 A need has been felt to issue guidelines to provide certain additional facilities/amenities to the persons with disabilities (PWD) to enable them to effectively discharge their duties. The facilities such as identification of jobs, post recruitment and pre-promotion training, assistive devices, free accessibility, preference in transfer/posting, special casual leave, etc. have been identified as areas which require special attention. The proposed facility indicated in the guidelines should be applicable in respect of such employees working in the Ministries/Departments of the Government of India, their attached and subordinate offices, Central Public Sector Enterprises, Cantonment Boards etc.

2. An inter-ministerial committee was formed to finalise guidelines for providing certain facilities in respect of persons with disabilities, who are already employed in efficient discharge of their duties. Based on the discussions held with the stake holders and suggestion received from the stakeholders, the following guidelines are issued to provide certain facilities/amenities to the persons with disabilities:.

A. Identification of jobs
Each Ministry/Department of the Government of India, their attached and subordinate offices, Central Public Sector Enterprises, Cantonment Boards etc. should identify the types of jobs which could be easily performed by them specially for Group B, C and D posts where the number of lobs are more. Such persons should preferably be posted to perform such Identified jobs and they be allowed to continue performing such jobs, as far as possible. If the concerned PWD officer could perform all the jobs as people without disability or could perform several types of jobs efficiently, no effort should be made to instruct them to certain types of jobs only.

B. Post reruitment and pre-promotion training
Induction training is an essential component of the service requirement of an employee. Induction training programme for the persons with disabilities should be imparted together with the other employees.

Job specific post-recruitment as well as pre-prornotion training programmes are required to be organised for the persons with disabilities. Outlining a specific module/norm for training programme for the persons with disabilities common to all the Ministries/Departments and their attached (subordinate offices, Central Public Sector Enterprises, Cantonment Board, etc. may not be possible as the training requirement may be different on the basis of the work pattern. All the Ministries / Departments should take definite action to conduct job specific inclusive training programmes for the persons with disabilities with other employees.

Duration and training contents may be finalized in consultation with the National Institutes under the Department of Disability Affairs, Ministry of Social Justice & Empowerment and, if felt necessary, prominent Associations/Federations/Confederations workings in the sphere of disability can be consulted. It should also be ensured that training programmes are conducted at the time of change in job, introduction of new technology, after promotion of the employee, etc. The venue of the training may be fixed as considered suitable for conducting such training. The Ministries/Departments and their offices shall utilize existing Budget provisions for undertaking the aspects of training programme.

The employee with disability shall be placed with an experienced employee for at least one month on resuming responsibility of a post. This would help him to pick up skills required to perform the job and also the adaptations that may be required in individual cases.

C. Providing aids / assistive devices
The persons with disabilities could perform their duties efficiently It they are provided with aids and appliances which are suitable to their needs. Ministries/Departments and their attached and subordinate offices, Central Public Sector Enterprises, Cantonment Board, etc. should assist the persons with disabilities by providing them high tech/latest technology led assistive devices (including low vision aids, hearing aids with battery), special furniture, wheel chairs (motorised if required by the employee), software scanners, computer and other hardware, etc. in accordance with their requirement, which would improve their efficiency.

They should either provide or shall reimburse the cost of such devices with a specific time period for such devices to persons with disabilities in accordance with the price/durability of the special devices, special furniture, software, scanners, computer and other hardware, etc. as fixed by them, in consultation with various National Institutes working in the sphere of disability. A review exercise shall be carried out by the Departments/Ministries every three years to check the
availability or need for introduction of enhanced/upgraded versions of such devices/software etc. They shall utilise their existing budget provisions for providing these facilities.

D. Accessibility and barrier free environment at work place
In addition to the guidelines for modification in all public buildings including Government offices to provide easy accessibility and barrier free environment for PWDs as per the provisions of the PWD Act, all Government offices should take special steps to provide barrier free and accessible work stations to PWD employees, access from main building entrance to their work stations and access to common utility areas such as Toilets, canteens etc. Lifts/elevators should be made accessible by providing Braille signage and audio outputs. Wherever required, suitable colour contrast may also be made available in buildings, utilities, staircases, etc. for the benefit of low vision employees.

E. Preference in Govt. accommodation
The Directorate of Estates may give preference to the persons with disabilities for providing them accessible accommodation near their place of posting and they may be preferred for allotment of ground floor accommodation. Possibility of existing housingaccommodations being renovated to make them conveniently accessible to persons with disabilities, be explored by the Directorate of Estates.

F. Grievance redresal
Some of the employees including persons with disability may be got trained by the empanelled Master Trainers/Offices of various National Institutes working in the sphere of disability to develop their skills in handling grievances relating to PWDs, the Liaison Officer appointed to look after reservation matters for SCs, STs may also act as the Liaison Officer for reservation matters relating to persons with disabilities.The Laison Officer would also look after the issues relating to providing of amenities for the persons with disabilities. In addition, every Ministry/Department, their attached and subordinate offices, Central Public Sector Enterprises, Cantonment Board, etc., would preferably constitute a Grievance Redressai Mechanism headed by the Head of Administration and comprising at least two employees including a PWD having knowledge in disability matters. The Committee so constituted would receive and try to redress the grievances of persons with disabilities within a reasonable time frame.

G. Special Casual Leave
Vide this Department’s OM No. 25011/1/2008.EStt.(A) dated 19.11.2008, a provision of Special Casual Leave for 4 days in a calendar year has been made for the employees of Central Government with disabilities for spedfic requirements relating to disabilities of the official. Further, vide this Department’s OM No. 28016/02/2007-Estt(A) dated 14.11.2007, there is also a provision of 10 days Special Casual Leave in a calendar year subject to exigencies of work for the differently abled Central Government employees with disabilities for participating in Conference/Seminars/Trainings/Workshop related to disability and development to be specified by Ministry of Social Justice & Empowerment.

H. Preference in transfer/posting
As far as possible, the persons with disabilities may be exempted from the rotational transfer policy/transfer and be allowed to continue in the same Job, where they would have achieved the desired performance. Further, preference in place of posting at the time of transfer/promotion may be given to the persons with disability subject to the administrative constraints. The practice of considering choice of place of posting in case of persons with disabilities may be continued. To the extent feasible, they may be retained in the same job, where their services could be optimally utilised.

3. Every Ministry/Department in consultation with the Office of the Chief Commissioner for Persons with Disabilities would arrange for training of the Liaison Officer on “Disability Equality and Etiquettes”.

4. All the Ministries/Departments are requested to bring the above instructions to the notice of all appointing authorities under their control, for information and compliance. The Department of Public Enterprises may ensure to give effect the above guidelines in the all the Central Public Sector Enterprises.

 The undersigned is directed to refer to this Department’s OMs No.21/36/03-CS.I dated 13.11.2003 and No.5/4/2005-CS.I dated 25.01.2006 on the subject mentioned above. Clarifications have been sought by various cadre units on the manner of fixation of pay of Section Officers upon granting NFS.

2. The matter has been examined in consultation with the Estt.(Pay) Division of this Department, It is clarified that Section Officers who have completed 4 years approved service in the grade may be granted NFS and their pay may be fixed notionally w.e.f. from the 1st July of the year in which they have completed the prescribed approved service with actual financial benefits w.e.f. from the date of assumption of duty in the post of Section Officer, whether on ad hoc or regular basis.

Attention is drawn to the Office Memorandum issued earlier extending validity of empanelment of all health care organizations under CGHS till 31st March, 2014.

It has now been decided to extend the validity of empanelment of all Health Care Organizations under CGHS for further period of three months or till finalization of next empanelment of health care organizations under CGHS whichever is earlier on same terms and conditions as defined in OM on which they were empanelled earlier.

Subject : Empanelment of public spirited senior level retired Civil / Defence Service Officers as National Level Monitors(NLMs) for monitoring implementation of rural development programmes.

The undersigned is directed to refer to Ministry of Personnel, Public Grievances & Pensions, Department of Pension & Pensioners’ Welfare D.O. letter No.4/36/2013-P&PW(D) dated the 23rd December, 2013 and to say that the Ministry of Rural Development has evolved a comprehensive system of independent third party monitoring of implementation of its rural development programmes across the country by deputing Individual and Institutional National Level Monitors(NLMs) who are public spirited senior level retired Civil/Defence Service Officers and Academia, for ensuring accountability and transparency in the execution of various programmes of this Ministry. The experience/exposure to rural development and rural development related programmes is required for empanelment as Individual NLM. The empanelment of NLMs are done against open advertisement issued in the leading Newspapers and on the website of the Ministry inviting applications from eligible and willing Individuals and Institutions for empanelment as NLMs. As per the scheme, following categories/level of retired officers having working knowledge on computer use, upto the age of 65 years as on specified date of publication of advertisement, are eligible for empanelment as Individual NLM:

    a) ex-service officer from the Armed Forces of the rank of Lt. Colonel and above,
    b) retired officers of Para Military Forces having equivalent rank to Lt. Colonel or above in the Armed Forces,
    C) retired Central/State Government Officers including IT professionals and Management Experts of the level of Deputy Secretary and above to the GOl,
    d) retired Engineers of the rank of Superintendent Engineer and above in Central/State Government,
    e) retired officers of the rank of Deputy Secretary in the offices of AGs and the Comptroller and Auditor General of India.
    f) retired police officers of the rank of Superintendent of Police and above.
    g) retired professors of any recognized University/Research Institutionsl Scientific organization, and
    h) retired PSU/PSB officers of the rank of Deputy General Manager and above

2. This Ministry pays TA/DA and other monitoring charges to the NLMs as per terms and conditions of their services, The reports submitted by the NLMs are sent to the Programme Divisions of this Ministry for taking follow-up action on all the NLM reports. The reports of NLMs are also shared with the District Collector and the Chairman of the Vigilance and Monitoring Committee of the district for corrective measures.

Consequent upon approval of Ministry of Labour & Employment and in continuation of this Office Memorandum of even number dated 8.10.2003, the approval of the Competent Authority is hereby communicated for the payment of Productivity Linked Bonus (PLB) equal to 60 (Sixty) days wages subject of Maximum of Rs.7000 (Rupees Seven thousand only) to the employees of the Corporation for the year 2012-13 as worked out on the basis of the exiting scheme of Productivity Linked Bonus.

Accordingly the advance already paid to the employees may be adjusted and no recovery is to effected and the undertaking be treated as null and void.

However, in case cl employees who have not been paid the advance, action may be initiated for all payment of Productivity Linked Bonus  (PLB) equal to 60 (Sixty) days wages subject to the maximum of Rs.7000/- (Rupees Seven Thousand Only) for the year 2012-13 as worked to the basis of the exiting scheme of Productivity Linked Bonus.

The other terms conditions governing the PLB shall remain the same.

We are in receipt of the copy of OFB letter cited under reference (ii) above alongwith M of D letter dt 23.01.2014 regarding framing of Recruitment Rules for the post of Master Craftsman (MCM) and Chargeman both in the same Grade Pay of Rs.4200/-.
          
Since Defence Finance and DOP&T have not agreed to grant 3rd MACP to MCM on completion of 30 years of regular service on the reasons that the feeder grade and promotion grade stands remain in the identical Grade Pay.  Further, it was also not agreed to grant one increment on their re-designation from MCM to Chargeman (T).  Based on this refusal, DOP&T suggested to M of D to create separate channel for promotion to MCM and Chargeman (T) and accordingly a model proposal was suggested by M of D and circulated to all Directorates and Federations asking views and comments for further action.
          
While forwarding the model proposal by OFB vide your letter Dt 03.03.2014 to all Ordnance Factories, you have mentioned in para (3) giving your views about the changes and its functional implications and impacts on the career prospects of other categories.
          
Giving your proposals and impacts on the changes on model proposal it appears that OFB is having prejudice on the matter which shows that OFB itself is not interested in agreeing to the views of M o D.
         
We therefore, are totally oppose to the comments of OFB mentioned in your letter, whereas INDWF is firmly support to the proposed model of M of D which will be benefited to the organisation as well as to the individuals.

  
a)    MCM till they become JWM will continue to work as workman by which we shall be getting their services of workmen (MCM) to work.
 b)    Chargeman (T) all will be with the background of having Diploma both through DR & LDCE.
 c)    The prospects of promotion of Chargeman will not affect at any cost to others.
 d)    The MCM can become only after 25 to 30 years of service only at the end of their long service.

Therefore, the model proposal may please be accepted and a favourable decision may please be forwarded to M of D so that MCM can be considered for 3rd MACP.

Respected Sir,
With due regards, I would like to draw your kind attention on the subject wherein the issue of grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay is being demanded & discussed by this Federation at every forum.

 It has now been brought to our notice that an affected employee had challenged the Government’s decision on grant of MACP benefit in the hierarchy of promotional grade vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP.

Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.

In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.

As such, you are requested to kindly issue necessary directives to all units under your jurisdiction to implement the same immediately.
