The Cabinet has approved the Cadre structure of Posts & Telegraphs Building Works Service (P& T BWS), Group ‘A’ as communicated vide Cabinet Secretariat Approval No. 34/CM/2019(i} dated 8th November 2019 (Case No. 296/34/2019).

2. The Cadre strength of Posts & Telegraphs Building Works Service, Group ‘A’ and distribution of posts at various levels has been fixed as follows:

 Respected Sir,

Sub: Safeguarding the career prospect of Group A, Gr. B and Gr. C officers in all Central Govt. Departments by granting timely promotions – request regarding.

Kindly refer to the burgeoning impasse created in all Central Govt. Departments in respect of promotions in Gr. A, Gr. B and Gr. C cadres following the DoPT OM dated 30.09.2016 on reservation.

The process of holding DPC meetings for promotion from Gr. B to Gr. A cadres in all Departments was aborted by the UPSC immediately after the OM.No 36012/11/2016-Estt(Res) Government of India, Ministry of Personnel, Public Grievances and Pension Department of Personnel and Training dated 30.09.2016, in connection with the pending SLP/Contempt Petition in the case of Jarnail Sngh vs Lachhmi Narain Gupta in the Hon’ble Supreme Court of India, was issued. The UPSC categorically refused to hold any DPC to any grade having reservation element, unless the said OM is further clarified by DoPT to its satisfaction. It is learnt that the UPSC had sought clarification from DoPT immediately after the issuance of the said OM, and that no clarification has so far been issued by the DoPT.

As the UPSC is considered as the nodal agency for accepting various Instructions/OMs/Circulars issued by the Govt. of India time to time in relation to promotion and holds DPCs accordingly, the refusal of UPSC to hold DPC of any grade having reservation element unless the said OM is further clarified by DoPT has barred all cadre-controlling authorities in all Departments to hold DPCs for promotion in various Gr. B and Gr. C cadres As a result, all regular promotions into Group A, Group B and Group C cadres all over the country have been stalled

As a matter of fact, as the cut-off date for counting of mandatory residency period in all cadres is fixed on 1st of April by the DoPT, the seniority and due career prospect of many officers/officials across various Departments would suffer irreparably if the normal promotion is not accorded to them on or before 31.03.2017. And if it happens, these unfortunate officers will lose at least one year for all consecutive promotions in their career for no fault of themselves.

As per our understanding of the subject, until the DoPT issues clarification of the OM dated 30.09.2016 and help the UPSC to decide the future course of action in respect of promotions in Gr. B to Gr. A cadres in various Departments, neither the vacancy position at various levels in Departments would improve nor the career prospects of officers/officials would be protected.

In view of the above, we are constrained to seek the intervention of the Hon. Minister in directing the DOPT to clarify the issues raised by the UPSC so that the promotions of Officers/Officials who serve the Government of India do not suffer unjustifiably. We do trust that the Honourable Minister will render justice to those who serve the Government of India

8.	Central Reserve Police Force	The-cadre structure is under submission in view of discussion held in meeting with MHA on 08/07/2015 and 17/07/2015
9.	Central Engineering Service (Roads)	The Proposal was received on 24/04/2014.Clarifications were sought from MoRTH, and based on reply received on 16/10/2014 a revised structure was proposed and sent to MoRTH for their comments. The proposal has been referred by the DoE with their comments on 26/06/2015. A meeting is scheduled to be held on 14/08/2015.
10.	Indian Railways Personnel Service	Comments of DoE on Work Charge posts have been received and the same is under submission.
11.	Indian Railways Accounts Service	Comments of DoE on Work Charge posts have been received and the same is under examination.

With reference to this Department letter dated 12th May, 2015, it is hereby informed that the meeting with the Cadre Controlling Authorities to be held under the Chairmanship of the Cabinet Secretary on 21.05.2015 is postponed till further notice.

Dear Colleagues,

Sub: Promotion from Group ‘B' to Group ‘A’, after CR.

In my previous message dated 19.5.2014, at step No. VII, I had referred to the work relating to promotions of 2,118 officers from Group ‘B’ to Group ‘A’. The Board has since reviewed the work of Committee No. II, Sub-Committee No.1, which is looking after this task, along with the officers from the Ad.II Sections of the CBEC and DG, HRD.

2. After obtaining the tentative consideration zone and the All India seniority list of Superintendents/ Superintendents(P)/ Appraisers from the DG, HRD in December, the Sub-Committee No.1 has obtained around 5000 folders from the various CCAs. Individual folders for each of the eligible officers has been prepared containing the ACRs/APARs for the preceding 5 years. Work is in progress for ensuring that CR/APAR folder is up-to-date which would include availability of vigilance status, integrity certificates, penalty statements (where necessary) availability of part period ACR/APAR, if any, in a particular financial year, completion of action in respect of ‘Below Bench Mark’ cases, No Report/No Review certificates, additional ACRs/APARs in he last mentioned types of cases, etc. Check List has been maintained in respect of each folder. Review of the work revealed that there are 256 dossiers from eight CCAs which are yet to be sent:-

Though Member (P&N) has been contacting the above mentioned CCAs, it would be appreciated if the Group ‘B’ Gazetted Officers Associations if these zones take up the matter of ensuring that the missing dossiers are forwarded to the Committee without delay. The Sub-Committee has moved forward with the action for completion of the dossiers and same is expected to be completed shortly. However, it is reiterate that unless the pending dossiers are also received and the same rigorous scrutiny done, we would not be in a position to  move the UPSC for obtaining a date for DPC. All CCAs are, therefore, requested ti bestow personal attention in the matter and‘ the Associations re also requested to coordinate with the administration
in this regard

4. At the level of Ad.II Section in CBEC, necessary action is being taken for de ling with all representations received from individuals as also from Associations. The Ad.II Section will also be providing to the DG, HRD the number of carry forward / backlog vacancies which require to be filled so that the same can be included in the DPC proposal. he Ad.II will send the vetted list of the zone of consideration to the Sub-Committee to enable them to properly identify the dossiers required for the DPC. Once the dossiers are completed and forwarded by the Sub-Committee, the same will have to be completely vetted again before being certified by the appropriate authority in Ad.II and submission to the UPSC through the single window.

5. . I would again emphasise that existence of complete and correct dossiers is necessary before the proposal for DPC can be sent to UPSC. Therefore, I could request all CCAs and Associations to ensure that the action, a required at the zonal level, is expedited. It is evident that delay b even one zone would put in jeopardy the legitimate aspirations rid expectations of the officers of remaining zones. Therefore, I look forward to a coordinated and quick response from you.

“The Sixth Central Pay Commission in para 2.2.18 of its Report recommended, inter-alia, that pre-revised pay scales ranging from Group `A` entry level to S-27 scale of Rs. 16400-20900 may be placed in the common Pay Band-3. The Commission further recommended Grade Pay of Rs.6100/- for an Under Secretary level officer, Grade Pay of Rs.6600/- for a Deputy Secretary level officer and Grade Pay of Rs.7600/- for a Director level Officer. As part of the modifications made by the Government, while the Grade Pay of Under Secretary and Deputy Secretary level Officers were enhanced to Rs.6600/- and Rs.7600/- respectively, pre-revised Pay Scales from S-24 (applicable to Director level Officers) to S-27 have been placed in Pay Band-4. Both in pre-revised and revised pay structure, the pay scale applicable io a Director level Officer has been higher than that in case of a Deputy Secretary or Under Secretary level Officer and since pension is a function of pay drawn by an Officer at the time of superannuation, pension in case of a DS/US level officer is independent of that in case of a Director level officer. Thus, the question of taking any steps in this regard does not arise.”

DRAFT TRANSFER POLICY

1. SALIENT FEATURES

i. The transfer policy has been formulated for officers of different levels.

ii. Group 'A' officers shall have all India transfer liability. (Authority: General Policy of Government of India)

iii. In the case of Railway Doctors, frequent transfers are not considered to be in the overall interest of the patients. However, they can be transferred on a case to case basis in order to ensure that they do not develop vested interests. (Authority: E(0)III / 2007/ PL/ 01 dated 19.04.2007)

iv. Group 'B' officers have localized seniority and hence they are not normally transferred from one Railway/Unit to another. However, they can be transferred on their own request on acceptance of bottom seniority.

v. Group A officers allotted to NF Railway are required to serve there for a minimum period of 8 years before they can be considered for transfer to other Railway/Unit of their choice. (Authority: E(0)III/2009/PL/01 dated 28.4.2009)

 3. DEPUTATION AFTER POSTING IN RAILWAY BOARD

i. The posting in Board is not a deputation but is a tenure posting, the officers after completion of tenure in Board may be permitted to go for deputation in Railway/non-Railway PSUs or on Central deputation. (Authority: ERB-I/2013/2/70 dated 3.3.2014) This will be subject to provision in Para 2.

ii Deputation of Railway Officers will be governed by DoP&T's guidelines as adopted by Ministry of Railways vide letter No.2010/F(E)II/ 1(1)/ 1 dated 28.07.2010.

iii A 'cooling off' period of three years will be necessary for posting of the officer between two postings in Railway Board. The officers after completion of tenure in Railway/non-Railway PSUs or under Central Staffing Scheme will be eligible for posting in Railway Board.

iv There can be a maximum of two postings of an officer in Railway Board from JAG to HAG of a total tenure not exceeding eight years. For example, if an officer has already worked for six years in JAG/SAG (five years regular + one year extended tenure) and is posted back to Board in the second tenure, he/she have only two years tenure in the second posting and no extension of tenure shall be considered. (Authority: Board's decision dated 30/31 Dec 2013)

v Extension of tenure for 6th year (beyond normal tenure of five years in one post) shall need prior approval of Minister of Railways (MR). (Authority: Board's decision dated 30/31 Dec 2013.)

4. DEPUTATION OF OFFICERS UNDER CENTRAL STAFFING SCHEME AND UNDER NON-CENTRAL STAFFING SCHEMES OUTSIDE THE RAILWAYS

4.1 An officer may be allowed to go on deputation outside the Railways including Railway PSUs for not more than two terms in his entire career. However, each term of deputation shall not exceed 6 years and the total tenure of both the deputation shall not under any circumstances exceed 10 years. (The deputation in Railway PSU would be included for counting 10 years (new policy)"

5. TRANSFER ON ADMINISTRATIVE GROUNDS

5.1 Notwithstanding anything contained in this policy, Government may, if necessary in administrative interest, transfer or post any officer to any station or post.

6. Procedure regarding posting/transfer/deputation will be governed by Railway Board's circular No. ERB-I /2013/ 2/ 70 dated 03.03.2014 86 Officer Order No. 16 of 2014 (No. 2014/0&M/2/6 dated 03.03.2014)

6.1 Any deviation from the policy prescribed above would require the approval of the Minister of Railways.

7. POSTING OF HUSBAND & WIFE AT THE SAME STATION

7.1 Posting of husband 86 wife at same station shall be governed by DOPT's OM No.28034/9/2009-Estt(A) dated 30.09.2009.

8. ROTATIONAL TRANSFER OF DOCTORS IN RAILWAY HOSPITALS

1. General Principles

1.1 All IA&AS officers at all levels are liable to be transferred and posted anywhere within India and outside at short notice as per administrative requirements.

1.2. To ensure stability and continuity, every officer, generally, will have a minimum tenure of 2 years.

1.3. Officers may give their preferences for postings. While preference of individual officers will be given due consideration, transfers will be made as per administrative requirement.

1.4 Existing guidelines of DOP&T with respect to posting of husband and wife at the same station will be followed.

2. On promotion to SAG (Senior Administrative Grade)

2.1 On promotion to the level of PD/AG, every TAMS officer will be transferred out of the station irrespective of the number of years completed at that station.

3 Posting to the North Eastern Region, J&K etc.

3.1 The posting to any station in J&K, Andaman & Nicobar Islands and the North East Region including Sikkim, Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura will be for a minimum period of two years.


3.2 On completion of two years in these difficult stations, an officer will be accommodated to a station of his choice, subject to availability of post.

4 Overseas Postings/Assignments

4.1 On return from overseas posting, posting should normally be done to a station other than home station or the last place of posting and also not to Hqrs. office.

5. Deputation Policy

5.1 No direct recruit IA&AS officer should be sent on Central deputation unless he has completed 9 (nine) years of service since appointment.

5.2 Promoted officers and LCE (Limited Competitive Examination) officers will be considered for Central & State deputation only after completion of three years of service.

6. These guidelines will not apply to cases of transfers on administrative grounds and exigencies of work.

Sub:- Re-designation of the post of Deputy Secretary held by an officer appointed under the Central Staffing Scheme as Director as a measure personal to him — reg.

As per instructions contained in O.M. No. 31/5/2002-EO(MM-l) dated 28th February, 2002, an All India/Group ‘A’ Service Officer holding the post of Deputy Secretary could be appointed as Director by re-designating the post of Deputy Secretary held by him/her if he/she has completed 14 years of service and has got Non-Functional Selection Grade in his/her parent cadre. If such an officer has completed 14 .years of service but has not got Non-Functional Selection Grade, he/she could be appointed as Director only if a sanctioned vacant post of Director was available, and the basic pay of the officer was Rs. 13,125/- (pre-revised).

2. It may be noted that under the Central Staffing Scheme, the posts of Deputy Secretary and Director are interchangeable. Therefore, the requirement for a vacant post of Director being available in the Ministry before such re-designation is no longer applicable

3. In view of the above, it is being clarified that officers of All India Services/Group ‘A’ Services appointed under the Central Staffing Scheme and holding the post of Deputy Secretary, who have not yet got NFSG in their cadres, could be appointed as Director by re-designating the post of Deputy Secretary held by him/her if he/she has completed 14 years of service without insisting on the condition that there should be a clear vacancy of Director available. This re-designation would be subject to the condition that

(i) The promotion of the officer to NFSG has not been specifically denied.
(ii) The officer should have earned at least 3 increments in a post in Pay Band-3 carrying Grade Pay of Rs. 7600/-.

4. Where an officer holding the post of Deputy Secretary under the Central Staffing Scheme has completed 14 years of service and has been granted NIFSG in his cadre, his post may be re-designated as Director. .

5. All proposals for such re-designation may be forwarded to this Department with the approval of the Minister in-charge.

 The Executive Engineers who have already been granted 3rd Financial up-gradation in the grade pay of Rs 7600/- under MACP scheme would not be entitled for NFU to the same grade in future - Clarification by CPWD.

Subject:- Modified Assured Career Progression Scheme for the Central Government Civilian Employees-Clarification regarding grant of benefits of MACPS to Officers who have later on inducted into Organized Group A Service.


The undersigned is directed to refer to DOPT's O.M No. 35034/10/2011-Estt. dated 13/06/2013 regarding grant of 3rd financial upgradation under MACP scheme in respect of Executive Engineers who have already been inducted into Organized Group 'A' Services. In this connection, DOPT vide above OM clarified that it has been decided to allow grant of financial up-gradation under MACPs with effect from the due date to those officers who are inducted to the organized Group `A' Services when they are nearing retirement subject to the condition that only at the time of retirement an evaluation of up-gradation/promotion earned by the officer would be made. In case such officers have already attained three financial up-gradations under MACP scheme, they shall not be entitled for NFU to the same grade from a later date (Copy enclosed).

In view of above, the Executive Engineers who have already been granted 3rd Financial up-gradation in the grade pay of Rs 7600/- under MACP scheme would not be entitled for NFU to the same grade in future.
