Retirement age 65 years

The government has amended rules putting the maximum age limit of 65 years (retirement age 65) for the Chief of Defence Staff (CDS) to serve in the post.

The changes were made in the Rules of the Army, 1954, according to a defense ministry notification.


In a landmark decision, Tuesday (31st December 2019) Cabinet Committee on Security approved the formation of the CDS, which will serve as the defense minister’s principal military advisor on all tri-service issues.

The service chiefs can serve for a maximum duration of three years or until they reach the age of 62, depending on the early age.

Sub: Option to be submitted by Doctors belonging to IRMS and Dental Doctors under the Ministry of Railways to serve the Government upto 65 years - Reg.

Ref: 1. Ministry of Personnel, Public Grievances and Pensions (DoP&T)'s Notification No. GSR.767(E) dated 11.08.18 (Annexure A).

2. MoH&FW’s OM NO. A.12034/4/2018-CHS.V dated 13.8.18 (Annexure B).
In supersession of orders contained in Board’s Letters of even number dated 31.05.16 (RBE No. 57/2016) and 26.12.2017 (RBE No. 205/2017) and in accordance with the orders contained in the DoP&T’s Notification No. GSR.767(E) dated 11.08.18 amending Clause (bb) under FR 56 of the Fundamental Rules, 1922, the provisions in respect of age of superannuation of doctors of the Indian Railways Medical Service and Dental Doctors under the Ministry of Railways are modified as stated in the Notification.

2. The age of superannuation of Doctors belonging to IRMS and Dental Doctors under the Ministry of Railways shall be sixty-two (62) years unless they exercise the option of posting to a Clinical post depending upon their expertise and experience, as decided by the Competent Authority in the Ministry of Railways from time to time, in case they desire to continue in their service upto the age of sixty-five (65) years.

3. The serving doctors belonging to IRMS and Dental Doctors under the Ministry of Railways who have already attained the age of 62 years or will be attaining the age of 62 years within 6 months from the date of issue of these orders may exercise their option as per the enclosed format within a period of 30 days from the date of issue of these orders. All other doctors would, in future, be required to submit their option not less than 06 months before their attaining the age of 62 years. The Railway doctors should furnish their option through the Personnel Branches of their respective Railway administrations.

4. The serving doctors who fail to exercise the option within the period specified above shall stand superannuated from service on attaining the age of 62 years or on expiry of the period of 30 days from the date of issue of these orders, whichever is later.

5. Posting orders involving inter-Railway transfers and for those working in Boards office will be issued by the Railway Board. Orders of CMSs and CMDs in Zonal Railways who cross 62 years of age and opt to serve in a Clinical post and who are posted on the same Railway itself would be issued by the Zonal Railway administration themselves.

6. Copies of options exercised by the Railway doctors should be forwarded to the Board’s office (Secretary's Confdl. Cell) for record and necessary action.

7. A list of administrative posts identified by the Ministry of Railways and designations of IRMS officers after 62 years is annexed (Annexure C).

8. These instructions are available online at www.indianrailways.gov.in.

9. These instructions may be brought to the notice of all doctors belonging to IRMS and Dental Doctors under the Ministry of Railways.

10. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

Cabinet approves enhancement of age of superannuation of General Duty Medical Officers, Specialist Grade doctors and Teaching Medical Faculty working in Bhopal Memorial Hospital and Research Centre, Bhopal

The Union Cabinet chaired by Prime Minister Shri Narendra Modi has approvedthe proposal of Department of Health Research, Ministry of Health & Family Welfare to enhance the age of superannuation of General Duty Medical Officers, Specialist Grade doctors and Teaching medical faculty working in Bhopal Memorial Hospital and Research Centre, Bhopal to sixty-five years at par with doctors of Central Health Services and doctors working under other Central government hospitals/institutes.

The age of superannuation in respect of General Duty Medical Officers and Specialists included in Teaching, Non-Teaching and Public Health sub-cadres of Central Health Services was increased to sixty-five years vide a Notification in January, 2018.

The Government decision will meet the shortage of faculty and specialist doctors in the BMHRC and improve the patient care facility to the victims of Bhopal Gas Tragedy and members of their families.

Cabinet approves Enhancement of age of superannuation of doctors other than Central Health Service (CHS) doctors to 65 years 

The Union Cabinet chaired by Prime Minister Shri Narendra Modi has approved the enhancement of age of superannuation of doctors other than Central Health Service (CHS) doctors to 65 years in the following manner:
i. Ex-post facto approval to enhance the superannuation age of doctors of Indian Railways Medical Service to 65 years.

ii. Ex-post facto approval to enhance the superannuation age to 65 years for doctors working in Central Universities and IITs (Autonomous Bodies) under Department of Higher Education and doctors in Major Port Trusts (Autonomous Bodies) under Ministry of Shipping.

iii. The superannuation age has been enhanced to 65 years in respect of doctors under their administrative control of the respective Ministries/Departments [M/o of AYUSH (AYUSH Doctors), Department of Defence (civilian doctors under Directorate General of Armed Forces Medical Service), Department of Defence Production (Indian Ordnance Factories Health Service Medical Officers), Dental Doctors under D/o Health & Family Welfare, Dental doctors under Ministry of Railways and of doctors working in Higher Education and Technical Institutions under Department of Higher Education].

iv. The Union Cabinet has further approved that doctors shall hold the administrative posts till the date of attaining the age of 62 years and thereafter their services shall be placed in Non-Administrative positions.
The decision would help in better patient care, proper academic activities in Medical colleges as also in effective implementation of National Health Programmes for delivery of health care services.
Around 1445 doctors of various Ministries/Departments of the Central Government would be benefitted.
The decision will not have much financial implications as large number of posts are lying vacant and the present incumbents would continue to work in their existing capacity against sanctioned posts.

Background :
  • The age of superannuation of doctors of Central Health Service was enhanced to 65 years w.e.f 31st May, 2016.
  • The doctors other than Central Health Service including doctors of other systems of Medicine of Central Government requested for enhancement of age of superannuation on the ground of parity with CHS and shortage.

Government proposes raising retirement age of scientists from 60 to 65

The government has proposed raising the retirement age of scientists working in all ministries, departments and autonomous institutions from 60 to 65 years.

In a draft cabinet note that has been circulated to all ministries, the science and technology ministry has argued that such a move will help attract scientific manpower and that all institutions would be able to harness the expertise of scientists for a longer duration.

“Most of the scientists at 60 would be leading productive research groups and are involved in mentoring students and young scientists. It is therefore necessary to make use of the productive age of the scientists beyond 60 years so that the effective scientific strength and correspondingly the scientific wealth of the country get enhanced,” the draft note said.

 We have heard it so many times . Every one of us got tired of hearing this rumour again and again. But this time this news may not fade away just as a rumour.

Because the series of events that had happened until now listed below are telling that it will be come true soon.

1. Though there is no any demand from any corner to raise the retirement age of central government employees to 62 years, a parliamentary panel has recommended a proposal to increase the retirement age of government servants to 65 years. The report of the standing committee of Parliament on social justice and empowerment tabled in the Parliament on 7th of this month. Ample justification also was given for their recommendation to increase the retirement age.

2. A reliable source close to a Cabinet Minister told that, the Cabinet Minister himself, while addressing to the Trade Union Wing of his party told ‘the Central Government would announce some important decisions in respect of central government employees within a week or two. This will be good news for all the central government employees.’

3. A close ally of a Central Minister told that, in a meeting held with the leaders of the state unit of his party day before yesterday, the Minister told the Leaders ‘a proposal of increasing retirement age of central government employees to 62 years has been waiting for Cabinet nod. It is expected that the cabinet will clear this proposal within a week. After it gets the Cabinet Nod, the formal announcement will be made by Central Government before the Election announcement.’


The above information clearly indicates that some Good News for Central Government Employees are waiting to be announced within a week or two. All the central government employees know what that good news is!

 The expected good news will be either increasing retirement age or Merging 50% DA with Basic Pay or Both!

Retirement age 65 – Retirement age of Lecturers of NCERT to 65 years

The above question was asked in Parliament on 14th August and the concerned ministry has replied that "the retirement age for all the employees of the Kendriya Vidyalayas Sangathan (KVS) and the Navodaya Vidyalayas Samithi (NVS), including the teaching staff, is 60 years.

The age of retirement for the teaching faculty in the centrally funded Higher and Technical institutes was enhanced from 62 to 65 years vide an Order issued by Department of Higher Education in March, 2007.

These orders are applicable to the teachers, who are actually engaged in teaching classes/courses/programmes of study in such institutions. At present, no proposal to enhance the retirement age of lecturers of the National Council of Educational Research & Training (NCERT) to 65 years is under the consideration of this Ministry.

OFFICE MEMORANDUM

Subject : Re-Constitution of Departmental Peer Review Committee for considering the cases for extension of service of Scientists beyond the age of superannuation.

The Prime Minister has approved the composition of the Standing Peer Review Committee in respect of Ministry of Earth Sciences with the following compositions for considering the cases for extension of servIce of Scientists beyond the age of superannuation under FR 56(d).

i.Secretary, Ministry of Earth Sciences-Chairman
ii.Dr.R.R.Navalgund, Ex-Director, Space Application Centre, Ahmedabad-Member
iii.Prof. S.K.Dubey (Ex-Director, IIT, Kharagpur), IIT, Delhi-Member
iv.Prof.Krishna Lal, President, Indian National Science Academy-Member
v.Secretary, DOPT or representative of Secretary not below the
rank of Additional Secretary
-Member

2. The tenure of the Committee will be two years.

3. The Committee will hold biennial meetings, three to four months in advance to consider the proposals for extension of service coming up in the six months block i.e. April-September and October-March so that the ACC gets sufficient time to consider the proposals. The recommendation of the Peer Committee for extension of service beyond 60 years and upto 62 years may be submitted to the EO Division of DOP&T for obtaining approval of the ACC.

4. The Committee will also consider the cases of extension of service beyond 62 years and upto 64 years and the recommendation of the Committee may be submitted to the Establishment Division for placing the same for consideration by the Screening Committee headed by the Cabinet Secretary before obtaining the approval of the ACC.

Whether the Government proposes to increase the age of retirement of Government employees from 60 to 65..? and 

Whether various Departments of the Government has fixed different age limits for the purpose of retirement..? 

The Minister of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy said in a written reply to the Lok Sabha on 5th December 2012 as follows... 

"There is no such proposal at present. As per Fundamental Rule 56, except as otherwise provided in the Rule, every Government Servant shall retire from service on attaining the age of 60 years".

One of the major demand submitted by the associations of KV Employees to discuss in the JCM Meetings to enhance the retirement age at par with the retirement age of University teachers...

The point has been discussed in the JCM meeting which was held on 18th October 2012, after detailed deliberation on the matter from both sides the Chairperson decided that no parity can be held between the University Teachers and KV Teachers as well. Also it cannot be compared with other State Government teaching employees. Hence, the demand of association does not appear to be acceptable.
The matter discussed at length in the last JCM but was not agreed hence stands dropped.

Whether decision taken by the Government to increase the retirement age of faculty doctors from 65 years to 70 years has been implemented..?

The Government have not taken any decision to increase the retirement age of faculty doctors from 65 years to 70 years.

However the Medical Council of India, with the previous approval of the Central Government, has amended the “Minimum Qualifications for Teachers in Medical Institutions (Amendment) Regulations, 2010” wherein the maximum age limit up to which a person can be appointed or granted extension or re-employed in service against the posts of Teachers or Dean or Principal or Director, in any Medical College or Teaching Institution for imparting Graduate and Post-Graduate medical education, has been increased to 70 years, allowing an authority making recruitment rules /appointment to such posts in Medical College or Teaching Institution to make recruitment rules/appointment accordingly.

Is raising retirement age of Central Government Employee a threat for employment prospects of youth ?
At the end of Every Year people used to talk about the proposal of raising the retirement age of government servants. Normally the people who are at the verge of retirement from government service are eagerly expecting the government to increase the retirement age. The Government servants especially those who are in the pay structure of Pay band –I will have to face financial burden as the Pension amount they will be paid after commutation will be very meager and it is not sufficient enough to meet their expenses of day to day life. Because the Government employees those who are drawing grade pay of Rs.1800/-, 1900/-, 2000/-, 2400/-and 2800/- will get only around Rs.20000 as the gross salary of every month. It is understood that one cannot lead a financially successful life with this income alone. So many government servants, to run the life, forced to avail loans from where ever they can get. At the end, they are badly in debt at the time of retirement. 

That is why the government servants don’t feel happy about retiring from service. But extending the service of two years from 60 to 62 will not solve all their problems. It will help them to put off facing the financial crisis for at least two years. But the Government does not consider this aspect any way to increase the retirement age of central government employees from 60 to 62.
Extension of Service to  Bureaucrats
The Central Government always wanted to make better use of the knowledge and experience of its Bureaucrats even after their retirement. In other words Government wants to secure their top brass preferably IAS officers by giving service extension. Sometime extending their service for further period of two year is difficult task for the concerned department. Extension in service can be given only in “exceptional circumstances”. For example recently home Ministry wanted to give one year extension to its former Director-General of the Central Reserve Police Force (CRPF) as he has done commendable work in his stint . But it was denied by the Appointments Committee of the Cabinet (ACC). However, it was mainly the service rules that led to the ACC declining Home Ministry’s proposal. Normally IAS officers offered multiple service extension.
The Retirement Age of  Professors   
The Central Government has already increased the retirement age of professors in all the central universities from 62 to 65 years, two years back. Before that, the retirement age of professors of Central Universities was 62 with the provision for re-employment for three years after the superannuation. That time there was some allegation that this provision of re-employment was being “misused” by the authorities who took such decisions in an “arbitrary” manner. So Central Government decided to increase the retirement age of Professors to 65 uniformly.
One year extension for state government employees 
Recently the Punjab government’s decided to offer an extension of one year in service to its retiring employees with effect from October 2012 . The condition laid down for this offer was 1.Employees will be given an option to continue at the same salary.2. They will get no increments in salary during the extension period but will get any due promotions. The decision to give the extension was taken to meet the shortage of 35,000 employees who are expected to retire in next one year. Since, the move may affect employment prospects of the youth, the government increased the maximum age limit for recruitment into government service from 37 to 38 years.
The Retirement Age of  Judges
On August 18, 2012, The Prime Minister Dr. Manmohan Singh, speaking at the 150th year celebrations of the Bombay High Court, said the government was in favour of raising the age of retirement of High Court judges. Presently, Supreme Court judges retire at 65 and High Court judges at 62.
Re engagement of Retired Employees in Railways
Whether it is true or not but it is believed that Railway gave its consensus to raise the retirement age of its employees, as it is already re-engaging their retired employee for daily remuneration after their retirement till the age of 62. It was followed from 1998 with the reference of Railway Board Letter No.E(NG)II/97/RC-4/8 dated 03.02.98. In 2009 the rates of Daily Allowances also revised for engagement of retired employees on daily remuneration basis.
So keeping in view of the entire above aspects one can assume that the state and central governments and some Departments are in fovour of increasing the retirement age of Central and State government employees.
       But Social Activists and youth associations are against this proposal and they expressed their dissatisfaction over this  and telling that the retirement age of central government employees should not be increased to 62 as increasing the retirement age is a threat for employment prospects of the youth.Many of them opined that instead of increasing, the retirement age should be reduced to 58 so that the youngsters will be given opportunity to get into Central government services.
