Consequent upon issue of this Deptt. Memo. No. 224- F(Pen) dated 03.06.2016 the Pensioners /Family Pensioners of the State Government and Government Sponsored or aided non Government educational institutions, local bodies, statutory bodies, boards, corporations, undertakings etc., covered under Finance Department Resolution No. 8071-F(P) dt. 27.11.2015 have been allowed the benefit of Interim relief @ 8% of the Basic Pension with effect from 01.07.2016.

2.Now, in view of the fact that the service and pay of the college teachers and others in the UGC/ AICTE scale is since not covered under the terms of reference of the Resolution issued vide No.8070-F(P) dated 27.11.2015, a question has raised whether the Pensioners/Family Pensioners of college who are/were entitled to pension/family pension from the State Government but on determination of the pension/family pension with respect to the last-pay of the retired/deceased employee in the UGC/ AICTE scale, are entitled to the Interim relief.
3.It is hereby clarified that the benefit of Interim relief contemplated in this Deptt. Memo No.224- F(Pen) dated 03.06.2016 relates to the grant only in respect of the Pensioners/Family Pensioners whose pension/family pension thus fixed on the basis of the pay and the service are covered in the terms of reference of the 6th Pay Commission as per the Resolution issued vide No.8070-F(P) dated 27.11.2015. Accordingly, the Pensioners/Family Pensioners of Govt. Colleges & Non-Govt. Colleges covered under the UGC/AICTE scales of pay, i.e. retired teaching staff including Librarian, Laboratory Instructors, Physical Instructors, Demonstrators of Govt. & Non Govt.General Degree Colleges, Engineering Colleges & Polytechnic Colleges and all other Pensioners/Family Pensioners of such category whose service and pay are not covered in the Resolution ibid, are not entitled to the grant of Interim Relief under Memo No. 224- F(Pen) dated 03.06.2016.

4.Payment of the Interim Relief allowed to the category of Pensioners/Family Pensioners who are not entitled to such grant as clarified at Para- 3 above, if any, is liable to be recovered/adjusted immediately from the pension relief, as per rules, in 5 (five) instalments starting from the month of November, 2017.

5.All the Pension Disbursing Authorities may act accordingly.

Himachal pradesh government gives 5% interim relief to its employees, pensioners

Shimla: Himachal Government released five per cent interim relief to its employees and pensioners from August 1 this year on Wednesday.

The Interim Relief (IR) would be paid on basic salary plus Grade Pay but would not be part of salary and no allowance would be payable on it, a notification issued by the government said.
The pensioners would also get five percent interim relief from August 2016, payable along with pension for the month.

The release of IR would put annual burden of about Rs 300 crore on the state exchequer, Additional Chief secretary, S K Baldi said.

Chief minister Virbhadra Singh had made the announcement to release five per cent IR from August 1 during his budget speech in March this year.

However, the government has not yet released the installment of six per cent additional DA to the employees which was due from January 1, 2016.

Meanwhile, the government today announced 8.1 per cent interest on general provident Fund and other such savings to the employees for current Financial Year.

Sub: Non-settlement of our demands – Decision to go on “Indefinite Strike” commencing from 11.07.2016 – Request for your intervention and support.

I write this on behalf of the apex level body of all the Central Government Employees Organizations who are participating in the Negotiating Forum; called the Joint Consultative Machinery. The JCM as a Negotiating Forum was conceived and implemented in 1966 after the prolonged discussions with the Staff Associations and the Federations in the Central Services in the wake of first industrial action in 1960. The idea of setting up the JCM was in realization of the absence of a platform to discuss, deliberate and settle the demands/issues/grievances/problems of the Civil Servants. Up to 1995-96 the JCM, which has a three level negotiating platform was functioning well, meetings were regular. However, after the promulgation of the new recognition Rules in 1993, the meetings at the Ministry level became few and far between and at the national level, the deterioration stepped in a little latter. The National Council, which was to meet thrice in a year did not meet even once in a year. The last meeting of the National Council was held on 15.05.2010 The organizations participating in the JCM were demanding the meeting to be held, but the pleas were ignored by the successive Cabinet Secretaries. The Charter of Demands (copy enclosed), in pursuance of which the strike is decided to be organized, has arisen due to long neglect of the grievances of the employees/workers.

When the 7th CPC was set up in February, 2014, no announcement for Interim Relief or DA Merger was made by the then government, which had all along been the practice whenever the government had set-up the Pay Commissions earlier. We fully co-operated with the Commission, submitted a memorandum detailing the issues and explained the reasoning behind each demand. The 7th CPC submitted report on 19.11.2015 to the government. In our communication dated 10.12.2015 (copy enclosed), we sought
improvement/amendment over the recommendations of the 7th CPC and explained our demands both in writing and orally before the Empowering Committee. Most of the meetings were monologues except perhaps the last one. What we have understood, is that, the Empowering Committee might not come forward to make any major changes. A fruitful meeting is supposed to be a dialogue where both parties at the negotiating table exchange their understanding, views and difficulties and reach a mutually acceptable position. In 1998, when the then Cabinet Secretary decided not to have such a dialogue with the Staff Side and unalterably issued the Government Notification on the 5th CPC recommendations, the then government did set up a committee of Group of Ministers. The GoM held discussions on all issues and averted the strike action. The 1998 situation establishes, without an iota of doubt, that, the Staff Side has always taken reasonable stand on all the issues and paved way for settlement.

The one and only recommendation made by the 7th CPC was to provide some relief to the past old pensioners. The Department of Pension & Pensioners’ Welfare has unfortunately recommended to the Cabinet Secretary that, even that recommendation must be rejected on the specious plea that the requisite relevant records might not be available.

These developments have caused anguish, anxiety and anger amongst the workers. It is now more than six months that the Commission submitted its report. If the government comes forward to hold a meaningful discussion with the leaders of the NJCA, a mutually acceptable settlement can be brought about and the impending strike, slated to commence from 11.07.2016, can ultimately be avoided.

Grant of Interim Relief to West Bengal State Government Employees Amounting to 10 % of their Band Pay.

After coming to power for the second time, the Mamata Banerjee led government on Friday announced a grant of interim relief to state government employees amounting to 10 percent of their band pay.

"In our first cabinet meeting, we have decided to provide a grant of interim relief to state government employees amounting to ten percent of the band pay drawn by them," said state Finance Minister Amit Mitra.

"This will be effective from July and will cover state employees, teachers, local government employees and pensioners," he said.

"The interim relief is small in nature but the net impact to the state exchequer will be around Rs.3,000 crore," said Banerjee.

The difference in dearness allowance for state employees compared to their central counterparts stands at 50 percent.

Banerjee had announced a 10 percent hike in dearness allowance for the state employees from January reducing the difference to 44 percent. Later in March, the centre hiked the allowance by another six percent.
The government in its first stint had announced the Sixth Pay Commission to review the pay structure of state government employees.

Sub: National JCA Meeting held on 8th June

The National JCA, which met at the Staff Side Office on 8th June, 2015, took note of the fact that quite a few states are yet to hold the State Level Conventions. The meeting also noted that the strike decision taken on 28th April, 2015 has not been percolated down to the rank and file of the workers. The meeting wanted the affiliate to realize that the denial of the demand for wage revision to be effective from 01.01.2014 and the consequent denial of interim relief and the benefit of merger of DA with Pay must be viewed very seriously as the said decision will have far reaching consequence. The Government would discard the age old practice of grant of I.R. and merger of DA forever. It has decided to appeal to all the affiliates to chalk out independent programmes of actions in the months to come and to carry out the same in all seriousness so that the employees become fully aware of the possible outcome of the 7th CPC. The Chairman and Convenor of the National JCA will get in touch with those States, where the convention has not been held so far. The meeting decided to convey to members that the minimum wage computation, in the given situation would be on an imaginary basis. The National JCA was of the opinion that a meeting of all office bearers of the participating organizations must be convened at Delhi somewhere in the month of July to chalk out programmes of action to be pursued by the CGEs together. It was informed at the meeting that both Defence and Railways would be taking their strike ballot and would be concluded in the first week of October. The meeting, therefore, decided to advise the other units to chalk out progammes of action in July so that an ambience of struggle could be created. The NJCA also took note of the painful fact that despite assurances, Government was not convening the National Council and Departmental Councils and the JCM has been allowed to become defunct. The National JCA in conclusion decided to appeal to all affiliates to take concrete steps to invigorate the joint movement of the Central Government employees and meet the challenge that is likely to arise on receipt of the recommendations of the 7th CPC by creating an atmosphere of Unity, and determination to carry out the call of indefinite strike action scheduled to commence on 23rd November, 2015.

RECORD NOTE OF THE MEETING HELD ON 25TH FEBRUARY, 2015
A meeting was held on 25th February, 2015 in Conference Room No.190, North Block, New Delhi with the representatives of the Staff Side under the Chairmanship of Secretary (Personnel). A list of participants who attended the meeting is annexed.


2.At the outset, the Chairman welcomed the representatives of the Staff Side and Official Side and expressed his firm belief and conviction that all the issues/demands can be resolved through the consultative process. He also indicated that the next (47th) meeting of the National Council (JCM) is likely to be scheduled soon under the Chairmanship of Cabinet Secretary. Thereafter, the Chairman invited the Leader and Secretary of Staff Side for their opening remarks.

3. Shri M. Raghaviah, Leader of the Staff Side welcomed the new Chairman. He thanked the Chairman and conveyed the appreciation of the Staff Side for convening the meeting. He mentioned that presently JCM is almost defunct which has caused much anguish and frustration. He observed that the basic framework for which Joint Consultative Machinery (JCM) has been set up is defeated if meetings are not held and no result oriented interaction takes place. He complained that even issues agreed upon do not result in appropriate orders being issued by the Government and cogent replies are not given in case of rejection of proposal.

4.While thanking the Chairman, the Secretary Staff side, Shri Shiva Gopal Mishra, stated the anguish of the Central Government Employees about communication deadlock. He also mentioned that no dialogue policy of the Official Side has left the Staff Side with no option except to agitate the issue. He further mentioned that no date has been fixed for National Anomaly Committee and that no meeting of the National Council has been fixed till date.

All the above shows that the government does not want to resolve the problems of the Central Government Employees in a peaceful manner and this is the reason that all the constituents of National Council JCM had decided for sustained struggle with massive demonstration before the Parliament on 28th April. He further hoped that, the Government will take a note and will resolve the issues raised in their Declaration.

5.It was also pointed out by other Members from Staff Side that many anomalies of 6th CPC have not been resolved and since 7th CPC has been constituted, this has become an excuse to keep the anomalies pending as they stand referred to the 7th CPC. I confrontation is to be avoided, the legitimate demands should be settled and action taken on agreed area like stepping up of pay in the matter of pay fixation anomaly. They pointed out that since meetings of the JCM are not held regularly, it gives the impression that the government is not interested to settle the issues positively and the JCM is being treated casually. This is a painful situation as even Departmental Council meetings are not taking place which leads to plethora of litigations. It was also brought out that a Memorandum was submitted earlier by Staff Side for merger of DA and interim relief in view of the erosion of the value of rupees and cost hike. Thereafter, the issues as per the Charter of Demands were taken up for discussion.

1.Effect wage revision of Central Government employees from 1.1.2014 accepting the memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA. Ensure submission of the 7th CPC report with the stipulated time frame of 18 months; include Grameen Dak Sewaks with the ambit of the 7th CPC. Settle all anomalies of the 6th CPC.

The Staff side stated that a memorandum was submitted to 7th CPC for merger of DA and Interim Relief, and the Commission has forwarded the same to the government. Now, the government must take a decision on the memorandum itself or amend the terms of reference to enable the CPC to make their recommendations on the twin issues. Staff Side also pointed out that there was no laid down periodicity rule setting up of Pay Commissions but by convention it has been done after every ten years. The Staff Side stated that the wage revision must be made every five years as is the case in the Banking and Insurance Sector and other Public Sector Undertakings. With regard to the 7th CPC recommendations, the staff side wanted these to be given effect from 01.01.2014.

Regarding Grameen Dak Sewaks, the staff side wanted the Government to amend the terms of reference of 7th CPC to include Gramen Dak Sewaks as a category of employees as the Supreme Court has declared them as holders of civil post.

It was also submitted by the Staff Side that Interim relief is not part of the TOR of CPC. However, it can be made as part of the TOR even now by the government. Staff Side was of the view that the Interim Relief should not be linked to the delay in the submission of the report by the CPC but should be construed as necessary in view of the erosion of the real value of wages on account of inflation. This was noted by the Chairman.

2.No privatization, PPP or FDI in Railways and Defence Establishments and no corporatization of postal services;


The Staff Side shown its concern on silence of the Government of India on their demand for trans discussion on FDI and PPP. Staff Side vehemently opposed 100% FDI in the Railways and 49% FDI in Defense Establishment. The Staff was advised to meet and discuss the issue with the concerned departments.

3. Non-resolving of the issues as referred by the Ministry of Railways to MoF(Exp.)

With regard to the demand for setting the anomalies of 6th CPC, the staff side submitted that the Ministry of Railways had sent certain proposals to the Department of Expenditure on which no action has been taken till date. The Grade pay based MACP has created administrative and other problems in Railways and they added that there was no cadre with the grade pay of Rs.2000 in Railways. The staff side also pointed out that the decision to hold the meeting of the NAC has not been honoured so far. The Official Side stated that the proposals of the Ministry of Railways will be sorted out between Railway Board and Department of Expenditure. The Staff Side further stated that there are several items in the NAC pending settlement. Some agenda items have not been subjected to discussion even once. The Chairman agreed to convene the meeting of NAC shortly.

4. No Ban on recruitment/creation of post.


Regarding ban on recruitment, the Official side stated that there is no ban on recruitment. They further stated that with regard to ban on creation of posts, exceptions are made for operational needs.

5. Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.


The Staff Side submitted that the Supreme Court had declared pension as one of the fundamental rights. The Government should, therefore, retrace from its avowed position, which is detrimental to the interest of the employees and ensure that the employees recruited after 1.1.2004 is covered by the existing statutory defined benefit scheme and rescind the PFRDA Act.The recent decision of the Cabinet to allow FDI in pension fund operations has made the real intent of the PFRDA Act unambiguously clear. The FDI will facilitate the mutual fund operators to invest the funds outside India. It is clear that the decision behind the contributory pension scheme was the pressure imposed on Government and taken without consulting Staff Side and therefore it is to be opposed at all cost and with vehemence. The Govt. should not go ahead with its intention of induction of FDI in pension fund companies. The Staff Side demanded to (i) restore the old pension scheme. (ii) abolish PFRDA and amend the New Pension Scheme. The proposal from the Ministry of Railways regarding replacement of National Pension scheme (NPS) with Old Pension Scheme was sent to Ministry of Finance on 29.0.2014, which needs to be agreed to. The Department of Financial Services gave details on the scheme, asserting the comparative benefits of the contributory pension scheme, Reacting the presentation, the staff side requested that official side to make the contributory pension scheme optional and the employees might opt for the same if the new scheme is beneficial as presented by the official side. It was decided that the staff side will discuss the issue with the Department of Financial Services further.

6.No outsourcing; contractorisation, privatization of governmental functions; withdraw the proposed move to close down the Printing Presses; the publication, form store and stationery departments and Medical Stores Depots; regularize the existing daily rated/casual and contract workers and absorption of trained apprentices;

Staff Side demanded that due to the ban on creation of posts and recruitment of personnel continuing for a very long period, there was consequent strain on the existing workers and many Departmental heads had to recruit personnel on daily rated basis or as casual workers. Thus, almost 25% of the present work force in Governmental organizations are casual workers deployed to do the permanent and perennial nature of jobs, contrary to the prohibition of such unfair labour practices by the law of the land. In fifties and sixties, even the casual workers who had been employed to do the casual and non perennial jobs used to get priority for regular employment as and when vacancy for such permanent recruitment arises. Thousands of persons are now recruited as casual workers and kept as such for years together. As per information now made available on the floor of the Parliament, the number of contract workers engaged by various public sector undertakings and Governmental organizations is very large. They are paid pittance of a salary with no benefits like provident fund, DA and other compensatory allowances etc. In order to ensure that they do not get the benefit of regularization, these workers are technically discharged for a few days to be employed afresh again. The modus operandi differs from one department to another.

Staff Side demanded that privatization and corporatization must not be allowed. It was informed by official side that the meeting in the Departments of (Railways & Postal) have taken place in this matter and dialogue is continuing.

Regarding Printing Press, representative of Ministry of Urban Development stated that it was looking into it in a holistic manner and no final decision has yet been taken on privatization of printing presses.

The Ministry of Health representative said that there was no plans to close the Medical Stores Depots. A Society was being floated for better supplies of medicines. It was decided that Staff Side will have a meeting with Ministry of Health & Family Welfare/Ministry of Urban Development separately.

7.Revive the JCM functioning at all levels as an effective negotiating forum for settlement of the demands of the Central Government Employees (CGEs).

This issues was not discussed.

8.Remove the arbitrary ceiling on compassionate appointments.

The Staff Side has submitted that on the plea of a Supreme Court directive, Government introduced a 5% ceiling on the compassionate appointments. When the matter was taken up by the Staff side in the National Council the Govt. was not able to produce any such direction of the Supreme Court. Despite that, the official side refused to withdraw the said instructions limiting the appointments to 5% of the available vacancies. In one of the National Council meetings, presided over by the Cabinet Secretary solemn assurance was given to the Staff Side that the issue will be revisited in the light of the discussion, but nothing happened thereafter.It is pertinent to mention in this connection that the compassionate appointments in the Railways continue to be operated without any such ceiling. In the Department of Posts hundreds of candidates selected by Selection Committee were denied jobs. Some candidates approached the Court and obtained favorable order. But the Court detective was made applicable to only those who approached the Court. Such an assurance is being breached by the provisions of limiting such appointments to 5% of vacancies therefore must be done away with.

It was agreed that DoPT will revisit the issue.

9.Other issues were deferred for next meeting.

10. It was agreed that the pending issues on the National Anomaly Committee would also be discussed further. In the case of MACP issues, Ministry of Railways would be requested to respond to the same in consultation with DoPT and Department of Expenditure. As regards, the issue relating to stepping up of pay Department of Expenditure would be requested to respond to the issue.

11.Staff Side Members from the Ministry of Defence flagged the following issues for reconsideration by DoPT:-

(i) As per provisions of CCS(RP) Rules, 2008, merger of unskilled and Semi-skilled in the Workshop Staff has taken effect from 01.01.2006. Accordingly, as per DoPT guidelines, ACP granted to the labourers (Unskilled and Semi-skilled) of Ministry of Defence may be reviewed, for which an exemption of trade test is required. The MoD recommended the case of DoPT for their approval, however, DoPT has rejected the case on the plea that the ACP, already granted, need not be reviewed since merger of the Unskilled and Semi-skilled has taken place from 01.09.2008.

(ii) Defence Civilian Employees are always paid a higher rate of Risk Allowance when compared to other Central Government Employees since they are working in highly hazardous and risky jobs. Risk Allowance rate of Defence Civilian Employees may be revised to 6th CPC pay scales.

(iii) CAT, Principal Bench and also Supreme Court have ruled that Night Duty Allowance of Defence Civilian Employees may be revised in 6th CPC pay scales. However, judgments are not implemented.

For the past few years, a solution hasn’t been found to the problems faced by the Central Government Employees. The National council JCM formed for the grievances of Central Government Employees has been totally disabled and the NC JCM meeting has not been held for the past five years.

The Pending demands of the Central Government, which include the merge of Dearness Allowance with Basic Pay, the enforcement of Old Pension Scheme in the place of New Pension Scheme, Interim Relief, Filling up of Vacancies, Increasing the bonus range, Promotion Opportunities, etc didn’t yield to a decision, hence the Railway, Defence (Civil Employees), Postal, other Central Government Sectors are forced to give a presentation in the Parliament under NC J.C.M. on 28th April 2015.

We Central Government Employees whether in Railways, Defence, Postal Department or other Central Government Sectors, are working with complete devotion towards service to the society and progress to the country. Dear Comrades,

The 7th CPC had asked the JCM Staff Side to present their case before the Commission for wage revision on 23rd and 24th March 2015. Accordingly, the Standing Committee of the Staff Side met on 22nd March and again 23rd March 2015. The presentation was made on 23rd and 24th March 2015 before the Commission.

We have discussed the memorandum, chapter wise and the Commission made a very patient hearing and interacted with us seeking clarifications on certain matters. It is not possible to provide a detailed account of the discussions. However, we are to inform you that we came out of the discussion with a very good impression and satisfaction.

1. The Commission will adopt Minimum Wage Concept(Dr. Aykhrod Formula) as the principle of wage determination. They will however, collect the retail rates of the commodities that go into the basket.

2. We have pleaded for the adoption of the best international practices while fixing the highest salary.

3. On the demands for Interim Relief and Merger of DA, the Commission finally said that those can only be considered if Terms of Reference are amended.

4. The Commission agreed that there had been reduction in the sanctioned strength and working strength over the years despite the increased workload.

5. They have also noted that there was substantial reduction in percentage terms of the expenses on salary and wages over the years.

6. The Commission enquired, as to how multiplication factor of 3.7 was arrived at. The same was explained in detail.

7. Fitment Formula and the demand on Fixation of Pay on Promotion, were appreciated as the rationale was explained.

8. Date of effect: No commitment or comment was made by the Commission. The Staff Side explained, as to how they compromised by shifting the date from. 01.01.2011 to 01.01.2014.

9. The institution of Special Pay, especially in the wake of de-layering was explained.

10. Common Categories: We have requested the upgradation and amalgamation of the cadres of LDC with UDC and the need for bringing about parity in pay scales of the Subordinate Offices with the Central Secretariat. The problems of Staff Car Drivers were also elaborated. The contractorisation and casualisation at lower level positions and the consequent exploitation of the labour were discussed at length. The Commission has made a proposal to do away with the contractorisation/casualisation. Staff side will discuss the proposal and will send its views to the Commission in due course.

11. Classification of Posts: Our proposal has not been found favour.

12. GDS: While sympathizing with the Staff Side, the Commission wanted them to approach the Government with a view to amend the Terms of Reference.

13. Allowances and Advances: Detailed discussions were held on HRA, CCA, Transport Allowance, CEA and Special Allowance for personnel posted at North East Region. Chapters dealing with the facilities was also discussed at length, including compassionate appointment. On holidays, we have requested to include May Day in the list of holidays. The background of observance of May Day was enquired by the Commission and explained.

14. Pension and Retirement Benefit – NPS: Commission stated categorically that NPS being an Act of Parliament, they will not make any comment thereon.

Pension Computation: The rationale of 67% was explained and appreciated.

Minimum Pension: our demand for 2/3rd of the Minimum Wage was also explained.

Parity in pension of past and present pensioners was fully explained, linked with one rank -one pension scheme for Defence Personnel. We have pleaded that Civilian Pensioners should not be discriminated against. Demand for Additional Pension for both Pensioners and Family Pensioners was explained. All matters concerning Family Pension were also discussed. So also, gratuity to be computed in accordance with the Gratuity Act.

There was good response for the demands from the Commission.

Restoration of commuted value of pension: The Commission will enquire the views of the Government as to what is their objection to the demand.

Medical facilities for pensioners and discrimination between Pensioners in CGHS area and CCS(MA) Area as also the Postal Pensioners was brought home including the higher Fixed Medical Allowance for ESI persons.

Certain clarifications/elucidations have been asked for by the Commission. To provide such clarifications, another meeting with the Commission might be held after the Commission’s interaction with other organizations. The Staff Side may meet the Commission after their interaction with the other organizations are over.

Dear Comrade

The Standing Committee of the Staff Side, National Council has interaction with the 7th CPC on 25th Feb. 2015 followed by the Standing Committee meeting of National Council (JCM) with the Secretary DOPT in the afternoon. The meeting with the Secretary Personnel came as a result of the decisions that we have conveyed for organizing March to Parliament and other programmes, culminate as a pre pretretory meaure for an indefinite strike. The agenda for discussion with the Secretary Personnel was, therefore, the charter of demands (10 points) we had submitted to the Government after the National Convention of all Central Government Employees Organizations on 11th December, 2014. The response from the Government undoubtedly establish the fact that ultimately they have taken note of the growing discontentment of the Central Government employees manifested through various programmes we have jointly carried out by this time. We, therefore, earnestly request the affiliates and leaders of various organizations at the field formations to intensify the ongoing programmes to compel the Government to settle our demands. We give hereunder a brief resume of the discussions we had with the Pay Commission and the Secretary Personnel, which is indicative of the reflections of both the entities.

Meeting with the Pay Commission:
The Chairman informed of his inability to take a final decision on the question of merger of DA and Interim relief as the Government has not referred this matter to them and further stated that this Govt. can take decisions on the two issues, without any report from the CPC. He added that the memoranda received from the staff Side on these two issues had been forwarded to the Government. He wanted the staff side to take up the matter with the Government and assured that on receipt of the reference from the Government they would consider the matter without any loss of time. However, they indicated that the Commission would strive to submit their report to the Government within the stipulated time frame and therefore, the question of Interim relief, in his opinion should not arise at all. The Staff side requested him to appreciate the fact that the matter concerning merger of DA and interim relief has been raised by them not on account of the possible delay on the part of the Pay Commission but emanated from the fact that the erosion in the real value of wages of the Central Government has been eroded during the period drastically.

On Oral Evidence:
The methodology to be adopted by the 7th CPC in the matter was discussed at length. It was ultimately decided that the Staff Side after considering the viewpoints expressed by the CPC will draw out a plan both for the National Council Staff Side and for the organizations at the Departmental levels. The scheduled date for meetings with the Pay Commission will be finalized after Holi festival i.e. 5th March, 2015. The Staff Side will discuss the matter and will submit its consensus view to the Commission soon in this regard. In any case, the staff side would require the following information immediately at its office.
1. Name of the organization which has submitted its memorandum to CPC with date of submission.
2. Underwhich Ministry the Department function
3. Whether the organization is recognized or not
4. The number of employees, whom the organization represents
5. The total – Group C and Group B Non Gazetted – strength of the concerned Department.
Inclusion of GDS
The Chairman assured that he would go through the Supreme Court Judgment in the matter. However, fie added that the inclusion or otherwise of the GDS within the purview of the 7th CPC is the prerogative of the Government and except making its opinion clear on the subject he might not be able to do anything further in the matter.
Standing Committee meeting with Secretary Personnel: There had been no tangible result in the discussions. The impression gained was that the staff side was invited to show that the dialogue continues, However, we give here under the response of the Government in respect of the issues subjected for discussion. The rest of the issues in the charter will be discussed later on at another meeting, for which the date has not been indicated.

1. Interim relief, Merger of DA, Date of effect, Inclusion of GDS in the ambit of 7th CPC; Settlement of anomalies; The views expressed by the official on each of the above items are as under

a). Interim relief is normally given if there is an apprehension of abnormal delay. Government has been informed by the 7th CPC that they would adhere to the time schedule.
b). DA merger: Since the Pay Commission would be submitting its report soon, the question of merger of DA would automatically be in-built in their recommendation.
c). It is the prerogative of the CPC to recommend the date of effect. Govt.’s role will come only after the recommendations are received.
d). GDS: Govt. has not considered the GDS as Civil Servants. However, the latest recommendation received from the Postal Department in the matter is said to be under the consideration of the Govt.
e). The National Anomaly committee will meet again shortly and the resolution on agreed items would be expedited.

2. FDI and Privatization of Railways and Defense factories and Corporatization of Postal: The Staff Side was advised to take up the issue at a higher level as the issues raised were said to be policy matters.

3. No ban on recruitment.: The official Side clarified that the Govt. has not instituted any ban on recruitment. There is only ban on creation of posts. However, for operational posts, exemption has been provided in compelling situation.

4. Scrap PFRDA Act.: The official side will look into the letter received from the Railway and Defence Ministers. The scrapping of the Act was said to be not within the scope of discussion. The Joint Secretary Financial Services explained the various provisions of the Act and as to how the contributory pension scheme would be beneficial to the subscribers. The Staff Side requested the Government to make it optional that anybody who feels that the new scheme would be beneficial would opt for it and others will have the opportunity to opt out and adopt the old defined benefit scheme scheme of Pension.

5. Closure of Medical Stores Depots and Printing and Stationery Departments : It was categorically cleared by the Govt that there had been no decision to close down the Printing Presses and Stationery Department. In view of the new situation in which all Departments are permitted to purchase the requisite stationery items from the market, the Urban Development Ministry has suggested certain modernization and restructuring the of Stationery Department. The Govt. was prepared to discuss the details thereof and arrive at an amicable settlement, acceptable to the Staff Side. The official side expressed willingness to discuss the matter with the staff Side of the concerned Department along with the 3 (three) members of the standing Committee. In respect of Medical store depots also, the official side clarified that the department would not be closed down and no employee will be retrenched. They also wanted the staff side to meet and discuss the issue with them to clear the doubts and suspicion in the matter.

6. Active Functioning of JCM : The Government will convene the meeting of the National Council soon. the convening of the Departmental Councils would be taken up with the concerned Departmental heads. The delay in the grant of recognition may be brought to the notice of the Department of Personnel for corrective action at their end

7. Compassionate Appointment : Government will consider lifting of the ceiling of 5% but no assurance was held out. The other issues in the charter will be subjected to discussion later on.

PUDUCHERRY: The Confederation of Pondicherry State Government Employees Associations has urged the Central government to announce an interim relief and merger of Dearness Allowance with the basic pay.

Confederation honorary president, C H Balamohanan, told reporters that the BJP-led Central government is yet announce the interim relief for the employees ahead of the implementations of the recommendations made by the pay commission.

The Seventh pay commission which was set up on January 1, 2014 by the previous Congress government will take at least 18 to 24 months to submit the final recommendations. In the meantime, the government should have announced the interim relief with retrospective effect, but steps were not taken in this direction, Balamohanan said.


Meanwhile, the Confederation honorary president, Balamohanan added that steps were not taken to merge the Dearness Allowance (DA) with the basic pay as in the last announcement, it was 7 per cent hike, taking it to 107 per cent of basic pay.

The Confederation honorary president also informed that on March 2, a dharna will be held in front of Head Post Office by the activists of the confederation and will hand over memorandum consisting of charter of demands to the Chief Secretary.

He added that the representatives of the confederation will take part in the parliament march on April 28 pressing the central government for the implementation of the pay commission recommendations.

Meanwhile, it may be noted that the Union Territory of Puducheryy has 25,000 government employees, who are having the same service conditions as that of the Central Government.

The JCM Staff Side delegation met the Chairman, Seventh Central Pay Commission, 25/02/2015 at 11:00 hrs. The following issues were raised :-
i. Merger of DA with Pay and grant of Interim Relief :-
The JCM Staff Side insisted that the Pay Commission should consider Staff Side memorandum submitted in the month of June 2014 and recommend DA merger. The Chairman, 7th CPC replied that there is no communication from the Government of India to give interim report on DA merger demand. After discussion, the Chairman 7th CPC has decided to send D.O. letter to the Government today conveying the strong protest of Staff Side/JCM.
With regard to grant of Interim Relief, the Chairman heard the point of view of the Staff Side JCM that it is only “provisional payment in view of market situation and urged upon the Commission to send suo-moto recommendation to the Government.
ii. Allotment of time slots for explaining the case of Central Government Employees as well ‘ Departments like Railways, Postal, Defence (Civil side) etc.,
The Chairman suggested that small committees may be constituted by the Staff Side for meeting the Pay Commission for deliberations and enough time will be given. He also said that the Memorandums given by JCM, Federations/Unions/Associations have been gone into by the Pay Commission fully. He further said that VII CPC will meet the teams from each department and hear their proposals.
Responding to this, the JCM Staff Side has agreed to make out the proposal for the purpose of facilitating the Pay Commission to hear the views/submissions of the Federations/Unior/Associations. The deliberations may commence somewhere after 15th March, 2015. Staff Side JCM will prepare time schedule proposal and send to Pay Commission accordingly.
iii. Gramin Dak Sewaks – The case was explained. The Pay Commission was suggested that the copy of Supreme Court Judgment may be made available for examination.

1. Withdraw FDI, PPP in Railways – Stop Out Sourcing, Contractorisation and Privatization.
2. Scrap New Pension Scheme in Railways and restore liberalised pension scheme.
3. DA merger with pay with retrospective effect and payment of Interim Relief to Central Government employees (serving and retired).
4. Calculation and payment of Productivity Linked Bonus (PLB) on actual wages.
5. Transport Allowance be exempted from the purview of Income Tax.
6. Increase contribution to Group Insurance Scheme (GIS) by atleast 10-times for all Government employees.
7. Merge Technician-II with Technician-1 with Grade Pay Rs.2800/- (PB-I) in Railways.
8. Revise entry grade pay of Station Masters as Rs.4200/- in PB-2.

23. Remove hardships being faced by Train Controllers.
24. Reduce Duty Hours of Nursing Staff, thus honour Government’s decision.
25. Create ticket checking staff posts for manning trains.
26. Casual Labour acquired temporary status prior to 01/01/2004 should be covered under Liberalised Pension Scheme.
27. Implement norms approved by Railway Board and sanction new posts of SSE/JE (Signal), ESM, Helper (Signal) etc.
28. Amend Rules for providing employment to Wards of Employees.
29. Provide quality Health care to employees, their families besides retired employees.
30. Fill vacancies of Doctors, Para Medical Staff and provide Super specialists in all Railway Hospitals — enhance superannuation age of Railway Doctors.
31. Cover all Railway employees under Incentive Scheme in Workshops, PUs etc., wherever not covered.
32. Grant parity in Pay Structure for Stenographers in Railways at par with CSS/RBSS.
33. Training Allowance should be revised to 30% of pay in all Training Centres/Schools.
34. Implement agreement on stepping up of pay of Loco Inspectors.
35. Review SPAD definition – Prevent harassment and victimisation of Running and safety categories staff.
36. Make upward revision of Income Tax exemption limit in the case of running staff.
37. Running Rooms should be improved, air-conditioned and upgraded on priority.
38. Grant Project incentive allowance to the staff working in projects on Indian Railways.
39. Negotiating foras of PNM, DC/JCM & NC/JCM should be made effective for resolving issues speedily – Implement agreements reached in PNM, DC/JCM & special meetings etc., immediately.
40. Ensure creation of posts in safety/operational/public image categories for manning new services and maintaining new assets without linking to matching surrender.
41. Grant Daily Allowance to Staff Car Drivers.
42. Absorb quasi administrative units/offices staff against posts in GP Rs. 1800/- PB-1.
43. Induct Course Completed Act Apprentice against vacancies.
44. Ensure quality Uniform to all employees and supply of quality protective gears — concede NFIR’s proposals.
45. Grant Patient Care Allowance to all para-medical staff.
46. Provision of single woman Hostel facility at all Divisional Headquarters and important stations.
47. Setting up of a multi-disciplinary training institute for imparting training in rail related electronic technologies for the wards of Railway Employees.
48. Extension of medical facilities to the dependent parents of railway employees.
49. Liberalize compassionate appointment provisions.
50. Remove restrictions on payment of Children Education Allowance/Hostel subsidy.
51. Allot adequate funds for maintenance of Railway Quarters as well as construction of new quarters.
52. Introduce warning/ Hooter system to prevent deaths of Track Maintainers etc., while on duty.
53. Grant Study leave with attendant incentives liberally o the employees for pursuing higher studies.
54. Enhance Night Patrolling Allowance for Track Maintainers.
55. Allot Pay Band-4 to Junior Administrative Grade Officers in Railways.

    Government employees to have nice budget this year 
New Delhi, Government would have to bear burden of Rs. 10000 crore rupees in case deaness allowance of central government employees is merged and till the implementation of seventh pay commission report government will neither give interim relief nor merge dearness allowance in basic pay for central government employees. Central government has flatly refused to give two thousand interim relief to 34 lakhs of its employees. Chairman of seventh pay commission Justice Ashok Kumar Mathur has refused to oblige on this issue. He further reiterated that provision of giving interim or merger of dearness allowance hasn't been there in the terms of reference for seventh pay commission. Pay commission has asked representatives of employee union to move to dopt or Ministry for Finance for interim or da merger. Representatives of Joint Consultative Machinery then met the oflicials of DOPT and Ministry of Finance on the issue, but both department refused to give any assurance on these issues, rather assured JCM members that pay commission report will be implemented on time.

But employees’ unions are not impressed; JCM says that no pay commission has ever presented its report before two years. Employees’ unions are also raising the demand to resolve the anomalies of sixth pay commission which are still lying pending. JCM members also demanded that interim relief may be taken into account in the report of seventh pay commission; this has also been out rightly rejected by government. JCM had requested to merger dearness allowance with effect from lst January 2014. Total expenditure on interim relief and merger of dear allowance will respectively be Rs. 800 crore and ten thousand crore. On the other hand pay commission is doing its work on the daily routine basis. Pay commission has recently visited Kolkatta and Andaman Nicobar islands on Jan 11 14 respectively. Now the pay commission has decided to have evidence meeting with JCM staff side in February.

Till date central government has notified six pay commissions before notifying seventh in February 2014. First central pay commission was notified in 1946, Second CPC in 1957, Third CPC in 1970, Fourth CPC in 1983, Fifth in 1994 and sixth in 2006.
    Government employees to have nice budget this year
Ahead of his first full fledged budget, the Finance Minister Arun Jaitley today said that the NDA government was against raising revenue by imposing higher taxes, instead it would want to leave more money in the hands of consumer to fuel demand and growth. The minister also pledged to make the budgetary process more transparent so as to present the real picture of public finances before the people. “High taxation is not the only route to achieve the target of larger revenue we are not going to take this route,” Jaitley said while speaking at a fianction of private news channel CNBC Awaaz. He was replying to a question whether it was possible to increase the income tax payer base from from 3.5 crore to 15 crore. “We believe that the consumer should have money in hand and by spending that money, production will increase and the country will be benefited,” the minister said. The government raised income tax exemption limit from Rs. 2 lakh to Rs. 2.5 lakh in the last budget, he said.

Dear Sir,

I solicit your kind attention to my letter in No.NC/JCM/2014 dated 16 th December, 2014, wherein we had conveyed the decisions taken at the National Convention of representatives of the organisations participating in the JCM. We are distressed that you have chosen not to respond to our letter till date. We have so far not received any communication from any quarter of the convening of the National Council of the JCM. No effort has also been taken by any Ministry to convene the Departmental Councils.

We have now been given to understand that the Government has taken serious steps to set up a corporation to carry on the functions of the 41 ordnance Factories, presently functioning under the Ministry of Defence. We have also noted that the report of the Committee set up by the Government to corporatize the functions of the Postal Department. The inordinate delay in settling the demands for Interim Relief and Merger of DA is causing distress amongst the Central Government employees. The Railwaymen are particularly agitated over the decision of the Government to induct FDI to the extent of 100% in Railways, which we are aware cannot be done without privatisation of the Railways. The declaration of the Convention, which we had forwarded to you vide our letter cited had amply explained the anguish of the Central Government employees.

In order to register our opposition to the recent decision of the Government to corporatize the functions of the Ordnance factories, we have amended Item No.2 of the charter of demands. We send herewith the revised charter of demands.

The National JCA met today and took note of the silence on the part of the Government to our pleadings. The meeting has, therefore, decided to go ahead with the agitational programmes, the first phase of which will culminate in a massive March to Parliament by Central Government employees on 28th April, 2015. If no settlement is brought about on the 10 point charter of demands, we will be constrained to go for an indefinite strike action, the date of commencement of which will be decided on 28 th April, 2015.

Dear Comrades,

As scheduled, the meeting of the National JCA was held at the Staff Side office today, i.e. 11th January, 2015. The list of members who attended the meeting is annexed to this communication. The meeting was chaired by Com. M. Raghavaiah, General Secretary, National Federation of Indian Railwaymen. The meeting made the following observations and took the following decisions:

The Statement made by Shri Narendra Modi, Honourable Prime Minister of the country at Varanasi to the effect that the Railways would not be privatised was misleading and intended to create confusion in the minds of the Railwaymen, especially in the background that the proposal to induct FDI in Railways to the extent of 100% is being pursued vigorously.

The Government has decided to set up a Corporation to carry on the functions of the 41 ordnance factories under the Ministry of Defence.

Except in a few States, the steps required to be taken for form the State level Committees of the JCA have not been undertaken.

In order to expedite the formation of such committee in all States, the NC JCM website will carry the names and addresses of the State leaders of the participating organisations

The Zonal Secretaries of AIRF will be asked to ensure that such committees are formed at all State Capitals before the end of this month and the convention is held on a mutually convenient date for all but before 15th February, 2014.

District conventions or March to Collectorates will be organised by the Committee in all District capitals of the country.

The entire month of March and the first half of April will be utilised for campaigning amongst the employees at all work- spots.

The March to Parliament will be organised on 28th April, 2015.

Every effort will be taken to reach a target of 5 lakh workers to participate in the said March. Target quota for each organisation will be fixed.

The State Committees will advise the National Convenor as to which organisations (those CGE organisations who are not presently participating in the JCM must be addressed to join the movement.

The State Committees after the convention will hold Press Conferences to give media publicity to the decisions taken including the decision to go on indefinite strike action.

The National JCA will hold a Press Conference at Delhi prior to the March to Parliament programme.
The Charter of demands will be amended (Item No.2) to include the following words: “and ordnance factories under the Ministry of Defence.”

Reminder letter will be sent to the Cabinet Secretary expressing distress over his silence and the non convening of the National Council, Anomaly Committee and Departmental Councils of the JCM.
The Convenor reported that the 7th CPC has informed him of their intention to convene the meeting of the organisations for tendering oral evidence in the month of February, 2015.

Even though the Seventh Pay commission was formed by the Manmohan Singh government before the advent of Election for the sake of a Political advantage, this was pleasant news for the Central Government Employees.

Soon after the formation, the Pay commission has also started meeting the relevant Employee Organisations. Meeting different organisations and obtaining their opinions are still in progress. The Pay commission has also visited various cities for this cause.

Meeting Employees and Organisations in different cities and understanding their living conditions is the general functional procedure of the Pay commission. It is to be known that the recommendation for House Rent Allowance is also given by the Pay Commission.

The Sixth Pay commission was released to the Employees in 2006. The recommendations of the Pay commissions are provisioned to be accepted after 10 years. Now the recommendations of the Pay Commission are to be implemented by the government before Janurary 2016.

Another important point for the Pay commission to work on is the Dearness Allowance which has already crossed 100 percent. It is a common practice that employees are given an Interim relief when the Dearness Allowance crosses 100 percent. This is also to be considered by the Government and the Pay commission.
Sources say that the declaration by the government may be done during or before the budget session. 

The pay commission is also taking a memorandum from the Employee Unions and Organisations. As always, even this time every Employee is looking forward to the Railway Federation, as the Railway Employee Union is believed to be very strong. It is believed that the conditions and directions of the Pay commission are influenced to a very large extent by the Railway union. The defence organisation is also very strong, but they didn’t accept the conditions of the Sixth Pay Commission, and later their pay scale was modified. For this reason, all the Central government employees have fixed their sight on the Railway Union.

This time, Railways has been divided into two big Employee unions for the sake of Pay. Now, only time can tell how fruitful will this strategy will prove to be.

Sub: Holding of National Convention of the National Council (JCM)(Staff Side)

As you are aware, the Staff Side, JCM National Council had, as desired by the 7th CPC, submitted a separate memorandum on Interim Relief and Merger of DA, copy of which had also been sent to the Finance Ministry. During the Informal Discussions the Staff Side had with the Pay Commission, they had assured us to take up the issue with the Government seeking amendment to the Terms of Reference to enable them to act upon our memorandum.

We have received reply from the Finance Ministry, which is indicative of a refusal of both the demands. The NDA Government has adopted the same plea made by the UPA II Government to reject our demands. The 7th CPC have so far not communicated to us, the decision they have taken on our memorandum.
From the steps so far taken by the BJP Government, it is unambiguous that they would be pursuing the neo-liberal economic policies with much more intensity than even the UPA Government. Having got a clear majority in the Parliament, they would be able to push through necessary legislations to pursue reforms. The outsourcing of Railway functions, privatization of Defence manufacturing Units, increased FDI inflow in various core sectors of economy, dismantling of the administrative price mechanism, de-nationalization efforts in the Banking, Insurance and Coal Sectors and above all the adherence to New Contributory Pension Scheme are some of the bold anti worker steps taken by the new Government.

The matter of fact approach and urgency which was visible in the initial days of the 7th CPC appears to have vanished. It is a matter of pride for all of us that we could submit our final memorandum on common issues to the Commission within the stipulated time frame. We are also happy to note that almost all service organizations of Central Government employees have endorsed our formulations on the wage structure and other service benefits. It is also a fact that all these organizations have submitted their memoranda on department-specific issues before 31st July, 2014. Despite having received such large number of memoranda, the 7thCPC has so far not commenced taking oral evidence giving an indubitable impression that the Commission might not be able to submit its report within the stipulated time of 18 months.

All these issues came up for the consideration of the members of the Staff side when they met a few days back. The unanimous opinion was to pursue the issues through organizational methods. Accordingly, it was decided to hold a National Convention, eliciting the participation of the representatives of all Service organizations participating in the JCM to discuss the emerging situation and decide upon future course of action. Incidentally, we must mention that the JCM conceived as a negotiating forum has been made ineffective by the Government over the years by not convening its meetings periodically.

The National Convention will be held at MPCU Shah Auditorium, Sree Gurjarathi Samaj, Raj Niwas Road, Civil Lines(Opposite Civil Lines Metro Station), Delhi, on 11th December, 2014. The Convention will commence at 12 Noon and will be concluded by 4.00 PM. 740 delegates will participate in the convention, of which 370 shall be Railwaymen(AIRF and NFIR), 150 will be Defence Civilian employees (AIDEF and INDWF) and the rest 220 will be represented by other Central Government employees (Confederation of Central Government employees and workers). The participating organizations will issue separate circular letter indicating the number of delegates of each Branch/Unit, Divisions/Zones, Circles/States, and affiliates may deploy to the Convention.

The Staff side will meet again to finalize the draft declaration to be placed before the Convention for discussion and adoption. The date and venue of the meeting will be intimated in due course.

Will the 7th Central Pay Commission present an Interim Report to the Central Government?
Why are central government employees so keen to know about the interim report?

A few months ago, excitement was sparked by an opinion expressed by the Karnataka Pensioners Association’s chief, Ramnath Rao, after his meeting with the members of the 7th Pay Commission.
He said that the chairman of the 7th Pay Commission had told him that an interim report would be presented only if the Government gives its direction.

Last month, on the 25th, the Ministry of Finance presented a written reply to a question raised during the Parliamentary session. The reply stated that the Government had given complete autonomy to the Pay Commission to function without any interference from them. The Commission has, until now, not presented any report to the Government. And, as stated in the Terms of Reference, the Commission will submit its report to the Government within the stipulated time.

Why this curiosity about interim report?
The transparency in the functioning of the Commission is a laudable one. The regular updates on its website about the Commission’s activities too have received positive response from one and all.

For more than three years, there has been a demand to add 50% Dearness Allowance with the basic salary of the Central Staff. After the demand for interim relief too has strengthened. All Central Government employees federations are fighting in order to get these demands fulfilled.

The Centre continues to reject these demands. The Government explains that 50% DA was added to the basic salary only because the 5th Pay Commission had made the recommendation. There were no such recommendations in the 6th Pay Commission. The Government has also clarified that interim relief will be granted only if the Pay Commission recommends it. It is under these circumstances that the Pay Commission’s interim report gains significance.

Nearly ten months have passed since the 7th Pay Commission was constituted. With only eight more months to go, it remains to be seen if an interim report will be presented. Even if a report is presented, will it recommend interim relief to the employees?

New Central Govt. under the leadership of our Hon’ble Prime Minister Shri. Narendra Modi has completed six months in office. As far as the common people and working class of this country is concerned, no positive action has been taken by the Govt. to mitigate their woes and grievances. Instead much negative steps are taken during this six months period.

Government has withdrawn the guidelines which controls the pricing of essential medicines through National Pharmaceutical Pricing Authority. As a result, the prices of essential medicines for treatment of cancer, blood pressure, colestorol, diabetics, heart-deceases etc will shoot up in the market. Prices of medicines for treatment of cancer itself which now costs Rs.8500 may go upto Rs.1,08,000/-. Pharmaceutical corporate companies are the beneficiaries.

Government has made its intention clear that the number of gas cylinders (LPG) per year will be reduced from existing 12 to 9 and also to link it to Aadhar and subsidies through direct cash transfer to Bank accounts. Earlier UPA Govt. has reduced the gas cylinders from 12 to 9 but subsequently it has been withdrawn the order due to widespread protests.

Govt. has deregularised the pricing of diesel. Earlier UPA Govt. has deregulated petrol prices and now the NDA Govt. has deregularised diesel price. Petroleum companies will now be free to decide the prices of petrol and diesel. Even-now the prices of petrol and diesel in India are 40% higher than the prices in the international market.

Govt. has decided to allow 100% Foreign Direct Investment (FDI) in Defence Production. Earlier this move of the UPA Govt. was opposed by NDA saying that it is against the national interest and security of the country. Defence production will now be completely privatised.

Govt. has decided to allow 100% FDI in Railways and also public-private-partnership (PPP). During his speech delivered in Australia Prime Minister has called upon the Industrialists of that country to country to invest in Indian Railways. Doors for privatisation of Railways is opened.

Govt. has decided to allow 49% FDI in Insurance sector. The bill for amending the Insurance Act for this purpose is pending in the Parliament and Govt. spokes person has hoped that the bill will be passed in this winter session of Parliament.

Govt. has decided to disinvest the share of all public sector nationalised banks upto 48%. Road map for privatisation of banking sector is drawn.

Govt. has made it clear that 100% FDI will be allowed in Pension Funds. The future of those who are under the New Pension Scheme will be uncertain due to Pension Fund Privatisation.

Govt has decided to sell the shares of profit making public sector undertakings such as ONGC, BHEL, coal India Ltd. etc to the tune of 25%.

Govt. has made it clear that Indian Post Office Act 1898 will be amended to facilitate grant of licences to multi-national courier services. This will pave way for privatisation of postal sector.

While extending red-carpet welcome to the corporates and multinational companies, the Govt. has declared that all the labour laws which put hurdles before them will be amended. Govt. has already moved in Parliament Labour Law amendments to remove all the protections and justifys now enjoyed by the working class including justify to strike and justify to form unions.

Government has declared that all the loss-making public sector undertakings will be closed or privatised. Air India, BSNL etc. are all in the hit-list.

Government has made it clear that its slogan is “minimum government and maximum governance”. It has imposed a total ban on creation of new posts and for filling up of posts which are lying vacant for more than one year.

Regarding Central Government Employees, none of their legitimate demands are conceded by the Government. DA merger, Interim Relief, Inclusion of Gramin Dak Sevaks (GDS) under 7th CPC, Date of effect of 7th CPC as 1-1-2014, Removal of 5% condition for compassionate appointment – everything stands rejected.

Regarding Postal employees none of the 39 demands raised by Postal JCA (NFPE & FNPO) is settled. Three lakhs GDS are still not included in the 7th CPC and their future is uncertain, Revision of wages of Casual, Part-time, contingent employees with effect from 01-01-2006 is pending before the Government from 2008 onwards. Cadre Restructuring, issues of Postmaster Cadre, Accountants, System Administrators, MMS etc. all pending or rejected.

It is in the above background the Central Trade Unions, JCM National Council staff-side, Confederation of Central Govt. Employees & Workers and Postal JCA has decided to organise following agitational programmes.
1. As a part of nation-wide agitation by all Central Trade Unions including BMS, INTUC, HMS, AITUC, CITU etc. has decided to organise Parliament March on 5th December, 2014 to protest against the anti-people, anti-labour policies of the NDA Government. In the march they will declare future struggle programmes.

2. All the organisations in the JCM National Council (Staff side) including Railways, Defence and Confederation has decided to organise a National Convention on 11th December, 2014 to decide future course of action for realisation of the legitimate demands of the Central Government employees.

3. Postal JCA comprising NFPE, FNPO, AIPEU-GDS (NFPE) and NUGDS has decided to organise a massive Parliament March of 20000 Postal& RMS employees including Gramin Dak Sevaks and Casual, Part-Time, Contingent employees on 4th December, 2014 demanding settlement of 39 point charter of demands. PJCA has decided to go for indefinite strike.

NFPE calls upon the entirety of five lakhs Postal employees to participate in all the above programmes and make it a grand success. Let us pledge that we shall continue our struggle till success.

Dear Colleagues,

National Council (Staff Side) JCM for Central Government employees demanded and submitted a memorandum on Interim Relief and Merger of DA to the 7th CPC and also to the Ministry of Fiance. A reply has been received by the Secretary (Staff Side) National Council (JCM) from Ministry of Finance which is indicative of a refusal of both the demands. Accordingly, it was decided to hold a NATIONAL CONVENTION, eliciting the participation of the representatives of all Service organisations participating in the JCM to discuss the emerging situation and decide upon future course of action. Incidentally, we must mention that the JCM conceived as a negotiating forum has been made in-effective by the Government over the years by not convening its meetings periodically.

It was decided that the National Council Convention will be held at

Venue : MPCU Shah Auditorium, Sree Gujarati Samaj, Raj Niwas Road, Civil lines (Opposite Civil lines Metro Station), Delhi
Date : 11th December, 2014 from 12 noon to 1600 hrs.

150 Delegates from Defence Federations (INDWF and AIDEF) are permitted to participate.

Around 75 Delegates from INDWF have to participate and therefore all the Office Bearers and Working Committee members are invited to participate in the convention. Those who are participating are required to intimate to the undersigned so that the Delegate Passes/Badges on their names will be arranged to participate in the convention.

Treat this as an important matter which will decide the issues of 7th CPC (merger of DA and IR) as well as present trend of the New Government on the future of Central Government Employees particulars about Defence Civilian Employees.
