Kind attention of Railway Board is invited to Federation's PNM Agenda Item No. 15/2017, proposing grant of 3rd financial upgradation under MACP Scheme to the Station Masters entered in GP 2800 which got merged with GP 4200 / Level-6 w.e.f. 01/01/2016 vide Railway Board's instructions dated 02/08/2016 (RBE No. 93/2016), pursuant to acceptance of 7th CPC recommendation. Federation is however disappointed that the Railway Board has not yet considered for granting GP 5400 / Level-9 as financial upgradation to those Station Masters who have completed 30 years of service.

Federation has however learnt that the Railway Board vide letter No. PC-V/2009/ACP/5/CR dated 11/12/2017 has issued a clarification to the General Manager (P), Central Railway stating that the upgradation of ASM in GP 2800 to the post of SM in GP 4200 has to be counted as promotion for the
purpose of MACPS and therefore the GP 4200 (now Pay Level-6) cannot be treated as entry Grade. This clarification of the Railway Board is totally unjustified due to the fact that the said decision violates policy instructions as mentioned below:-
  • The Railway Board have cited Item No. 31 of Board's letter No. PC-V/99/I/1/1 dated,19/02/2002 to deny the benefit. The Federation on going through the contents of Item No. 31 of Board's letter dated, 19/02/2002 found following provision.
"Where all the posts are placed in a higher scale of pay, with or without a change in the designation; without requirement of any new qualification for holding the post in the higher grade, not specified in the Recruitment Rules for the existing post, and without involving any change in responsibilities and duties, then placement of all the incumbents against such upgraded posts is not be treated as promotion/upgradation".
Since the upgradation of ASMs GP 2800 to GP 4200 as SM has been done as a result of acceptance of 7th CPC recommendation by the Government with slight change in the designation but without change in the qualification and any change in responsibilities and duties, therefore, the placement of all such incumbents against the upgraded posts cannot be treated as promotion / upgradation.
  • Federation fur1her desires to clarify that the later part of the conditions mentioned against Item No.31 are not at all relevant to the case of Station Master category.
  • Further in Board's letter dated 02/08/2016 (93/2016), it has clearly been mentioned vide Item No. 2.1 of Annexure 'B' that in the case of ASMs GP 2800, their Grade Pay has to be revised to Gp 4200, therefore they are to be fitted in Pay Level-6 of 7th CPC. Note at Item No. 2 clearly states that ASMs in GP 2800 should be upgraded to 4200 and then fitted in the revised pay Matrix and the designation of ASM shall stand abolished and the post of ASMs shall stand merged with the post of Station Master (GP 4200) along with functions. However, the Note further states that the revised AVC, inter-se-seniority, recruitment rules, classification as decided by the Board, will be issued through separate letters. There are no instructions to treat such upgradation as promotion particularly for those ASMs who have been recruited in GP 2800/-.
  • Federation also brings to the notice of Railway Board the condition no. 5 mentioned in Annexure to Board's letter dated 10/06/2009 (RBE No. 101/2009) which stipulates as under:-
"Promotions earned/upgradations granted under the ACP Scheme in the past to those grades which now carry the same Grade Pay due to merger of pay scales/upgradations of posts by the 6th Pay Commission shall be ignored for the purpose of granting upgradation under MACPS".

Federation further states that based on the above positions, Railway Board have issued clarification vide letter dated 10/06/2009 (RBE No. 17/2009), that on the analogy of Para 5 of the Annexure to Board's letter dated 10/06/2009, that promotions earned or upgradations granted under ACP Scheme of 01/01/1999 in the past to the four pay scales mentioned above, which now carry the Grade Pay of Rs.1800 shall be ignored for the purpose of MACPS.
Federation requests the Railway Board to kindly review the case denovo, taking into account the points raised above as also the PNM Agenda Item No. 15/2017 and grant 3rd MACP to the Station Masters in GP 5400/ Pay Level-9 on completion of 30 years service. The subject will be discussed in the ensuing PNM meeting with the Railway Board on 25th/26th April. 2019.

ii) Officers from State Government / Autonomous Bodies/ PSUs holding regular post in equivalent grade;
iii) Professional qualifications of Chartered Accountant / Cost Accountant / MBA (Finance);
OR
Having passed SAS/equivalent examination of organised Accounts Cadre of Central / State Government;
OR
Having successfully completed Cash and Accounts training conducted by ISTM;
iv) Five years experience in finance, accounts and budget related matters.
Desirable Qualifications / Experience : Knowledge of experience in work on Tally or other accounting software.

2. Period and other terms and conditions of deputation:
The initial period of deputation shall be for three years extendable by a further period of two years, as per Department of Personnel & Training O.M.No 6/8/2009-Estt. (Pay-II) dated 17.06.2010. The terms and conditions of deputation will be governed by the DOP&T's aforementioned O.M. of 17.6.2010 and Government of India's instructions issued from time to time on the subject.

Age Limit
The maximum age limit for appointment on deputation shall not exceed 56 years as on the closing date of receipt of application

Eligibility for Government Accommodation
As per the ongoing arrangement (further continuity of which is subject to approval of Ministry of Urban Development), the officers appointed in the UIDAI will be eligible for General Pool Residential Accommodation at par with Central Government employees.

3. Eligible and willing candidate may apply through proper channel in prescribed format Annexure I Cadre authorities / Head of Departments are requested to forward applications of eligible and willing candidates whose services can be spared on deputation immediately on their selection. The applications of only such officers would be considered that are routed through proper channel and are accompanied by following documents:
  1. Application in prescribed proforma - Annexure I
  2. Cadre Clearance Certificate from the Controlling Authority.
  3. Statement giving detail of Major/ Minor penalties, imposed upon the Officer, if any, during the last ten (10) years Annexure II.
  4. Vigilance Clearance / Integrity Certificate (Annexure II)
  5. Photocopies of the ACRs/APARs for the last five (5) years duly attested on each page by an officer not below the level of Under Secretary or equivalent (Annexure II).
4. While forwarding the application it may also be verified and certified by the cadre controlling authority that the particulars furnished by the applicant are correct (Annexure II).

5. The applications of suitable and eligible officers complete in all respect, in the prescribed format (Annexure-I), along with documents listed in para 3 and 4 above may be forwarded to Deputy Director (HR), Unique Identification Authority of India (UIDAI). Subject: Closing of Central Government Offices in connection with General Elections to Lok Sabha 2019 and General Election to the Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim and Bye- elections to fill the clear vacancies in Assembly Constituencies of various States - Grant of Paid Holiday - regarding

The undersigned is directed to say that in connection with the General Elections to the Lok Sabha 2019 and General Election to the Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim and Bye- elections to fill the clear vacancies in Assembly Constituencies of various States scheduled to be held in 2019, the following guidelines, already issued by DOPT vide OM No.12/14/99-JCA dated 10th October, 2001, have to be followed for closing of the Central Government Offices including Industrial Establishments in the States:-
  • The relevant offices / organizations shall remain closed on the day of poll in the notified areas where general elections to the Lok Sabha and State Legislative Assembly are scheduled to be conducted.
  • In connection with bye-election to State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organization / Industrial Establishment located outside the Constituency having a general / bye-election.

Sir/Madam,
I am directed to invite your attention to Section 135 B of the Representation of the People Act, 1951 which provides for the grant of paid holiday to the employees on the day of poll. The Section 135B is reproduced below:-

“135B. Grant of paid holiday to employees on the day of poll

(i) Every person employed in any business trade, industrial undertaking or any other establishment and entitled to vote at election to the House of the People or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday.

(ii) No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with sub-section (1) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.

(iii) If an employer contravenes the provisions of sub-section (1) or sub-section (2), then such employer shall be punishable with fine, which may extend to five hundred rupees.

(iv) This section shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which he is engaged.”

The above provisions require that all establishments and shops including those which work on shift basis shall be closed on the day of poll in the Constituency where a General/bye-election is to be held. However, there may be cases where a person is ordinarily resident of the Constituency and registered as an elector, may be serving/employed in an industrial undertaking or an establishment located outside the constituency having a general/bye-election. It is clarified that in such a situation, even those electors including casual workers working outside the constituency concerned would be entitled to the benefit of a paid holiday extended under Section 135B(1) of the Representation of the People Act, 1951.

The daily wage/causal workers are also entitled for a holiday and wages on poll day as provided in Section 135B of the R.P. Act, 1951:

The Commission desires that suitable instructions should be issued to all concerned for the phase-wise election schedules, as mentioned in the Commission’s Notifications under endorsement to the Commission for information and record.
