ORDER

This Department's order of even number dated 09.08.2019 directed the concerned Ministries/ Departments to relieve the officer(s) concerned by 13.08.2019 under Rotational Transfer Policy so that the officers could join the allocated Ministry/ Department' However' it has been observed that inspite of this Department's OM of even number dated 11.09.2019 requesting to relieve the officers immediately not all the officers have been relieved so far.

2. Mean while requests have been received from the Ministries / Departments for retention of officers. The matter has been examined in the Department. However, it has been decided not to accede to the requests for retention of the officers.

3. Accordingly, all the Section Officers who have not yet been relieved, are hereby deemed relieved from their respective Ministries / Departments w.e.f. 30.09.2019(AN) with the direction to report for duty to their allocated Ministries/ Departments. The only exception will be in respect of officers who are presently undergoing any mandarory training at ISTM. They will join the new Ministries/ Departments on completion of training.

4. The concerned cadre units as well as the officer(s) concerned are requested to comply with the order. The onus to join the allocated Ministry/ Department on the basis of order of even number dated 09.08.2019 issued by this Department will be on the officer concerned and failure to do so may attract punitive action. It will also be incumbent upon the Ministry/ Department and the officer concerned not to draw salary beyond the stipulated date.

5. This issues with the approval of the Competent Authority.

6. A copy of relieving /joining order may also be furnished to this Department for records.

Subject: Transfer of Personal Assistant of CSSS under the provision of RTP of CSSS-reg.

The undersigned is directed to refer to this Department's O.M. No. 25/28/2014-CSII(A) dated 22.07.2015 vide which the revised Rotational Transfer Policy (RTP) for CSSS personnel has been notified. It has accordingly been decided to carry out rotational transfer on the basis of the revised RTP.

2. As per the provision of RTP, the total tenure prescribed for a PA of CSSS in a particular Cadre Unit! Ministry/ Department is 8 years against the cut-off date of 1 sl July, 2016. Officials serving in Ministry/ Department, which are largely regulatory in nature, namely DoPT, MHA, Defence, Legal Affairs and Expenditure will be given a reduced tenure by one year i.e. 7 years against the cut-off date of 1 sl July, 2016.

3. Keeping in view of the above, all the Cadre Units of CSSS are required to furnish the name of all the eligible PAs, who have completed the prescribed tenure, mentioned in para 2 above, as on 01.07.2016 for transfer under RTP to execute the transfer policy smoothly as in Annexure-I.

4. While examining the web based data in respect of the Personal Assistants to be covered under RTP, it has been observed that complete data in respect of a large number of officials are not available. The Cadre Units are, therefore, requested to ensure that the data at Cadre Management System updated. In the meanwhile, the information in respect of PAs be furnished to this Department in the enclosed proforma positively by 16.10.2017.

The undersigned is directed to refer to this Department's O.M. of even number dated 16.07.2015 vide which revised Rotational Transfer Policy, applicable to Central Secretariat Service officers, was circulated. The competent authority has approved the following additions in the para 12 of the Rotational Transfer Policy:

12.3 In all cases not covered under existing provisions like merger and winding up of Departments / Ministries etc, the posting to Group A and B of the officer would be determined as follows:

(a) If term available is 2 years or more then the officer would be posted to the Group in which the erstwhile Department / Ministry was categorized.

(b) If term available is less than 2 years then the officer would be posted as per overall period served in the entire service and going to a category of Department / Ministry in which less number of years has been served.

Subject:- Rotational Transfer Policy (RTP) applicable to Central Secretariat Stenographers' Service personnel - Constitution of Committee therefor - reg.

The undersigned is directed to refer to this Department's O.M. No. 13/1/2009-CS.1I dated 15.07.2011 on the subject mentioned above vide which transfer policy (Rotational Transfer Policy) in respect of officials
belonging to Central Secretariat Stenographers' Service has been laid down.

2. As per the RTP, tenure of a CSSS official in a particular cadre unit/Ministry/ Department shall be 10 years. An officer is normally posted outside the cadre unit/Ministry/Department only upon promotion. In pursuance of this policy, a committee consisting of three adequately senior officers is constituted at the time of promotion/consideration of transfer of CSSS officials. Based on the recommendations of the said committee, requisite order for promotion/transfer of CSSS officials is issued with the approval of the competent authority.

3. In compliance of Supreme Court's order dated 31.10.2013 in WP (Civil) No. 82/2011, it has been decided to constitute a committee for recommending the transfer of CSSS personnel in each grade and further to specify the authority competent to take a decision in this regard. The constitution of the grade-wise Committees in this regard will be as mentioned below. Nomination of the members in the committees, wherever required, will be made by the authority competent to approve the transfers in the respective grades. The committees will make recommendations and final decision will be taken by the authority mentioned under each of the Committee :-

i. Stenographer Grade 'D', PB-I, Rs.5200-20200/- + Rs.2400/- G.P, entry by Direct Recruitment
a) US(CSSS),
b) Another US,
c) SO(CS-II.C,Dealing with the subject)

Authority competent to approve the recommendations of the Committee:-

Deputy Secretary/Director CS-II

ii. Personal Assistant, PB-II, Rs.9300-34800/- + Rs.4600/- G.P
a) US(CSSS),
b) Another 2 USs,

Authority competent to approve the recommendations of the Committee:-

3. While making recommendations for posting /transfer in the grades of PAs upto PSO,due consideration would be given to the three options given by the official, as provided under OM No. 13/1/2009-CS II dated
15.07.2011, and subject to seniority and availability of vacancies, effort would be made to accommodate their options to the extent possible. This criteria may not, however, be applicable in case of Stenographers Grade' D' who are recruited through direct recruitment.

4. Other terms and conditions of the a.M. No. 13/1/2009-CS.1I dated 15.07.2011 will remain unchanged.

Subject: Non-relieving of Section Officers covered under RTP - regarding.

The undersigned is directed to refer to this Department OMs of even number dated 06.02.2013, 15.03.2013 and 12.04.2013 vide which all the Cadre Units were requested to relieve the officers covered under RTP orders dated 21.12.2012 and 09.01.2013. As per the records available in this office, a number of Section Officers included in the said orders have not been relieved by the Cadre Units concerned as yet.

2. Non-compliance of RTP orders by various Cadre Units has led to various administrative difficulties for DOP&T in smooth cadre management DOP&T is well aware of the fact that large number of vacancies exists across the 42 Cadre Units. UPSC had conducted the Limited Departmental Competitive Examination (LDCE) for Section Officer grade for 2009, 2010 & 2011 and the result of the written part of the examination has already been declared. After declaration of the final results by UPSC, which is expected shortly, almost all the vacancies in Section Officers’ grade across Cadre Units of CSS would be filled up.

3. This is a transitional phase and the Cadre Units are requested to cooperate with DOP&T during this phase. It is, therefore once again requested that all the offìcers, who have not yet been relieved, may be relieved immediately.

Subject: Rotational Transfer of Section Officers of CSS with more than 7 years of service in the same Ministry/Department.

The undersigned is directed to refer to this Department OM No. 4/12/2011- CS-I(D) dated 02.03.2012 vide which decision to implement Rotational Transfer Policy(RTP) in a phased manner all Grades of CSS was conveyed.

2. With the approval of the Competent Authority, RTP orders in respect of Section Officers have been issued vide order No. 6/10/2012-CS-I(S) dated 10.05.2012 and order No. 6/13/2012-CS-I(S) dated 21.12.20V2. In furtherance of the above, a list of Section Officers(regular & ad-hoc) to be covered under RTP during January, 2013 after excluding those officers who are due to superannuation within two years, are enclosed at Annexure-I. The list includes Section Officers as on 01.01.2012, who have completed 7 years or more in a Cadre Unit in any capacity.

3. Ministries/Departments and officers concerned may check the enclosed information and bring to the notice of this Department urgently if some Section Officers have been left out or if there is any other error/omission in the list

4. The officers included in the Annexure and those covered under the instant RTP are requested to indicate their preferences, if not yet submitted, in the enclosed format Annexure-II which should reach CS-I Division by 04th January, 2013. It may be noted that seeking preferences is only for the purpose of assisting this Department indeciding the posting and this should not in any way be construed as a right for claiming posting of choice. The option may be faxed at 24629413 & 24629414
