Sir/Madam,

This is in continuation to our Circular No.Acad-09/2013 dated 25.1.2013 intimating you about the generation of Question Papers for Summative Assessment II for classes IX & X. As you are aware the Board will support schools to generate online question papers in the major subjects w.e.f this session. All of us are to ensure that the examination is conducted in smooth and fair manner. It is essential that the conduct of the Assessment does not only appear to be fair but should enjoy the complete confidence and trust of the public at large. Therefore, it is our bounden duty to sustain this trust. In order to conduct this examination fairly and smoothly the following measures may be taker and ensured.

1. that the candidates should be advised to be in their seats 30 minutes before the schedule commencement of the assessment;

2. they may be given the Question Paper for the day 15 minutes before the commencement of the assessment. This time be allotted to read the question paper only. The students will not write any answer on the answer book during this period;

3. proper seating arrangement should be made for the conduct of the assessment;

4. as suggested in the abovesaid circular the schools are advised to club themselves with the Sahodaya Cluster and schools in a particular city and design the combined datesheet for conduct of the Assessment and evaluation of answer books;

5. sufficient number of invigilators be developed for invigilation duty;

6. it must be ensured that teachers who are teaching a particular subject should not be given invigilation duty on the day when examination of the concerned subject is being conducted;

7. no candidate should be allowed to leave the examination hall before the expiry of half the time allotted for the paper;

8. efforts must be made to ensure that no unfairmeans are permitted during the conduct of the assessment;

9. the visually impaired, physically handicapped, spastic, dyslexic, autistic and candidates with disabilities as defined in the Persons with Disabilities Act 1995 shall be extended the facility of extra time and that of the amanuensis as per rules of the Board.

10. there may be teachers teaching in Classes IX and X whose ward/near relation may also be appearing for the Class IX/X examination from the same school. The head of the institution shall ensure that such teachers are not involved in the invigilation/evaluation duties for class IX/X, as the case may be in case, it is not feasible to absolve them from evaluation duties, the evaluation work should invariably be got done under supervision of the head of the school.

11. an undertaking must be obtained from the invigilators that their no near relation(s) is/are appearing at the examination;

12. immediately after the expiry of the time of examination the Centre Superintendent shall collect all the answer books from the invigilators. These should then be personally checked by the Centre Superintendent with the List of Candidates who appeared in each subject in that session.

13. after the examination is over the answer books must be got evaluated strictly as per the Marking Scheme provided by the Board;

14. in case of preparing the Question paper by the school itself the evaluation be done as per the Marking Scheme prepared by that school;

15. the answer-books must be kept in proper lock and key under the safe custody of the Prinicpal or the Examination incharge.

16. the answer books after evaluation must be also kept with the set of Question Papers and Marking Scheme properly and safely for verification by the Board at any time:

In the end, I once again request you to please extend your willing co-operation to the Board in the smooth and fair conduct of the Assessment. I am sure, with your active support the Board would be able to preserve the sanctity of the system and avoid criticism. Needless to mention that we all are custodian of examinees faith and we have to preserve it at all cost.

OFFICE MEMORANDUM

Subject : Payment of wages under the Minimum Wages Act to contract/casual workers in CPSEs.

The undersigned is directed to refer to the above noted subject and to state that reportedly few CPSEs are not paying the statutory wages and allowances to their casual/contract workers admissible under the Minimum Wages Act.

2.It must be ensured that the wages to the workmen in CPSEs are regulated as per the provisions of Minimum Wages Act and the agreement concluded between the Management and the Trade Union, and in no ease should the workers be paid wages less than the wages prescribed under the Minimum Wages Act. It may also be ensured that there is no incident of exploitation of casual/contract workers in any manner.

3.All administrative Ministries/Department of Government of India are requested to bring the aforesaid to the notice of the CPSEs under their administrative control for necessary action at their end.

Subject : Regarding tests investigations at private hospitals / diagnostic laboratories / imaging centres empanelled under CGHS.

The undersigned is directed to refer to the Office Memorandum of even no. dated 1st January, 2013 on the above subject wherein it has been provided under Para 3 that the serving government employees / CGHS beneficiaries shall submit medical prescription in original while claiming reimbursement of expenses incurred on diagnostic tests and investigations, from their office. Keeping in view the inconvenience and difficulties faced by the serving employees / CGHS beneficiaries in submission of prescription in original, it has been decided to relax the above condition and to allow a self attested photocopy of the medical prescription to claim reimbursement of medical expenses incurred on getting diagnostic tests / investigations carried out from a CGHS empanelled hospital / diagnostic laboratory / imaging centre on a valid prescription issued by a CGHS Medical Officer / Govt. Specialist, without a permission letter issued from the Department concerned.

2.The Serving beneficiaries will not require any permission from their Department for getting the diagnostic tests / investigations carried out in a CGHS empanelled private hospital /diagnostic laboratory / imaging centre in respect of investigations for which CGHS rates are available. They will get the prescribed tests done on payment basis and claim reimbursement from their Office. However, the serving employees of Ministry of Health and Family Welfare are eligible for credit facility from the CGHS empanelled private hospitals / diagnostic laboratories and imaging centres in terms of this Ministry's OM No. Rec.1- 008/Gr./CGHS/Delhi/CGHS (P) dated 10.06.2008.

3.The medical prescription issued by a CGHS Medical Officer / Government Specialist prescribing diagnostic tests / investigations shall be treated as valid for a single use within a period of two weeks from the date of prescription. However the medical prescription shall remain valid beyond two weeks for undertaking diagnostic tests / investigations if specifically prescribed by the CGHS doctor / Government Specialist about the date or period by which the prescribed tests are to be conducted for a routine check up or follow up treatment. The medical prescription would require revalidation or issue of a fresh prescription from the prescribing CGHS doctor/Government Specialist for getting the prescribed tests done after expiry of the validity period of two weeks or as prescribed by the CGHS doctor / Govt Specialist, as the case may be.

BANGALORE: Heart patients availing benefits under the Central Government Health Scheme (CGHS) will have to dig deeper into their pockets for treatment.

The Union ministry of health and family welfare has cut the aid by nearly 50% to various coronary drug-eluting stents to Rs 25,000 effective February 21. This is irrespective of the standard of stent used.

The CGHS beneficiaries who undergo angioplasty will be reimbursed for stents as per the new rates  a maximum of Rs 25,000 for drug-eluting stents and Rs 12,000 for the bare-metal coronary stents.

Till February 20, the CGHS rates were Rs 65,000 for drug-eluting stents approved by Drug Controller General of India and FDA; Rs 50,000 for sents approved by CE, Europe; and Rs 40,000 for those manufactured indigenously.

The move has not gone down well with the patients and the hospitals, who fear quality stents would be unaffordable.

Drug-eluting stents prevent narrowing of coronary artery after . They are coated with medicine that prevents scar tissue from growing into the artery.

There are about 40,000 CGHS card holders in Karnataka and about 1 lakh beneficiaries under this scheme. However, the exact number of persons with cardiovascular diseases in the CGHS scheme is not known.

Ravi Kant, undersecretary, government of India, has stated on the CGHS website: "Reimbursement to the beneficiaries/empanelled hospitals shall be allowed subject to the ceiling rates or actual, whichever are lower."

The decision will affect the CGHS beneficiaries as the market rate for high-end drug-eluting stents is between Rs 1 lakh and Rs 2 lakh. "With this decision, patients will have to pay from their pocket if they want FDA-approved stents," said a senior cardiologist from Bangalore.

"I came to know about this sudden change only after my wife was operated last week at a private hospital empanelled with CGHS. As we already had fixed the date of surgery around February 18, we could not back out. I had to withdraw a bank fixed deposit to settle the difference in the cost of stent as I was left with no option," said Murugesh Shetty (name changed), a retired central government employee.

"Not just poor and retired employees from central government jobs, but even affluent and high-ranked government officials will be affected by the Centre's move as they go to government hospitals for treatment. A patient will either have to shell out a huge amount or will have to compromise on the quality of stent," said Dr C N Manjunath, senior cardiologist and director, Sri Jayadeva Institute of Cardiovascular Sciences and Research.

"This decision has come as a rude shock for pensioners. You can't afford to pay such a huge difference if you depend on pension nor can you compromise on quality of stent as it is a matter of your life. Hospitals too will be hit as they don't stock stents at wholesale rate. Older versions of stents, which are comparatively cheap, are not as much beneficial as the high-end stents," said Dr Ranganath Nayak, interventional cardiologist, Vikram Hospital.

Subject : Notional fixation of pay to officers included in USSL 2009 and 2010 reg.

The undersigned is directed to refer to references received from Ministries/ Departments forwarding therewith requests of officers included in USSLs 2009 & 2010 for notional fixation of pay in the grade of Under Secretary from 1 July of the Select List year. The issue has been examined in this Department.

2. It is informed that as per DPC guidelines promotions are effective from a prospective date. Grant of notional fixation of pay from a date prior to the date of actual promotion is not as per the general instructions on promotion. The pay and allowances attached to a post is admissible only w.e.f. the date of appointment to the post and for actual pay benefit, assumption of charge of the promotional post is the criterion.

3. It was decided by this Department that notional fixation of pay would not be allowed to any grade/ service on the ground of delayed holding of DPC. Accordingly, in the Office Memorandum of even number dated 26.11.2012 issued by this Department for inclusion of officers in USSL-2009 & 2010 no instructions were issued for notional fixation of pay.

4. Accordingly, notional fixation of pay in respect of officers included in USSL-2009 and 2010, w.e.f. 1 July of the Select List year is not consistent with extant rules/instructions on the subject and is not, therefore, allowed. All the Ministries/Departments are, therefore, requested to review the cases of fixation of pay of officers included in USSLs 2009 & 2010 and take steps to rectify the pay fixation in all those cases where the benefit of notional fixation of pay has incorrectly extended.

As it was almost confirmed that expected dearness allowance from January 2013 will be 80% and only issuing Government order for releasing additional installment of Dearness Allowance from January 2013 is awaited, here after  our focus will obviously be on expected dearness allowance from July 2013. All the Central Government employees have nothing to say about government decision on  not to increase  the Income Tax exemption limit. But it seems all of them were upset with this, as almost all of them will fall under 2lakh to 5lakh income bracket. Now their only hope and expectation to increase the take home pay will be on Dearness Allowance from July 2013. The AICPIN for Industrial Workers for the coming six months from January 2013 to June 2013 will decide the amount of increase in DA from July 2013. So it is quite obvious that the central government employees are very much interested to know the status of  AICPIN – IW  every month. The AICPIN for January 2013 rose by 2 points and pegged at 221 points

Consumer Price Index for Industrial Workers (CPI-IW) – January, 2013

The All-India CPI-IW for January, 2013 rose by 2 points and pegged at 221 (two hundred and twenty one). On 1-month percentage change, it increased by 0.91 per cent between December and January compared with 0.51 per cent between the same two months a year ago.

The largest upward contribution to the change in current index came from Housing Group which increased by 3.53 per cent, contributing 1.28 percentage points to the total change. This was followed by Miscellaneous and Food groups with 0.74 and 0.26 per cent increase respectively contributing 0.32 and 0.28 percentage points to the change. At item level, largest upward pressure came from Rice, Wheat & Wheat Atta, Groundnut Oil, Eggs (Hen), Fish Fresh, Goat Meat, Poultry (Chicken), Onion, Tea (Readymade), Firewood, Auto Rickshaw Charges, Bus Fare, Rail Fare, etc. However, this was compensated by Arhar Dal, Potato, Tomato, Other Green Vegetables, Sugar, Electricity Charges and Flower/Flower Garlands by putting downward pressure on the index.

The year-on-year inflation measured by monthly CPI-IW stood at 11.62 per cent for January, 2013 as compated to 11.17 per cent for the previous month and 5.32 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 14.08 per cent against 13.53 per cent of the previous month and 0.49 per cent during the corresponding month of the previous year.

At centre level, Durgapur recorded the largest increase of 18 points followed by Jharia (10 points), Godavarikhani (9 points), Goa and Surat (8 points each), and Chandigarh (6 points). Among others, 5 point rise was registered in 3 centres, 4 points in 6 centre, 3 points in 12 centres, 2 points in 13 centres and 1 point in 11 centres. On the contrary. Labac-Silchar and Mariani-Jorhat centres reported a decline of 2 points each. The indices of Jalandhar, Rourkela, Sholapur and Kolkata were also declined by 1 point each. Rest of the 21 centres’ indices remained stationary.

The indices of 39 centres are above All-India Index and other 38 centres’ indices are below national average. The index of Mysore centre was at par with all-India index.

The next index of CPI-IW for the month of February, 2013 will be released on Thursday, 28 March, 2013. The same will also be available on the office website www.labourbureau.nic.in.

The result of the Central Armed Police Forces (ACs) Examination, 2011 was declared vide Press Note dated 30th October, 2012 recommending 567 candidates in order of merit for appointment.  Result of another candidate which was withheld was also declared on 30.11.2012, taking the total recommendations as 568.

 The Commission, in accordance with Rule 16(4) and (5) of the Central Armed Police Forces (ACs) Examination, 2011, has also maintained a consolidated Reserve List in order of merit below the last recommended candidate in each category.

 As now sought by Ministry of Home Affairs, the Commission hereby recommends 87 candidates, which includes 14 General, 55 Other Backward Classes, 11 Scheduled Caste and 07 Schedule Tribe to fill up the remaining posts based on Central Armed Police Forces (ACs) Examination, 2011.  Ministry of Home Affairs/CAPFs would be communicating directly with the recommended candidates.

 The Candidature of 09 candidates bearing Roll No(s). 033350, 62855, 69244, 75277, 116267, 118392, 125997, 126042 and 150733 is provisional.

 The list of these 87 candidates would be available on the UPSC website i.e. http://upsc.gov.in.

2.    In the month of January, 2013 workshops with representatives of Ministries/Departments were organized to facilitate and smoothen the process of uploading and submission of data and invite suggestions for improvement of the software. Now, the software has been augmented and is ready for uploading of data about representation of SCs, STs & OBCs and Persons with Disabilities in Central Government Services in respect of your Ministry/Department as on 1.1.2013.

Subject: Grant of Night Duty Allowance on the basis of Actual Salary –        Implementation of Courts Judgements.

    The issue of payment of Night Duty Allowance based on actual salary instead of notional pay of Rs.2200/- is under consideration in the Ministry consequent of Courts judgments. Hon’ble CAT jodhpur has passed the following directions in OA No 34/2008 dated 5.11.2009:

(i)    The Night Duty Allowance shall be paid to the applicants and the similarly situated persons on the basis of the actual salary after taking out the pay structure determinants like HRA etc., which have no actual relation to the work performed and on the basis of this pay, thus arrived at, Night Duty Allowance is payable to the applicants.

(ii)    The applicants are entitled to such arrears as is applicable to them from April 2007 on the basis of actual pay thus arrived at without any interest if the amount is calculated and arrears paid to them from six months from the date of receipt of a copy of this order and thereafter with 6% interest.

(iii)    The O.A is allowed to the extent as aforesaid. No order as to costs.

2.     The following information is required to be submitted to Defence (Finance) for taking a conscious decision in the matter:

(i)    No. of employees eligible for getting NDA with the break-up of Industrial or Non-Industrial employees; and

(ii)    The financial implication if the proposal is implemented in favour of the petitioners only and (ii) all similarly placed personnel including the petitioners.

3.    It is requested that the above information may be furnished to the Ministry in time bound manner
