Technical Staff(Helpers, Technicians, JEs and SSEs) of all Engineering Disciplines(Civil, Electrical, Mechanical and S&T Deptts.), staff engaged in train operation, sanitation and many staff of Medical Department are prone to Risk and Hardship. Their level of Risk and Hardship may vary according to their job contents, working conditions, weather conditions, work pressure and surrounding environments at the respective places.

While drawing structure of Risk and Hardship Matrix, it is clarified that, the Matrix only aims to compensate for Risk and Hardship involved in job/work environment and it does not determine status in any way.

Ministry of Railways (Railway Board) have decided to constitute a Committee for inclusion of fresh categories within the ambit of Risk & Hardship Allowance. The Committee will consist of the following:-

The Terms of Reference of the Committee will be as under:-

"To holistically examine the inclusion of fresh categories within the ambit of Risk and Hardship Allowance introduced by 7th CPC."

1. The tenure of the Committee will be Six months from the date of its constitution.
2. The Headquarters of the Committee will be at New Delhi.
3. PC-VII branch, Railway Board will be the Nodal branch for functioning of the Committee. Therefore, submission of report of the Committee for consideration of Railway Board, implementation of its recommendations and all related issues including Parl, Questions, RTI cases and other formalities with regard to the Committee, shall be dealt with by PC-VII branch, Railway Board.
4. The Convener and Members of the Committee will draw TA/DA as per extant rules.

Ref: (i) Railway Board's letter No.87/2017) No. PC-VIII/ 2017/I7/5/4 dated 1/08/2017 (RBE (P), E.C. Railway vide letter

(ii) Railway Board's clarification issued to GM No. PC-VII/ 2017/I7/5/4 dated 25/10/2018.

Federation desires to bring to the kind notice of Railway Board that consequent to the acceptance of recommendations of 7th CPC relating to grant of Risk & Hardship Allowance to Track Maintainers, the Railway Board vide letter dated 10/0812017 (RBE No. 87/2017) issued instructions to the GMs of Zonal Railways to grant Risk & Hardship Allowance to the Track Maintainers of Indian Railways as per Cell R3 H2 of Risk and Hardship Matrix @ Rs 2700/- p.m. per person. The 7th CPC in its ;eport mentioned that the "Track Maintainers-I, II, III and IV of lndian Railways should be granted Risk & Hardship Allowance in view of hardship faced by these categories of employees".

It has however been brought to the notice ofthe Federation that on a reference received from GM (p), E.C. Railway, thelailway Board vide letter dated25ll0l2018 addressed to GM (p), E.C. Railway, has clarified that the Track Maintainers working in Construction Oiganizations are not eligible for grant of Risk and Hardship Allowance. Federation does not agiee with the unjustifieJ view taken by the Railway Board and the same is unacceptable to NFIR due to the following reasons:-

• Track Maintainer is essentially required to work on Rail tracks, whether under Open line or in the Constructions Organizations.
• In the Construction Organization, the Track Maintainers are required to perform duties of laying of rails, sleeper, points, and crossing in a programmed way and for completing work within targeted periods. Hardship and Risk is involved in their duties.
• It needs to be appreciated that the Track Maintainer by designation, has been granted Risk and Hardship Allowance, therefore denying Risk and Hardship Allowance to the desisnated Track Maintainers working in Construction Organizations is improper.

The duties performed by the Track Maintainers working in Construction organization as mentioned above justify payment of Risk and Hardship Allowance in accordance with Board's instructions dated 10/0812017 (RBE No. 87/2017). The erroneous clarification of the Railway Board vide letter dated 25/10/2018 therefore needs to be withdrawn immediately.

NFIR, therefore, requests the Railway Board to review the case and withdraw Board's letter dated 25110/2018. Action taken in the matter may be apprised to the Federation.

Sub: Risk and Hardship Allowance - coverage of Safety category Staff such as Pointsmen, Gate Keepers, Operating Staff working in Yard etc., Electrical Staff in TRD, Staff of AC Coaches, EMUs, Electrical Workshops & staff working in General Services (Power and Train lighting) and Staff of S&T Department in Railways-reg.

Ref:   (i)  Railway Board's letters No. PC-VII/2017/I/7/5/4 dated 10/08/2017.

         (ii)  NFIR' s letter No. I/5(g)/Part V dated 29/08/2017.

Kind attention of Railway Board is invited to Federation’s letter dated 29/08/2017 wherein it was requested to take action for covering the remaining categories of P. Way staff such as Black Smiths, Welders etc., for payment of Risk & Hardship Allowance as their duties/responsibilities are also risky and hardships prone due to the fact that they are required to work physically on the P. Way tracks and that the 7th CPC has unfortunately failed to consider the role of these staff in laying/maintenance of Railway tracks. However, decision for payment of Risk & Hardship Allowance in favour of these P. Way staff working (Black Smith, Welders etc.,) is yet to be taken by Board. A copy of Federation’s letter dated 29/08/2017 on the subject is enclosed for ready reference.

Further to above, Federation finds that the jobs performed by Pointsmen, Traffic Gate Keepers, Traffic Assistants (Operating Department - working in Yards, stations etc.,), Staff of TRD/OHE, AC Coaches, EMU Car Sheds, Electrical Workshops, General Services and S&T Staff are also risky consequently they are prone to accidents and health hazards. These categories have not been covered for Risk & Hardship Allowance under the Risk & Hardship Matrix (Cell R3H2) due to the reason that the 7th CPC had failed to give weightage to the nature of duties and responsibilities being performed by these staff. The Railway Board also has not taken initiative to highlight the Risk and Hardship conditions before the Committee on Allowances headed by the Finance Secretary, Government of India.

NFIR, therefore, requests the Railway Board to kindly arrange to initiate action for covering P. Way Staff such as Black Smiths, Welders, Helpers, Pointsmen, Traffic. Gate Keepers, Traffic Assistants (Operating Department), Electrical Staff working in TRD/OHE, AC Coaches, EMU Car Sheds, Electrical Workshops, General Services and S&T Staff under Risk and Hardship Matrix (Cell R3H2) for payment of Risk & Hardship Allowance @ Rs. 2700/- p.m. Action taken in the matter may kindly be apprised to the Federation soon.

Consequent upon the acceptance of recommendation of 7th Central Pay Commission on Allowances, the President is pleased to decide grant of Risk and Hardship Allowance to Track Maintainers - I, II, III & IV of Indian Railways as per cell R3H2 (Rs. 2700 for Level 8 and below and Rs. 3400 for Level 9 and above) of Risk and Hardship Matrix.

The amount of ex-gratia lump sum compensation available to the families of Central Government Civilian employees, who die in the performance of their bona fide official duties under various circumstances, has been increased on the recommendations of the 7th Pay Commission w.e.f. 01/01/2016 vide DoP&PW OM No.38/37/2016-P&PW(A)(i) dated 04/08/2016, as under:

The rate of ex-gratia lump sum compensation for 100 percent disability to CAPFs & Assam Rifles personnel, who are disabled in the performance of their bonafide official duty under various circumstances and are boarded out from service on account of disability attributable to aggravated in service, has been revised vide this Ministry OM No.27011/64/2010-R&W (Part) dated 07/06/2017 from Rs. 09 lakhs to Rs. 20 lakhs w.e.f 01/01/2016.

The 7th CPC has recommended a common regime of Risk and Hardship Allowance for Army and CAPFs which has been accepted by the Government.

This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in a written reply to question by Shri Bahadur Singh Koli in the Lok Sabha today.

7th CPC: AIIMS nurses to go on mass casual leave tomorrow

Services at AIIMS are likely to be hit tomorrow as around 5,000 nurses of the premier hospital plan to go on mass casual leave to protest against the "discrimination" by the Seventh Central Pay Commission.
The AIIMS Nurses Union has also threatened to go on an indefinite strike from March 27 if their demands for revision of their pay scales and a hike in allowances are not met.

We are protesting against the retrograde recommendations of the Seventh Pay Commission. Our demand is that the entry pay grade for staff nurses should be enhanced to Rs 5,400 from the existing Rs 4,600 and the nursing allowance should be enhanced by Rs 7,800.

Besides, risk allowance and night duty allowances should be given to all nurses as it is given to all other government employees, said Harish Kumar Kajla, President of AIIMS Nurses Union.

We deal with the deadly infections daily but we are not provided enough risk allowance. If the demands are not met, we will go on an indefinite strike from March 27, Kajla added.

The association further claimed that the AIIMS management despite giving assurances has not addressed their issues for over a year.

On the assurance give by the management in a meeting regarding recommendation of enhanced pay scale, the Nurses Union had withdrawn the agitation called upon by the All India Nurses Union and subsequently withdrawn the mass casual leave called on February 26, 2016.

The AIIMS Nurses Union was patiently waiting for the last one year for the fulfilment of the promises made by the administration but our demands went into deaf ears. Despite repeated representations, the administration has shown no mood to address the issue raised by the Union, Kajla claimed.
According to faculty members, the move will badly hit the emergency services and the functioning of the operation theatres of the institute apart from other patient services.

The pay scales proposal has been sent to the Ministry of Health for consideration while the report of government on the allowances has not yet been finalised, a senior AIIMS official said.

2. The Terms of reference of the Committee will be as under:-

i) To find out whether the duties and responsibilities of kitchen staff including Cooks, Asstt. Cooks and Mates working in Railway Hospitals/Health Units involve continuous and routine contacts with communicable diseases and handling infected materials, instruments, which can spread infection and thereafter would take final decision ·regarding their entitlement to Hospital Patient Care Allowance(HPCA)/Patient Care Allowance(PCA)/Risk Allowance; and

ii) To find out if any other category of staff working in Railway Hospitals/Health Units are eligible for HPCA/PCA as per demands made by the Federations/ Associations.

3. The Committee should submit its report within a period of two months from the date of its constitution.

4. The Headquarter of the Committee will be at New Delhi.

5. The Health Directorate of Railway Board will be the Nodal Directorate for functioning of the Committee.

Kindly refer to FHQrs letter No.E-12013/1/10-Estt.11/4490 dated 04/12/2009 and letter of even No.(515) dated 23/02/2011 regarding admissibility for grant of Risk/Hardship allowance for CISF personnel posted in PSUs, Airports in J&K and NE region.

2. The matter was taken up with MHA and MHA has now intimated vide their letter No.11- 27012/25/CF-62360/2010-PF.1 dated 16/04/2014 that proposal for Risk/Hardship allowance for C1SF personnel deployed at PSUs, Airports in J&K and NE region has not been agreed to.

3. In view of the above, it is requested to give instructions to all Unit Commander’s under your jurisdiction to stop giving Risk/Hardship allowance with immediate effect.

4. A consolidate compliance report may be forwarded to FHQr (Estt Branch) by 30th April 2014 positively.

A question has been raised by the Member of Parliament about the provision of Special Allowances to CRPF Personnel deployed in difficult areas and encaged in counter insurgency operations in the country and the concerned Minster of State for Home Affairs Shri R.P.N.Singh replied as under...

Government of India has approved grant of Risk/Hardship Allowance to the combatized personnel of the Central Armed Police Forces (CAPFs), including Central Reserve Police Force (CRPF), upto the rank of Commandant, based upon their area of deployment in difficult areas.

Further, personnel of CAPFs, including CRPF, deployed in the areas/coordinates defined by the Army, are granted Field Area Allowance or the Counter Insurgency Operation (CI Ops) Allowance as admissible to the Army.

Government has approved Five Year Perspective Modernization Plan-II (2012-2017) for CRPF with a financial outlay of Rs.2619.16 crore which has been allocated to CRPF vide MHA order dated 20.6.2013. The various items, inter-alia, include modern Arms and Ammunition, Communication Equipments, Night Vision Devices, Surveillance Equipment, Special Purpose Vehicles etc.

Subject: Risk Allowance to Central Government employees - clarification reg.

Reference in invited to this Department’s O.M. No.21012/01/2008-Estt.(Allowance) dated 18th June, 2012 wherein the grant of Risk Allowance was extended at the then existing rates beyond 30.06.2012 and upto 31.12.2012. Subsequently, vide this Department’s OM. No.21012/01/2010-Estt. (Allowance) dated October 18, 2012 the rates of Risk Allowance were revised with effect from 1st September, 2008, implying that grant of Risk Allowance would be at revised rates w.e.f. 1st September, 2008 onwards. Hence, there is no need for issuing separate instructions continuing payment of Risk Allowance beyond 31.12.2012.

This issues with the approval of Joint Secretary (Establishment).

Will the Minister of HOME AFFAIRS be pleased to state:-

(a) whether any proposal is under consideration of the Government to bring the risk allowance given to Central Armed Police Forces (CAPF) including CRPF personnel deployed in maoist strongholds at par with their counterparts in Jammu and Kashmir or the North Eastern Region of the country; and

(b) if so, the details thereof and the time by which a final decision is likely to be taken by the Government in this regard?

ANSWER

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI R.P.N. SINGH)

(a) to (b): At present, no such proposal is under the consideration of the Government. As per the Ministry of Home Affairs order dated 16.4.2009, Risk/Hardship Allowance is sanctioned to the combatized Central Armed Police Forces (CAPFs) personnel upto the rank of Commandant, based upon their deployment at different places in India including Jammu & Kashmir, North Eastern Region and Left Wing Extremist (LWE) States.

Sub : Enhancement in the rate of Risk Allowance in respect of eligible unskilled staff on the railways in accordance with DOP&T's guidelines.

 

Ref : Railway Board' letter No.E(P&A)I-84/SP-1/TP-1 dated 21.08.1991.

 

It has been decided to enhance the rate of Risk Allowance in respect of eligible unskilled workers on the railways/Production Units as per list attached.

 

2. The V CPC had recommended that Risk Allowance should be admissible to only those staff who face continuous risk rather than contingent risk while performing their duties. As such in accordnace with these guidelines, the categories/staff engaged in the jobs as mentioned in the list annexed with this letter were identified as eligible for grant of Risk Allowance. The rate of Risk Allowance in respect of these categories/staff is enhanced from the existing rate of Rs.20 per month to Rs.40 per month w.e.f. 01.09.2008 to 31.12.2010.

 

3. The rate of the Risk Allowance would increase by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.

 

4. Subsequent to enhancement in the rate of Dearness Allowance to 51%, the rate of Risk Allowance would be Rs.50 per month from 1.1.2011 onwards.

 

5. The categories who are in receipt of HPCA/PCA are not eligible for grant of Risk Allowance.

 

6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

List of categories / Staff engaged in the following jobs are eligible for Grant of Risk Allowance.

1. Those directly engaged in spray painting.

2. Those directly engaged in galvanising tanks, effluent treatment plant, manufacturing of insulation components involving hazardous chemicals etc.

3. Those directly engaged in use of electrolytes.

4. Those directly exposed to metallic dust, fumes generated from resin bakers, smoke from the furnance, carbon burst shops.

5. Those directly working in Melting Shop in all foundaries where scrap is used.

6. Moulding shop in Rail Wheel Factory / Bangalore.

7. Those directly engaged in chrome plating.

8. Safaiwalas directly working in underground drains/sewer pipes, cleaing of manholes.

9. Safaivalas directly working in sewerage treatment plant in workshops.

10. Malaria Khalasis directly engaged in spraying pesticides, handling acids, anti-larval drugs, etc.

11. Chest Clinic Staff.

12. X Ray Attendants.
