Sub: Implementation of recommendations of 6th CPC – merger of grades – revised classification and mode of filling up of non-gazetted posts – scheme for filling up of vacancies after 31/12/2013.

Ref: (i) Railway Board’s letter No. E(NG)I-2008/PM1/15 dated 03/09/2009, extended upto 31/12/2014 vide Board’s letter dated 16/06/2014.
(ii) Railway Board’s letter No. E(NG)l-2008PM1/15 dated 07/08/2014.
(iii) GS/NFIR’s letter No.II/Pt. 5 dated 08/09/2014.

Federation desires to invite kind attention of the Railway Board to letter dated 03/09/2009, referred to above, wherein it was decided that promotion to all vacancies as existed on 31/08/2009 should be granted as indicated in the enclosure to the said letter. In para 3 of the said letter, it has further been mentioned that the scheme for filling up vacancies arising on or after 01/09/2009 will be issued in due course in consultation with the Federations. Currency of these instructions has been extended by the Railway Board from time to time, the latest extension covers vacancies upto 31/12/2014 vide Board’s letter dated 16/06/2014.

2. NFIR vide letter No.II/6/Pt. 5 dated 08/09/2014 has conveyed protest against arbitrary decision of Railway Board (Board’s letter dated 07/08/2014) to calculate DR, LDCE quota etc., in the merged grades based on Board’s letter dated 03/09/2009. The Federation has also highlighted the harm being done to staff pointing out the case of Technical Supervisors
belonging to JE, SSE.

3. Further to above NFIR wishes to state that the Federation has been receiving grievances from ministerial staff as well whose promotional avenues have also been effected adversely as can be seen from the following position:

It can be seen that 20% quota vacancies against LDCE quota in the category of OS/GP 4200 have wrongly been enhanced to 20% of total of V CPC pay scale posts which is improper.

The percentage needs to be brought down to 10%. NFIR, therefore, once again requests the Railway Board to review and withdraw the instructions issued vide Board’s letter dated 07/08/2014 and hold discussions with the Federation.

Will the 7th Pay Commission submit its Interim Report to the Central Government..?

Eight months have passed since the 7th Pay Commission was constituted by the Central Government.

In the Terms of Reference of the 7th Pay Commission, it was mentioned that the Commission could submit an interim report to the Government, if required.

All the employee associations and federations have been demanding a DA merger and an interim report. They have also announced a number of multi-stage protests. The big question is – will the 7th Pay Commission submit its stand on this issue to the Government.

50% TATKAL TICKETS o­n DYNAMIC PRICING

Ministry of Railways have decided that 50% of the existing tatkal quota tickets shall be sold under dynamic fare scheme. After booking of the first 50% of tatkal tickets under tatkal quota, the subsequent 50% tatkal tickets will be sold o­n dynamic pricing. The fare shall increase by 20% after each slab of 10% berths are sold subject to the existing cap (maximum fare chargeable) o­n dynamic fare.

As such the scheme is implemented in following 5 trains of Central Railway with effect from 3.10.2014.

2. 12534 Chhatrapati Shivaji Terminus-Lucknow Pushpak Express

DA Announcement for TN Government Staff Awaited…

On September 18, 2014, the Ministry of Finance announced that the Central Government employees were to get Dearness Allowance of 7% from July onwards. Following the announcement, various state governments too have been announcing Dearness Allowance of 7% to its staff. (Rajasthan Government DA Order & Karnataka Government DA Order)

It is a well known fact that the Tamil Nadu state government is in a crisis following the conviction of J. Jayalalithaa in the disproportionate assets case. O. Paneerselvam has been chosen as the new Chief Minister of the state.

More than 18 lakh state government employees, pensioners and their dependents are eagerly waiting for the Dearness Allowance announcement from the new Chief Minister. They are wondering if the new government would grant the arrears and release the Government Order before Diwali this year.
Let us hope that the new Chief Minister makes their dreams come true on the occasion of Diwali and announces a 7% DA this time.

Clarification orders circulated by Railway Board regarding eligibility of Children Education allowance/Hostel subsidy to third child

Dopt once again clarified that the Children Education Allowance/Hostel Subsidy shall be admissible only for the eldest two surviving children except when the number of children exceeds two as a result of second child birth resulting in twins or multiple births.

Sub: Grant of Children Education allowance/Hostel subsidy to third child when first / second child is not in a position to go to school due to severe disability.

References have been received from Zonal Railways seeking clarification regarding admissibility of Children Education Allowance / Hostel Subsidy in respect of third child of the Railway employee when the first / second child is not in a position to go to school as he/she is born with profound mental retardation or is totally invalid and cannot even go to a school meant for the special children.

2. The matter has been examined in consultation with DOP&T, the nodal Department in respect of aforesaid policy and they have intimated vide OM No.A-27012/1/2014-Estt(AL) dated 26-08-2014 that Children Education Allowance/Hostel Subsidy shall be admissible only for the eldest two surviving children except when the number of children exceeds two as a result of second child birth resulting in twins or multiple births. Copy of DoP&T’s OM is enclosed for information and guidance of all.

3. This disposes of CORE’s letter number E/O/39 dated 05-06-2-2014 & ICF’s letter number PB/WI/Misc/2014 dated 09-06-2014 on the matter.

Sub: Competent Medical Officer/Board for issuing certificate of disability for the purpose of family pension under rule 54 of CCS (Pension) Rules, 1972 – reg.

The undersigned is directed to state that rule 54 (6) of the CCS (Pension) Rules, 1972 had been amended vide this department’s Notification of even number, dated 25th April, 2008 to change the competent authority to issue a disability certificate from ‘a Medical Officer not below the rank of a Civil Surgeon” to ‘a Medical Board comprising of a Medical Superintendent or a Principal or a Director or head of the Institution or his nominee as Chairman and two other members, out of which at least one shall be a Specialist in the particular area of mental or physical disability including mental retardation’.

2. The above amendment as made in order to comply with the guidelines, dated 18”th February, 2002, issued by the M/o Social Justice and Empowerment in pursuance of Persons with Disabilities (Equal Opportunities, Protection of justify and Full Participation) Rules, 1996.

3. Subsequently, the guidelines, issued vide Ministry of Health and Family Welfare Notification No.S.13020/1/2010. dated 18.6.2010, in pursuance of the Persons with Disabilities (Equal Opportunities. Protection of justify and Full Participation) Rules. 1996, do away with the Medical Board in cases other than those of Multiple Disabilities.

4. It has been decided in consultation with the Ministry of health & Family Welfare and the Ministry of Social Justice and Empowerment that for grant of family pension under the CCS (Pension) Rules, 1972, the authority competent to issue disability certificate would be as specified in the guidelines issued by the M/o Health & Family Welfare referred to in para 3 above. It has also been decided that for the past cases, the disability certificate issued either in pursuance of the guidelines, dated 18.06.2010 or in pursuance of rule 54(6) of the CCS (Pension) Rules, 1972 shall be acceptable.
