dated 6.7.2017. In the case of those employees who retired/died before 01.01.1986, these concordance tables may be used based on their notional pay as on 01.01.1986, which was fixed m accordance with DoP&PW's O.M. No. 45/86/97-P&PW(D)(iii) dated 10.02.1998.

3. Separate tables have been given in respect of pre-01.01.2016 pensioners who retired in the Group D pay scales corresponding to 6th CPC grade pay of Rs 1300/-, Rs 1400/-, Rs.1600 and Rs. 1650/- (Table No. 1 to Table No.4) and for pensioners who retired during 6th CPC period after upgradation to the Grade pay of Rs 1800/- (Table No. 5 to Table No. 8). The pension/family pension of such pensioners/family pensioners may be revised using the appropriate table.

4. In case of any inconsistency in the concordance tables vis-a-vis the relevant rules/instructions, the notional pay and pension/family pension of pre-2016 pensioners/family pensioners may be fixed in accordance with the rules/instructions applicable for fixation of pay in the intervening Pay Commission periods.

5. It is requested that all concerned subordinate authorities may be instructed accordingly. Vigorous efforts may be made to complete all revision cases by 30.09.2017.  The nodal officer in each circle/DAP may please send the progress report on fortnightly basis in time.

The Ministries/Departments of the Central Government are aware of the orders issued by Department of Pension and Pensioners' Welfare (DoP&PW) contained in their OM No. 38/37/2016-P&PW(A) dated 12.5.2017 regarding revision of pension of pre-1.1.2016 retirees. In terms of para 4 thereof, the revised pension/family pension w.e.f. 1.1.2016 in respect of all Central civil pensioners/family pensioners, including CAPF's who retired/died prior to 1.1.2016 may be revised by notionally fixing their pay in the pay matrix recommended by the 7th Central Pay Commission in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died. The said OM further provides that this will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. 50% of the notional pay as on 1.1.2016 shall be the revised pension and 30% of this notional pay shall be the revised family pension w.e.f. 1.1.2016.

2. The Ministries/Departments are aware that actual implementation of the aforesaid order contained in the OM dated 12.5.2017 of the Department of Pension and Pensioners' Welfare involves a procedure for revision of pension of such pensioners, which covers a number of agencies like the Heads of Departments/Heads of Offices, under whose administrative control a particular pensioner had worked before retirement/death, the concerned PAOs, pension accounting organizations like CPAO in case of civil pensioners and similar pension accounting organizations pertaining to pensioners in Ministries of Railways, Defence and Department of Posts, etc. Therefore, a coordinated action amongst these agencies is required to ensure that revision of pension in such cases is processed expeditiously.

3. Accordingly, while the substantive matter pertaining to revision of pension of pre-1.1.2016 Central Government retirees concerns Department of Pension and Pensioners' Welfare as already provided in their aforesaid OM dated 12.5.2017 and any further substantive order thereon issued by them, there are certain procedural actions which need to be taken by the concerned administrative agencies in each Ministry/Department as well as the pension accounting organisations like the Central Pension Accounting Office under the Ministry of Finance, Department of Expenditure; Controller General of Defence Accounts under the Ministry of Defence and similar pension accounting organisations under the Ministry of Railways and Department of Posts etc so that appropriate implementation of the orders of Department of Pension and Pensioners' Welfare as per their OM dated 12.5.2017 is carried out expeditiously.

4. In order, therefore, to put the procedural issues in this regard in perspective and to provide for coordinated action amongst the concerned agencies, the following procedural points of action are to be taken by the concerned agencies as brought out below:
(A) Department of Expenditure, Ministry of Finance
(i) The fitment tables for fixation of notional pay will be worked out by the Department of Expenditure and provided to Department of Pension and Pensioners' Welfare for appropriate guidelines for the purpose of issue of any further substantive order in the matter.

(B) Department of Pension & Pensioners' Welfare
(i) The appropriate guidelines/ instructions for revision of pension based on fitment tables for notional pay will be issued for use by the pension revising administrative authorities, PAOs and pension accounting organisations in the Central Government.

(C) Pension Accounting Authorities
(i) The Central Pension Accounting Office in case of civil pensioners and similar pension accounting offices in the Ministry of Defence, Ministry of Railways, Department of Posts etc., shall pass on the available and relevant data of live pensioners to the concerned PAOs by 31.05.2017, if such data is already available with them. This action will be completed within two weeks. In cases where the data is not available, the same will be obtained by the pension accounting offices from the disbursing banks and shall be passed on to the concerned PAOs. This action will be taken up simultaneously and completed within four weeks.

(ii) The pension accounting offices, while passing on the data to the concerned PAOs, may also devise a suitable mechanism for electronic revision, as far as possible, to enable PAOs to process the cases of pension revision expeditiously.

(iii) The central pension accounting offices like the CPAO, at the time of passing on the data to the concerned PAOs, shall send a few illustrative examples on pension revision in such cases to the pension disbursing Banks to enable them to consider suitable changes in the software, if necessary, for the purpose.

(D) Pay & Account Office (PAO)/Head of the Department.

(i) The concerned PAOs, on receiving data from the pension accounting organizations, shall immediately, and not later than 3 days from the receipt of data, pass on the data to the concerned administration/establishment Branches/Heads of the Office (HOO)s under various Heads of Department (HODs) of the Ministries/Departments. The HOOs will also check their records to ascertain the actual numbers of retirees.

(ii) The concerned administration/establishment branches/Heads of Offices (HOO) under various Heads of Departments (HODs) of the Ministries/Departments shall take action to revise the pension in case of retirees who had worked under their administrative control, based on the orders issued by the Department of Pension and Pensioners' Welfare dated 12.5.2017 and any further order containing the fitment table providing for notional pay, after due verification of the relevant records.

(iii) In cases where records are readily available with the HoD/DDO, the action to process revision of pension shall be initiated forthwith and not later than 30 days from the date of receipt of the list of pensioners by the PAOs from the CPAO. In such cases, revised pension cases will be sent to the PAOs for further necessary action by the concerned administrative Branches/HOOs, which normally process the pension cases in case of employees under their administrative domain on their retirement/death.

(iv) In cases where records are not readily available, the concerned HOOs/HODs will ensure appropriate action for verification of such cases and ensure expeditious revision of pension as per the prescribed procedure and passing on the same to PAOs for further necessary action.

(v) On receipt of revised pension cases from the administrative/establishment branches, the PAOs shall take further appropriate action expeditiously and pass on the duly verified pension revision authorities to the pension accounting offices like the CPAO, which will in turn take further action to issue necessary instructions/authority to the disbursing Banks without delay.

(vi) Once the revised pension authority is received by the Banks, they will ensure timely payment of revised pension and arrears, if any, to the accounts of pensioners.

5. In order to ensure effective monitoring of the progress of pension revision based on the procedure outlined above, a monitoring mechanism will also be followed as brought out below:

(i) DOP&PW will periodically monitor the Ministry-wise progress of pension revision. For this purpose, Ministry-wise details would be made available by the respective pension accounting organisations, viz, CPAO, CGDA, etc, to the Department of P&PW.

(ii) The progress of pension revision at the HOD/HOO level will be monitored by the concerned JS(Admn) of the Ministry/Department on a weekly basis. This will be included as one agenda in the Senior Officers Meetings (5OM) in each Ministry/Department.

(iii) CPAO and similar pension accounting organisations shall place online a dashboard of the progress of revision of pension cases with PAOs, CCAs, nodal authorities of Ministries/Departments and Department of Pension and Pensioners' Welfare.

(iv) In order to ensure timely action on the part of Chief Controller of Accounts/Controller of Accounts/PAOs and Pension Accounting Organisations, a weekly progress meeting shall be held at the level of Chief Controller of Pension and this shall be monitored on monthly basis by Controller General of Accounts, CGDA and similar levels in the Ministry of Railways, Department of Posts, etc.

2. The applicability of the provisions of the aforesaid Office Memorandum of the Department of Pension & Pensioners Welfare to the members of All India Services has been considered and it has been decided that the provisions contained in the aforesaid Office Memorandum issued by the Department of Pension & Pensioners shall be equally applicable Mutatis-Mutandis to members of All India Service governed by the All India Service (Death-Cum-Retirement-Benefits) Rules, 1958.

Sub:- Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission - Revision of pension of pre-2016 pensioners/family pensioners, etc.

The undersigned is directed to say that the 7th Central Pay Commission (7th CPC), in its Report, recommended two formulations for revision of pension of pre-2016 pensioners. A Resolution No. 38/37/2016-P&PW (A) dated 04.08.2016 was issued by this Department indicating the decisions taken by the Government on the various recommendations of the 7th CPC on pensionary matters.

2.Based on the decisions taken by the Government on the recommendations of the 7th CPC, orders for revision of pension of pre-2016 pensioners/family pensioners in accordance with second Formulation were issued vide this Department's OM No. 38/37/2016-P&PW (A) (ii) dated 04.08.2016. It was provided in this O.M. that the revised pension/family pension w.e.f. 1.1.2016 of pre-2016 pensioners/family pensioners shall be determined by multiplying the pension/family pension as had been fixed at the time of implementation of the recommendations of the 6th CPC, by 2.57.

3.In accordance with the decision mentioned in this Department's Resolution 38/37/2016-P&PW (A) dated 04.08.2016 and OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016, the feasibility of the first option recommended by 7th CPC has been examined by a Committee headed by Secretary, Department of Pension & Pensioners' Welfare.

4. The aforesaid Committee has submitted its Report and the recommendations made by the Committee have been considered by the Government. Accordingly, it has been decided that the revised pension/family pension w.e.f. 01.01.2016 in respect of all Central civil pensioners/family pensioners, including CAPF's, who retired/died prior to 01.01.2016, may be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay. While fixing pay on notional basis, the pay fixation formulae approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. 50% of the notional pay as on 01.2016 shall be the revised pension and 30% of this notional pay shall be the revised family pension w.e.f. 1.1.2016 as per the first Formulation. In the case of family pensioners who were entitled to family pension at enhanced rate, the revised family pension shall be 50% of the notional pay as on 01.01.2016 and shall be payable till the period up to which family pension at enhanced rate is admissible as per rules. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

5.It has also been decided that higher of the two Formulations i,e. the pension/family pension already revised in accordance with this Department's OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016 or the revised pension/family pension as worked out in accordance with para 4 above, shall be granted to pre-2016 central civil pensioners as revised pension/family pension w.e.f. 01.01.2016. In cases where pension/family pension being paid w.e.f. 1.1.2016 in accordance with this Departments OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016 happens to be more than pension/family pension as worked out in accordance with para 4 above, the pension/family pension already being paid shall be treated as revised pension/family pension w.e.f. 1.1.2016.

6. Instructions were issued vide this Department's OM No. 45/86/97-P&PW(A) (iii) dated 10.02.1998 for revision of pension/ family pension in respect of Government servants who retired or died before 01.01.1986, by notional fixation of their pay in the scale of pay introduced with effect from 01.01.1986. The notional pay so worked out as on 01.01.1986 was treated as average emoluments/last pay for the purpose of calculation of notional pension/family pension as on 01.01.1986. The notional pension/family pension so arrived at was further revised with effect from 01.1996 and was paid in accordance with the instructions issued for revision of pension/family pension of pre-1996 pensioners/family pensioners in implementation of the recommendations of the 5th Central Pay Commission.

7. Accordingly, for the purpose of calculation of notional pay w.e.f. 1.1.2016 of those Government servants who retired or died before 01.01.1986, the pay scale and the notional pay as on 1.1.1986, as arrived at in terms of the instructions issued vide this Department's OM 45/86/97-P&PW(A) dated 10.02.1998, will be treated as the pay scale and the pay of the concerned Government servant as on 1.1.1986. In the case of those Government servants who retired or died on or after 01.01.1986 but before 1.1.2016, the actual pay and the pay scale from which they retired or died would be taken into consideration for the purpose of calculation of the notional pay as on 1.1.2016 in accordance with para 4 above.

8.The minimum pension with effect from 01.01.2016 will be Rs. 9000/- per month (excluding the element of additional pension to old pensioners). The upper ceiling on pension/family pension will be 50% and 30% respectively of the highest pay in the Government (The highest pay in the Government is Rs. 2,50,000 with effect from 01.01.2016).

9.The pension/family pension as worked out in accordance with provisions of Para 4 and 5 above shall be treated as ‘Basic Pension' with effect from 01.01.2016. The revised pension/family pension includes dearness relief sanctioned from 1.2016 and shall qualify for grant of Dearness Relief sanctioned thereafter.

10.The existing instructions regarding regulation of dearness relief to employed/re-employed pensioners/family pensioners, as contained in Department of Pension & Pensioners Welfare O.M. No. 45173/97-P&PW(G) dated 02.07.1999, as amended from time to time, shall continue to apply.

11. These orders would not be applicable for the purpose of revision of pension of those pensioners who were drawing compulsory retirement pension under Rule 40 of the CCS (Pension) Rules or compassionate allowance under Rule 41 of the CCS (Pension) Rules. The pensioners in these categories would continue to be entitled to revised pension in accordance with the instructions contained in this Department's M. No. 38/37/2016-P&PW(A)(ii) dated 4.8.2016.

12. The pension of the pensioners who are drawing monthly pension from the Government on permanent absorption in public sector undertakings/autonomous bodies will also be revised in accordance with these orders. However, separate orders will be issued for revision of pension of those pensioners who had earlier drawn one time lump sum terminal benefits on absorption in public sector undertakings, etc. and are drawing one-third restored pension as per the instructions issued by this Department from time to time.

13.In cases where, on permanent absorption in public sector undertakings/autonomous bodies, the terms of absorption and/or the rules permit grant of family pension under the CCS (Pension) Rules, 1972 or the corresponding rules applicable to Railway employees/members of All India Services, the family pension being drawn by family pensioners will be updated in accordance with these orders.
14.Since the consolidated pension will be inclusive of commuted portion of pension, if any, the commuted portion will be deducted from the said amount while making monthly disbursements.

15.The quantum of age-related pension/family pension available to the old pensioners/ family pensioners shall continue to be as follows:-

The amount of additional pension will be shown distinctly in the pension payment order.
For Example, in case where a pensioner is more than 80 years of age and his/her revised pension is Rs.10,000 pm, the pension will be shown as (i).Basic pension=Rs.10,000 and (ii) Additional pension = Rs.2,000 pm. The pension on his/her attaining the age of 85 years will be shown as (1).Basic Pension = Rs.10,000 and (ii) additional pension = Rs.3,000 pm. Dearness relief will be admissible on the additional pension available to the old pensioners also.

16.A few examples of calculation of pension/family pension in the manner prescribed above are given in Annexure-1 to this O.M.

17.No arrears on account of revision of Pension/Family pension on notional fixation of pay will be admissible for the period prior to 1.1.2016. The arrears on account of revision of pension/family pension in terms of these orders would be admissible with effect from 01.01.2016. For calculation of arrears becoming due on the revision of pension/ family pension on the basis of this 0.M., the arrears of pension and the revised pension/family pension already paid on revision of pension/family pension in accordance with the instructions contained in this Department's OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016 shall be adjusted.

18. It shall be the responsibility of the Head of Department and Pay and Accounts Office attached to that office from which the Government servant had retired or was working last before his death to revise the pension/ family pension of pre - 2016 pensioners/ family pensioners with effect from 01.01.2016 in accordance with these orders and to issue a revised pension payment authority. The Pension Sanctioning Authority would impress upon the concerned Head of Office for fixation of pay on notional basis at the earliest and issue revised authority at the earliest. The revised authority will be issued under the existing PPO number and would travel to the Pension Disbursing Authority through the same channel through which the original PPO had travelled.

19.These orders shall apply to all pensioners/family pensioners who were drawing pension/family pension before 1.1.2016 under the Central Civil Services (Pension) Rules, 1972, and the corresponding rules applicable to Railway pensioners and pensioners of All India Services, including officers of the Indian Civil Service retired from service on or after 1.1.1973. A pensioner/family pensioner who became entitled to pension/family pension with effect from 01.01.2016 consequent on retirement/death of Government servant on 31.12.2015, would also be covered by these orders. Separate orders will be issued by the Ministry of Defence in regard to Armed Forces pensioners/family pensioners.

20 These orders do not apply to retired High Court and Supreme Court Judges and other Constitutional/Statutory Authorities whose pension etc. is governed by separate rules/orders.

21. These orders issue with the concurrence of Ministry of Finance (Department of Expenditure) vide their 1. D. No. 30-1/33(c)/2016-1C dated 11.05.2017 and 1.D. No. 30-1/33(c)/2016-IC dated 12.05.2017.
22.In their application to the persons belonging to the Indian Audit and Accounts Department, these orders issue in consultation with the Comptroller and Auditor General of India.

23.Ministry of Agriculture etc. are requested to bring the contents of these orders to the notice of Heads of Department/Controller of Accounts, Pay and Accounts Officers, and Attached and Subordinate Offices under them on top priority basis. All Ministries/Departments are requested to accord top priority to the work of revision of pension of pre-2016 pensioners/family pensioners and issue the revised Pension Payment Authority in respect of all pre-2016 pensioners.

How, the battle is lost
One rank one pension denied

OPTION 1 recommended by 7th CPC for the revision of Pension/Family pension of pre-2016 Denied inspite of availability of service records of over 80% of old pensioners.

The alternative given vide OM dated 12.5.2017 though to some extent it will benefit a good % of old pensioners, it cannot make up the lifelong loss old pensioners will suffer due to denial of option 1. Ever since Honourable Supreme Court land mark judgement dated_____ in UOI vs D S Nakra. In the hide and seek game with UOI for 100% parity between present & past Civil Pensioners Bharat Pensioners Samaj had this time secured Penalty Corner but the Babu in DOP & PW foiled the final hit.

Why only DOP& PW, our own people must share the blame! The war veterans whom we had been supporting for years in their struggle for one rank one pension were the first to oppose 'Bharat Pensioners Samaj' demand for 100% parity/one rank one pension through electronic media as well as through representations (backed by their serving HODs) to GOI pleading that they only are entitled to this benefit and not the Civil pensioners

The final blow was delivered in the 7th meeting of feasibility committee on 17.10.2016 when as mentioned in Para 4 of the official minutes vide No. 38/37/2016-P&PW(A) GOI Ministry of Personnel, P.G. and Pensions -DOP &PW dated the 31st October, 2016 (placed here under). JCM (staff side) agreed with govt's alternative proposal.

DOP&PW is likely to issue Fitment Tables & Ready Reckoners soon for Revised Pension of Pre-2016 Pensioners as per OM Dated 12-5-2017 - as requested by RSCWS & BPS - to avoid delay in implementation of orders due to delay in issuing the Revised PPOs by the PSAs - i.e. the Offices from which the Pensioner Retired.

Regarding: Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission - Revision of pension of pre-2016 & post-2016 pensioners/family pensioners. Reference: DOP&PW OM NO.38/37/2016-P&. PW(A) Dated 12-5-2017

Kind attention is invited towards the DOP&PW OM Dated 12-5-2017 regarding Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission - Revision of pension of pre-2016 & post-2016 pensioners/family pensioners.

Incidentally, Fitment Tables and the Ready Reckoners have not been issued with the said orders as was done after every Pay Commission - both in respect of the Pay and Pension.

This will make the Revision of Pension very difficult, and time consuming as Notional Pay has to be fixed from one Pay Commission to the next since the Retirement of the employee for Revising their Pension as per Notional Pay in the Pay Matrix of 7th CPC.

This will substantially delay the issue of Revised PPOs and implementation of the said orders this time, causing hardship to the old Pensioners.

It is, therefore, earnestly requested that
i) Scale-wise Fitment Tables and Ready Reckoners may please be issued early for the Pensioners who had retired in the regimes of various Pay Commissions (especially those who retired from Pay Scales of Fourth, Fifth, Sixth and Seventh Pay Commissions.

ii) A dedicated Software may please be posted on the Pensioners Portal for the Revision of pension of pre-2016 & post-2016 pensioners/family pensioners and for expeditious issue of the Revised PPOs and for placing them on the Internet.
