7th CPC Pay Revision of Option for Railway Employees

OPPORTUNITY FOR 7TH CPC PAY REVISION OF OPTION TO RAILWAY EMPLOYEES

Sub: – Railway Services (Revised Pay) Rules, 2016 – opportunity for revision of option to come over to revised pay structure.

Ref:- Board’s letter No. PC-VII/2018/RSRP/1 dated 17.12.2018 (RBE No. 197/2018)

Please refer to Board ‘s letter mentioned above inter-alia circulating Ministry of Finance’s (MoF) OM No.4-13/17-IC/E-IIIA dated 12.12.2018 regarding opportunity for revision of option to come over to revised pay structure under CCS(RP) Rules, 2016 for adoption of the same in Railways with respect to RS(RP) Rules, 2016.

Consequent to issue of the same, certain Railways has sought clarification whether option to switch over to 7th CPC pay structure can be exercised in a prospective manner covering promotions materialized after notification of RS(RP) Rules, 2016.

2. With respect to above, it is stated that earlier, the issue has been examined in Board’s Office and a reference has already been made to MoF seeking clarification on the issue. Response from MoF is awaited.

Till such time clarifications are received from MoF, it is advised that while allowing options, conditions as stipulated in Rules 5 & 6 of RS(RP) Rules, 2016 may strictly be followed as Ministry of Finance while liberalizing conditions under Rule 6(4) of CCS(RP) Rules, 2016 which provides that the option once exercised shall be final and permitting another opportunity to employees to revise their initial option in terms of Rule 5 & 6 within a period of 3 months, made no changes in the other conditions laid down in Rules 5 & 6 of CCS(RP) Rules, 2016 governing exercise of option.

3. Hence, it is clarified that option for switching over to 7th CPC with respect to promotions up to 28 .07.2016 (date of notification of RS(RP) Rules, 2016) valid only and option for switching over to 7th CPC cannot be exercised with respect to promotions materialized after the said date.

Further, Illustrations on pay fixation methodology in cases

(a) where a Railway Servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of RS(RP) Rules, 2016 on account of promotion or upgradation and elect to switch over to revised pay structure from the date of such promotion/upgradation and

(b) fixation of pay in case an employee elect to continue to draw pay in existing pay structure until he vacates his post or ceases to draw pay in the existing pay structure with respect to promotion upgradation materialized after the date of notification of RS(RP) Rules, 2016 in terms of relevant provisions of RS(RP) Rules, 2016 is enclosed as Annexure-I.

4. This issue are in concurrence with Finance Directorate of Ministry of Railways.

Ref: NFIR’s PNM Item No.28/2011.

Vide Action Taken Statement provided by the Railway Board during NFIR’s PNM meeting held on 13-11-2017, it was conveyed that after issuance of guidelines vide Board’s letter No.PC-VII/2017/1/7/5/7 dated 03/10/2017 (RBE No.141/2017), remaining aspects of the Uniform including changes of uniform code for Diesel Loco shed staff has been under examination.

NFIR requests the Railway Board to kindly expedite action and convey the latest status soon with regard to change of uniform code for Diesel Loco shed staff on Indian Railways.

In the recently held Meeting, All India Railwaymen’s Federation has pointed out (PNM Item no.30/ 2011) that the pensioners are facing difficulties with regard to grant of Fixed Medical Allowance despite several letters from Board emphasizing to ensure strict compliance of the instructions issued vide letter cited under reference, the latest being dated 27.10.2016 (RBA No. 80/2016).

It is ,.therefore, requested that the prevailing status on your Railway may be reviewed and pensioners’ grievance in this regard may be redressed.

Sub: Simplification of rules/procedure on withdrawals from Provident Fund by Railway employees-reg.

Ref: (i) Railway Board's letter No. F(E)/III 77 PFI/3 dated 27/5/1977.
(ii) Rule 925 read with sub rule (3) (a) of RI.

Difficulties are being faced by Railway employees while withdrawing money from the their Provident Fund as the authorities have been insisting on submission of various uncalled for/unwarranted affidavits/documents with result the payments are delayed causing deep sense of frustration among employees.

2. In this connection N FIR desires to convey that provision exists under Rule 925 read with sub rule (3) (a) of Indian Railway Establishment Code Vol-I (Reprint Edition, 1995) as below:-

    "Marriage expenses-- Withdrawals may be permitted for meeting expense subject to the following terms and conditions:-

    (a) meeting the expenditure in connection with the betrothal/marriage of the subscriber or his sons or daughters and any other female relation actually dependent on him".

Above rules no where indicate that the employee should be asked to submit affidavits and complete other unnecessary formalities causing hindrance and delay in the process unnecessarily in the drawal of employee's own money which is unfortunate despite the fact that the employees have to forego interest on the amount of money drawn from P.F.

3. For easy processing and to overcome the hurdles, NFIR wishes to state that Zonal Railways etc., may be directed to sanction and pay the amount drawn by the employee on a simple application form containing all relevant information with self certification.

NFIR, therefore, requests the Railway Board to issue suitable instructions to all Zonal Railways/Production Units to avoid unnecessary hardship to staff. A copy of the instructions issued may be endorsed to the Federation.
