Action taken report on the minutes of the standing Committee National Council JCM held on 03.05.2017

Minutes - Reacting to the comment made by the official side, the staff side pointed out that prima-facie, on introduction of computerized functioning in almost all departments, the functions assigned to LDCs have become redundant.

Decision - What is required is to get the report from each department and take a conscious decision, as LDC is a common category.

Report of the Ministry of Railways (OM dated 01.12.2017)

In view of functional requirement of Ministry of Railways (Railway Board) and promotional aspects of MTS, proposal to abolish and upgrade all posts of LDCs (LDC now as Junior Secretariat Assistant) to UDCs (now called as Senior Secretariat Assistant) may not be recommended and besides this, RBSCS is patterned on the lines of the CSCS and the existing system is working well, unless there is any change in CSCS, no change is desirable in RBSCS. 7th CPC has also not provided upgradation of to LDCs; therefore to abolish and upgrade all posts of LDCs to UDCs is considered not feasible.

CHANGE OF NOMENACLATURE OF LDC & UDC IN CENTRAL SECRETARIAT
DOPT HAS DECIDED TO CHANGE THE NOMENCLATURE OF LDC & UDC OF CENTRAL SECRETARIAT OFFICES. BUT NOTHING IS HEARD IN RESPECT OF CHANGE OF NOMENCLATURE/MERGER OF LDCS AND UDCS OF SUBORDINATE OFFICES. IT IS TO BE NOTED THAT IMMEDIATELY BEFORE THE FINALIZATION OF 6TH PAY COMMISSION REPORT, GOVERNMENT HAD UPGRADED THE PAY SCALE OF THE ASSISTANT IN CENTRAL SECRETARIAT FROM RS. 5500-9000 TO 6500-10500 THAT PAVED THEM TO GET AN EDGE OVER THE PAY OF THE ASSISTANTS OF SUBORDINATE OFFICES. LIKEWISE IT MAY BE A MOVE TO GIVE MORE BENEFITS TO THE LDC & UDCS OF CENTRAL SECRETARIAT IN 7TH CPC.

IT IS TO BE NOTED THAT THIS ASSOCIATION HAS CONTINUOUSLY RAISING THE MERGER AND UPGRADATION OF GRADE PAY LDC & UDC. THE CASE WAS SENT TO JCA SECTION WITH RECOMMENDATION BY THE DOPT BUT THE JCA RETURNED THE SAME TO DOPT WITH A REMARK THAT “THIS IS NOT AN ISSUE OF ANOMALY AND NO SUCH ITEM WAS BEFORE THE NATIONAL ANOMALY COMMITTEE” AND SUGGESTED THAT ESTABLISHMENT II MAY PROCESS THE CASES WITH THE CASE OF LDC & UDCS OF CENTRAL SECRETARIAT IN CONSULTATION WITH THE MINISTRY OF FINANCE. BUT DOPT HAS RETURNED THE CASE TO THIS ASSOCIATION WITH A DIRECTIVE TO TAKE UP THE SAME WITH MINISTRY OF FINANCE DIRECTLY.

IT IS WORTH TO MENTION HERE THAT JCA HAD RETURNED THE CASE WITH A PLEA THAT THIS IS NOT AN ISSUE OF ANOMALY AND NO SUCH ITEM WAS BEFORE THE NATIONAL ANOMALY COMMITTEE. WHEREAS ON 9TH JUNE WHEN THE LAST MEETING OF THE NATIONAL ANOMALY COMMITTEE HELD, ITEM NO. 4 –”UPGRADATION OF PAY BAND AND GRADE PAY OF LDCS AND UDCS” WAS DISCUSSED. WHEN THERE WAS NO ITEM WAS PENDING WITH THE JCA, THEN HOW THIS ITEM SURFACED IN THE ANOMALY COMMITTEE MEETING. SIMILARLY THE CONCERNED OFFICER IN DOPT HAD ORALY INFORMED ME THAT THE CASE OF LDC & UDC WAS RETURNED BECAUSE HIS SECTION IS DEALING THE CASES OF LDC & UDC OF CENTRAL SECRETARIAT ONLY AND THE LDC & UDC OF CENTRAL SECRETARIAT HAD NOT DEMANDED THEIR PAY UP-GRADATION.

THE STATE OF LDCS POSTED IN SUBORDINATE OFFICES HAD DISCUSSED IN THIS WEBSITE SEVERAL TIMES. THEY ARE ALLOCATED WITH WORK WORTH TO BE ALLOCATED TO UDC/ASSISTANT AND IN MOST OF THE CASES OFFICERS ARE TAKING DECISION ON THE FILE PUT UP BY THE LDCS WHERE AS IN CENTRAL SECRETARIAT SUCH FILES INITIATES BY UDC/ASSISTANT LEVEL. THUS IT IS HIGH TIME THE GOVERNMENT SHOULD TAKE A DECISION ON THE UPGRADATION OF GRADE PAY AND NOMENCLATURE OF LDC & UDCS WORKING IN THE SUBORDINATE OFFICES BEFORE THE FINALIZATION OF PAY COMMISSION REPORT.

DoPT seeks suggestions on the proposal under consideration to change the name of posts of LDC, UDC and Assistants of CSCS / CSS.

Upgradation of Pay Band and Grade Pay of LDC and UDC will be discussed in National Anomaly Committee Meeting.

NAC Meeting today : Upgradation of Pay for LDC and UDC will be discussed

The Secretary, NCJCM Staff Side has already informed that a meeting NAC will be held after the final Meeting of NCJCM with 7th Pay Commission. Accordingly the DOPT is holding the National Anomaly Committee Meeting today at 3.00 PM at New Delhi. The office Memorandum issued to all Staff Side Members 0f The National Anomaly Committee stated that..
“In continuation of meeting held on 29/5/2015 the next meeting of the National Anomaly Committee is scheduled to be held under the Chairpersonship of Joint Secretary (Establishment) on 9th June, 2015 at 3.00 P.M. in the Conference Hall (Room No. 190) North Block, New Delhi. Agenda Notes for the meeting as suggested by the Staff Side are enclosed.
All the concerned are requested to kindly make it convenient to attend the meeting.”

At Item Number 4 the issue of Upgradation of Pay Band and Grade Pay of LDC, UDCs and stenographers Gr.III In Subordinate offices is included for discussion. it is established in the point that LDCs may be placed in PB-i with Grade Pay of Rs.2800 and UDCs may be placed in PB-2 with Grade Pay of Rs.4200

ITEM No.4 : Upgradation of Pay Band and Grade Pay of LDC, UDCs and stenographers Gr.III In Subordinate offices.

Group ‘D’ employees have been placed in PB-I with Grade Pay Rs. 1800 and entry qualification now prescribed in Matriculation.

LDC/UDCB have been assigned the same PB-I with Grade Pay of Rs. 1900 and Rs. 2400.

Assistants and Stenographers of Central Secretariat who were in the pre revised pay scale of Rs.5500-9000 PB-2 with Grade Pay of Rs. 4200 has been granted upgraded pay scale in PB-2 with Grade Pay of Rs.4600 with retrospective effect from 1.1.2006. (0M dated 17.11.2009).

The result is that vertical relativity between Group ‘D’ and LDCs has been drastically reduced on the one hand and on the other vertical relativity between UDC sand Stenographer Gr.III of subordinate offices vis a vis the Assistants and Stenographers of Central Sectt. has been widened. In both way the relativities vis-à-vis Group D’ and LDCs and vis-à-vis UDCs/Stenographer III and Assistants have been disturbed without assigning any reasons therefore.

With a view to maintain the well established relativities it is proposed that LDCs may be placed in PB-i with Grade Pay of Rs.2800 and UDCs may be placed in PB-2 with Grade Pay of Rs.4200.

Will the 7th CPC fulfil the demands of LDCs and UDCs?

For a number of years now, especially after the 6th CPC, the problems faced by LDCs and UDCs have started gaining prominence. The unity and sense of purpose among them makes them look all set for the kind of victory that Pharmacists had. Common sense of purpose, unity and dedication sure make success possible!

In order to decrease the number of grades, the 6th Pay Commission combined all the different grades between Grade Pay 1300 to Grade Pay 1800 into a single grade – Grade Pay 1800, thereby wiping out the entire Group ‘D’. As a result, everybody became Group ‘C’ employees. Even those who lacked the minimum education levels, illiterates and everybody else were lumped into Group ‘C’. Their Grade Pay was also raised to Rs. 1800. But, at the same time, employees working as LDCs, who have a minimum educational qualification of Class XII and also possess some technical education, were not given any upgrading. Instead, they now had to share their grade with lesser-qualified former Grade ‘D’ employees.

The next huge trouble originated from the MACP. Those who didn’t get any promotion for years are given career upgradations through MACP. LDCs who didn’t get any promotions for more than 10 years were given their next grade pay, from Rs. 1900, their pay rose to Rs. 2000. The increase of mere Rs. 100 turned out to be a huge disappointment to many. Similarly, those with Grade Pay 2400 were hoping for a jump to Grade Pay 4200, but were instead forced to upgrade with only Grade Pay 2800 as per MACP rules. That anger kept seething too, because the different is 1400.

The most important demand of the LDCs and UDCs is to upgrade the current Pay Scale-Grade Pay.
Grades are decided based on the educational qualification of the employees. An LDC possesses a minimum educational qualification of Class XII and also has some technical qualifications. The basic salary of an LDC is just Rs. 1900 + 5830 = Rs. 7730.00. They want it revised to Rs. 2400 + 7510 = Rs. 9910.

The big question is – will the 7th CPC grant this demand?

The comments of Shri George Antony, Kalpakkam on the Memorandum submitted to the 7th Pay Commission by this Association is given below: Shri Antony has made a comparative study on the pay scales of LDC & UDCs of Kerala State and Central Government wherein it has seen that the LDC/UDC posted in Central Government are being paid much less pay than the pay of LDC/UDC of Kerala State.


All our friends are requested to send useful material in support of the demands put up by us to the 7th CPC to this Association so that the same may be used during oral evidence.

I have gone through your memorandum to 7th CPC. After analyzing the past pay commissions and various state government pay commissions, I have observed some facts which I would like to share with you. This may be useful for your meeting with 7th CPC in the nearby future. The observations are listed below for your consideration.

1) There is a general conception that central gov. employee’s pay is more than state gov. employee’s pay. But this is not true in many cases.
Kerala gov. employee’s pay is more than central gov. employee’s pay in many equivalent posts like LDC, UDC etc.

Creation of NFSG in CSCS for UDC in 4200 GP

The below information was submitted as a written reply in the Parliament to a question on 20th Feb 2014 as follows:

The Government decided to create a grade of UDC ‘Non-Functional Selection Grade (NFSG)’ in Central Secretariat Clerical Services (CSCS) in the grade pay of Rs.4200/- in Pay Band-2 vide O.M. No. 20/49/2009-CS-II(B) dated 22.6.2011. As per the O.M. mentioned above, UDCs of CSCS with 5 years of approved Service are eligible for grant of Grade Pay of Rs.4200/- (NFSG) subject to the condition that the total number in the grade will be restricted to 30% of the sanctioned strength. The NFSG grade came into being from the date of issue of the said O.M.

Modified Assured Career Progression (MACP) Scheme came into operation w.e.f 1.9.2008. The Scheme ensures three Financial up-gradation in the immediate next higher grade pay in the hierarchy of recommended revised pay bands as given in CCS (Revised Pay) Rules, 2008 on completion of 10, 20 and 30 years of continuous regular service subject to the provisions of Scheme issued vide DOP&T O.M. No. 35034/3/2008-Estt.(D) dated 19.5.2009. MACP benefits are granted with effect from the actual date of completion of 10 years of regular service in any grade since its inception from 1.9.2008 by the concerned cadre units. The benefit of NFSG could not be availed of by the beneficiaries as the Select List 2003(extended) of UDCs of CSCS is sub-judice.
