Subject:- Board level posts and below Board level posts including Non-unionised supervisors in Central Public Sector Enterprises (CPSEs) - Revision of scales of pay w.e.f. 01.01.1997 - Payment of IDA at revised rates regarding.

In modification of this Department's O.M. of even No. dated 04.072018, the rate of DA payable to the executives of CPSEs (1997 pay revision) is as follows:
a) Date from which payable: 01.10.2018
(b) Average AICPI (1960-100) for the quarter June, 2018 - Aug., 2018
June, 2018 - 6641
July, 2018 - 6872
Aug., 2018 - 6872

2. These rates are applicable in the case of IDA employees, whose pay have been revised with effect from 01.01.1997 as per DPE O.M. dated 25.06.1 999.

3. All Administrative Ministries/Departments of the Government of India are requested to bring the foregoings to the notice of the CPSEs under their administrative control for necessary action at their end.

I am to invite your attention to the references cited.

2. Based on the recommendations of the Official Committee, 2017, orders have been issued in the Government Orders first to fourth cited granting revision of pay, special pay and allowances to the State Government employees and teachers including employees of local bodies. The pay revision has been given notional effect from 1st January 2016 with monetary benefit from 1st October 2017.

3. As per Rule 6(2) of the Tamil Nadu Revised Pay Rules, 2017 every employee shall have to exercise option to come over to the revised pay structure within 3 months from the date of coming into force of the above rules on a date advantageous to the employees concerned as classified under sub-rule (1) of the above Rules. Considering the time limit available for exercising option by the employees to switch over to the revised pay structure, the pay bills have been presented by the Drawing and Disbursing Officers in the old pay itself to avoid difficulty in drawing salary by the employees.

4. Based on the option exercised by the individual employees,
(i) In the case of non-self drawing employees, the Heads of Offices concerned shall fix the pay of such employees in the revised pay structure and send the orders to the Drawing and Disbursing Officers concerned for drawing salary in the new pay immediately;

(ii) Likewise in the case of self-drawing officers, the Pay and Accounts Officer in case of the city offices including Pay and Accounts Officer, Madurai and in respect of other officers in Districts, the Accountant General shall fix the pay of the Officers in the revised pay structure and issue necessary pay slips so as to enable the Officers concerned to present the bills and draw the salary in the new pay structure immediately.
5. The Drawing and Disbursing Officers concerned on getting the orders from the Heads of Offices / pay fixing authorities concerned shall draw and disburse monthly salaries in the new pay structure from the month of November 2017 along with arrears for the month of October 2017. They shall present salary bills accordingly for the month of November 2017 after claiming arrears for October 2017 before 20-11-2017.

6. The National Informatics Centre (NIC) is requested to update the software application for salary bills in accordance with the orders issued in the Government Orders cited to enable drawing of salary in revised pay structure from November 2017, after claiming the arrears for the month of October 2017 before 20-11-2017.

7. The Commissioner of Treasuries and Accounts is also requested to co-ordinate with the National Informatics Centre (NIC) to finalise the revised software application for presenting salary bills in the revised pay structure immediately.

8. All Head of Departments are therefore requested to issue necessary instructions to all their subordinate officers to adhere to the above instructions scrupulously.

Subject: Revision of pay of the Chairpersons and Members of the Regulatory Authorities / Bodies consequent to the implementation of the 7th Central Pay Commission recommendations.

This Department had, vide OM No. 3/ 6/ 97-Estt.(Pay-II) dated 29th January 1998, issued guidelines regarding perquisites and some important terms and conditions for the Chairpersons and Members of the Regulatory Authorities and allied matters.

2. These guidelines were applicable to Chairpersons and Members of existing Regulatory Authorities also, appointed subsequent to the issue of these guidelines, unless there is a constitutional or statutory obligation to the contrary. As per the aforesaid guidelines, the Chairperson would be eligible for pay not exceeding Rs. 26,000/ - p.m. (fixed) and Members would be eligible for pay scale not exceeding Rs.22400-525-24500. The pay will be fixed in accordance with the prevailing orders, i.e. pay minus pension.

3. After implementation of the Sixth Pay Commission, in order to attract expertise available outside the Government, the full time Members of TRAI, CERC, IRDA, SEBI and CCI were granted consolidated pay packages vide orders of Ministry of Finance, Department of Expenditure. Replacement scales of Rs.80,000/- p.m. and Rs.37400-67000 (PB-4) with Grade Pay of Rs. 12000/- (since replaced with HAG scale of Rs.67000-79000) were granted respectively to Chairpersons and Members of all other Regulatory Authorities / Bodies.

 4. The 7th CPC has looked into the emoluments structure, including pay, allowances and other facilities/benefits, in cash or kind of the members of Regulatory Bodies (excluding the Reserve Bank of India) set up under Acts of Parliament, and have given their recommendations in Chapter-13 of their Report. As per recommendations of the 7th CPC, as accepted by Government of India, and also as intimated by Department of Expenditure vide OM No. 394959/ E.IIIA/ 2017 dated 211d March 2017, the pay and allowances of Chairperson and fulltime Members of Telecom Regulatory Authority of India (TRAI), Insurance Regulatory and Development Authority (IRDA), Central Electricity Regulatory Commission (CERC), Securities and Exchange Board of India (SEBI), Competition Commission of India (CCI), Pension Fund Regulatory and Development Authority (PFRDA), Petroleum and Natural Gas Regulatory Board (PNGRB), Warehousing Development and Regulatory Authority (WDRA), Airports Economic Regulatory Authority of India (AERAI), Railway Development Authority (RDA) and Insolvency & Bankruptcy Board of India (IBBI) which have been de-linked from Government salaries will be governed by the orders issued by the Department of Expenditure.

5. In respect of existing Members of remaining Regulatory Bodies set up under the Acts of Parliament, the 7th CPC has recommended normal replacement pay. This has also been accepted by the Government of India vide Resolution No.1-2/ 2016-IC dated 25th July, 2016. Accordingly, the existing Chairpersons as well as future appointees would be eligible for basic pay not exceeding Rs. 2,25,000/- (Level 17 of Pay Matrix) in revised pay structure and the existing Members as well as future appointees would be eligible for basic pay not exceeding Level 15 of Pay Matrix in the revised pay structure.

6. Existing instructions provide that Chairperson and Member(s) who on the date of his / her appointment to the Regulatory Authority/ Statutory Body/ Tribunal was in the service of the Central/ State Government shall be deemed to have retired from such service with effect from the date of his / her respective appointment as such Chairperson/ Member. In case such officers are in receipt of pension, the same shall be deducted in accordance with the prevailing orders applicable to the reemployed pensioners.

 7. The rates of all allowances shall be as admissible to Government employees of corresponding Level from time to time.

8. These orders shall take effect from 01.01.2016.

Revision of pay and pension of bank employees

Will the Minister of FINANCE be pleased to state:

(a) whether the Central Pay Commission benefits are not applicable for employees of banks;

(b) if so, how their salaries are revised;

(c) whether the salaries of employees of banks are revised on the recommendations of some other body;

(d) if so, the name of such body;

(e) whether the Minister is aware that after the recommendations of the said body only the salaries of servicing  employees are revised and pensioners are ignored by these bodies; and

(f) if so, the detailed reasons for ignoring pensioners of nationalized banks by such bodies whereas separate recommendations are made by pay commission for Central Government pensioners?

ANSWER

(a) to (f) : The Central Pay Commission recommendations are not applicable to the employees of Public Sector Banks (PSBs). The pay scales of employees in PSBs are revised every five years on the basis of the Bipartite Settlement signed with Workmen Unions and Joint Note signed with Officers’ Associations by Indian Banks’ Association (IBA). Accordingly, IBA negotiates salary and service conditions of employees. As part of negotiations, the terms of payment of pension are also discussed alongwith the salary revision. The service conditions of Central Government employees differ significantly from those of bank employees and the two are regulated by their respective service regulations. Hence, no comparison can be drawn between the two.
