NOTIFICATION

This office is in receipt of representations from various serving and retired employees of Navodaya Vidyalaya Samiti for coverage under Old Pension Scheme i.e. Pensionary Benefit under CCS (Pension) Rules -1972.

Dealing with each individual representation on this subject is not feasible. Therefore, for information of all the concerned it is intimated that the issue regarding grant of benefits of CCS (Pension) Rules – 1972 to the Samiti’s employee has been considered and examined on a number of occasions by the Government but this benefit is not extended so far due to various reasons.

 

In place of CCS (Pension) Rules – 1972, a proposal for grant of Annuity Based Pension to the serving employees of Navodaya Vidyalaya Samiti who joined Samiti before 01.01.2004 is under consideration. Further, New Pension Scheme has already been made applicable to the employees who joined Samiti on or after 01.04.2009 and option was also provided to the employees who joined upto 31.03.2009 for opting NPS or to continue with existing CPF scheme.

With this the representations and notices of all the serving as well as retired employees stand disposed off.

This issues with the approval of the Competent Authority.

NOTIFICATION

Sub:- Enhancement of ceiling of Payment of Gratuity to the employees of NVS from Rs.10.00 lacs to Rs.20.00 lacs.

It is hereby notified that the ceiling limit of Gratuity has been enhanced from Rs.10.00 lacs to Rs.20.00 lacs with effect from 29.03.2018 in respect of the employees who joined NVS prior to 01.01.2004.

It is also notified that the NVS-Payment of Gratuity Rules, 2007 hither to in operation has been scrapped. Henceforth, the Payment of Gratuity, as amended from time to time under Payment of Gratuity Act, 1972 ( amended in 2018) will be applicable for employees of NVS who joined NVS prior to 01.01.2004.

This has the approval of the Ministry as communicated vide letter No. F.No. 17-30/2018-UT-3 dated 11.02.2020.

MEASURES TO PREVENT CHILDREN FROM DANGERS OF WATER AND DROWNING

Navodaya Vidyalaya Samiti (NVS) and Kendriya Vidyalay Sanghatan (KVS) in their guidelines have explained steps to be taken to avoid danger of children from drowning.

WELLS AND PONDS

I. The wells and ponds if exist in the campus are to be provided with protective wall and iron grills covering the well and the movements of the students should be restricted towards it.

RIVER, CANALS, PONDS AND RAILWAY TRACKS

II. Children should not be allowed to go towards the nearby river, canals, ponds and railway tracks and to take bath using water from the overhead tanks by climbing on the terrace.

Fencing should be provided to the steps of overhead tank to avoid children climbing over head tank.

III. Movements of children are to be strictly watched through formation of groups by school authorities.

IV. Children should not be permitted to go outside the School premises during the school hours.

SCHOOL CAMPUS STRICTLY ENFORCED

V. The presence of the students in the School campus at all times should be strictly enforced. Strict discipline and to check the unauthorized absence of the students from the School is to be given paramount importance.

VI. The root cause for such behavior of the child must be ascertained, parents should be informed accordingly and corrective steps should be taken.

VII. For certain ritual and functions which are observed in the school, necessary precautions and arrangements to be made in advance.

Children should not be permitted to go on rallies for immersion of idols in tanks, ponds and wells etc.

VIII. No procession should be allowed to move from school out of the campus in the eve of any religious celebrations.

SWIMMING POOL

IX. No swimming pool will be constructed without prior permission of competent authority.

X. If swimming pool is constructed in school premises, it must be constructed as per the prescribed norms of competent authority and should also be maintained as prescribed.

Sir,
In continuation to this office letter of even number dated 06.12.2018 seeking willingness of the employees with regard to introduction of alternate annuity based pension, it is to clarify the following:-

1. Own share of employee in the existing CPF scheme shall remain intact. It will not be utilized for creating the corpus fund of the alternate pension plan.

2. However, the management share of the existing CPF scheme will be utilized to form the corpus fund for the proposed annuity based pension scheme.

3. Proposed basic pension is 50% of the basic pay at the time of retirement and there is no provision for DA thereon.

4. Provision for commutation of pension upto 1/3rd of the basic pension exists..Employee at the time of retirement can get the commutation value. It would be more or less equal to the management share. Besides 213rd of basic pension per month fixed at the time of retirement is payable.

5. The pension is payable till the pensioner is alive. There is no provision for family pension after death of the employee.
6. However, proposal for provisioning of DA and family pension is also being sent to the Ministry for
consideration.

7. In case of death of the eligible employees during service, Provision for a lump sum insured amount payable to their dependents is proposed to be covered under group term Insurance Scheme.

The afore mentioned information may be widely circulated amongst the eligible employees to enable them to franchise their options/willingness for the proposed annuity based pension.

This issues with the approval of Competent Authority.

Sub: Continuance of "Special Allowance" to Teaching Staff in NVS - reg.

The proposal for continuance of special allowance @ 10% of Basic Pay to the teaching staff of NVS including Librarian has since been approved by the Department of Expenditure as communicated vide Ministry of HRD's letter No.17-01/2017-UT.3 dated 04.06.2018.

This is issued in continuation to Samiti's Notification of even number dated 20.02.2018,

Benefits of Pay Commission to employees of KVS and NVS

Approval of the competent authority for the extension of the revised pay scales as per the Seventh Pay Commission recommendations for the employees of Navodaya Vidyalaya Samiti (NVS) and Kendriya Vidyalaya Sangathan (KVS) has been conveyed on 11th July 2017 and 26th July 2017 respectively.
NVS and KVS have been advised to project their specific requirement of funds for implementation of the 7th Pay Commission recommendations to their employees and reflect them in their proposals for Revised Estimates 2017-18.

Disbursement of arrears etc. will depend upon projection of requirement by these organizations as also allocation of funds for this purpose. As such, no time frame can be fixed for the disbursal of arrears to the employees of NVS and KVS.

(a) whether Government is aware of the fact that the retired teachers and officials of Navodaya Vidyalaya Samiti (NVS) are leading a precarious life after retirement, as the provision for pension was not available to the employees who joined before 2004, prior to introduction of New Pensions Scheme;
(b) whether Government is planning to provide pensions to such retired teachers and officials;
(c) if so, by when such pension would be disbursed and the details thereof; and
(d) if not, the reasons therefor?

ANSWER

(a) to (d) The employees of Navodaya Vidyalaya Samiti had been given the benefit of Contributory Provident Fund (CPF) scheme since its inception. Subsequently, the Government had approved introduction of New Pension Scheme (NPS) for all regular employees of the Navodaya Vidyalaya Samiti (NVS) joining on or after 01.04.2009. However, those employees who joined NVS on regular basis before 01.04.2009 were given the option vide NVS’s notification dated 04.08.2009 either to continue with the existing Contributory Provident Fund (CPF) scheme or to join the New Pension Scheme. This option was to be exercised latest by 03.11.2009. Thus, the Government has already provided post retirement benefits of either CPF Scheme or NPS to the employees of NVS including teaching and non-teaching staff.

(a) whether 15 out of 23 demands of teaching and non-teaching staff of Jawahar Navodaya Vidyalayas (JNVs) which have been accepted by the Government;

(b)    if so, by when the accepted demands would be implemented;

(c)    whether it is a fact that the employees suspended during the strike have not been paid so far their wages for the period under strike;

(d) if so, by when they would be paid their wages for the period under strike; and

(e) Government''s view with regard to extending the benefit of pension-cum-GPF scheme to JNV employees?

ANSWER

(a&b)  The following demands of teaching and non-teaching staff of Jawahar Navodaya Vidyalayas have since been accepted and implemented:

  •     Conducting the departmental promotion test yearly
  •     Timely promotion to all staff
  •     To settle the demand for stepping up the pay of senior with that of junior, a committee was constituted by the Navodaya Vidyalaya Samiti (NVS) to examine such cases of anomalies. The NVS had informed that no cases of anomalies were pending. However, the Association of Employees has also been asked to furnish the list of any unresolved cases to the Commissioner, NVS so that these are settled.
  •     Providing free education to the children of expired staff
  •     Timely compensation and entitlement to dependents on accidental expiry of any staff
  •     Timely grant of benefits for retiring staff
  •     Creation of PGT posts in Modern Indian Languages

(c&d)    The employees are not eligible for wages for the period they went on strike.

(e)    So far, it has not been found possible for the Government of India to accede to the demand for the Pension-cum-GPF scheme for the employees recruited before 01.01.2004
