ORDER
Ministry of Railways (Railway Board) have decided to constitute a Committee for evolving a new formula for Productivity Linked Bonus on Indian Railways. The Committee will consist of the following :-

i) Additional Member (Staff), Railway Board - Convener
ii) Additional Member (Budget), Railway Board - Member
iii) Additional Member (Civil Engineering), Railway Board - Member
iv) Additional Member (Mechanical Engineering), Railway Board - Member
v) Additional Member (Commercial), Railway Board - Member

2. The Terms of reference of the Committee will be as under :
"To evolve a new formula for calculation of number of Productivity Linked Bonus days keeping in view the recommendations of the Sixth Central Pay Commission and the views of the Ministry of Finance."

3. The Headquarter of the Committee will be at New Delhi.

4. The Committee shall submit its report within a period of four months from the date of its Constitution.

5. The Convener and Members of the Committee will be eligible to draw TA/DA, as per extant rules.

HQrs vide Letter of even no dated 9/12/2013 had called for the information regarding number of individuals coming under the category of “Non Gazetted” drawing Grade Pay of Rs.4600 and above for consideration of extension of benefit of brief cases/hand bags to Non Gazetted staff also drawing Grade Pay of Rs 4600 and above. The matter is one of the Agenda points to be discussed in JCM Meeting.

2. However, even after subsequent reminders on 15/01/2014 and 10/02/2014, requisite information has not been furnished by some Controllers which has been viewed very seriously. A copy of all previous references are again being forwarded for necessary action.

3. It is requested to expedite the same by return fax Latest by 4.04.2014 for consolidational HQrs. alongwith the reasons for the delay.

OFFICE MEMORANDUM

Subject: – Payment of DA to the CDA pattern employees of 69 CPSEs governed by HPPC recommendations.

The undersigned is directed to refer to Para No. 2 and Annexure-III to this Department’s O.M. dated 14.10.2008 wherein the rates of DA payable to the employees who are following CDA pattern pay scales had been indicated.

2. The DA payable to the employees may be enhanced from existing rate 90% to 100% with effect from 01.01.2014.

3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.

4. These rates are applicable in the case of CDA employees whose pay have been revised with effect from 01.01.2006 as per DPE O.M. dated 14.10.2008.

5. All administrative Ministries/Department of Government of India are requested to bring the foregoing to the notice of the Central Public Sector Enterprises under their administrative control for action at their end.

Projected DA From May 2014 -PROJECTED D.A. FROM MAY, 2014 By Sri pannvalan

The AICPI-IW (1960=100) for January, 2014 was 237 and for February, 2014, the index stood at 238.
As per the present trend in retail inflation, the index may remain unchanged at 238 for March, 2014 too. If it happens, the D.A. will fall to 97.05%, from the existing level of 99.90%.

Even if the index records a modest rise of 1 point and touches 239 for March, 2014, yet there will be a downfall and the revised D.A. will be only 97.35%.

When the central government employees are getting D.A. of 100% on their Basic Pay, Grade Pay and Transport Allowance effective 01-01-2014, it is regrettable that our D.A. that is already below this 100% mark has started its downward journey (D.A of Central government employees will be at 100% till 30-06-2014 and our new D.A. from May, 2014 will be in force till 31-08-2014).

For retaining the D.A. at the present level of 99.90%, the index must increase by 10 points in March, 2014 (touching 248 points), registering an inflation of 4.20% in one month (i.e.50.40% annualized), which is ruled out.

D.A. of bank staff was merged at 2836 points in 1960=100 series, when 9th BPS was implemented from 01-11-2007.  Despite merger of D.A. at a higher level (2836 points) than the central government staff (2642 points), the Dearness Allowance of bank staff is less than that of Central Government staff, because of faulty construction of pay scales and lesser D.A. compensation per slab for the bank staff.

Moreover, if the central government employees get 50% of their present D.A. merged with their Basic Pay, as an interim measure, the difference will widen further. I shudder to think of the situation after the 7th CPC is fully implemented.

Will UFBU wake up at least now?

The Dearness Allowance from July-2014 as DA/DR from January, 2014 is to be paid to employees/pensioner.  Release of additional installment of DA/DR effected from January, 2014 today approved by govt. and will be paid from Salary/Pension of March, 2014 means arrear and increased DA will be paid in April, 2014.  On the other hand All India Consumer Price Index Number [http://labourbureau.nic.in/indtab.html] for Industrial Workers (CPI-IW) on base 2001=100 for the month of January, 2014 declined by 2 points and pegged at 237 (two hundred and thirty seven).  AICPI Number declined by 6 points in two months and this tendency is showing 4-5 percent increase in future DA/DR.  April or May AICPIN will give confirm picture of expected DA/DR from July, 2014.  Expectation of DA/DR for July, 2014 may understood with table is given below:-

The Supreme Court Monday held that "one rank one pension must be the norm in respect of a Constitutional Office" of judges and allowed the plea of former judges of high courts and apex court drawn from the Bar that their retirement benefits should be matched with those elevated from subordinate courts.
The apex court delivered the judgement in this regard on the petitions filed by former judges of the higher judiciary alleging discrimination as the years served by them at Bar as advocates are not considered in grant of pension while those elevated from subordinate courts get the benefit of their service duration.


A three-judge bench headed by Chief Justice P Sathasivam said such classification was not only "unreasonable" and "adversely affects the image of the Judiciary" but also comes in the way of quality of justice as capable lawyers do not show inclination towards Judgeship.

"When persons holding constitutional office retire from service, making discrimination in the fixation of their pensions depending upon the source from which they were appointed is in breach of Articles 14 and 16(1) of the Constitution. One rank one pension must be the norm in respect of a Constitutional Office," the bench, also comprising justices Ranjan Gogoi and N V Ramana said.

It further said "When a Civil Servant retires from service, the family pension is fixed at a higher rate whereas in the case of Judges of the High Court, it is fixed at a lower rate. No discrimination can be made in the matter of payment of family pension".

The bench said there should not be any discrimination with regard to the fixation of their pension irrespective of the source from where Judges are drawn and they must be paid the same pension just as they have been paid same salaries and allowances and perks as serving Judges.

"Only practicing Advocates who have attained eminence are invited to accept Judgeship of the High Court. Because of the status of the office of High Court Judge, the responsibilities and duties attached to the office, hardly any advocate of distinction declines the offer.

"Though it may be a great financial sacrifice to a successful lawyer to accept Judgeship, it is the desire to serve the society and the high prestige attached to the office and the respect the office commands that propel a successful lawyer to accept Judgeship," the bench observed.

In continuation of separate sanction orders of CBDT vide F.No. HRD/CM/102/3/2009 - 10/11/0167 dated le July 2013 for creation of posts in the IRS and grades other than the IRS, and in supercession of all earlier orders regarding distribution of posts in various CCA Regions, posts in various grades in the Income Tax Department are hereby allocated to various cadre controlling Regions, as per Annexure 1.

Subject:- Submission of quarterly returns in respect of the Recruitment Rules - regarding.

Attention is invited to Para No. 5.5 of this Department's O.M. No. AB.14017/48/2010-Estt.(RR) dated 31st December, 2010 wherein it has been stipulated that Quarterly returns in respect of the recruitment rules for service should be sent in time to the Department of Personnel & Training and the Union Public Service Commission (for Group 'A' & 'B' posts) to enable them to keep a watch on the progress made in finalizing the recruitment rules.


2. It is observed that Ministries/Departments are not sending quarterly returns to this department or UPSC. Therefore, UPSC has requested this Department to collect the information from the Ministries/Departments about the posts which are required to be filled up in consultation with the Commission, but are being filled in a different manner.

3. Ministries/Departments are, therefore, requested to send the status of Recruitment Rules for all Group 'A' and 'B' posts to DoP&T and UPSC as on 31.12.2013 by 30.4.2014 and on quarterly basis. It is also requested to send the details of the posts that are required to be filled in consultation with UPSC but are being filled in different manner so that the information can be submitted to the Commission. The quarterly report may be submitted in the enclosed proforma.
