Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission – Revision of pension of pre-2016 retired Medical Officers of Army Medical Corps/ Army Dental Corps/ Remount & Veterinary Corps-reg.

Sir,

The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2017/ (02)/D(Pension/ Policy) dated 5 September 2017. In accordance with Para-4 of this letter, the revised pension/ family pension of all Armed Forces Personnel who retired/ died prior to 01.01.2016, shall be revised by notionally fixing their pay in the pay matrix recommended by the 7t CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/ died. This will be done by notional pay fixation under each intervening Pay Commissions based on the formula for revision of pay. The revised rates of Military Service Pay, Non-Practice Allowance, where applicable, and ‘X’ Group. Pay & Classification Allowance for JCO/ORs, if applicable notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emoluments as of 01.01.2016 while fixing pay on notional basis. It was further decided at para-6 of the letter that higher of the two formulations ice. the pension/ family pension already revised in accordance with this Ministry’s letter No. 17 (01)/ 2016-D(Pen/Pol) dated 29.10.2016 or the revised pension/family pension as worked out in accordance with Para-5 of the MoD letter dated 05.09.2017 referred above, shall be granted to pre-01.01.2016 ‘Armed Forces pensioners as revised pension/family pension w.e.f. 01.01.2016.

2. Department of Pension & Pensioners’ Welfare vide their OM No. 38/37/16-P&PW(A){iii) dated 11th September 2017 have decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay as of 01.01.2016 to arrive at pension/ family pension of retired medical officers w.e.f. 01.01.2016 and the pension/ family pension of retired medical officers shall be further revised w.e.f, 01.07.2017 by adding NPA @ 20% to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 subject to the condition that the notional pay as on 01.01.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.

 

3. The matter regarding revision of all kinds of pension/ family pension of medical officers of Armed Forces who have retired/ died prior to 01.01.2016 has been examined by the Govt. and it has been decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay worked out in terms of Para-4 of the MoD letter No. 17(01)/2017/(02)/D (Pension/ Policy) dated 5th September 2017 to arrive at notional reckonable emoluments as on 01.01.2016 for calculation of pension/ family pension of pre-01.01.2016 retired/ died Medical Officers of Armed Forces, w.e.f. 01.01.2016. All kinds of pension/ family pension of pre-01.01.2016 retired/ died medical officers of Armed Forces Pensioners/ family pensioners shall be further revised w.e.f. 01.07.2017 by adding NPA @ 20% of notional pay in VIIth CPC scale to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 (which was 25% of pre-revised scale).

4. The fixation of pension/ family pension of retired Medical officers of Armed Forces in the above manner, shall be further subject to the condition that emoluments (ie. Basic Pay + MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.

5. This issues with the concurrence of the Ministry of Defence (Finance/ Pension) vide their ID No. 10(8)/2018/Fin/Pen dated 23.12.2020.

These instructions shall apply mutatis mutandis on the  Railways also. The Rule 33 of the Central Civil Services (Pension) Rules, 1972 corresponds to Rule 49 of the Railway Services (Pension) Rules, 1993. The Ministry of Finance, Department of Expenditure's O.M. No. 12-2/2016-EIII. A dated 7th July, 2017 reffered to in the enclosed O.M. dated 08.11.2017, has been adopted on Railways vide this office's letter No. PC-V/2017/A/NPA/1 dated 4th August,2017.

Sub : Implementation of Government's decision on the recommendations of the Seventh Central Pay Commission Revision of pension of pre-2016 retired medical officers.

The undersigned is directed to say that in implementation of the decision taken on the recommendations of the 7th CPC, orders were issued vide this Departments OM No.38/37/2016-P&PW(A)(ii) dated 04.08.2016 for revision of pension of pre-2016 pensioners/family pensioners w.e.f. 01.01.2006 by multiplying the pre-revised pension/family pension by a factor of 2.57. Subsequently, vide OM No. 38/37/2016-P&PW(A) dated 12.05.2017, it has been decided that the pension/family pension w.e.f. 01.01.2016 in respect of all Central civil pensioners/family pensioners, who retired/died prior to 01.01.2016, may be revised w.e.f. 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay hand and grade pay at which they retired/died. This will be done by notional pay fixation under each intervening Pay Commission based on the Formula for revision of pay

2. In the case of medical officers, the emoluments reckoned for calculation of pension include Non-practicing Allowance (NPA). The pay of the medical officers is revised in accordance with the specific provision made in the Revised Pay Rules. The manner in which the pay of the medical officers is to be revised w.e.f. 1.1.2016 is prescribed in Rule 7 of the CCS (Revised Pay) Rules, 2016. Accordingly, for the purpose of revision of pension of pre-2016 retired medical officers in accordance with this Department’s O.M. dated 12.05.2017, their pay will be notionally revised w.e.f. 1.1.2016 based on the formula for revision of pay as applicable to the medical officers in the 7th CPC as well as in the intervening Pay Commissions. NPA at the rate as applicable as on 01.01.2016 shall be added to such notional pay as on 1.1.2016 to arrive at pension/family pension of retired medical officers w.e.f. 1.1.2016.

3. NPA to serving medical officers has been revised @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the pension/family pension of retired medical officers shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the notional pay as on 1.1.2016, instead of the NPA admissible as on 1.1.2016.

4. The revision of pension/family pension of retired medical officers in the above manner will be further subject to the condition that the notional pay as on 1.1.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.

5. This issues with the approval of Ministry Of Finance, Department of Expenditure vide their I.D.No.136/EV/2017 dated 25.08.2017.

Sub: Enhancement of remuneration of retired Medical officers appointed on contract basis in Postal Dispensaries.

Sir/Madam,
In continuation of this Directorate letter of even No. dated 30th September, 2014 vide which remuneration payable to newly appointed contractual doctors in P&T dispensaries were enhanced to Rs. 60,000/- per month. It has now been decided to enhance the remuneration further to Rs. 75,000/- from Rs. 60,000/- per month. It is requested that instructions of Rule-177 of General Financial Rules-2017 may be complied with.
This should come into effect w.e.f. 1st July, 2017 and it issues with the concurrence of JS & FA vide Dy. No. 1603 dated 2nd August, 2017.

Subject : Revision of pension of pre-1996 pensioners – inclusion of Non- Practicing Allowance (NPA) for revision of pension of retired medical officers w.e.f. 1.1.1996

The undersigned is directed to say that in this Department’s OM No.45/10/98-P&PW(A) dated 17.12.1998, it was provided that pension of all pensioners irrespective of their date of retirement would not be less than 50% of the minimum of the revised scale of pay introduced w.e.f. 1.1.1996. In this Departments OM No.45/3/99-P&PW(A) dated 29.10.1999, it was clarified that in the case of retired medical officers, Non-Practicing Allowance (NPA) was not to be added to the minimum of the revised scale of pay as on 1.1.1996 for stepping up of the consolidated pension/family pension to 50% / 30% respectively, in terms of the OM dated 17.12.1998.

2. In its judgment dated 27.11.2013 in Civil Appeal No.10640-46/2013 and other connected matters, Hon’ble Supreme Court has observed that in accordance with Ministry of Health and Family Welfare’s OM No.45012/11/97-CHS.V dated 7.4.1998, NPA counts as pay for all service benefits including retirement benefits. Hon’ble Supreme Court has further observed that clarification issued vide this Department’s aforesaid OM dated 29.10.1999 is legally unsustainable. Hon’ble Supreme Court has directed to recalculate the pension payable to the Applicants (i.e. pre-1996 retired medical officers) by adding the element of NPA. The Review Petitions filed by the Government against the above mentioned judgment have been dismissed by Hon’ble Supreme Court on 31.7.14.

3. It has now been decided, in consultation with Ministry of Finance, Department of Expenditure and Ministry of Law, Department of Legal Affairs to implement the judgment dated 27.11.2013 of Hon’ble Supreme Court in CA No.10640-46 of 2013 and other connected matters. Accordingly, in the case of pre-1996 retired medical officers, NPA @ 25% shall be added to the minimum of the revised scale of pay as on 1.1.1996 corresponding to the pre-1996 pay scales from which the pensioner had retired, in cases where consolidated pension/family pension was to be stepped up to 50% / 30% respectively of the minimum of revised pay-scale in terms of OM No.45110/98-P&PW(A) dated 17.12.1998 read with OM No.45/86/97-P&PW(A) (Pt.) dated 11.5.2001.

4. This issues with the approval of Ministry of Finance, Department of Expenditure vide their I.D. No. 518/E-V/2014 dated 29.9.2014.
