Subject: Revision of Scholarship Scheme for the Children of Non-Statutory Departmental Canteen employees out of Discretionary Fund of Director of Canteens

The Scheme for grant of scholarship for the children of Non-Statutory Departmental Canteens, out of the funds available in the Discretionary Fund of Director of Canteens was introduced vide this Department’s O.M.No.20/1/88-Dir. (C), dated 3.12.98 and revised O.M.No.20.1.2011-Dir.(C), dated 2.09.2011. In suppression of this office O.M. of even number dated 2.9.2011; the amended scheme has been introduced to encourage higher studies for those children whose past performance had been meritorious. The details of the scholarships from Academic Year 2019-2020 being instituted and the considerations which will apply are given below:

3. Awards will be given on yearly basis and every aspirant will have to meet the prescribed norms in regards to the percentage of marks in the previous year of study for being considered for grant of fresh award during the course of his/her studies. The awards will be given strictly in accordance with the principle of the highest one or next highest one (if there are more than one scholarship) getting the Scholarship.

Conditions

(a) Candidates seeking award of Scholarship should have obtained a minimum of 60% marks in the aggregate in the previous year of examination;

(b) Children belonging to SC /ST categories and Handicapped children would be given a relaxation of 10% marks in the minimum standard. 25% of the awards for school level and Under Graduate level studies (Serials (1) to (5) of para (2) will be earmarked for such candidates. However, being an award Scheme there will be no strict applications of general orders relating to SC/ST/ Physically Handicapped. In the event of the earmarked awards remaining unutilised due to non-satisfaction of the minimum prescribed norms, the award will be transferred to the general category;

(c) One Scholarship will be reserved for girl child for class IX & X. Notwithstanding the prescribed minimum percentage the award will be given to those securing the highest marks. Only aggregate marks will be taken into account. However, every applicant should have obtained the minimum pass marks in all subjects;

(d) Children of only those Canteen Employees who are working in Central Govt. Offices / Establishments and who have been declared as Central Govt. employees will be eligible to apply;
(e) The Canteen employees from the Department of Telecommunications. Posts etc. which are already having separate Scholarship Scheme are to certify that their children are not already in receipt of Scholarship under the Schemes of their Department.

4. The Scholarship will be awarded considering the performance of the candidates in the previous years of examination. In case the studies were discontinued in the previous years(s) i.e. prior to the academic year but an applicant otherwise becomes eligible for consideration, detailed justification for break in the studies during the preceding year(s) will have to be submitted. All applications will have to be submitted in the appended format only. Applications will have to be accompanied by the attested true copies of the Mark Sheets given by the recognised Institution such as School. Central/State Boards of Education/ Universities. Original certificates will be submitted, if called for, for verification.

5. The individual applying for award of scholarship is required to furnish the following documents:

(a) (i) Aadhaar enrolment ID, if he has enrolled, or
(ii)A copy of request made for Aadhaar enrolment;

(b) (i) Bank Passbook with Photo or
(ii) Voter's ID card or
(iii) PAN Card or
(iv) Passport; or
(v) Driving Licence or
(vi) Ration Card; or
(vii) Photo ID Card issued by the Government.

6. The last date for receipt of applications in the Office of Director (Canteens) will be 31st October, during the year 2020 and all subsequent years. . It is expected that awards will be finalised by the month of January of the following year. In no case any application received after the prescribed date will be entertained.

7. Applications will be forwarded to the office of the Director (Canteens) through concerned Head of Organization who in turn will get the same routed through the Head or the Department in the controlling Ministries /Department.

8. The awards of Scholarships will be decided by a duly designated Committee, as may be appointed from time to time. The decision taken by the Committee will be final and no representation in the matter will be entertained after awards are finalised.

9. It is requested that wide publicity of this Scheme may be given amongst all concerned.

OFFICE MEMORANDUM

Subject: Grant of increased rate of Washing Allowance to the Canteen Employees working in Non-Statutory Departmental Canteen/Tiff in Room functioning from Central Government Offices —regarding.


The undersigned is directed to refer to this Department’s Office Memorandum No. 18/1/2000-Dir-(C), dated 29.6.2001 on the subject mentioned above and to say that it has been decided to revise the existing rate of washing allowance from Rs. 30/- p.m. (Rupees thirty only) to Rs. 60/- p.m. (Rupees sixty only) who have been supplied with uniforms. The rate of washing allowance will be increased by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.


2. This order shall be effective from 1 September, 2008 in pursuance of the Department of Personnel and Training O.M. No14/3/2008-JCA, dated 11.9.2008 (Copy enclosed).

3. This issues with the concurrence of Ministry of Finance, Department of Expenditure and Home Finance Division vide their U.O /Dy. No. 3101359, dated 3.7.2014 respectively.

OFFICE MEMORANDUM


    Subject: Duties and responsibilities of various Canteen employees working in Non-Statutory Departmental Canteens functioning from the Central Government Offices.

It has been decided to prescribe duties of various posts in the Non-Statutory Departmental Canteens located in the Central Government Offices. The existing hierarchy of post in Non-Statutory Canteens is at Annexure-I. The list of duties, enclosed(Annexure-II) is only illustrative and would be subject to modifications as per the requirements of the respective canteen.


2. All Ministries/Departments are requested to bring these guidelines to the notice of all concerned Departmental Canteens functioning under them.

Annexure - II

DUTIES AND RESPONSIBILITIES OF CANTEEN EMPLOYEES IN NON-STATUTORY DEPARTMENTAL CANTEENS IN CENTRAL GOVERNMENT OFFICES.

I Canteen Attendant 
(i) To prepare Tea/Coffee/Juice etc. for the users;
(ii) To serve Tea/Coffee/Biscuits etc. in the official meetings;
(iii) To provide regular room service to the Officers/Staff;
(iv) To collect the used cups/plates & utensil’s etc. within the canteen premises, after concluding of official meetings and also from the rooms of Senior Officers.
(v) To clean crockery/cutlery/utensils etc. in three stage i.e. in running normal water; in hot detergent water and in potassium permanganate solution;
(vi) To sweep and wash the floor area;
(vii) Cleaning/dusting table, chair and other furniture in canteens.
(viii) Cleaning slabs and area where food is cooked.
(ix) Any other additional duty allotted by the in-charge of the Canteen.

The in-charge of the canteen is authorized to allocate the duties to the Canteen Attendants according to their capabilities and capacity for smooth functioning of the canteen.

As and when services of Safaiwala are outsourced the duties of point (vi), (vii) and (viii) would be performed by him/her.

II Assistant Halwai-cum-Cook
(i) To assist the Halwai-cum-Cook in preparation of various snacks and beverages such as bonda, butter-toast, dosa, idly, vada, paneer pakora, smosa, matthi, vegetable cutlet, vegetable sandwich/pakora etc.
(ii) To assist Halwai-cum-Cook in preparation of lunch/meals i.e. chapati, curd, dal, puri, raita, rice, sabzi, sambar, soup, sweat-dish, vegetable salad etc.
(iii) In absence of Halwai-cum-Cook preparation of snacks and meals.
(iv) Any other additional duty allotted by the in-charge of the Canteen.

III. Halwai-cum-Cook
(i) To prepare snacks like bonda, butter-toast, dosa, idly, vada, paneer pakora, smosa, matthi, vegetable outlet, vegetable sandwich/pakora etc.;
(ii) To prepare lunch/meals i.e. chapati, curd, dal, puri, raita, rice, sabzi, sambar, soup, vegetable salad and sweet dishes i.e. burfi, besan burfi, coconut burfi, ladoo, pinnee, gulab-jamun, gajar-halwa, patisa and rasgulla etc.
(iii) Any other additional duty allotted by the in-charge of the Canteen.

IV. Clerk
 (i) To issue coupons in respect of items prepared for daily sale on counter;
(ii) To maintain daily sale register;
(iv) Tally daily cash sales against the coupons issued off and submit daily account in respect of sales.
(v) Responsibility of Store Keeping and accounting Tiffin Room A - Type.
(vi) Any other additional duty allotted by the in-charge of the Canteen.

V. Assistant Manager-cum-Storekeeper
(i) Procure and receive all raw materials;
(ii) Issue raw materials to the Assistant Halwai-cum-Cook/ Halwai-cum-Cook or kitchen staff as and when required for preparation of eatables;
(iii) in-charge of store items and raw materials;
(iv) Maintain account of the stock items in a proper manner;
(v) Responsible for keeping accurate holding of stocks as per ground balance of accounting records;
(vi) Responsible for loss/damage of store.
(vii) Any other additional duty allotted by the in-charge of the Canteen.


VI Manager Grade-II/Manager-cum-Accountant

Manager Grade II post is authorised for Type A, B & C canteen and Manager-cum-Accountant post is authorised in all canteen except in Type A, B & C canteen.
(i) Responsible for ensuring smooth and proper functioning of the canteen;
(ii) Ensure that all operations in the canteen are carried out uninterruptedly;
(iii) Supervision of work of subordinates;
(iv) Ensure that entries in all records/accounts including Cash Book, Ledger, Stock Register, Dead Stock Register are made timely and accurately. Annual Account and Balance Sheet.
(v) Catering to foreign delegation, VIP and WlPs
(vi) Any other additional duty allotted by the in-charge of the Canteen.


VII Deputy General Manager


Deputy General Manager post is authorised in Type 3-A to 10-A canteens.
(i) Ensure that all accounts of canteens viz. Preparation Register, Coupon Sales Register are maintained;
(ii) Checking all the entries in register;
(iii) Submission of all register records to General Manager;
(iv) Perform duty of Canteen-in-Charge in absence of General Manager
(v) Any other additional duty allotted by the in-charge of the Canteen.


VIII General Manager

The post of General Manager is authorised for Canteens of ‘2-A’ Type and above.
(i) Managing and supervising all functions of canteens so as to ensure clay to day smooth running of Canteens;
(ii) Administration of canteen staff;
(iii) Maintenance of all accounts;
(iv) To complete and submit all accounts progressively prepared as on the last day of every month, within seven working days of the following month, after internal audit, to the Honorary Secretary for putting up to the Managing Committee;
(v) The following books and records are required to be maintained and checked by General Manager;
(i) Cash Book
(ii) Ledger
(iii) Raw Material Stock Register
(iv) Dead Stock Register
 (v) Preparation Register(daily eatables items)
(vi) Coupon sales register etc;
(vii) Attendance Register
(viii) Bill/Cash Memo Register
(ix) Rate list of eatable items
(xi) To initiate ACR/Probation Report etc; in respect of all employees working in the canteens.

(vii) In cases of minor indiscipline, to issue non-recordable warning in respect of all employees working in the Canteens.

(viii) Any other additional duty allotted by the Competent Authority.

(While issuing warnings etc. as above, the procedure laid down/instructions contained in the Department of Personnel 8. Administrative Reforms O.M. No. 21011/1/18-Estt.(A) dated 5.6.1981 should be kept in view).

Framing of Rules for URC Employees

The Unit Run Canteen employees are getting paid as per the rules regulating the terms and conditions of the services of the civilian employees of the URCs, issued by Army Headquarters in April 2003. These rules were made as per the directions of Hon'ble Supreme Court.

It has been held by the Hon'ble Supreme Court in its order dated 28-4-2009, in the case of R.R. Pillai Vs the commanding officer HQ SAC(U), that employees of the URC are not government servant.

Unit Run Canteens (URCs) employees are not Government employees, hence recommendations of Sixth Central Pay Commission are not applicable to them.

This information was given by Defence Minister Shri AK Antony in a written reply to Shri Shadi Lal Batra in Rajya Sabha today.

No employees of Canteen Stores Department (CSD) are on strike, however, a section of the employees of Unit Run Canteens (URCs) are on strike. Data in respect of profit generated by the URCs is not maintained by CSD, however, the total sales turnover and profit generated by CSD during the last five years is as under:-

OFFICE MEMORANDUM

Subject: Implementation of the Order dated 30.4.12 passed by the Hon’ble Delhi High Court in W.P. (Civil) No.5695/2000 – Pensionary benefits to the employees of Non-Statutory Departmental Canteens – Regarding.

The undersigned is directed to refer to this Department’s Office Memoranda Nos.12/3/92-Dir (C), dated 16.11.92 and 16.12.93 (copies enclosed) which provided for Pensionary and GPF benefits admissible to the Non-Statutory Departmental Canteen employees. These provisions had been against by a section of canteen employees. The Hon’ble CAT, Principal Bench, New Delhi in two such petitions bearing Nos.572/96 and 2136/98 have ordered on 3.12.99 and 13.1.2000 respectively as under :-

i) "……….The respondents are, therefore directed to grant the benefits of the entire past service prior to the Applicants having been declared as Government Servants for counting towards pensionary benefits"

ii) "………Respondents are directed to take a decision in terms of the decision given by the Tribunal in O.A. No.572/96 i.e.to take into account the entire past service of the applicants for purpose of  counting towards pensionary benefits".

2. However, Government decided to file an appeal against the said orders of the CAT before Hon’ble High Court. Accordingly, an appeal was filed vide W.P. No.5695/2000 against of the CAT. Pending disposal of W.P.No.5695/2000 in the Delhi High Court, it was decided to implement the CAT’s Order dated 3.12.99 vide OM No.12/9/2000-Dir (C), dated 8.11.2000. Now, W.P. (C) No.5695/2000 has been dismissed by the Hon’ble High Court vide their order dated 30.04.2012 for devoid of merits.

3. The matter has been accordingly considered by the Government and it has been decided that the entire past service rendered on regular basis by the non-statutory canteen employees will be reckoned as "Qualifying Service" for the purpose of calculation of pension in accordance with the relevant provisions contained in CCS (Pension) Rules, 1972 and related orders. This admissibility will be subject to the refund of the entire amount received as employers’ contribution to the EPF, if any, including interest received by them alongwith interest at the rate applicable to GPF accumulation from time to time as prescribed in Department of Pension and Pensioners Welfare’s OM No.38/34/2001-p&PW (F), dated 29/4/2002 (copy enclosed). The interest will be calculated for the period from the date of receipt of employers’ share of EPF contribution by the employee to the date of refund to the Government.

4. In view of the above, the provisions contained in this Department’s Office Memoranda bearing No.12/3/92-Dir (C), dated 16/11/92, 16/12/93 and 8/11/2000 shall stand modified to the extent of the provisions specified herein above.

5. The Ministries/Departments are requested to issue instructions to their attached/subordinate offices to take immediate necessary action to settle the cases of the employees afresh who retired/died in harness on or after 1/10/91.

6. This issues with the approval of Ministry of Finance, Department of Expenditure U.O. Note No.1(17)/E.V/2000, dated 7/11/2012 and Ministry of Home Affairs, Home (Finance) Dy. No.CF 147351/AFA (F-1), dated 8/11/2012.
