Sub: Grant of Advance – Special festival package to Govt. Servants.

The undersigned is directed to refer to this department’s OM of even number dated 12.10.2020 on the above mentioned subject and to say that the following SOP (Standard Operating Procedure) for disbursal of pre-paid UTSAV Card will be followed by all DDOs / HOOs concerned:-

  • On receipt of application for grant of Special Festival Package advances, each DDO will advise the number of UTSAV Cards required by them and SBI Branch details where the DDO account is maintained along with IFSC code. In case DDOs do not have an account in SBI they have to identify the nearest SBI Branch and advise the name of the Branch and the IFSC code for the purpose of receiving the Cards.
  • Each card will be of fixed denomination of Rs. 10,000/-.
  • A SPOC detail at each DDO level to be provided for better coordination. (e-mail ID and contact details of DDO and SPOC to be provided).
  • All the above details (standard indent format for UTSAV Card is attached) to be mailed to agm2debitcards.dtb/aisbi.co.in with a copy to dgmdebitcards.dtba@sbi.co.in. This information needs to be sent as early as possible.
  • Based on the above indicative list. Card Procurement orders will be placed by SBI and UTSAV Cards delivery schedules (to SBI Branches) will be advised based on the indicative requirements provided.
  • The envelope containing the individual Card & PIN will be made available at the identified Branches (where DDO’s accounts are maintained) as per schedule provided.
  • The identified Branches will intimate the respective DDO about the receipt of the card. DDO will then provide the Branch Debit Authorisation / Cheque for the number of cards required along with the Standard Procurement Format, which will be shared with DDOs.
  • The duly filled in Standard Procurement Form (both in hard copy and soft copy) needs to be provided to the Branch along with the debit authorization / Cheques from the DDOs. In case where the DDO does not maintain an account with SBI branch he has to provide a Bankers Cheque / Govt. Cheque drawn in favour of the SBI Branch identified by them earlier.
  • Branch will issue / activate the above cards (as per the indent provide by the DDO) in Bank’s system against acknowledgment from the DDOs after realization of payment.
  • The DDO will take necessary precautions in safe handling of cards and distribution to identified persons.
  • A nominal change of Rs.36 plus GST will be charged for each card and will be bore by the Ministry / Department.

2. These orders will take effect from the date of issuance of this Office Memorandum and will be in force during the current financial year i.e. 2020-21 only.

3. All the Ministries / Departments are requested to bring the contents of this OM to the notice of all its Attached and subordinate office for their information / necessary action.

Office Memorandum

Sub: Grant of Advance - Special Festival Package to Government Servants.

The undersigned is directed to say that with a view to enable Government servants to meet expenses relating to festivals and to encourage spending thereby giving a boost to economic activities, in pursuance of decision taken by the Government, it has been decided that a special festival package of advance will be accorded to all Government servants for any important festivals upto 31st March, 2021.

2. A Head of Office may sanction this special package on the eve of any important festival to any Central Government Servant under his administrative control. The term “important festival” is clarified as such festivals or one of such festivals as Head of Department may declare in respect of establishments under his/her administrative control.

3. The amount of the package is Rs. 10,000/- to be paid as advance to Government servant. This amount is interest free. The amount would be released through pre-loaded Rupay Card from SBI. DDOs, on receipt of application from Government servants for this package may process and acquire the prepaid cards from SBI for issue among the applicants. A detailed SOP for DDOs for obtaining these cards would be separately issued.

4. The festival package may be granted to a Government servant if he/she is on Government duty or on leave excluding leave preparatory to retirement, on the date on which the advance is disbursed. The amount paid under this package is recoverable in not more than ten (10) instalments.

5. These orders will take effect from the date of issuance of this Office Memorandum and will be in force during the current financial year till 31 March, 2021.

6. All the Ministries/ Departments are requested to bring the contents of this OM to the notice of all its Attached and Subordinate offices for their information /necessary action.

The undersigned is directed to refer to this Department’s O.M. of even no. dated 24.04.2018 on the subject noted above and to say that as per para 5 of the aforesaid O.M., civilian Central Government servants posted in North-Eastern Region, Union Territory of Ladakh, Andaman & Nicobar Islands and Lakshadweep groups of Islands, who leave their family behind at the old headquarters or another selected place of residence shall be allowed “Emergency Passage Concession” on two additional occasions during their entire service career to enable the Government employees and/or their families [restricted only to spouse and dependent children] to travel either to the Home Town or the station of posting an emergency.

In this regard, this Department is in receipt of references seeking clarification as to whether the facility of “Emergency Passage Concession” is available to the Government servant for travel from the station of posting to Home Town only whether the Government servants can avail the facility to travel to the selected place of residence of family declared by them for the duration of their posting /transfer to these regions


The matter has been considered in this Department in consultation with Department of Expenditure. It is clarified that “Emergency Passage Concession” can be availed by Government employees posted in North-East Region, Andaman & Nicobar Islands, Lakshadweep Islands and Union Territory of Ladakh to visit any one of the destinations, i.e. Home Town or any selected place of residence of the family declared by them for the duration of their posting/transfer to these regions.

OFFICE MEMORANDUM

Subject: Sanction for holding an elective office under Rule 15(1)(c) of CCS(Conduct) Rules, 1964 - reg.

The undersigned is directed to refer to this Department O.M. No. 11013/1/2016-Estt.A-III dated 5.08.2019 (copy enclosed) to say that the competent authority has now approved the modification in Para 3 and Para 4 of the existing O.M. dated 5.08.2019. Para 3 and Para 4 of existing OM dated 5.08.2019 are modified as under:
"3. The policy on fixing an upper limit of the number of years for which Government servants can hold elective office in any body in their entire career has been reviewed and it has been decided that a Government servant may be allowed to hold elective office in any body, whether incorporated or not, for period of two terms or for a period of 5 years, whichever is earlier, for which prior sanction would be required when a Government servant contests an election in such body, as per existing rules.
4. It is, therefore, necessary for the Competent Authority to keep in mind all the relevant factors while granting permission under Rule 15(1)(c) of CCS (Conduct) Rules, 1964. In cases where the Government senvants have assumed charge of elected posts prior to the issuing of O.M. dated 5.08.2019, they may be allowed to complete the full period of their current tenure, except in cases where there are charges of corruption and adverse audit paras etc."
2. All Ministries/ Departments/ Offices are requested to bring the above instructions to the notice of all administrative authorities under their control.

3.In their application to the employees of Indian Audit and Accounts Department, these order are issued after consultation with Comptroller and Auditor General of India, as mandated under Article 148(5) of the Constitution

Subject: Sanction for holding an elective office under Rule 15(1)(c) CCS(Conduct) Rules, 1964 - reg.

The undersigned is directed to say that as per Rule 15 (1) (c) of the CCS (Conduct) Rules, 1964, no Government servant shall except with the previous sanction of the Government, hold an elective office, or canvass for a candidate or candidates for an elective office, in any body, whether incorporated or not. DoPT's O.M. No. 110 13/9/93-Estt.(A) dated 22.04. 1994 had also stipulated that no Government servant should be allowed to hold elective office in any sports association/federation for a term of more than 4 years, or for one term whichever is less. Further, according to Department of Personnel & Training's OM No. 110 13/11/2007-Estt (A) dated the 13th November, 2007, the entire time of the Government servant should be available to the Government and that no activities unconnected with his or her official duties should be allowed to interfere with the efficient discharge of such duties. All Ministries were requested to ensure that the participation of the Government servants in the activities of the cooperative societies conform to the above provisions and does not interfere with the discharge of their official duties.

2. Instances have come to notice where Government servants continue to hold elective offices in various capacities for unduly long periods. In some cases, where bye-laws of these bodies place restrictions on the number of consecutive terms a person may hold an office, Government servants are reported to have either got themselves re-elected after a gap or have got a family member/ close relative elected as a surrogate in order to keep control of such bodies. In such cases, Government servants may not be bestowing adequate attention upon their official duties and, as a result, an apprehension may arise that such Government servants also develop vested interests, particularly if the body is involved in commercial activities, directly or indirectly.

3. 4. It is, therefore, necessary for the Competent Authority to keep in mind all the relevant factors while granting permission under Rule 15(1)(c) of CCS(Conduct) Rules, 1964. It may also be necessary that cases of such sanctions are reviewed from time to time and permissions earlier granted revoked where Government servants have been holding office in any body, whether incorporated or not, for more than four years or in cases there are charges of corruption, adverse audit paras etc. In such cases, the Government servant concerned may be directed to resign from his office in such body immediately. He will cease to discharge any function from the date such direction is conveyed to him, irrespective of the fact whether his resignation from the body is accepted or not. This action may be taken immediately in those cases where information is already available with the Ministries and Departments. In addition, all the Ministries and Departments are also requested to obtain information from their employees in the proforma attached to this Office Memorandum for reviewing the position as well as while considering the request for sanction under Rule 15(1)(c) of CCS(Conduct) Rules, 1964 in future.

5. This O.M. issues in supersession of DoPT's 110 13/9/93-Estt.(A) dated 22.04.1994.

6. In so far as the employees of Indian Audit and Accounts Departments are concerned, this O.M. issues after consultation with Comptroller & Auditor General of India.

7. All Ministries/ Departments/ Offices are requested to bring the above instructions to the notice of all administrative authorities under their control.

NPS - Grant of Additional Benefits on death / disability of Central Government Servants covered under National Pension System
Attention is invited to Board’s letter No. 2008/AC-II/21/19 dated 29.05.2009 vide which instructions were issued providing for additional relief on death/disability of Government servants covered by New Defined Contribution Pension System (NPS). Instructions issued vide letter ibid will be applicable to those Government Servants who joined Government Service on or after 01.01.2004 and will take effect from the same date i.e. 01.01.2004. Further, attention is invited to the letter No. 2016/F(E)III/1(1)/3 dated 27.05.2016 vide which Pension Fund Regulatory and Development Authority (Exits and Withdrawals under NPS) Regulation, 2015 notified vide Gazette notification dated 11.05.2015 was adopted and circulated on Railways. It is prescribed in these regulations that if the subscriber or the family members of the deceased subscriber, upon his death, avails the option of additional relief on seek transfer of the entire accumulated pension wealth of subscriber to itself.

2. References were received in this office seeking clarification whether the rule allowing option for drawl of pension/ family pension, instead of NPS corpus, is also applicable retrospectively for the cases where corpus of NPS has already been paid to the deceased employee’s legal heirs before issue of board’s letter No. 2008/AC-II/21/19 dated 29.05.2009. If the date of application of additional benefit is retrospective, whether it is from the date the employee deceased or from the date of issue of Board’s letter dated 29.05.2009. Also, whether the arrears of pension/family pension is to be paid (upon surrender of NPS Corpus) or not, and the amount is likely to be huge which would impact the Railway Finances. Clarification was, also, sought whether the interest on the corpus is to be charged from the date of payment of corpus amount till the date of is surrender and if so, at what rate.

3. The above issue has been examined in consultation with Department of Pension and Pensioners’ Welfare (DOP&PW), the nodal Department of pensioner matters. DOP&PW has clarified that Railway servant/ family member in the case of death of railway servant of his discharge from service on account of invalidation/ disability, is entitled to pension/ family pension under old pension scheme under Railway Services (Pension) Rules, 1993, if the Railway servant/ Family wants to. DOP&PW have, further, clarified that the entire accumulated pension funds under NPS may be recovered from him/family with interest for the period from the date of receipt of entire accumulated pension wealth to the subscriber under NPS to the date of refund to the Government at the rate and manner applicable to GPF deposits from time to time.

4. The aforesaid clarification may be kept in view while dealing with cases covered under National Pension System (NPS).

Rule 39 CCS Leave Rules 1972 - Leave encashment for Central Government Employees

Central Government servant resigns or quits service, the maximum encashment of leave allowed is 150 day

Leave Encashment of Employees

As per Rule 39 of the CCS (Leave) Rules, 1972, a Central Government servant is entitled to cash equivalent of leave salary for both earned leave and half pay leave at his / her credit on the date of retirement, subject to a maximum of 300 days including the period of encashment allowed in the previous employment under the Central Government.

In case a Government servant resigns or quits service, the maximum encashment of leave allowed is 150 days.

The above information was given by the Minister Shri Jitendra Singh in a written reply in the Rajya Sabha on 5.12.2019.

Increment Issue: for those retired on 30th June, due increment is 1st July. Supreme Court of India dismissed Review petition No.1731/2019 judgement dt.8th Aug. 2019 filed by the Government, indicated based on the merit, review petition submitted by Government was dismissed. Now, the national forums responsibility is to insist the government to implement the same to all the central government servants who are similarly placed, instead of everybody approaching the court of law for justice and it is shear waste of money and time.

Sub.: Grant of TTA/ Joining Time to officials / officers on appointment in EPFO - reg.

Madam/Sir,

The Head Office has been receiving representations from the Direct Recruit Assistant Provident Fund Commissioners who were employed in other Central Government Department and had applied through proper channel for appointment in Employees’ Provident Fund Organisation, for granting them TTA/Joining Time on their appointment in this Organisation.

As per provision of SR 114 Travelling allowance is admissible to a Govt. Servant on transfer from one station to another, if he is transferred in public interest and entitled to joining time pay during the period of journey. As per Government of India decision (i) appended below a provision SR 114, it has been further clarified that:

(i) T.A to officials getting appointed under central Government through examination/interview – It has been decided that joining time and joining time pay should be granted as follows to Government servants appointed to posts under the Central Government on the results of a competitive examination which is open to both Government servants and others-:

(a) Joining time should ordinarily be permitted for all Government servants serving under the Central Government and for Provincial Government servants who hold permanent posts in a substantive capacity and that,
(b) no joining time pay should be granted except,-
(i) When the Government servant holds a permanent post under
Government (including a provincial Government) in a substantive capacity, or
(ii) In the case of appointments through the Home Department to the ministerial establishment of the Government of India Secretariat and attached or subordinate offices when a candidate originally nominated to a vacancy likely to become permanent is re-nominated to another such vacancy owing to the cessation of the former.

(c) Traveling allowance under SR 114. should also be granted in cases where Joining time pay is granted under Clause (b) above. This also applies to a Government servant selected after an interview for appointment to a post under central Government.

By implication of Government of India decision (i) under SR 114, a permanent Government Servant who has been permitted Joining Time as well as Joining Time pay, to be allowed Travelling Allowance under SR 114 on the results of the Competitive Examination which is open to both Government Servants and Others and even in case of Government Servant selected after an interview for appointment to the post of Central Government.

However, admissibility of Composite Transfer Grant. is governed by the provisions of SR 116(a). As per the entitlement w.e.f 01.10.1997, it is payable equal to (a) one month’s Basic pay, (b) Actual fare for self and family for journey by rail/steamer/air, (c) Road mileage for journey by road between places and connected by rail, (d) Cost of transportation of personal effects from residence to residence, (e) Cost of transportation of conveyance possessed by the employee.

EPFO being an autonomous body, FR and SR have been adopted by the Central Board and there is a parity in terms of the Rules. The GID no. (i) below SR 114 applies to the cases of permanent Govt. servant who have been appointed through Competitive examinations in other Government Department. However by analogy a Government Servant who is entitled to transfer allowance under SR 114 would be entitled under SR 116 as a natural corollary and hence the same may be considered to be allowed in such cases.

In view of the above. all such representations for grant of TTAI Joining Time may be examined in the light of SR-114. SR-116 and DOPT OM No. 2802011/2010- Estt.(C) dated 08.04.2016. It is reiterated that the benefit of TTA/ Joining Time on appointment is admissible only in cases where the officer was earlier employed as Permanent Central /State Government servant and had applied for the post in the new Department through proper channel.

Subject: Withdrawal of resignation of Central Government Servants Appointed after 31.12.2003 covered under the National Pension System (NPS) - reg.

The undersigned is directed to say that instructions on the procedure to be followed for Resignation from Service have been provided vide Ministry of Home Affairs O.M.No.39/6/57-Ests.(A) dated 06.05.1958, Department of Personnel & Training (DoPT) O.M.No.28034/25/87-Estt (A) dated 11.02.1988, No.28034/4/94-Estt. (A) dated 31.05.1994 and No.28035/2/2007 -Estt.(A) dated 04.02.2007. Para 5 of DoPT O.M. dated 11.02.1988 referred to above, provides the procedure for withdrawal of resignation as governed by Rule 26 (4) to (6) of Central Civil Services (Pension) Rules, 1972. References are being received from Ministries/ Departments on the request for withdrawal of resignation by Government servants appointed after 31.12.2003 and for whom CCS (Pension) Rules are not applicable. The matter of withdrawal of resignation of Government servants of Central Civil Services/Posts, appointed after 31.12.2003 who are covered under the National Pension System (NPS) and for whom CCS (Pension) Rules, 1972 is not applicable has been considered in this Department and with the approval of the competent authority, it has been decided that the following guidelines/instructions may be followed while considering the request for withdrawal of resignation of the aforesaid Government Servants.

2. The appointing authority may permit a person to withdraw his resignation in the public interest on the following conditions, namely:
  • that the resignation was tendered by the Government Servant for some compelling reasons which did not involve any reflection on his integrity. efficiency, or conduct and the request for withdrawal of the resignation has been made as a result of a material change in the circumstances which originally compelled him to tender the resignation.
  • that during the period intervening between the date on which the resignation became effective and the date from which the request for withdrawal was made, the conduct of the person concerned was in no way improper;
  • that the period of absence from duty between the date on which the resignation became effective and the date on which the person is allowed to resume duty as a result of permission to withdraw the resignation is not more than ninety days;
  • that the post, which was vacated by the Government servant on the acceptance of his resignation or any other comparable post, is available.
3. Request for withdrawal of a resignation shall not be accepted by the appointing authority where a Government Servant resigns his service or post with a view to taking up an appointment in or under a private commercial company or in or under a corporation or company wholly or substantially owned or controlled by the Government or in or under a body controlled or financed by the Government.

4. when an order is passed by the appointing authority allowing a person to withdraw his resignation and to resume duty, the order shall be deemed to include the con donation of interruption in service for the purpose.

5. No withdrawal from NPS corpus shall be permissible within a period of 90 days from the date on which the resignation becomes effective. i.e the resignation is accepted by the competent authority and the Government servant is relieved of his duties. However, the aforesaid condition shall not be applicable in case of death of the government servant after the resignation becomes effective.

6. The provision for withdrawal of resignation shall not be applicable for temporary Government Servants.

7. Above guidelines/instructions will be applicable only for the Government Servants appointed on central civil service/posts after 31.12.2003 who are covered under the National Pension System (NPS) and for whom CCS (Pension) Rules,1972 is not applicable. Further, these guidelines/instructions will be applicable till the time the statutory rules regarding withdrawal of resignation for such Government Servants are notified.

8. This O.M. shall be prospective and cases already settled shall not be opened.

9. this issues in consultation with the office of comptroller and Auditor general of India.

10. It is requested to bring it to the notice of all concerned for strict compliance.

Staff Sided stated that in order to encourage sports activities, every department has been permitted to recruit sports personnel and maintain teams at the Government cost. However, presently practice of providing incentive to sports personnel varies from department to department as there are no uniform guidelines. It is necessary that some general guidelines must be issued in this regard.

Reply of the Official Side :
DoPT has issued guidelines from time to time on the issue of special increment in the form of personal pay to Central Government Servants for participation in sporting events and tournaments of national or international importance. Vide OM dated 11.06.2018, DoPT has revised the rates of these increments in the context of the 7th CPC applicable to all the Central Government Civilian Employees and posts.

Subject: Incentive for acquiring fresh higher qualifications, in the 7th CPC Scenario - reg

Central Government Servants acquiring fresh higher qualifications after coming into service are granted incentive in the form of one-time lump-sum amount ranging from Rs.2000/- to Rs.10,000/-, as provided in this Department's OM No. 1/2/89-Estt.(Pay-l) dated 09.04.1999 and other related OMs.

2. The 7th CPC has reviewed the rates of incentive presently available to employees on this account in addition to pay, and have suggested their rationalization and simplification in Para 8.9.11 to 8.9.14 of their report.

3. Ministry of Finance, Department of Expenditure (DOE) Resolution No. 1-2/2016-IC dated 25.07.2016 vide Para 7 provided that the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th CPC shall be referred to a Committee under the Chairmanship of Finance Secretary, and until a final decision thereon, all allowances including this incentive were required to be paid at the existing rates in the existing pay structure (the pay structure based on 6th CPC) as if the pay has not been revised w.e.f. 1st January, 2016.

4. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of Finance Secretary has been issued as per the Resolution No. 11-1/2016-IC dated 06.07.2017 of DOE.

5. The President is pleased to decide that in supersession of all the existing orders/OMs/instructions/guidelines on the subject of granting incentive for acquiring fresh higher qualifications, the following one-time lump-sum rates as incentive for acquiring fresh higher qualification by a Government employee shall be permissible for courses in fields that are directly relevant to the employee's job.

6. Professional courses directly relevant to the functional requirement of the Organization/Ministry/Department but not covered by any one of the categories mentioned in para 5 above, shall be notified specifically under SI. No. 4 or S of para 5 above, by the concerned Ministry/Department in consultation with their respective IFD.

7. Ministries/Departments are free to choose courses on their own. However, the grant of incentive in respect of above qualifications will be subject to the fulfillment of the criteria laid down in para 8 below. The grant of incentive for the qualifications listed above shall be considered by the administrative authorities in consultation with their lFD and necessary orders shall be issued after ensuring that the criteria laid down in para 8 below are fulfilled.

8. Criteria/guidelines for granting incentive for acquiring fresh higher qualifications, in the 7th CPC Scenario, are as under:
8.1. The incentive will not be available for the qualifications which are laid down as essential or desirable qualifications in the recruitment rules for the post.

8.2. No incentive shall be allowed for acquiring higher qualification purely on academic or literary subjects. The acquisition of the qualification should be directly related to the functions of the post held by him/her, or to the functions to be performed in the next higher post. There should be direct nexus between the functions of the post and the qualification acquired and that it should contribute to the efficiency of the government servant.

8.3. The quantum of incentive will be uniform for all posts, irrespective of their classification or grade or the department.

8.4. The incentive shall not be admissible where the government servant is sponsored by the government or he/she avails study leave for acquiring the qualification.

8.5. The incentive would be given only for higher qualification acquired after induction into service.

8.6. No incentive would be admissible if an appointment is made in relaxation of the educational qualification. No incentive would be admissible if employee acquires the requisite qualification for such appointment at a later date.

8.7. The qualifications meriting grant of incentive should be recognized by University Grants Commission, respective regulatory bodies like AICTE, Medical Council of India, etc. set up by Central/State Government or recognized by the Government.

8.8. The incentive shall be limited to maximum two times in an employee's career, with a minimum gap of two years between successive grants.

8.9. The Government servant should prefer the claim within six months from the date of acquisition of the higher qualification.
9. The incentive as per this OM will be admissible for above qualifications acquired on or after 01.07.2017

10. Government Servants, who have acquired the fresh higher qualification on or after 01.07.2017 till the date of issuance of this OM, may also claim these incentives within six months from the date of issuance of this OM.

11. Insofar as the persons working in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

This Directorate had received a communication from General Manager (Finance), Postal Accounts Office, Lucknow in respect of grant of Special increment in the form of personal pay to the Government Employees for participation in Sports evens and tournaments of National /International importance in the 7th CPC Sceneario.
  1. In this regard, the advice of the Nodal Ministry was sought for on the following:
i) Whether any official is entitled for any enhancement of the increment in the light of Para No. 8 (I)(i) 'e' to 'g' of DoP&T OM no. 14034/01/2013·Estt (D) dated 03.10.2013.

ii) Also whether the Dop&T ON No. 6/1/2017-Estt. (Pay) dated 11th June 2018 will be made applicable in the case of Shri Avinash Srivastava Umpire.
  1. The Nodal Ministry has advised that:
a) Para 2 of DoPT's OM No. 6/1/2013-Estr(Pay-I) dated 19.09.2013 inter alia states that the personal pay will be related to the Grade Pay corresponding to the post against which the employees or will earn the personal pay. From the words ” had initially earned or will earn” it may be understood that the intention of the OM dated 19.09.2013 was not only to revise the rates of the then existing rate of personal pay for those who will earn it after 01.09.2013, but also for the employee concerned who had already earned it prior to 01.09.2013.

b) Further, it is stated that the subject of DoP&T's OM 6/1/2017-Est. (Pay I) dated 11.06.2018 states as under "Grant of special increment in the form of personal pay to Central Government Servants for participation in sporting events and tournaments of National or International importance, in the 7th CPC Scenerio". From the subject itself it may be inferred that it is for Central Government Servants and it does not distinguish between players, umpires, referees, coaches etc.

c) In view of the position at 3(a) and 3(b), it is clarified that DoPT's OMs dated 19.09.2013 and 11.06.2018 are applicable in the instant case and they may examine the instant case accordingly.
  1. Taking into account the advice of the Nodal Ministry in this regard, action may kindly be taken in similar case only on the basis of the above advice and in any case of deviation from the above, the advice of the Directorate may be sought for.
  2. This issue with the approval of competent authority.

Subject: Grant of special increment in the form of personal pay to Central Government Servants for participation in sporting events and tournaments of National or International importance, in the 7th CPC Scenario- reg.

Subsequent to the implementation of the recommendations of the 7th CPC and issuance of CCS(RP) Rules 2016, the system of running Pay Bands and Grade Pays have been replaced by pay matrix. Accordingly, in partial modification of this Department’s OM No. 6/1/2013-Estt.(Pay-I) dated 19.09.2013, the President is pleased to revise the rates of special increment granted in the form of personal pay to Central Government Servants, for participation in sporting events and tournaments of National or International importance, as indicated in Column 5 of Annexure to this Office Memorandum.

2. The revised rates and these guidelines will be effective from 01.07.2017.

3. In respect of the Government Servants who are already getting the special increments as Personal Pay in accordance with this Department’s OM dated 19.09.2013, the rates for them have also been revised as per Column 5 of the Annexure to this Office Memorandum. The rate of revised Personal Pay to these Government servants is to be granted based on the Grade Pay attached to the post in which they were placed at the time of participating in the sporting event for which they are getting special increment as Personal Pay.

3.1. Illustration: (a):
Grade Pay at the time of participating in sporting event : Rs.2000/-
Personal Pay granted on the basis of OM dated 19.09.2013 : Rs.710/-
Revised Personal Pay w.e.f. 01.07.2017 : Rs.480/-

3.2. Illustration: (b):
Grade Pay at the time of participating in sporting event : Rs.4200/-
Personal Pay granted on the basis of OM dated 19.09.2013 : Rs.400/-
Revised Personal Pay w.e.f. 01.07.2017 : Rs.900/-

4. The Central Government servants who become eligible for grant of special increment in the form of personal pay on or after 01.07.2017, shall be entitled to the Personal Pay prescribed in Column (5) of the Annexure to this OM, corresponding to the level of the post in the Pay Matrix [indicated in Column (4)], in which the Government Servant is placed at the time of participating in the sporting event.

4.1. Illustration:
Level of the post in the Pay Matrix in which the Government Servant is placed at the time of participating in sporting event : Level 7

Amount corresponding to Level 7 in Column (5) of the Annexure to this OM : Rs.1020/-

5. This Personal Pay shall not count for any service matters like pay fixation on promotion, retirement benefits or any other allowances like HRA etc.

6. The entitled Central Government servant should claim the benefits within six months from the date of completion of the overall sporting event.

7. All the other terms and conditions governing the subject matter shall remain unchanged and will continue to apply.

8. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Allowance Committee may submit its report on 20th February 2017

Federation Leaders associated with National Council JCM are keep telling that Allowance Committee might submit its report on 20th February 2017. The CG Staff are already very much upset over the Government’s deliberate attempt to delay the payment of Allowances by constituting many committees. Because the payment of revised Allowances is considered will impact the Governments Exchequers.

Lot of Committees formed and Meetings held after the Notification issued for implementation of 7th CPC Recommendations. But there is no any fruitful outcome from these meetings. No sign of making decisions which satisfy the Central government employees.

Had the Allowance like HRA is paid in revised rates from the date of Notification ie 25th July 2016, it seems more beneficial than waiting for the subcommittee reports. Because if revised allowances are not given retrospective effect, it will be a huge loss for Central Government Servants.

Reports suggests that the Allowance Committee may submit its report on 20th February 2017 and it will be notified with effect from 1st April 2017. Federation sources told that It is unacceptable and we will fight it out until the revised allowances implemented with effect from 1.1.2016

Schemes for Retired Employees

The pension of Central Civil Government servants appointed on or before 31.12.2003 is governed by the Central Civil Services (Pension) Rules 1972 or the corresponding Pension Rules of other Services/Departments such as All India Services and Railways.

The Central Civil Government Servants appointed on or after 01.01.2004 are governed by the Defined Contribution-based Pension Scheme under the National Pension System.

The personnel belonging to the Defence Services continue to be eligible for pension under Defined Benefit Pension Rules applicable to defence personnel.

There is no proposal to introduce any new pension scheme for retired Central Government employees.
This was stated by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh in a written reply to a question by Smt. Rekha Verma in the Lok Sabha today.

Subject: Participation by Central Government servants in sporting events and tournaments of National or International importance - Clarification - Regarding.

The undersigned is directed to refer to this Department's OM No. 6/ 2/ 2009-Pay-1 dated 18th May, 2010 which clarifies inter-alia that sportspersons participating in sporting events (individual/ team) of  national / international importance will be treated as having achieved excellence for the purpose of grant of increments if they achieve 1st, 2nd or 3rd position in the finals of sporting events, if more than three individuals or teams have participated in the events. If only three or less individuals or teams have participated in the finals of a sporting event, the sportsperson / team achieving first position will be treated as having achieved excellence.

2. The question as regards treating the term 'finals' used in OM dated 18.5.2010 and also the distinction sought to be made between athletic / equivalent and non- athletic / equivalent sporting events has been engaging the attention of the Government. The matter has been examined and the President is pleased to decide the conditions for grant of incentive increments as under:
(i) In the case of athletic / equivalent sporting events, which are generally decided on the basis of finishing position and which do not involve level-related concept e.g. finals, semi-finals and are held all at one go, there would be no 'finals'. The three individuals / teams that secure first three positions shall be said to have achieved excellence, if more than three individuals / teams have participated in the sporting events of national / international importance, for the purpose of grant of incentive increments. This benefit, however, is allowable to the individual/team, who achieves the first position only, if the number of individuals/teams that participate in the sporting event, is three or two.
(ii) In the case of non-athletic/equivalent sporting events which involve level-related concept and the Game's format provide for awarding 1 Gold + 1 Silver + 1 Bronze Medals - The individuals/ members of the teams who have achieved first and second positions (i.e. Gold and Silver Medals) respectively, in the finals and the individual/ members of the team who has/ have achieved third position and has/ have been awarded Bronze Medal, shall be said to have achieved excellence for the purpose of grant of incentive increments, if more than three individuals/ teams have participated in the sporting events of national/ international importance. This benefit, however, is allowable to only the individual/ members of the team securing first position, if the number of individuals / teams that participate in a sporting event is three or two.
(iii) In the case of non-athletic/equivalent sporting events which involve level-related concept and the Game's format provide for awarding 1 Gold + 1 Silver + 2 Bronze Medals and there is no "play off' match for the Bronze Medal which is awarded to both the loosing semi-finalists
The individuals/ members of the teams, achieving first and second positions (i.e. Gold and Silver Medals) respectively, in the finals and both the losing semi-finalist individuals/ members of the teams who have been awarded Bronze Medals (i.e. the third position is a tie between the two semi-finalists), shall be said to have achieved excellence for the purpose of grant of incentive increments, if more than four individuals/ teams have participated in the sporting events of national/ international importance. This benefit, however, is allowable to only the individual/ team securing first position, if the number of individuals/ teams that participate in a sporting event is four or three or two.

3. These orders shall be in supersession of the OM No. 6/2/2009 - Pay-1 dated 18th May, 2010. The provisions as contained in the OM No.6/1/85-Estt(Pay-1) dated 16th July, 1985 and subsequent orders
issued on the subject shall continue to apply. Past cases may also be decided accordingly.

This Department proposes to issue clarification with regard to the term ‘finals’ used in OMs dated 18.05.2010 & 16.07.1985 (copies enclosed) and also with regard to the distinction between athletic/equivalent and nonathletic/equivalent sporting events, in respect of participation by Central Government Servants In Sporting Events of national/international importance.

Sub: Participation by Central Government servants In sporting events and tournament of National or International importance.

The undersigned is directed to refer to this Department’s OM No. 6/1/85-Estt (Pay+I) dated 18th May, 2010 which clarifies Inter-alia that sportspersons participating In sporting events (individual/team) of  national/international importance will be treated as having achieved excellence for the purpose of grant of increments if they achieve lst, 2nd or 3rd position in the finals of sporting events, if more than three individuals or teams have participated in the events. If only three or less individuals or teams have participated in the finals of a sporting event, the sportsperson / team achieving first position will be treated as having achieved excellence.

2. The question as regards treating the term ‘finals’ used in OM dated 18.5.2010 and also the distinction sought to be made between athletic / equivalent and non- athletic / equivalent sporting events has been engaging the attention of the Government. In the case of athletic / equivalent sporting events, which are generally decided on the basis of finishing position and which do not involve level-related concept e.g. finals, semi-finals and are held all at one go, there would be no ‘finals’. The three individuals / teams that secure first three positions shall be said to have achieved excellence, if
more than three individuals / teams have participated in the sporting events of national/international importance for the purpose of grant of incentive increments. This benefit, however, is granted to the individual/team, who achieve the first position only, if the number of individuals / teams that participate in the sporting event is three or two.

3. In the case of non-athletic / equivalent sporting events, which are generally single elimination sporting events and which involve level-related concept, the individuals / members of the teams achieving first and second positions respectively In the finals and both the losing semi-finalist individuals / members of the teams achieving third and fourth positions respectively shall be said to have achieved excellence for the purpose of grant of incentive increments, if more than three individuals / teams have
participated in the sporting events of national/international importance for the purpose of grant of incentive increments. This benefit, however, is allowable to only one individual/team, if the number of individuals / teams that participate in a sporting event is less than three.

4. These orders shall be in supersession of the OM No. 6/1/85-Estt(Pay-1) dated 18th May, 2010. The provision as contained in the OM No.6/1/85-Estt(Pay-1) dated 16th July, 1985 shall continue to apply. Past cases may also be decided accordingly.
