Sir /Madam,
I am directed to refer to the relevant provisions for recording of
PAR under the AIS(PAR)Rules, 2007 as amended, including also the
provisions regarding the reporting / reviewing / accepting authorities
to record PAR not after one month of their retirement and also to this
Department’s letters of even number dated 27.03.2020 and 30.03.2020.
2. In view of the pandemic caused by the spread of COVID 19
and the consequent nation-wide Lockdown extended from time to time, AIS
officers are involved in various activities relating to management and
control of the pandemic, continuance of essential services and
maintenance of law and order etc. Further, most of the government
offices, except those involved in essential services and law and order,
are working with skeletal staff strength. In the light of exigent
situation, the timelines for online generation of PAR, and submission of
self-appraisal, recording of comments by reporting/ reviewing /
accepting authorities and also retired/retiring government officers were
extended vide this Department’s letters of even number dated 27.03.2020
and 30.03.2020.
3 In view of the continuance of the restrictions imposed due to
spread of COVID 19, it would still be practically difficult for the AIS
officers to either submit their self -appraisal or to record the PAR for
the year 2019-2020 as reporting / reviewing / accepting authority
within extended timelines. To overcome this, it has now been decided
with the approval of competent authority, to further revise the existing
cut-off dates prescribed for self-appraisal, reporting, reviewing and
acceptance of PAR in respect of AIS officers for the year 2019-20, in
relaxation of Rule 4 A (1), Rule 5(1) read with Schedule 2 of the AIS
(PAR) Rules, 2007 as amended, so as to give sufficient time to each authority, as indicated below:-
4. It has also been decided with the approval of Competent Authority,
that irrespective of their date of retirement, the reporting/
reviewing/ accepting authorities, retiring from 29.02.2020 to 31.10.2020
shall be allowed to record PAR for the year 2019-2020 beyond the extant
time line of one month after their retirement and as per the revised
timeline mentioned in para 3 above, in relaxation of Rule 7A of AIS
(PAR) Rules, 2007 as amended.
5. Further, it may cause a burden on healthcare system as well as
risk to AIS officers to get medical examination done for submitting
mandatory summary of Medical Report along with self-appraisal.
Therefore, with the approval of competent authority, it has also been
decided to delink the submission of summary of medical report from
recording and completion of APAR for the year 2019-2020 in respect of
AIS officers. Also, it has been decided to extend the timeline for
conduct of Annual Medical Examination and thereafter submitting the
summary of Medical Report for the PAR year 2019-2020 for a further
period up to 31.12.2020.
6. Notwithstanding anything contained herein, no remarks may be recorded after 31st December,2020 in the PAR of AIS officers for the PAR year 2019-2020, in accordance with the 2nd proviso of the AIS (PAR) Rules, 2007 as amended.

Subject: Instructions for the cases where the reporting / reviewing / accepting authority demits office or retires before the due dates prescribed for the PAR year 2018-19 for all AIS officers, vide DOPT's letter dated 26.4.2019- reg.
I am directed to refer to the subject noted above and to state that vide letter dated 26.04.19 (copy enclosed), this Department, had extended the cut off dates prescribed for online generation, filling of self-appraisal, reporting, reviewing and acceptance of PAR for the year 2018-19 through SPARROW portal for all levels of AIS officers , in relaxation of Rule 4A(1) of AIS (PAR) Rules.
Vide para 3 of the letter dated 26.04.2019 , it was stated that instructions for cases, where the reporting / reviewing / accepting authority demits office or retires before the due date. as amended , shall be issued separately
In view of the timelines for writing PARs having been extended in relaxation of Rule 4A(1) of AIS (PAR) Rules, the corresponding restrictions under Rule 7A of the said Rules, on the duration within which a reporting / reviewing/ accepting authority who has demitted office or retired from service may record their remarks, have also accordingly been considered to be modified appropriately for the PAR year 2018-19 .
Therefore, it has been decided that in relaxation of Rule 7A of the said rules, the timelines specified in the modified schedule for the PAR year 2018-19 , circulated vide letter dated 26.04.2019, shall apply to the reporting / reviewing / accepting authorities who demit office or retire from service prior to the respective cut off dates and they shall be allowed to record their remarks till the respective cut off dates.
However, for the authorities demitting office or retiring in September, 2019 or thereafter, the Rule 7A read with 2nd proviso to Rule 5(1) of AIS (PAR) Rules shall continue to be applicable.

Subject:
Implementation of Government's decision on the recommendation of the
Seventh Central Pay Commission - Revision of pension of pre-2016
pensioners / family pensioners etc - reg.
The undersigned
is directed to refer to this Department's letter of even number dated
19th May 2017 vide which the instructions dated 12th May 2017 relating
to revision of pension of pre-2016 pensioners issued by Department of
Pension and Pensioner's Welfare in the context of implementation of VII
CPC recommendations, were extended to All India Service (AIS)
Pensioners. The said letter dated 19th May 2017 was also sent to all
Ministries / Departments of Government of India (copy enclosed).
2.Many
retired AIS Officers who are drawing pension from the Central
Government, have since voiced grievances at various levels, stating that
pension revision in pursuance of the order dated 19th May 2017 has not
taken place so far.
3.It is observed in this regard that CPAO,
with the approval of the Controller General of Accounts, have issued
instructions on 25th May 2017 to Pr. Chief Controller of Accounts /
Chief Controller of Accounts etc. about the modalities to be followed
for expeditious implementation of the instructions dated 12th May 2017
of the D/o Pension & PW. Joint Secretary (Admn) / Admin in charge of
Ministries / Departments have also been requested by CPAO to instruct
their Head of Offices (HOOs) to start immediately sending the revised
pension cases to the PAOs on the basis of records available with them
and monitor the progress in this regard. Further follow up instructions
have also been issued by CPAO on 7 th July 2017.
4.In view of the
hardships being encountered by retired AIS Officers vis-a-vis revision
of their pensions, all Ministries / Departments are requested to take
necessary action for effective and expeditious implementation of the
instructions dated 19th May 2017 pertaining to revision of pension of
AIS Officers read with D/o Pension and PW instructions dated 12th May
2017.

Amendments in the recommendations of the 7th Central Pay Commission

Subject: Amendments in the recommendations of the 7th Central Pay Commission - reg.
Sir/Madam,
The Ministry of Finance, Department of Expenditure vide Resolution No.1-2/2016-IC dated the 16th May, 2017 has
made certain changes in the recommendation of the Seventh Central Pay
Commission. The following changes are relevant for All India Service
officers:
(i) The Index of Rationalisation (IOR) of Level 13 of
Civil Pay Matrix shall be enhanced from 2.57 to 2.67. Accordingly, the
Civil Pay Matrix as contained in Schedule-III of IAS (Pay) Rule, 2016
dated 08.09.2016, IPS (Pay) Rule, 2016 dated the 23.09.2016 and IFS
(Pay) Rule, 2016 dated 28.09.2016 shall be revised as at Appendix-I
(copy enclosed)
(ii) The provision contained in Rule 7 of the
aforesaid Rules shall be revised to the extent that the benefit of pay
protection in the form of personal pay of officers posted on deputation
under Central Staffing Scheme, as envisaged therein, shall be given
effect from 1st January, 2016 instead of 25th July, 2016. Further, this
benefit shall also be extended to officers from Services under Central
Staffing Scheme, coming on deputation to Central Government, on posts
not covered under Central Staffing Scheme.
Accordingly, the Rule 7
of IAS (Pay) Rule, 2016 dated 08.09.2016, IPS (Pay) Rule, 2016 dated
the 23.09.2016 and IFS (Pay) Rule, 2016 dated 28.09.2016 shall be
revised as under:
7. Pay protection to officers on Central deputation.
"If
the pay of the AIS officers posted on deputation to the Central
Government, is fixed in the revised pay structure, either under these
rules or as per the instructions regulating such fixation of pay on the
post to which they are appointed on deputation, and happens to be lower
than the pay they would have been entitled to had they been in their
parent cadre and would have drawn that pay but for the Central
deputation, such difference in the pay shall be protected in the form of
Personal Pay with effect from the 1st January, 2016".
The
State Government is requested to furnish their comments on the proposed
amendments immediately and positively by 26th May, 2017. If no reply is
received by this time, it would be presumed that the State Government
concurs with the said amendments.
This issues with the approval of the competent authority.

Subject: Proposal to amend AIS (PAR) Rules, 2007 - reg.
Sir / Madam;
The undersigned is directed to refer to the subject noted above and to say that this Department is in the process of amending rule AIS(PAR)Rules, 2007. The proposed amendments (copy enclosed), inter alia, provide for:-
(i) Mandatory filing of PAR electronically and exceptions thereof
(ii) Modified procedure for submitting representation by the member of service after disclosure of PAR and role of the newly defined competent authority and referral board.
(iii) Seeking comments of reporting / reviewing / accepting authority on relinquishing charge (transfer) and superannuation.
(iv) Revised timelines filling of PAR by AIS officers, as specified in schedule for completion of PARs in para 9 under general guidelines for filling of the PAR form (Annexure-I).
2. Therefore, it is requested to furnish your comments/views on the proposed amendments in AIS (PAR) Rules, 2007 to this Department latest by 15thMarch, 2017 positively. Soft copy of the comments / views may also be sent by email at soais3nic.in.
If no reply is received within the stipulated time, it will be presumed that State Government has no objection to the proposed amendments.
