Compulsory Retirement – Cracking down on Central Government Employees

Since the exercise is believed to have been kicked off at the instance of the Prime Minister’s Office, chances are that several more employees may be shown the door.

Compulsory Retirement – Cracking down on CG Employees – While there was always a rule to compulsorily retire bureaucrats, the rule applies to only those who are at least 50 years old.

CG employees may get 3-4 times the salaries of their private sector counterparts, especially at the lower-to-medium levels, but the security of tenure that they enjoyed is now under threat because of the compulsory retirement threat.

A study for the 7th Pay Commission found a fresh government nurse earned 3.4 times her private sector counterpart, a teacher 2.7 times and a driver 2.3 times. While there was always a rule to compulsorily retire bureaucrats, the rule applies to only those who are at least 50 years old – on grounds of either corruption or inefficiency, this has rarely been used.

According to The Economic Times that reported the use of an obscure Rule 56(j) to sack 15 customs and central excise officials —including two at the level of commissioners—this was last invoked three decades ago. Indeed, a few months before it demitted office in 2014, the UPA government reiterated the rule, but it did precious little about it. The NDA reissued the order last September, but made its intentions clear since, while doing so, the order excerpted various Supreme Court judgments on this – in other words, CG employees were warned that the highest court in the land had ruled in favour of this in the past.

In the case of State of Gujarat vs Umedbhai M Patel, the SC had ruled that “whenever the services of a public servant are no longer useful to the general administration, the officer can be compulsorily retired for the sake of public interest”. It then went on to say, according to the DoPT circular, “For better administration, it is necessary to chop off dead wood, but the order of compulsory retirement can be passed after having due regard to the entire service record of the officer.”

Since the exercise is believed to have been kicked off at the instance of the Prime Minister’s Office, chances are that several more employees may be shown the door.

However, there are enough checks since there will be review panels before the compulsory retirement and then there is the process of appeal to the tribunal as well as to the courts.

2. Govt of India, MoD vide letter No. 8(14)/2015 dated 04 Mar 2016 has extended Canteen facilities to family pensioners of retired Defence Civilian employees. The procedure for processing of application will be as per this Dte letter No. 96301/Q/DDGCS/Policy dated 12 Aug 2015. The applicant must write Family Pensioner of retired defence civilian on the application form.

Subject: Declaration of Assets and Liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013 —filing of Returns by public servants on or before 15th April, 2016 – regarding

The undersigned is directed to invite attention to the provisions of section 44 of Lokpal and Lokayuktas Act, 2013 whereby every public servant i.e. all categories of public servants as defined under section 2 (0) read with section 14 (1) (a) to (h) of Lokpal and Lokayuktas Act, 2013, shall make a declaration of his assets and liabilities. The timelines for filing the declarations/information/annual returns under the said Act are as under:
i. The first return of assets and liabilities as on 1st August, 2014 under the Lokpal and Lokayuktas Act, 2013 – on or before 15th April, 2016

ii. The annual return of assets and liabilities as on 31st March, 2015 under the Lokpal and Lokayuktas Act, 2013 – on or before the 15th April, 2016.

iii. The annual return of assets and liabilities as on 31st March, 2016 under the Lokpal and Lokayuktas Act, 2013 – on or before 31st July, 2016.

iv. The annual return of assets and liabilities for subsequent years as on 31st March every year should be filed on or before 31st July of that year.
The aforesaid timelines have already been intimated vide this Department’s OM No. 407/12/2014-AVD-IV(B) dated 28.03.2016 ,

2. All Ministries/Departments are requested to ensure compliance of the aforementioned provisions of the Lokpal and Lokayuktas Act, 2013 and in this regard inform and sensitize the societies/Association of persons/trusts under their administrative/financial control about the requirement of the law and deadlines for filing of necessary declarations/returns. To facilitate smooth compliance & information/provisions of section 44 of the Lokpal & Lokayuktas Act, 2013, this department has already placed in the public domain all the relevant rules framed under the said Act, forms in which declarations are required to be made, FAQs etc..

3. This may please be accorded due priority keeping in view that the declarations & returns for the years 2014 & 2015 are required to be filed by all public servants by 15.04.2016 mandatorily.

This is regarding proposals on the subject of Maternity Leave and CCL that are under consideration in this Department. In this connection, a workshop was held in DoPT on 28.01.2016 with the stakeholder Departments on the following issues and the consensus emerged as follows:

(a) Maternity/CCL in case of surrogacy: There is no provision at present for any kind of Leave for surrogate/commissioning mothers. It is proposed that 180 days maternity leave may be granted to the surrogate as well as commissioning mothers, in case either/both of them are Government servants. The commissioning mother also requires time for bonding with her child and to take care of him/her and hence would also become eligible for Child Care Leave. Paternity Leave may also be granted in case of surrogacy.

(b) Age Limit for CCL in case of disabled children: It is proposed that the age limit for CCL in case of disabled children needs to be done away with since the requirement of parental care may be more/stronger when the disabled child grows older. It may therefore be allowed to provide for CCL in the case of disabled children — the ‘disability’ being clearly defined by the Ministry of Social Justice & Empowerment – without any age limit provided the maximum CCL that can be availed remains within the ceiling of 730 days.

(c) Leaving HQ/availing LTC while on CCL: At present leaving headquarters or availing LTC are not permissible during CCL. The underlying intent of CCL is to allow care of up to two children whether for rearing or to look after any of their needs like examination, sickness etc. Thus, it is not restricted to exam and sickness alone. Taking care may also include ensuring their rest and recreation and towards that objective leaving headquarters or availing LTC can be allowed. It is thus proposed that the employees may be permitted to leave headquarters/avail LTC while they are on CCL, provided clearances from appropriate competent authorities are taken while proceeding on foreign travel.

(d) CCL minimum for at least five days: Vide this Department O.M. No.13018/6/2013-Estt.(L) dated  5th June, 2014 the stipulation of the requirement of minimum period of 15 days’ CCL has been removed. It is now proposed to introduce a minimum period of five days of CCL i.e., CCL henceforth may not be granted for less than 5 days.

The Government of India have announced the Sale (re-issue) of (i) “7.68 per cent Government Stock 2023” for a notified amount of Rs. 3,000 crore (nominal) through price based auction, (ii) “7.59 per cent Government Stock 2026” for a notified amount of Rs. 8,000 crore (nominal) through price based auction, (iii) “7.73 per cent Government Stock 2034” for a notified amount of Rs. 2,000 crore (nominal) through price based auction, and (iv) “8.13 per cent Government Stock 2045” for a notified amount of Rs. 2,000 crore (nominal) through price based auction. The auctions will be conducted using multiple price method. The auctions will be conducted by the Reserve Bank of India, Mumbai Office, Fort, Mumbai on April 07, 2016 (Thursday).

Up to 5% of the notified amount of the sale of the stocks will be allotted to eligible individuals and Institutions as per the Scheme for Non-Competitive Bidding Facility in the Auction of Government Securities.
Both competitive and non-competitive bids for the auction should be submitted in electronic format on the Reserve Bank of India Core Banking Solution (E-Kuber) system on April 07, 2016. The non-competitive bids should be submitted between 10.30 a.m. and 11.30 a.m. and the competitive bids should be submitted between 10.30 a.m. and 12.00 noon.

The result of the auctions will be announced on April 07, 2016 and payment by successful bidders will be April 11, 2016 (Monday).

The Stocks will be eligible for “When Issued” trading in accordance with the guidelines on ‘When Issued transactions in Central Government Securities’ issued by the Reserve Bank of India vide circular No. RBI/2006-07/178 dated November 16, 2006 as amended from time to time.

Release of E-filing of Income Tax Returns (ITR) and other forms

In pursuance of the Notification of the Income Tax Returns (ITR) for AY 2016-17 on March 31st, 2016, Central Board of Direct Taxes (CBDT) announces the release of electronic filing of ITRs 1 and 4S on its website https://incometaxindiaefiling.gov.in. Other ITRs will be e-enabled shortly.

Online filing of Appeal before Commissioner (Appeal) using newly notified Form 35 has been enabled for taxpayers mandated to E-file their returns using Digital Signature Certificate. Electronic Verification Code (EVC) option will be available shortly for other category of taxpayers. Reference may be made to Notification 11/2016 dated March 1, 2016 for the various categories of taxpayers required to file appeal online.

In pursuance of Notification No 93/2016 dated 16th Dec 2015, effective from 1April 2016, the following forms have been substituted by new forms and are now available for E-filing:
  1. Form 15CA -payments to a non-resident not being a company, or to a foreign company,
  2. Form 15CB-Certificate of an accountant,
  3. Form 15CC -Quarterly statement
Vide Notification No 3/2016 dated 14th Jan 2016, CBDT had substituted with effect from 1 April 2016, Forms 9A (Application for exercise of option under clause (2) of the Explanation to sub-section
(1) of section 11 of the Income tax Act, 1961) and Form 10 (Statement to be furnished to the Assessing Officer/Prescribed Authority under sub-section (2) of section 11 of the Income tax Act, 1961). These forms can be filed online using Digital Signature Certificate on the Income Tax Department’s e-filing website. EVC option will be available shortly.

2. CGHS is pleased to announce a new initiative by which its beneficiaries can now print their own cards at their convenience. This facility for self-printing is applicable for those beneficiaries whose CGHS membership has already been approved by the concerned Additional Director.

3. The steps involved in printing of the card are given below:

Click ‘Beneficiary Login’
Enter Ben ID and Password, and sign in.
In case the beneficiary does not have a password or has forgotten it, then click on ‘Generate Password’ and follow the instructions.
Click ‘Print Card’ for the beneficiary whose card needs to be printed.
Enter the One Time Password (OTP) sent on registered mobile.
Click ‘Print CGHS Card’
A message will appear on the screen requesting to take a coloured printout and get the card laminated. Click ‘OK’
Download or open the CGHS card in PDF format.
Print the CGHS card using Print command.
4. The introduction of this facility may kindly be given due publicity.
