In another new initiative “Anubhav”, inspired by the Prime Minister Shri Narendra Modi, the Ministry of Personnel, Public Grievances & Pensions has advised officers retiring within a period of six months to leave behind a note or write-up on their achievements as well as outstanding work done by them which could have, according to them, contributed to efficient functioning of the government or any innovation introduced by them which could have led to improvement in work culture.

Disclosing this here today, Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh said that “Anubhav” will serve as a platform for retiring employees to showcase achievements made by them during their service tenure. While the retiring employees can look back with satisfaction and a sense of fulfillment, the written account left by them could serve as a vital database for future improvement, he added.

Ministry of Personnel has, through a circular dated November 5, 2015, sought to reiterate and remind all the Ministries and Departments to follow up this initiative seriously. The Link to “Anubhav” Portal is available on the homepage of Department’s website at http://persmin.nic.in → DoP&T → Anubhav, he informed and added that initially this facility is available only to retiring Central Government employees including Central Secretariat Service (CSS) and Central Secretariat Stenographers Services (CSSS) officials.

Earlier, on the advice of Prime Minister, Dr. Jitendra Singh recalled that DoPT had also introduced a new practice of senior IAS officers who had put in nearly 25 to 30 years of service to revisit the place of their first posting as District Collectors or SDMs and furnish feedback about the change over the years as visualized by them. The DoPT and the Department of Administrative Reforms and Public Grievances (DAR&PG) are infact the Research & Development (R&D) organs of the government and not merely responsible for carrying out only transfers, promotions and empanelments. To this extent, he expressed satisfaction that during the last 17 months of the present government, a number of new reforms have been introduced with regard to recruitment in Services, Pension Department, IAS/Civil Services training and other areas.

Indian Railways: New Rail Refund Rules came into effect from 12.11.2015

Indian Railways today modified the refund system for train passengers. With accordance with the new refund rules, passengers will have to pay double for cancelling tickets.

As per the rule, the first AC or executive class has been increased from Rs 120 to Rs 240, for second AC or First Class the cancellation charge has been increased from Rs 100 to Rs 200 and for the Third AC/ ACC/3A economy goes up to Rs 180 from Rs 90.

Amendments in the certain provisions of Refund Rules – Comprehensive Refund Rules.

Amendments in the certain provisions of Refund Rules have been made and Comprehensive Refund Rule shall be notified through Gazette Notification.

This will come into effect from 12.11.2015

The changes in the refund rule wherever required should be carried out in manual ticketing system and in PRS, UTS, SPTMs etc.

Special arrangements should be made to ensure that necessary instructions and the revised refund rules reach the staff well in time. Steps should also be taken to ensure that the staff fully understand these changes in the refund rule and implement them properly.

Wide publicity should be given through media at regular intervals and the same may also be displayed prominently at all stations at booking/reservation counters. Action should also be taken to make changes in Passenger Information Systems at all places including Enquiry office etc.

In case of any disparity in English and Hindi version, the English version shall prevail.

KOLKATA: Reserve Bank’s employees have proposed one-day mass leave on November 19 to protest what they termed as the government’s intention to curb the apex bank’s activity and intervening into monetary policies.

The United Forum of Reserve Bank Officers and Employees, the umbrella organisation of four recognised unions of officers and workmen staff in RBI, has decided a day’s ‘Mass Leave’ on November 19 by around 17,000 workforce, AIRBEA General Secretary Samir Ghosh told PTI.

“With the proposed mechanism of Monetary Policy Committee (MPC), the government plans to intervene and themselves decide the monetary policy which has been the exclusive jurisdiction of RBI so far,” he said.
In the wake of the protest, settlement activity of the banking system of the country is likely to be disrupted on November 19.

“The cease-work programme is intended, inter alia, to strongly oppose Government of India’s current moves to cripple RBI in the name of the draft financial code and legislative reforms,” the United Forum release said.
“The Finance Ministry is reportedly giving final shape to shift Government’s debt management functions from RBI to the proposed Public Debt Management Agency (PDMA), which will also henceforth function as depository of government securities (G-Sec), thus taking away from RBI some vital operations having relevance to money market as well,” it added.

The union body will also press for their demand for improvement in pension.

Now, book train tickets 30 minutes prior to departure

In a significant move to provide additional booking facilities, Ministry of Railways has undertaken an exercise of rationalization of Computerized Passenger Reservation System (PRS) with a view to enable passengers to buy tickets even after the preparation of reservation charts. These new provisions will come into effect from 12th November, 2015. The rationalization exercise will also facilitate implementation of revised refund rules (notified recently) which will also become effective from 12th November, 2015. Under this exercise, sufficient time gap will be provided to passengers between preparation of charts and departure of train so that they can plan journeys properly.

The following are the advantages of rationalization of computerized Passenger Reservation System : –

a)Reservation charts will invariably be made at least 4 hours before the scheduled departure of the train and in case if the same are not made by the charting section, the system will automatically finalise them 4 hours before the scheduled departure of train(w.e.f. 18th November 2015). This will facilitate passengers to know the status of the ticket to plan their journey well in time. (this may be referred as the first reservation chart)
b)Immediately after preparation of first reservation charts, the reservation will again become open at the PRS counters as well as on internet (e-ticket) and the passengers can:-

Book the available accommodation in the train for full/partial leg of the journey, in case there is no RAC/waitlist for that leg.In case of passengers holding RAC/waiting list ticket, the passengers will be given facility to cancel the ticket up to 30 minutes before the scheduled departure of train. This will facilitate the passengers, particularly partially confirmed passengers, to decide either to undertake the journey or to cancel their ticket.

c) A second (and final) chart of reservations will be made available before departure of train and handed over to onboard ticket checking staff.

This exercise will ensure optimum utilization of train accommodation as well as enhanced earnings.
d)For the present, the condition for printing of first reservation charts at least four hours before departure of train shall be applicable in case of train originating station.

Under the above mentioned rationalization, the passengers can book / cancel / modify the tickets even after the preparation of first reservation chart but only upto 30 minutes before the departure of train across any PRS Counters as well as on internet (E-ticket) as per extant provision of Refund Rules. In case of e-tickets where after preparation of first reservation charts, passengers had the option to only file online Ticket Deposit Receipt and to request for refund, now will have the facility to modify/cancel the partially confirmed ticket and get refund electronically. Passengers holding PRS counter ticket / I-ticket will now be saved from the botheration of going only to current reservation counter at the journey originating station to book / cancel / modify ticket after the preparation of first reservation chart as per refund rules. They can now go to any PRS counter. Additionally, the facility will continue to be available at current reservation counters, wherever required. Later, this facility is also proposed be made available at some designated UTS counters at stations for which the work is under progress.

7th pay panel’s draft report riddled with dissent notes

The seventh Pay Commission’s draft report to determine the new salary structure for the 5.5 million civil servants in the central government has got riddled with several dissent notes. The notes, mainly about bringing in parity between the top-ranked Indian Administrative Service (IAS) and the specialised central services, argue that it will widen the talent base available to the government to deliver increasingly complex services to a demanding population.

But the dissensions could exacerbate differences at the top of the bureaucracy in the Government of India, already reeling from the impact of pay-related problems for the retired armed forces personnel who have demanded ‘one rank one pension’.

“There is a strong case for considering talent in the government rather than being confined to choices within some cadres,” former expenditure secretary Dhirendra Swarup told Business Standard. Swarup is one of the few non-IAS officers who became secretaries in the government, under former finance minister Jaswant Singh.

The notes are also a first for the Pay Commissions, set up every 10 years by the central government to revise the pay and allowances of central government employees. In the fifth Pay Commission, economist Suresh Tendulkar had put in a dissent note but it was on a macro theme suggesting a pruning of the bureaucracy and relating wages to performance.

But this time the notes reflect the sharp differences that have come up among the different cadres of government services about their pay and promotion avenues. There is a larger issue here. All the services taken together make up fewer than 150,000 people within the central government tasked with a mammoth level of administrative responsibility for a country of 1.3 billion people. So, frustrations among them could have far-reaching repercussions.

These men and women operate in a rigidly differentiated world through an appointment system that places them in cadres. The cadres almost mirror the caste differences in the larger society. The top-most cadres are the all-India services that include the IAS, Indian Police Service and Indian Forest Service. Of them, the IAS are the most numerous, at 4,572 according to the Civil Survey Report of 2010, written by former cabinet secretary, K M Chandrasekhar.

Below them are about 45 cadres clubbed as central civil services, which include the IFS, IA&AS and IRS.
The impact of this pecking order came out in the open recently in the list of empanelled officers for the post of 60 additional secretaries. These posts rank just one notch below that of the secretaries, who function as heads of department or ministries in the government. Of those empanelled, only three (railways, income tax and audit & accounts services) were from the non-all India services. Swarup said the numbers were even lower than those until the 1990s, when there were at least five non-IAS officers in the central government ministries. At joint secretary and senior levels, positions up to those of secretaries (senior administrative grade) in central ministries, the share of other services is minuscule when compared with IAS. Yet, this is where policies are shaped.

At the heart of the difference is a two-year increment offered to IAS officers when they join vis-a-vis other cadres. Since seniority within the government is decided on pay scale, the higher start assures these officers of a higher position at each grade. But as the IRS officers and others in their representations have pointed out, this makes it impossible for them to compete for additional secretary and secretary posts in the ministries.

But Chandrasekhar counters it saying officers from most non-IAS services have enough options to be promoted within their services. “There is need for both specialists and generalists in the civil services. The Indian government is a massive structure that demands many different skill sets”.

To correct some of the problems, the 2010 report had suggested setting up of a Central Civil Services Authority for officers from all the services after they completed 13 years of service. Each officer would get to choose an area of specialisation for the rest of their career. It has not been implemented so far.

The report of the Pay Commission, headed by Ashok Kumar Mathur, a former judge of the Supreme Court, was held up due to Bihar Assembly polls. The commission was given a four-month extension in August. Besides Mathur, the others in the commission are Vivek Rae (IAS) as full-time member, besides part-time members Meena Agarwal (Indian Railway Accounts Service) and Rathin Roy, director, National Institute of Public Finance and Policy (NIPFP). The commission is attempting to paper over some of the differences before the report goes to Finance Minister Arun Jaitley. The commission did not respond to requests for an interaction on the contents of the report.

The differences have become so sharp that social media platforms like WhatsApp have been flooded with often derogatory comments from opposing cadres about each other, a first of sorts. But both Swarup and Chandrasekhar held that such comments might not be serious enough to test the smooth functioning of the officers from different services when they were posted together.

DMRC Staff say their demand for Salary Restructuring not yet been met

New Delhi: The Delhi Metro Rail Corporation has hit rough waters with its employees resorting to protests once again. The protesting non-executive employees of the corporation have now begun a hunger strike as they claim their demands for salary restructuring are going unheard by the administration.

As many as 3,600 employees, mainly technicians, are taking turns to protest at Jantar Mantar and at the seven metro depots. They are not ruling out train services being affected as 32 of those on hunger strike have already been hospitalized. Members of the staff council are likely to meet the administration on Monday to reach a common consensus.

They demand that the salaries of technicians be revised from Rs 8,000 – 14,140 to Rs 10,170 – 18,500. For senior technicians, they have demanded a hike in pay-scale from Rs 10,170 – 18,500 to Rs 14,000 – 26,950 and for head technicians from Rs 14,000 – 26,950 to Rs 16,000 – 30,770.

According to General Secretary, DMRC Employees Union, Kuldeep Maan, the employees fear that once the Seventh Pay Commission is implemented, their problems with the corporation would be quashed. “We have been victims of DMRC’s exploitation since 2007. Our protest has been on for long now but nothing has happened. On November 3, we decided to extend the protest to Jantar Mantar and November 5 onwards employees began their hunger strike,” he said.

To register his protest for the cause Kishan went a step ahead and resigned from his membership of the employees’ council. “So far, 32 of the many employees on hunger strike have been hospitalised. If the administration does now blink an eye many more will be taken ill and then we won’t be responsible if metro operations are hit,” said another protesting member. The administration had called for a meeting once, but it bore no fruitful conclusions, he added.

Responding to the report, the DMRC said, “It is an internal matter of the organization and the Human Resource department has taken up the issues of these employees.”

G.S.R – In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Lal Bahadur Shastri National Academy of Administration (Establishment Group ‘C’ and ‘D’ Posts) Recruitment Rules, 2000, in so far as they relate to the posts of Physical Training Instructor, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Physical Training Instructor, namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Mussoorie (Physical Training Instructor) Recruitment Rules, 2015.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade payor pay scale.- The number of the post, their classification and the pay band and grade payor pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualifications.- No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, for reasons to be recorded in writing, in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Class, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The undersigned is directed to refer to this Departments D.O. letter of even number dated 23.07.2012 (copy enclosed) regarding holding of meetings of Departmental Councils regularly with a view to make effective use of Joint Consultative Machinery (JCM) Scheme. Secretary, DoPT, had also vide his DO letters of even number dated 03.12.2012, 26.07.2013 and 17.02.2015 requested to promote this interaction more proactively through regular meetings of Departmental/Office Councils under the Ministry/Department.
The JCM Scheme provides for Departmental Councils at the level of individual Ministries/ Departments, including their attached and subordinate offices. The Staff Side of JCM, however, has been remonstrating that regular dialogue with the Staff Side through the mechanism of Departmental Councils at Ministry/Department level is not happening. Meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.

It is requested that suitable instructions may please be issued to hold meetings of Departmental Councils on regular basis.

Attention is invited to para 2 (ii)(b) of this Ministry’s letter of even number dated 17/09/2007 regarding guidelines for providing concessions/facilities including scribes to persons with disabilities (PWDs), white conducting examination for their recruitment from open market.

Pursuant to advice of the Court of Chief Commissioner for Persons with Disabilities, in Case No.389/1041/2013 dated 13/9/2013 that criteria like educational qualification, marks secured, age or other such restriction for the scribe should not be fixed and instead, the invigilation system should be strengthened so that the candidates using scribe do not indulge in malpractices like copying and cheating during the examination, it has been decided by the Board to delete para 2 (ii)(b) of this Ministry’s fetter of even number dated 17/09/2007.

Further, where recruitment notices have already been published, the recruiting agency may also issue corrigendum, bringing this fact to the notice of all concerned.

Attention is invited to Board’s letter of even number dated 15.6.2010 (RBE No.88/2010) on the above subject, wherein instructions had been issued for extending the currency of instructions contained in RBE No.210/1991 pertaining to freezing of 25% of the vacancies falling within the direct recruitment quota in the category of Clerks in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.1900) and in Senior Clerks in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.2800) and 20% in the category of Junior Accounts Assistant in Pay Band-I of Rs.5200-20200 (Grade pay: Rs.2800) and Accounts Clerk in Pay Band-I of Rs.5200-20200 (Grade Pay: Rs.1900). The question of continuance of the above freeze orders has been considered by the Board and it has been decided to extend the currency of the instructions mentioned for a further period up to 31.12.2013. Rest of the vacancies may be filled up after reviewing the requirement of clerical staff.

2. In this regard, Board also desire that the Railways and Production Units should furnish information regarding the sanctioned strength of Junior Clerk, Senior Clerk, Junior Accounts Assistant and Accounts Clerk as on 1.4.92 and as on 1.1.2013 as well as their views with respect to continuance or otherwise of such a freeze order for future in the said categories of staff.

3. The instructions will be effective from the date of expiry of earlier freeze order i.e. 0l.0l.2013.

4. It has also come to the notice of this Ministry that the instructions on this freeze order is being interpreted by certain railway establishments in the manner as if there is total ban to fill up the posts in question. It is clarified that these instructions only limit percentage of recruitment and should not be construed as complete ban. Remaining posts may, therefore, be filled up by the Railways in terms of instructions on the subject.

I am directed to say that while introducing the New Pension Scheme from 01/01/2004, amendments to various existing rules including second proviso to Rule l of the All India Services (Death Cum Retirement Benefits) Rules, 1958 were made whereby these rules became inapplicable to those appointed to All India Service and posts from 01/01/2004. The pension of the member of All India Services appointed on or after 01/01/2004 is regulated by the New Defined Contribution Pension Scheme (known as the New Pension Scheme), notified by the Ministry of Finance (Department of Economic Affairs) vide their Notification No.5/7/2003-ECB2 PR dated 22/12/2003 now rechristened as National Pension System as per Section 8 of Pension Fund Regulatory Development Authority Act, 2013. The guidelines for New Pension Scheme in respect of All India Services was issued by this Department vide letter No.25014/14/2001-AIS(II) dated 08/09/2009 in terms of the instruction/guidelines notified by the Ministry of Finance.

2. Therefore, in view of the above new and changed position, this Department has received references from the State Governments and member of services for Clarification in regard to counting of past services for the purpose of pensionary benefits, pay protection and leave accumulation. The matter has been examined by this Department in consultation with the Ministry of Finance (Department of Expenditure) and Department of Pension and Pensioners’ Welfare and has decided as under: –

(i) The member of All India Services who had been an employee in pensionable establishment viz. Central/State Governments or autonomous bodies as on 31/12/2003 and appointed to All India Services on or after 01/01/2004 with proper permission shall be covered under the old non-contribution pension scheme in terms of Office Memorandum No. 28/30/2004-P&PW(B) dated 28/10/2009,which has been made applicable Mutatis-Mutandis to members of All India Services by this Department vide letter No. 25014/1/2013-AIS(II) dated 18/3/2013. The pay protection and leave accumulation arising out of previous service would be admissible as per relevant rules of respective All India Services (Pay) Rules and All India Services (Leave) Rules 1955.

(ii) Those under CPF etc will not be allowed entry into the old pension scheme on appointments from 01/01/2004

(iii) The member of All India Services who were appointed to government service in the central/state governments or autonomous bodies, whether in a pensionable or non-pensionable establishment, on or after 01/01/2004 before being appointed to All India Services shall be governed by the New Pension Scheme. The pay protection and leave accumulation arising out of their previous service would be admissible as per the relevant rules of the respective All India Services (Pay) Rules and All India Services (Leave) Rules, 1955.

(iv) The admissibility of counting of past services for the purpose of benefits as mentioned at point (i) and (iii) above shall be subject to continuous service and technical resignation.


    3. The State Governments are competent to determine the past service rendered by the member of service for such benefits as mentioned above. The service rendered by a member of All India Services before his appointment to the service under the Central Government or a State Government will count as continuous service for the said benefits subject to the fulfilment of the specific conditions provided in the All India Services (Leave) Rules, 1955 and the respective All India Services (Pay) Rules. Approval of the Central Government is not necessary for counting the previous service for such benefits. In such cases the Government of the State on whose cadre the member of service is borne/the Accountant General concerned, will have to take necessary action in consultation with the Central Department or the State Government, if the officer had worked under the Central Government or another State Government, as the case may before joining the All India Services, to count such service as qualifying service for the aforesaid benefit. If any clarification is required or condonation of break in service is involved, a reference may be set to the Department of Personnel and Training in the case of members of the Indian Administrative Services, the Police Division of the Ministry of Home Affairs in the case of Indian Police Service and the Ministry of Environment, Forest and Climate Change in the case of members of Indian    Forest Service.
