Dear Sir,

I solicit your kind attention to my letter in No.NC/JCM/2014 dated 16 th December, 2014, wherein we had conveyed the decisions taken at the National Convention of representatives of the organisations participating in the JCM. We are distressed that you have chosen not to respond to our letter till date. We have so far not received any communication from any quarter of the convening of the National Council of the JCM. No effort has also been taken by any Ministry to convene the Departmental Councils.

We have now been given to understand that the Government has taken serious steps to set up a corporation to carry on the functions of the 41 ordnance Factories, presently functioning under the Ministry of Defence. We have also noted that the report of the Committee set up by the Government to corporatize the functions of the Postal Department. The inordinate delay in settling the demands for Interim Relief and Merger of DA is causing distress amongst the Central Government employees. The Railwaymen are particularly agitated over the decision of the Government to induct FDI to the extent of 100% in Railways, which we are aware cannot be done without privatisation of the Railways. The declaration of the Convention, which we had forwarded to you vide our letter cited had amply explained the anguish of the Central Government employees.

In order to register our opposition to the recent decision of the Government to corporatize the functions of the Ordnance factories, we have amended Item No.2 of the charter of demands. We send herewith the revised charter of demands.

The National JCA met today and took note of the silence on the part of the Government to our pleadings. The meeting has, therefore, decided to go ahead with the agitational programmes, the first phase of which will culminate in a massive March to Parliament by Central Government employees on 28th April, 2015. If no settlement is brought about on the 10 point charter of demands, we will be constrained to go for an indefinite strike action, the date of commencement of which will be decided on 28 th April, 2015.

Dear Comrades,

As scheduled, the meeting of the National JCA was held at the Staff Side office today, i.e. 11th January, 2015. The list of members who attended the meeting is annexed to this communication. The meeting was chaired by Com. M. Raghavaiah, General Secretary, National Federation of Indian Railwaymen. The meeting made the following observations and took the following decisions:

The Statement made by Shri Narendra Modi, Honourable Prime Minister of the country at Varanasi to the effect that the Railways would not be privatised was misleading and intended to create confusion in the minds of the Railwaymen, especially in the background that the proposal to induct FDI in Railways to the extent of 100% is being pursued vigorously.

The Government has decided to set up a Corporation to carry on the functions of the 41 ordnance factories under the Ministry of Defence.

Except in a few States, the steps required to be taken for form the State level Committees of the JCA have not been undertaken.

In order to expedite the formation of such committee in all States, the NC JCM website will carry the names and addresses of the State leaders of the participating organisations

The Zonal Secretaries of AIRF will be asked to ensure that such committees are formed at all State Capitals before the end of this month and the convention is held on a mutually convenient date for all but before 15th February, 2014.

District conventions or March to Collectorates will be organised by the Committee in all District capitals of the country.

The entire month of March and the first half of April will be utilised for campaigning amongst the employees at all work- spots.

The March to Parliament will be organised on 28th April, 2015.

Every effort will be taken to reach a target of 5 lakh workers to participate in the said March. Target quota for each organisation will be fixed.

The State Committees will advise the National Convenor as to which organisations (those CGE organisations who are not presently participating in the JCM must be addressed to join the movement.

The State Committees after the convention will hold Press Conferences to give media publicity to the decisions taken including the decision to go on indefinite strike action.

The National JCA will hold a Press Conference at Delhi prior to the March to Parliament programme.
The Charter of demands will be amended (Item No.2) to include the following words: “and ordnance factories under the Ministry of Defence.”

Reminder letter will be sent to the Cabinet Secretary expressing distress over his silence and the non convening of the National Council, Anomaly Committee and Departmental Councils of the JCM.
The Convenor reported that the 7th CPC has informed him of their intention to convene the meeting of the organisations for tendering oral evidence in the month of February, 2015.

Central Government Employees Confederation (CGEC); National Organisation of Central Government Employees (NOCGE) and INTUC have unanimously resolved to observe “NATIONAL PROTEST DAY” on 5th December, 2014 all over India along with all Central Trade Unions in India (Viz: INTUC, BMS, CITU, HMS, AITUC, TUCC, AIUTUC, AICCTU, UTUC, SEWA, LPF and all Federations of Banks, Railways (NFIR & AIRF), Defence (INDWF & AIDEF), Insurance, Central/State Govt. and other Service Establishments Employees).
Demands

1. Central Govt. should desist from its unilateral move to amend Labour Laws and consult and honour the views of Central Trade Unions.

2. Central Govt. should withdraw the retrograde move in allowing/hiking Foreign Direct Investment (F.D.I.) in Defence Sector, Railways, Insurance, PSUs and other Sectors.

3. Restore minimum wages of Rs.15,000/- to all the Unorganised/Contract Workers and Minimum Wages of Rs.26,000/- to the lower paid employees of Central Government.

4. Demands of Bank Officers and Bank Employees should be immediately accepted in respect of their Wage Revision and other privileges and social security measures, which are over due (Go through the Circulars dated 14/10/2014 & 16/10/2014 issued by the UFBU, AIBOBOA, INBOC, INBEC and INBEF etc.)

5. Strict implementation of existing Labour Laws concerning the Welfare of the Working Class all over India.

6.Benefits of Regular Workers should be given to all Contract Workers.

7. Compulsory Registration of Trade Unions within 45 days and all the ILO Conventions meant for the Workers should be ratified by the Govt. Of India.

8. 50% D.A. of Central Staff should be merged with Pay and Interim Relief should be paid to all employees, pending finalisation of the 7th Central Pay Commission.

9. Minimum 4 Promotions should be given to all Central Govt. Officials, without the hindrances of Departmental Examinations and DPC proceedings, on or before their respective date of retirements.
10. MACP/ACP benefits should be extended to all Central Government Employees, including the staff of Autonomous Body/Semi-Govt. Departments.

11. Bonus eligibility and Bonus Ceiling should be raised as per the present Price Index Cost of Living and Updated Model of Pay Structure.

12. Present quantum of Pension should be raised with adequate Medical facilities/Medical Allowance and the New Pension Scheme should be liberalised as Worker-Friendly.

Accordingly, all the Unions, Associations and their Federations are requested to observe “NATIONAL PROTEST DAY” on 5th December, 2014 by way of Mass Demonstrations and Mass Protest Meetiungs & Rallies all over India and give wide publicity through Newspapers, T.V. Channels and AIR/Doordarshan etc. Concerned Office-bearers are requested to send a report after observing the above programme of action to the undersigned on or before 15/12/2014.

Respected Hon’ble Prime Minister,

At the outset, we extend Good wishes to the Government. We are happy the 7th Central Pay Commission team came to Bangalore, and gave us an audience on August 24 to present our views on different subjects. Around 20 organisations representing different sections of serving employees and pensioners met the Commission, in groups. The interaction was very good. The Chairman and the members heard us all very well and gave convincing answers.

2. One subject of immediate interest is the Grant of Interim Relief. We stated that the very constitution of the Commission was as a sequel to the proposal of the Planning Commission about two/three years back. This meant that the Commission gives out its Recommendations within 2016, and thereupon the Govt could take its Decisions before 2016. This also meant particularly that the Government would not face a situation, as it did after the 6th CPC, wherein it had to pay out large sums to the serving staff and pensioners, which it did in two instalments, in 2008-09.

In this very background, to reduce payment of large sums in 2016, the concept of Interim Relief has been in place. A similar Pay Commission has recommended it in the past, and the Govt has accepted such a recommendation, in the interest of the serving and retired staff. The State Governments have sanctioned the Interim Relief along with the constitution of the Pay Commissions. If it could be stated, by 2016, when the Commission Recommendations come into force, some of the aged members may not be there. The Grant will also help the staff/pensioners face the rising food prices to some extent and the erosion in monetary value. The Interim Relief is thus justified.

3.When this position was projected to the Commission at Bangalore, on August 24, theChairman gave us all an Impression that the Commission was in favour of the Interim Relief; but the Government should give them a specific reference on the subject. He added that the Commission would consider the reference in a month or two, and give out its Recommendation on Interim Relief. The Quantum of Interim Relief and the Date of effect are to be decided.

It should be admitted that this IR would not be calculated for the purpose of DR/DA/HRA/CCA or any such Allowance; and the amount paid thus would be adjustable in the payments that would befall in 2016, about 18 months hence. This Grant of Interim Relief would be Dasara/Deepavali Gift.

4. We. therefore, very sincerely Request the Government to make a very specific reference soon to the 7th CPC to consider the Grant of Interim Relief.

Is Interim Relief Likely for Central Government Employees?
 
Is it really possible for Central Government employees to get an interim relief this time? Let us look at it in detail.

‘Interim Relief’ may be defined as the temporary relief given to employees before the new Pay Commission’s recommendations are implemented. ‘Interim relief will be treated sui generis’, most of the Finance Ministry orders included the sentence when sanctioning interim relief.

If one looks at the interim relief granted in 1983 and 1993, it can also be inferred that interim relief is granted in order to correct the errors in salary revision once every ten years. One gets the feeling as if an entire Pay Commission was lost simply for the sake of a small hike.

During the previous Pay Commission, particularly in 5th CPC, since 50% DA Merger was granted, there was no interim relief.

Here are some of the reasons why interim relief is normally granted :
* It has been granted a number of times before, in the past.
* DA Merger hasn’t been sanctioned this time
* Prices have touched the skies
* Some errors in the formulation of once-in-a-decade Pay Commission…etc.,
Reasons cited for the Government’s refusal to sanction DA Merger/interim relief:
* 7th Pay Commission was constituted at the justify time.
* There was no recommendation for DA Merger in the 6th Pay Commission
* There was a recommendation against DA merger in the 6th Pay Commission (the Commission is, therefore, not recommending merger of dearness allowance with basic pay at any stage).
* In the event that the Price Index is taken as 115.76 instead of 306.33 for the DA calculations.
All the Central Government Employees Unions and Federations are functioning with the intention of getting the DA merged with the basic pay. If that doesn’t happen, these federations are hoping that interim relief will be offered through the 7th Pay Commission’s interim report.

This is very much possible if Modi Government is willing to accept the demand.

Demands for DA Merger & Interim Relief strengthen Once again…NC JCM Staff Side emergency meeting on October 12

National Council JCM Staff Side meeting will be held on 12th October 2014 to discuss and finalise future course of action on major demands of DA Merger, Interim Relief and Date of effect of 7th CPC.

The responsibility of Trade Unions and Federations is to ensure that the demands and anticipation of the employees are fulfilled. Demands for DA Merger are being raised for more than 3 years now, ever since Dearness Allowance crossed 50% (01.01.2011).

Previously, when Dearness Allowance crossed 50%, on April 1, 2004 it was added to the basic pay, during the Fifth Pay Commission.

All over the country, employees are demanding that DA be added to the basic pay once again in 6th CPC which is crossed 50%. Sensing this, all the Central Government Employees Federations and Unions began negotiating with the Government in various levels. When the Centre refused, a number of protests were held across the nation. Confederation successfully conducted a 2-day long total strike including for this demand.

Despite the fact that the demand occupied prominent position in a number of protests, there was an expectation that decision in this regard would be made during the final cabinet meeting of the previous government, which was held on February 28, 2014. Most of the Employees Federations had withdrawn their protests, trusting the assurance of the then government. But when no such announcement was made, there was an immense sense of disappointment.

Then there were expectations that the new government at the Centre would fulfil this demand. There are no signs of the important demands being granted.

In order to draw the attention of the Government to their demands, the National Council JCM (Staff Side) is going to meet on 12.10.2014. The meeting assumes prominence because all the National Council JCM Staff Side members are going to participate in it. Merger of Dearness Allowance, Payment of Interim Relief, and Declaration of 01.01.2014 as the date of effect of the recommendations of the 7th CPC are the important demands of the meeting. Plan of action will also be drawn on how to make the Centre accept these demands.

NO DIFFERENCE BETWEEN NDA AND UPA GOVERNMENT LET US PREPARE FOR A MAJOR INDUSTRIAL ACTION

Dear Comrades,
Confederation National Secretariat met at New Delhi on 26.09.2014, under the Presidentship of Com. K. K. N. Kutty, National President. Com. S. K. Vyas Ji, Advisor was also present. After detailed deliberations on all agenda items, the following decisions are taken.

1. Decided to further intensify the campaign and agitational programmes against the Governments attitude towards the legitimate demands of the Central Government Employees. It is decided to organize two hours MASS SQUATING of not less than 3000 Central Government employees on 18th November 2014, at a centrally located important place at all the state capitals. Effort should be made to ensure maximum participation of Lady comrades in the programme. Next phase of action will be decided after successful implementation of the above programme.

2. Decided to explore the possibility of joint action with Railways (AIRF) and Defence (AIDEF) culminating in strike.

3. Decided to participate and implement all the decisions taken in the National convention of workers organised by Central Trade Unions on 15.09.2014.

4. Decided to organize Two days All India Trade Union workshop of Confederation at Bangalore on 2015 January 3rd and 4th. Total number of delegates will be limited to 200. COC Karnataka has agreed to host the Trade Union workshop.

5. Decided to grant affiliation to the following two organizations.
(1) Forest Survey of India Employees Association
(2) Nehru Yuvak Kendra Sanghathan (NYKS) workers Welfare Association.

6. Decided to organize Dharna in front of all Government of India Presses and Stationery offices and also in front of Government Medical stores Depot to protest against the proposed move to close down these offices. In front of Government of India Presses Dharna will be organised by Confederation on 27th October 2014 and in front of Government Medical Stores Depot dharna will be organised on 30th October 2014.

7. Financial position of the Confederation was presented by Financial Secretary Com. Vrigu Bhattacharjee. CHQ is running with a ‘NIL’ balance. Unless and until all the affiliated Unions/Associations voluntarily clear all pending dues it will be very difficult to run the CHQ. It is decided that Financial Secretary shall issue notice to all affiliated organizations to clear the pending dues.

8. National Secretariat calls upon all Central Government employees and also the affiliated organisatons and state COCs to make the 18th October programme a thundering success.

Central Government Employees Launch Countrywide Stir Demanding 7th Pay Commission Interim Relief

The Central Government employees are going to launch nationwide protests, stressing that their 11-point demands, including interim relief for the 7th Pay Commission, be granted.

Duraipandian, the General Secretary of Central Government Employees Federation, said, whenever the Pay Commission is constituted, interim reliefs are announced. But this time, when the 7th Pay Commission was announced, we weren’t given interim relief.

We want the new pension scheme to be revoked and old pension scheme to be reinstated. Outsourcing of Central Government jobs to private firms must stop. And, we want the more than 6 lakh vacancies in various central government agencies, like the Railways, Income Tax Departments, to be filled up.

We are going to launch nationwide Dharna protests (except Jammu and Kashmir), demanding that these 11 conditions be fulfilled.

Dear Sir,
The Confederation of Central Government employees and workers is the apex level organisation of all Federation/Association/Unions of CGEs other than in the Railways and Defence Departments. It was in the wake of a strike action in 1960s by the Central Govt. Employees, the Govt. of India set up permanent negotiating machinery called JCM so that the employees will be able to raise their demands and grievances and seek settlement thereof through dialogue. This machinery has now come to a standstill as the Govt.does not convene the meetings of the councils at the National and Departmental levels on one pretext or the other. A new set of rules for grant of recognition of service associations were promulgated in 1993. Many Ministries, despite the employees organizations abiding by the stipulated conditions, have not afforded recognition to the Associations/Federations, thereby closing all channels of communication. The JCM had the facility of referring the issues on which the Government could not agree upon to the Board of Arbitration. The decision/award of the Board was binding on all parties. Still the Government had been rejecting the awards in favour of the employees on the specious plea of adverse impact on national economy by presenting resolutions in the Parliament. We need not emphasise the unethical character of this approach which undermines the confidence of the employees in the fairness of the system.

The 6th CPC recommendations and its implementation had given rise to various anomalies. The employees genuinely felt that the said anomalies would be removed through discussions for which the Government had set up a committee. The Committee despite meeting on four occasions had not been able to settle the issues; nor could it be referred to the Arbitrator. No decision has been taken by the Government so far as to the fate of these anomalies.

The Government set up the 7th CPC in September last. Its notification was issued early this year. Despite assurance being held out, the terms of reference was not subjected to discussion with the staff side with the result the demand of the employees to include the Gramin Dak Sewaks within the ambit of the Commission was not acceded to. The 6th CPC recommendations were implemented with effect from 1.1.2006. The revision of wages was due on 1.1.2011 having completed five years. Wage revision is permitted in the Public Sector undertaking every five years. The value of wages fixed in 2006 has been eroded significantly during the period due to the high rate of inflation and price rise.

The new contributory pension scheme was introduced by the Government on the plea that the pension liability has become unbearable and is a drag on the exchequer. In our Memorandum to the then Prime Minister, we had raised several issues and had pointed out that the financial outflow on account of the new scheme will be much more than the existing defined benefit scheme. We had indicated in our memorandum quite a number of aspects which would be detrimental to the interest of workers. The Government has decide allow FDI in pension fund operations. This will only result in the flow of Indian Savings for investment outside the country.

We submit herewith the charter of demands which requires settlement urgently. We have also appended a Note on each of the issues included in the charter of demands, which is self explanatory. We shall be grateful if these issues are caused to be considered by the concerned departments of the Government of India and brought before the negotiating forum for settlement.

CONFEDERATION DECLARES NATIONWIDE AGITATIONAL PROGRAMMES

Dear Comrades,

The National Sectt. of the Confederaton met at New Delhi on 11.08.2014 to consider the follow up action required in the matter of some of the pressing issues on which Confederation had organized series of agitational programmes prior to the commencement of the Election process of the 16th Lok Sabha. The CHQ has received reports from various affiliaties to the effect that they have all endorsed the common memorandum, the Confederation had submitted to the 7th CPC. Most of the affiliates have emailed copies of the respective memorandum to the CHQ. Those who have not sent copies are requested to do so without further loss of time. This will enable the Confederation to write to the 7th CPC to provide an opportunity to these organisations to tender oral evidence to explain and elucidate their submissions in the memorandum.

The meeting noted that there has been only negative response from the Government on the issues of Interim Relief and merger of DA.

We have already sent to you a copy of our letter addressed to the Seretary, Staff Side, JCM National Council, (Com. Shivgopal Mishra) which is yet to be responded. The meeting considered the following issues as important, the pursuance of which must not brook any delay, especially in the background that the 7th CPC has formally written to the Government asking it to indicate the course of action required to be taken on the memorandum of the staff side on Interim Relief and marger of DA.

CHARTER OF DEMANDS
1. Merger of DA with pay for all employees with effect from 01.01.2014 including Gramin Dak sewaks and pensioners.

2. Grant of Interim Relief to all employees including Gramin Dak Sewaks and Pensioners.

3. Inclusion of Gramind Dak sevaks under the purview of 7th Central pay Commission.

4. Scrap PFRDA Act and grant of statutory pension to all.

5. Date of effect of 7th CPC recommendations should be 01.01.2014.

6. Regularisation and revision of wages of casual laboures and contract workers.

7. Removal of 5% condition for compassionate appointments.

8. Fill up al vacant posts and creation of new posts wherever justified.

9. Stop downsizing, outsourcing, contractorisation and privatisation of Government functions.

10. Grant Productivity linked Bonus to all without ceiling; compute Bonus as weighted average of PLB for those not covered by PLB agreement.

11. Revise OTA and NDA and implement arbitration awards.

The meeting also considered the policy perception of the new Government in the light of the administrative price hike in petroleum products, the proposals in the Railway and General Budget, the steep hike in the freight and passenger fares of Railways, the decision to hike FDI in Defence Production, Railway Infrastructure and Insurance sectors, disinvestment of public sector including nationalized banks and have come to the inescapable conclusion that under Narendra Modi dispensation, the neo-liberal policies, as expected, will only be intensified and the promised “Achche Din” is for the Corporate giants of the country. The last session of the Parliament witnessed the determination of the NDA Government in changing the labour laws on the lines of the enactment made by Rajasthan Government of Vasundhara Raje Scindhia by virtue of which in almost 90% of the manufacturing units in India, the employers are permitted to indulge in hire and fire policy, for the existing regulations will be dispensed with.

The meeting came to the decision that the confederation must organise serious and prolonged campaign, preferably in unison with the Railway and Defence Federations. We will pursue our consultation with those Federations to reach a common approach in the matter. Since it might take some more time, the meeting decided to pursue the demands through a demonstrative programme.

11th September 2014 – Submission of the Charter of Demands along with a brief Note to all heads of offices by arranging demonstration in front of all offices; the branch level/district/divisional/state level leaders will explain the demands especially the memorandums on interim relief, DA merger and GDS issues.

19th September 2014 – Dharna between 10 AM to 3 PM at all important state/districts/divisional centres.

25th September 2014 – Dharna between 10 AM to 3 PM at New Delhi with participation of the leaders of all affiliates and the members working in the city of Delhi (at a central place-to be decided by the Confederation Delhi State committee).

Confederation office Bearers will meet again at Delhi on 26.09.2014, 5 PM to decide further course of action. Confederation will bring out pamphlets and bulletins to explain various issues like minimum wage, DA, Bonus, GDS problems etc. shortly as part of an education campaign. The detailed campaign programe to be undertaken after Diwali festival will be intimated later.

Government of India totally failed to take effective measures to arrest the spiraling price rise and contained inflation. Dearness allowance which is paid to neutralize the inflation is not sufficient and employees are facing hardship.

Their is delay to announce the recommendation of 7th CPC.
BRMS demand that Government should announce atleast Rs. 7000.00 as interim relief to meetout the arrogant expenses due to inflation.
Merger of 50%DA allowances into Basic Pay.
5th CPC has recommended that whenever the dear allowances exceeds 50% , it should be merged in the basic pay. While 6th CPC had also observed that a portion (25%) of DA should be merged whenever it exceeds of 50% for certain part of the pay packet.


BRMS has been demanding that it should be automatic as and when dearness allowance crosses 50% mark and it should be merged with the basic pay as there is no pay revision after 4 or 5 years as in the case of public sector/financial sector employees. It is stated that NDA Government had already merged the 50% DA of serving and retired employees for all purposes when it cross 50%.

In Parliament Minister of State for Finance Shrimati.Nirmala Sitharaman said in a written reply to a question on 5th August 2014 regarding grant of interim relief to Central Government employees.

She said that there is no proposal for grant of Interim Relief to Central Government employees is at present under consideration of the Government.

She also added, the 7th Central Pay Commission has already been set up vide Resolution dated 28th February, 2014. The Commission has started functioning.

The National Secretariat of the Confederation of Central Government employees and workers places on record its appreciation over the efforts of the Staff Side, JCM, National Council in preparing and submitting the memorandum to the 7th Central Pay Commission, which has received the widest acceptance and admiration of the Central Government employees. Since the last date for submitting the Department-specific memorandum has been got extended by your efforts uptill 31st July, 2014, the first phase of our endeavour and interaction with the 7th CPC will come to a conclusion in a few days’ time.

I have been directed by the National Secretariat of the Confederation which met on 17th July, 2014 to solicit your kind reference to the memorandum submitted by the Staff Side on behalf of all Federations, Unions, Associations on Interim Relief and merger of Dearness allowance. In its foreword of the 7th CPC Memorandum prepared by the National Council JCM Staff Side, the National Council has said that the Centre has made a discretionary decision regarding the 7th CPC Terms of Reference. The writeup also adds that the Centre did not consult with them prior to formulating the Terms of Reference for the 7th Pay Commission.

The Prime Minister has given his approval to the composition of the 7th CPC on 4th February 2014 and the Union Cabinet gave its approval to the 7th CPC Terms of Reference on 28.02.2014.

On 01.01.2011, when the Dearness Allowance touched 50%, the Central Government employees started to strengthen their demand to add it to the Basic Pay. Some of them demanded setting up of the 7th CPC on the plea that the residency period of any wage structure must not exceed 5 years, especially in the background that the pay revision in most of the PSUs takes place at the interval of 5 years. The Government turned a deaf ear to them.

After implementation of pay band and grade pay, there was plethora of anomalies, common as well as department specific. None of these anomalies were removed despite several rounds of discussions. And Government refused to discuss these demands either bilaterally or at the forum of JCM

The Confederation of Central Government Employees successfully conducted a 2-day protest. Defence and Railway employees too were ready to join the protests. Just when it looked as if confrontation was imminent, in September 2013, the Centre announced the formation of the 7th Pay Commission. The protests were dropped when the Government accepted their demands.

While formulating the Terms of Reference, there was a general expectation that the Government would consider the 6-point demand that was debated upon at the Standing Council NC JCM meeting that was held on 24.10.2013.

6-point demands are…

The Commission should have a labour representative.

DA (as on 1.1.2014) to be merged and treated as pay for all purposes. 
To include Gramin Dak Sewaks within the ambit of 7th CPC.

To grant Interim Relief @ 25% of Pay + GP.

To ensure that the 7th CPC recommendation will be effective from 1.1.2014.

To ensure parity in pension for all pensioners as per the 5th CPC recommendation.

They were also hoping that another meeting would be held before the final Terms of Reference were decided. But the Government made a discretionary decision regarding and 7th CPC Terms of Reference. None of the important demands presented by the association made the final list.

In its Memorandum to the 7th Pay Commission, the National Council has presented the twin issues, i.e. the need to grant interim relief and merger of Dearness Allowance.

The 98-page long report to the 7th Pay Commission prepared by the members of National Council JCM Staff Side, incorporating all the suggestions and demands presented by all the representative of employees involved. The National Council also hopes that all Central Government employees, Associations/ Federations/Unions would accept and support the demands raised by them in the memorandum.

The Memorandum consists of expectations and requirements of common for all the Central Government employees. No doubt they will submit separate memorandum on department specific issues.

The 7th Pay Commission is bound to take note of this report and its recommendations.

I take this opportunity to bring to your kind notice that, while Government of India have appointed 7th Central Pay Commission for the Central Government Employees to make recommendations in regard to revision of wages and other allowances, merger of Dearness Allowance with Pay and payment of Interim Relief have neither been considered by the government itself nor included in the Terms of Reference(ToR)
of the VII CPC.
 
It may be recalled that the two issues, viz. Merger of Dearness Allowance with Pay and Interim Relief have been the subject matter with the government at the time when the Staff Side was called upon to present their views while finalizing the ToR of the VII CPC by the Secretary(PersonneI, DoP&T), in his capacity as Chairman, Standing Committee, National CounciI(JCM). Although, the Staff Side pleaded for the specific reference of the above two issues to the VII CPC, the final version of the ToR, as approved by the government, did not find place for our views.
 
It would not be out of context to mention here that the methodology adopted for compensating the erosion in the real value of wage on account of price hike refiected in the rate of Dearness Allowance paid to Government Employees. The merger of DA to partially compensate the erosion in the real wages was done in pursuance of the report of Gadgil Committee in the post 2“ Pay Commission. This has, thereafter, been continued in the successive Central Pay Commissions also, wherein up to 50% of DA has been merged with the Pay when Dearness compensation exceeded 50%.
 
Dearness compensation has already reached 100% as on 01.01.2014, and it is further likely to exceed w.e.f. 01.07.2014, therefore, it would be grossly justified that, at least 50% DA be merged with Pay to compensate the erosion of the real value of the wages immediately.
 
The 7th CPC, appointed by the Government of India, has though started its functioning, nevertheless its report is expected to be available not earlier than 1 and 1/2 years time and because of uncontrolled skyrocketing price hike of essential commodities in the market, the real value of the wages is eroding the greatest extent, which is in no way being compensated even by sanction of Dearness Allowance/Dearness Relief.
 
It would, therefore, be imperative that, at least 25% of the Basic Pay of Central Government Employees, but not less than Rs.2000 should be sanctioned as “lnterim Relief” with immediate effect to compensate the sharp erosion in the real value of the wages.
 
We request your early intervention in the matter so as to provide necessary relief to the Central Government Employees.

On the invitation of the Seventh Central Pay Commission for having Preliminary Interaction with All India Railwaymen’s Federation(AIRF), a delegation of the AIRF, comprising of Com. Shiva Gopal Mishra, General Secretary AIRF, Com. Rakhal Das Gupta, Working President AIRF, Com. Ch. Sankara Rao, Asstt. General Secretary AIRF and Com. J.R. Bhosale, Treasurer AIRF, met today, i.e. 28th May, 2014, the Seventh Central Pay Commission(Hon’ble Justice Shri Ashok Kumar Mathur, Chairman, Shri Vivek Rae, Member, Dr. Rathin Roy, Member and Ms Meena Agarwal, Secretary, Seventh Central Pay Commission) in Hotel Janpath(Camp Office of the VII CPC), New Delhi.
 
The following points were raised by the AIRF before the VII CPC:-  

(i) Extension and improvement in Railway Services 
(ii) Safety & Training 
(iii) Wages, Dearness Allowance and Other Allowances 
(iv) Living Wage 
(v) Interim Relief 
(vi) Merger of Dearness Allowance 
 
 
It was asserted by the AIRF that the Railwaymen are Industrial Workers and are governed by the Industrial Disputes Act, Factories Act and Hours of Employment Regulations etc.
 
It was stressed by the AIRF that, out of 7,000 railway stations, over 6,000 are road side stations where staff are bereft of all civic facilities like housing, electricity, drinking water, sanitation, medical facilities etc., and the education of their children suffers.
 
Indian Railways run 19,000 trains daily and additional train services are being introduced without developing
infrastructure and adding manpower, rather manpower is being reduced day-by-day. In spite of all impediments, there has been tremendous improvement in carrying goods traffic and passenger services.
AIRF further stressed that, the Railwaymen are working round-the-clock in all weathers and arduous conditions, even sacrificing their lives to keep the lifeline of the nation(Indian Railways) in operation. On the one hand it used to be said that we(the Railwaymen), are the second line of defence, on the other, when the issue of Wage Structure and Allowances comes, the Railwaymen always get raw-deal, saying, they are “Common Categories”. Quoting examples of the Running Staff, Technician, Technical Supervisor, Operating & Commercial Staff, AIRF asked, where we are common? The VII CPC agreed that they would definitely look into these aspects while deciding wages and allowances of the Railwaymen.
 
It was impressed upon to the Seventh Central Pay Commission that AIRF would lead broad categories/ departments’ representation to VII CPC during oral evidence.
 
It was also stressed that the Seventh Central Pay Commission should consider the matter of granting Interim Relief as well as merger of Dearness Allowance with the Pay.
 
The Members of the Pay Commission, mainly the Chairman himself, interacted with AIRF’s representatives. The Pay Commission gave patient hearing and assured that they could understand the complexity and gravity of the Railway Industry, devotion and dutifulness of the Railwaymen and would try to administer justice to the Railwaymen by way of their recommendations.
 
Thereafter, representatives of the Staff Side, National Council (JCM), lead by Com. Shiva Gopal Mishra, Secretary, Staff Side, National Council(JCM), along with Com. Rakhal Das Gupta, Com. Ch. Sankara Rao and Com. J.R. Bhosale, Members, Standing Committee, NC/JCM/AIRF, held discussions with the VII CPC.
 
The issues of Fixation of Wages, allowances and the matters of Anomalies of VI CPC, Scrapping of New Pension Scheme, Promotional Policy, General Grade Structure along with the demands of Interim Relief and Merger of Dearness Allowance with the Pay were raised by the Staff Side, NC/JCM. Apart from AIRF representatives, in the delegation, Coms. M. Raghavaiah, Guman Singh, S.N. Pathak, S.K. Vyas, Sri Kumar, K.K.N. Kutty and B.C. Sharma were also present on the occasion.
 
The Chairman, VII CPC, on persistent demand of the Staff Side, NC/JCM, suggested that the Staff Side can submit separate Memorandum on Interim Relief and Merger of Dearness Allowance, so that VII CPC can seek necessary advice from the Government, as to how to deal with these issues since there has been no specific reference in the matter from the Government to VII CPC on these subjects.
 
It was decided that detailed memorandum on behalf of Staff Side, National Council(JCM) should be submitted by 30th June 2014, and all the departments, like Railways and others should submit their memorandum by 15th July, 2014.

NMC stresses on 20% Interim Relief for State and Central Government Employees – News Report

The National Mazdoor Conference has urged the Chairman of the newly formed 7th Pay Commission recommend that 20% interim relief be given to all Central and State Government employees.

As per Newspapers report that the National Mazdoor Conference has also strongly demanded that these recommendations be submitted to the new government that is likely to form at the Centre.

The NMC President, Subhash Shastri said in a letter to 7th Pay Commission that along with the State and Central Government employees, the interim relief of 20% of basic pay be also extended to pensioners too and that these demands be recommended as soon as the Election Commission’s restrictions (Model Code of conduct Rules) end.

Shastri emphasised that whenever the recommendation of the commission are submitted to the Central government, the Commission should extend these recommendations to the state governments in general and Jammu and Kashmir in particular.

In addition to these, the National Mazdoor Conference has also demanded on its previous demands for raising the retirement age to 62 and of 50% DA merger.

Last week, the Confederation had released its draft reply to the 7th Central Pay Commission questionnaire. The Secretary General said that a final decision in this regard will be made at the Staff Side National Council Meeting.

Leading federations are going to proclaim their replies in the near future. Employees all over the country are eagerly waiting to see these, especially the opinions and queries of federations like AIRF, and NFIR.
Meanwhile, the 7th Pay Commission has sent a circular to all the federations to submit their replies as memorandum on or before June 30. The Commission has sought the cooperation of all the federations since it has to submit a complete report to the Government within 18 months.

The Federations have advised their affiliate unions to hurry with their opinions, demands and their views on the implementation of 7th CPC. Attention is now being channelized to draft suggestions and demands that include all thoughts and views.

The 7th Pay Commission too is particular about gathering opinion and feedback from all Ministers/Departments and the general public for drafting its recommendations.
